Propiedad intelectual, plagio y el concepto "open"

PROPIEDAD INTELECTUAL

• Wikipedia: La propiedad intelectual, según la definición de la Organización Mundial de la Propiedad Intelectual (OMPI), se refiere a toda creación de la mente humana. Los derechos de propiedad intelectual protegen los intereses de los creadores al ofrecerles prerrogativas en relación con sus creaciones. La propiedad intelectual tiene que ver con las creaciones de la mente: los inventos, las obras literarias y artísticas, los símbolos, los nombres, las imágenes y los dibujos y modelos utilizados en el comercio.

Los derechos relacionados con el derecho de autor son los derechos de los artistas intérpretes y ejecutantes sobre sus interpretaciones y ejecuciones, los derechos de los productores de fonogramas sobre sus grabaciones y los derechos de los organismos de radiodifusión sobre sus programas de radio y de televisión.

• Guidelines for handling reported cases of authors who have submitted the same manuscript to two or more publications, or who have not properly cited the reuse of their previously published work in newly submitted papers

• The guidelines recognize that it is common in technical publishing for material to be presented at various stages of its evolution. As one example, this can take the form of publishing early ideas in a workshop, more developed work in a conference, and fully developed contributions as journal or transactions paper

• Corrective actions: 1. A reminder that the practice is considered

inappropriate scholarly practice, 2. a requirement to submit an apology to the

publication editor for possible publication, and/or 3. suspension of publication in the IEEE publication

where the offense took place for one year, or, if appropriate, the next volume of the conference proceedings.

1. Indexing of open access Computer Science journal is generally weak A journal needs to be indexed so that your fellow researchers can find out about your work. Most open access journals will be indexed by Google Scholar, but other indexes are important in Computer Science such as DBLP and the ACM Digital Library. Scopus is also often used by hiring and promotion committees. (Scopus is run by Elsevier.) As I review the open access journals in Computer Science, I find that indexing is often a sore point. The next table shows that the ACM Digital Library does a poor job at indexing open access journals. In fact, I could find only two open access journals indexed by ACM. It cannot be explained by the prestige of the respective journals: some of these open access journals that ACM fails to index are just as good or better than others it indexes. And, of course, no ACM publication is open access. Quite clearly, ACM is doing little to help open access.

2. Many open access Computer Science journals require complete copyright transfer

To publish an article, a journal does not require complete copyright ownership. The only valid justification for requiring that the author gives away his copyright is to restrict access. When reviewing open access journals in Computer Science, I see that several of them inexplicably require complete copyright transfer:
