El pasado 14 de Noviembre el Senado aprobaba las enmiendas presentadas a los tres proyectos de ley que conforma la Reforma Fiscal en la que destaca la rebaja al hachazo fiscal que suponían las ganan-cias patrimoniales en la venta de propiedades. De las enmiendas aprobadas destacamos:
The Senate approved the amendments presented to the three projects of law forming the Tax Re-form.The most important modification is the one pre-sented to reduce the tax blow established in one of the texts concerning the capital gains on the sale of properties and the Inheritance and Dona-tion Tax of non residents:
Am 14. November billigte der Senat, im Rahmen eines echten Zeitfahrens, die von verschiedenen Fraktionen eingereichten Abänderungen zu den drei Entwürfen der Steuerreform.Hervorzuheben ist zweifellos die Änderung im Sin-ne einer Minimierung der steuerlichen Nachteile festgelegt in einem der Texte, welche Vermögens-gewinne erzielt durch den Verkauf von Immobilien betreffen.

1. IRPFEl mantenimiento de los coeficientes de abatimien-to para las ganancias de patrimonio derivadas de la ventas de propiedades por un precio de de hasta 400.000€. La aplicación de los coeficientes, que supondrán una rebaja fiscal, se hará efectiva por la venta de propiedades adquiridas únicamente an-tes del 31 de Diciembre de 1994 y hasta el 20 de Enero de 2006.Esta cuantía límite solo se aplicará al conjunto de la venta de bienes con independencia de que la transmisión de cada bien se produzca en periodos diferentes.
Ejemplo:- Un contribuyente vende una propiedad adquirida en 1993 por un valor de 250.000 €, el coeficiente de abatimiento se aplicará sobre este importe y todavía dispondrá de 150.000 € para la venta de otro inmueble o activo, aunque estas propiedades las venda con posterioridad al anterior.
- En el caso que un contribuyente venda una vi-vienda que fue adquirida en 1993 por un valor de 600.000 €, el coeficiente de abatimiento se apli-cará sobre los primeros 400.000 € y no tendrá disponible ningún importe para la venta de otra propiedad o activo.
1. Personal Income Tax (IRPF)Approved that the rates of reduction be maintai-ned for profits obtained in the sale of properties for a selling price up to 400.000 €. The application of the rates, that implicate a tax reduction, will be effective only for the sale of properties purchased before the 31st December 1994 and up to the 20th January 2006.This limit amount of 400.000€ will only be applied to the combined sale of assets even though the sale of each property takes place in different pe-riods of time.
Examples:- A tax payer sells for the amount of 250.000 € a property purchased in 1993. The reduction rate will be applied on the selling value and 150.000€ will still be available for the sale of another property, although the sale of the properties be carried out in different periods of time.
- In case of a tax payer selling for 600.000 € an abode purchased in 1993, the reduction rate will be applied on the first 400.000 € and no amount will be available for the sale of another property.

Einkommensteuer (IRPF)Berichtigungskoeffiziente.Schliesslich wurde die Aufrechterhaltung der Be-richtigungskoeffiziente in Bezug auf Vermögens-gewinne erzielt durch den Verkauf von Immobilien oder sonstigen Vermögenswerten bei Übertra-gungspreisen von bis zu 400.000 € genehmigt. Die Anwendung der Berichtigungskoeffiziente stellt eine Steuersenkung dar, die nur Verkäufe von Immobilien erworben vor dem 31. Dezember 1994 und bis zum 20. Januar 2006 betrifft. Der Höchstbetrag von 400.000€ wird lediglich auf die Gesamtheit der Verkäufe angewandt, una-bhängig davon, ob die Übertragung der einzelnen Immobilien im gleichen oder in verschiedenen Steuerjahren stattfindet.
Beispiele:- Ein Steuerzahler verkauft eine Immobilie erwor-ben in 1993 für einen Preis in Höhe von 250.000 €. Nach Anwendung des Berichtigungskoeffizients auf den Verkaufspreis verfügt der Steuerzahler noch über eine Spanne von 150.000 € für den Verkauf anderer Immobilien oder Vermögenswer-te, selbst wenn die Verkaufsgeschäfte in unters-chiedlichen Zeiträumen stattfinden.
- Sollte der Steuerzahler die vor 1993 erworbene Immobilie für einen Preis in Höhe von 600.000 € verkaufen, wird der Berrechtigungskoeffizient auf die ersten 400.000 € angewandt, ohne die Mögli-chkeit über den restlichen Betrag für den Verkauf einer anderen Immobilie oder Vermögenswert zu verfügen.
Aus diesem Grund und mit dem Ziel, die höchst-mögliche Steuersenkung zu erzielen, rät unsere Steuerabteilung, zuerst die ältesten Immobilien, Güter oder Vermögenswerte zu verkaufen.

2. NO RESIDENTESCon las enmiendas aprobadas se adecuará la Sen-tencia del Tribunal de Justicia de la Unión Europea de 3 de Septiembre, por la que se consideraba el impuesto de Sucesiones y Donaciones español dis-criminatorio para los no residentes, a la normativa de la Unión Europea en los siguientes supuestos:
- En caso de adquisición de bienes por herencia o sucesión y cuando el causante hubiera sido re-sidente en un Comunidad Autónoma, los contri-buyentes no residentes, residentes en un Estado miembro de la Unión Europea o del Espacio Eco-nómico Europeo (EEE), podrán acogerse a las ven-tajas fiscales autonómicas ya que se les aplicará la normativa de la Comunidad Autónoma, y no la Estatal, del causante.
- Ocurrirá lo mismo en caso de adquisición de bie-nes inmuebles situados en España por donación a título gratuito e “intervivos”, los contribuyentes no residentes tendrán derecho a tributar siguiendo la normativa de la Comunidad Autónoma donde se ubiquen los referidos bienes.
2. Payment of the NON RESIDENTSThe Sentence of the European Union Court of Jus-tice on the 3rd September, in which the Spanish Inheritance and Donation Tax is considered as discriminatory for non residents, will adapt to the sentence of the European Union Court of Justice in the following cases:
- In case of acquisition of assets through inheri-tance and when the deceased has been Resident in the Autonomous Region, the Non Resident tax payers, resident in a member State of the EU or the Economic European Area, may take advantage of the autonomous tax advantages as they will be applied the regulation corresponding to the Auto-nomous Region and not the National State, of the deceased.
- The same will occur in the acquisition of pro-perties located in Spain through donation without charge and “living” as the non resident tax payers will also have the right to pay tax following the regulation of the Autonomous Region, where the mentioned assets are situated.
2. Besteuerung von NICHT-RESIDENTENWie wir schon in unserem Blog berichteten, ge-mäss dem Urteil des Gerichtshofes der Europäis-chen Gemeinschaft (EuGH) vom 3. September hat die spanische Erbschafts- und Schenkungssteuer eine diskriminierende Wirkung auf Nicht-Residen-te Bürger. Die neulich gebilligten Abänderungen werden die Anpassung der Steuervorschriften an das Urteil des EuGH in folgenden Fällen bewirken:
- Beim Erwerb von Vermögen und Rechten durch Erbschaft oder Schenkung, sofern der Erblasser in einer autonomen Region (Comunidad Autónoma) wohnhaft gewesen ist, werden Nicht-Residente Steuerzahler die in einem anderen Staat der EG bzw. des Europäischen Wirtschaftsraums (EU plus Norwegen, Island und Liechtenstein) residieren re-chtmässig von den steuerlichen Vorteilen der au-tonomen Region profitieren können, da sowohl sie als auch der Erblasser den regionalen, und nicht den staatlichen Steuervorschriften unterliegen.
- Das gleiche gilt für Fälle bei denen Immobi-lien in Spanien aufgrund einer unentgeltlichen Schenkung "inter vivos" erworben werden. Nicht-Residente Steuerzahler sind in diesem Fall eben-falls berechtigt gemäss den Steuervorschriften der autonomen Region, in dem die vererbte Immobilie gelegen ist, besteuert zu werden.
