ACT

To authorize certain unauthorised expenditure; to charge the Provincial Revenue Fund

with certain unauthorised expenditure; and to provide for matters connected 'therewith.

BE IT ENACTED by the Limpopo Provincial Legislature, as follows: -

1. Authorisation of unauthorised expenditure 2005/2006, 2006/2007, 2007/2008,

2008/2009 financial years

(1) The Limpopo Provincial Legislature authorised unauthorised expenditure in the amount of

R852, 340, 000.00 for the 2005/2006, 2006/2007, 2007/2008, 2008/2009 financial years.

(2) The Provincial Revenue Fund is charged with the amount of R748, 492, 000.00 to

authorise certain unauthorised expenditure for the 2005/2006, 2006/2007, 2007/2008,

2008/2009 financial years as set out in Schedule 1.

(3) The expenditure referred to in subsection (2) is fully described in the 2005/2006,

2006/2007, 2007/2008, 2008/2009 reports of the Auditor-General and is a direct charge

against the Provincial Revenue Fund.

(4) The expenditure referred to in Schedule 2 form a direct charge against funds allocated to

the relevant Departments in the next financial year.

2. Action of recovery of unauthorised expenditure

Nothing in this Act may in any way be construed as affecting any action to recover

unauthorised expenditure.

3. Short title

This Act is called the Limpopo Unauthorised Expenditure Act, 2012.

WET

Om ongemagtigde uitgawes te magtig; om die Provinsiale inkomstefondste betas met sommige ongemagtigde uitgawes; en om voorsiening te maakvir aangeleenthede wat daarmee verband hou.

WORD DAAR DERHALWE deur die Provinsiale Wetgewer van Limpopo asvolg bepaal:-

Magtiging van ongemagtigde uitgawes vir die finansiele jaar 2005/2006 , 2006/2007, 2007/2008 en 2008/2009.

(1) Die Limpopo Provinsiale Wetgewer magtig ongemagtidge uitgawes tot diebedrag van R852,340,000,00 vir die finansiele jaar 2005/2006 ,

2006/2007, 2007/2008 en 2008/2009.

(2) Die Provinsiale Inkomstefonds word belas met die bedrag van R748,492,000.00 om sekere ongemagtigde uitgawes te magtig vir die finansiele jaar2005 / 2006, 2006/ 2007, 2007 /2008 en 2008 / 2009 soos uiteengesit inSkedule 1.

(3) Die uitgawes verwys na in subartikel (2) word volledig omskryf in die2005 / 2006, 2006/ 2007, 2007 /2008 en 2008 / 2009 verslae van dieOuditeur-generaal en is 'n direkte koste teen die ProvinsialeInkomstefonds.

(4) Die uitgawes verwys na in Skedule 2 is 'n direkte koste teen dietoegewysde fondse van die relevante Departemente in diedaaropvolgende finansiele jaar.

2. Ingrypings vir die verhaling van ongemagtigde uitgawes

Geen aspek in hierdie Wet wat strydig is met enige poging in die verhalingvan ongemagtigde uitgawes mag op enige wyse verklaar word nie.

1. Ukugunyazwa kweendleko ezingakagunyazwa zomnyaka weemali ka-2005/2006, ka-

2006/2007, ka-2007/2008, ka-2008/2009

(1) IsiBethamthetho sePhrovinsi yeLimpopo sigunyaze iindleko ezingakagunyazwa ezilinani

elima-R852, 340, 000.00 zomnyaka weemali ka-2005/2006, ka-2006/2007, ka-

2007/2008, ka-2008/2009.

(2) isiKhwama seNgeniso yePhrovinsi sinikelwe inani elima-R748, 492, 000.00 ukugunyaza

ezinye iindleko ezingakagunyazwa zomnyaka weemali ka-2005/2006, ka-2006/2007, ka-

2007/2008, ka-2008/2009 njengombana kuhlathululwe kuTjhejuli 1.
