NATIONAL POLICY ON URBAN STREET VENDOR-2004

SCHEME OF MCD FOR SQUATTERS / HAWKERS - 2007

The Corporation vide Resolution No: 377 dated 2510.2004 approved theadoption of National Policy on Urban Street Vendor-2004 introduced by theMinistry of Urban Development &c Poverty Alleviation, Govt. of India, Theimplementation of the same was under consideration before the Hon'ble

Supreme Court of India in a PIL titled " Gainda Ram V/s MCD & others" WP(C)No. "1699 of 1987 and in IA No. 394 in lA No. 365 titled "Sudhir Madan & Ors VsMCD & Ors". After considering numerous affidavits filed by the MCD on

.13/1/2006, 7/4/2006, 1/5/2006, 11/9/2006, 20/3/2007 and considering diecontents of decision delivered in Maharastra Ekta Hawkers Union & Another VsMunicipal Corporation, Great Mumbai, and others (2004) 1 SCC, 625, the Hon'ble

Supreme Court of India has been pleased to deliver the judgments on 6/2/2007& 17/5/2007.

The Scheme of the MCD for implementation of National Policy on UrbanStreet Vendors-2004 as modified by the orders of the Hon'ble Supreme Court of

' India, are elaborated hereunder :-

1.Ward V^nding Committees constituted in 134 Wards of MCD, are tobe re-constituted in the wake of creation of more Wards i.e. 272 in all,which will be responsible for identifying sites, declaring hawing andnon-hawing / squatting and non-squatting zones in consultation withvarious stake holders like ; Vendors / Traders' Associations, RWAs,Traffic Police, Delhi Fire Service, DMRC (where Metro Stations fall inthe jurisdiction of that Ward) etc. by adopting the norms explained inthe coming paras.

2.Zonal Vending Committees have been constituted in all the 12 Zones .of MCD whose responsibility will be to approve and review thehawking /non-hawking and squatting./ non-squatting zones and thesites identified by the Ward Vending Committee and to make changeswherever required. Such identification will not be permanent butsubject to change depending on the exigencies of the situation.

. Allotment will be made to eligible venders and squatters by this^^

Committee, which shall also take policy decisions in respect bfregulation for venders in their respective zones. For resolution of alldisputes between allottees and MCD,. the Zonal Vending Committeeshall be presided over by a Judicial Officer not below the rank o^Addl.

Distt. Judge., In case the matter is not sorted out by this Committee thedispute will be placed before the Appellate Committee to be presidedover by a retired Judge of High Court consisting of other members i.e.Chairman Adhoc Licensing Committee, MCD, Addl. Commissioner

Incharge pf CL&EC, CLO, Dy. Commissioner of the concerned zone &

ADC/AC (CL&EC) and decision of the Appellate Committee shall befinal.

3.The total Vending sites shall not exceed 2.5% of the total population ofthat particular Ward / Zone which will be based on Census 2001.However, the number of sites, which may become necessary should bebased upon the current Census figures as and when available.A deduction of existing tehbazari / vending/hawing sites shall,however, be made t^fe

4.The tehbazari/ vending sites will remain the MCD's property. Thesesites will be non-transferable, except in the case of death or permanent'insanity of an allottee, in which case the legal heir will be substitutedin his place in accordance with the norms. This will further be subject

to the condition that the legal heir (s) who is allotted the sites in theplace of the deceased/ insane allottee shall carry on tehbazari /vending activity himself and shall not permit any one else to carry onthe business on his behalf. In case there are more than one legalrepresentative, the allotment can be made in favour of one or more

(jointly).

5.Change of hands, sale, transfer and rental of tehbazari / Vending sitesshall not be allowed and they shall be required to be evicted adoptingdue process of law.

6.Tehbazari / Vending site shall measure 6' X 4' and will be covered by astandard design in such a manner as to identify and demarcate thearea available for tehbazari and with a view to afford protectionagainst the elements such as; Sun, Cold and Rain to the allottee (s) andtheir goods lying within the allotted sites. The expense on this accountshall be borne by the allottee. On the proposals from the Zones, site-wise standard designs will be provided by the Chief Architect of MCDalongwith designs for moving carts, auto-rickshaw three-wheelers andfour wheelers.

7.The Squatter / Vendor will pay one time registration fee of Rs.1000/-for the squatting / vending site in addition to monthly tehbazaricharges as approved by the MCD in consultation with the ZonalVending Committee of the concerned zone or a Ward VendingCommittee of the concerned Ward. The registration fee as well ascharges are subject to change as and when required by the MCD.

8.The registration will be continuous and an ongoing process.

9.Priority in Allotment of Tehbazari / Vending Sites will be determinedin the following manner :

(i) Those, already allotted under earlier schemes would be re-allotted the same sites wherever possible. In case such personshave already paid registration charges under old schemes, thesame may be waived. These persons would be given newidentity cards and registration numbers under the new scheme.

(ii) Approximately 578 cases waiting for allotment, found underGainda Ram Scheme by the Chopra Committee.

(iii) Cases rejected by the Chopra Committee for non-furnishing ofrequired documents and due to minor reasons and casespending in different courts but are covered under the Scheme.

(iv) Approx. 11000 applications for allotment of PCO.booths/Tehbazari to handicapped persons and widows^ thewidows of deceased MCD employees (through DMC Widows &Dependant Welfare Society) and war widows for which a quotahas been reserved to the extent of 15%. Women will be allottedsites adjacent to each other in a block for selling items, whichprimarily interest the women.

(v) General urban poor people by inviti^g fresh applicationsespecially those who are already engaged in the activities ofsquatting / hawking.

10.Specially designed three-wheeler auto/ Cycle rickshaw will beallowed to sell the wares / eatables having attached dustbins. Credit

will be arranged through Banks/ NGO's engaged in the welfare ofVendor Institutions and to also provide social security & insurancecover by creating Self- Help Welfare Boards. They shall also have topay registration fee and Vending / Tehbazari charges in addition to

Road Tax etc.

11.The Squatting sites shall be leaving atleast 5 ft. space on footpath fromthe edge of the road as an undisturbed passage for the free movementof pedestrians along the walls of offices, medical & educationalinstitutions (excluding the school gates), courts, police stations outsidethe parks (atleast 10 ft. away from the gates), bus-stands and bus-queue-shelters.

12.The nature of goods/ items of daily needs/ service will only beallowed, which are as per. the needs & requirements of that particulararea, but cooking of any food item shall not be permitted at all.Cooked food properly packed shall however, be allowed to be sold bythe allottees, which should not be adulterated or un-hygienic. HealthDepartment will issue licences and the provisions of Prevention of

Food Adulteration Act. will be complied with. The places, which are

visited by public at large throughout the day & night such as: Railwaystations. Bus-stands, Hospitals1 etc. provision may be made for sale offood items / beverages through duly established outlets, shops &restaurants, however, where such facilities are not available thehawker / venders may serve tea/ coffee, cold-drink & food itemsincluding packed cooked food items, provided it does not result indisposal of any wastage and the beverage is served in disposableglasses / cups for which adequate arrangements shall have to be madeby the allottee.

13.Obnoxious, hazardous, polluting items and electronic items will not be. allowed to be sold.

14.The existing PCO booths will be allowed to switchover to other tradesas the PCOs have become outdated due to inception of mobile phones/ cordless phones.

15.The timings of fixed squatting / vending sites will depend on theweather conditions and other relevant considerations like; consultationwith RWAs and other stake holders.

16.A centralized database of the registrations will be maintained and fulldetails like name, address, photograph etc. alongwith three locationsin fiie order of preference of the applicant will form part of thedatabase. The information will be accessible at all Zones to avoidduplicacy. -A Public Notice inviting applications from squatters /hawkers, who are unauthorisedly squatting / hawking in MCD'sjurisdiction and from un-employed persons, who are desiring to maketheir livelihood by squatting / vending in accordance with theeligibility conditions, will be advertised by the Central Licensing &Enforcement Cell, MCD in leading newspapers and shall also bedisplayed on MCD's website www.mcdonline.gov.in, which will bedownloaded by the applicants and filled up forms will be submitted inrespective zonal offices of MCD, where the applicant is residing.

l^MlIf the Legislature intervenes and frames another scheme or regulations^

governing such schemes, that will certainly supersede the schemes

prepared by the MCD.

The complaint in respect of encroachment especially by taxi-stands

will be lodged by the MCD with the District Magistrate of the areaconcerned and SHO of the Police Station wider which the taxi-stand falls,

shall take appropriate action within one week. The GNCTD has beengiven liberty to exercise its power to denotify the taxi-stand concerned in

case of persistent defiance and breaches.

The zonal vending committee will provide the list of squatting/ non-squatting areas and hawing/non-hawing area alongwith the list anddetails of allotted site/ tehbazari holders to the SHO concerned, who will

ensure requisite action and strict compliance of Hon'ble Supreme CourtOrder. The Police authorities will provide aid to the MCD as & whenrequired for proper implementation of the schemes propounded by theMCD and any laches on the part of the police will be viewed seriously bythe Hon'ble Supreme Court of India as amounting to a breach of an orderpassed by the Hon'ble Court. Removal of unauthorized street vendorswill be the primary responsibility of the SHO of the Police Station

concerned..

POLICY RELATING TO WEEKLY BAZAARS :

Weekly Bazaars 227 in number at present are being held in Delhi andengaged in traditional style of retail shopping are quite popular especially

.among the lower and middle income groups. These bazaars are held at sites like;

footpaths, side-roads, sub-lanes, service markets, commercial centers and onopen spaces, specific locations & timing operation of such bazaars will bespecified and regulated by the RWAs and other stake holders of Ward / Zonal

Vending Committee.The following norms will be followed for allowing Weekly Bazaars . /

festivals / Melas etc.

(i) The bazaars will be held only once a week in an area, which must bethe day on which the markets in the area observe a weekly closure

under the Shops & Establishments Act. .(ii) No Weekly Bazaars will be held on a day which is not a closed day for

the market of the area keeping in view that no road is blocked and

access to any of the premises on the road is not affected. Open spacesavailable, excluding the parks, will be utilized for such bazaarswithout causing undue inconvenience to the residents of the locality.

(iii) Traffic congestion will be avoided and wherever there is heavy traffic,such bazaars will be removed therefrom and settled in a more spacious

area.(iv) The concept of natural market will be given a due regard like e.g.weekly book bazaar in DaryaGanj, which is providing an opportunity

to have avid readers to purchase books at low cost.(v) Weekly Bazaar site will not be more than 6'X4' open to sky.(vi) A fee of Rs.10/- per day per site will be charged from all the weekly

bazaars in addition to one time registration fee of Rs.1000/-, by theZonal Licensing Office under the management of Ward / ZonalVending Committee and middleman should not be involved in such

collection. The fees are subject to change, in future.(vii) Irrespective of the title of land / street / road/ area, which may belong

to any other land owning agency, the overall control on Weekly Bazaar

ELIGIBILITY CONDITIONS :J O

While the pending applications shall be taken up for disposal by the Zones, fresh

applications shall be invited simultaneously on prescribed proforma andallotments will be made by preference explained in the policy and allotmentswill be made by draw of lots if the number of applications surpasses the numberof available squatting / vending sites. For considering the eligibility, some of the

conditions will be as follows :-

A.Person, who are already engaged in tehbazari / vending activities butwere not considered due to one reason or the other will be consideredfor allotment. Such applicants will submit proof like; festival receipt /token, challan, traffic police challan or any receipt of fine or fees,certificate of a registered RWA or Market Associations, Membership ofan NGO engaged in the welfare of like-wise people.

B.The person should be resident of an area under the jurisdiction ofMCD for the last 5 years on the date of application, having proof like;Ration Card, Election I-Card or any other Govt. document.

C.Persons, who need to carry on tehbazari / vending in order to earn alivelihood, his financial standing will be taken into account and onlythe needy will be considered. An affidavit to this effect, sworn before

an SDM or MM will be submitted.D.The age should not be less than 18 years on the date of application.

Proof will be submitted and in case cf non-availability, the same willbe declared in the affidavit mentioned at serial No. 'C above.

E.The charges of electricity, water and scavenging, if any will be borne

by the allottee.F.The applicant or his dependant family member should not be

employed or should not have any other tehbazari / vending or any

other business premises in Delhi.G.Loud noise or any other public nuisance will not be created for

attracting customer.H. In case the allotted site is required by any agency in the larger public

interest, the hawking / squatting site shall be transferred to some other

; smtabVe place as per the av^ilability / feasibility.I. In^ase of violations of any of the terms & conditions of. allotment, the

(viii) Different timings will be fixed for Summer &: Winter months but carewill be taken to ensure that Weekly Bazaars do not continue tofunction after 10.00 P.M., such timings will be determined by eachZonal Vending Committee.

(ix) Vendors will not be allowed to sell expensive and electronic items and

will not throw garbage etc. on public places. Sale of cut fruits, juiceand sugarcane juice will not be permitted. No cooking of any typeshall be allowed except packed eatable items under hygienicconditions to be maintained by Health / Food AdulterationDepartment officials.

(x) The vendor will sell the wares / goods by sitting on the footpath /platform and by keeping steel / wooden table or plank.

(xi) Transfer / mutation of such sites will be controlled by the normsapplicable for regular squatters / vendors.

Note: Merely fling of application does not guarantee for allotment of ^CO.Booth/Vending / Hawking/Squatting site/place, on tehbazari basis.
