Neni 1

Qëllimi

Qëllimi i kësaj rregulloreje është caktimi i

niveleve maksimale për kontaminues të

CHAPTER I

GENERAL PROVISIONS

Article 1

Scope

The scope of this regulation is laring down

GLAVA I

OPŠTE ODREDBE

Član 1

Cilj

Cilj ovog uredba je da utvrdi maksimalne

nivoe određenih kontaminanata u

Neni 2

Fushëveprimi

Dispozitat e kësaj rregulloreje zbatohen

nga prodhuesit, përpunuesit dhe

importuesit e ushqimit, lëndës së parë për

ushqim për njerëz dhe kafshë, dhe

ushqimit për kafshë.

Neni 3

Përkufizimet

1.Shprehjet e përdorura në këte rregullore

kanë këtë kuptim:

1.1.“Kontaminues”- nënkupton

materien kimike, biologjike,

radiologjike dhe fizike e dëmshme për

shëndetin e njerëzve, e cila nuk është e

dedikuar për shtesat në ushqim, ndërsa

prezenca e të cilave në ushqim është si

pasojë e procedurave gjatë prodhimit,

përpunimit, pergatitjes, trajtimit,

paketimit, transportit, deponimit të atij

ushqimi ose si pasojë e ndotjes së

ambientit.

1.2.“Niveli Maksimal”- nënkupton

nivelin më të lartë të përmbajtjes së

kontaminuesve dhe substancave të

padëshiruara të cilët gjinden në

contaminants in foodstuffs and undesirable

Article 2

Field of activity

Provisions of this regulation shall be

implemented by producers, processors and

importers of food ,raw material for food and

feed and animal feed.

Article 3

Definitions

1.Terms used in this regulation shall mean:

1.1.“Contaminant”-shall mean

chemical, biological, radiological, and

physical matter harmful to human

health whiuch is not intended to be used

as food additive ,whereas the presence

of which in food is as aresult of the

process of production, processing,

preparation ,treatment, packaging,

transport and storage of such food or as

result of enivroinment pollution.

1.2.”Maximum level“-shall mean the

maximum level of the content of

contaminants and undesirable

substances in foodstuffs ,animal feed,

prehrambenim proizvodima za ljudsku

ishranu i zabranjenih supstanci u hrani za

životinje, radi zaštite javnog zdravlja .

Član 2

Delokrug

Odredbe ovg uredba primjenjuju

proizvođači, prerađivači i uvoznici hrane,

prehrambenih sirovina i hrane za ljude i

životinje, i hranu za životinje .

Član 3

Definicije

1.Izrazi korišćeni u ovom uredba imaju

sledeće značenje :

1.1."Kontaminant " – znači

hemijsku, biološku, radiološku i

materiju fizički štetnu za zdravlje

ljudi, koja nije planirana za upotrebu

kao dodatak ishrani, i čije je prisustvo

u hrani posledica postupaka tokom

proizvodnje, prerade , pripreme,

rukovanja, pakovanja , prevoza ili

skladištenja takve hrane nastalo kao

posledica zagađenja okoline .

1.2."Maksimalan nivo" – znači

najviši nivo sadržaja kontaminananta i

nepoželjnih supstanci koje se nalaze u

hrani za ljude, u hrani za stoku,

1.3.“Substancë e padëshirueshme “ -

nënkupton secilën substancë apo

produkt me përjashtim të agjenteve

patogjen, i cili është i pranishem në

/dhe/apo produkt i cili është i dedikuar

për ushqim të kafshëve dhe i cili

paraqet rrezik potencial për shëndetin e

kafshës apo njeriut apo ambientit, apo

munde të ketë ndikim të dëmshem në

prodhimin blegtoral.

1.4.“Materiali i ushqimit për kafshë

“ – nënkupton produktet e ndryshme

me origjinë bimore apo shtazore në

gjendjen e tyre natyrale, të freskëta apo

të konservuara dhe produktet e fituara

nga përpunimi industrial i tyre si

substanca organike dhe inorganike me

ose pa aditiv të cilat dedikohen për

përdorim të drejtepërdrejt oral si dhe

për përgatitjen e përbersve të

produkteve ushqimore për kafshë apo

si substrate për paraperizerje.

1.5.“Përbërësit e produkteve

ushqimore për kafshë”– nënkuptojnë

përzierjet e materialeve të ushqimeve

për kafshë të cilat përmbajnë sasi të

larta të subctacave të caktuara të cilat

për arsye të përberjes se tyre janë të

raw material for food and feed .

1.3.“Unbdesirable substances” –shall

mean any substance or product except

pathogenic agents which is present

in/and/or product intended nfor animal

feed and which prtesents potentional

risk to human health ,animal health or

environment or it may have harmful

effect in livestock production.

1.4.“Feed Materials “-shall mean

various products of vegetable or animal

origin in their natural state ,fresh or

preserved and products derived from the

indiustrioal processing thereof and

organic and inorganic substances

,whether or not containing additives

,which are intended for use in oral

animal feeding either directly as such or

after the processing ,in the preparation

of compound feeding stuffs or as

substrates for premixtures.

1.5.“Compound feedingstuffs” –shall

mean mixtures of feedingstuffs which

have a high content of certain

substances and which by reason of their

composition ,are sufficient for a daily

ration only if used in combination with

životinja ili životnu sredinu, ili može

imati štetan uticaj na stočarsku

proizvodnju .

1.4."Materijal hrane za životinje" -

znači različite proizvode biljnog ili

životinjskog porekla u izvornom

obliku , sveže ili konzervisane i

proizvode dobijene obradom njihovih

industrijskih organskih i neorganskih

supstanci , sa ili bez aditiva , koji su

namenjeni za direktno korišćenje per

os (oralno), kao i za pripremu

proizvoda za ishranu životinja ili kao

substrat za premikse.

1.5."Sastojci prehrambenih

proizvoda za životinje" - znači

mešavine materija za ishranu životinja

koje sadrže velike količine određenih

materija koje su, zbog svog sastava,

dovoljne za dnevni obrok , samo kada

mjaftueshme për racione ditore, vetëm

atëherë kur përdoren të kombinuara me

materiale tjera ushqyese.

1.6.“Artikuj ushqimor plotësues për

kafshë”- nënkupton përzierjet e

produkteve ushqimore të kafshëve të

cilat kanë përmbajtje të lartë të

substancave të caktuara dhe të cilat për

arsye të përbërjes së tyre janë të

mjaftueshme për një racion ditor

vëtem nëse janë përdorur në

kombinim më artikuj të tjerë ushqimor

për kafshë.

1.7.”Ushqim i kompletuar për

kafshë– nënkupton përzierjet e

produkteve ushqimore për kafshë të

cilat për arsye të përbërjes së tyre janë

të mjaftueshëm si racion ditor.

1.8.“Autoriteti kompetent” :

nënkupton Agjencinë e Ushqimit dhe

Veterinarisë.

KAPITULLI II

KONTAMINUESIT NË USHQIM PËR

NJERËZ

Neni 4

Produktet ushqimore të listuara në Shtojcën

I të kësaj rregulloreje nuk lejohen të

other feedingstuffs.

1.6.“Complementary feedingstuffs”-

shall mean mixtures of feedingstuffs

which have a high content of certain

substances and which by reason of their

composition ,are sufficient for a daily

ration only if used in combination with

other feedingstuffs.

1.7.“Complete feedingstuffs”-shall

mean mixtures of feedingstuffs which

by rason of their composition ,are

sufficient for a daily ration.

1.8.“The competent authority”-shall

mean The Fopod and Veterinary

Agency.

CHAPTER II

CONTAMINANTS IN FOODSTUFFS

Article 4

The foodstuffs listed in the Annex I of this

regulation shall not be placed on the market

znači mešavinu prehrambenih

proizvoda za životinje koji sadrže

visoke nivoe određenih supstanci i

koja je, zbog svog sastava dovoljna za

kombinaciji sa drugim prehrambenim

artiklima za životinje.

1.7.‘’Kompletna hrana za životinje’’

- je smeša prehrambenih proizvoda za

životinje koja je zbog svog sastava

dovoljna kao dnevni obrok .

1.8." Nadležan organ" – je agencija

za hranu i veterinarstvo .

GLAVA II

KONTAMINANTI U HRANI ZA

LJUDE

Član 4

Prehrambeni proizvodi navedeni u dodatku

I. ove uredbe nisu dozvoljeni za plasman

shtojcën I të kësaj rregulloreje.

Neni 5

Nivelet maksimale të specifikuara në

shtojcen I të kësaj rregulloreje do të

zbatohen për pjesët e ngrënshme të

produkteve ushqimore, nëse nuk

specifikohet ndryshe në shtojcë.

Neni 6

Produkti ushqimor i tharë , holluar,

përpunuar dhe i përbërë

1.Kur zbatohen nivelet maksimale të

vendosura në shtojcën I të kësaj

rregulloreje për produktet ushqimore që

janë të thara, të holluara, të përpunuara ose

të përbërë me më shumë se një përbërës, do

të merren në konsideratë si më poshtë :

1.1 ndryshimet në përqëndrimin e

kontaminuesit të shkaktuar nga

procesi i tharrjes ose i hollimit;

1.2 . ndryshimet në përqëndrimin e

kontaminuesit të shkaktuar nga

përpunimi;

1.3 raportet përkatëse të përbërësve në

produkt ;

1.4 . kufiri analitik i përcaktimit të

sasisë.

where they contain a contaminant listed in

the Annex I at a level exceeding the

maximum level set out in the Annex I of

this regulation

Article 5

The maximum levels speicified in Annex I

of this regulation shall apply to the eddible

part of the foodstuffs concerned ,unless

otherwise specified in the Annex .

Article 6

Dried, diluted, processed and compound

foodstuffs

1.When applying the maximum levels set

out in the Annex I to foodstuffs which are

dried,diluted,processed ,or composed of

more than one ingredient ,the following

shall be taken into account:

1.1changes of the concentration of the

contaminant caused by drying or

dillution process.

1.2.Changes of the concentration of the

contaminant caused by processing.

1.3. The relative proportions of the

ingredients in the product.

1.4.Analytical limit of quantification.

nivou koji prelazi maksimalan nivo

utvrđen u dodatku I. Ovog pravilnika .

Član 5

Maksimalni nivoi navedeni u dodatku I.

ove Uredbe važe za jestivi deo

prehrambenih proizvoda, osim ako u

dodatku nije drugačije navedeno.

Član 6

Suvi, razređeni, prerađeni i složeni

prehrambeni proizvodi

1 . Kada se primjenjuju maksimalni nivoi

iz dodatka I. Ov0g pravilnika za

prehrambene proizvode koji se suše,

razređuju, prerađuju ili se sastoje od više

od jedne komponente , u obzir će se uzeti

sledeće:

1.1 . Promene u koncentraciji

kontaminanata uzrokovane procesom

sušenja ili razređivanja;

1.2 . Promene u koncentraciji

kontaminananta uzrokovane preradom;

1.3 . srodan odnos sastojaka u

proizvodu;

1.4.analitička granica određivanja

količine.

2.Faktorët specifik të përqëndrimit ose

hollimit për proceset e tharrjes, hollimit ,

përpunimit dhe/ose përzierjes për artikuj

ushqimor të tharrë, të holluar, të përpunuar

dhe/ose të përbërë, duhët të sigurohen dhe

të arsyetohen nga operatori i biznesit

ushqimor, kur kryhet një kontroll zyrtar .

3.Nëse operatori i biznesit ushqimor nuk

siguron dëshmi të mjaftueshme për faktorin

e koncentrimit apo hollimit apo nëse

autoriteti kompetent mendon se ai faktor

nuk është ai i duhuri, atëherë autoriteti

kompetent vet do të përcaktoj atë faktor

duke u bazuar në informatat e disponueshme

dhe me qëllim të mbrojtjes maksimale të

shëndetit.

Neni 7

Ndalimet në përdorim, përzierje dhe

detoksifikim

1.Produktet ushqimore, që nuk përputhen

me nivelet maksimale të vendosura në

shtojcën I të kësaj rregulloreje nuk lejohen

të përdoren si përbërës ushqimor.

2.Produktet ushqimore, që përputhen me

nivelet maksimale të vendosura në

shtojcën I të kësaj rregulloreje nuk lejohen

të përzihen me produktet ushqimore, të

factors for the drying, dilution,processing

and/or mixing operations concerned or for

the dried ,diluted,processed and/or

compound foodstuffs concerned shall be

provided and justified by the food business

operator ,when the competent authority

carris out an official control.

3.If the food business operator does not

provide neccessary concentration or dilution

factor or if the competent authority deems

that factor inappropriate in view of the

justification given ,the authorit shall itself

define that factor, based on the available

information and with the objective of

maximum protection of human health.

Article 7

Prohibition on use, mixing and

detoxification

1.Foodstuffs not complying with the

maximum l;evels set out in the Annex I

ofthis regulation shall not be used a food

ingredients.

2.Foodstuffs complying with the maximum

levels aet out in the Annex I shall not be

mixed with foodstuffs which exeeds these

maximum levels.

2. Posebni faktori koncentracije ili

razblažavanja u procesu razređivanja,

razređivanje, prerada i / ili radnja mešanja

koji se tiču ili sušenja, razređivanja,

prerade i / ili složene hrane za stoku ,

obezbeđuju se i pravdaju od strane

operatera u poslovanju s hranom , kada

nadležan organ sprovede službenu kontroll.

3.Ukoliko operater u poslovanju s hranom

ne obezbedi dovoljno dokaza za faktor

koncentracije ili razređivanja, ili ako

nadležan organ smatra da faktor nije

odgovarajući, sam nadležan organ mora da

utvrdi taj faktor, na osnovu dostupnih

informacija i sa ciljem da maksimalno

zaštiti ljudsko zdravlje.

Član 7

Zabrana upotrebe, mešanja i

detoksikacije

1.Prehrambeni proizvodi koja nisu u

skladu sa najvišim nivoima utvrđenim u

dodatku I. ove uredbe ne smeju se koristiti

za upotrebu kao prehrambeni sastojak .

2.Prehrambeni proizvodi, u skladu sa

najvećim dozvoljenim nivoima navedenim

u dodatku I. ove uredbe ne smeju se mešati

sa prehrambenim proizvodima koji

cilat tejkalojnë këto nivele maksimale.

3.Produktet ushqimore, të dedikuara për

ndarje ose trajtime tjera fizike për të

reduktuar nivelet e kontaminimit nuk

duhet të përzihen me artikuj ushqimor, që

janë për konsum të drejtëpërdrejt njerëzor

apo me produkte të përcaktuara të jenë për

përdorim si përbërës ushqimor.

4.Produktet ushqimore, që përmbajnë

kontaminues të listuar në pjesën 2 të

shtojcës I të kësaj rregulloreje nuk duhet

të detoksifikohen me anë të trajtimeve

kimike.

Neni 8

Dispozitat e veçanta për kikirikët , farat

tjera vajore, fruta arrore, fruta të thata,

oriz dhe misër

1.Kikirikët, farat tjera vajore, fruta arrore,

fruta të thata, orizi dhe misri, që nuk

përputhen me nivelet maksimale të

përshtatshme të aflatoksineve të dhëna në

pikat 2.15,2.1.6,2.1.7,2.1.8,2.1.10, dhe

2.1.11 të shtojcës I të kësaj rregulloreje,

mund të vendosen në treg kur sigurohet që:

1.1.Nuk janë për konsum të

drejtepërdrejt njerëzor ose përdoren

si përbërës në produkte ushqimore;

1.2 Përputhen me nivelet maksimale

të dhëna në pikat

3.Foodstuffs to be subjected top sorting or

other physical treatment to reduce

contamination levels shall not be mixed

with foodstuffs intyended for direct human

consumption or with foodstuffs intended for

use as a food ingredient.

4.Foodstuffs containing contaminants listed

in the section 2 of annex I shall not be

delioberately detoxified by chemical

treatments.

Article 8

Specific provisions for groundnuts, nuts,

dried fruit and maize

1.Groundnuts ,nuts ,dried fruits and maize

not complying with the approprioate

maximum levels of aflatoxins laid down in

points 2.15,2.1.6,2.1.7,2.1.8,2.1.10, and

2.1.11 of Annex I can be placed on the

market provided that these foodstuffs:

1.1.are not intended for direct human

consumption or use as ingredient in

foodstuffs;

1.2. comply with the appropriate

4.Prehrambeni proizvodi koji sadrži

kontaminante navedene u delu 2. dodatka

I. ove uredbe ne smeju se detoksificirati

hemijskim tretmanima .

Član 8

Posebne odredbe za kikiriki, ostale

uljarice,orašasto voće, sušeno voće,

pirinač i kukuruz

1 . Kikiriki , ostale uljarice , orašasto voće,

sušeno voće , pirinač i kukuruz , koji nisu

u skladu sa odgovarajućim podacima o

maksimalnim nivoima aflatoksina u

tačkama 2.15, 2.16, 2.1.7, 2.1.8, 2.1.10 i

2.1.11 dodatka I. ove uredbe mogu se

plasirati na tržište pod uslovom da:

1.1 . Nisu za neposrednu ljudsku

potrošnju ili se koriste kao sastojak u

prehrambenim proizvodima;

1.2. su u skladu sa podacima o

2.1.1,2.1.2,2.1.3,2.1.4,2.1.9 dhe

2.1.12 të shtojcës I të kësaj

1.3. Janë objekt trajtimi, duke

përfshirë ndarjen ose trajtime

fizike, pas këtij trajtimi, nivelet

maksimale të deklaruara në pikat

2.1.5, 2.1.6, 2.1.7, 2.1.8, 2.1.10

dhe 2.1.11 të Shtojcës I të kësaj

rregulloreje nuk tejkalohen dhe

ky trajtim nuk rezulton në

mbetje të tjera të dëmshme .

1.4. Etiketohen në mënyrë të qartë

duke treguar përdorimin e tyre

dhe mbajn shenjën “ produkti

duhet të jëtë objekt për ndarje

apo trajtime tjera fizike për të

reduktuar kontaminimin me

aflatoksinë para konsumit për

njerëz ose përdorimit si

përbërës në produktet ushqimore“.

2.Shenja duhët të përfshihet në etiketën e

çdo ambalazhi individual ose në

dokumentin origjinal shoqërues. Kodi i

identifikimit të ngarkesës / paketës duhet të

jetë që nuk fshihet në çdo ambalazh

individual të ngarkesës dhe në dokumentin

origjinal shoqërues .

1.3. are subjected to a treatment

Involving sorting or other

physical treatment and that

after the treatment the

points 2.1.5, 2.1.6, 2.1.7, 2.1.8,

Neni 9

Dispozitat e veçanta për kikirikë, farat

tjera vajore, produktet e tyre të

derivuara dhe drithërat

1.Një shenjë e qartë për përdorimin e

caktuar duhet të vendoset në etiketën e çdo

ambalazhi individual ose në dokumentin

origjinal shoqërues. Dokumenti origjinal

shoqërues duhet të ketë lidhëshmëri të qartë

me ngarkesën me anë të vendosjes në të, të

kodit të identifikimit të ngarkesës, i cili

ndodhet në çdo ambalazh individual të

ngarkesës . Veç kësaj, informacionet e

dhëna në dokumentin shoqërues lidhur me

ngarkesën duhet të jenë kompatibile me

qëllimin e përdorimit.

2.Në mungesë të një përcaktimi të qartë, që

përdorimi i tyre i paracaktuar nuk është për

konsum njerëzor, nivelet maksimale në

pikat 2.15 dhe 2.1.11 të shtojcës I të kësaj

rregulloreje duhet të zbatohen tek të gjith

kikirikët,farat tjera vajore, produktet e tyre

të derivuara dhe drithërat e vendosur në

treg.

3.Në lidhje me përjashtimin e kikirikëve

dhe farave tjera vajore për shtrydhje (

prodhim vaji) dhe aplikimit të niveleve

maksimale të përcaktuara në pikën 2.1.1 të

shtojcës I të kësaj rregulloreje, përjashtimi

zbatohet vetëm për ngarkesat të cilat janë

etiketuar qartë duke treguar përdorimin e

1.A clear indication of the intended use

1.Jasna oznaka za namenjenu upotrebu

mora da je vidljiva na etiketi svake

pojedinačne ambalaže ili u dokumentu

koji prati izvorni. Ovaj propratni

dokument mora da ima jasnu vezu sa

pošiljkom na način takav da se pominje

kod koji se nalazi na svakoj kesi, kutiji i dr.

Osim toga, informacije sadržane u

propratnom dokumentu o pošiljci moraju

biti u skladu sa namenom .

2.U odsustvu jasnih oznaka da njihova

develop researches for identification of the

source of undesirable substances in case of

the exceeding of maximum levels.

specific decisions.

Entry into force

This regulation enter into force seven (7)

days after the signature by the Prime
