RE: TO SUPPLY AND INSTALL STRUCTURAL STEEL WORKS INCLUDINGRAILS FOR CRANES

LETTER OF AWARD AND ACCEPTANCE

With reference tu your quotation and subsequent discussions for the above mentionedand are pleased to award for To supply and installation of structural steel works andrail for cranes to your Company subject to the following trems and conditions.

1.0 Sub-Contract Amount

1.1 The accepted Sub-Contract Amount for abouve-mentioned work is RinggitMalaysia Nineteen Million And Five Hundred Thousand Only (RM19,500,000.00) derived as Appendix A.

1.2 This is based upon your final quotation submission dated 13th March 2012 with afinal discount of RM1,081,550.00.

1.3 The Contract Documents for the Work shall include but not limited to the following: - The contents of this letter. - Your quotation dated 13th March 2012.

1.4 Contract Drawings The architectural Drawing and Structural Drawing provided hereof shall be the Contract Drawings.

Notwithstanding the drawing referred to above, you agree that the Sub-Contract Amount and your rates in the Schedule of Rates shall be inclusive of all ancillary and other word and expenditure, whether separately or specifically mentioned or described in the Contract Document or not, which are either indispensably necessary to carry out and bring to completion the work described in the Contract Documents as a whole.

You have confirmed that the Contred Drawings are sufficiens to enable you to prepare and fabricate your work for construction.

2.0 Scope of Works

2.1 The Scope of Works shall include the supply of all labor, materials and machinery for the structural steel work includeing the crane rail for all the buildings necessary for the completion of the abovementioned subcontract work, all in strict accordance with the Specifications and as indicated on the consultant’s drawing.

2.2 You are deemed to have allowed for everything necessary for completing the work whether any item described is taken individually or collectively.

2.3 You shall be deemed to be familiar with the site working conditions, access and egress and all other restrictions on site. Certain area of works may be required to be carried after other trades have completed their work an site and you are deemed to have allowed for in your rates.

2.4 You are required to liaise with the relevant Authorities prior to you commencement of the work, if required.

2.5 You are required to provide coordination or work together with other subcontractors to ensure that the work are carried out in accordance with the drawings, specifications etc.

3.0 Sub Contract Duration

3.1 TheDate of Commencement shall be an 25th May 2012 and the completion date shall be an 25th August 2012. In any case, the duration and Completion date shall not exceed those as indicated in our programmed.

3.2 Time is of the essence in this contract. You may be required to work overtime as and when necessary and this shall be demmed to be included in your rates. You are also to comply with the Local Authorities requirements on overtime work and obtained the necessary permission.

3.3 The Defects Liability Period shall be Twelve (24) months from the date of issuance of Certificate of Practical Completion by the Architect.

3.4 You shall be charged Liquidated and Ascertained Damages (L.A.D) at the rate of RM39,000.00 per day (Max.) in the event the completion date is exceeded: or in the case of time extension being granted under the trem and conditions of the Contract, the extended date of completion is exceeded.

4.0 Sub Contractor’s Obligation

4.1 You are demmed to have fully understood the scope of work involved and shall undertake to perform all work at your best endeavor under this subcontract including the provisions for the following:-

a) To provide all necessary equipment, tools, skilled labours for the completion of the said work. b) To provide sufficient security for your own tools and equipment. c) You are to provide and ensure your workers wear proper PPE before entering the side. Any worker caught of not wearing safety gears shall be liable of fine RM 50.00 per each time, deductible directly from you’re your account. Repetition of the act will result in the worker being expelled from the site permanently. d) You are to responsible for taking delivery, unloading and storing your own materials at your site storage, provided by yourself at your own cost and at the designated area approved by the Main Contractor or any person appointed as the main Contractor’s representative. e) You are to provide two or more full time Foremen, who preferably be able to communicate in English with our site staff, on site f) To clear and remove from site all debris resulting from your work including paying for any charges for dumping ground at an interval period or anytime instructed by the Main Contractor or the Main Contractor’s Representative. g) To be responsible for making good all work disturbed to the satisfaction of the Main Contractor or any person appointed as the Main Contractor’s representative

h) To minimize all noise and dust at all time

5.0 Working Hours

5.1 The Sub-Contractor shall provide for working at night on Sundays and Public holidays as necessary (subject to the written instruction of theArchitect/Employer). When working outside normal working hours the Sub-Contractor shall make adequate security arrangement and indemnify the MainContractor against any claims by third parties resulting there from. No claimsfor extra remuneration on account of working outside shall be entertained.

5.2 The normal working hours for this contract are as following:-(i) Monday to Sunday - 8.00 a.m to 6.00 p.m.

6.0 Program

6.1 You are required to carry the work according to our Master Work Program

6.2 Notwithstanding the above, we reserved the right to vary the work program tosuite progress required on site and you are deemed to have allowed suchdisruptions, overtime and re-sequencing etc in your pricing.
