Canadian Recommendations – UPR 17 23 October 2013

Mexico Question: In 2009, Mexico agreed to promote the domestic implementation of its international human rights commitments through the adoption of effective mechanisms at all levels of government and consultation with stakeholder groups. Could the Mexican Delegation inform us on what measures have been taken to ensure domestic compliance with its international obligations, including consultations with stakeholders, and what impact these have had on the protection of human rights in practice? Recommendations: Canada recommends that Mexico:

1. Undertake all necessary measures to ensure that Article 57 of the Code of Military Justice conforms with the Mexican constitution.

2. Take measures to ensure the effective and timely implementation of the constitutionally mandated judicial reforms and police professionalization by providing integrated training and capacity building to stakeholders involved in the delivery of justice, including judges, prosecutors, lawyers, police and criminal investigators.

3. Establish effective protections for civil society and journalists, includingthe prompt and efficient investigation and prosecution of all threats and attacks made against these individuals.

Observations: We welcome the concrete steps taken by Mexico to address poverty and promote social development and urge sustained policy and programming efforts to address ongoing marginalization, particularly in Indigenous communities. We also note reports that violence and serious crimes against women and girls have intensified. We encourage the government to strengthen measures to prevent violence against women and to thoroughly investigate and prosecute such crimes.

权项目，与联合国人权机制积极合作，接待多个特别机制访

问。

中方愿在此向墨西哥提出两项建议：

一、建议墨西哥在落实国家发展规划过程中继续将消除

贫困作为优先事项，为全体人民享受人权打下更加坚实的物

质基础。

二、建议墨西哥继续推动消除歧视的立法与行动，加强

对妇女、儿童、土著人等弱势群体权益的保护。

Recommendations from Denmark to Mexico

Mr. President,

Denmark sincerely thanks the delegation of Mexico for their comprehensive presentation.

We commend Mexico for the constitutional reform of the criminal justice system, which was passed in 2008. However, we are concerned that delay in the implementation of this reform increases the risk of human rights violations. In the traditional criminal justice system of Mexico serious problems remain, such as impunity and effective access to justice in the form of free and fair trials. Denmark therefore recommends that the reform of the criminal justice system is fully implemented in all Mexican states as soon as possible. Mexico has commendably accepted a number of UPR recommendations to combat gender based violence. Nevertheless, there has been very limited progress when it comes to impunity of transgressors, nor has there been a reduction in the high levels of violence. Some sexual offense laws are contingent on the life style of the victim and this is not in compliance with international standards. Denmark therefore recommends that concrete measures are taken to prevent and punish violence against women in Mexico’s 31 states, particularly those with high reporting of killings and attacks of women and girls.

Universal Periodic Review of MEXICO, 23 October 2013 Intervention by delegation of Estonia

Estonia warmly welcomes the delegation of Mexicoto its UPR. We positively note the achievements ofMexico since itsfirst UPR in promoting gender equality, the rights of women, children, and persons with disabilities. We encourage the Government to continuethesestepsand further widen the protection of the rights of indigenous peoples.

Estonia notesthe efforts of Mexico regarding the rights to freedom of expression, assembly and association.We are proud that Mexico is our partner in theFreedom Online Coalition.

Weacknowledge Mexico’sendeavours incrime fighting and security operations. At the same time,we encourage the Government to ensure that all allegations of human rights abuses by the security forces are investigated in a timely and impartial manner, and that theperpetrators are brought to justice. We furtherrefer to preventing excessive use of force and the need to continue pursuing the abolition of preventive custody - “arraigo”.

Estonia would like to recommend to the Government of Mexico the following:

1. to continue the fight against impunity, especially regarding violence against women, children, human rights defenders, journalists and all other vulnerable groups;

2. to accedeto Additional Protocol II of the 1949 Geneva Conventions; 3. Estonia welcomes Mexico’s cooperation with the ICC and recommends it to fully

align its national legislation with the obligations arising from the Rome Statute.

Estonia wishes Mexico every success in the UPR and in implementing these measures. Thank you!

Statement by Hungary on Mexico, UPR Session 17, 23 October 2013

Mr. President,

Hungary warmly welcomes the distinguished delegation from Mexico to this UPR and thanks the Government for its strong engagement with the UPR process as demonstrated by its mid-term review report. Hungary commends Mexico for the important amendments to its Constitution in 2011 reflecting its commitment to prevent and investigate human rights violations and ensure accountability and redress for such violations. My delegation also welcomes the new law strengthening the remedy of Amparo as a tool for the protection of human rights and the recently promulgated National Development Plan which provides for an ambitious programme to reduce poverty and hunger in the country.

My delegation takes positive note of the Government’s efforts to reaffirm the prohibition of torture, to ensure that torture allegations are properly investigated and to raise awareness among law enforcement officials of the obligation to uphold human rights. We encourage the Government to continue its good work in this area and recommend that it follows up on the recommendations of the CAT by ensuring that the definition of torture under all federal and state legislation is fully aligned with international and regional standards and by providing for the inadmissibility in court proceedings of evidence obtained under torture. Also, could the delegation elaborate on whether the proposed amendment to article 16 of the Constitution will fully eliminate the preventive custodial arrangement of arraigo?

Mr President,

My delegation welcomes the increased focus of the Mexican Government on ensuring freedom of expression and their efforts to address risks faced by human rights defenders and journalists, in particular through the creation in 2012 of the Human Rights Defenders and Journalists Protection Mechanism. We recommend that Mexico ensures full financial and political support for the Mechanism, including by allocating to it the necessary resources as well as well trained and qualified staff. We further recommend that Mexico seek the guidance of special procedures in further enhancing the safety of all human rights defenders in the country by inviting the Special Rapporteur on Human Rights Defenders to visit the country.

UNIVERSAL PERIODIC REVIEW (UPR) WORKING GROUP SEVENTEENTH SESSION

UPR OF MEXICO - INTERACTIVE DIALOGUE

INTERVENTION BY INDIA Mr. President,

My delegation welcomes the delegation of Mexico led by Dr. José Antonio Meade Kuribreña, Honorable Minister of Foreign Affairs, Mexico, and thanks it for its National Report and presentation made today. We commend Mexico for the candid acknowledgement of the many human rights challenges being faced by it.

2. The legislative, institutional and policy reforms undertaken by the Government of Mexico since its first UPR amply reflect its commitment to the promotion and protection of the human rights of its citizens.

3. We welcome broad-ranging reforms undertaken by the Mexican Government and, the National Development Plan for 2013–2018, which sets out goals for achieving Mexico’s full potential as an inclusive and pluralistic society.

4. We take positive note of comprehensive constitutional amendments giving constitutional status to human rights enshrined in international Human Rights treaties, to which Mexico is a Party.

5. We commend Mexico’s efforts to reduce poverty and hunger by strengthening existing poverty alleviation programmes. We recommend that Mexico focuses on marginalised groups or disadvantaged sections of society. Of particular relevance would be measures to improve health and education.

6. Concerns have been expressed on the independent functioning of the National Human Rights Institutions. In this regard, we recommend that Mexico considers appropriate steps to ensure that the National Human Rights Commission functions in an independent and impartial manner.

UPR 17 - Mexico Statement by Ireland

Thank you, Mr. President. Ireland welcomes the delegation of Mexico and thanks it for its report and presentation. We welcome improvements in the legislative and human rights framework since Mexico’s last review, particularly the granting of constitutional status to all human rights guaranteed in international treaties to which Mexico is a party. We also welcome the adoption last year of the Human Rights Defenders and Journalists Protection Act. However, reports of continuing murders, attacks and threats to the safety of journalists and women human rights defenders show that significant challenges remain. Ireland recommends that Mexico develops an investigation protocol with gender and ethnicity perspectives that can be used by the offices of the Attorneys General of the States in all cases where women human rights defenders report threats or attacks. While we welcome the enactment of the Missing or Disappeared Persons Registry Act and the General Law on Victims, we note that enforced disappearances, especially of women, girls and migrants, continue to occur. Ireland asks what practical impact these measures have had on the number of cases investigated and resolved, and whether further improvements could be made? Ireland recommends that Mexico implements the outstanding recommendations contained in the December 2011 report of the Working Group on Enforced or Involuntary Disappearances. We further encourage Mexico to ensure the continued implementation of the 2011 Migrants Act to protect migrants and those who work to promote their human rights. I thank you, Mr. President.

Thank you Mr. President.

Republic of Macedonia welcomes the Delegation of Mexico and presentation of their national report, today.

We acknowledge the efforts that Government of Mexico is making in order to further promote and protect Human Rights by implementing international standards at the national level.

In particular, we note with appreciation the undertakings in regard of protection of the rights of the child and the fight against abuse of child labour, as well as the national reforms in the field of combating trafficking of persons and the Protection and Assistance of Victims.

Republic of Macedonia commends the reforms in the legal system and the implementation of the Amparo procedure in the access to justice. Since, the constitutional amendments have been made recently we would like to ask about the practical effects, so far.

We would appreciate if the Delegation can provide more details on Government's efforts and future measures to eradicate poverty.

Permanent Mission of Maldives to the United Nations Offices in Geneva

Check Against Delivery Thank you Madam Vice-President. The Maldives welcomes the delegation of Mexico to the 17th Session of the UPR and appreciates their active cooperation and engagement with the mechanism. We would like to make the following recommendations;

1) Ensure investigations of violence against women, and establish victim support programmes for affected women;

2) Ensure the implementation of gender equality laws, specifically the General

Act for Equality between men and women, in all 32 states. The Maldives notes positively that Mexico has made some noteworthy achievements in its promotion and protection of human rights, in particular the rights of women. The establishment of the General Act for Equality between Women and Men, and the General Act on Women’s Access to a Life Free of Violence are significant developments that can ensure the full implementation of CEDAW, of which Mexico is a party to. We would also encourage Mexico to improve measures to counter discrimination and violence against women, which is on-going, despite the adoption of the General Act on Women’s Access to a Life Free of Violence.

We commend Mexico for their active engagement, and remain impressed by the role of Mexico in the Human Rights Council. We will always look forward to working with them, in close collaboration and partnership. We wish the delegation of Mexico all the best in its review. Thank you Madam Vice-President

STATEMENT OF MAURITIUS

The Republic of Mauritius wishes to add its voice in expressing its appreciation to the delegation of State of Mexico for the comprehensive presentation made by H.E. .The Minister of Foreign Affairs of Mexico.

The Republic of Mauritius wishes to commend the Government of the State of Mexico for its steadfast commitment to the promotion and protection of human rights and its active engagement within the multilateral human rights system.

We welcome Mexico’s efforts in “Putting People First” at the centre of the Government´s actions and in putting in place a broad array of legal instruments to ensure the protection of human rights. We also note that significant energy has been leveraged to ensure that the legal framework put in place is being effectively applied.

We are also encouraged by the setting up of the active consultation mechanism initiated for engagement of the civil society, academia and human rights experts to address the interconnectedness of issues relating to poverty, economic, social, environmental and cultural rights. We also commend the cogent manner in which Mexico is dealing with the issues relating to justice and human rights and the elimination of discrimination and violence against women.

Mr President,

My delegation wishes to recommend that the State of Mexico considers intensifying its efforts for Human Rights Education across the spectrum of the Mexican establishment and organisations for a proper dissemination and implementation of the bold measures announced in its National Report.

Universal Periodic Review – Mexico

Intervention by theKingdom of theNetherlands

Mr. President,

The Kingdom of theNetherlands compliments Mexico on improvements in the

institutional and legal framework on Human Rights, in particular:

- the establishment of the Mechanism for Human Rights Defenders and

Journalists.

- establishing that cases of grave crimes against freedom of expression can

be brought into the jurisdiction of the Office of the Special Prosecutor for

Attention to Crimes against Freedom of Expression.

- the creation of the Criminal Investigation Protocol for Feminicide with a

gender perspective and the accompanying Technical Committee.

However, there are still concerns about the continuing high number of violence

against and intimidation of journalists, human rights defendersand women.

Furthermore, access to safe abortion is still insufficient,even for survivors of rape.

The Kingdom of the Netherlands therefore recommends Mexico:

1. to strengthen both the Mechanism for the Protection of Human Rights

Defendersand Journalists as well as theOffice of the Special Prosecutor for

Attention to Crimes against Freedom of Expression (FEADLE).

2. to strengthen sexual and reproductive health services to ensure that women

who qualify for legal abortion services are able to access safe, timely, quality

and free services in all Mexican states.

Statement by Norway: Thank you Mr. President, Norway welcomes the national report presented by the Mexican Delegation.

We are encouraged by the enactment of Mexico’s constitutional reform on Human Rights1, and the adoption of the new law protecting journalists and human rights defenders. However, threats and violence against this group persists and perpetrators largely go unpunished.

We recommend that Mexico ensures an effective implementation of the Protection Mechanism with properly managed funds and trained human resources and that Mexico investigates and prosecutes reported threats, attacks and disappearances.

We are further concerned about serious human rights violations against a large number of undocumented migrants that pass through Mexico each year.

We recommend that Mexico creates a database of disappeared and missing migrants,

and that all authorities cooperate to prevent and punish crimes against this group.

Norway welcomes the adoption of the new federal law on human trafficking.2 However, the law does not provide any funding for the federal human trafficking prosecutors. We recommend that Mexico increases funding for federal human trafficking prosecutors

and take steps to end the impunity for public officials complicit in human trafficking.

The protection of the rights of indigenous peoples differs greatly between states.

We recommend that Mexico ensures prior consultations with indigenous communities in accordance with the International Labor Organizations Convention No. 169, and that Mexico improves this group’s access to housing, healthcare, education and water.

SIERRA LEONE PERMANENT MISSION TO THE UNITED NATIONS

Mr. President,

My delegation would like to welcome the distinguished delegation of Mexico and congratulate the delegation on presentation of a comprehensive national report. We applaud the participatory efforts made during the compilation of the report and commend the progress made since the previous review on 10th February 2009.

Notably, we welcome the entry into force of constitutional amendments related to human rights and remedy of amparro, the Pact for Mexico signed in 2012. The People’s Health Insurance Scheme of 2012, Women Justice Centres, the Opportunities Programme and the Scholarship Project for Indigenous Students in Higher Education are commendable.

While Sierra Leone is welcomes the achievements registered by Mexico, my delegation would like to make the following recommendations:

• Expedition of the process of amending Article 57 of the Code of Military Justice to ensure that human rights violations committed by armed forces against civilians are tried in civilian courts;

• Provision of sufficient resources and capacity building for the Citizens Relations Unit to address dangers of a heavy military presence on the streets designed to curb organised crime;

• Designing and strengthening programmes to address human rights inequalities suffered by indigenous communities and afro-descendants;

• Enactment and enforcement of laws to reduce incidences of violence against women and girls.

Sierra Leone wishes Mexico success in ensuring the best human rights standard for its people.

17ème session du Groupe de Travail de l’EPU Mexique – 23 Octobre 2013

Merci Monsieur le Président,

Ma délégation souhaite la bienvenue à la délégation du Mexique et se félicite de l’intérêt que ce pays ami accorde à l’EPU et de la contribution cruciale de sa Mission à Genève aux travaux du Conseil des Droits de l’Homme.

Ma délégation salue les progrès considérables réalisés par le Mexique, en particulier les réformes constitutionnelles et la signature du Pacte pour le Mexique. La Tunisie recommande au Mexique d’œuvrer à l’incorporation rapide dans les législations fédérales et des Etats des dispositions des instruments internationaux, dont le Statut de Rome.

La Tunisie salue en particulier l’adoption de la loi relative à la protection des défenseurs des droits de l’homme et des journalistes et la création du Mécanisme de protection des défenseurs des droits de l’homme. Elle recommande au Mexique d’intensifier ses efforts visant à garantir la sécurité des défenseurs des droits de l’Homme et des journalistes et à mettre fin à toute impunité dans ce domaine.

La Tunisie recommande également au Mexique de lutter plus efficacement contre l’incitation à la discrimination raciale et la violence raciste contre les autochtones et les personnes d’ascendance africaine.

Elle l’encourage à poursuivre ses efforts visant à éradiquer les multiples formes de discrimination à l’égard des femmes vivant en milieu rural et à supprimer les obstacles à la participation des femmes à la vie politique.

La Tunisie recommande en fin au Mexique de prendre des mesures pour sensibiliser la population aux droits des personnes handicapées et garantir l’exercice effectif de leurs droits.

UPR Intervention for Mexico, 17th Session October23, 2013

The United States warmly welcomes the Honorable Secretary Jose Antonio Meadeand the Mexican delegation. We commend Mexico for demonstrating its commitment to the UPR process by accepting and implementing many of the recommendations made during its first review. The passage of the Human Rights Defenders and Journalists Protection Act in June 2012 and the creation of the national protection mechanism for those under threat due to their human rights work are significant achievements.Moreover,we acknowledge Mexico’s efforts to promote and protect the rights of persons with disabilities. We note Mexico’s efforts to combat human trafficking by passing the anti-trafficking law in 2012, which increases penalties for trafficking offenses and mandates states to bring their legislation in line with the law. However, Mexico faces numerous challenges to fully implement this legislation on the federal and state level. We welcome Mexico’s recent steps to modify the Code of Military Justice to provide more transparent adjudication of human rights cases involving members of the military. We encourage speedy adoption of implementing legislation. We recommend that Mexico:

1. Continue to improve implementation of the Human Rights Defenders and Journalists Protection Act and the national protection mechanism at the federal and state level;

2. Continue to implement the 2012 national anti-trafficking law, through efforts to investigate and prosecute trafficking offenses on the federal and state level;

3. Continue efforts to ensure transparent adjudication of members of the security forces for human rights abuses, and continue efforts to reform the civilian police.
