Seek help for debt problemsThe National Debt Media-tion Association (NDMA) isconcerned that consumersare not aware of the costs oflegal action should they de-lay seeking assistancewhen they start experienc-ing difficulties with meet-ing their monthly debt obli-gations.

An analysis of complaintsreceived by the NDMA showsthat consumers are still notapproaching their credit pro-viders the moment they startexperiencing payment diffi-culties, with the resut taht bythe time they seek help, theircase is already in the legalprocess or a court order is inplace. This makes the case diffi-

cult and expensive to resolve. For theyearendingDecember2011, inmore than 50% of cases dealtwith, the credit provider was in theprocess of executing a court order.Depending on who manages the

collection process, legal costs in-curred can include collection com-mission, interest on outstandingcosts, sheriff expenses and corre-spondence expenses.“By not acting quickly enough, it

can cost thousands of rand, whichthe consumer could have used to-wards settling outstanding debts,”says CEO of the NDMA, MagautaMphahlele. In one case a consumer who owed

R5 443 , endedup owingR12 409. Thisincluded R6 976 in legal fees thatwent to the collecting attorneys. This trend could be an indication

that the average South African con-sumer is either ignorant of theirrights and responsibilities or doesnot trust what action the credit pro-vider will take once they approachthem for assistance.Organisations such as the NDMA

are there to assist consumersthrough this difficult process andconsumers should take advantage ofthe avenues available to seek adviceand assistance. Many consumers approach the

NDMA a day or two before theirhouses or vehicles are auctioned orrepossessed, which is often too late. With credit agreements that are reg-ulated by the National Credit Act(NCA), the legalprocessusuallycom-menceswith a section 129 notice that

credit providers are obligedto issue to a consumer oncetheyareindefault forat least20 business days. If 10 busi-ness days elapsewithout theconsumer responding to thecredit provider, the creditprovider can take legal ac-tion.“While the section 129 no-

tice might seem like an in-timidating document formany consumers, it is notnecessarily the end of theworld if the consumer takesaction in respect of the op-tions provided in the letter,”says Mphahlele.Once a consumer has re-

ceived a section 129 letterthey have the option to referthat specific credit agree-ment to adebt counsellor, analternative dispute resolu-tion agent, consumer court

or Ombud with jurisdiction. The intention is that thecreditpro-

vider and the consumer resolve anydispute related to the agreement orto bring the payments up to date.Consumers must inform their

creditprovidersassoonas theyexpe-rience or think they will be experi-encing payment difficulties. If they find this process intimidat-

ing or are not sure who to approach, the NDMA will provide them withfree advice and the relevant chan-nels to follow within the credit pro-vider institutions. Consumers expe-riencing any payment difficulties orwho want to lodge a complaintagainstacreditprovideraboutadebtcounselling matter can also contactthe NDMA on 086 111 6362.
