Terms and Conditions #OKBugaboo

These Terms and Conditions apply to the legal relationship between Bugaboo International B.V., Paasheuvelweg 9, 1105 BE, Amsterdam, Netherlands (“Bugaboo”), and you as a social media -#- user. Bugaboo loves the photograph you uploaded to Twitter / Instagram relating to Bugaboo (“the Photo”) and would like to show and share it on its –digital- platforms. When showing and sharing the Photo, Bugaboo will give you the deserved credits by adding your Twitter / Instagram handle to the Photo (e.g. ‘Photo by @creatorxx’). By responding to Bugaboo’s tweet (request) with #OKBugaboo you allow Bugaboo to use the Photo and agree to the following: 1. You grant Bugaboo a royalty-free, perpetual, worldwide license to use the which you have tagged with a hashtag containing ‘bugaboo’ or any product name of Bugaboo and in relation to which you have responded to us with #OKBugaboo, in whole or part thereof, also in an edited form, for promotional and marketing purposes in any manner whatsoever, including print, broadcast and internet, without further reference and free of charge. You also allow Bugaboo to mention your Instagram / Twitter handle in relation to the Photo. 2. You hereby represent and warrant that:

You are the sole owner and author of the Photo and its copyrights;

the Photo is original and not subject to any third-party rights;

each recognizable person and/or child depicted in the Photo has granted permission (or the parent / care-taker on behalf of the child) to be portrayed as shown and that they have been informed of the use by Bugaboo;

you will not violate these Terms and Conditions or any applicable law or regulation, guideline or community standard;

the Photo contains no unsolicited or unauthorized promotion, political campaigning, advertising, or any other form of solicitation.

3. You hereby release, discharge and agree to hold Bugaboo and any person acting on Bugaboo’s behalf harmless from all claims, demands, and liabilities whatsoever in connection with the use of the Photo as described above. 4. Bugaboo reserves the right and you expressly agree that Bugaboo may use your name and/or your entry content. Use may include the Internet, such as the website of Bugaboo, its social network pages including Facebook, Twitter, Instagram, Flickr, YouTube, Pinterest etc. and all photograph, publicity, magazines, catalogues or the likes. 5. By agreeing to these Terms and Conditions, you will only be providing information to Bugaboo. Bugaboo will store your details in connection with the above mentioned use solely for the purpose of administration, unless you have given permission for additional use. 6. Bugaboo reserves the right in its sole discretion to amend the Terms and Conditions at any time and without prior notice. The Terms and Conditions have lastly been changed on 26 January, 2016.

7. If at any time one or more of the provisions of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out without affecting the remaining provisions. 8. These terms and conditions shall be governed by and construed in all respects in accordance with the laws of the Netherlands.
