Completed tenders in a sealed envelope, clearly marked: Tender No. T01/2020, must be placed in the tender box at the Matzikama Municipality on the Ground Floor, Directorate: Financial Services,

Supply Chain Management, Church Street, Vredendal by no later than 12:00 on Friday 6 March 2020. Tenders are not allowed to be placed in

the tender box after 12:00. Tenders will be opened on the same day in the Ground Floor Committee Room at 12:05. Late or unmarked tenders

will not be considered. No posted tenders or tenders per fax or e-mail will be accepted. Tender documents are available at a non-refundable deposit of R150-00 each from the Supply Chain Management Unit, Ground Floor, 37 Church Street, Vredendal. Tender documents are available on the Matzikama Municipality’s website: www.matzikamamunicipality.co.za free of charge. Tenders will be evaluated and adjudicated in terms of the Matzikama Municipality’s Immoveable Property Management Policy. Sixty points will

be awarded in respect of price and 40 points in respect of empowerment goals. Preference will be given to black people, women and people with disabilities. Only one erf/house will be awarded per tenderer. Erven/Houses will be awarded to individuals and close corporations, partnerships or other legal entities. GENERAL INFORMATION

1) Completion of this application does not mean that the Municipality has accepted your bid as purchaser.

2) Qualifying as a purchaser does not necessarily mean that the Municipality will invite you to bid every time the

Municipality puts out tenders or requests for quotations.

3) The Municipality will use the information that you fill in on this form to pre-qualify and accredit your financial

status / business entity in terms of the criteria stipulated in the application form.

4) The Municipality will treat all the information that you supply as strictly confidential.

5) The Municipality reserves the right to request additional information and / or documents regarding your answers

and / or documents in this application.

6) The Municipality reserves the right to perform an audit to confirm or verify any of the answers and / or documents

that you supply.

7) If your complete tender document is not in the tender box, situated as indicated in the notice, on the due date and

time the tender cannot be accept for consideration.

8) Please make sure that the application is duly signed, where required, before you return it to the Municipality.

9) Please make sure all required documents are included in the application before you submit it in the tender box as

stated in the applicable notice.

10) Please respond to all questions in the application as incomplete forms will not be processed. If divisions of the

tender document are not applicable (N/A) to you as the purchaser – it must be state accordingly.

11) No late, copy’s, fax or email tenders will be accepted.

12) Only fully completed original documentation, included the applicable receipt number and original receipt attached,

will be accepted.

13) Please make a copy for your own records (we do not supply copies of the completed document).

14) Kindly note that the property will be sold to use accordingly the approved zoning and the successful tenderer /

buyer will be responsible for any land use change applications and / or subdivisions, if required. This additional

the costs will include submission fees of the application to the municipality, as well as the cost of the land surveyor.

To use the erven, or portions thereof, zoned for public open spaces for church /community purposes will get

preference when the tenders are considered.

15) A successful tenderer can only qualify to buy one of these erven except if there is no interest from other tenderers

and the committee decided accordingly.

16) If the tender is successful the property will be registered only in the name indicated in the prescribed tender form

17) Properties will be sold accordingly the municipal standard conditions read together with conditions stipulated in

this document / relevant notice. Most restricted will be applicable.

18) Property will be sell as “it is” (“voetstoots”) // in the condition on the day when the successful tenderer / buyer sign

the agreement, with access to mainline basic municipal services infrastructure, where available. Prospective

tenderers must contact the Department of Infrastructure and Basic Services regarding the cost

implication for him/her to develop the property.

19) If a property listed in the attached notices due to the failure of the former buyer to adhere to the selling contract

conditions and he/she comply with last mentioned before the successful bidder in this tender process sign the

contract and pay the deposit, legal advised will be obtained and the issue will refer back to the committee for

reconsideration.

20) Residential/Church/Community erven will be sold for cash and the minimum prices consider will be the market

value price plus the “pro rata” cost to supply bulk services to the specific erf, if applicable.

21) A successful tenderer must sign the sales agreement within two (2) weeks of cognisance of decision.

22) A 40% deposit is payable upon signing of the sales agreement.

23) The outstanding price is payable by the successful tenderer on the date of registration of the property.

24) Payment of deposit and the selling price must be done direct into the bank account of the municipality as identify

in the letter of approval of tender.

25) Non payment of points 22 & 23 above, will lead to automatic cancelation of the contract.

26) It is the responsibility of the successful tenderer to submit the receipts of the deposit and selling price to the official

identify in the mentioned approval letter.

27) Date of registration must be within three (3) months from the date of signing the sales agreement.

28) A right of pre-emption, building- and right of revertion clause will be contained within the sales agreement.

28) Registration-, transfer and service connection costs must be settled by the buyer additional to the bid offer.

29) A successful tenderer must sign the agreement within two (2) weeks of cognisance of decision.

30) If the tenderer is not contact within 2 weeks of the closing date, he/she can accept that his/her tender was not

successful.

31) Canvassing members of the council members or any official in the employment of the municipality is an ethical

offence and could lead to the immediate disqualification of tenders.

32) The municipality shall not be obligated to accept any bid and will consider the tenders in terms of the

Administration of Immoveable Property Management Policy of Matzikama Municipality.

33) Bidders must be South African Citizens, 18 years or older and natural persons.

1) Voltooiing en indien van hierdie tenderdokument beteken nie dat enige regte gevestig het nie en u tender deur

die Munisipaliteit aanvaar is nie.

2) Indien u tender suksesvol is beteken dit nie dat die Munisipaliteit u elke keer gaan nooi om te tender nie wanneer

tenders of kwotasies aangevra word nie.

3) Die Munisipaliteit sal die inligting wat u in hierdie dokument verskaf gebruik om u besigheid finansiële status /

entiteit te “pre”-kwalifiseer en akkrediteer in terme van die kriteria wat in die aansoekvorm gestipuleer is.

4) Die Munisipaliteit sal al die inligting wat u verskaf as streng vertroulik ag.

5) Die Munisipaliteit behou die reg om addisionele inligting en / of dokumente met betrekking tot die antwoorde in

dokument verskaf, aan te vra.

6) Die Munisipaliteit behou die reg om ’n oudit te doen of antwoorde en / of dokumente verskaf, te verifieer.

7) Indien u volledig voltooide tenderdokument nie op die sperdatum en tyd in die tenderhouer op die posisie in

kennisgewing uitgewys, is nie, kan dit nie vir oorweging aanvaar word nie.

8) Maak asseblief seker dat u tenderdokument onderteken is, waar so in die dokument versoek word, voordat u dit

in die tenderhouer plaas.

9) Maak verder seker dat al die dokumente/bylaes soos in tenderdokument en betrokke kennisgewing versoek

word, die tenderdokument vergesel.

10) Beantwoord asseblief alle vrae in die tenderdokument, want onvolledige dokumente kan nie oorweeg word nie.

Indien die vraag in die tenderdokument nie op u van toepassing is nie, skryf asseblief in “n.v.t”.

11) Geen laat, gekopieerde, gefakste of epos tenders sal oorweeg word nie.

12) Slegs volledige,oorspronklike dokumentasie, voltooi met die toepaslike kwitansie nommer ingevoeg en

oorspronklike kwitansie aangeheg, sal aanvaar / oorweeg word.

13) Maak asseblief kopië van die tenderdokument voor u dit in die tenderhouer plaas, want kopië van die voltooide

dokument sal nie verskaf word nie.

14) Geliewe kennis te neem dat die eiendom verkoop sal word ooreenkomstig die goedgekeurde sonering daarvan en

indien die suksesvolle tenderaar/koper dit vir enigiets anders wil aanwend sal alle kostes ten opsigte van die

grondgebruikveranderingsaansoek en / of onderverdeling, indien nodig, vir die suksesvolle tenderaar wees.

Hierdie kostes sluit in die voorgeskrewe tariewe vir die indien van die betrokke aansoeke by die munisipaliteit

asook die kostes van die Landmeter. Die gebruik van vakante erwe, of gedeeltes daarvan, wat as publieke

oopruimtes gesoneer is, sal vir aanwending vir kerkdoeleindes/ gemeenskapsdoeleindes, voorkeur geniet.

15) Die suksesvolle tenderaar kan slegs kwalifiseer om een van die gelyste eiendommete koop, tensy daar nie ander

belangstelling van ander tenderaars is nie en die komitee dienooreenkomstig besluit.

16) Die verkoopooreenkoms sal gesluit word slegs in die naam van die suksesvolle tenderaar soos in die voorgeskrewe

vorm aangedui.

17) Eiendomme sal verkoop word ooreenkomstig die munisipale standaard verkoopvoorwaardes saamgelees met

voorwaardes in hierdie dokument / betrokke kennisgewing vervat. Die mees beperkende sal van toepassing

wees.

18) Die eiendomme word soos dit is (voetstoots) // in die toestand wat dit op die dag waarop die koopooreenkoms

deur die koper onderteken is, verkoop met toegang tot munisipale hooflyn minimum basiese dienste

infrastruktuur, waar beskikbaar. Voornemende tenderaars moet direk die Departement van Publieke Werke en

Basiese Dienste kontak rakende die koste-implikasie vir hom/haar om die eiendom te ontwikkel.

19) Indien ‘n eiendom gelys is omdat die voornemende koper nie aan die verkoopvoorwaardes voldoen het nie en

hy/sy voldoen aan laasgenoemde voordat die suksesvolle tenderaar in hierdie tenderproses die koopooreenkoms

geteken en deposito betaal het, sal regsadvies ingewin word en die aangeleentheid terug na die komitee vir

heroorweging, verwys word.

20) Die residensiёle/kerk/gemeenskaps erwe word kontant verkoop en die minimum verkoopprys wat oorweeg sal

word is die markverwante prys soos bepaal deur ‘n geregistreerde professionele persoon aanbeveel en deur die

raad goedgekeur plus die pro rata kostes om grootmaatdienste aan daardie spesifieke erf beskikbaar te kan stel,

indien van toepassing.

21) ’n Suksesvolle tenderaar moet die koopooreenkoms binne twee (2) weke na skriftelike kennisname van die besluit

onderteken.

22) ’n 40 % deposito is betaalbaar by ondertekening van die kontrak.

23) ’n Suksesvolle tenderaar moet die uitstaande verkoopprys op datum van registrasie van die eiendom betaalbaar.

24) Die betaling van die deposito en verkoopprys moet direk in die bankrekening van die munisipaliteit, soos in die

goedkeuringskrywe uiteengesit betaal word.

25) Indien u nie punt 22 & 23 nakom nie, sal die kontrak outomaties gekanselleer word

26) Dit is die verantwoordelikheid van die suksesvolle tenderaar om die kwitansie vir die betaling van die deposito en

verkoopprys te voorsien aan die amptenaar soos in die genoemde goedkeuring, geidentifiseer.

27) Datum van registrasie moet binne drie (3) maande na datum van ondertekening van die koopooreenkoms

geskied.

28) ’n Voorkoopsreg-, bou- en terugvalklousule sal in die koopooreenkoms vervat word.

29) Kostes soos dienste-aansluitings, registrasie- en oordragkostes, moet addisioneel tot die koopprys getender, deur

die koper vereffen word.

30) Die munisipaliteit is nie gebonde om die hoogste of enige van die tenders te aanvaar nie en om gedeeltelike

toekennings te maak wat gedoen word ooreenkomstig die bepalings van die Administrasie van Ontroerende

Eiendomsbeleid van Matzikama Munisipaliteit.

31) ‘n Suksesvolle tenderaar moet die koopooreenkoms binne 2 weke van die suksevolle kennisgewing teken.

32) Indien daar nie binne 2 weke van die sluitingsdatum met die tenderaar kontak gemaak is nie, kan

aanvaar word dat die tender nie suksesvol is nie.

33) Gunswerwing by raadslede en/of enige amptenaar in diens van die munisipaliteit, is ’n etiese oortreding

en kan meebring dat tenders onmiddellik gediskwalifiseer word.

34) Alle aansokers moet ‘n Suid Afrikaanse burger wees, 18 jaar of ouer wees en ‘n natuurlike persoon wees.

In case of any discrepancies between the English or Afrikaans version, the most restric-tive will be applicable. ….

Frequently asked questions and the answers:

1) What do I need to complete in the document? The entire document must be complete and if the section does not apply to you, it must be marked “not applicable / N/A”. Read through the entire document before you begin. The instructions are clearly stated.

2) May I tender for more than one erf and do I need to buy a complete document for each erf that I want to tender for? You may tender for more than one erf, BUT you need to complete the cover page together with “Form no T1 separately for each erf that you want to tender for. Last mentioned original completed forms must be attached to the rest of the tender document that you bought, starting with “Part 1”.

3) What is the fair market value? How much money is it worth to address your needs proportionate the value obtain from a registered professional (property valuer/bank valuer/lawyer/municipal valuation roll). Therefore only you can decide what the bid offer must be. This offer do not includes the additional amount for provision of services to the erf.

4) Form MM BC (4): Decide what your status is (A or B or C or D or E or F or G), tick the relevant box AND complete only the relevant questions link to the status you identify. The other sections must than marked N/A. Most of the church groups’ and/or community organizations status will be a “B”. Written authorization to the person who signs all the documents must be attached to the tender document.

5) Form M BC (C): If you decided to tender on an erf which was for example earmarked to be used as a business erf (see zoning column in notice) but you want to develop it as a residential erf – than this section must be completed. If not, mark it as N/A and sign it.

6) Forms MM BC (H) to MM BC (L)(2): Complete and attach documentation as requested. If you live on somebody else property – please attach a copy of the applicable municipal account together with a letter from the accountholder which confirm that you live there.

Gereelde vrae en die antwoorde:

1) Watter gedeeltes van die tender dokument moet ek voltooi? Die hele dokument moet voltooi word en indien die afdeling nie op u van toepassing is nie moet dit “nie van toepassing / n.v.t” gemerk word. Lees deur die hele dokument voordat u dit begin invul – die instruksies is duidelik uiteengesit.

2) Mag ek vir meer as een erf tender en indien wel, moet ek dan ’n afsonderlike vorm vir elke erf koop waarop ek wil tender? U mag vir meer as een erf tender, MAAR u moet vir elke erf wat u tender die dekblad tesame met die Vorm no T1 afsonderlik voltooi. Laasgenoemde oorspronklike voltooide vorms moet dan geheg word aan die res van die oorspronklike dokument wat u gekoop het, wat begin met “PART 1”.

3) Wat is die billike markwaarde? Die bedrag wat die erf vir u werd is om u behoeftes aan te spreek in verhouding tot die waarde verkry van ’n geregistreerde professionele persoon (eiendomswaardeerder, bank waardeerder, prokureur, munisipale waardasierol, ens.). Dus net u kan bepaal wat u tenderbedrag moet wees. Hierdie bedrag sluit nie in die addisionele kostes verbonde daaraan om vir dienste op die erf voorsiening te maak nie.

4) Vorm MM BC (4): Besluit wat u status is (A of B of C of D of E of F of G), merk daardie betrokke blokkie EN voltooi dan slegs die relevante vrae wat gekoppel is aan die status wat u geidentifiseer het. Die ander afdelings moet dan as n.v.t gemerk word. Meeste kerkgroepe en/of gemeenskaps-organisasies se status sal ’n “B” wees. Skriftelike magtiging aan die persoon wat die dokumente moet teken moet aan die tenderdokument geheg word.

5) Vorm M BC (C): Indien die tenderaar besluit om op ’n erf te tender wat byvoorbeeld vir ontwikkeling as ’n sake erf geoormerk is (sien soneringskolom in kennisgewing), maar u wil die erf koop om dit as ’n woonerf te ontwikkel dan moet u hierdie afdeling invul. Indien nie, merk dit net as n.v.t. en onderteken dit.

6) 5. Vorms MM BC (H) to MM BC (L)(2): Voltooi en heg dokumente soos versoek word aan. Indien u op iemand anders se erf woon, heg u steeds ’n kopie van daardie betrokke erf se munisipale rekening aan tesame met ’n skrywe van die rekeninghouer wat bevestig dat u daar woon.

PART 1 CONDITIONS OF BID

BID DOCUMENTS Bid documents are obtainable from MATZIKAMA MUNICIPALITY, Supply Chain Management Office or Directorate

Corporate Services, 37 Church Street, Vredendal, during cashier office hours (08:00 to 15:30) on payment of R150-00 (One hundred Rand) for each set of documents.

The bid document payment will not be refunded. SOUTH AFRICAN CURRENCY All deposits and payments shall be made in the currency of the Republic of South Africa (Rand).

UNIT PRICES

The Bidder shall enter a price per erf number which included only the selling price. The two pages of the tender

document marked as Form no T1 must be completed separately for each erf which is being tendered for and

the completed Forms no T1 must be attached to the other/remainder pages of the prescribed tender document

(refer to above as “set of documents”) and submitted as required in the notice.

Bidders shall exclude value added tax (VAT) in the bid price.

WITHDRAWAL OF BIDS A Bidder may, without incurring any liability, withdraw his bid provided written advice to that effect reaches the MATZIKAMA MUNICIPALITY before the expiry of the time fixed in the bid notice for receiving bids.

CHECKING OF BID DOCUMENTS The Bidder shall satisfy himself that the set of bid documents is complete. If any page has been omitted or duplicated, or if the script or anything else in the contract documents is indistinct, or if doubt exists as to the meaning of any description, or if the contract documents contain any obvious errors, the Bidder shall immediately notify the applicable manager accordingly, in writing, so that such discrepancy or indistinctness can be clarified and / or rectified, as the MATZIKAMA MUNICIPALITY or the applicable manager will not accept any responsibility or consider any claim in connection with such discrepancy or indistinctness which is not rectified during the bid period.

RECTIFICATION OF INCORRECT ENTRIES Mistakes made by the bidder with the completion of the documents shall not be erased. A line shall be drawn through the incorrect entry and the correct entry shall be written above and the correction initialed by the bidder. The use of products such as correction fluid is strictly forbidden. Failure to observe this rule will lead to the bid being disqualified.

EXPENSES DUE TO PREPARATION AND SUBMISSION OF BID DOCUMENTS The MATZIKAMA MUNICIPALITY shall not be liable for any expenses or losses incurred by the Bidder resulting from the preparation and / or submission of the bid documents.

SEALING AND MARKING OF BIDS All bids shall be submitted under sealed cover. The envelope shall be addressed to the MATZIKAMA MUNICIPALITY,

and endorsed as described in the bid notice and placed in the bid box of the MATZIKAMA MUNICIPALITY before closing date and time of bid.

Any bid which is delivered to an address other than the one stipulated in the bid notice will not be accepted.

OPENING OF BIDS The MATZIKAMA MUNICIPALITY or his mandatory representative will open the bids in public shortly after the closing

time stipulated. The name of the Bidder for each property will be announced to all Bidders present at the opening.

ANNOUNCEMENT OF BIDDED VALUES The announcement of the tender price by each bidder will not be done at the bid opening.

LATE BIDS In terms of section 22.(a)(iii) of the Municipal Supply Chain Management Policy, bids received after the closing date and

time shall not be considered and shall be returned unopened immediately. PERIOD OF VALIDITY Bids shall remain valid for a period of 120 days after the closing date of the bid.

MM BC (A) in this regard. Failure to duly complete this statement may subject the bid to prejudice or rejection. ALTERATIONS BY BIDDER (MM BC (C)), if applicable Should the Bidder desire to make any amendments or modifications to the general or special conditions of contract,

specifications, schedule of quantities or to qualify his bid in any way, he shall set out his proposals clearly in MM BC (C), or alternatively state them in a covering letter attached to his bid and referred to in the said annexure, failing which the bid will be deemed to be unqualified.

If no amendments or modifications are desired, MM BC (C) shall be marked “Nil” or N/A and signed by the bidder. GENERAL INFORMATION TO THE BIDDER (MM BC (D)) The information provided to the bidder in this Annexure is simply to assist the bidder with the completion of the various

schedules included. No bidder entries are required in this Annexure. ACCEPTANCE OR REJECTION OF BIDS The MATZIKAMA MUNICIPALITY does not bind itself to accept the lowest or any bid and reserves the right to accept

any bids or part thereof. The MATZIKAMA MUNICIPALITY also reserves the right to accept more than one bid and to allocate the bid to one, two or more individual bidders. Any Bidder taking exception to the complete specification, or a major element thereof, will result in immediate rejection of the bid.

SIGNING OF CONTRACT The successful Bidder(s) shall sign the contract agreement within 2 (two) weeks after receiving notification that his bid

has been accepted or such extended period which the MATZIKAMA MUNICIPALITY may grant. Should a Bidder withdraw his bid during the period of its validity then he shall be liable for and pay to the MATZIKAMA MUNICIPALITY all expenses incurred in calling for new bids, as well as the difference between his bid and any less favorable bid accepted.

CANVASSING AND SOLICITING The bid of any person who canvasses or solicits, or causes to be canvassed or solicited, the support of any person employed by or in the service of the Employer in favor of his bid, will not be considered. ADDITIONAL INFORMATION

Only information given formally in writing to the Bidder by Matzikama Municipality during the bid period will be regarded as binding on the Contract. Verbal information, given during the site inspection (where applicable) or at any other time prior to the award of the Contract, will not be regarded as binding on the Contract.

INDEBTEDNESS TO MATZIKAMA MUNICIPALITY

The Municipality reserves the right to disqualify any Bidder who either at the date of submission of bids or prior to the date of award of the contract is indebted to the MATZIKAMA Municipality in respect of any rental, levies, rates and/or service charges unless suitable arrangements have been made with the Director: Finance of this municipality.

PART 2

SPECIAL CONDITIONS OF CONTRACT The following special conditions of contract (SCC) shall be applicable to the bids. DEFINITIONS, INTERPRETATIONS AND GENERAL PROVISIONS

DEFINITIONS: MATZIKAMA MUNICIPALITY - MATZIKAMA MUNICIPALITY is a category B Municipality established in terms of Section 12 of the Municipal Structures

Act 1998, Act 117 of 1998.

BID SUM - “Bid sum” or the “sum named in the bid” or the “price” means the amount of the bid after adjustment in respect of; i) the correction, in accordance with the bid rules. ii) the price as entered against each property as offered by the bidder as stipulated in tender document

SETTLEMENTS OF DISPUTES Should any dispute, disagreement or claim arises between the parties (called hereafter “the dispute”) concerning this

agreement; the parties shall try to resolve the dispute by negotiation. This entails firstly that one party invites the other in writing to a meeting in an attempt to resolve the dispute within 7

(seven) days from date of written invitation. Further, if the dispute has not been resolved by such negotiations within 1 (one) month of the date of the written

invitation, the CEO’s, Managers or Directors of the one party may invite the other in writing to a meeting in an attempt to resolve the dispute within 7 (seven) days from the written invitation.

If the dispute has not been resolved by such negotiation, the parties may refer the dispute to mediation, without limiting

any party’s right. BREACH In the event of any of the parties (“the defaulting party”) committing a breach of any of the terms of this contract and

failing to remedy such breach within a period of 7 (seven) days after receipt of a written notice from another party (“the aggrieved party”) calling upon the defaulting party so to remedy, then the aggrieved party shall be entitled, at the sole discretion and without prejudice to any of its other rights in law, either to claim specific performance in terms of this contract or to cancel this agreement forthwith and without further notice, claim and recover damages from the defaulting party.

CERTIFICATE OF INDEPENDENT BID DETERMINATION

1 This Municipal Bidding Document (MBD) must form part of all bids¹ invited.

2 Section 4 (1) (b) (iii) of the Competition Act No. 89 of 1998, as amended, prohibits an agreement between, or concerted practice by, firms, or a decision by an association of firms, if it is between parties in a horizontal relationship and if it involves collusive bidding (or bid rigging).² Collusive bidding is a pe se prohibition meaning that it cannot be justified under any grounds.

3 Municipal Supply Regulation 38 (1) prescribes that a supply chain management policy must provide measures for the combating of abuse of the supply chain management system, and must enable the accounting officer, among others, to:

a. take all reasonable steps to prevent such abuse;

b. reject the bid of any bidder if that bidder or any of its directors has abused the supply chain management system of the municipality or municipal entity or has committed any improper conduct in relation to such system; and

c. cancel a contract awarded to a person if the person committed any corrupt or fraudulent act during the bidding process or the execution of the contract.

4 This MBD serves as a certificate of declaration that would be used by institutions to ensure that, when bids are considered, reasonable steps are taken to prevent any form of bid-rigging.

5 In order to give effect to the above, the attached Certificate of Bid Determination (MBD 9) must be completed and submitted with the bid:

² Bid rigging (or collusive bidding) occurs when businesses, that would otherwise be expected to compete, secretly conspire to raise prices or lower the quality of goods and / or services for purchasers who wish to acquire goods and / or services through a bidding process.

4. Each person whose signature appears on the accompanying bid has been authorized by the bidder to determine the terms of, and to sign, the bid, on behalf of the bidder;

5. For the purposes of this Certificate and the accompanying bid, I understand that the word “competitor” shall include any individual or organization, other than the bidder, whether or not affiliated with the bidder, who:

(a) has been requested to submit a bid in response to this bid invitation;

(b) could potentially submit a bid in response to this bid invitation, based on their qualifications, abilities or experience; and

(c) provides the same goods and services as the bidder and/or is in the same line of business as the bidder

6. The bidder has arrived at the accompanying bid independently from, and without consultation, communication, agreement or arrangement with any competitor.

7. In particular, without limiting the generality of paragraphs 6 above, there has been no consultation, communication, agreement or arrangement with any competitor regarding:

(a) prices;

(b) geographical area where product or service will be rendered (market allocation);

(c) methods, factors or formulas used to calculate prices;

(d) the intention or decision to submit or not to submit, a bid;

(e) the submission of a bid which does not meet the specifications and conditions of the bid; or

(f) bidding with the intention not to win the bid.

8. In addition, there have been no consultations, communications, agreements or arrangements with any competitor regarding the quality, quantity, specifications and conditions or delivery particulars of the products or services to which this bid invitation relates.

9. The terms of the accompanying bid have not been, and will not be, disclosed by the bidder, directly or indirectly, to any competitor, prior to the date and time of the official bid opening or of the awarding of the contract.

10. I am aware that, in addition and without prejudice to any other remedy provided to combat any restrictive practices related to bids and contracts, bids that are suspicious will be reported to the Competition Commission for investigation and possible imposition of administrative penalties in terms of section 59 of the Competition Act No. 89 of 1998 and or may be reported to the National Prosecuting Authority (NPA) for criminal investigation and or may be restricted from conducting business with the public sector for a period not exceeding ten (10) years in terms of the Prevention and Combating of Corrupt Activities Act No. 12 of 2004 or any other applicable legislation.
