109 Functions and powers

(1) The Maunga Authority has the powers and functions conferred on it by or under this Act or any other enactment.

(2) In exercising its powers and carrying out its functions in relation to the maunga, the Maunga Authority must have regard to—

(a) the spiritual, ancestral, cultural, customary, and historical significance of the maunga to Ngā Mana Whenua o Tāmaki Makaurau; and

(b) section 41(2).

(3) In exercising its powers and carrying out its functions in relation to the administered lands, the Maunga Authority must have regard to the spiritual, ancestral, cultural, customary, and historical significance of the administered lands to Ngā Mana Whenua o Tāmaki Makaurau.

41 Maunga must remain as reserves vested in trustee

(1) This section applies to each maunga once the maunga is—

(a) vested in the trustee under subpart 1, 2, or 3 of this Part;

and

(b) declared a reserve under any of sections 18 to 29, 33, and 39.

(2) The maunga is held by the trustee for the common benefit of Ngā Mana Whenua o Tāmaki Makaurau and the other people of Auckland.

Statutory responsibility

Auckland Council is required under section 63 of the Ngā Mana Whenua o Tāmaki Makaurau

Collective Redress Act 2014 (the Act) to provide the Tūpuna Maunga o Tāmaki Makaurau Authority (Tūpuna Maunga Authority):

a) An annual financial report on the Tūpuna Maunga and administered lands; and

b) A letter, signed by the Council’s Chief Executive, confirming the annual financial report is accurate and the Council’s accounts relating to the Tūpuna Maunga and administered land have been operated appropriately.

The Annual Financial Report for year ending 30 June 2018

Attachment A is the annual financial report covering financial period 1 July 2017 to 30 June

2018.

It is a special purpose annual report that reflects the current understanding of the council’s reporting requirements for the Tūpuna Maunga Authority under section 61 of the Act.

The special purpose annual financial report provides the following:

The council provides quarterly reports to the Tūpuna Maunga Authority on income and expenditure and variance commentary for each quarter.

Purpose To provide the Tūpuna Maunga Authority with the special purpose annual financial report for the year ending 30 June 2018.

Recommendations That the Tūpuna Maunga Authority:

a. Receive the annual financial report for the year ending 30 June 2018 (attachment A).

b. Receive the letter from the chief executive of Auckland Council confirming that the annual financial report is accurate (attachment B).



The annual financial report:

is prepared independently by the Financial Control team at Auckland Council using separate reports and transaction analysis tools.

did not change materially from the Quarter 4 year-to-date results presented to the Tūpuna Maunga Authority at Hui 39 on 27 August 2018.

has been reviewed by the Group Financial Controller.

A full internal audit will not be carried out unless it is requested by the Tūpuna Maunga Authority.

Letter from Auckland Council’s Chief Executive

Attachment B is a letter from the chief executive of Auckland Council to accompany the annual

financial accounts for year ending 30 June 2018. It confirms the financial report is accurate and that the accounts relating to the Tūpuna Maunga Authority have been operated appropriately and consistently within section 63 of the Act.

The letter also includes an appendix which references matters raised in the internal report of

findings and recommendation. Management has responded to the recommendation.

Administering body over the maunga of Tāmaki Makaurau. Established by the Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Act 2014 (Redress Act)

Entity's Purpose or Mission: The Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Settlement vested the Crown-owned land in 14 Tūpuna Maunga ("Maunga") in Ngā Mana Whenua o Tāmaki Makaurau, on the basis they would be held in trust by the Tūpuna Taonga o Tāmaki Makaurau Trust ("Tūpuna Taonga Trust") for the common benefit of the iwi/hapū of Ngā Mana Whenua o Tāmaki Makaurau and the other people of Auckland. The Tūpuna Maunga are vested as reserves.

The Tūpuna Maunga Authority is responsible as the administering body for the Tūpuna Maunga.

The Tūpuna Maunga Authority was established by legislation and commenced operations on 28 August 2014.

Auckland Council is responsible for routine management of the maunga and the administered land and must carry out this responsibility under the direction of the Tūpuna Maunga Authority. This means that all income and expenditure for the maunga is received and incurred by Auckland Council. These special purpose accounts represent that income and expenditure.

The Tūpuna Maunga Authority has six representatives from Ngā Mana Whenua o Tāmaki Makaurau and six representatives from the Auckland Council. The chairperson is elected by Ngā Mana Whenua o Tāmaki Makaurau representatives. The deputy chair is elected by Auckland Council appointees.

A non-voting Crown representative is appointed by the Minister for Arts, Culture and Heritage for a three year term, which can be extended for any period with the agreement of all parties.

The Maunga Operational Plan has been adopted. Where ownership under the Redress act has been transferred from the Crown to the Tūpuna Taonga Trust or where administration of Crown-owned maunga has been transferred, administration of the maunga is through the Tūpuna Maunga Authority and routine management is undertaken by Auckland Council.

Statement of Accounting Policies


Basis of preparationThis financial report is a special purpose report that reflects the current understanding of Auckland Council's ("the council") reporting requirements for the Tūpuna Maunga o Tāmaki Makaurau Authority ("Tūpuna Maunga Authority") under the Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Act 2014.

The council is responsible for the routine management of the maunga and the administered land and must carry out this responsibility under the direction of the Tūpuna Maunga Authority and in accordance with the annual operational plan, any standard operating procedures between the Tūpuna Maunga Authority and council and any delegations made to council.

The Tūpuna Maunga Authority was established on 28 August 2014. The amounts presented are extracted from the council's accounting records in relation to the work of the Tūpuna Maunga Authority as the administering body of the maunga and administered land. This report is designed to provide information about the current period's income and expenditure and the policies applied to prepare the reported results.

Goods and services tax (GST)All amounts are recorded exclusive of GST.

Council fundingThe Tūpuna Maunga Authority and the council must agree an Annual Operational Plan to provide a framework and funding in which the council will carry out its functions for the year. Each annual operational plan must be:a) Agreed before commencement of the financial year to which it relates; andb) Prepared and adopted concurrently with the council's annual plan; andc) Included in the council's annual plan in summary form.

The council's annual operational funding is recognised as the Tūpuna Maunga Authority revenue in these financial statements to a maximum of net expenditure incurred.

Funding for capital expenditure is also agreed in the annual operational plan. The council assigns this funding under the direction of the Tūpuna Maunga Authority. Refer to Note 7 for detail.

Lease incomeThe Tūpuna Maunga Authority receives rental income from buildings and structures located on the maunga and administered land.

Event chargesIncome is received for events in relation to the maunga and is recognised when the event occurs.

Employee related costsEmployee related costs are recorded as an expense when staff provide services and become entitled to wages, salaries, leave or other entitlements.

Employee related costs for staff dedicated to the management of maunga activities are assigned to the Tūpuna Maunga Authority. The council also incurs employee related costs for staff involved in the areas of governance, property management and general corporate support of the Tūpuna Maunga Authority. These employee related costs are not assigned to the Tūpuna Maunga Authority.

Other ExpensesExpenditure is recognised when the good or service is received.Other expenses include expenditure associated with maunga related property maintenance, utilities and general consultancy.

Surplus/(deficit) The council's funding is to a maximum of the Tūpuna Maunga Authority's net expenditure therefore no surplus or deficit is presented.

Auckland Council is required to incur remuneration and expenses of members of the Tūpuna Maunga Authority appointed by a rōpū entity (s.62, Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Act 2014). These expenses are to be incurred by Auckland Council in addition to any revenue and funding received by the Tūpuna Maunga Authority. The appointed member remuneration and expenses are not included in this annual financial report.

Related party disclosures have not been made for transactions with related parties that are within a normal supplier or client/recipient relationship on terms and conditions no more or less favourable than those that it is reasonable to expect the Tūpuna Maunga Authority would have adopted in dealing with the party at arm's length in the same circumstances.

Under the direction of Tūpuna Maunga Authority $1.9m has been spent on capital projects for the Maunga (budget $2.8m). The unused budget for these capital projects has been carried forward into future years.

3.0 FINANCIALS

3.1 Operating revenue and costs

Financial Commentary:

Operating Revenue is tracking slightly favourable to budget for the quarter.

Operating Expenditure for quarter two is under budget mainly due to repairs and maintenance and outsourced works coming in under budget for the quarter. There was also a one‐off credit of about $56k for rates rebates in quarter two relating to current and previous year that was processed incorrectly and queried by management. Expenditure is at 86% of budget as at December YTD, but it is expected to be on budget by year end.

3.2 Capital projects

Financial Commentary:

There are several capital projects currently underway including Maungawhau toilets, pedestrianisation of the remaining maunga, tihi crater tracks, the vegetation restoration programme and renewals. The first six months has involved a significant amount of scoping projects, getting consents and appointing contractors. The bulk of the capital costs will be incurred in the second half of the financial year (and under budget).

Neighbour tried 3 times to hit a Cornwall Park Trust Board staff member with a piece of a concrete block.

Verbally abused contractor and shoved him in the chest.

Final throw of breeze block also narrowly missed passing member of public.

Rec Services workers saw end of altercation and came to assist.

Offender ran back to his house, changed and then went to nearby medical Centre.

Police called, came to investigate and then caught up with offender at Medical Centre where he had self-admitted for a Psych exam.

Police called and attended.

Trespass notice issued.

Hui 44 Maungawhau Visitor has injured ankle on tihi track

Tourist was walking up to the trig when he has injured his ankle, requiring an ambulance.

Unable to get any more information from paramedic due to privacy reasons and tourist spoke limited English.

Hui 44 Takarunga Car attempted to drive around track, became stuck on the slopes

The incident occurred approx. 12-30am 5th of February. Person has used his employers 4WD Ute to drive around the lower track to attempt to bypass auto gate. Has come to the end to realise he can’t get through, attempted to reverse back down the path and has become stuck on the slope below the track.

Fence and gate was damaged and needed repair.

Bollard had to be cut to get rescue vehicle in to tow Ute out.

Rutting on slope caused by tyres.

Incident reported to police.

Bill for damages and time to be passed onto offender.

Offender will be trespassed from ngā Tūpuna Maunga.

Hui 43 Mangere Car driving into fence and abandoned

The incident occurred after private event at the Mangere/ Onehunga United Sports Club.

Reported to police and vehicle removed.

A new fence for the maunga is now required.

Incident reported to police. Car eventually removed by owner.

Management have since met with the club and advised them that private events are not appropriate.

Hui 43 Maungawhau Visitor broke ankle on tihi track

Tourist was walking up to the trig when she tripped and broke ankle.

Ambulance called and attended.

Tihi track to be upgraded.

Hui 43 Maungawhau Visitor had a minor heart attack in the car park

Tourist walking up summit road had a minor heart attack.

Summer Field Officers offered to contact emergency services – this offer was refused by the

Hui 42 Maungarei A small grass fire approximately 5m x 7m occurred on Maungarei. The fire occurred above the summit road and was put out by the Fire and Emergency Department. The fire occurred on Guy Fawkes Night. 5 “Roman Candles” were found at the tihi car park.

All maunga had signage put up and extra patrols by the security contractor organised.

We are still awaiting a formal report from the Fire Department on the incident.

Management will be meeting with our security contractor and the fire department to review processes prior to the Christmas and New Year Period.

Hui 41 Maungakiekie Incident where a Father and son were reported in the Archery field area with a BB gun.

Huia Lodge visitor centre were informed by a member of the public who then contacted Matrix security to investigate. The security officer then approached the two males who immediately made the gun safe. The officer advised them that they could not use the gun in the maunga and explained the safety

Safety protocols for Security staff to follow up when attending to these incidents - Police should have been requested to attend.

Refresher SOP training for Matrix Security officers working in both Maungakiekie and Cornwall Park.

All security officers to review Personal safety and lone worker policy and procedures.

Hui 40 Ōtāhuhu Staff made aware of another homeless man that has been sleeping in the toilet building on the Mt Richmond side of the maunga

N/a Management/Operations team have contacted the Auckland Mission Outreach team who will make contact with the new homeless man.

Maintenance contractors are buddying up in pairs when undertaking maintenance on the toilet.

Contractors are checking that the building is locked during their daily checks.
