Golden Arrow Bus Services’ applica-tion against MEC for Transport andPublic Works, Robin Carlisle, and

two companies operating existing interimMyCiTi services was recently dismissedwith costs in the High Court.

The City of Cape Town roundly wel-comed the judgement in the case, since itthreatened to halt the further expansion ofMyCiTi services.

“This is wonderful news for the peopleof Cape Town. It means that current negoti-ations for long-term contracts to operateexisting MyCiTi routes, as well as those inthe rest of Phase 1A and Phase 1B, can con-tinue and those contracts can be concluded.Importantly, this ruling allows us to imple-ment our vision of affordable and integrat-ed public transport for all the residents ofCape Town,” said mayoral committeemember for transport, roads and stormwa-ter, Brett Herron.

Golden Arrow Bus Services, which is al-so an operator of existing MyCiTi servicesin Phase 1A, applied to the court to compelthe city to enter into a mediation and arbi-tration process around areas of dispute, and to prevent the city from going aheadand negotiating and concluding a 12-yearcontract in terms of the National LandTransport Act (NLTA) to operate MyCiTiroutes in Phase 1A and Phase 1B.

The judge said that the process of estab-lishing an Integrated Public Transport Net-work was “extremely complex”. He foundthat compulsory arbitration and mediationwhere parties could not reach agreementwas “inappropriate”.

“If the city were obliged to reach consen-sus on every issue and with every partici-pant in the process, failing which it couldbe compelled to go to mediation and arbi-tration, it could become endlessly boggeddown,” the judge said when handing downhis judgement.

Being compelled to a process of media-tion and arbitration would make it impos-sible for the city to fulfil its statutory man-date, as required by the NLTA, to take steps“as soon as possible” to integrate servicesinto the larger public transport system.

The judgement said that the relevant sec-tion of the NLTA meant a contracting au-thority, such as the city, was obliged to ne-gotiate but was not obliged to agree.

Golden Arrow’s application to compelthe city to negotiate in good faith was alsodismissed.

The judge said that the allegation that thecity did not negotiate in good faith was astrong allegation, which implied fraud ordishonesty.

He found that the city was not obliged bysection 41 of the NLTA to negotiate withGolden Arrow Bus Services about compen-sation for its vehicles and assets whichwould be made redundant by Phase 1A andB. The City has not refused these negotia-tions at all, but the parties have negotiatedto deadlock on these issues. The fact thatthe city and Golden Arrow hold differentviews cannot justify an inference of badfaith or unreasonableness on the part of thecity.

“We welcome this judgement. It is goodfor Cape Town,” concluded Herron.

The Kleinvlei police are warning the com-munity to ensure that their vehicles areproperly secured, especially when visitingthe Shoprite and Pick n Pay parking area.A serious problem regarding theft of mo-

tor vehicles and theft out of motor vehicleshas been taking place in the area. The police claim that owners tend to be

negligent which is the main cause of theincidents.“We discovered that the owners leave

their valuable properties in open spaceswhere someone outside can see inside thevehicle,” said Kleinvlei police station com-mander, Colonel Joan Stroebel. She is appealing to the public to make

sure that their vehicles are installed withtracking devices. However, if they cannotafford this theyneed tomake sure that theydo not go shopping alone.

Police warn about carsafety after rise in theft

The Kleinvlei police are creating awarenessabout railway safety and regulations. They are urging the community to abide

by railway safety rules and regulations, es-pecially when crossing the railway tracks.Pedestrians and commuters are to only

cross tracks using designated crossings.Earlier this yearan18-year-oldboy losthis

life while walking with earphones, unawarehe was to be rammed by a train.Officer Annacletta Mothoalo, spokesper-

son for Kleinvlei police, said when it comesto such tragedies: “It is difficult to determinewhether or not it is a suicide attempt or ne-gligence when crossing the railway.”She also raises concerns that insurance

companies are also become stricter whensuch incidents are listed on claims.“People are not supposed to be walking

over the railway crossings in the first place. We urge them to be vigilant and not travelalone,” she said. She also urges commuters to make proper

use of trains, thereby preventing furtherrisk of injury.Metrorail, through safety campaigns, has

issued various commuter safety tips whichshould be heeded at all times.Metrorail encourages the public to make

use of bridges and subways instead of cros-sing railway lines, to remain in the carriageuntil the train comes to a complete halt, al-ways keep train doors closed and do notstand beyond the yellow line on the plat-form.Also to avoid taking an overcrowded

train, wait for the next one and to not engagein train surfing.

It’s all about compassion as The South Afri-can National Zakáh Fund (SANZAF)launched it winter warmth project in Uitsiglast week. The organisation’s signature seasonal

project, Operation Winter Warmthlaunched nationally at all its offices inSouth Africa, but the excitement was run-ninghighatUitsigPrimarywhowill benefitfrom it.A large majority of children and the aged

live in wretched poverty in South Africa, hence, their campaign is targeted at under-privileged children, the aged and the home-less in need across the country. In the Western Cape, the focus is specifi-

cally on deserving school children in thevarious communities. “Our objective is toprovide these deserving school childrenwith a woolly beanie, scarf and gloves toprotect them from the cold,” saysMoulanahMoegamat Hassiem, Western Cape chair-person of the organisation.“The aged in our community are also par-

ticularly vulnerable to the cold weather.Chances are we all know an aged personwho fits the above description. Thousandsof our aged in countless informal settle-ments and in old age institutions will be af-flicted by the severe cold winter weather. They have little or nothing to keep themwarm.”In Gauteng, the focus will be on the aged

and destitute families who will be providedwith a range ofwinter clothing items so thatthey could select the relevant items thatthey need, adopting the Islamic principle ofequality, equity and dignity.Beneficiarieswill identifywhat theyneed

from a variety of items.Similarly offices in KwaZulu-Natal and

the Eastern Cape will provide blankets, comforters, andwinter jackets to communi-ties in need.“Collaboration with like-minded people

and our contributors enables us to expandour reach and fulfil our mission, providingquality new winter items for children andcommunities in need,” added SajidDawray, national chairperson of SANZAF.“Wework with individuals, corporate do-

nors, community and faith-based serviceorganisations looking to give back throughcause marketing programmes. We alsowork with manufacturers and transporta-tion partners who provide in-kind supportthat help us work so efficiently.“The project also responds to local com-

munities with a powerful, national advan-tage as it addresses the immediate and criti-cal needs for appropriate clothing duringthe cold winter months.“Operation Warm Warmth can be lever-

aged to go beyondwarmth, to strengthen re-lationships between our partners and theircommunities and to facilitate positive out-comes that help break the cycle of poverty,”he saidOperation Winter Warmth advocates for

awareness of the impact of poverty on fami-lies and communities, and demonstrateshow even one person can make a positivedifference in the life of a person in need.

These youngsters get in line for their beaniesand gloves to keep them warm this winter.

Opportunity for emerging theatre directors

In haar laat sestigs wil dit voorkom of synou besiger is as ooit, beter is as ooit.

So, ekmoesbaie laewegkrap,maaruiteinde-lik was ek mal oor Rita.

“Ek is altyd so half verbaas as mense dinkek’s snaaks!”

REJAUN ERASMUS

After receiving numer-ous complaints over thepast few weeks, Tyger-

Burger came to the conclu-sion that the number of peo-ple parking in disabled park-ing bays without the requiredpermits seems to upset localsand disabled people alike. This has been an ongoing

problem but prominent shop-ping malls in the area claimthey are dealing with the is-sue.TygerBurger recently re-

ceived a complaint about anincident at the De’Ville Shop-ping Centre in Durbanvillefrom Sanet Mulder. Sanettook a photo of a black BMW parked acrossboth the disabled and parents’ parkingbays. “I asked the woman why she parkedthere and across both the special parkinglots. She then raised her voice and said ‘Iwas only five minutes; that’s why I parkedhere’, ’’ explains Sanet. The woman then al-legedly verbally abusedSanet in front of heryoung girl and Sanet’s baby, scaring Sanet.

Police hideAnother reader sentTygerBurger a photo

of a police vehicle parked in a loading bayat N1 City Mall. “The lady in the passengerseat (of the police vehicle) tried her best tohide when the photograph was taken,” ex-plains VernonWucherpfennigwho took thephoto of the police vehicle.Needless to say, disabled people them-

selves are also upset by this flippant behav-iour. “It aggravates and upsets me,” com-ments a disabled Edgemead resident on theillegal parkers. “It all comesdown to respectand what they’re saying to disabled peopleis that they simply don’t respect us.”AnotherGoodwood resident said: “People

shouldn’t judge. Not everyone who needs topark in adisabled parking space is disabled.I have a heart condition and can’t walk fardistances without having an angina attack.People don’t realise how important thatcloser bay is to me.”“It is inconsiderate and disrespectful to-

wards us,” a disabled shopper from CanalWalk told TygerBurger, “The bays are de-signed to be larger to make it easier to get

in and out of our cars with-out knocking someone else’scar.”When asked, shopping

centres admitted to receiv-ing complaints from custom-ers about illegal parkings.Vanessa Herbst from Ca-

nal Walk explained that theyhave security and parkingstaff monitoring their spe-cial bays on a daily basis.“We are in the process of in-vestigating ways to improveand enhance the disabled, parents’ and aged parking,”added Vanessa.

SecurityShopping centres such as

Parow Centre are trying tomake the illegal parkings their main con-cern. Operationsmanager Francois van derMerwe told TygerBurger that “due to thecomplaints received, we have a new securi-ty company and are making these parkingsour priority”.A car guard at aBothasig shopping centre

felt it necessary to comment on the issue toTygerBurger after seeing the disruptions ofthese illegal parkings. “People think thatit’s okay to park in disabled parking spacesif they’re just going to be in the shops fortwo minutes,” he explains, “it just makestrouble.”The law states that a minimum fine of

R500 should be issued for parking in a bayreserved for disabled motorists withouthaving a permit displayed. It seems that itmay be difficult to enforce at Parow Shop-ping Centre, which has recently started im-plementing fines, but “will accept as littleas R50 if we’re feeling lenient,” Francoisstates.According to Natalie Browne from N1

City Mall, “clamping and fining is used asa last resort,” after customers are warnedby the parking guards and security staff.Michelle Swart explains how it works at

TygerValley: “When a vehicle is noticed be-ing illegally parked, security are notified byeither patrolling security officers or cus-tomer assistants.“The customer whose vehicle has been

clamped will have to pay the penalty fee be-fore the vehicle can be released. The releasefee is normally R500.”

There are two words in theEnglish language which set mysenses on edge like a fingernailscraping on a blackboard andthey are “spokesperson” and“chairperson”.

It seems to me that if awoman speaks on behalf of anentity or is elected to chair anentity, she must figurativelyundergo a bi-lateral mastectomyand a radical hysterectomy torender her genderless. In thecase of a man it is far easier asa couple of snips with thekitchen scissors and the is jobdone.

SA prides itself on genderequality and advancing womenin the workplace so why notgive a woman credit and referto her a “spokeswoman” or“chairwoman”?

Political correctness has beendescribed as pretending to pickup a dog turd by its clean end.

Who is chairing thismeeting anyway?

On Friday 19 April I saw fourcitizens lying on the pavementand after a while they ap-proached my home shouting forfood. I interviewed them andthey told me their trolleys wereremoved from them by LawEnforcement and now theycannot survive and are strollingin the neighbourhood.

With the trolley they hadmade from R30 to R100 per dayand had fed themselves andtheir children. I asked them, what now? The answer is theydo not know but I silentlythought if I was in your shoesand and in your situation Iknow what I am forced to doagainst my principles and willto provide food for my childrenand my mouth.

KEITH ALFRED AND ADOLPH BLAKEEmail

What would you doif forced to steal?

My hele lewe lank is Christusmy enigste rolmodel. Mensewat met my verskil, moetbesluit wie hulle s’n is.

The sale of drugs is a call forconcern, particularly in theWestern Cape and South Africa. This in part, has generatedmany questions and quickresponses have been that thoseinvolved want to make quickmoney, as a result of a hugeprofit margin.

Drugs commonly sold inSouth Africa are cocaine, heroin, Ecstasy, marijuana andQuaaludes. Why is it so easy toget a dose of these drugs withrelative ease, in spite of ade-quate security measures thegovernment has put into place. Are these drugs from within orimported? Who is to be blamed, the government? Are the portsof entry this country so vulnera-ble? The law is flexible to thosewho are engaged in this line oftrade. The execution of a SouthAfrican lady who was caughtwith drugs in China was notenough warning to them andmeant nothing to the authority.I am not proposing a deathsentence to drug traders, but

LEWENSKIEKIE

Geweld is vandag heeltemal aanvaar-baar. Dis vermaak-lik. Geweld is cool.

TYGERBURGER | EERSTERIVIER & BLUEDOWNSWoensdag, 1 Mei 2013

Touched: The Northern Suburbs Winter Touch Rugby Season gets under way in the weekon Monday 27 May. Players and teams of all shapes and sizes are encouraged to shake offthe cobwebs for what promises to be the best season ever. League matches will be playedon Monday nights at the Brackenfell Rugby Club. Players of all standards from provinciallevel to social will be accommodated. For more information or to enter a team, phone Nielde Beer on 021 439 8646 or visit www.touchrugby.co.za.

SAREL BURGER

HTS B’villedamwal breek toe Tiere vlamvat

SHIHAN HENNIE: HE WILL SUCCEED

Turner backin ring again

Graham Turner will make his comeback after a lengthy layoff in the MMA ring. Here he is sparringwith one of his top students, Shaun de Lange.

STEHAN SCHOEMAN

Sit down when you read this sentence. At the age of 45, GrahamAshley Turn-er is making a comeback to the MMA

ring and this is a man with his sights setfirmly on an EFC title. It’s been 10 long years since his last fight. After the defence force as a youngster,

Graham started working as a doorman aswell as VIP close-protection security.Through this he was able to learn many

forms of martial arts, but still found some-thing was missing. That something wassoon found after he watched UFC 1 and sawRoyce Gracie submit his opponents thatwere much bigger than him without sus-taining injury to himself. This was Gra-ham’s first introduction to the art of Brazil-ian JiuJitsu.

MMA dojoIn the 90s, Grahamstarted his first school

training in the art of street reality combatin London. He trained up fighters that com-peted for pro-tournaments on the Britishcircuit reaching national level. After that he moved back to South Africa

and followed his dream of opening his ownprofessional MMA dojo den.“At the age of 45, I’m physically andmen-

tally in the shape of my life. I have neverfelt this good. I seemyself as amartial artistnot a fighter. A fighter will stop trainingwhen he stops competing. A true martialartists never stops training even if heknows he’s done competing,” said Graham.

He has a busy schedule to say the least. He is training 16 times a week, with any-thing between two and four classes daily athis Leviathans Den dojo in Durbanville.“A lot of thought has gone into this mas-

sive decision. I’m not done yet, far from it.I really feel my best is still ahead of me. Ithink itwould be arrogant ofme to step intothe EFC ring for my first fight. I need to getthe ring rust off.

Burning desire“That’swhy I decided to compete in a pro-

am fight on 25May in Edgemead. I need thetime in the ring before getting competingin the EFC in November. I have a burningdesire to compete on the highest level andlet me tell you I am ready for it.”He also has a lot of respect forKyokushin-

kan’s Shihan Hennie Bosman. “ShihanHennie opened his doors for me and someof my students two years ago. He broughtme back from being a prized fighter to theroots of a true martial artists.“Training at Shihan Hennie is all about

respect for each other and yourself. The tra-ditional ethics is something very importantto us. Althoughwe are involved in differentstyles, I still see him as my teacher.”“You know I have always had respect for

Graham. His technique and power sur-prised me and let me tell you it takes a lotof guts to get back into the ring at his age.I have no doubt he will make a success ofhis comeback,” said Shihan Hennie.Anybody willing to sponsor Graham can
