Vehicle theft in Despatchon increase
An unknown man was fatally injured in a motor collision in MelbrooksAvenue, Uitenhage.
According to police information, a taxi was on its way to KwaNobuhleand as the vehicle passed Melbrooks Bridge, the driver noticed a pedestri-an suddenly cross the road.
“He allegedly swerved to avoid hitting the pedestrian, but the left sideof the mirror hit the person. The driver immediately stopped and contact-ed the police. The unknown pedestrian died at the scene,” said policespokesperson Lt Col Priscilla Naidu.
A case of culpable homicide is being investigated. The identity of thepedestrian is still unknown. The man is about 65 years old. Anyone whocan assist in identifying the deceased person, is asked to contact D/W/OBarnard at SAPS Uitenhage on 0041 9963444.

On World Music Day Riebeek College an-nounced that its senior choir has been se-lected to perform at the national finals ofthe prestige ATKV Applous choir competi-tion to be held in Stellenbosch during July.
This is an impressive achievement as onlychoirs which receive a gold certificate at the re-gional competition stand a chance to be invitedto the finals. The senior choir received gold atthe regionals during May.
What makes this special is that Riebeek’schoir has been entered in the “more experi-enced” category, which means that they haveto compete at the highest level in this nationalevent.
Riebeek’s choir, well known for their per-formancesof indigenoussongs, aims towowtheadjudicators with their unique piece called“Izwe”.
According to Siphesihle Tsotsa, junior choirconductor, “Izwe speaks about how the worldhas turned into a cruel and ugly place, but ifeveryoneworks together to eradicate crimeandcorruption, the world will be a better place.”

Nelson Mandela Metropolitan Uni-versity has won an internationalaward for best use of social mediathanks to the flash mob by its choirflighted on YouTube that becamean overnight viral global sensa-tion.
NMMU took a silver award behindAmerican higher education giantsJohns Hopkins University and Massa-chusetts Institute of Technology(MIT) in the Council for Advancementand Support of Education (CASE) Cir-cle of Excellence awards honouringoutstanding work in communica-tions, alumni relations, marketingand advancement services.
The latest accolade against 570 oth-
er institutions around the globe fol-lows a string of others already won bythe university and its design agency,Boomtown.
“We are thrilled with the news ofthis awardas it positionsusas aglobalplayer – a university that can hold itsown internationally,” says NMMU’sDirector of Marketing and CorporateRelations Pieter Swart.
The flash mob - an impromptu per-formance in a public place – whichwas staged almost a year ago byNMMU’s international award-win-ning choir at Greenacres ShoppingCentre was part of a campaign to high-light the closing date for applicationsto study at NMMU and to raise aware-ness of the institutions.
It became an overnight sensationon YouTube, making it the most popu-lar South African video on the social
network site soon after it was releasedin July 2011.
To date some 133 000 people havewatched it, and the choir has been in-undated with requests to share theirtalent elsewhere. In July, they willrepresent Africa in a choral symposi-um in China.
In a congratulatory letter to the uni-versity, CASE organisers highlightedthe high standards of the entries, ofwhich 69 were received in the best us-es of social media category.
“You, your staff and your institu-tion should be very proud of what youhave achieved,” wrote Brian Fla-haven, CASE Director: Legislative,Foundation and Recognition Pro-gramme.
The award will be handed over at aCASE conference in Birmingham,United Kingdom, in August.

New Life Crisis PregnancyCentre needs volunteers aswell as a mobile unit that cango into different areas andminister to young womenwithin their own community.
Young people who require apregnancy test usually findthemselves in a crisis, whichbecomes a turning point intheir lives.
“This crossroad is a placewhere they need acceptanceand a listening ear, within asafe confidential environ-ment,” said Jean Downey, Di-rector at New Life Crisis Preg-nancy Centre.
“We fill this gap, and the on-ly way we can do this is by hav-ing women volunteers, whoare willing to give a little oftheir precious time and beavailable to those in need.”
The team currently consistsof 14 volunteers and since Jan-uary 2012 they have seen 308girls and women for pregnan-cy tests. They have also minis-tered to others who have beencounselled for various reasonsor attended programs. For ex-ample 275 attended their week-ly ante-natal classes and theyhad 178 baby visits, whichbrings the total clients to 857.
According to Downey theyare also available to “boy-friends and parents whowould like to chat about theirchild or girlfriend’s pregnan-cy, as an unplanned pregnan-cy affects the entire family.”SNew Life CPC will be run-

Kirkwood Hardware had its humble beginning 60 years ago.The 2 owners each had the shop for 20 and 25 years. Ava & Frans Scholtz moved to the SundaysRiver in 1999, and bought the shop in April 2000, from Gerty Smith, the previous owner. The shop
was 300m², had 2 staff members and was selling from cement to guitar strings and leather“riempies” and anything that could fit in a honey jar.
Very soon Frans realized the need for a proper building material and hardware store. The decision togo with the Build It group was easy. There are 270 Build It stores nationwide and they are part of theSpar group, which is the fastest growing franchise group in the country. In 2007 a new building waserected in front of the existing store, which extended the store to 2300m². A state of the art computersystem was installed, lighting was upgraded, and new shelving and the stock range was upgraded to35000 stock line items. Today there are 20 staff, 1 x 8 ton truck, 1 x 3 ton truck & 1 tip truck. Their aim
is to supply the valley with the best service and the best products at the best price.

The people of the Sundays River Valley are en-suring that visitors to the annual Absa Kirk-wood Wildsfees brought to you in associationwith DStv will be getting even more value formoney this year.
The organisers have kept all fees at lastyear’s levels, while increasing the range of ex-periences and entertainment for the wholefamily. It will run from Friday to Sunday.
“In solidarity with our visitors and stall-holders during tough times, we have not in-creased the gate entrance fee,” says festival di-rector Jenni Honsbein.
“We have been able to achieve this becausemany of our suppliers have also frozen theircosts, and also owing to the additional spon-sorship attracted by the Wildsfees, which isnow in its 11th year,” she says.
This year’s Wildsfees includes a full pro-gramme of entertainment, as well as the expe-rience of shopping at over 300 specialist stalls,wild rides, wild animals, wild shows, and theannual wildlife auction.
Visitors will also experience a festival offirsts. For the first time the festival is hostinga “mohair journey”. Designs from The NelsonMandela Metropolitan University (NMMU)and Mode University in Japan’s collaborationprojects will be on show, along with other mo-hair products and live goats in a Mohair SouthAfrica exhibition.
Another first is the staging of a dramaticproduction, “My Naam is Ellen Pakkies,” ariveting story of a mother from the Cape Flatswho killed her Tik-addicted son. Ellen is por-trayed by Vinette Ebrahim – known as Char-maine Meintjes in 7de Laan.
On the lighter side, Quattro – “an ItalianFlavoured Review” will be seen on stage in theEastern Cape for the first time. Many of the
artists appearing on stage will be in the East-ern Cape for the first time this year.
Headline acts include Karen Zoid, Snotkop,Arno Carstens, Elvis Blue, Valiant Swart, Ro-manz, Emo Adams, and Chris Chameleon andhis band will ensure that the festival ends ona high note.
On thewild side, babycrocodilesmake theirappearance for the first time in the “Walk onthe Wildside” experience, where visitors canalso touch snakes and owls and other raptors.“The Addo Elephant National Park display isalways a highlight of this attraction,” saysHonsbein.
Penguins will also be seen inland in Kirk-wood for the first time, with the South AfricanMarine Rehabilitation and Education Centre(SAMREC) giving demonstrations and talkson rehabilitation and the plight of the highlyendangered African penguin.
There will also be talks on the control ofpredators. “And, of course, we will be focusingon the fight against rhino poaching – whichis unfortunately another first at the festival,”she says.
This year’s Absa Kirkwood Festival in-cludes an expanding agricultural show, whichwill be used by suppliers to introduce anumber of new products, while the car show– the biggest in the Eastern Cape – will includea number of new models.
Wine lovers will find new vintages and vari-etals in the Kyknet Leefstyl Plein - the placewhere food lovers will also be able to savournew tastes and flavours.

This week the Property Poserexperts address a reader’s con-cern about preventing pedes-trians from crossing her va-cant seafront plot.
The reader explains that shebought the land a decade ago andinitially intended to build on itbut has since decided to sell.
The problem she faces is thatthe local residents, mostly fisher-men, use a pathway across herland to access the beach, eventhough there is a public road ashort distance away.
The reader has checked the ti-tle deed and no servitude exists.Her land is unfenced and she hasno intention of erecting one as shebelieves it would look unsightlyand that it would soon be dam-aged in order to gain renewed ac-cess to the pathway.
The reader’s concern is that aright, claimed by the local author-ity and residents, may be createdby means of prescription if shecontinues to allow the public touse the path. This, in turn, mightaffect the planned sale.
According to Rian du Toit fromDTS Attorneys in Nelson Mande-laBay, SectionSixof thePrescrip-tion Act provides that “a personshall acquire a servitude by pre-sumption if he has openly, and asthough he was entitled to, exer-cised the rights and powers whicha person who has a right to suchservitude is entitled to exercisefor an uninterrupted period of 30years”.
It therefore certainly appearsthat, over time, such a right maybe constituted, says Du Toit.
“The change in ownership ofthe land will not interrupt the
running of prescription, as longas the public continues using theproperty openly, and this may re-alistically present a problem forfuture owners.”
Du Toit says the Act does, how-ever, make provision for certaininstances in which prescriptionis interrupted and the passing oftime needed to complete the ac-quisition of the right stops.
Despite the reader’s aversion toa fence, a cost-effective optionwould be to enforce the right ofownership by preventing accessin a practical manner, says Char-lotte Vermaak from Chas Everittin the metro.
“This could be as easy as erect-ing a signboard indicating thepri-vate nature of the property or,preferably, the aforementionedfence or other mechanism de-signed to prevent thoroughfare.”
Another alternative is for theowner of the land in question tostart legal proceedings, such asobtaining a declaratory orderconfirming that no right of wayexists, says Vermaak.
“This would be done by way ofan application to the High Court.It would of course involve legalcosts, but may be important foranyone who is planning long-term ownership of the land.”
Vermaak says, under the Act,these measures may well curb thebuilding of a communal right ofway.
“But the reader must take somekind of action because to continueto overlook the occurrence maybecome problematic for her or thenext owner.”

The Volkswagen Amateur Athletic Club’s an-nual road races will be held on Saturday atBrandwag sports fields. The 10km road racestarts at 07:00 with the 5km event at 07:15.This is a prestige and participation leagueevent and participants are requested that fullclub colours should be worn during the rac-es.
There will be water points along the roadas well as bins and participants are remindedplease not to litter, but rather make use ofthese bins. Also note that the wearing of ear-phones may lead to disqualification.

THE 30th running of the annual Volkswa-gen Rally takes place on Friday and Satur-day,July13and14, inUitenhage,PortEliz-abeth and surroundings.
This popular event on the national rally cal-endarwill see thecreamofSouthAfrica’s rallyfraternity in action on a combination of tarand gravel stages. Competitors in the 2012Volkswagen Rally will make the traditionalAutoPavilion start outside of the main gate ofthe Volkswagen plant where the public willenjoy free entry to the museum for the day.
This is also a good time for rally fans tomeet their favourite rally competitors andtake the opportunity to collect autographsandtakeafewphotoswiththeirmotorsporthe-roes.
“TheVolkswagenRally is oneof thebest ral-liesonthenationalcalendar,”saysMikeRowe,head of Volkswagen Motorsport. “It is well or-ganised and run by the Algoa Rally Associa-tion and route organiser Joe Fourie celebrateshis 21st Volkswagen Rally with us this year.There is a dedicated team of enthusiasts whoensure the event is as good as it could possiblybe and this shows in the organisation.”
Volkswagen has sponsored the VolkswagenRally since 1982, an event that has a large fol-lowingamongstrally fanswhoturnout inhighnumbers to watch their rally favourites in ac-tion.
When the flag drops for the start of theVolkswagen Rally competitors will find them-selves contesting stages in Gamtoos, the Long-more Forest, Uitenhage, Port Elizabeth OvalTrack Raceway (PEOTR) in Greenbushes and
will also contest the very popular KingsBeach spectator stage which is the traditionalgrand finale.
“This year promises to be a very goodevent,” says routeorganiserJoeFourie. “Goodrainsintheareahavesignificantlyreducedthefire risk in the Longmore Forest, the roads arein good condition and there are even a coupleofnewstagesaswell.We’reall anticipating the30th running of the Volkswagen Rally is goingto be one of the best we’ve had.”
Competitors in the Volkswagen Rally willface one of the two new stages right at the startof the event when they head to Melon in theGamtoos area. Here Fourie has indicated thefield will face a challenging, but extremelygood first stage.
“That first stage hasn’t been used for manyyears,” says Fourie. “It is a good distance, at10.5 km long, but the competitors will find
themselvesincompetitiononastagethatwould do a round of the WRC (World RallyChampionship) proud. It’ll really wake themup and get the rally off to a good start.”
FivestagesawaittheVolkswagenRallycom-petitors on Friday with a further seven sched-uled forSaturday–ofwhichthreewillbedupli-cated from day one of the rally.
The focus for the event is on providing achallenging rally for competitors while retain-ing the high level of spectator-friendliness forwhich the Volkswagen Rally is known.
“Accessibility is a big issue on a rally,” saysFourie. “Getting rally fans to good viewingpointswhilenot interferingwiththerally itselfis a challenge. The popularity of the Volkswa-gen Rally amongst spectators is legendary andwe do everything we can to make it as easy aspossible for them to be a part of the action.”
