The AssistantConsolidation officeron the application ofthetenure-holderorthe Land
ManagementCommittee,to whom chak orlands have been allotted underthe finalconsolidationScheme,mayandwhereanylandhasbeenallottedtotheStateGovt.shall,withoutanyapplicationoftheStateGovt.,withinsixmonthsofthedateonwhichthesaidschemehascomeintoforce,putthetenureholderortheLMCortheStateGovt.,asthecasemaybe,inactualphysicalpossessionoftheallottedchakorlands;andforsodoingshallhaveallthe powers,including powers as regards contempt,resistance and the like as areexercisablebyacivilcourtinexecutionofadecreefordeliveryofpossessionofimmovableproperty.
Providedthatthedeliveryofpossessionasaforesaidshallnotaffecttheright ofthepersonfrom whom possessionistransferredtotendandgatherthecrops standing on suchchaksorlandorpartthereof,onthedateofthedelivery,unlessthe Assistant Consolidationofficerdecides,forreasonstoberecorded,thatthepossession over the crop also shall bedelivered.
Providedfurtherthatthepersontendingandgatheringthestandingcrop.inaccordancewithfirstprovisoshallbeliabletopaytothepersonswhohavebeenallotedthechak,orlands,compensationfortheuseoflandatsuchrateandin suchmannerasmaybeprescribed.
Section28(2)oftheActfurthersaysthatontheexpiryofsixmonthsfrom thatdateonwhichatenureholderorLandManagementCommitteeortheStateGovernmentbecameentitledtoenterintopossessionoftheChak,orlandsallottedwhetherbeforeorafterthecomingintoforceoftheUttarPradeshConsolidationofHoldings(Amendment)Act,1962,orontheexpiryofsixmonthsfromthedateofthecomingintoforceofthatAct,whicheverislaterthetenure-holderortheLandManagementCommittee.orStateGovernmentasthecasemaybeshall,unlesspossessionhasbeenobtainedearlier,bedeemedtohaveenteredintoactualphysicalpossessionoftheallottedchakorlands.
Section29oftheActwhichexplainsthatwherepossessionoverstandingcropsalsoisdeliveredunderSection28,theA.C.O.shalldetermineinthemannerprescribedthecompensationpayableinrespectofsuchcropsbythetenureholderputinpossession.Anyaggrievedpersonisempoweredtopreferanappealbeforetheconsolidationofficeritsdecisionshallbefinal.
Again Section 29(A) of Actwhich explains thatwhere a tenure-holderfrom whomcompensationisrecoverableunderthisAct,failstopaythesamewithintheperiodprescribed.Therefore,thepersonentitledtoreceiveit,mayinadditiontoanyothermodeofrecoveryopentohimapplytothecollectorwhichsuchtimeasmaybeprescribedtorecovertheamountdueonthisbehalfasifitwereanarrearoflandrevenuepayabletogovernment.
WhereanycompensationpayableunderthisActisnotpaidwhetherinwholeorinpastwithinthreemonthsofthedateofobtainingpossessionundersection24orSection28asthecasemaybeinterestattherateof6percentperannum shallbechargedontheamountnotsopaid.Consequencesafterexchangeofpossession:-Section30 oftheActwhichexplainsregardingconsequenceswhichshallensureonexchangeofpossessionthatwiththeeffectfrom thedateonwhich,tenureholderenters,orisdeemedtohaveenteredintopossessionofthechakallottedtohim,in accordancewiththeprovisionsoftheActthefollowingconsequencesshallensure-a. Therights,title,interestandliabilities-
i. ofthetenureholderenteringordeemedtohaveenteredintopossessionandii. oftheformertenureholderoftheplotscomprisingthechak,intheirrespective
originalholdingsshallcease;andb. Thetenureholderenteringintopossession,ordeemedtohaveenteredintopossession,
shallhaveishischakthesamerights,title,interestsandliabilitiesashehadin original

holdingstogetherwithsuchbenefitsofirrigationfrom aprivatesource,till such sourceexistsastheformertenureholderoftheplotscomprisingthechakhadinregardtothem;
c. LandsvestedintheGaonSabhaoranylocalauthorityandallottedtothetenure-holder shallbedeemedtohavebeenresumedbythestateGovernment.Underthe provisions ofsection117orSection117Aasthecasemaybe,oftheUttarPradeshZamindariAbolitionandLandReformsAct1950andsettledwithtenureholder;
d. therightsofthepublicaswillasindividualsinoroverlandincludedinachak following adeclarationmadeundertheprovisotosubsection(2)ofsection19(a) shallceaseandbecreatedinthelandspecifiedforthepurposeinthefinal consolidationscheme;and
e. theencumbrances,ifany,upontheoriginalholdingofthetenure-holderentering,ordeemedhaveentered,intopossession,whetherbywayoflease,mortgageor otherwise,shallinrespectofthatholding,cease,andbecreatedontheholdings,oronsuchpartthereof,asmaybespecifiedinthefinalConsolidationScheme.

Provisionrelatingtodeclarationandnotificationregardingconsolidationhasbeen mention undersection4oftheAct.Accordingtosection4–1.(a)TheStateGovernmentmaywhereitisofopinionthatadistrictorpartthereofmay be broughtunderconsolidationoperations,madeadeclarationtotheeffectinthe Gazette, where upon itsmallbecomelawfulforanyofficerorauthoritywhomaybe empoweredinthisbehalfbytheDistrictDeputyDirectorofConsolidation.(i) toenteruponanysurveyinconnectionwithrectangulationorotherwiseandtotakelevels ofany
landinsucharea.(ii) tofixpillarsinconnectionwithrectamgulation,and(iii) todoallactsnecessarytoascertainthesuitabilityoftheareaforconsolidation operations.(b) TheDistrictDeputyDirectorofConsolidationshallcausepublicnoticeofthe declaration issued
underclause(a)tobegivenatconvenientplacesinthesaiddistrict orpartthereof.2.(a) WhentheStateGovernmentdecidestostartconsolidationoperations,eitherinaarea, itmayissuea notificationtothiseffect.(b) Everysuchnotification,shallbepublishedintheGazetteandinadailynewspaper having no
circulationinthesaidareaandshallalsobepublishedineachunitinthe said area in suchmannerormaybeconsideredappropriate.IncaseofChhediPrasadTiwariVsDDC1990RD213:1990RJ141.It was held thatafter
notificationoftheconsolidationoperationallobjectionsrelatingto interiorand to be raised beforeconsolidationauthorities.FurtherUnderSection4A-1. WheretheStateGovernmentisofopinionthatinthecaseofadistrictorpartthereof inrespectofwhichanotificationhasalreadybeenissuedundersection52.ItisexpedientinpublicinterestsotodoitmayadeclarationintheGazettethatsuch districtorpartthereofmayagain be broughtunderconsolidationoperation.
Providedthatnosuchdeclarationshallbeissuedwithintwentyyearsfrom the date of thenotificationreferredtointhesaidsectionbutinspecialcircumstancesthe state Governmentmay inpublicinterestissuesuchdeclarationaftertenyearsfrom thesaiddate.

Section5Effectofnotificationundersection4(2)–(i)uponthepublicationofthenotification[undersub-section(2)ofSection4]intheOfficialGazette,theconsequenceorhereinaftersetforth,shallsubjecttotheprovisionsofthisAct,from thedatespecifiedthere-undertillthepublicationofnotificationunderSection52orSubSection(1)ofSection6,asthecasemaybeensureintheareatowhichthe[notificationundersub-section(2)ofSection4]relatesnamely-(a) Thedistrictorpartthereof,asthecasemaybe,shallbedeemedtobeunderconsolidationoperationanddutyofmaintainingtherecordofrightsandpreparingthe villagemap.Thefield-bookandtheannualregisterofeachvillageshallbeperformedbytheDistrictDeputyDirectorofConsolidation,whoshallmaintainorpreparethem asthecasemaybe,inthemannerprescribed.b.ii. NotwithstandinganythingcontainedintheUPZamindariAbolitionandLandReforms Act 1950,notenureholder, exceptwiththepermissioninwritingofthe SettlementOfficer,Consolidation,previouslyobtainedshall-(i) usehisholdingsoranypartthereofforpurposesconnectedwithagriculture,horticulture oranimal husbandryincludingpiscicultureandpoultryfarmingor(ii) (----------)
Providedthatatenure-holdermaycontinuetousehisholding,oranypartthereoffor anypurposeforwhichitwereinusepriortothedatespecifiedinthenotification issued [undersub-section(2)ofSection4].(2) uponthesaidpublicationofthenotificationundersub-section(2)ofSection4the followingfurtherconsequencesshallensureintheareatowhichthenotification relates,namely-(a) everyproceedingforthecorrectionofrecordsandeverysuitandproceedingin respect ofdeclarationofrightsorinterestinanylandlyingintheareaorfor declarationoradjudicationofanyotherrightinregardtowhichproceedingscanoroughttobetakenunderthisActpendingbeforeanycourtorauthoritywhetherofthe firstinstanceorofappeal,referenceorrevision,shallonanorderbeingpassinthat behalfbythecourtorauthoritybeforewhom suchsuitorproceedingispendingstand abated.
Providedthatnosuchordershallbepasswithoutgivingtothepartynoticeby postoranyothermannerandaftergivingthem anopportunityofbeingheard.
Providedfurther,thatontheissueofanotificationundersub-section(1)of section 6 inrespectofthesaidareaorpartthereof,everysuchorderinrelationtothe land lying insuch areaorpart,asthecasemaybe,shallstandvacated.(b). Providedfurtherthatthepersontendingandgatheringthestandingcrop.in accordancewithfirstprovisoshallbeliabletopaytothepersonswhohavebeen allotedthechak,orlands,compensationfortheuseoflandatsuchrateandin suchmannerasmaybeprescribed.
Section28(2)oftheActfurthersaysthatontheexpiryofsixmonthsfrom thatdateonwhichatenureholderorLandManagementCommitteeortheStateGovernmentbecameentitledtoenterintopossessionoftheChak,orlandsallottedwhetherbeforeorafterthecomingintoforceoftheUttarPradeshConsolidationofHoldings(Amendment)Act,1962,orontheexpiryofsixmonthsfromthedateofthecomingintoforceofthatAct,whicheverislaterthetenure-holderortheLandManagementCommittee.orStateGovernmentasthecasemaybeshall,unlesspossessionhasbeenobtainedearlier,bedeemedtohaveenteredintoactualphysicalpossessionoftheallottedchakorlands.

(2)Asuitfortheevictionofatenantfrom abuildingafterthedeterminationofhistenancymaybeinstitutedononeormoreofthefollowing,grounds,namely-
(a)thatthetenantisinarrearsofrentfornotlessthanfourmonths,andhasfailedtopaythesametothelandlordwithinonemonthfrom thedateofserviceuponhim ofanoticeofdemand:ProvidedthatinrelationtoatenantwhoisamemberofthearmedforcesoftheUnionandinwhosefavourtheprescribedauthorityundertheIndianSoldiers(Litigation)Act,1925(ActIVof1925)hasissuedacertificatethatheisservingunderspecialconditionswithinthemeaningofSection3ofthatActorwherehehasdiedbyenemyactionwhilesoserving,theninrelationtohisheirs,thewords“fourmonths”inthisclauseshallbedeemedtohavebeensubstitutedbythewords“oneyear”,

(e)thatthetenanthassub-let,incontraventionoftheprovisionsofSection25,orathecasemaybe,oftheoldActthewholeoranypartofthebuilding;
(f)thatthetenanthasrecountedhischaracterassuchordeniedthetitleofthelandlord,andthatlaterhasnotwaivedhisrightofreentryorcondonedtheconductofthetenant;
(g)thatthetenantwasallowedtooccupythebuildingaspartofhiscontractofemploymentunderthelandlord,andhisemploymenthasceased.
(4)Inanysuitforevictiononthegroundmentionedinclause(a)ofsub-section(2),ifatthefirsthearingofthesuitthetenantunconditionallypaysor[tendertothelandlordordepositsinCourt]theentireamountofrentanddamagesforuseandoccupationofthebuildingduefrom him (suchdamagesforuseandoccupationbeingcalculatedatthesamerateasrent)togetherwithinterestthereonattherateofninepercentperannum andthelandlord’scostsofthesuitrespectthereof,afterdeducingtherefrom anyamountalreadydepositedbythetenantundersub-section(1)ofSection30,theCourtmay,inlieuofpassingadecreeforevictiononthatground,pasanorderrelievingthetenantagainsthisliabilityforevictiononthatground:

atenantfrom thebuildingundertenancyoranyspecifiedpartthereofitissatisfiedthatanyofthefollowinggroundsexists,namely—
(a)thatthebuildingisbonafiderequiredeitherinitsexistingform orafterdemolitionandnewconstructionbythelandlordforoccupationbyhimselforanymemberofhisfamily,oranypersonforwhosebenefititisheldbyhim,eitherforresidentialpurposesorforpurposesofanyprofession,trade,orcalling,orwherethelandlordisthetrusteeofapubliccharitabletrust,fortheobjectsofthetrust;
(b)thatthebuildingisinadilapidatedconditionandisrequiredforpurposesofdemolitionandnewconstruction:
Providedthatwherethebuildingwasintheoccupationofatenantsincebeforeitspurchasebythelandlord,suchpurchasebeingmadeafterthecommencementofthisact,noapplicationshallbeentertainedonthegroundsmentionedinclause(a),unlessaperiodofthreeyearshaselapsedsincethedateofsuchacquisitionandthelandlordhasgivenanoticeinthatbehalftothetenantnotlessthansixmonthsbeforesuchapplication,andsuchnoticemaybegivenevenbeforetheexpirationoftheaforesaidperiodofthreeyears:Providedfurtherthatifanyapplicationunderclause(a)ismadeinrespectof(anybuildingletoutexclusivelyfornon-residentialpurposes)theprescribed authoritywhilemaking theorderofevictionshallafterconsideringallrelevantfactsofthecase,awardagainstthelandlordtothetenant(anamountnotexceedingtwoyears’rent)ascompensationandmay,subjecttorules,imposesuchotherconditionsashethinksfit:
Providedalsothatnonapplicationunderclause(a)shallbeentertained-(i) Forthepurposeofacharitabletrust,theobjectsofwhichprovidefordiscriminationin

him oriswhollydependentonhim]hasbuiltorhasotherwiseacquiredinavacantsateorhasgotvacatedafteracquisitionaresidentialbuildinginthesamecity,municipality,notified area ortown area,no objection bythe tenantagainstanapplicationunderthissub-sectionshallbeentertained.[Note—Forthepurposesofthisclauseapersonshallbedeemedtohaveotherwiseacquiredabuilding,ifheisoccupyingapublicbuildingforresidentialpurposesasatenant,allotteeorlicensee].
(ii) wherethelandlordofanybuildingis—(1)aservingorretiredIndianSoldierasdefinedintheIndianSoldiers(Litigation)Act,
1925(IVof1925),andsuchbuildingwasletoutatanytimebeforehisretirement,or
(2)awidow ofsuchasoldierandsuchbuildingwasletoutatanytimebeforetheretirementordeathordeathofherhusband,whicheveroccurredearlier;andsuchlandlordneedssuchbuildingforoccupationbyhimselforthemembersofthisfamilyforresidentialpurposes,thenhisrepresentationthatheneedsthebuildingforresidentialpurposesforhimselforthemembersofhisfamilyshallbedeemedsufficientforthepurposesofclause(a),andwheresuchlandlordownsmorethanonebuildingthisprovisionshallapplyinrespectofonebuildingonly][1-A]NotwithstandinganythingcontainedinSection2,theprescribedauthorityshall,ontheapplicationofalandlordinthatbehalf,ordertheevictionofatenantfrom anybuildingundertenancy,ifitissatisfiedthatthelandlordofsuchbuildingwasinoccupationofapublicbuildingforresidentialpurposeswhichhehadtovacateononaccountofthecessationofhisemployment:Providedthatanapplicationunderthissub-sectionamyalsobegivenbyalandlordinoccupationofsuchpublicbuildingatanytimewithinaperiodofoneyearbeforetheexpecteddateofcessationofhisemployment,buttheorderofevictiononsuchapplicationshalltakeeffectonlyonthedateofhisactualcessation].
(2)Theprescribedauthoritymayonanapplicationofthelandlordinthatbehalfordertheevictionofatenantfrom anysurpluslandappurtenanttothebuildingundertenancyifitissatisfiedthatthelandisrequiredforconstructingoneormorenewbuildings,orfordividingitintoseveralplotswithaview tothesalethereofforpurposesofconstructionofnewbuildings,andineithercase,thatthecompetentauthorityunderanylawforthetimebeinginforcehasapprovedaplanforthesaidpurpose.Explanation-Wheretheappurtenantlandincludingpassageexceedsdoublethecoveredareaofthebuilding,excessareashallbedeemedtobesurplusland.
(3)Noordershallbemadeundersub-section(12)orsub-section(1-A)orsubsection(2),exceptaftergivingtothepartiesconcernedareasonableopportunityofbeingheard:
ProvidedthatwherethetenantbeingaservantofGovernmentorofanylocalauthorityoranypublicsectorcorporationdoesnotcontesttheapplicationthen a reasonable opportunityofbeing heard shallbe given to the DistrictMagistrate,whoshallhavetherighttoopposetheapplication.]

section(2)],thebuildingorpartofappurtenantland,asthecasemaybe,shallstandreleasedinfavourofthelandlord:
ProvidedthatontheoccurrenceofanyofthecircusstnacesmentionedinSection24,anybuildingorpartthereof(butnotappurtenantandalone)releasedasabove,shallwithoutprejudiceto theprovisionsofSection 24,bedeemed tobecomeaginssubjecttoallotmentinaccordancewithChapterIII.
(6)Ontheexpirationofaperiodofthirdydaysfrom anorderunder[Sub-section(1)orsub-section (1-A)orsub-section (2)],the tenancyofthe tenantshallstanddetermined in itsentiretyorasthe case maybe in respectofanypartorappurtenantlandreleasedinfaourofthelandlord,andinthelatercase,therentpayableforthereminderofthebuildingundertenancyshallbesuchasmaybeagreeduponbetweenthepartiesandintheabsenceofsuchagreementasmaybedeterminedunderSection8.]
(7)Whereduringthependencyofanapplicationunderclause(a)ofsub-section(1),thelandlorddies,hislegalrepresentativesshallbeentitledtoprosecutesuchapplicationfurtheronthebasisoftheirownneedinsubstationoftheneedofthedeceased.

Accordingtosection4(1):-TheStateGovernmentmaybynotificationinthe Gazette,constituteforpurposeofthisAct,anAuthoritytobecalledtheDevelopment Authority for anydevelopmentarea.
Section4(2):- TheAuthorityshallbeabodyCorporatebythenamegiventoit.Inthesaidnotificationhavingperpetualsuccessionandacommonsealwithpowertoacquireholdanddisposeofpropertybothmovableandimmovableandtocontractandshallbythesaidnamesueandbesued.
MemberofaDevelopmentAuthority:-Accordingtosection4(3):-Theauthorityinrespectofadevelopmentareawhichincludesthe
wholeoranypartofacityasdefinedinthe(UttarPradeshMunicipalCorporationAct-1916).Shallconsistofthefollowingmembersnamely-

Providedthata[Municipality]whichimmediatelybeforethecommencementof[theConstitution]waslawfullylevyinganysuchtaxunderthissectionastheninforce,maycontinuetolevythattaxuntilprovisiontothecontraryismadebytheParliament.Accordingtosection131Framingofpreliminaryproposals.-1. WhenaMunicipalitydesirestoimposeatax,itshall,byspecialresolution,frameproposal
specifying—(a) Thetax,beingonethetaxesdescribedinsub-section(1)ofSection128,whichitdesires
toimpose;(b) Thepersonsorclassofpersonstobemadeliable,andthedescriptionofpropertyor
othertaxablethingsorcircumstancesinrespectofwhichtheyaretobemadeliable,exceptwhereandinsofarasanysuchclassordescriptionisalreadysufficientlydefinedunderClause(a)orbythisAct;
(c) Theamountorratelveiablefrom eachsuchpersonorclassofpersons;(d) AnyothermatterreferredtoinSection153,whichtheStateGovernmentrequiresbyrule
tobespecified.2. TheMunicipalityshallalso prepare a draftoftheruleswhich itdesiresthe State
Governmenttomakeinrespectofthematters,referredtoinSection153.3. TheMunicipalityshall,thereuponpublishinthemannerprescribedtheSection94the
proposalsframedundersub-section(1)andthedraftrulesframedundersubsection(2)alongwithanoticeintheform setforthinScheduleIII.
AccordingtoSection134ResolutionofMunicipalitydirectingimpositionoftax-1.When the proposals have been sanctioned by the Prescribed Authority orthe State
GovernmenttheStateGovernmentaftertakingintoconsiderationthedraftrulessubmittedbyMunicipality,shallproceedforthwithtomakeunderSection296suchrulesinrespectoftaxasforthetimebeingitconsidersnecessary.
2.Whentheruleshavebeenmade,theorderofsanctionandacopyoftherulesshallbesenttothe Municipality,and thereupon the Municipality shallby specialresolution directtheimpositionofthetaxwitheffectfrom adatetobespecifiedintheresolution.

AccordingtoSection135Impositionoftax-1.AcopyoftheresolutionpassedunderSection134shallbesubmittedtotheStateGovernment
ifthetaxhasbeensanctionedbytheStateGovernmentandtothePrescribedAuthorityinanyothercase.
2.UponreceiptofthecopyoftheresolutionstheStateGovernmentorPrescribedAuthorityasthecasemaybe,shallnotifyintheofficialGazette,theimpositionofthetaxfrom theappointeddate,andtheimpositionofataxshallinallcasesbesubjecttothecondtionthatithasbeensonotified.
3.Anotificationoftheimpositionofataxundersub-section(2)shallbeconclusiveproofthatthetaxhasbeenimposedinaccordancewiththeprovisionsofthisAct.

(iii) KnowinglyactedasaPresidentorasamemberinamatterotherthanamatterreferredtoinclauses(a)to(g)ofsub-section(2)ofSection32,inwhichhehas,directlyofindirectly,orbyapartner,anyshareorinterestwhetherpecuniaryorofanyothernature,orinwhichhehaswasprofessionallyinterestedonbehalfofaclient,principalorotherperson;or
(iv) BeingalegalpractioneractedorappearedinanysuitorotherproceedingonbehalfofanypersonagainsttheMunicipalityoragainsttheStateGovernmentinrespectofnazulandentrustedtothemanagementoftheMunicipality,oractedorappearedfororonbehalfofanypersonagainstwhom acriminalproceedinghasbeeninstitutedbyoronbehalfoftheMunicipality;or
(v) Abandonedhisordinaryplaceofresidenceinthemunicipalareaconcerned;or(vi) Beenguiltyofmisconductinthedischargeofhisduties;or(vii) Duringthecurrentorthelastprecedingterm oftheMunicipality,actingasPresidentorVice
-President,orasChairmanofaCommittee,orasmemberorinanyotherChairmanofa

Committee,orasmemberorinanyothercapacitywhatever,whetherbeforeorafterthecommencementoftheUttarPradeshUrbanLocalSelf-GovernmentLaws(Amendment)Act,1976,soflagrantlyabusedhisposition,orsowillfullycontravenedanyoftheprovisionsofthisActoranyrule,regulationorbye-law,orcausedsuchlossordamagetofundorpropertyoftheMunicipalityastorenderhim unfittocontinuetobePresident;or
(viii) Been guilty of any other misconduct whether committed before or after thecommencementoftheUttarPradeshUrban LocalSelf-GovernmentLaws(Amendment)Act,1976whetherasPresidentorasVice-President,exercisingthepowersofPresident,orasVice-President,orasmember;or
(ix) CausedlossordamageotanypropertyoftheMunicipality;or(x) MisappropriatedormisusedofMunicipalfund;or(xi) ActedagainsttheinterestoftheMunicipality;or(xii) ContravenedtheprovisionsofthisActortheRulesmadethereunder;or(xiii) Createdanobstacle inameetingoftheMunicipalityinsuchmannerthatitbecomes
impossibleforthe Municipalityto conductitsbusinessin the meeting orinstigatedsomeonetodoso;or
(xiv) WillfullycontravenedanyorderordirectionoftheStateGovernmentgivenunderthisAct;or(xv) Misbehaved withoutany lawfuljustification with the officers oremployees ofthe
Municipality;or(xvi) DisposedofanypropertybelongingtotheMunicipalityatapricelessthanitsmarketvalue;
or(xvii) Encroached,orassistedorinstigatedanyotherpersontoencroachupontheland,building
oranyotherimmovablepropertyoftheMunicipality;Itmaycalluponhim toshow causewithinthetimetobespecifiedinthenoticewhyheshouldnotberemovedfrom office;
ProvidedthatwheretheStateGovernmenthasreasontobelievethattheallegationsdonotappeartobegroundlessandthePresidentisprimafacieguiltyonanyofthegroundsofthissub-sectionresultingintheissuanceoftheshowcausenoticedandproceedingsunderthissub-sectionheshall,from thedateofissuanceoftheshow causenoticecontainingcharges,ceasetoexercise,perform anddischargethefinancialandadministrativepowers,functionsanddutiesofthePresidentuntilheisexoneratedofchargesmentionedintheshowcausenoticeissuedtohim underthissub-sectionandfinalizationoftheproceedingsundersub-section(2-A)andthesaidpowers,functionsanddutiesofthePresidentduringtheperiodofsuchceasing,shallbeexercised,performedanddischargedbytheDistrictMagistrateoranofficernominatedbyhim notbelowtherankofDeputyCollector.
(2-B) AnorderpassedbytheStateGovernmentundersub-section(2-A)shallbefinalandshallnotbequestionedinanycourt.
(4)A Presidentremoved undersub-section (2-A)shallalso cease to be a memberoftheMunicipalityandincaseofremovalonanyofthegroundsmentionedinclause(a)orsub-clause(vi),(vii)or(viii)ofclause(b)ofsub-section(2)shallnotbeeligibleforre-electionasPresidentormemberforaperiodoffiveyearsfrom thedateofhisremoval.
