F’dawn ir-regolamenti, kemm-il darba l-kuntest ma jetiex xort’ora: "ADAMS" tfisser is-sistema tal-amministrazzjoni u estjoni tal- anti-doping immexxija mill-WADA; "assistenza sostanzjali" tfisser persuna li tipprovdi assistenza li tivela kompletament f’dikjarazzjoni bil-miktub iffirmata, l- informazzjoni kollha li din il-persuna jkollha dwar ksur tal-anti- doping, u tikkopera bis-si mal-investigazzjoni u goti ta’ sentenzi ta’ kull ka relatat ma’ dik l-informazzjoni, u gandha tinkludi l- preentazzjoni ta’ xhieda fi proeduri ta’ smig, jekk din tkun mitluba tagmel hekk minn organizzazzjoni tal-anti-doping jew mill-elenku tas-smig. Regolamenti tal-Anti-Doping, 2011

BIS-SAA tas-setgat mogtija bl-artikoli 6(1)(n) u 53 tal-Att dwar l-Isports, il-Ministru tal-Edukazzjoni, Xogol u l-Familja,wara konsultazzjoni mal-Kunsill Malti gall-Isport, gamel dawn ir-regolamenti li ejjin:-

Titolu.1. It-titolu ta’ dawn ir-regolamenti hu r-Regolamenti tal-Anti-Doping, 2011.

Tifsir.2. F’dawn ir-regolamenti, kemm-il darba l-kuntest majetiex xort’ora:

"ADAMS" tfisser is-sistema tal-amministrazzjoni u estjoni tal-anti-doping immexxija mill-WADA;

"assistenza sostanzjali" tfisser persuna li tipprovdi assistenza litivela kompletament f’dikjarazzjoni bil-miktub iffirmata, l-informazzjoni kollha li din il-persuna jkollha dwar ksur tal-anti-doping, u tikkopera bis-si mal-investigazzjoni u goti ta’ sentenzita’ kull ka relatat ma’ dik l-informazzjoni, u gandha tinkludi l-preentazzjoni ta’ xhieda fi proeduri ta’ smig, jekk din tkun mitlubatagmel hekk minn organizzazzjoni tal-anti-doping jew mill-elenkutas-smig. L-informazzjoni provduta gandha tkun kredibbli ugandha tikkonsisti f’parti importanti minn kull ka li ngata l-bidutiegu, jew, jekk f’ka li l-ebda ka ma nfeta, gandha tkun provdietbai suffijenti li fuqha seta’ jitressaq ka;

Organizzazzjonijiet nazzjonali tal-anti-doping jistgħu jiddeëiedu li jittestjaw u japplikaw ir-regolamenti tal-anti-doping għal kompetituri fuq livell rikreattiv jew tal-masters lipreŜentement jew potenzjalment mhumiex kompetituri ta’ kalibrunazzjonali. Organizzazzjonijiet nazzjonali tal-anti-doping mhumiexmarbuta, madankollu, li japplikaw l-aspetti kollha tal-Kodiëi għaldawn il-persuni. Regolamenti speëifi ëi nazzjonali jistgħu jiāustabbiliti għall-kontroll tad-doping għall-kompetituri ta’ livell mhuxinternazzjonali jew nazzjonali mingħajr ma jkunu f’kunflitt mal-Kodiëi. Għalhekk, pajjiŜ jista’ jiddeëiedi li jittestja kompetituri ta’livell rikreattiv iŜda ma jistipulax eŜenzjonijiet għall-uŜu terapewtikujew il-whereabouts information. Bl-istess mod, organizzazzjoni ta’avvenimenti maāāuri li torganizza avveniment biss għall-kompetiturifuq livell tal-masters tista’ tiddeëiedi li tittestja il-kompetituri iŜda matistipulax eŜenzjonijiet għall-uŜu terapewtiku jew il-whereaboutsinformation bil-quddiem. Għall-finijiet tal-għoti jew tentattiv għall-għoti, u għall-finijiet ta’ informazzjoni u edukazzjoni dwar l-anti-doping, kull persuna li tipparteëipa fi sport taħt l-awtorità ta’ kullfirmatarju, gvern, jew organizzazzjoni sportiva oħra li taëëetta l-Kodiëi, hi atleta;

"atleta ta’ livell nazzjonali" tfisser atleta, minbarra atleta ta’livell internazzjonali li jiāi nnominat mill-organizzazzjoni nazzjonalital-anti-doping sabiex ismu jiāi inkluŜ fir-registered testing pool tal-organizzazzjoni nazzjonali tal-anti-doping;

"atleti ta’ livell internazzjonali" tfisser atleta nnominat minnFederazzjoni Internazzjonali waħda jew aktar li jkun fir-registeredtesting pool għal federazzjoni internazzjonali;

"avveniment" tfisser serje ta’ kompetizzjonijiet individwalimmexxija flimkien taħt organizzazzjoni regolatorja waħda;

"avveniment internazzjonali" tfisser avveniment fejnorganizzazzjoni sportiva internazzjona li hija l-korp regolatorju għall-avveniment jew li taħtar l-uffiëjali tekniëi għall-avveniment;

"avveniment nazzjonali" tfisser kull avveniment sportiv lijinvolvi fih atleti ta’ livell internazzjonali jew nazzjonali li ma jkunxavveniment internazzjonali;

"CAS" tfisser il-Qorti tal-Arbitraāā tal-Isport;

"doping" tfisser l-okkorrenza ta’ waħda jew aktar ksur tar-regolital-anti-doping imsemmija fir-regolament 3;

"l-ebda notifika bil-quddiem" tfisser kontroll tad-doping li jsirmingħajr avviŜ minn qabel lill-atleta u fejn l-atleta jiāi kontinwamentakkumpanjat u ssorveljat mill-mument tan-notifika sal-provvista tal-kampjun;

"l-ebda tort jew negliāenza" tfisser il-preŜentazzjoni ta’ provimill-atleta li hu ma kienx jaf jew ma ssuspettax, u ma setax ikun jafjew jissuspetta b’mod raāonevoli anki bl-aktar kawtela li hu uŜa jewingħata sustanza projbita jew metodu projbit;

"l-ebda tort jew negliāenza sinifikanti" tfisser il-preŜentazzjonita’ provi mill-atleta li t-tort jew negliāenza tiegħu, meta wieħedjeŜamina t-totalità taë-ëirkostanzi u b’konsiderazzjoni tal-kriterji tal-ebda tort jew negliāenza, ma kinux sinifikanti fir-relazzjoni mal-ksurtar-regoli tal-anti-doping;

"elenku nazzjonali dixxiplinarju tal-anti-doping" tfisser l-elenkuappuntat mill-gvern jew mill-Kunsill sabiex jaāāudika fuq ksurallegat ta’ dawn ir-regolamenti, sakemm is-CAS mhijiex preferita

"elenku nazzjonali tal-appell tal-anti-doping" tfisser l-elenkuappuntat mill-Gvern jew mill-Kunsill sabiex jaāāudika f’appelli minndeëiŜjonijiet tal-elenku nazzjonali dixxiplinarju tal-anti-doping;

"firmatarji" tfisser dawk l-entitajiet li jiffirmaw il-Kodiëi ujaqblu li jkunu konformi mal-Kodiëi u mal-WADA;

"in-competition" tfisser il-perjodu li jibda tnax-il siegħa qabelkompetizzjoni li fiha l-atleta hu ppjanat li jipparteëipa sal-aħħar ta’din il-kompetizzjoni u l-proëess tal-ābir tal-kampjun relatat ma’ dinil-kompetizzjoni, kemm-il darba ma jkunx stipulat mod ieħor fir-regolamenti tal-Federazzjoni Internazzjonali jew organizzazzjonirilevanti oħra tal-anti-doping;

"ineliāibbiltà" tfisser li l-atleta jew persuna oħra jkunu projbitigħall-perjodu ta’ Ŝmien speëifikat milli jie ħdu sehem f’ xikompetizzjoni jew attività oħra jew għal fondi kif stipulat fil-Kodiëitaħt l-‘Istatus waqt l-Ineliāibilità;

"ittestjar" tfisser l-partijiet tal-proëess tal-kontroll tad-doping lijinvolvu l-ippjanar tad-distribuzzjoni ta’ testijiet, ābir ta’ kampjuni,immaniāājar ta’ kampjuni, u trasport ta’ kampjuni lejn laboratorji;

"KAD" tfisser għall-Kummissjoni tal-Anti-Doping maħturamill-Ministru responsabbli għall-Isport biex jissorvelja l-aspetti kollhatal-Programm tal-anti-doping tal-organizzazzjoni tal-anti-doping(NADO) skont l-istandard internazzjonali għat-testijiet. Il-

Kummissjoni tal-Anti-Doping għandha tkun magħmula minnchairperson u minimu ta’ tlett sa massimu ta’ ħames membri oħrab’kompetenza fil-qasam tal-anti-doping;

"kampjun" jew "kampjuni" tfisser kull materjal bijoloāikumiābur għall-finijiet tal-kontroll tad-doping;

"il-Kodi ëi" tfisser l-Kodiëi Dinji ta’ Kontra d-Doping li āieadottat għall-ewwel darba mill-WADA fil-5 ta’ Marzu 2003 u kullemenda sussegwenti* ;

"kompetizzjoni" tfisser tellieqa, partita, logħba jew kuntestatletiku waħdieni. Għal tlielaq fi stadji jew kuntesti oħra tal-atletikafejn il-premjijiet jingħataw kuljum jew fuq baŜi oħra temporanja, id-distinzjoni bejn kompetizzjoni u avveniment tkun kif stipulata fir-regolamenti tal-Federazzjoni Internazzjonali applikabbli;

"konsegwenzi għall-ksur tar-regolamenti tal-anti-doping" tfisserksur minn atleta jew persuna oħra tar-regola tal-anti-doping li jista’jwassal għal skwalifika, ineliāibbiltà u sospensjoni proviŜorja;

"kontroll tad-doping" tfisser l-istadji u l-proëessi kollha mill-ippjanar tad-distribuzzjoni tat-testijiet sad-disposizzjoni finali ta’ kullappell inkluŜi l-istadji u l-proëessi kollha applikabbli fl-intervall,inkluŜa l-provvista tal-whereabouts information, ābir u mmaniāājarta’ kampjuni, analiŜi f’laboratorji, eŜenzjonijiet għall-uŜuterapewtiku, āestjoni ta’ riŜultati u seduti tas-smigħ;

"Konvenzjoni tal-UNESCO" tfisser il-KonvenzjoniInternazzjonali kontra d-Doping fl-Isport adotatta permezz tat-33sessjoni tal-Konferenza Āenerali tal-UNESCO fid-19 ta’ Ottubru2005 inkluŜi l-emendi kollha adottati mill-Istati Partijiet għall-Konvenzjoni u l-Konferenza tal-Partijiet għall-KonvenzjoniInternazzjonali kontra d-Doping fl-Isport;

"Kumitat Olimpiku Nazzjonali" tfisser l-organizzazzjonirikonoxxuta mill-Kumitat Olimpiku Internazzjonali;

"il-Kunsill" tfisser l-Kunsill Malti għall-Isport li āie mwaqqafskont l-artikolu 4 tal-Att;

"lista projbita" tfisser l-lista tal-WADA li tidentifika s-sustanziprojbiti u l-metodi projbiti kif aāāornata minn Ŝmien għall-Ŝmien;

"marker" tfisser kompoŜizzjoni, grupp ta’ kompoŜizzjonijietjew parametru jew parametri bijoloāiëi li jindikaw l-uŜu jew nuqqas

"metaboliti" tfisser kull sustanza prodotta permezz ta’ proëessta’ bijotrasformazzjoni;

"metodu projbit" tfisser kull metodu kif deskritt fil-listaprojbita;

"minorenni" tfisser kull persuna fiŜika li għadha ma laħqitx l-etàmaāāorenni kif inhu stabbilit fil-liāijiet applikabbli tal-pajjiŜ tar-residenza tal-persuna;

"organizzazzjoni tal-anti-doping" tfisser firmatarju li huresponsabbli għall-adozzjoni tar-regolamenti, għall-introduzzjoni,għall-implimentazzjoni jew infurzar ta’ kull parti tal-proëess tal-kontroll tad-doping;

"organizzazzjoni nazzjonali tal-anti-doping" tfisser l-entità jewentitajiet, nominata minn kull pajjiŜ, li għandha l-awtorità uresponsabbiltà prinëipali sabiex tadotta u timplimenta r-regolamentital-anti-doping, tikkontrolla l-ābir ta’ kampjuni, il-āestjoni tar-riŜultati tat-testijiet, u t-tmexxija tas-seduti tas-smigħ, kollha fuqlivell nazzjonali. Għall-finijiet ta’ dawn ir-regolamenti, il-Kunsillhuwa l-entità maħtura;

"organizzazzjonijiet ta’ avvenimenti maāāuri" tfisserassoëëjazzjonijiet kontinentali ta’ kumitati olimpiëi nazzjonali uorganizzazzjonijiet multi-sportivi internazzjonali oħra li għandhom il-funzjoni ta’ korp regolatorju għal kull avveniment kontinentali,reājonali jew internazzjonali ieħor;

"out of competition" tfisser kull kontroll tad-doping li mhux in-competition;

"parteëipant" tfisser kull atleta jew persunal tal-appoāā tal-atleta;

"persuna" tfisser persuna naturali jew organizzazzjoni jew entitàoħra;

"Persunal tal-appoāā tal-atleta" tfisser kowë, trejner, maniāer,aāent, staff tat-tim, uffiëjal, personal mediku, paramediku, āeniturjew kull persuna oħra li taħdem ma’, tikkura jew tassisti atleta li jkunqed jipparteëipa f’kompetizzjoni sportiva jew iħejji ruħu għaliha;

"programm ta’ osservatur indipendenti" tfisser tim ta’osservaturi, taħt is-superviŜjoni tal-WADA, li josserva u jista’jipprovdi gwida fil-proëess tal-kontroll tad-doping f’ ëerti

"pussess" tfisser l-pussess fiŜiku, attwali, jew il-pussesskostruttiv, li għandu jinsab biss jekk il-persuna għandha l-kontrollesklussiv fuq is-sustanza projbita jew il-metodu projbit jew il-fondfejn tinsab is-sustanza projbita jew metodu projbit:

IŜda, jekk il-persuna ma għandhiex kontroll esklussiv fuqis-sustanza projbita jew metodu projbit jew il-fond fejn tinsab is-sustanza projbita, pussess kostruttiv għandu jinsab biss jekk il-persuna kienet taf bil-preŜenza tas-sustanza projbita jew metoduprojbit u kellha l-ħsieb li teŜerëita’ l-kontroll fuqhom:

IŜda wkoll, ma jkun hemm l-ebda ksur tar-regoli tal-anti-doping fuq baŜi ta’ pussess biss, jekk, qabel ma tirëievi notifika ta’kull xorta, li l-persuna kkommettiet ksur tar-regoli tal-anti-doping, il-persuna ħadet azzjoni konkreta li turi li l-persuna qatt ma kellha l-intenzjoni li jkollha l-pussess u rrinunzjat il-pussess billi tiddikjarahb’mod espliëitu lill-Organizzazzjoni Nazzjonali tal-anti-doping:

IŜda wkoll li minkejja kull ħaāa kontra din it-tifsira, ix-xiri, inkluŜ dak b’kull mezz elettroniku jew mezz ieħor, ta’ sustanzaprojbita jew metodu projbit jikkostitwixxi pussess mill-persuna litagħmel ix-xiri;

"registered testing pool" tirreferi għall-grupp ta’ atleti tal-ogħlalivell stabbilit separatament minn kull federazzjoni internazzjonali uorganizzazzjoni nazzjonali tal-anti-doping li huma soāāetti kemmgħal in-competition kif ukoll għal out-of-competition testing bħalaparti mill-pjan għad-distribuzzjoni ta’ testijiet ta’ dik il-federazzjoniinternazzjonali jew organizzazzjoni nazzjonali tal-anti-doping;

"sejba analitika avversa" tfisser rapport minn laboratorju jewentità oħra tal-Ittestjar approvata li tidentifika li f’kampjun ikunhemm il-preŜenza ta’ sustanza projbita jew il-metaboliti jew markerstagħha, inkluŜi kwantitajiet għoljin ta’ sustanzi indoāeniëi, jewevidenza tal-uŜu ta’ metodu projbit;

"sejba atipika" tfisser rapport minn laboratorju jew entità oħraapprovata mill-WADA li jesiāi aktar investigazzjoni kif inhu stipolatfl-istandard internazzjonali għal laboratorji jew dokumenti tekniëirelatati qabel id-determinazzjoni ta’ sejba analitika avversa;

"skwalifika" tfisser ir-riŜultati ta’ atleta f’kompetizzjoni jewavveniment partikolari jiāu invalidati, bil-konsegwenzi kollhariŜultanti, inkluŜ it-telf ta’ xi medalji, punti u premjijiet;

"smigħ proviŜorju" tfisser smigħ abbrevjat mingħajr dewmien lijsir qabel is-seduta tas-smigħ taħt ir-regolament 8 li jistipola li l-atletajkun notifikat u jkollu l-opportunità li jagħti x-xhieda tiegħu bil-miktub jew bil-fomm;

"sospensjoni proviŜorja" tfisser li l-atleta jew persuna oħrajkunu projbiti temporanjament milli jieħdu sehem f’kullkompetizzjoni qabel id-deëiŜjoni finali fi proëeduri ta’ smigħ li jsiruskont ill-prinëipju tad-‘Dritt ta’ Smigħ Āust’;

"sport individwali" tfisser kull sport li mhux team sport;

"standard internazzjonali" tfisser standard adottat mill-WADAb’appoāā għall-Kodiëi. Konformità ma’ standard internazzjonalib’kuntrast ma’ standard, prattika jew proëedura oħra alternattivagħandha tkun suffiëjenti sabiex jiāi konkluŜ li l-proëeduri indirizzatipermezz tal-istandard internazzjonali twettqu b’mod xieraq.Standards internazzjonali għandhom jinkludu kull dokument teknikumaħruā b’mod konformi mal-istandard internazzjonali;

"sustanza projbita" tfisser kull sustanza kif deskritta fil-listaprojbita;

"sustanza speëifikata" għandu jkollha l-istess tifsira bħal dikmogħtija taħt ir-regolament 5(3);

"target testing" tfisser l-għaŜla ta’ atleti għall-ittestjar fejn atletispeëifi ëi jew grupp ta’ atleti speëifiku jintgħaŜlu b’mod mhuxaleatorju sabiex jiāu ttestjati fi Ŝmien speëifiku;

"team sport" tfisser sport li fih is-sostituzzjoni tal-plejers hipermessa matul il-kompetizzjoni;

"tentattiv" tfisser għall-involviment fi māieba li tikkostitwixxipass sostanzjali f’linja ta’ māieba li tista' jew wasslet għall-ksur tar-regoli tal-anti-doping; b’dan illi ma għandux ikun hemm ksur tar-regoli tal-anti-doping ibbaŜat biss fuq tentattiv sabiex isir ksur, jekkil-persuna tirrinunzja t-tentattiv qabel ma tiāi skoperta minn terzapersuna mhux involuta fit-tentattiv;

"traffikar" tfisser l-bejgħ, l-għoti, it-trasport, it-trasmissjoni, il-kunsinna jew id-distribuzzjoni jew it-tqassim ta’ sustanza projbitajew metodu projbit fiŜikament kif ukoll b’kull mezz elettroniku jewb'mezzi oħra minn atleta, personal tal-appoāā tal-atleta jew xi persunaoħra soāāetta għall-āurisdizzjoni ta’ organizzazzjoni tal-anti-dopinglil kull terza persuna, bil-kondizzjoni, madankollu, li din it-tifsira magħandhiex tinkludi l-azzjonijiet bona fide ta’ personal mediku lijinvolvu sustanza projbita uŜata għal finijiet terapewtiëi āenwini ulegali jew āustifikazzjoni oħra aëëettabbli, u ma għandhiex tinkludiazzjonijiet li jinvolvu sustanzi projbiti li mhumiex projbiti fl-out-of-competition testing, ħlief, jekk ië-ëirkostanzi b'mod āenerali juru lidawn is-sustanzi projbiti mhumiex maħsuba għal finijiet terapewtiëiāenwini u legali;

"TUE" tfisser l-eŜenzjoni għall-uŜu terapewtiku;

"uŜu illeëitu" tfisser l-uŜu, applikazzjoni, ināestjoni, injezzjonijew konsum b’ kull mezz ieħor ta’ kwalunkwe sustanza projbita jewmetodu projbit;

"WADA" tfisser l-Aāenzija Dinjija tal-Anti-Doping bħalafondazzjoni kostitwita skont il-Kodiëi êivili tal-I Ŝvizzera f’Lausannefl-10 ta’ Novembru 1999 u kull Organizzazzjoni Nazzjonali tal-Anti-Doping li jkollha kuntratt mal-WADA;

"Ŝmien tal-avveniment" tfisser iŜ-Ŝmien bejn il-bidu u t-tmiemta’ avveniment, kif stabbilit mill-korp regolatorju tal-avveniment; u

"Ŝvelar lill-pubbliku" jew "tħejjija ta’ rapporti għall-pubbliku"tfisser t-tixrid jew distribuzzjoni ta’ informazzjoni lill-pubblikuāenerali jew lil persuni minbarra dawk il-persuni li huma intitolatigħal notifika minn qabel skont id-disposizzjonijiet rilevanti tal-Kodiëi.

Responsabbilta-jiet ta’ atleti u persuni.

3. (1) Atleti jew persuni għandhom ikunu humaresponsabbli għall-għarfien dwar x’jikkostitwixxi ksur tar-regoli tal-anti-doping u s-sustanzi u metodi li āew inkluŜi fil-lista projbita.

(2) Hu d-dover personali ta’ kull atleta li jassigura li l-ebdasustanza projbita ma tidħol f’ āismu. L-atleti huma responsabbli għalkull sustanza projbita jew il-metaboliti jew markers tagħha misjubapreŜenti f’kampjuni tagħhom. Għalhekk, mhux neëessarju liintenzjoni, tort, negliāenza jew konoxxenza tal-uŜu mill-parti tal-atleta jiāu ppruvati sabiex jiāi stabbilit ksur tal-anti-doping skont danis-subregolamenti u s-subregolamenti (3) sa (6).

(3) Prova suffiëjenti tal-ksur tar-regoli tal-anti-doping ta’ danis-subregolament u s-subregolamenti (2), u (4) sa (6) tiāi stabbilita

permezz ta’ waħda minn dawn li āejjin:

(a) preŜenza ta’ sustanza projbita jew il-metaboliti jewmarkers tagħha fil-kampjun A tal-atleta fejn l-atleta jirrifjuta lijagħmel l-analiŜi tal-kampjun B u l-kampjun B ma jiāixanalizzat; jew

(b) fejn il-kampjun B tal-atleta jiāi analizzat u l-analiŜital-kampjun B tal-atleta tikkonferma l-preŜenza ta’ sustanzaprojbita jew il-metaboliti jew markers tagħha misjuba fil-kampjun A tal-atleta.

(4) B’Ŝieda ma’ dan, l-Organizzazzjoni Nazzjonali tal-Anti-Doping tista’, u fid-diskrezzjoni tagħha, tiddeëiedi li l-kampjun B jiāianalizzat, anki jekk l-atleta ma jitlobx l-analiŜi tal-kampjun B.

(5) Minbarra dawk is-sustanzi li għalihom hemm identifikatb’mod speëifiku l-livell kwantitattiv fil-lista projbita, il-preŜenza ta’kull kwantità ta’ sustanza projbita jew il-metaboliti jew il-markerstagħha f’kampjun ta’ atleta għandha tikkostitwixxi ksur tar-regolament tal-anti-doping.

(6) Bħala eëëezzjoni għar-regola āenerali tas-subregolamenti(2) sa (5), il-lista projbita jew standards internazzjonali jistgħujistabbilixxu kriterji speëjali għall-evalwazzjoni ta’ sustanzi projbiti lijistgħu jiāu prodotti wkoll b’mod indoāeniku.

(7) Is-suëëess jew falliment tal-uŜu jew tentattiv għall-uŜu ta’sustanza projbita jew metodu projbit hu irrilevanti. Hu biŜŜejjed li s-sustanza projbita jew metodu projbit jkunu intuŜaw jew sar tentattivbiex jintuŜaw sabiex isir ksur tar-regoli tal-anti-doping.

(8) Rifjut jew jekk atleta jonqos, mingħajr āustifikazzjonikonvinëenti, milli jissottometti ruħu għall-ābir tal-kampjun wara n-notifika kif inhu awtorizzat f’dawn ir-regolamenti jew inkella jevadil-ābir tal-kampjun għandha tkun kondotta projbita sew jekk dan il-ksur ta’ rifjut jew nuqqas sabiex l-atleta jissottometti ruħu għall-ābirtal-kampjun tirriŜulta mill-imāieba intenzjonata tal-atleta jewimāieba negliāenti tal-atleta. Fil-kaŜ li atleta jevadi s-sottomissjonitiegħu għall-ābir tal-kampjun, din l-imāieba għandha tiāi kkunsidratabħala māieba intenzjonata mill-atleta.

(9) Ksur tal-ħtiāiet applikabbli rigward id-disponibbiltà tal-atleta għall-ittestjar out-of-competition stipulati fl-istandardinternazzjonali għall-ittestjar, inkluŜ in-nuqqas tal-provvista tal-whereabouts information mingħand il-persuna b’mod konformi mal-artikolu 11.3 tal-Istandard Internazzjonali għall-Ittestjar, li jipprovdi

għal ‘Filing Failure’ u n-nuqqas tad-disponibbiltà għall-ittestjar fil-post iddikjarat b’mod konformi mal-artikolu 11.4 tal-IstandardInternazzjonali għall-Ittestjar li jipprovdi għal ‘Test MaqbuŜ’. Kulltgħaqid ta’ tliet testijiet maqbuŜa u, jew filing failures kommessif’perjodu ta’ tmintax-il xahar, kif dikjarat mill-Kunsill, għandujikkostitwixxi ksur tar-regoli tal-anti-doping.

(10) Pussess minn atleta f'in-competition ta’ kull metodu projbitjew kull sustanza projbita, jew pussess minn atleta f’out-of-competition ta’ kull metodu projbit jew kull sustanza projbita li hiprojbita fl-out-of-competition, sakemm l-atleta ma jistabbilixxix li l-pussess hu b’mod konformi mat-TUE mogħtija b’mod konformi mar-regolament 5(5) sa (8) jew āustifikazzjoni aëëettabbli;

(11) Pussess minn persunal tal-appoāā tal-atleta f'in-competition ta’ kull metodu projbit jew kull sustanza projbita, jewpussess minn personal għall-appoāā tal-atleta f’out-of-competition ta’kull metodu projbit jew kull sustanza projbita li hi projbita fl-out-of-competition testing, b’konnessjoni mal-atleta, kompetizzjoni jewtaħriā, kemm-il darba l-persunal tal-appoāā tal-atleta majistabbilixxix li l-pussess hu b’mod konformi mat-TUE mogħtija lilatleta b’mod konformi mar-regolament 5(5) sa (8) jew āustifikazzjoniaëëettabbli;

(12) Traffikar jew tentattiv ta’ traffikar ta’ kull sustanza projbitajew metodu projbit;

(13) Għoti jew tentattiv ta’ għoti lil kull atleta f'in-competitionta’ kull metodu projbit jew sustanza projbita, jew għoti jew tentattivtal-għoti lil kull atleta f'out-of-competition ta’ kull metodu projbit,jew kull sustanza projbita li hi projbita fl-ittestjar out-of-competitiontesting jew jassisti, jinkoraāixxi, jgħin, iħajjar, jaħbi jew kull formaoħra ta’ kompliëità li tinvolvi l-ksur tar-regoli tal-anti-doping jewkwalunkwe tentattiv ta’ ksur tar-regoli tal-anti-doping.

Responsabbiltà tal-KAD u tal-assoëjazzjonijiet nazzjonali li jistabbilixxxu ksur tal-liāi.

4. (1) Il-KAD u, jew, l-assoëjazzjonijiet nazzjonali humainkarigati bir-responsabbiltà sabiex jistabbilixxu jekk sarx ksur tar-regoli tal-anti-doping. Il-Kunsill ser ikollu t-tribunal dixxiplinarjutiegħu għad-determinazzjoni ta’ dan il-ksur, li l-assoëjazzjonijietnazzjonali jistgħu jagħmlu uŜu minnu jekk dawn tal-aħħar magħandhomx tribunal dixxiplinarju tagħhom. Ksur ta’ dawn ir-regolamenti għandu jiāi stabbilit jekk il-Kunsill u, jew l-assoëjazzjoninazzjonali jistgħu jippruvaw għas-sodisfazzjon tat-tribunaldixxiplinarju, b’konsiderazzjoni tal-gravità tal-allegazzjoni li tkunsaret, li kien hemm il-ksur ta’ xi waħda mid-disposizzjonijiet tar-regolament 3. Dan il-grad ta’ prova fil-kaŜi kollha hu akbar minnsempliëiment bilanë tal-probabbiltà iŜda inqas minn prova bla ebda

dubju raāonevoli. Fejn dawn ir-regolamenti jpoāāu l-piŜ tal-prova fuql-atleta jew persuna oħra li allegatament ikkommettiet ksur tar-regolital-anti-doping sabiex tirrispināi preŜunzjoni jew tistabbilixxi fattijew ëirkustanzi speëifikati, il-grad tal-prova għandu jkun permezz ta’bilanë tal-probabbiltà, minbarra kif inhu stipolat fl-artikoli 10.4 u10.6 tal-Kodiëi fejn l-atleta jrid jissodisfa piŜ ta’ prova ogħla.

(2) Fatti relatati ma’ ksur tar-regoli tal-anti-doping jistgħu jiāustabbiliti permezz ta’ kull mezz ta’ min joqgħod fuqu, inkluŜiammissjonijiet. Ir-regolamenti ta’ prova li āejjin għandhom ikunuapplikabbli f’kaŜi tad-doping:

(a) hu preŜunt li laboratorji akkreditati mill-WADAwettqu analiŜi u proëeduri ta’ kustodja tal-kampjun b’modkonformi mal-istandard internazzjonali għall-analiŜif’laboratorji. L-atleta jew persuna oħra jistgħu jirribattu din il-preŜunzjoni billi jistabbilixxu li seħħet devjazzjoni mill-istandard internazzjonali li setgħet ikkawŜat b’mod raāonevolis-sejba analitika avversa. Jekk l-atleta jew persuna oħrajirrispināi l-preŜunzjoni preëedenti billi juri li seħħetdevjazzjoni mill-istandard internazzjonali li setgħet ikkawŜatb’mod raāonevoli s-sejba analitika negattiva f’dak il-kaŜ l-KADjew l-assoëjazzjoni nazzjonali għandha r-responsabbiltà litistabbilixxi li din id-devjazzjoni ma kkawŜatx is-sejba analitikanegattiva;

(b) devjazzjonijiet minn xi standard internazzjonaliieħor jew regola jew politika oħra tal-anti-doping li makkawŜatx sejba analitika negattiva jew ksur ieħor tar-regoli tal-anti-doping ma għandux jinvalida dawn ir-riŜultati. Jekk l-atletajew persuna oħra jistabbilixxu li seħħet devjazzjoni minnstandard internazzjonali ieħor, jew regola jew politika oħra tal-anti-doping li setgħet ikkawŜat b’mod raāonevoli s-sejbaanalitika negattiva jew ksur ieħor tar-regoli tal-anti-doping,f’dak il-kaŜ l-KAD jew l-assoëjazzjoni nazzjonali għandha r-responsabbiltà li tistabbilixxi li dik id-devjazzjoni ma kkawŜatxis-sejba analitika negattiva jew il-baŜi fattwali għall-ksur tar-regoli tal-anti-doping;

(ë) il-fatti stabbiliti permezz ta’ deëiŜjoni finali ta’qorti jew tribunal dixxiplinarju professjonali tal-āurisdizzjonikompetenti għandhom ikunu evidenza irribattibbli kontra l-atleta jew persuna oħra li għalihom id-deëiŜjoni tagħmel partiminn dawk il-fatti, kemm-il darba l-atleta jew persuna oħra majistabbilixxux li d-deëiŜjoni kissret il-prinëipju tal-āustizzjanaturali; u

(d) l-elenku tas-smigħ fi proëedura tas-smigħ dawnksur tar-regoli tal-anti-doping jista’ jikkonkludi b’mod negattivgħall-atleta jew persuna oħra li allegatament ikkomettew ksurtar-regoli tal-anti-doping fuq baŜi tar-rifjut tal-atleta jewpersuna oħra, wara li tkun saret talba magħmula fi Ŝmienraāonevoli qabel is-smigħ, sabiex jidhru għas-smigħ, jew bil-preŜenza tagħhom jew b’mod telefoniku kif ordnat mit-tribunalu jwieābu għal mistoqsijiet jew mit-tribunal jew mill-KAD jewmill-assoëjazzjoni nazzjonali li tasserixxi l-ksur tar-regoli tal-anti-doping.

Lista Projbita. 5. (1) Dawn ir-regolamenti jinkorporaw il-lista projbita lihi ppubblikata u riveduta mill-WADA kif deskritt fl-artikolu 4.1 tal-Kodiëi. Il-Kunsill jew l-awtorità delegata minnu tippubblika dawn il-listi riveduti fil-Gazzetta tal-Gvern u barra minn hekk, tagħmel il-listaprojbita attwali disponibbli lil kull assoëjazzjoni nazzjonali u kullassoëjazzjoni nazzjonali għandha tassigura li l-lista projbita attwali hidisponibbli għall-membri tagħha rreāistrati.

(2) Sakemm ma jkunx provdut mod ieħor fil-lista projbita u,jew reviŜjoni, il-lista projbita u reviŜjonijiet li għandhom jidħlu fis-seħħ taħt dawn ir-regolamenti tliet xhur wara l-pubblikazzjoni tal-lista projbita mill-WADA mingħajr il-ħtieāa ta’ xi azzjoni oħra mill-Kunsill. Il-Kunsill għandu jippubblika wkoll il-lista projbita u, jewreviŜjoni u, jew aāāornamenti fil-Gazzetta tal-Gvern.

(3) Għall-finijiet tal-applikazzjoni tas-sanzjonijiet fuqindividwi, is-sustanzi projbiti kollha għandhom ikunu sustanzispeëifi ëi minbarra s-sustanzi fil-klassijiet ta’ sustanzi u ormonianaboliëi, u dawk l-istimulanti u l-antagonisti u modulaturi tal-ormoni kif identifikati fil-lista projbita. Metodi projbiti magħandhomx ikunu sustanzi speëifi ëi:

IŜda f’kaŜ li l-WADA tespandi l-lista projbita biŜ-Ŝieda ta’klassi ādida ta’ sustanzi projbiti skont l-artikolu 4.1 tal-Kodiëi, il-kumitat eŜekuttiv tal-WADA għandu jiddetermina jekk kwalunkwejew is-sustanzi projbiti kollha fil-klassi l-ādida ta’ sustanzi projbitigħandhomx jiāu kkonsidrati bħala sustanzi speëifi ëi taħt l-artikolu4.2.2 tal-Kodiëi.

(4) Kif stipolat fl-artikolu 4.4.3 tal-Kodiëi, id-determinazzjonital-WADA ta’ sustanzi projbiti u metodi projbiti li jiāu inkluŜi fil-listaprojbita u l-klassifikazzjoni ta’ sustanzi f’kategoriji fil-lista projbitahija finali u ma għandhiex tkun soāāetta għal oāāezzjoni minn atletajew persuna oħra fuq baŜi ta’ argument li s-sustanza jew metodumhumiex sustanza li taħbi (masking agent) jew ma kellhiex il-potenzjal li ŜŜid il-prestazzjoni, tirrappreŜenta riskju għas-saħħa jew

(5) Atleti b’kondizzjoni medika dokumentata li jeħtieāu l-uŜuta’ sustanza projbita jew metodu projbit għandhom l-ewwel nettjiksbu TUE. Il-preŜenza ta’ sustanza projbita jew il-metaboliti jewmarkers tagħha skont l-artikolu 2.1 tal-Kodiëi, uŜu jew tentattiv ta’uŜu ta’ sustanza projbita jew metodu projbit skont l-artikolu 2.2 tal-Kodiëi, pussess ta’ sustanzi projbiti jew metodi projbiti skont l-artikolu 2.6 tal-Kodiëi jew għoti ta’ sustanza projbita jew metoduprojbit skont l-artikolu 2.8 tal-Kodiëi konsistenti mad-disposizzjonijiet ta’ TUE applikabbli maħruāa skont l-istandardinternazzjonali għat-TUEs ma għandhomx jiāu kkonsidrati bħala ksurtar-regoli tal-anti-doping.

(6) Atleti inkluŜi mill-KAD fir- registered testing pool tagħhau atleti oħra parteëipanti f’kull avveniment nazzjonali għandhomjiksbu TUE mogħtija jew rikonoxxuta mill-Kunsill jew mill-awtoritàdelegata minnu. L-applikazzjoni għal TUE għandha ssir mill-iktar fispossibbli, f’kaŜ ta’ atleta fir-registered testing pool, din issir metaatleta jiāi notifikat għall-ewwel darba bl-inkluŜjoni tiegħu fil-pool ufi kwalunkwe avveniment, minbarra f’sitwazzjonijiet ta’ emerāenza,mhux aktar tard minn tletin āurnata qabel il-parteëipazzjoni tal-atletafl-avveniment.

(7) Il-KAD għandha tiddelega din l-awtorità lil elenku ta’speëjalisti sabiex jikkunsidraw talbiet għal TUEs, minn hawn il-quddiem l-"Elenku tat-TUE". Hekk kif il-Kunsill jirëievi talba għalTUE, ië-êhairman tal-Elenku tat-TUE għandu jaħtar membru jewdiversi membri tal-Elenku tat-TUE, li jistgħu jinkludu ë-êhairman,sabiex jikkonsidra din it-talba. Kull membru tal-Elenku tat-TUEmaħtur b’dan il-mod għandu jevalwa minnufih din it-talbab’konformità mal-istandard internazzjonali għat-TUEs u jgħaddi d-deëiŜjoni ta’ dawn it-talbiet, li għandha tkun id-deëiŜjoni finali tal-Kunsill jew l-awtorità delegata minnu.

(8) Il-WADA, fuq talba ta’ atleta jew fuq inizjattiva tagħha,tista’ tirrevedi l-għoti jew ië-ëaħda ta’ kull TUE lil atleta ta’ livellinternazzjonali jew atleta ta’ livell nazzjonali li jkunu inkluŜi fir-registered testing pool. Jekk il-WADA tiddetermina li l-għoti jew ië-ëaħda tat-TUE ma kinitx konformi mal-istandard internazzjonaligħat-TUEs fis-seħħ f’dak il-perjodu, il-WADA tista’ tirrevoka dik id-deëiŜjoni. DeëiŜjonijiet fuq TUEs huma soāāetti għall-appell ieħorkif stipulat fir-regolament 14.

Testijiet In-Competitition.

6. (1) L-atleti kollha affiljati ma’ assoëjazzjoni nazzjonaligħandhom ikunu soāāetti għal in-competition testing mill-assoëjazzjoni nazzjonali tal-atleta, federazzjoni internazzjonali, il-

L-atleti kollha affiljati ma’assoëjazzjoni nazzjonali, inkluŜi atleti li qegħdin iservu perjodu ta’ineliāibbiltà jew sospensjoni proviŜorja, għandhom ikunu soāāettiwkoll għall-out-of-competition testing f’kull ħin jew post, b’notifikabil-quddiem jew mingħajrha, mill-assoëjazzjoni nazzjonali, il-federazzjoni internazzjonali tal-atleta, il-WADA, il-KAD, l-organizzazzjoni nazzjonali tal-anti-doping ta’ kwalunkwe pajjiŜ fejnl-Atleta hu ëittadin, resident, detentur tal-liëenzja jew membru ta’organizzazzjoni sportiva, il-kumitat olimpiku internazzjonali matul il-logħob tal-olimpjadi, u l-kumitat paraolimpiku internazzjonali matulil-logħob paraolimpiku.

(2) Testijiet mitluba mill-KAD jitħallsu mill-Kunsill stess.Testijiet oħra li jsiru f’Malta minn federazzjoni internazzjonali jewassoëjazzjoni nazzjonali għandhom jiāu notifikati lill-KAD fi Ŝmientmienja u erbgħin siegħa qabel isiru dawn it-testijiet u javŜaw ukolllill-KAD bir-ri Ŝultati ta’ dawn it-testijiet fi Ŝmien sebat ijiem minnmeta jkunu rëevuti bil-miktub.

(3) F’avvenimenti internazzjonali, il-ābir ta’ kampjuni għall-kontroll tad-doping għandhom jinbdew u jiāu ssorveljati minnorganizzazzjoni internazzjonali li tkun il-korp regolatorju tal-avveniment. Jekk l-organizzazzjoni internazzjonali tiddeëiedi li matagħmilx testijiet effettivi f’dan l-avveniment, l-KAD tista’,b’kordinazzjoni ma’ jew bl-approvazzjoni tal-organizzazzjoniinternazzjonali jew tal-WADA, tibda u tmexxi dawn it-testijiet.F’avvenimenti nazzjonali, il-ābir ta’ kampjuni għall-kontroll tad-doping għandhom jsiru u jiāu sorveljati mill-KAD.

(4) Il-KAD, kif awtorizzata mill-Kunsill, għandha tkunresponsabbli għat-tħejjija ta’ pjan tad-distribuzzjoni ta’ testijiet skontl-artikolu 4 tal-istandard internazzjonali għall-ittestjar, u għall-implimentazzjoni ta’ dak il-pjan, inkluŜa s-superviŜjoni tat-testijietkollha li jsiru mill-Kunsill. It-testijiet jistgħu jsiru minn membri tal-KAD jew minn persuni kwalifikati oħra kif awtorizzati mill-Kunsill.

(5) Testijiet li jsiru mill-KAD għandhom ikunu sostanzjalmentkonformi mal-istandard internazzjonali għall-ittestjar li jkun fis-seħħfil-perjodu tal-ittestjar.

(6) Kampjuni tad-demm jew oħrajn minbarra dawk tal-awrinajistgħu jintuŜaw jew sabiex jiāu individwati sustanzi projbiti jewmetodi projbiti jew għal skopijiet proëedurali ta’ eŜaminar jew għall-profiling ematoloāiku lonāitudinali magħruf bħala “l-passaport”. għall-atleta minbarra sabiex jiāi identifikat dan l-atleta għat-test tal-awrina taħt dawn ir-regolamenti. F’dawn ië-ëirkostanzi, l-KAD tista’tiddeëiedi b’mod diskrezzjonali liema parametri tad-demm għandhomjitkejlu fl-eŜaminar tal-kampjun u liema livelli ta’ dawk il-parametriser jintuŜaw sabiex jindikaw li atleta għandu jintgħaŜel għal test tal-awrina.

(7) Il-KAD għandha tirrapporta t-testijiet kompluti permezztal-clearinghouse tal-WADA fi Ŝmien erbatax-il āurnata tax-xogħolsabiex tiāi evitata d-duplikazzjoni mhux metieāa fl-ittestjar.

(8) Il-KAD għandha ŜŜomm registered testing pool fuq livellnazzjonali ta’ dawk l-atleti li huma meħtieāa li jkunu konformi mal-whereabouts requirements tal-istandard internazzjonali għall-ittestjaru għandha tippubblika l-kriterji għall-atleti li ser jiāu inkluŜi f’dan ir-registered testing pool kif ukoll lista tal-atleti li jissodisfaw dawn il-kriterji għal perjodu konëernat. Il-KAD għandha tirrevedi u taāāornakif ikun neëessarju l-kriterji tagħha għall-inkluŜjoni tal-atleti fir-registered testing pool tagħha, u għandha tirrevedi s-sħubija tar-registered testing pool tagħha minn Ŝmien għal Ŝmien kif inhu adattatb’mod konformi mal-kriterji stipulati. Kull atleta fir-registered testingpool għandu:

(a) javŜa lill-KAD dwar fejn mistenni jkun kull tlietxhur, bil-mod kif inhu stipolat fl-artikolu 11.3 tal-IstandardInternazzjonali għall-Ittestjar;

(b) għandu jaāāorna l-informazzjoni kif ikun meħtieā,b’mod konformi mal-artikolu 11.4.2 tal-IstandardInternazzjonali għall-Ittestjar, sabiex din tibqa’ eŜatta ukompluta f’kull ħin; u

(ë) għandu jkun disponibbli għall-Ittestjar fil-postdikjarat, b’mod konformi mal-artikolu 11.4 tal-IstandardInternazzjonali għall-Ittestjar.

(9) F’kaŜ li atleta jonqos milli jinforma lill-KAD dwar fejnmistenni dan jiāi kkonsidrat filing failure għall-finijiet tal-artikolu 2.4tal-Kodiëi fejn il-kondizzjonijiet tal-artikolu 11.3.5 tal-IstandardInternazzjonali għall-Ittestjar ikunu ntlaħqu.

(10) F’kaŜ li atleta jonqos milli jkun disponibbli għall-ittestjarfil-post dikjarat minnu jew minnha jiāi kkonsidrat bħala test maqbuŜgħall-finijiet tal-artikolu 2.4 tal-Kodiëi fejn il-kondizzjonijiet tal-artikolu 11.4.3 tal-Istandard Internazzjonali għall-Ittestjar ikununtlaħqu.

(11) Kull assoëjazzjoni nazzjonali għandha tassisti wkoll lill-KAD fl-istabbiliment tar-registered testing pool fuq livell nazzjonalita’ atleti nazzjonali tal-ogħla livell li għalihom għandhom japplikawukoll il-whereabouts requirements tal-istandard internazzjonali għall-ittestjar.

(12) Id-dikjarazzjoni ta’ fejn mistenni jkun l-atleta skont is-subregolamenti (8) u (11) għandha titqassam lill-WADA u lilorganizzazzjonijiet tal-anti-doping oħra li għandhom il-āurisdizzjonili jittestjaw lil atleta b’mod konformi mal-artikoli 11.7.1(d) u 11.7.3(d) tal-Istandard Internazzjonali għall-Ittestjar, inkluŜa l-kondizzjonistretta li tintuŜa biss għal finijiet ta’ kontroll tad-doping.

(13) Atleta li āie identifikat mill-KAD għall-inkluŜjoni fir-registered testing pool tal-Kunsill għandu jibqa’ soāāett għal dawn ir-regolamenti, inkluŜ l-obbligu li jkun konformi mad-dikjarazzjoni ta’fejn kellu jkun tal-istandard internazzjonali għall-ittestjar, kemm-ildarba u sakemm l-atleta ma jinformax lill-KAD bil-miktub, li hu rtirajew sakemm hu ma jissodisfax aktar il-kriterji għall-inkluŜjoni fir-registered testing pool tal-KAD u kien infurmat b’dan mill-KAD.

(14) Atleta li ssottometta n-notifika ta’ rtirar lill-KAD ma jistaxjerāa’ jikkompeti kemm-il darba hu ma jinnotifikax lill-KAD mill-inqas sitt xhur qabel hu jistenna li jirritorna għal kompetizzjoni u jkundisponibbli għall-out-of-competition testing bla avviŜ, inkluŜa l-konformità, jekk tintalab, mal-whereabouts requirements tal-istandard internazzjonali għall-ittestjar f’kull ħin waqt il-perjodu ta’qabel ir-ritorn attwali għal kompetizzjoni.

(15) Federazzjonijiet internazzjonali u assoëjazzjonijietnazzjonali jistgħu jistabbilixxu rekwiŜiti simili għall-irtirar u ritorngħal kompetizzjoni għall-atleti fir-registered testing poolinternazzjonali.

(16) F’avvenimenti internazzjonali f’Malta, il-federazzjoniinternazzjonali għandha tiddetermina n-numru ta’ testijiet skont il-poŜizzjoni finali fil-kompetizzjoni, testijiet aleatorji u target tests ligħandhom isiru.

(17) F’avvenimenti nazzjonali, il-KAD għandha tiddeterminan-numru ta’ atleti magħŜula għall-ittestjar f’kull kompetizzjoni u l-proëeduri għall-għaŜla tal-atleti għall-ittestjar u għandha tinkludi kullatleta li jikser rekord mondjali, reājonali jew nazzjonali.

(18) Minbarra l-proëeduri tal-għaŜla stipulati fis-subregolamenti (16) u (17), il-kummissjoni tal-anti-doping tal-federazzjoni internazzjonali f’avvenimenti internazzjonali, u l-KAD

f’avvenimenti nazzjonali, jistgħu jagħŜlu wkoll atleti jew timijietgħat-target testing sakemm dan it-target testing ma jintuŜax għal xifini oħra ħlief dawk leāittimi tal-kontroll tad-doping.

(19) Il-KAD għandha tagħŜel l-atleti għall-out-of-competitiontesting. Dan il-proëess ikun sostanzjalment skont l-istandardinternazzjonali għall-ittestjar fis-seħħ fiŜ-Ŝmien tal-għaŜla.

(20) L-Assoëjazzjonijiet nazzjonali u l-kumitati tal-organizzazzjoni ta’ avvenimenti ta’ assoëjazzjoni nazzjonaligħandhom jipprovdu aëëess lill-osservaturi indipendentif’avvenimenti kif ikun ordnat mill-KAD.

AnaliŜi ta’ kampjun ta’ kontroll tad-doping.

7. Kampjuni għall-kontroll tad-doping miābura skont dawnir-regolamenti għandhom jiāu analizzati skont il-prinëipji li āejjin:

(a) għall-finijiet tal-artikolu 2.1 tal-Kodiëi, il-KADgħandha tibgħat il-kampjuni għall-kontroll tad-doping għall-analiŜi lil-laboratorji akkreditati mill-WADA biss jew kifapprovat mill-WADA b’mod ieħor. L-għaŜla tal-laboratorjuakkreditat mill-WADA, jew laboratorju ieħor jew metodu ieħorapprovat mill-WADA uŜat għall-analiŜi tal-kampjuni għandhatiāi ddeterminata esklussivament mill-KAD;

(b) kampjuni għall-kontroll tad-doping għandhom jiāuanalizzati għall-iskoperta ta’ sustanzi projbiti u metodi projbitiidentifikati fil-lista projbita u sustanzi oħra kif jista’ jiāi ordnatmill-WADA b’mod konformi mal-programm ta’ monitoraāādeskritt fl-artikolu 4.5 tal-Kodiëi jew għall-assistenza lill-KADfit-tħejjija ta’ profili ta’ parametri rilevanti fl-awrina, demm jewmatriëi oħra tal-atleta, inkluŜ id-DNA jew genomic profiling,għall-finijiet tal-anti-doping;

(ë) l-ebda kampjun ma jista’ jintuŜa għal xi skop ħliefdak li jiāu skoperti sustanzi, jew klassijiet ta’ sustanzi, jewmetodi fil-lista projbita, minbarra kif inhu deskritt fl-artikolu6.2 tal-Kodiëi mingħajr l-kunsens bil-miktub tal-atleta.Kampjuni uŜati bil-kunsens tal-atleta, għall-finijiet oħraminbarra dawk tal-artikolu 6.2 tal-Kodiëi għandhomjitneħħewlhom kull mezz ta’ identifikazzjoni b’dak il-mod lidawn ma jistgħux jiāu rintraëëati għal atleta partikolari;

(d) laboratorji għandhom janalizzaw kampjuni għall-kontroll tad-Doping u jirrapportaw ir-riŜultati skont l-istandardinternazzjonali għall-analiŜi f’laboratorji; u

(e) kampjun jista’ jiāi analizzat mill-ādid għall-finijietdeskritti fl-artikolu 6.2 tal-Kodiëi f’kull ħin esklussivament fuq

direttiva tal-organizzazzjoni nazzjonali tal-anti-doping jew tal-WADA. Ië-ëirkostanzi u l-kondizzjonijiet għall-ittestjar mill-ādid ta’ kampjuni għandhom ikunu konformi mar-rekwiŜiti tal-istandard internazzjonali għal-laboratorji.

Tmexxija tar-riŜultati.

8. (1) It-tmexxija tar-riŜultati għal testijiet ordnati mill-KAD, inkluŜi testijiet magħmula mill-WADA b’mod konformi mal-ftehim mal-KAD, għandha tipproëedi kif stipolat hawn taħt:

(a) ir-riŜultati tal-analiŜi kollha għandhom jintbagħtulill-KAD f’forma kodifikata, f’rapport iffirmat minnrappreŜentant awtorizzat tal-laboratorju. Il-komunikazzjonijietkollha għandhom isiru b’dak il-mod li r-riŜultati tal-analiŜijkunu kunfidenzjali;

(b) kif wieħed jirëievi sejba analitika avversa tal-kampjun A, il-KAD għandha tagħmel analiŜi sabiextiddetermina jekk:

(i) ngħatatx eŜenzjoni għall-uŜu terapewtikuapplikabbli; jew

(ii) hemmx xi devjazzjoni evidenti mill-istandards internazzjonali għall-ittestjar jew analiŜi tal-laboratorji li jimminaw il-validità tas-sejba analitikaavversa;

(ë) f’kaŜ li fl-ewwel analiŜi skont il-paragrafu (1)(b)ma jirrivelax eŜenzjoni tal-uŜu terapewtiku applikabbli jewdevjazzjoni mill-istandard internazzjonali għall-ittestjar jew l-istandard internazzjonali għall-analiŜi f’laboratorji fis-seħħ fiŜ-Ŝmien tal-ittestjar jew analiŜi li timmina l-validità tas-sejbaanalitika avversa, l-KAD għandha tinnotifika minnufih lill-atleta u lill-assoëjazzjoni nazzjonali tiegħu dwar:

(i) is-sejba analitika avversa;

(ii) ir-regola tal-anti-doping miksura, jew, f’kaŜli jaqa’ taħt is-subregolamenti (1)(h) jew (1)(i),deskrizzjoni tal-investigazzjoni addizzjonali li ser issirsabiex jiāi determinat jekk hemmx ksur tar-regoli tal-anti-doping;

(iii) id-dritt tal-atleta li jitlob minnufih l-analiŜital-kampjun B jew, jekk ma ssirx din it-talba, f’dan il-kaŜl-analiŜi tal-Kampjun B jista’ jiāi kkonsidrat bħalarrinunzjat;

(iv) id-data, ħin u lok skedati għall-analiŜi tal-kampjun B jekk l-atleta jiddeëiedi li jitlob l-analiŜi tal-kampjun B;

(v) l-opportunità għall-atleta jew ir-rappreŜentanttal-atleta li jattendu għall-ftuħ u analiŜi tal-kampjun Bf’perjodu ta’ Ŝmien speëifikat fl-istandard internazzjonaligħal-laboratorji jekk dik l-analiŜi tintalab; u

(vi) id-dritt tal-atleta li jitlob kopji tal-pakkett ta’dokumentazzjoni tal-laboratorju tal-kampjuni A u B lijinkludi informazzjoni kif mitlub mill-istandardinternazzjonali għal-laboratorji;

(d) arranāamenti għandhom isiru għall-ittestjar tal-kampjun B fi Ŝmien tliet āimgħat min-notifika deskritta fil-paragrafu (1)(ë). Atleta jista’ jaëëetta r-riŜultati analitiëi tal-kampjun A billi jittardja t-talba għall-analiŜi tal-Kampjun B.Madankollu, l-KAD tista’ tiddeëiedi li tipproëedi bl-analiŜi tal-Kampjun B;

(e) l-atleta jew ir-rappreŜentant tiegħu għandhom id-dritt li jkunu preŜenti għall-analiŜi tal-kampjun B bi spejjeŜgħalihom. RappreŜentant tal-assoëjazzjoni nazzjonali tal-atletakif ukoll rappreŜentant tal-KAD għandhom ukoll id-dritt lijkunu preŜenti, iŜda bi spejjeŜ għalihom ukoll. L-atleta għandujkun infurmat dwar il-laboratorju, id-data u l-ħin tal-analiŜimeta l-kampjun B għandu jiāi analizzat;

(f) f’kaŜ li r-riŜultat ta’ kampjun B ikun negattiv, it-test kollu għandu jiāi kkunsidrat bħala negattiv u l-atleta, l-assoëjazzjoni nazzjonali tiegħu, u l-KAD għandhom jiāu hekkinformati u l-investigazzjoni u l-proëeduri kollha jingħalqu;

(ā) jekk tiāi skoperta sustanza projbita jew l-uŜu ta’metodu projbit, is-sejbiet għandhom jiāu rraportati lill-atleta,lill-assoëjazzjoni nazzjonali tal-atleta, l-KAD, u lill-WADA;

(ħ) il-KAD għandha tkompli tagħmel kullinvestigazzjoni ta’ prosegwiment kif jista’ jkun meħtieā skontil-lista projbita. Kif titlesta din l-investigazzjoni ta’prosegwiment, il-KAD għandha tinnotifika minnufih lill-atletadwar ir-riŜultati tal-investigazzjoni ta’ prosegwiment u jekk l-KAD ssostnix jew le li kien hemm ksur tar-regoli tal-anti-doping; u

(i) għal ksur tar-regoli tal-anti-doping evidenti li ma

jinvolvix sejbiet analitiëi avversi, l-KAD għandha tkomplitagħmel kull investigazzjoni oħra li hi neëessarja u għandhatinnotifika minnufih lill-atleta bir-regolament tal-anti-doping lijkun jidher li nkiser, u l-baŜi ta’ dan il-ksur. L-assoëjazzjoninazzjonali għandha tmexxi kull investigazzjoni fi Ŝmien tletināurnata.

(2) Il-āestjoni tar-riŜultati u t-tmexxija ta’ proëeduri ta’ smigħta’ test mill-organizzazzjoni ta’ avveniment maāāuri għandhom jiāuamministrati mill-federazzjoni internazzjonali, minbarra s-sanzjonijiet lil hinn mill-iskwalifika mill-avveniment jew tar-riŜultatital-avveniment.

(3) L-assoëjazzjoni nazzjonali, wara konsultazzjoni mal-KAD,għandha tissospendi atleta temporanjament qabel l-opportunità ta’smigħ komplut fuq baŜi ta’ sejba analitika avversa mill-kampjun Ajew mill-kampjuni A u B tal-atleta u r-reviŜjoni deskritta fis-subregolament (1). Fl-eventwalità ta’ riŜultat negattiv wara l-ittestjarta’ kampjun B, is-sospensjoni titneħħa awtomatikament u l-atletajitħalla jikkompeti minnufih.

(4) Fejn tiāi imposta sospensjoni proviŜorja fuq atleta, l-atletagħandu jingħata jew:

(a) smigħ proviŜorju qabel l-impoŜizzjoni tas-sospensjoni proviŜorja; jew

(b) smigħ proviŜorju mill-aktar fis possibbli, fi Ŝmiengħaxart’ijiem, wara l-impoŜizzjoni tas-sospensjoni proviŜorja.Estensjonijiet jistgħu jingħataw man-notifika bil-miktub; jew

(ë) smigħ mgħaāāel mill-aktar fis possibbli wara l-impoŜizzjoni tas-sospensjoni proviŜorja.

(5) Il-proëeduri tas-smigħ proviŜorji kollha għandhomjitwettqu skont l-artikolu 8 tal-Kodiëi.

(6) Fejn āiet imposta sospensjoni proviŜorja relatata ma’rapport tal-uffiëjal tal-kontroll tad-doping jew dokumentazzjonirelatata li turi l-possibilità ta’ ksur tar-regoli tal-anti-doping u l-Kunsill jiddetermina, wara sottomissjoni tal-atleta, li ma kien hemml-ebda ksur tar-regoli tal-anti-doping, is-sospensjoni proviŜjorjagħandha tiāi revokata minnufih.

(7) Jekk il-Kunsill jiddikjara li ma kien hemm l-ebda ksur tar-regoli tal-anti-doping, dan għandu jinforma minnufih lill-federazzjoniinternazzjonali, l-assoëjazzjoni nazzjonali, l-organizzazzjoni tal-anti-

doping nazzjonali tal-atleta u lill-WADA.

(8) Jekk atleta jew persuna oħra jirtiraw waqt li jkun għaddejproëess tal-analiŜi tar-riŜultati, l-organizzazzjoni tal-anti-doping litkun qed tmexxi dan il-proëess tal-analiŜi tar-riŜultati jibqa’ jkollha l-kompetenza sabiex ittemm il-proëess tal-analiŜi tar-riŜultati tagħha.Jekk atleta jew persuna oħra jirtiraw qabel ma jkun beda xi proëessgħall-analiŜi tar-riŜultati, l-organizzazzjoni tal-anti-doping li kienikollha l-kompetenza fuq r-riŜultati fuq l-atleta jew persuna oħra fiŜ-Ŝmien meta l-atleta jew persuna oħra kkommettew ksur tar-regoli tal-anti-doping, għandu jkollha l-kompetenza biex tmexxi fuq dawn ir-riŜultati.

Dritt għal smigħ xieraq.

9. (1) Meta jidher, wara l-proëess tal-analiŜi tar-riŜultatideskritt fir-regolament 8, li dawn ir-regolamenti nkisru, l-atleta jewpersuna oħra involuti għandhom jināiebu quddiem elenkudixxiplinarju tal-KAD jew tal-assoëjazzjoni nazzjonali tal-atleta jewta’ persuna oħra għal smigħ sabiex jiāi aāāudikat jekk kienx hemmksur ta’ dawn ir-regolamenti u jekk hu l-kaŜ, x’konsegwenzigħandhom jiāu imposti. Dan il-proëess tas-smigħ għandu jirrispetta l-prinëipji li āejjin:

(a) deëiŜjoni fi Ŝmien raāonevoli;

(b) tribunal āust u imparzjali;

(ë) id-dritt ta’ assistenza jew rappreŜentanza minnavukat bi spejjeŜ għall-atleta;

(d) id-dritt li jkun informat fi Ŝmien raāonevoli tal-allegat ksur tar-regoli tal-anti-doping;

(e) id-dritt ta’ tweāiba għall-allegat ksur tar-regoli tal-anti-doping;

(f) id-dritt ta’ kull parti li tippreŜenta evidenza, inkluŜid-dritt li jissejħu xhieda u jiāu eŜaminati, soāāett għad-diskrezzjoni tat-tribunal jekk jaëëettax xhieda permezz tat-telefon jew bil-miktub;

(ā) id-dritt ta’ atleta għal interpretu waqt is-smigħ; u

(ħ) id-deëiŜjoni li tidentifika b’mod ëar il-baŜi li fuqhattieħdet il-konkluŜjoni.

(2) L-elenku dixxiplinarju tal-KAD għandu s-setgħa li jisma’u jiddetermina l-kwistjonijiet kollha li jitfaëëaw minn kull kwistjoni lihemm referenza għaliha b’mod konformi ma’ dawn ir-regolamenti.

B’mod partikolari, l-elenku dixxiplinarju tal-KAD għandu s-setgħa lijiddetermina l-konsegwenzi ta’ ksur tar-regoli tal-anti-doping ligħandhom jiāu imposti b’mod konformi ma’ dawn ir-regolamenti.

(3) Meta jidher, wara l-proëess tal-āestjoni tar-riŜultati deskrittfir-regolament 8, li dawn ir-regolamenti setgħu nkisru, l-KADgħandha tirreferi l-kwistjoni lill-elenku dixxiplinarju għad-deëiŜjonijekk sarx ksur ta’ dawn ir-regolamenti u jekk hu l-kaŜ, x’għandhomikunu l-konsegwenzi imposti.

(4) Il-membri maħtura tal-elenku ma għandu jkollhom l-ebdainvolvement mal-kaŜ fil-passat. Kull membru, meta jiāi maħtur,għandu jiŜvela lië-Chairman kullëirkostanzi li jistgħu jaffettwaw l-imparzjalità tiegħu fil-kaŜ odjern.

Skwalifika mill-kompetizzjoni.

10. Il-ksur ta’ dawn ir-regoli fi sports individwali konness ma’in-competition test awtomatikament iwassal għal skwalifika tar-riŜultat miksub f’dik il-kompetizzjoni bil-konsegwenzi kollhariŜultanti, inkluŜ it-telf ta’ xi midalji, punti u premjijiet.

Ksur tar-regoli tal-anti-doping.

11. (1) Il-ksur tar-regoli tal-anti-doping li jseħħ matul jewb’rabta ma’ avveniment, b’deëiŜjoni tal-bord amministrattiv, iwassalgħal skwalifika tar-riŜultati kollha tal-atleta miksuba f’dak l-avveniment bil-konsegwenzi kollha, inkluŜ it-telf tal-midalji, punti upremjijiet kollha, minbarra kif provdut fl-artikoli 10.1.1. u 10.1.2 tal-Kodiëi. Madanakollu, jekk l-atleta jistabbilixxi li hu ma għandux tortjew ma kienx negliāenti fil-ksur, ir-riŜultati individwali tal-atleta fil-kompetizzjoni l-oħra ma għandhomx jiāu skwalifikati, sakemm majkunx hemm il-possibilità li, r-riŜultati tal-atleta f’kompetizzjoniminbarra dik il-kompetizzjoni li fiha seħħ il-ksur tar-regoli tal-anti-doping, āew affettwati mill-ksur tar-regoli tal-anti-doping mill-atleta.

(2) Il-perjodu ta’ ineliāibbiltà impost għall-ksur tal-artikoli2.1, 2.2 u 2.6 tal-Kodiëi għandu jkun kif āej, kemm-il darba ma jiāuxsodisfatti l-kondizzjonijiet għall-eliminazzjoni jew tnaqqis tal-perjodu ta’ ineliāibbiltà, kif provdut fis-subregolamenti (4) u (5), jewil-kondizzjonijiet għaŜ-Ŝieda tal-perjodu ta’ ineliāibbiltà, kif provdutfis-subregolament (6), jiāu sodisfatti, għall-ewwel ksur sentejnineliāāibbiltà.

(3) Il-perjodu ta’ ineliāibbiltà għall-ksur ta’ dawn ir-regolamenti għandu jkun:

(a) għal ksur tal-artikoli 2.3 jew 2.5 tal-Kodiëi, il-perjodu ta’ ineliāibbiltà għandu jkun sentejn, kemm-il darba l-kondizzjonijiet provduti fis-subregolament (5), jew il-kondizzjonijiet provduti fl-artikolu 10.6 tal-Kodiëi, jiāusodisfatti;

(b) għal ksur tal-artikoli 2.7 jew 2.8 tal-Kodiëi, il-perjodu ta’ ineliāibbiltà impost għandu jkun minimu ta’ erba’snin sa għomor, kemm-il darba l-kondizzjonijiet provduti fis-subregolament (5) ma jiāux sodisfatti. Il-ksur tar-regoli tal-anti-doping li tinvolvi minorenni għandha titqies bħala ksurpartikolarment serju, u, jekk ikun kommess mill-persunal tal-appoāā tal-atleta għal sustanzi speëifikati li hemm referenzagħalihom fir-regolament 5(3), għandha tirriŜulta f’ineliāibbiltàgħall-għomor għaldak il-persunal tal-appoāā tal-atleta.Barraminnhekk, ksur sinifikanti ta’ dawn l-artikoli, li jiksruwkoll liāijiet u regolamenti mhux sportivi, għandhom jiāurapportati lill-awtoritajiet amministrattivi, professjonali jewāudizzjarji kompetenti;

(ë) għal ksur tal-artikolu 2.4 tal-Kodiëi, il-perjodu ta’ineliāibbiltà għandu jkun għall-ewwel ksur minimu ta’ sentejnineliāibbiltà ibbaŜata fuq il-grad tat-tort tal-atleta.

(4) (a) Fejn atleta jew persuna oħra jistgħu jistabbilixxukif sustanza speëifikata daħlet f’āisimhom jew āiet fil-pussesstagħhom u li s-sustanza speëifikata ma kinitx intiŜa biex iŜŜid il-prestazzjoni tal-atleta fl-isport jew taħbi l-uŜu ta’ sustanza li ŜŜid il-prestazzjoni, il-perjodu ta’ ineliāibbiltà li jinsab fis-subregolament(2) għandu jiāisostitwit b’minimu ta’ twissija u l-ebda perjodu ta’ineliāibbiltà minn avvenimenti fil-futur u, massimu ta’ sentejnineliāibbiltà għall-ewwel ksur.

(b) Sabiex tiāi āustifikata kull eliminazzjoni jewtnaqqis, l-atleta jew persuna oħra għandhom jipproduëuevidenza korroborattiva minbarra l-kelma tagħhom litistabbilixxi għas-sodisfazzjon tal-elenku tas-smigħ, l-assenzatal-intenzjoni sabiex tiŜdied il-prestazzjoni fl-isport jew tinħebal-uŜu ta’ sustanza li ŜŜid il-prestazzjoni. Il-grad tat-tort tal-atletajew persuna oħra għandu jkun il-kriterju fl-evalwazzjoni ta’ kulltnaqqis tal-perjodu ta’ ineliāibbiltà.

(5) Fuq baŜi ta’ ëirkostanzi eëëezzjonali, dan li āej jista’jelimina jew inaqqas il-perjodu ta’ ineliāibbiltà:

(a) jekk atleta jistabbilixxi f’kaŜ individwaliindividwali li hu ma għandu l-ebda tort jew negliāenza, il-perjodu applikabbli f’ëirkostanzi differenti ta’ ineliāibbiltàgħandu jiāi eliminat. Meta sustanza projbita jew il-markers jewil-metaboliti tagħha jiāu skoperti f’kampjun tal-atleta bi ksurtal-artikolu 2.1 tal-Kodiëi, l-atleta għandu wkoll jistabbilixxi kifis-sustanza projbita daħlet fis-sistema tiegħu sabiex jitneħħa l-perjodu ta’ ineliābibiltà. F’kaŜ li dan il-paragrafu jiāi applikat u

l-perjodu ta’ ineliāibbiltà applikabbli f’ëirkostanzi oħra jiāieliminat, il-ksur ta' regola tal-anti-doping ma għandux jiāikkonsidrat ksur għall-finijiet limitati sabiex jiāi determinat il-perjodu ta’ ineliāibbiltà għal diversi ksur skont l-artikolu 10.7tal-Kodiëi;

(b) jekk atleta jew persuna oħra tistabbilixxi f’kaŜindividwali li m’għandhom l-ebda tort jew ma kinux negliāenti,f’dak il-kaŜ il-perjodu ta’ ineliāibbiltà jista’ jitnaqqas, iŜda l-perjodu mnaqqas ta’ ineliāibbiltà ma jistax ikun inqas min-nofsil-perjodu ta’ ineliāibbiltà li kien ikun applikabbli. Jekk il-perjodu ta’ ineliāibbiltà li kien ikun applikabbli jkun ta’ineliāibbiltà għall-għomor, il-perjodu mnaqqas taħt dan il-paragrafu ma għandux ikun inqas minn tmien snin. Metasustanza projbita jew il-markers jew il-metaboliti tagħha jiāuskoperti f’kampjun ta’ atleta bi ksur tal-artikolu 2.1 tal-Kodiëi,l-atleta għandu wkoll jistabbilixxi kif is-sustanza daħlet fis-sistema tiegħu sabiex il-perjodu ta’ ineliāibbiltà jitnaqqas;

(ë) it-tribunal tal-assoëjazzjoni nazzjonali jista’ qabelid-deëiŜjoni finali tal-appell taħt ir-regolament 14, jew l-iskadenza taŜ-Ŝmien għall-appell, jissospendi parti mill-perjoduta’ ineliāibbiltà impost f’kaŜ individwali fejn l-atleta jewpersuna oħra provdiet assistenza sostanzjali lil organizzazzjonital-anti-doping, awtorità kriminali jew bord dixxiplinarjuprofessjonali li tirriŜulta li l-organizzazzjoni tal-anti-dopingtiskopri jew tistabbilixxi ksur tar-regoli tal-anti-doping minnpersuna oħra jew li tirriŜulta li bord kriminali jew dixxiplinarjujiskopri jew jistabbilixxi reat kriminali jew ksur tar-regoliprofessjonali minn persuna oħra. Wara d-deëiŜjoni finali tal-appell skont ir-regolament 14 jew l-iskadenza taŜ-Ŝmien tal-appell, il-bord tal-eŜaminar fuq livell nazzjonali jista’jissospendi biss parti mill-perjodu ta’ ineliāibbiltà applikabblibl-approvazzjoni tal-WADA u l-federazzjoni internazzjonaliapplikabbli. It-tul tal-perjodu ta’ ineliāibbiltà li kien ikunapplikabbli li jista’ jiāi sospiŜ għandu jkun ibbaŜat fuq il-gravitàtal-ksur tar-regoli tal-anti-doping kommess mill-atleta jewpersuna oħra u l-importanza tal-assistenza sostanzjali provdutamill-atleta jew persuna oħra fl-isforz sabiex jiāi eliminat id-doping fl-isport. Ma jistax jiāi sospiŜ aktar minn tliet kwarti tal-perjodu ta’ ineliābibiltà li kien ikun applikabbli. Jekk il-perjoduta’ ineliāibbiltà li kien ikun applikabbli jkun ta’ ineliāibbiltàgħall-għomor, il-perjodu mhux sospiŜ taħt din is-sessjoni magħandux ikun inqas minn tmien snin. Jekk il-bord tal-eŜaminarfuq livell nazzjonali jissospendi xi parti mill-perjodu ta’ineliāibbiltà skont dan il-paragrafu, dan għandu jipprovdi

āustifikazzjoni minnufih bil-miktub għad-deëiŜjoni tiegħu lilkull organizzazzjoni tal-anti-doping li għandha d-dritt litappella d-deëiŜjoni. Jekk il-bord tal-eŜaminar fuq livellnazzjonali sussegwentement jerāa’ jdaħħal xi parti tal-perjoduta’ ineliāibbiltà sospiŜa minħabba li l-atleta jew persuna oħranaqset milli tipprovdi l-assistenza sostanzjali li kienetantiëipata, l-atleta jew persuna oħra jistgħu jappellaw l-introduzzjoni mill-ādid skont ir-regolament 14(3) sa (7);

(d) fejn atleta jew persuna oħra jammettuvolontarjament l-għemil ta’ ksur tar-regoli tal-anti-doping qabelma tirëievi notifika ta’ ābir tal-kampjun li jista’ jistabbilixxi l-ksur tar-regoli tal-anti-doping jew, fil-kaŜ ta’ ksur tar-regoli tal-anti-doping minbarra r-regolamenti 3(1) sa (6), qabel ma tkunirëevuta l-ewwel notifika tal-ksur ammessa skont ir-regolament8 u li l-ammissjoni hi l-unika evidenza ta’ min wieħed joqgħodfuqha tal-ksur tar-regoli fil-ħin tal-ammissjoni, f’dak il-kaŜ il-perjodu ta’ ineliāibbiltà jista’ jitnaqqas, iŜda mhux inqas min-nofs tal-perjodu ta’ ineliāibbiltà li kien ikun applikabbli;

(e) qabel ma jiāi applikat kull tnaqqis skont ir-regolamenti 11(5)(b), (c) jew (d), il-perjodu ta’ ineliāibbiltà likien ikun applikabbli għandu jiāi determinat skont ir-regolamenti 11(2) sa (4) u r-regolament 11(6). Jekk l-atleta jewpersuna oħra jistabbilixxu d-dritt għal tnaqqis jew sospensjonital-perjodu ta’ ineliāibbiltà skont Ŝewā disposizzjonijiet jewaktar tar-regolamenti 11(5) (b) sa (d), f’dak il-kaŜ, il-perjodu ta’ineliāibbiltà jista’ jitnaqqas jew jiāi sospiŜ, iŜda mhux inqasminn kwart tal-perjodu ta’ ineliāibbiltà li kien ikun applikabbli.

(6) Jekk il-bord tal-eŜaminar fuq livell nazzjonali jistabbilixxif’kaŜ individwali li jinvolvi ksur tar-regoli tal-anti-doping minbarraksur tar-regoli taħt ir-regolament 3(13) u (14), li ëirkostanziaggravanti huma preŜenti li jiāāustifikaw l-impoŜizzjoni tal-perjoduta’ ineliāibbiltà itwal mis-sanzjoni ta’ livell standard, f’dak il-kaŜ, il-perjodu ta’ ineliāibbiltà li kien ikun applikabbli għandu jiŜdied samassimu ta’ erba’ snin ħlief, jekk l-atleta jew persuna oħra jistgħujipprovaw għas-sodisfazzjon tal-elenku tas-smigħ li makkommettewx il-ksur tar-regola tal-anti-doping b’mod intenzjonat. L-atleta jew l-persuna oħra jistgħu jevitaw l-applikazzjoni ta’ dan is-subregolament billi jammettu l-ksur tar-regoli tal-anti-doping kif ikunasserit minnufih wara li tiāi kkonfrontata bi ksur tar-regoli tal-anti-doping mill-bord tal-eŜaminar fuq livell nazzjonali.

(7) Għall-ewwel ksur tar-regoli tal-anti-doping minn atletajew persuna oħra, il-perjodu ta’ ineliāibbiltà hu stabbilit fir-regolamenti 11(2) u (3), soāāett għal eliminazzjoni, tnaqqis jew

sospensjoni taħt ir-regolamenti 11(4) u (5), jew għaŜ-Ŝieda taħt ir-regolament 11(6). Għat-tieni ksur tar-regoli tal-anti-doping, il-perjodu ta’ ineliāibbiltà għandu jkun fil-medda stabbilita fit-tabellat’hawn taħt:

"NSF" tfisser sanzjoni mnaqqsa għall-ebda tort jew negliāenzasinifikanti. Il-ksur tar-regoli tal-anti-doping kien jew għandu jiāisanzjonat b’sanzjoni mnaqqsa skont r-regolament 11(5)(b) minħabbali ā ie provat l-ebda tort jew negliāenza sinifikanti skont ir-regolament11(5)(b) mill-atleta;

"St" tfisser sanzjoni standard skont ir-regolamenti 11(2) jew11(3)(a). Il-ksur tar-regoli tal-anti-doping kien jew għandu jiāisanzjonat bis-sanzjoni standard ta’ sentejn skont ir-regolamenti 11(2)jew 11(3)(a);

"AS" tfisser sanzjoni aggravata. Il-ksur tar-regoli tal-anti-doping kien jew għandu jiāi sanzjonat b’sanzjoni aggravata skont ir-regolament 11(6) minħabba li l-organizzazzjoni tal-anti-dopingstabbilit il-kondizzjonijiet stipulati taħt ir-regolament 11(6);

"TRA" tfisser traffikar u amministrazzjoni. Il-ksur tar-regoli tal-anti-doping kien jew għandu jiāi sanzjonat b’sanzjoni skont ir-regolament 11(3)(b) għat-traffikar jew amministrazzjoni.

(9) Fejn atleta jew persuna oħra li tikkommetti t-tieni ksur tar-regoli tal-anti-doping tistabbilixxi d-dritt għal sospensjoni jewtnaqqis ta’ parti mill-perjodu ta’ ineliāibbiltà taħtis-subregolament(5)(ë) jew (d), il-bord tal-eŜaminar fuq livell nazzjonali għandu l-ewwel jiddetermina l-perjodu ta’ ineliāibbiltà li kien ikun applikabblifil-medda stabbilita fit-tabella fis-subregolament (8), u wara tiāiapplikata s-sospensjoni jew tnaqqis tal-perjodu ta’ ineliāibbiltàxieraq. Il-bqija tal-perjodu ta’ ineliāibbiltà, wara li tiāi applikata xisospensjoni jew tnaqqis taħt is-subregolamenti (5)(ë) u (d), għandhatkun mill-anqas kwart tal-perjodu ta’ ineliāibbiltà li kien ikunapplikabbli.

(10) It-tielet vjolazzjoni tar-regoli tal-anti-doping tirriŜultadejjem f’perjodu ta’ ineliāibbiltà għall-għomor, ħlief, jekk it-tieletksur jissodisfa l-kondizzjoni għall-eliminazzjoni jew tnaqqis tal-perjodu ta’ ineliāibbiltà taħt is-subregolament (4) jew tinvolvi ksurtar-regolament 3(9). F’dawn il-kaŜijiet partikolari, il-perjodu ta’ineliāibbiltà għandu jkun minn tmien snin sa ineliāibbiltà għall-għomor.

(11) Għall-finijiet ta’ impoŜizzjoni ta’ sanzjonijiet taħt is-subregolamenti (7) sa (10), it-tieni ksur tar-regoli tal-anti-dopingjista’ jkun biss ikkonsidrat bħala t-tieni ksur jekk il-KAD jew l-assoëjazzjoni nazzjonali tista’ tistabbilixxi li l-atleta jew persuna oħrakkommettew it-tieni ksur tar-regoli tal-anti-doping wara li l-atletajew persuna oħra jkunu irëivew notifika b’mod konformi mar-regolament 8, jew wara li l-KAD jew l-assoëjazzjoni nazzjonali tkungħamlet sforzi raāonevoli sabiex tavŜa permezz ta’ notifika dwar l-ewwel ksur tar-regoli tal-anti-doping; jekk il-KAD jew l-assoëjazzjoni nazzjonali ma tistax tistabbilixxi dan, il-ksur għandhomjiāu kkunsidrati flimkien bħala l-ewwel ksur waħdini, u s-sanzjoniimposta għandha tkun ibbaŜata fuq il-ksur li āāor magħha l-aktarsanzjoni severa, madankollu l-okkorrenza ta’ diversi ksur tista’ tiāikkonsidrata bħala fattur li jiddetermina ëirkostanzi aggravanti.

(12) Jekk, wara d-determinazzjoni tal-ewwel ksur tar-regoli tal-anti-doping, il-KAD tiskopri fatti li jinvolvu ksur tar-regoli tal-anti-doping mill-atleta jew persuna oħra li seħħ qabel in-notifika rigward

l-ewwel ksur, f’dan il-kaŜ, il-KAD għandha timponi sanzjoniaddizzjonali fuq baŜi tas-sanzjoni li setgħet āiet imposta li kieku Ŝ-Ŝewā ksur āew deëiŜi fl-istess ħin. Ir-riŜultati fil-kompetizzjonijietkollha li d-data tagħhom tmur lura qabel il-ksur tar-regoli tal-anti-doping jiāu skwalifikati kif inhu stipulat fis-subregolamenti (14) sa(16). Sabiex tiāi evitata l-possibilità ta’ ëirkostanzi aggravantiminħabba ksur preëedenti iŜda skopert wara, l-atleta jew persuna oħragħandhom jammettu volontarjament il-ksur tar-regoli tal-anti-dopingpreëedenti f’ħin opportun wara n-notifika tal-ksur li jkunu qiegħdinjiāu akkuŜati għalih. L-istess regola għandha tapplika wkoll meta l-KAD tiskopri fatti li jinvolvu ksur ieħor li sar qabel, wara d-deëiŜjonitat-tieni ksur tar-regoli tal-anti-doping.

(13) Għall-finijiet tas-subregolamenti (7) sa (10), kull ksur tar-regoli tal-anti-doping għandu jseħħ fl-istess perjodu ta’ tmien sninsabiex jiāu kkonsidrati diversi ksur.

(14) Minbarra l-iskwalifika awtomatika tar-riŜultati fil-kompetizzjoni li produëiet il-kampjun poŜittiv skont ir-regolament10, ir-riŜultati l-oħra kollha miksuba mid-data meta l-kampjunpoŜittiv ināabar, irrispettivament jekk humiex in-competition jew out-of-competition, jew seħħ ksur ieħor tar-regoli tal-anti-doping matul il-bidu ta’ kull sospensjoni proviŜorja jew perjodu ta’ ineliāibbiltà,għandhom, sakemm is-sens ta’ āustizzja ma jitlobx mod ieħor, jiāuskwalifikati bil-konsegwenzi kollha riŜultanti inkluŜ it-telf għad-drittta’ midalji, punti u premjijiet.

(15) Bħala kondizzjoni sabiex terāa’ tinkiseb l-eliāibbiltà warali jkun instab li kkommetta ksur tar-regoli tal-anti-doping, l-atletagħandu l-ewwel irodd lura l-flus kollha tal-premjijiet li jkun tilef id-dritt għalihom skont dan ir-regolament.

(16) Kemm-il darba r-regolamenti tal-federazzjoniinternazzjonali ma jistipulawx li l-flus tal-premjijiet mitlufa bħalapiena għandhom jiāu allokati mill-ādid lil atleti oħra, dawn l-ewwelgħandhom jiāu allokati sabiex jagħmlu tajjeb għall-ispejjeŜ tal-ābirtal-organizzazzjoni tal-anti-doping li ħadet il-passi neëessarji biextiābor lura l-flus tal-premjijiet, imbagħad jintraddu lura l-ispejjeŜ tal-organizzazzjoni tal-anti-doping li wettqet il-āestjoni tar-riŜultati fil-kaŜ, bil-bilanë, jekk ikun baqa’, jiāi allokat b’mod konformi mar-regolamenti tal-federazzjoni internazzjonali.

(17) Il-perjodu ta’ ineliāibbiltà għandu jibda mid-data tad-deëiŜjoni tas-smigħ li tistipola l-ineliāibbiltà jew, jekk is-smigħ āierrifjutat, fid-data meta l-ineliāibbiltà āiet aëëettata jew imposta. Kullperjodu ta’ sospensjoni proviŜorja, irrispettivament jekk hux impostjew aëëettat volontarjament, għandu jitnaqqas mill-perjodu totali ta’

Fejn kien hemm dewmien sostanzjali fil-proëess tas-smigħ jew aspetti oħra tal-kontroll tad-doping mhuxattribwibbli għall-atleta jew persuna oħra, l-elenku dixxiplinarju tal-KAD jew l-assoëjazzjoni nazzjonali li timponi s-sanzjoni tista’ tagħtibidu għall-perjodu ta’ ineliāibbiltà f’data aktar kmieni li jibda sa mid-data tal-ābir tal-kampjun jew id-data meta seħħ l-aħħar ksur ieħor tar-regoli tal-anti-doping.

(18) Fejn l-atleta jammetti minnufih, li fil-kaŜijiet kollha,tfisser qabel l-atleta jerāa’ jikkompeti, il-ksur tar-regoli tal-anti-doping wara li jiāi kkonfrontat bi ksur tar-regoli tal-anti-doping, il-perjodu ta’ ineliābibiltà jista’ jibda sa mid-data tal-ābir tal-kampjunjew mid-data li fiha jkun seħħ l-aħħar ksur tar-regoli tal-anti-dopingieħor. F’kull kaŜ, madankollu, fejn dan is-subregolament hu applikat,l-atleta jew persuna oħra għandhom iservu mill-inqas nofs il-perjoduta’ ineliāibbiltà li jmur ’il quddiem mid-data meta l-atleta jew persunaoħra aëëettaw l-impoŜizzjoni ta’ sanzjoni jew id-data tad-deëiŜjonitas-smigħ fejn li jimponi sanzjoni:

IŜda dan is-subregolament ma għandux japplika fejn il-perjodu ta’ ineliāibbiltà ikun diāà tnaqqas taħt is-subregolament(5)(d).

(19) Jekk sospensjoni proviŜorja āiet imposta u rrispettata mill-atleta, f’dak il-kaŜ, l-atleta għandu jirëievi kreditu għal dan il-perjoduta’ sospensjoni proviŜorja għal kull perjodu ta’ ineliāibbiltà li fl-aħħarmill-aħħar jista’ jiāi impost.

(20) Jekk atleta jaëëetta volontarjament sospensjoni proviŜorjabil-miktub mill-KAD u wara jŜomm ruħu lura milli jikkompeti, l-atleta għandu jirëievi kreditu għal dan il-perjodu ta’ ineliāibbiltà li fl-aħħar mill-aħħar jista’ jiāi impost. Kopja tal-aëëettazzjoni volontarjatal-atleta ta’ sospensjoni proviŜorja għandha tingħata minnufih lil kullparti li hi intitolata li tirëievi notifiki ta’ ksur potenzjali tar-regoli tal-anti-doping skont l-artikolu 14.1. tal-Kodiëi.

(21) L-aëëettazzjoni volontarja ta’ atleta ta’ sospensjoniproviŜorja mhijiex ammissjoni min-naħa tal-atleta u ma għandhiextintuŜa bl-ebda mod sabiex tinkiseb inferenza avversa kontra l-atleta.

(22) L-ebda kreditu għal perjodu ta’ ineliāibbiltà ma għandujingħata għal xi perjodu ta’ Ŝmien qabel id-data effettiva tas-sospensjoni proviŜorja jew sospensjoni proviŜorja volontarjairrispettivament jekk l-atleta għaŜilx li ma jikkompetix jew āiexsospiŜ mit-tim tiegħu.

ineliāibbli ma tista’, matul il-perjodu ta’ ineliāibbiltà, tieħu sehemf’xi kapaëità f’kompetizzjoni jew attività, minbarra programmiawtorizzati edukattivi jew ta’ riabilitazzjoni tal-anti-doping,awtorizzati jew organizzati minn kull firmatarju, organizzazzjonijietmembri ta’ Firmatarju, inkluŜa l-assoëjazzjoni nazzjonali jew klabbjew organizzazzjoni membru oħra ta’ organizzazzjoni membru ta’firmatarju, organizzata minn league professjonali jew kullorganizzazzjoni ta’ avveniment internazzjonali jew nazzjonali.Barraminnhekk, għal kull ksur tar-regoli tal-anti-doping li majinvolvux sustanzi speëifikati deskritti fis-subregolament (3), il-Kunsill u, jew assoëjazzjoni nazzjonali tista’ wkoll tirtira jew tnaqqasparzjalment l-appoāā finanzjarju tal-atleta.

(24) Persuna soāāetta għal perjodu ta’ ineliāibbiltà ta’ aktarminn erba’ snin tista’, wara li jkunu għaddew l-erba’ snin ta’ineliāibbiltà, tieħu sehem f’avvenimenti sportivi lokali fi sport,minnbarra dak l-isport li fih il-persuna kkommettiet il-ksur tar-regolital-anti-doping, iŜda biss sakemm l-avveniment sportiv lokali mhuxta’ livell li b’xi mod jista’ jikkwalifika lil din il-persuna direttamentjew indirettament sabiex tikkompeti fi, jew takkumula punti lejn,avveniment nazzjonali jew avveniment internazzjonali. Persunasoāāetta għal perjodu ta’ ineliāibbiltà għandha tibqa’ soāāetta għall-ittestjar.

(25) Fejn atleta jew persuna oħra li āiet iddikjarata ineliāibblitikser il-projbizzjoni tal-parteëipazzjoni waqt l-ineliāibilità deskrittafis-subregolament 23, ir-riŜultati ta’ din il-parteëipazzjoni għandhomjiāu skwalifikati u l-perjodu ta’ ineliāibbiltà li kien impostoriāinarjament għandu jerāa’ jibda mill-ādid mid-data tal-ksur. Il-perjodu ta’ ineliāibbiltà l-ādid jista’ jitnaqqas skont is-subregolament(5)(b), jekk l-atleta jew persuna oħra jistabbilixxi li ma għandhom l-ebda tort jew negliāenza sinifikanti għall-ksur tal-projbizzjoni tal-parteëipazzjoni. Id-determinazzjoni, jekk atleta jew persuna oħrajiksrux il-projbizzjoni tal-parteëipazzjoni, u jekk it-tnaqqis skont is-subregolament (5)(b) hux xieraq, għandha ssir mill-organizzazzjonital-anti-doping li l-analizi tar-riŜultati tagħha wassal għall-impoŜizzjoni tal-perjodu inizjali ta’ ineliāibbiltà.

(26) Minbarra dan, għal kull ksur tar-regoli tal-anti-doping lima jinvolvix sanzjoni mnaqqsa għal sustanzi speëifikati kif inhudeskritt fis-subregolament (4), parti minn jew l-appoāā kollufinanzjarju relatat mal-isport jew benefiëëji oħra relatati mal-isport lijingħataw lil din il-persuna tinŜamm milli tingħata minn kullfirmatarju, membru ta’ firmatarji, inkluŜi federazzjoni nazzjonalisportiva, u gvernijiet.

fl-aħħar tal-perjodu speëifikat ta’ ineliāibbiltà, atleta għandu, waqtkull perjodu ta’ sospensjoni proviŜorja jew ineliāibbiltà, jkundisponibbli għall-out-of-competition testing mill-FederazzjoniInternazzjonali, il-KAD, u kull organizzazzjoni tal-anti-doping oħra ligħandha l-awtorità li twettaq it-testijiet, u għandu jipprovdi fejnmistenni jkun kif provdut fir-regolamenti 6(8) sa (12). F’kaŜ li atleta,li jkun soāāett għal perjodu ta’ ineliāibbiltà, jirtira mill-isport ujitneħħa mill-out-of-competition testing pools u wara jipprova jidħolfl-isport, l-atleta ma għandux ikun eliāibbli għall-integrazzjoni mill-ādid sakemm l-atleta ma jinnotifikax lill-KAD u l-assoëjazzjoninazzjonali applikabbli u l-atleta kien soāāett għall-out-of-competitiontesting għal perjodu ta’ Ŝmien ugwali għall-itwal perjodu stipulat fir-regolamenti 6(13) sa (15) jew il-perjodu ta’ ineliāibbiltà li jkun baqa’mid-data li l-atleta kien irtira. Waqt il-bqija ta’ dan il-perjodu ta’ineliāibbiltà, jistgħu jsiru sa massimu ta’ tlett testijiet fuq l-atleta bispejjeŜ għall-istess atleta, b’mill-inqas tliet xhur bejn kull test. L-KAD għandha tkun responsabbli sabiex isiru t-testijiet neëessarji,iŜda testijiet minn organizzazzjoni tal-anti-doping jistgħu jintuŜawsabiex jissodisfaw ir-rekwiŜit. Barraminnhekk, immedjatament qabelit-tmiem tal-perjodu tas-sospensjoni, atleta għandu jagħmel testijiet lijsiru mill-KAD għal sustanzi u metodi projbiti għall-out-of-competition testing. La darba l-perjodu tas-sospensjoni tal-atleta jkungħadda, u l-atleta jissodisfa l-kondizzjonijiet ta’ integrazzjoni mill-ādid, f’dak il-kaŜ l-atleta jiāi awtomatikament eliāibbli mill-ādid uma jkun hemm bŜonn tal-ebda applikazzjoni min-naħa tal-atleta jewtal-assoëjazzjoni nazzjonali tal-atleta.

Target testing ta’ tim.

12. (1) Fejn aktar minn membru ta’ tim f’team sport āewnotifikati dwar ksur possibli tar-regoli tal-anti-doping skont ir-regolament 8 b’rabta ma’ avveniment, il-korp regolatorju tal-avveniment għandu jagħmel target testing adattat ta’ tim waqtperjodu ta’ avveniment. Jekk aktar minn Ŝewā membri ta’ tim f’teamsport jinstabu li kkommettew ksur tar-regoli tal-anti-doping matulperjodu ta’ avveniment, il-korp regolatorju tal-avveniment għandujimponi sanzjoni adattata fuq it-tim, inkluŜi iŜda mhux eskluŜivisanzjonijiet bħal tnaqqis ta’ punti, skwalifika minn kompetizzjoni jewavveniment, minbarra xi konsegwenzi imposti fuq l-atleta individwalijew atleti li kkommettew il-ksur tar-regoli tal-anti-doping.

(2) Il-korp regolatorju tal-avveniment jista’ jiddeëiedi lijistabbilixxi regolamenti għall-avveniment li jimponu konsegwenziaktar stretti minn dawk fis-subregolament (1) għall-finijiet tal-avveniment.

għandu awtorità fuqhom li ma jendorsjawx u ma jikkonformawx ma’dawn ir-regolamenti.

(2) Il-Kunsill jista’ jiddeëiedi li jieħu passi dixxiplinarjiaddizzjonali kontra assoëjazzjonijiet nazzjonali relatati mal-għarfien,l-eliāibbiltà tal-uffiëjali u atleti tagħhom sabiex jieħdu sehemf’avvenimenti nazzjonali u multi fuq baŜi ta’ dawn li āejjin:

(a) erba’ ksur jew aktar ta’ dawn ir-regolamenti,minbarra ksur li jinvolvu r-regolamenti 3(10) u 11(3), li jkunukommessi mill-atleti jew persuni oħra affiljati ma’ assoëjazzjoninazzjonali f’perjodu ta’ tnax-il xahar f’testijiet li jsiru mill-federazzjoni internazzjonali jew minn organizzazzjonijiet tal-anti-doping oħra inkluŜa l-KAD. F’dan il-kaŜ, il-Kunsill jista’b’mod diskrezzjonali jiddeëiedi sabiex jipprojbixxi lill-uffiëjalikollha minn dik l-assoëjazzjoni nazzjonali milli jieħdu sehemf’xi attivitajiet tal-federazzjoni internazzjonali għal perjodumassimu ta’ sentejn;

F’kaŜ li erba’ ksur jew aktar ta’ dawn ir-regolamenti,minbarra ksur li jinvolvu r-regolamenti 3(10) 11(3) ikunukommessi flimkien mal-ksur minn atleti jew persuni oħraaffiljati ma’ assoëjazzjoni nazzjonali f’perjodu ta’ tnax-il xaharta’ testijiet li jsiru mill-federazzjonijiet internazzjonali jeworganizzazzjonijiet tal-anti-doping inkluŜa l-KAD, f’dak il-kaŜ,il-Kunsill jista’ jissospendi s-sħubija ta’ dik l-assoëjazzjoninazzjonali għal perjodu massimu ta’ erba’ snin;

(b) aktar minn atleta wieħed jew persuna oħra mill-assoëjazzjoni nazzjonali jikkomettu ksur tar-regoli tal-anti-doping waqt avveniment internazzjonali. F’dak il-kaŜ, il-Kunsill, b’mod diskrezzjonali, jista’ jirrifjuta kull assistenzaproposta jew diāà kommessa lill-assoëjazzjoni nazzjonaliinvoluta; u

(ë) assoëjazzjoni nazzjonali naqset milli tagħmel l-isforzi diliāenti sabiex iŜŜomm lill-KAD infurmata dwar il-whereabouts ta’ atleta wara li tkun irëiviet talba għal dik l-informazzjoni mill-KAD. F’dak il-kaŜ il-Kunsill, fid-diskrezzjoni tiegħu, jista’ jirrifjuta kull assistenza proposta jewdiāà kommessa lill-assoëjazzjoni nazzjonali involuta, flimkienmal-ispejjeŜ kollha li āāarrab il-KAD fl-ittestjar tal-atleti ta’ dikl-assoëjazzjoni nazzjonali.

Appell ta’ deëiŜjonijiet meħuda taħt dawn ir-regolamenti.

14. (1) Id-deëiŜjonijiet meħuda taħtdawn ir-regolamentijistgħu jiāu appellati kif stipolat taħt dan ir-regolament jew kif inhuspeëifikat b’mod ieħor fil-Kodiëi. Dawn id-deëiŜjonijiet għandhom

jibqgħu fis-seħħ sakemm ikunu taħt l-appell, sakemm il-bord tal-appell ma jordnax mod ieħor. Qabel ma jiāi ppreŜentat l-appell, il-proëeduri tat-tribunal indikati fir-regolament 9 għandhom ikunukompluti.

(2) Fejn il-WADA għandha dritt għal appell skont dan ir-regolament u l-ebda parti oħra ma tappella deëiŜjoni finali fi ħdan il-proëess tal-Kunsill, il-WADA tista’ tappella din id-deëiŜjonidirettament quddiem il-CAS mingħajr ma teŜawrixxi r-rimedji l-oħrafil-proëess tal-Kunsill.

(3) DeëiŜjoni li sar ksur tar-regoli tal-anti-doping, deëiŜjoni litimponi konsegwenzi għal ksur tar-regoli tal-anti-doping, jewdeëiŜjoni li ma sar l-ebda ksur tar-regoli tal-anti-doping, deëiŜjoni liproëeduri ta’ ksur tar-regoli tal-anti-doping ma jistgħux jitkompluminħabba raāunijiet proëedurali; deëiŜjoni taħt ir-regolamenti 11(23)sa (26); deëiŜjoni li organizzazzjoni tal-anti-doping ma għandhiexāurisdizzjoni sabiex tiddeëiedi fuq allegat ksur tar-regoli tal-anti-doping jew il-konsegwenzi tiegħu, deëiŜjoni minn kull federazzjoninazzjonali li ma tressaqx sejba analitika avversa jew sejba atipika ta’ksur tar-regoli tal-anti-doping, jew deëiŜjoni li ma jittressaqx ksur tar-regoli tal-anti-doping wara investigazzjoni skont l-artikolu 7.4 tal-Kodiëi; u deëiŜjoni għall-impoŜizzjoni ta’ sospensjoni proviŜorjabħala riŜultat ta’ smigħ proviŜorju jew fi ksur b’mod ieħor tar-regolamenti 8(3) sa (7) tista’ tiāi appellata esklussivament kif provdutfis-subregolamenti (3) sa (7). Minkejja kull disposizzjoni oħra f’dawnir-regolamenti, l-unika persuna li tista’ tappella minn sospensjoniproviŜorja hi l-atleta jew persuna oħra li fuqhom hija imposta s-sospensjoni proviŜorja.

(4) F’kaŜijiet li jori āinaw minn kompetizzjonijietf’avveniment internazzjonali jew f’kaŜijiet li jinvolvu atleti ta’ livellinternazzjonali, id-deëiŜjoni tista’ tiāi appellata esklussivamentquddiem il-CAS skont id-disposizzjonijiet applikabbli quddiem dinil-qorti.

(5) F’kaŜijiet li jinvolvu atleti ta’ livell nazzjonali li magħandhomx id-dritt għal appell skont is-subregolament (4), il-KADjew l-assoëjazzjoni nazzjonali għandu jkollhom proëedura ta’ appellimħejjija li tirrispetta l-prinëipji deskritti fir-regolament 8. Id-drittijietgħall-appell tal-federazzjoni internazzjonali rigward dawn il-kaŜijiethuma stabbiliti fis-subregolament (6).

(6) F’kaŜijiet taħt is-subregolament (4), l-atleta jew persunaoħra li tkun is-suāāett tad-deëiŜjoni li tkun qed tiāi appellata; il-partil-oħra tal-kaŜ li fih ittieħdet id-deëiŜjoni; l-KAD, u l-federazzjoniinternazzjonali rilevanti; l-organizzazzjoni tal-anti-doping tal-pajjiŜ

fejn il-persuna hija residenti jew il-pajjiŜi fejn il-persuna għandha ë-ëittadinanza jew għandha l-liëenzja; il-kumitat olimpikuinternazzjonali jew il-kumitat paraolimpiku internazzjonali, kif ikunapplikabbli, fejn id-deëiŜjoni jista’ jkollha effett relatat mal-logħobtal-olimpjadi, inkluŜi deëiŜjonijiet li jaffettwaw l-eliāibbiltà għal-logħob olimpiku jew logħob paraolimpiku; u l-WADA huma l-partijiet li għandhom dritt għall-appell quddiem il-CAS.

(7) F’kaŜijiet taħt is-subregolament (5), il-partijiet ligħandhom id-dritt għall-appell quddiem il-bord tal-analiŜi fuq livellnazzjonali għandhom ikunu skont kif inhu stipolat fir-regolamenti tal-assoëjazzjoni nazzjonali iŜda, mill-inqas, għandhom jinkludu l-atletajew persuna oħra li tkun is-suāāett tad-deëiŜjoni li tkun qed tiāiappellata; il-parti l-oħra tal-kaŜ li fih ittieħdet id-deëiŜjoni; il-KAD ul-federazzjoni internazzjonali; u l-organizzazzjoni tal-anti-doping tal-pajjiŜ fejn il-persuna hija residenti jew il-pajjiŜi fejn il-persunagħandha ë-ëittadinanza jew għandha l-liëenzja; u l-WADA:

IŜda għall-kaŜijiet taħt is-subregolament (5), il-WADA u l-federazzjoni internazzjonali għandu jkollhom id-dritt ukoll għall-appell quddiem il-CAS rigward id-deëiŜjoni tal-bord tal-analiŜi fuqlivell nazzjonali.

(8) Fejn, f’kaŜ partikolari, il-Kunsill jonqos milli jagħtideëiŜjoni rigward jekk sarx ksur tar-regoli tal-anti-doping f’limitu ta’Ŝmien raāonevoli stabbilit mill-WADA, il-WADA tista’ tiddeëiedi litappella l-kaŜ direttament quddiem il-CAS bħallikieku l-Kunsill tadeëiŜjoni li ma nstabx ksur tar-regoli tal-anti-doping. Jekk l-elenkutal-CAS jiddetermina li kien hemm ksur tar-regoli tal-anti-doping u lil-WADA aāixxiet b’mod raāonevoli fid-deëiŜjoni li tappelladirettament il-kaŜ quddiem il-CAS, f’dak il-kaŜ l-ispejjeŜ tal-WADAu l-ispejjeŜ tal-avukati li mexxew il-prosekuzzjoni tal-appellgħandhom jintraddu lura lill-WADA mill-Kunsill.

(9) DeëiŜjonijiet mill-Kunsill li ji ëħdu TUEs, li mhumiexirrevokati mill-WADA, jistgħu jiāu appellati mill-atleti ta’ livellinternazzjonali quddiem il-CAS jew quddiem l-elenku tal-appell tal-anti-doping nazzjonali, meta l-atleta mhux atleta ta’ livellinternazzjonali. F’kaŜ li l-elenku tal-appell tal-anti-doping nazzjonalijirrevoka d-deëiŜjoni għaë-ëaħda ta’ TUE, dik id-deëiŜjoni tista’ tiāiappellata quddiem il-CAS mill-WADA. L-elenku tal-appell tal-anti-doping nazzjonali li jkun qed jikkonsidra appell taħt dan is-subregolament m’għandux jinkludi membri tal-Kumitat tat-TUE.

(10) DeëiŜjonijiet mill-WADA li jirrevokaw l-għoti jew ëaħdata’ TUE jistgħu, soāāetti għar-regolament tal-CAS, jiāu appellatiesklussivament quddiem il-CAS mill-Atleti jew mill-Kunsill.

(11) Meta l-Kunsill jonqos milli jieħu azzjoni fi Ŝmienraāonevoli fuq applikazzjoni għat-TUE li tkun āiet sottomessa b’modadattat, in-nuqqas tiegħu li jiddeëiedi jista’ jitqies bħala ëaħda għall-finijiet tad-drittijiet tal-appell provduti f’dan is-subregolament.

(12) DeëiŜjonijiet mill-Kunsill skont ir-regolament 13 jistgħujiāu appellati esklussivament quddiem il-CAS mill-assoëjazzjoninazzjonali.

(13) IŜ-Ŝmien għal rikors ta’ appell quddiem il-CAS għandujkun ta’ wieħed u għoxrin āurnata mid-data li l-parti appellantitirëievi d-deëiŜjoni. Minbarra dak imsemmi hawn fuq, li āej għandujapplika b’rabta ma’ appelli ppreŜentati mill-parti intitolata għall-appell iŜda li ma kinitx involuta fil-proëeduri li wasslu għad-deëiŜjonili hi soāāetta għall-appell:

(a) fi Ŝmien għaxart’ijiem minn notifika tad-deëiŜjoni,dik il-parti jew partijiet għandu jkollhom id-dritt li jitolbumingħand l-organizzazzjoni li tkun ħarāet id-deëiŜjoni kopjatar-rapport li qagħdet fuqu dik l-organizzazzjoni; u

(b) jekk dik it-talba ssir fi Ŝmien għaxart’ijiem, f’dakil-kaŜ il-parti li tagħmel dik it-talba għandu jkollha wieħed ugħoxrin āurnata minn meta tirëievi r-rapport biex tippreŜentarikors ta’ appell quddiem il-CAS.

It-terminu għar-rikors ta’ appell jew intervent sottomessmill-WADA g ħandu jkun l-aktar tard ta’ wieħed u għoxrināurnata wara l-aħħar āurnata li fih xi parti oħra fil-kaŜ setgħetappellat jew wieħed u għoxrin āurnata wara li l-WADA tkunirëeviet il-fajl komplut relatat mad-deëiŜjoni.

Ħarsien ta’ dawn ir-regolamenti.

15. (1) L-assoëjazzjonijiet sportivi nazzjonali kollhagħandhom iħarsu dawn ir-regolamenti. Dawn ir-regolamentigħandhom jiāu inkorporati jew direttament jew b’referenza fir-regolamenti ta’ kull assoëjazzjoni nazzjonali. L-assoëjazzjonijietnazzjonali kollha għandhom jinkludu fir-regolamenti tagħhom ir-regolamenti proëedurali neëessarji għall-implimentazzjoni effettivata’ dawn ir-regolamenti tal-anti-doping. Kull assoëjazzjoni nazzjonaligħandha tikseb l-għarfien u ftehim bil-miktub, fil-formola mehmuŜabħala Skeda 1, tal-atleti kollha soāāetti għall-kontroll tad-doping upersunal tal-appoāā tal-atleta għal dawk l-atleti. Madankollu,irrispettivament jekk il-formola āietx iffirmata, ir-regolamenti ta’ kullassoëjazzjoni nazzjonali għandhom jistipolaw li l-atleti, persunal tal-appoāā tal-atleta u persuni oħra taħt il-āurisdizzjoni tal-assoëjazzjoninazzjonali għandhom ikunu marbuta b’dawn ir-regolamenti.

(2) Bħala kondizzjoni għar-riëeviment ta’ assistenzafinanzjarja jew assistenza oħra mill-gvern ta’ Malta u, jew il-Kunsill,assoëjazzjonijiet nazzjonali għandhom jaëëettaw u jikkonformawmal-ispirtu u t-termini tal-programm tal-anti-doping nazzjonali udawn ir-regolamenti, inkluŜa l-applikazzjoni tas-sanzjonijiet tiegħufuq individwi, u għandhom jirrispettaw l-awtorità ta’ u jikkoperawmal-Kunsill u l-awtoritajiet tas-smigħ fil-kwistjonijiet kollha relatatimal-anti-doping li mhumiex regolati bir-regolamenti tal-federazzjoniinternazzjonali rilevanti b’mod konformi mal-Kodiëi.

(3) Meta assoëjazzjoni nazzjonali tkun irëiviet sejba analitikaavversa fuq wieħed mill-atleti tagħha, għandha tirrapporta l-informazzjoni li āejja lill-federazzjoni internazzjonali u l-WADA fiŜmien erbatax-il āurnata mill-proëess deskritt fir-regolamenti 8(1)(b)u (ë): l-isem, pajjiŜ, sport u dixxiplina fl-isport tal-atleta, jekk it-testkienx in-competition jew out-of-competition, id-data tal-ābir tal-kampjun u r-riŜultat analitiku rraportat mil-laboratorju. L-assoëjazzjoni nazzjonali għandha taāāorna regolarment lill-KAD, il-federazzjoni internazzjonali u l-WADA dwar l-istat u s-sejbiet ta’ kullanaliŜi jew proëeduri li saru b’konformità mar-regolamenti 8, 9, jew14, u informazzjoni komparabbli għandha tiāi provduta lill-KAD, il-federazzjoni internazzjonali u l-WADA fi Ŝmien erbatax-il āurnatamin-notifika deskritta fir-regolament 8(1)(i), rigward ksur ieħor ta’dawn ir-regolamenti. Fi kwalunkwe kaŜ li fih il-perjodu ta’ineliāibbiltà jitneħħa skont ir-regolament 11(5)(a) jew jitnaqqasskont ir-regolament 11(5), il-KAD, il-federazzjoni internazzjonali u l-WADA għandhom jingħataw deëiŜjoni raāunata li tispjega l-baŜigħall-eliminazzjoni jew tnaqqis. La l-KAD, la l-federazzjoniinternazzjonali u lanqas il-WADA ma għandhom jikxfu din l-informazzjoni minbarra lil dawk il-persuni fl-organizzazzjonijiettagħhom li jkun neëessarju li jkunu jafu, sakemm l-assoëjazzjoninazzjonali tagħmilha pubblika jew naqset milli tiŜvela lill-pubblikukif stipolat fis-subregolament (8).

(4) Il-Kunsill għandu jirrapporta minnufih kull TUE mogħtijalil atleta, minbarra dawk l-atleti li mhumiex fir-registered testingpool, lill-federazzjoni internazzjonali applikabbli, lill-federazzjonisportiva nazzjonali tal-atleta u lill-WADA.

(5) Il-Kunsill għandu jissottometti l-whereabouts informationkurrenti tal-atleta lill-WADA. Il-WADA għandha tagħmel din l-informazzjoni aëëessibbli lill-organizzazzjonijiet l-oħra tal-anti-doping li għandhom l-awtorità jittestjaw lill-atleta.

(6) Il-Kunsill għandu jirrapporta t-testijiet kollha in-competition u out-of-competition lill-WADA mill-aktar fis possibbliwara li jkunu twettqu dawn it-testijiet.

(7) Din l-informazzjoni għandha tibqa’ tinŜamm strettamentkunfidenzjali f’kull ħin; għandha tintuŜa esklussivament għall-finijiettal-ippjanar, kordinazzjoni jew twettiq ta’ testijiet u għandha tinqeredwara li ma tkunx aktar rilevanti għal dawn il-finijiet.

(8) Il-KAD u l-assoëjazzjonijiet nazzjonali ma għandhomxjidentifikaw pubblikament atleti li l-kampjuni tagħhom irriŜultawf’sejbiet analitiëi avversi, jew li kienu allegati li kisru artikoli oħra ta’dawn ir-regolamenti sakemm ikun determinat fi smigħ, b’konformitàmar-regolament 9, li sar ksur tar-regolamenti tal-anti-doping, jew li s-smigħ āie rrinunzjat, jew l-asserzjoni ta’ ksur tar-regoli tal-anti-doping ma āietx ikkontestata fil-ħin, jew l-atleta āie sospiŜproviŜorjament. Ladarba jkun stabbilit ksur ta’ dawn ir-regolamenti,dan għandu jkun rapportat pubblikament fi Ŝmien għoxrin āurnata.

(9) Kull deëiŜjoni mill-federazzjoni internazzjonali jewassoëjazzjoni nazzjonali rigward ksur ta’ dawn ir-regolamentigħandha tiāi rikonoxxuta mill-assoëjazzjonijiet nazzjonali kollha ligħandhom jieħdu l-passi kollha neëessarji sabiex dawk ir-riŜultatijiāu fis-seħħ.

(10) Il-Kunsill għandu jippubblika kull sena rapport statistikuāenerali tal-attivitajiet tiegħu tal-kontroll tad-doping matul is-senakalendarja b’kopja provduta lill-WADA.

Rikonoxximent tal-ittestjar eëë.

16. Soāāett għad-dritt ta’ appell kif stipulat fir-regolament 14,l-ittestjar, TUEs u riŜultati ta’ proëeduri ta’ smigħ u sentenzi oħrafinali ta’ kull firmatarju tal-Kodiëi li huma konsistenti mal-Kodiëi uhuma fil-limiti tal-awtorità tal-Firmatarju, għandhom jiāu rikonoxxutiu rispettati mill-KAD u l-assoëjazzjonijiet nazzjonali. L-KDC u l-assoëjazzjonijiet nazzjonali jistgħu jirrikonoxxu l-istess azzjonijietminn organizzazzjonijiet oħra li ma aëëettawx il-Kodiëi jekk ir-regolamenti ta’ dawk l-organizzazzjonijiet huma bi kwalunkwe modieħor konsistenti mal-Kodiëi.

Perjodu preskrittiv.

17. L-ebda azzjoni ma għandha tittieħed skont dawn ir-regolamenti kontra atleta jew persuna oħra għall-ksur ta’ regola tal-anti-doping li tinstab f’dawn ir-regolamenti kemm-il darba dik l-azzjoni ma nbdietx fi Ŝmien tmien snin mid-data meta l-vjolazzjonitkun saret.

Rapport kull sentejn.

18. Il-KAD tirrapporta lill-WADA fuq il-konformità tal-Kunsill mal-Kodiëi kull sentejn u għandha tispjega r-raāunijiet għalkull nuqqas ta’ konformità.

19. (1) Il-Kunsill jista’ minn Ŝmien għal Ŝmien joħroākummenti u linji gwida li jirreferu għal dawn ir-regolamenti.

(2) L-Iskeda 1 għandha tiāu kkonsidrata bħala parti integralita’ dawn ir-regolamenti.

(3) Dawn ir-regolamenti āew adottati b’konformità mad-disposizzjonijiet applikabbli tal-Kodiëi u għandhom jiāu interpretatib’mod li jkun konsistenti mad-disposizzjonijiet applikabbli tal-Kodiëi. Il-kummenti li jannotaw id-diversi disposizzjonijiet tal-Kodiëi għandhom jintuŜaw sabiex, fejn ikunu applikabbli, jassistu fil-fehim u l-interpretazzjoni ta’ dawn ir-regolamenti.

(4) Dawn ir-regolamenti ma għandhomx japplikawretrospettivament għal kwistjonijiet pendenti qabel id-data ta’ metadawn ir-regolamenti daħlu fis-seħħ.

Anti-Doping Regulations, 2011

IN exercise of the powers conferred by article 6(1)(n) and 53 ofthe Sports Act, the Minister of Education, Employment and theFamily, after consultation with the Kunsill Malti għall-Isport, hasmade the following regulations:-

Citation.1. The title of these regulations is the Anti-DopingRegulations, 2011.

Definitions.2. In these regulations, unless the context otherwise requires:

"ADAMS" means the anti-doping administration andmanagement system maintained by WADA;

"ADC" means the Anti-Doping Commission appointed by theMinister responsible for Sports to oversee all aspects of the NADO’sAnti-Doping Programme in accordance with the international standardfor testing. The Anti-Doping Commission is to consist of a chairpersonand a minimum of three and a maximum of five other members withexpertise in the field of anti-doping;

"adverse analytical finding" means a report from a laboratory orother approved Testing entity that identifies in a sample the presenceof a prohibited substance or its metabolites or markers, includingelevated quantities of endogenous substances, or evidence of the useof a prohibited method;

"anti-doping organisation" means a signatory that is responsiblefor adopting regulations for initiating, implementing or enforcing anypart of the doping control process.;

"athlete" means any person who participates in sport at theinternational level as defined by each international federation, at thenational level as defined by each national anti-doping organisation,including but not limited to those persons in its registered testingpool, and any other competitor in sport who is otherwise subject tothe jurisdiction of any signatory or other sports organisationaccepting the Code. All provisions of the Code including testing, andtherapeutic use exemptions must be applied to international and

national-level competitors. Some national anti-doping organisationsmay elect to test and apply anti-doping regulations to recreational-level or masters-competitors who are not current or potential nationalcalibre competitors. National anti-doping organisations are notrequired, however, to apply all aspects of the Code to such persons.Specific national regulations may be established for doping controlfor non-international-level or national-level competitors withoutbeing in conflict with the Code. Thus, a country could elect to testrecreational-level competitors but not require therapeutic useexemptions or whereabouts information. In the same manner, a majorevent organisation holding an event only for masters-levelcompetitors could elect to test the competitors but not requireadvance therapeutic use exemptions or whereabouts information. Forthe purposes of administration or attempted administration, and forthe purposes of anti-doping information and education, any personwho participates in sport under the authority of any signatory,government, or other sports organisation accepting the Code, is anathlete;

"athlete support personnel" means coach, trainer, manager,agent, team staff, official, medical, paramedical personnel, parent orany other person working with, treating or assisting an athleteparticipating in or preparing for sports competition;

"attempt" means engaging in conduct that constitutes asubstantial step in a course of conduct which could or did culminatein the commission of an anti-doping rule violation; so however thatthere shall be no anti-doping rule violation based solely on an attemptto commit a violation if the person renounces the attempt prior to itbeing discovered by a third party not involved in the attempt;

"atypical finding" means a report from a laboratory or otherWADA-approved entity which requires further investigation asprovided by the international standard for laboratories or relatedtechnical documents prior to the determination of an adverseanalytical finding;

"CAS" means the Court of Arbitration of Sport;

"the Code" means the World Anti-Doping Code first adopted byWADA on 5 March, 2003, and any other subsequent amendments* ;

"competition" means a single race, match, game or singularathletic contest. For stage races and other athletic contests whereprizes are awarded on a daily or other interim basis the distinction

between a competition and an event will be as provided in theregulations of the applicable International Federation;

"consequences of anti-doping regulations violations" means anathlete’s or other person’s violation of an anti-doping rule that mayresult in any of disqualification, ineligibility and provisionalsuspension;

"the Council" means the Kunsill Malti għall-Isport establishedaccording to article 4 of the Act;

"disqualification" means the athlete’s results in a particularcompetition or event are invalidated, with all resulting consequencesincluding forfeiture of any medals, points and prizes;

"doping" means the occurrence of one or more of the anti-doping rule violations mentioned in regulation 3;

"doping control" means all steps and processes from testdistribution planning to ultimate disposition of any appeal includingwhere applicable all steps and processes in between, includingprovision of whereabouts information, sample collection andhandling, laboratory analysis, therapeutic use exemptions, resultsmanagement and hearings;

"event" means a series of individual competitions conductedtogether under one ruling body;

"event period" means the time between the beginning and end ofan event, as established by the ruling body of the event;

"illicit use" means the utilisation, application, ingestion,injection or consumption by any means whatsoever of any prohibitedsubstance or prohibited method;

"in-competition" means the period commencing twelve hoursbefore a competition in which the athlete is scheduled to participatethrough the end of such competition and the sample collectionprocess related to such competition unless provided otherwise in theregulations of an International Federation or other relevant anti-doping organisation;

"independent observer program" means a team of observers,under the supervision of WADA, who observe and may provideguidance on the doping control process at certain events and report ontheir observations;

"ineligibility" means the athlete or other person is barred for a

specified period of time from participating in any competition oranother activity or funding as provided in the Code under ‘Statusduring Ineligibility’;

"individual sport" means any sport that is not a team sport;

"international event" means an event where an internationalsport organisation is the ruling body for the event or appoints thetechnical officials for the event;

"international-level athlete" means an athlete designated by oneor more international federations as being within the registeredtesting pool for an international federation;

"international standard" means a standard adopted by WADA insupport of the Code. Compliance with an international standard asopposed to another alternative standard, practice or procedure shall besufficient to conclude that the procedures addressed by theinternational standard were performed properly. Internationalstandards shall include any technical documents issued pursuant tothe international standard;

"major event organisations" means continental associations ofnational olympic committees and other international multi-sportorganisations that function as the ruling body for any continental,regional or other international event;

"marker" means a compound, group of compounds, orbiological parameter or parameters that indicate the use of aprohibited substance or of a prohibited method;

"metabolite" means any substance produced by a bio-transformation process;

"minor" means a natural person who has not reached the age ofmajority as established by the applicable laws of the person’s countryof residence;

"national event" means a sport event involving international ornational-level athletes that is not an international event;

"national anti-doping appeal panel" means the panel appointedby the government or by the Council to adjudicate on appeals fromdecisions of the national anti-doping disciplinary panel;

"national anti-doping disciplinary panel" means the panelappointed by government or by the Council to adjudicate on allegedviolations of these regulations, unless the CAS is preferred;

"national anti-doping organisation" means the entity or entitiesdesignated by each country as possessing the primary authority andresponsibility to adopt and implement anti-doping regulations, directthe collection of samples, the management of test results, and theconduct of hearings, all at the national level. For the purposes of theseregulations, the Council is the designated entity;

"national association" means a national entity which isregistered and recognized by the Council as the entity governing sportin Malta;

"national-level athlete" means an athlete other than aninternational-level athlete who is designated by the national anti-doping organisation as being within the national anti-dopingorganisation registered testing pool;

"National Olympic Committee" means the organisationrecognised by the International Olympic Committee;

"no advance notice" means a doping control which takes placewith no advance warning to the athlete and where the athlete iscontinuously chaperoned from the moment of notification throughsample provision;

"no fault or negligence" means the athlete’s establishing that hedid not know or suspect, and could not reasonably have known orsuspected even with the exercise of utmost caution, that he hadillicitly used or been administered the prohibited substance or aprohibited method;

"no significant fault or negligence" means the athlete’sestablishing that his fault or negligence, when viewed in the totalityof the circumstances and taking into account the criteria for no faultor negligence, was not significant in relationship to the anti-dopingrule violation;

"out of competition" means any doping control which is not in-competition;

"participant" means any athlete or athlete-support personnel;

"person" means a natural person or an organisation or otherentity;

"possession" means the actual, physical possession, or theconstructive possession, which shall be found only if the person hasexclusive control over the prohibited substance or over the prohibitedmethod or the premises in which a prohibited substance or prohibited

method exists:

Provided that if the person does not have exclusive controlover the prohibited substance or over the prohibited method or thepremises in which a prohibited substance or prohibited method exists,constructive possession shall only be found if the person knew aboutthe presence of the prohibited substance or prohibited method andintended to exercise control over it:

Provided further that there shall be no anti-doping ruleviolation based solely on possession if, prior to receiving notificationof any kind that the person has committed an anti-doping ruleviolation, the person has taken concrete action demonstrating that theperson never intended to have possession and has renouncedpossession by explicitly declaring it to the National Anti-DopingOrganisation:

Provided also that notwithstanding anything to thecontrary in this definition, the purchase, including by any electronicor other means, of a prohibited substance or prohibited methodconstitutes possession by the person who makes the purchase;

"prohibited list" means the WADA list identifying theprohibited substances and the prohibited methods as adjourned fromtime to time;

"prohibited method" means any method so described on theprohibited list;

"prohibited substance" means any substance so described on theprohibited list;

"provisional hearing" means an expedited abbreviated hearingoccurring prior to a hearing under regulation 8 that provides theathlete with notice and an opportunity to be heard in either written ororal form;

"provisional suspension" means the athlete or other personbeing barred temporarily from participating in any competition priorto the final decision at a hearing conducted under the principle of the‘Right to a Fair Hearing’;

"publicly disclose" or "publicly report" means to disseminate ordistribute information to the general public or persons beyond thosepersons entitled to earlier notification in accordance with the relevantprovisions of the Code;

"registered testing pool" means the pool of top level athletesestablished separately by each international federation and nationalanti-doping organisation subject to both in-competition and out-of-competition testing as part of that international federation’s ornational anti-doping organisation’s test distribution plan;

"sample" or "specimen" means any biological material for thepurposes of doping control;

"signatories" means those entities signing the Code andagreeing to comply with the Code and WADA;

"specified substance" shall have the same meaning as that givenunder regulation 5(3);

"substantial assistance" means a person providing assistancethat fully discloses in a signed written statement all information suchperson possesses in relation to anti-doping violations and fullycooperates with the investigation and adjudication of any case relatedto that information, and shall include the presenting of testimony at ahearing if so requested by an anti-doping organisation or a hearingpanel. The information provided shall be credible and shall comprisean important part of any case which is initiated or, if no case isinitiated, shall have provided a sufficient basis on which a case couldhave been brought;

"tampering" means altering for an improper purpose or in animproper way, bringing improper influence to bear, interferingimproperly, obstructing, misleading or engaging in any fraudulentconduct to alter results or prevent normal procedures from occurring;or providing fraudulent information to an anti-doping organisation;

"target testing" means the selection of athletes for testing wherespecific athletes or groups of athletes are selected on a non-randombasis for testing at a specified time;

"team sport" means a sport in which the substitution of playersis permitted during a competition;

"testing" means the parts of the doping control processinvolving test distribution planning, sample collection, samplehandling, and sample transport to the laboratory;

"trafficking" means selling, giving, transporting, sending,delivering or distributing a prohibited substance or prohibited methodeither physically or by any electronic or other means by an athlete,athlete support personnel or any other person subject to the

jurisdiction of an anti-doping organisation to any third party;provided, however, this definition shall not include the actions ofbona fide medical personnel involving a prohibited substance used forgenuine and legal therapeutic purposes or other acceptablejustification, and shall not include actions involving prohibitedsubstances which are not prohibited in out-of-competition testingunless the circumstances as a whole demonstrate such prohibitedsubstances are not intended for genuine and legal therapeuticpurposes;

"TUE" means therapeutic use exemption;

"UNESCO Convention" means the International Conventionagainst Doping in Sport adopted by the 33rd session of the UNESCOGeneral Conference on 19 October, 2005 including all theamendments adopted by the State Parties to the Convention and theConference of Parties to the International Convention against Dopingin Sport;

"WADA" means the World Anti-Doping Agency, being afoundation constituted under the Swiss Civil Code in Lausanne on 10November, 1999 and any National Anti-Doping Organisationcontracted by WADA.

Responsibilities of athletes and persons.

3. (1) Athletes or persons shall be responsible forknowing what constitutes an anti-doping rule violation and thesubstances and methods which have been included in the prohibitedlist.

(2) It is each athlete’s personal duty to ensure that noprohibited substance enters his body. Athletes are responsible for anyprohibited substance or its metabolites or markers found to be presentin their samples. Accordingly, it is not necessary that intent, fault,negligence or knowing use on the athlete’s part be demonstrated inorder to establish an anti-doping violation under this sub-regulationand sub-regulations (3) to (6).

(3) Sufficient proof of an anti-doping rule violation under sub-regulation (2), this sub-regulation and sub-regulations (4) to (6) isestablished by either of the following:

(a) presence of a prohibited substance or itsmetabolites or markers in the athlete’s A sample where theathlete waives analysis of the B sample and the B sample is notanalysed; or

(b) where the athlete’s B sample is analysed and theanalysis of the athlete’s B sample confirms the presence of the

prohibited substance or its metabolites or markers found in theathlete’s A sample.

(4) The National Anti-Doping Organisation may furthermore,and in its discretion, choose to have the B sample analysed even if theathlete does not request the analysis of the B sample.

(5) Apart from those substances for which a quantitativethreshold is specifically identified in the prohibited list, the presenceof any quantity of a prohibited substance or its metabolites or markersin an athlete’s sample shall constitute an anti-doping rule violation.

(6) As an exception to the general rule of sub-regulations (2)to (5), the prohibited list or international standards may establishspecial criteria for the evaluation of prohibited substances that canalso be produced endogenously.

(7) The success or failure of the use or attempted use of aprohibited substance or prohibited method is irrelevant. It is sufficientthat the prohibited substance or prohibited method was used orattempted to be used for an anti-doping rule violation to becommitted.

(8) Refusing, or failing without compelling justification, tosubmit to sample collection after notification as authorised in theseregulations or otherwise evading sample collection shall beprohibited conduct whether such violation of refusing or failing tosubmit to sample collection results from intentional conduct of theathlete or negligent conduct of the athlete. In the case of evasion bythe athlete to submitting himself to sample collection shall be deemedto be intentional conduct by the athlete.

(9) Violation of applicable requirements regarding athleteavailability for out-of-competition testing set out in the internationalstandard for testing including failure to provide one’s whereaboutsinformation in accordance with article 11.3 of the InternationalStandard for Testing, providing for a ‘Filing Failure’, and failure to beavailable for testing at the declared whereabouts in accordance witharticle 11.4 of the International Standard for Testing, providing for a‘Missed Test’. Any combination of three missed tests and, or filingfailures committed within an eighteen-month period, as declared bythe Council, shall constitute an anti-doping rule violation.

(10) Possession by an athlete in-competition of any prohibitedmethod or any prohibited substance, or possession by an athlete out-of-competition of any prohibited method or any prohibited substancewhich is prohibited in out-of-competition testing unless the athlete

establishes that the possession is pursuant to a TUE granted inaccordance with regulations 5(5) to (8) or other acceptablejustification.

(11) Possession by an athlete support personnel in-competitionof any prohibited method or any prohibited substance, or possessionby athlete support personnel out-of-competition of any prohibitedmethod or any prohibited substance which is prohibited in out-of-competition testing, in connection with an athlete, competition ortraining, unless the athlete support personnel establishes that thepossession is pursuant to a TUE granted to an athlete in accordancewith regulations 5(5) to (8) or other acceptable justification.

(12) Trafficking or attempted trafficking in any prohibitedsubstance or prohibited method.

(13) Administration or attempted administration to any athletein-competition of any prohibited method or prohibited substance oradministration or attempted administration to any athlete out-of-competition of any prohibited method, or any prohibited substancethat is prohibited in out-of-competition testing or assisting,encouraging, aiding, abetting, covering up or any other type ofcomplicity involving an anti-doping rule violation or any attemptedanti-doping rule violation.

Responsibility of ADC s and national associations to establish breaches.

4. (1) The ADC and, or, the national associations areentrusted with the responsibility of establishing whether an anti-doping rule violation has occurred. The Council shall have its owndisciplinary tribunal for the determination of such violation, whichnational associations may avail themselves of if the latter do not havetheir own disciplinary tribunal. A violation of these regulations shallbe established if the Council and, or national association can prove tothe satisfaction of the disciplinary tribunal, bearing in mind theseriousness of the allegation that is made, that any one of theprovisions of regulation 3 has been violated. This degree of proof inall cases is greater than a mere balance of probability but less thanproof beyond a reasonable doubt. Where these regulations place theburden of proof upon the athlete or other person alleged to havecommitted an anti-doping rule violation to rebut a presumption orestablish specified facts or circumstances, the degree of proof shall beby a balance of probability, except as provided in articles 10.4 and10.6 of the Code where the athlete is bound to satisfy a higher burdenof proof.

(2) Facts related to anti-doping rule violations may beestablished by any reliable means, including admissions. Thefollowing regulations of proof shall be applicable in doping cases:

(a) WADA-accredited laboratories are presumed tohave conducted sample analysis and custodial procedures inaccordance with the international standard for laboratoryanalysis. The athlete or other person may rebut this presumptionby establishing that a departure from the international standardoccurred which could have reasonably caused the adverseanalytical finding. If the athlete or other person rebuts thepreceding presumption by showing that a departure from theinternational standard occurred which could have reasonablycaused the adverse analytical finding, then the ADC or thenational association shall have the burden to establish that suchdeparture did not cause the adverse analytical finding;

(b) departures from any other international standard orother anti-doping rule or policy which did not cause an adverseanalytical finding or other anti-doping rule violation shall notinvalidate such results. If the athlete or other person establishesthat a departure from another international standard or otheranti-doping rule or policy which could reasonably have causedthe adverse analytical finding or other anti-doping rule violationoccurred, then the ADC or the national association shall havethe burden to establish that such a departure did not cause theadverse analytical finding or the factual basis for the anti-doping rule violation;

(c) the facts established by a decision of a court orprofessional disciplinary tribunal of competent jurisdictionwhich is not the subject of a pending appeal shall be irrebuttableevidence against the athlete or other person to whom thedecision pertained of those facts unless the athlete or otherperson establishes that the decision violated principles ofnatural justice; and

(d) the hearing panel in a hearing on an anti-dopingrule violation may draw an inference adverse to the athlete orother person who is asserted to have committed an anti-dopingrule violation based on the athlete or other person’s refusal, aftera request made in a reasonable time in advance of the hearing, toappear at the hearing, either in person or telephonically asdirected by the tribunal, and to answer questions either from thetribunal or from the ADC or national association asserting theanti-doping rule violation.

Prohibited List.5. (1) These anti-doping regulations incorporate theprohibited list which is published and revised by WADA as describedin article 4.1 of the Code. The Council or its delegated authority willpublish such revised lists in the Government Gazette and further

make the current prohibited list available to each national association,and each national association shall ensure that the current prohibitedlist is available to its registered members.

(2) Unless provided otherwise in the prohibited list and, or arevision, the prohibited list and revisions that shall go into effectunder these regulations three months after publication of theprohibited list by WADA without requiring any further action by theCouncil. The Council shall also publish the prohibited list and, orrevision and, or updates in the Government Gazette.

(3) For the purposes of the application of sanctions onindividuals, all prohibited substances shall be specified substancesexcept substances in the classes of anabolic agents and hormones, andsuch stimulants and hormone antagonists and modulators soidentified on the prohibited list. Prohibited methods shall not bespecified substances:

Provided that in the case WADA expands the prohibitedlist by adding a new class of prohibited substances in accordance witharticle 4.1 of the Code, WADA’s executive committee shall determinewhether any or all prohibited substances within the new class ofprohibited substances shall be considered specified substances underarticle 4.2.2 of the Code.

(4) As provided in article 4.3.3 of the Code, WADA’sdetermination of the prohibited substances and prohibited methodsthat will be included on the prohibited list and the classification ofsubstances into categories on the prohibited list is final and shall notbe subject to challenge by an athlete or another person based on anargument that the substance or method was not a masking agent or didnot have the potential to enhance performance, represent a health riskor violate the spirit of sport.

(5) Athletes with a documented medical condition requiringthe use of a prohibited substance or a prohibited method must firstobtain a TUE. The presence of a prohibited substance or itsmetabolites or markers according to article 2.1 of the Code, use orattempted use of a prohibited substance or a prohibited methodaccording to article 2.2 of the Code, possession of prohibitedsubstances or prohibited methods according to article 2.6 of the Codeor administration of a prohibited substance or prohibited methodaccording to article 2.8 of the Code consistent with the provisions ofan applicable TUE issued pursuant to the international standard forTUEs shall not be considered an anti-doping rule violation.

(6) Athletes included by the ADC in its registered testing pool

and other athletes participating in any national event must obtain aTUE granted or recognised by the Council or its delegated authority.The application for a TUE must be made as soon as possible, in thecase of an athlete in the registered testing pool this would be whensuch athlete is first notified of being included in the pool, and in anyevent, save in emergency situations, no later than thirty days beforethe athlete’s participation in the event.

(7) The ADC shall delegate such authority to a panel ofspecialists to consider requests for TUEs, hereinafter the "TUEPanel". Upon the Council’s receipt of a TUE request, the Chairman ofthe TUE Panel shall appoint one or more members of the TUE Panel,which may include the Chairman, to consider such request. Any TUEPanel member so designated shall promptly evaluate such request inaccordance with the international standard for TUEs and forward adecision on such requests, which shall be the final decision of theCouncil or its delegated authority.

(8) WADA, at the request of an athlete or on its own initiation,may review the granting or denial of any TUE to an internationallevel athlete or a national level athlete that is included in a registeredtesting pool. If WADA determines that the granting or denial of aTUE did not comply with the international standard for TUEs in forceat the time, WADA may reverse that decision. Decisions on TUEs aresubject to further appeal as provided in regulation 14.

In-competition testing.

6. (1) All athletes affiliated with a national associationshall be subject to in-competition testing by the athlete’s nationalassociation, international federation, the ADC, national organisationsand any other anti-doping organisation responsible for testing at acompetition or event in which they participate. All athletes affiliatedwith a national association, including athletes serving to a period ofineligibility or a provisional suspension, shall also be subject to out-of-competition testing at any time or place, with or without advancenotice, by the athlete’s national association, international federation,WADA, the ADC, the national anti-doping organisation of anycountry where the athlete is national, resident, licence-holder, ormember of sport organisation, the international olympic committeeduring the olympic games, and the international paralympiccommittee during paralympic games.

(2) Tests requested by the ADC will be funded by the Councilitself. Other tests carried out in Malta by an international federationor national association are to be notified to the ADC within forty-eight hours prior to such tests being carried out and further to notifythe ADC with the results of such tests within seven days from receiptin writing.

(3) At international events, the collection of the doping controlsamples shall be initiated and directed by the internationalorganisation that is the ruling body for the event. If the internationalorganisation decides not to conduct any effective testing at such anevent, the ADC may, in coordination with and with the approval ofthe international organisation or WADA, initiate and conduct suchtesting. At national events, the collection of the doping controlsamples shall be initiated and directed by the ADC.

(4) The ADC as authorised by the Council, shall beresponsible for drawing up a test distribution plan in accordance witharticle 4 of the international standard for testing, and for theimplementation of that plan, including overseeing all testingconducted by the Council. Testing may be conducted by members ofthe ADC or by other qualified persons so authorised by the Council.

(5) Testing conducted by the ADC shall be in substantialconformity with the international standard for testing in force at thetime of testing.

(6) Blood or other non-urine samples may be used either todetect prohibited substances or prohibited methods or for screeningprocedure purposes or for longitudinal haematological profiling, alsoknown as "the passport". If the blood is collected for screening only,it will have no other consequences for the athlete other than toidentify such athlete for a urine test under these regulations. In thesecircumstances, the ADC may decide at its own discretion whichblood parameters are to be measured in the screening sample andwhat levels of those parameters will be used to indicate that an athleteshould be selected for a urine test.

(7) The ADC shall report completed tests through the WADAclearinghouse within fourteen working days to avoid unnecessaryduplication in testing.

(8) The ADC shall maintain a national level registered testingpool of those athletes who are required to comply with thewhereabouts requirements of the international standard for testing,and shall publish the criteria for athletes to be included in thisregistered testing pool as well as a list of the athletes meeting thosecriteria for the period in question. The ADC shall review and updateas necessary its criteria for including athletes in its registered testingpool, and shall revise the membership of its registered testing poolfrom time to time as appropriate in accordance with the set criteria.Each athlete in the registered testing pool shall:

(a) advice the ADC of his whereabouts on a quarterly

basis, in the manner set out in article 11.3 of the InternationalStandard for Testing;

(b) shall update that information as necessary, inaccordance with article 11.4.2 of the International Standard forTesting, so that it remains accurate and complete at all times;and

(c) shall make himself available for Testing at suchwhereabouts, in accordance with article 11.4 of the InternationalStandard for Testing.

(9) An athlete’s failure to advise the ADC of his whereaboutsshall be deemed a filing failure for purposes of article 2.4 of the Codewhere the conditions of article 11.3.5 of the International Standard forTesting are met.

(10) An athlete’s failure to be available for testing at hisdeclared whereabouts shall be deemed a missed test for purposes ofarticle 2.4 of the Code where the conditions of article 11.4.3 of theInternational Standard for Testing are met.

(11) Each national association shall also assist the ADC inestablishing a national level registered testing pool of top levelnational athletes to whom the whereabouts requirements of theinternational standard for testing shall also apply.

(12) Whereabouts information provided pursuant to sub-regulations (8) and (11) shall be shared with WADA and other anti-doping organisations having jurisdiction to test an athlete inaccordance with articles 11.7.1(d) and 11.7.3(d) of the InternationalStandard for Testing, including the strict condition that it be used onlyfor doping control purposes.

(13) An athlete who has been identified by ADC for inclusionin the Council’s registered testing pool shall continue to be subject tothese regulations, including the obligation to comply with thewhereabouts requirements of the international standard for testing,unless and until the athlete gives written notice to ADC that he hasretired or until he no longer satisfies the criteria for inclusion in theADCs registered testing pool and has been so informed by ADC.

(14) An athlete who has given notice of retirement to ADC maynot compete again unless he or she notifies ADC at least six monthsbefore he expects to return to competition and is available forunannounced out-of-competition testing, including, if requested,complying with the whereabouts requirements of the international

standard for testing at any time during the period before actual returnto competition.

(15) International federations and the national associations mayestablish similar requirements for retirement and returning tocompetition for athletes in the international registered testing pool.

(16) At international events in Malta, the internationalfederation shall determine the number of finishing placement tests,random tests and target tests to be performed.

(17) In national events, the ADC shall determine the number ofathletes selected for testing in each competition and the proceduresfor selecting the athletes for testing and shall include any athlete whoestablishes or breaks a world regional or national record.

(18) In addition to the selection procedures set forth in sub-regulations (16) and (17), the international federation anti-dopingcommission at international events, and the ADC at national events,may also select athletes or teams for target testing so long as suchtarget testing is not used for any purpose other than legitimate dopingcontrol purposes.

(19) The ADC shall select athletes for out-of-competitiontesting. This process will substantially comply with the internationalstandard for testing in force at the time of selection.

(20) National associations and the organising committees fornational association events shall provide access to independentobservers at events as directed by the ADC.

Analysis of drug control samples.

7. Doping control samples collected under these regulationsshall be analyzed in accordance with the following principles:

(a) for the purposes of article 2.1 of the Code, the ADCshall send doping control samples for analysis only to WADA-accredited laboratories or as otherwise approved by WADA.The choice of the WADA-accredited laboratory, or otherlaboratory or method approved by WADA, used for the sampleanalysis shall be determined exclusively by the ADC;

(b) doping control samples shall be analyzed to detectprohibited substances and prohibited methods identified on theprohibited list and other substances as may be directed byWADA pursuant to the monitoring program described in article4.5 of the Code or to assist the ADC in profiling relevantparameters in an athlete’s urine, blood or other matrix, includingDNA or genomic profiling, for anti-doping purposes;

(c) no sample may be used for any purpose other thanthe detection of substances, or classes of substances, or methodson the prohibited list, other than as described in article 6.2 of theCode without the athlete’s written consent. Samples used, withthe athlete’s consent, for purposes other than article 6.2 of theCode shall have any means of identification removed such thatthey cannot be traced back to a particular athlete;

(d) laboratories shall analyse doping control samples andreport results in conformity with the international standard forlaboratory analysis; and

(e) a sample may be reanalysed for the purposes described inarticle 6.2 of the Code at any time exclusively at the directive of anational anti-doping organisation or WADA. The circumstances andconditions for retesting samples shall conform with the requirementsof the international standard for laboratories.

Results Management.

8. (1) Results management for tests initiated by the ADC,including tests performed by WADA pursuant to agreement with theADC, shall proceed as set forth below:

(a) the results from all analyses must be sent to theADC in encoded form, in a report signed by an authorizedrepresentative of the laboratory. All communication must beconducted in such a way that the results of the analysis areconfidential;

(b) upon receipt of an A sample adverse analyticalfinding, the ADC shall conduct a review to determine whether:

(i) an applicable therapeutic use exemption hasbeen granted; or

(ii) there is any apparent departure from theinternational standards for testing or laboratory analysisthat undermines the validity of the adverse analyticalfinding;

(c) if the initial review under sub-regulation (1)(b)doesnot reveal an applicable therapeutic use exemption or departurefrom the international standard for testing or the internationalstandard for laboratory analysis in force at the time of testing oranalysis that undermines the validity of the adverse analyticalfinding, ADC shall promptly notify the athlete and his nationalassociation of:

(i) the adverse analytical finding;

(ii) the anti-doping rule violated, or, in a caseunder sub-regulations (1)(h) or (1)(i), a description of theadditional investigation to be conducted as to whetherthere is an anti-doping rule violation;

(iii) the athlete’s right to promptly request theanalysis of the B sample or, failing such request, that the Bsample analysis may be deemed waived;

(iv) the scheduled date, time and place for the Bsample analysis if the athlete chooses to request ananalysis of the B sample;

(v) the opportunity for the athlete or the athlete’srepresentative to attend the B sample opening an analysiswithin the time period specified in the internationalstandard for laboratories if such analysis is requested; and

(vi) the athlete’s right to request copies of the Aand B sample laboratory documentation package whichincludes information as required by the internationalstandard for laboratories;

(d) arrangements shall be made for testing the Bsample within three weeks of the notification described in sub-regulation (1)(c). An athlete may accept the A sample analyticalresults by waiting the requirement for B sample analysis. TheADC may nonetheless elect to proceed with the B sampleanalysis;

(e) the athlete or his representative have the right to bepresent at the analysis of the B sample at their own cost. Arepresentative of the athlete’s national association as well as arepresentative of the ADC shall also be allowed to be presentbut again at their own cost. The athlete shall be informed of thelaboratory, date and time when the B sample shall be analysed;

(f) if the B sample proves negative, the entire test shallbe considered negative and the athlete, his national association,and ADC shall be so informed and the investigation and allprocedures closed;

(g) if a prohibited substance or the use of a prohibitedmethod is identified, the findings shall be reported to the athlete,to the athlete’s national association, ADC, and to WADA;

(h) the ADC shall conduct any follow-up investigation

as may be required by the prohibited list. Upon completion ofsuch follow-up investigation, the ADC shall promptly notify theathlete regarding the results of the follow-up investigation andwhether or not the ADC asserts that an anti-doping rule wasviolated; and

(i) for apparent anti-doping rule violations that do notinvolve adverse analytical findings, the ADC shall conduct anynecessary follow-up investigations and shall then promptlynotify the athlete of the anti-doping rule which appears to havebeen violated, and the basis of the violation. The nationalassociation shall conduct any investigation within a thirty dayperiod.

(2) Results management and the conduct of hearings from atest by the major event organisation shall be managed by theinternational federation, apart from sanctions beyond disqualificationfrom the event or the results of the event.

(3) The national association, after consultation with the ADC,shall temporarily suspend an athlete prior to the opportunity for a fullhearing based on an adverse analytical finding from the athlete’s Asample or A and B samples and the review described in sub-regulation (1). In the eventuality of a negative result after B sampletesting, the suspension shall be automatically lifted and the athleteallowed to compete forthwith.

(4) Where a provisional suspension is imposed on an athlete,the athlete shall be given either:

(a) a provisional hearing prior to the imposition of theprovisional suspension; or

(b) a provisional hearing as soon as possible, withinten days, after the imposition of the provisional suspension.Extensions may be granted upon written notification; or

(c) an expedited hearing as soon as possible after theimposition of the provisional suspension.

(5) All provisional hearings must be conducted in accordancewith article 8 of the Code.

(6) Where a Provisional Suspension has been imposed inrelation to a doping control officer report or related documentationshowing a possible anti-doping rule violation and the Councildetermines, following the athlete’s submission, that there has been no

anti-doping rule violation, then the provisional suspension shall berescinded immediately.

(7) If the Council declares that there has been no anti-dopingrule violation, it shall immediately inform the athlete’s internationalfederation, national association, national anti-doping organisation andWADA.

(8) If an athlete or other person retires while a resultsmanagement process is underway, the anti-doping organisationconducting the results management process retains competence tocomplete its results management process. If an athlete or other personretires before any results management process has begun, the anti-doping organisation which would have had results managementcompetence over the athlete or other person at the time the athlete orother person committed an anti-doping rule violation, shall havecompetence to conduct results management.

Right to a fair hearing.

9. (1) When it appears, following the results managementprocess described in regulation 8, that these regulations have beenviolated, the athlete or other person involved shall be brought beforea disciplinary panel of the ADC or of the athlete or other person’snational association for a hearing to adjudicate whether a violation ofthese regulations occurred and if so what consequences should beimposed. Such hearing process shall respect the following principles:

(a) a decision within a reasonable time;

(b) a fair and impartial tribunal;

(c) the right to be assisted or represented by counselwhich expenses are to be incurred by the athlete;

(d) the right to be informed within a reasonable time ofthe alleged anti-doping rule violation;

(e) the right of reply to the alleged anti-doping ruleviolation;

(f) the right of each party to present evidence,including the right to call and examine witnesses, subject to thetribunal’s discretion to accept testimony by telephony or writtensubmission;

(g) the athlete’s right to an interpreter at the hearing;and

(h) a decision which clearly identifies the basis on

which the conclusion was reached.

(2) The ADC disciplinary panel has the power to hear anddetermine all issues arising from any matter which is referred to itpursuant to these regulations. In particular, the ADC disciplinarypanel has the power to determine the consequences of anti-dopingrule violations to be imposed pursuant to these regulations.

(3) When it appears, following the results managementprocess described in regulation 8, that these regulations may havebeen violated, the ADC shall refer the matter to the disciplinary panelfor adjudication as to whether a violation of these regulations hasoccurred and, if so, what consequences should be imposed.

(4) The appointed members of the panel shall have had nominor involvement in the case. Each member, upon appointment,shall disclose to the chair any circumstances likely to affect theirimpartiality with respect to any of the parties.

Disqualification from competition.

10. A violation of these regulations in individual sports inconnection with an in-competition test automatically leads todisqualification of the result obtained in that competition with allresulting consequences, including forfeiture of any medals, pointsand prizes.

Anti-doping rule violation.

11. (1) An anti-doping rule violation occurring during orin connection with an event may, upon the decision of the ruling bodyof the event, lead to disqualification of all of the athlete’s individualresults obtained in that event with all consequences, includingforfeiture of all medals, points and prizes, except as provided inarticles 10.1.1. and 10.1.2 of the Code. Nonetheless, if the athleteestablishes that he bears no fault or negligence for the violation, theathlete’s individual results in the other competition shall not bedisqualified unless the athlete’s results in competition other than thecompetition in which the anti-doping rule violation occurred werelikely to have been affected by the athlete’s anti-doping ruleviolation.

(2) The period of ineligibility imposed for a violation ofarticles 2.1 2.2 and 2.6 of the Code shall be as follows, unless theconditions for eliminating or reducing the period of ineligibility, asprovided in sub-regulations (4) and (5), or the conditions forincreasing the period of ineligibility, as provided in sub-regulation(6), are met, for a first violation two years ineligibility.

(3) The period of ineligibility for violations of these anti-doping regulations shall be:

(a) for violations of articles 2.3 or 2.5 of the Code, theineligibility period shall be two years unless the conditionsprovided in sub-regulation (5), or the conditions provided inarticle 10.6 of the Code, are met;

(b) for violations of articles 2.7 or 2.8 of the Code, theperiod of ineligibility imposed shall be a minimum of four yearsup to lifetime ineligibility unless conditions provided in sub-regulation (5) are met. An anti-doping rule violation involving aminor shall be considered a particularly serious violation, and, ifcommitted by athlete support personnel for specified substancesreferenced in regulation 5(3), shall result in lifetime ineligibilityfor such athlete support personnel. In addition, significantviolations of such articles, which also violate non-sporting lawsand regulations, shall be reported to the competentadministrative, professional or judicial authorities;

(c) for violations of article 2.4 of the Code, the periodof ineligibility shall be for a first violation a minimum of oneyear to a maximum of two years ineligibility based on theathlete’s degree of fault.

(4) (a) Where an athlete or other person can establish howa specified substance entered his body or came into his possessionand that such specified substance was not intended to enhance theathlete’s sport performance or mask the use of a performance-enhancing substance, the period of ineligibility found in sub-regulation (2) shall be replaced with at a minimum, a reprimand andno period of ineligibility from future events and, at a maximum, twoyears ineligibility for a first violation;

(b) In order to justify any elimination or reduction, theathlete or other person shall produce corroborating evidence inaddition to his or her word which establishes to the comfortablesatisfaction of the hearing panel the absence of an intent toenhance sport performance or mask the use of a performanceenhancing substance. The athlete or other person’s degree offault shall be the criteria considered in assessing any reductionof the period of ineligibility.

(5) Based on exceptional circumstances the following mayeliminate or reduce the period of ineligibility:

(a) if an athlete establishes in an individual case thathe bears no fault or negligence, the otherwise applicable periodof ineligibility shall be eliminated. When a prohibited substanceor its markers or metabolites is detected in an athlete’s sample in

violation of article 2.1 of the Code, the athlete must alsoestablish how the prohibited substance entered his system inorder to have the period of ineligibility eliminated. In the eventthis paragraph is applied and the period of ineligibilityotherwise applicable is eliminated, the anti-doping ruleviolation shall not be considered a violation for the limitedpurpose of determining the period of ineligibility for multipleviolations under article 10.7 of the Code;

(b) if an athlete or other person establishes in anindividual case that he bears no significant fault or negligence,then the period of ineligibility may be reduced, but the reducedperiod of ineligibility may not be less than one-half of theperiod of ineligibility otherwise applicable. If the otherwiseapplicable period of ineligibility is a lifetime, the reducedperiod under this paragraph may be no less than eight years.When a prohibited substance or its markers or metabolites isdetected in an athlete’s sample in violation of article 2.1 of theCode, the athlete shall also establish how the prohibitedsubstance entered his system in order to have the period ofineligibility reduced;

(c) the national association’s tribunal may prior to afinal appellate decision under regulation 14 or the expiration ofthe time to appeal, suspend a part of the period of ineligibilityimposed in an individual case where the athlete or other personhas provided substantial assistance to an anti-dopingorganisation, criminal authority or professional disciplinarybody which results in the anti-doping organisation discoveringor establishing an anti-doping rule violation by another personor which results in a criminal or disciplinary body discoveringor establishing a criminal offense or the breach of professionalregulations by another person. After a final appellate decisionunder regulation 14 or the expiration of time to appeal, thenational level reviewing body may only suspend a part of theapplicable period of ineligibility with the approval of WADAand the applicable international federation. The extent to whichthe otherwise applicable period of ineligibility may besuspended shall be based on the seriousness of the anti-dopingrule violation committed by the athlete or other person and thesignificance of the substantial assistance provided by the athleteor other person to the effort to eliminate doping in sport. Nomore than three-quarters of the otherwise applicable period ofineligibility may be suspended. If the otherwise applicableperiod of ineligibility is a lifetime, the non-suspended periodunder this section must be no less than eight years. If the

national level reviewing body suspends any part of the period ofineligibility under this paragraph, it shall promptly provide awritten justification for its decision to each anti-dopingorganisation having a right to appeal the decision. If the nationallevel reviewing body subsequently reinstates any part of thesuspended period of ineligibility because the athlete or otherperson has failed to provide the substantial assistance whichwas anticipated, the athlete or other person may appeal thereinstatement pursuant to regulations 14(3) to (7);

(d) where an athlete or other person voluntarily admitsthe commission of an anti-doping rule violation before havingreceived notice of a sample collection which could establish ananti-doping rule violation or, in the case of an anti-doping ruleviolation other than regulations 3(1) to (6), before receiving firstnotice of the admitted violation pursuant to regulation 8 and thatadmission is the only reliable evidence of the violation at thetime of admission, then the period of ineligibility may bereduced, but not below one-half of the period of ineligibilityotherwise applicable;

(e) before applying any reductions under regulations11 (5)(b), (c) or (d), the otherwise applicable period ofineligibility shall be determined in accordance with regulations11 (2) to (4) and 11(6). If the athlete or other person establishesentitlement to a reduction or suspension of the period ofineligibility under two or more of regulations 11 (5)(b) to (d),then the period of ineligibility may be reduced or suspended, butnot below one-quarter of the otherwise applicable period ofineligibility.

(6) If the national level reviewing body establishes in anindividual case involving an anti-doping rule violation other thanviolations under regulations 3(13) and (14) that aggravatingcircumstances are present which justify the imposition of a period ofineligibility greater than the standard sanction, then the period ofineligibility otherwise applicable shall be increased up to a maximumof four years unless the athlete or other person can prove to thecomfortable satisfaction of the hearing panel that he did notknowingly commit the anti-doping rule violation. An athlete or otherperson can avoid the application of this sub-regulation by admittingthe anti-doping rule violation as asserted promptly after beingconfronted with the anti-doping rule violation by the national levelreviewing body.

(7) For an athlete or other person’s first anti-doping ruleviolation, the period of ineligibility is set forth in regulations 11(2)

and (3), subject to elimination, reduction or suspension underregulations 11(4) and (5), or to an increase under regulation 11(6).For a second anti-doping rule violation the period of ineligibility shallbe within the range set forth in the table below:

For the purposes of the second anti-doping rule violation table:

"RS" means reduced sanction for specified substance underregulation 11(4). The anti-doping rule violation was or should besanctioned by a reduced sanction under regulation 11(4) because itinvolved a specified substance and the other conditions underregulation 11(4) were met;

"FFMT" means filing failures or missed tests. The anti-dopingrule violation was or should be sanctioned under regulation 11(3)(c)providing for filing failures and, or, missed tests;

"NSF" means a reduced sanction for no significant fault ornegligence. The anti-doping rule violation was or should besanctioned by a reduced sanction under regulation 11(5)(b) becauseno significant fault or negligence under regulation 11(5)(b) wasproved by the athlete;

"St" means a standard sanction under regulations 11(2) or11(3)(a). The anti-doping rule violation was or should be sanctionedby the standard sanction of two years under regulations 11(2)or11(3)(a);

"AS" means an aggravated sanction. The anti-doping ruleviolation was or should be sanctioned by an aggravated sanctionunder regulation 11(6) because the anti-doping organisationestablished the conditions set forth under regulation 11(6);

"TRA" means trafficking and administration. The anti-dopingrule violation was or should be sanctioned by a sanction underregulation 11(3)(b) for trafficking or administration.

(9) Where an athlete or other person who commits a second

anti-doping rule violation establishes entitlement to suspension orreduction of a portion of the period of ineligibility under sub-regulation (5)(c) or (d), the national level reviewing body shall firstdetermine the otherwise applicable period of ineligibility within therange established in the table in sub-regulation (8), and then apply theappropriate suspension or reduction of the period of ineligibility. Theremaining period of ineligibility, after applying any suspension orreduction under sub-regulations (5)(c) and (d), must be at least one-fourth of the otherwise applicable period of ineligibility.

(10) A third anti-doping rule violation will always result in alifetime period of ineligibility, except if the third violation fulfils thecondition for elimination or reduction of the period of ineligibilityunder sub-regulation (4) or involves a violation of regulation 3(9). Inthese particular cases, the period of ineligibility shall be from eightyears to a life ban.

(11) For purposes of imposing sanctions under sub-regulations(7) to (10), a second anti-doping rule violation shall only beconsidered a second violation if the ADC or national association canestablish that the athlete or other person committed the second anti-doping rule violation after the athlete or other person received noticepursuant to regulation 8, or after the ADC or the national associationmade reasonable efforts to give notice, of the first anti-doping ruleviolation; if the ADC or the national association cannot establish this,the violations shall be considered together as one single firstviolation, and the sanction imposed shall be based on the violationthat carries the more severe sanction however, the occurrence ofmultiple violations may be considered as a factor in determiningaggravating circumstances.

(12) If, after the resolution of a first anti-doping rule violation,the ADC discovers facts involving an anti-doping rule violation bythe athlete or other person which occurred prior to notificationregarding the first violation, then the ADC shall impose an additionalsanction based on the sanction that could have been imposed if thetwo violations would have been adjudicated at the same time. Resultsin all competitions dating back to the earlier anti-doping ruleviolation will be disqualified as provided in sub-regulations (14) to(16). To avoid the possibility of a finding of aggravatingcircumstances on account of the earlier but later discovered violation,the athlete or other person must voluntarily admit the earlier anti-doping rule violation on a timely basis after notice of the violation forwhich he or she is first charged. The same rule shall also apply whenthe ADC discovers facts involving another prior violation after theresolution of a second anti-doping rule violation.

(13) For the purposes sub-regulations (7) to (10) each anti-doping rule violation must take place within the same eight yearperiod in order to be considered multiple violations.

(14) In addition to the automatic disqualification of the resultsin the competition which produced the positive sample underregulation 10, all other competitive results obtained from the date apositive sample was collected, whether in-competition or out-of-competition, or other doping violation occurred, through thecommencement of any provisional suspension or ineligibility period,shall, unless fairness requires otherwise, be disqualified with all ofthe resulting consequences including forfeiture of any medals, pointsand prizes.

(15) As a condition of regaining eligibility after being found tohave committed an anti-doping rule violation, the athlete must firstrepay all prize money forfeited under this regulation.

(16) Unless the regulations of the international federationprovide that forfeited prize money shall be reallocated to otherathletes, it shall be allocated first to reimburse the collection expensesof the anti-doping organisation that performed the necessary steps tocollect the prize money back, then to reimburse the expenses of theanti-doping organisation that conducted results management in thecase, with the balance, if any, allocated in accordance with theregulations of the international federation.

(17) The period of ineligibility shall start on the date of thehearing decision providing for ineligibility or, if the hearing iswaived, on the date ineligibility is accepted or otherwise imposed.Any period of provisional suspension, whether imposed orvoluntarily accepted, shall be credited against the total period ofineligibility to be served. Where there have been substantial delays inthe hearing process or other aspects of doping control not attributableto the athlete or other person, the ADC disciplinary panel or thenational association imposing the sanction may start the period ofineligibility at an earlier date commencing as early as the date ofsample collection or the date on which another anti-doping ruleviolation last occurred.

(18) Where the athlete promptly, which in all events meansbefore the athlete competes again, admits the anti-doping ruleviolation after being confronted with the anti-doping rule violation bythe council, the period of ineligibility may start as early as the date ofsample collection or the date on which another anti-doping ruleviolation last occurred. In each case, however, where this sub-regulation is applied, the athlete or other person shall serve at least

one-half of the period of ineligibility going forward from the date theathlete or other person accepted the imposition of a sanction or thedate of a hearing decision imposing a sanction:

Provided that this article shall not apply where the periodof ineligibility already has been reduced under sub-regulation (5)(d).

(19) If a provisional suspension is imposed and respected by theathlete, then the athlete shall receive a credit for such period ofprovisional suspension against any period of ineligibility which maybe ultimately imposed.

(20) If an athlete voluntarily accepts a provisional suspension inwriting from the ADC and thereafter refrains from competing, theathlete shall receive a credit for such period of ineligibility whichmay be ultimately be imposed. A copy of the athlete’s voluntaryacceptance of a provisional suspension shall be provided promptly toeach party entitled to receive notice of a potential anti-doping ruleviolation under article 14.1 of the Code.

(21) An athlete’s voluntary acceptance of a provisionalsuspension is not an admission by the athlete and shall not be used inany way as to draw an adverse inference against the athlete.

(22) No credit against a period of ineligibility shall be given forany time period before the effective date of the provisionalsuspension or voluntary provisional suspension regardless of whetherthe athlete elected not to compete or was suspended by his team.

(23) No athlete or other person who has been declaredineligible may, during the period of ineligibility, participate in anycapacity in a competition or activity, other than authorized anti-doping education or rehabilitation programs, authorised or organisedby any signatory, signatory’s member organisations, including anational association or a club or other member organisation of asignatory’s member organisation, organised by any professionalleague or any international or national level event organisation. Inaddition, for any anti-doping rule violation not involving specifiedsubstances described in sub-regulation (3), the Council and, ornational association may further withdraw or partially deduct itsfinancial support for the athlete.

(24) A person subject to a period of ineligibility longer thanfour years may, after completing four years of the period ofineligibility, participate in local sport events in a sport other than thesport in which the person committed the anti-doping rule violation,but only so long as the local sport event is not at a level that could

otherwise qualify such person directly or indirectly to compete in, oraccumulate points toward, a national event or international event. Aperson subject to a period of ineligibility shall remain subject totesting.

(25) Where an athlete or other person who has been declaredineligible violates the prohibition against participation duringineligibility described in sub-regulation (23), the results of suchparticipation shall be disqualified and the period of ineligibility whichwas originally imposed shall start over again as of the date of theviolation. The new period of ineligibility may be reduced under sub-regulation (5)(b) if the athlete or other person establishes he or shebears no significant fault or negligence for violating the prohibitionagainst participation. The determination of whether an athlete or otherperson has violated the prohibition against participation, and whethera reduction under sub-regulation (5)(b) is appropriate, shall be madeby the anti-doping organisation whose results management led to theimposition of the initial period of ineligibility.

(26) In addition, for any anti-doping rule violation notinvolving a reduced sanction for specified substances as described insub-regulation (4), some or all sport-related financial support or othersport-related benefits received by such person will be withheld by anysignatory, signatory member or members, including a national sportsfederation, and governments.

(27) As a condition to regaining eligibility at the end of aspecified period of ineligibility, an athlete shall, during any period ofprovisional suspension or ineligibility, be available for out-of-competition testing by the International Federation, the ADC, and anyother anti-doping organisation having testing jurisdiction, and mustprovide current and accurate whereabouts information as provided inregulations 6(8) to (12). If an athlete subject to a period ofineligibility retires from sport and is removed from out-of-competition testing pools and later seeks reinstatement, the athleteshall not be eligible for re-instatement until the athlete has notifiedADC and the applicable national association and the athlete has beensubject to out-of-competition testing for a period of time equal to thelonger of the period set forth in regulations 6 (13) to (15) or the periodof ineligibility remaining as of the date the athlete had retired. Duringsuch remaining period of ineligibility, a maximum of three tests maybe conducted on the athlete at the athlete’s expenses, with at leastthree months between each test. The ADC shall be responsible forconducting the necessary tests, but tests by any anti-dopingorganisation may be used to satisfy the requirement. In addition,immediately prior to the end of the suspension period, an athlete mustundergo testing by ADC for the prohibited substances and methods

for out-of-competition testing. Once the period of an athlete’ssuspension has expired, and the athlete has fulfilled the conditions ofreinstatement, then the athlete shall become automatically re-eligibleand no application by the athlete or by the athlete’s nationalassociation will then be necessary.

Target testing of teams.

12. (1) Where more than one member of a team in a teamsport has been notified of a possible anti-doping rule violation underregulation 8 in connection with an event, the ruling body for the eventshall conduct appropriate target testing of a team during the eventperiod. If more than two members of a team in a team sport are foundto have committed an anti-doping rule violation during or an eventperiod, the ruling body of the event shall impose an appropriatesanction on the team, including but not exclusively sanctions such asloss of points, disqualification from a competition or event, inaddition to any consequences imposed upon the individual athlete orathletes committing the anti-doping rule violation.

(2) The ruling body for an event may elect to establishregulations for the event which impose consequences stricter thanthose in sub-regulation (1) for the purposes of the event.

Witholding of funds.

13. (1) The Council has the authority to withhold partially,or in whole, funding or other non financial support to nationalassociations and any other sporting bodies over which it has authoritythat do not endorse and comply with these regulations.

(2) The Council may elect to take additional disciplinaryaction against national associations with respect to recognition, theeligibility of its officials and athletes to participate in national eventsand fines based on the following:

(a) four or more violations of these regulations, otherthan violations involving regulations 3(10) and 11(3), arecommitted by athletes or other persons affiliated with a nationalassociation within a twelve month period in testing conductedby the international federation or by the anti-dopingorganisations including the ADC. In such event the Councilmay at its discretion elect to ban all officials from that nationalassociation from participation in any international federationactivities for a period of up to two years:

If four or more violations of these regulations, other thanviolations involving regulations 3(10) and 11(3), are committedin addition to the violations by athletes or other personsaffiliated with a national association within a twelve monthperiod in testing conducted by international federations or anti-

doping organisations including the ADC, then the Council maysuspend that national association’s membership for a period ofup to four years;

(b) more than one athlete or other person from anational association commits an anti-doping rule violationduring an international event. In such event the council at itsdiscretion may withhold any assistance proposed or alreadycommitted to the national association involved; and

(c) a national association has failed to make diligentefforts to keep the ADC informed about an athlete’swhereabouts after receiving a request for that information fromthe ADC. In such event the Council at its discretion maywithhold any assistance proposed or already committed to thenational association involved, in addition to all of the ADCscosts incurred in testing that national association’s athletes.

Appeal from decisions made under these regulations.

14. (1) Decisions made under these regulations may beappealed as set forth in this regulation or as otherwise specified in theCode. Such decisions shall remain in effect while under appeal unlessthe appellate body orders otherwise. Before an appeal is filed,tribunal proceedings outlined in regulation 9 shall be completed.

(2) Where WADA has a right to appeal under this regulationand no other party has appealed a final decision within the Council’sprocess, WADA may appeal such decision directly to CAS withouthaving to exhaust other remedies in the Council’s process.

(3) A decision that an anti-doping rule violation wascommitted, a decision imposing consequences for an anti-doping ruleviolation, or a decision that no anti-doping rule violation wascommitted, a decision that an anti-doping rule violation proceedingcannot go forward for procedural reasons; a decision underregulations 11(23) to (26); a decision that an anti-doping organisationlacks jurisdiction to rule on an alleged anti-doping rule violation or itsconsequences, a decision by any national federation not to bringforward an adverse analytical finding or an atypical finding as ananti-doping rule violation, or a decision not to go forward with ananti-doping rule violation after an investigation under article 7.4 ofthe Code; and a decision to impose a provisional suspension as aresult of a provisional hearing or otherwise in violation of regulations8(3) to (7) may be appealed exclusively as provided in sub-regulations (3) to (7). Notwithstanding any other provision herein, theonly person that may appeal from a provisional suspension is theathlete or other person upon whom the provisional suspension isimposed.

(4) In cases arising from competition in an international eventor in cases involving international-level athletes, the decision may beappealed exclusively to CAS in accordance with the provisionsapplicable before such court.

(5) In cases involving national-level athletes that do not have aright to appeal under sub-regulation (4), the ADC or the nationalassociation shall have in place an appeal procedure that respects theprinciples outlined in regulation 9. The international federation’sright of appeal with respect to these cases are set forth in sub-regulation (6).

(6) In cases under sub-regulation (4), the athlete or otherperson who is the subject of the decision being appealed; the otherparty to the case in which the decision was rendered; the ADC, andthe relevant international federation; the national anti-dopingorganisation of the person’s country of residence or countries wherethe person is a national or license holder; the international olympiccommittee or international paralympic committee, as applicable,where the decision may have an effect in relation to the olympicgames, including decisions affecting eligibility for the olympic gamesor paralympic Games; and WADA are the parties having the right toappeal to the CAS.

(7) In cases under sub-regulation (5), the parties having theright to appeal to the national-level reviewing body shall be asprovided in the national association’s regulations but, at a minimum,shall include the athlete or other person who is the subject of thedecision being appealed; the other party to the case in which thedecision was rendered; the ADC and the international federation; thenational anti-doping organisation of the person’s country of residenceor countries where the person is a national or license holder; andWADA:

Provided that for cases under sub-regulation (5), WADAand the international federation shall also have the right to appeal tothe CAS with respect to the decision of the national-level reviewingbody.

(8) Where, in a particular case, the Council fails to render adecision with respect to whether an anti-doping rule violation wascommitted within a reasonable deadline set by WADA, WADA mayelect to appeal directly to CAS as if the Council had rendered adecision finding no anti-doping rule violation. If the CAS paneldetermines that an anti-doping rule violation was committed and thatWADA acted reasonably in electing to appeal directly to CAS, thenWADA’s costs and attorneys fees in prosecuting the appeal shall be

reimbursed to WADA by the Council.

(9) Decisions by the Council denying TUEs, which are notreversed by WADA, may be appealed exclusively to CAS by theinternational-level athlete or to the national anti-doping appeal panelwhere the athlete is not an international-level athlete. If the nationalanti-doping appeal panel reverses the decision to deny a TUE, thatdecision may be appealed to CAS by WADA. The national anti-doping appeal panel considering an appeal under this sub-regulationwill not include members of the TUE Committee.

(10) Decisions by WADA reversing the grant or denial of aTUE may, subject to the regulations of CAS, be appealed exclusivelyto CAS by the athlete or the Council.

(11) When the Council fails to take action on a properlysubmitted TUE application within a reasonable time, its failure todecide may be considered a denial for purposes of the appeal rightsprovided in this sub-regulation.

(12) Decisions by the Council pursuant to regulation 13 may beappealed exclusively to CAS by the national association.

(13) The time to file an appeal to CAS shall be twenty-one daysfrom the date of receipt of the decision by the appealing party.Nonetheless the following shall apply in connection with appealsfiled by a party entitled to appeal but which was not a party to theproceedings having led to the decision subject to appeal:

(a) within ten days from notice of the decision, suchparty or parties shall have the right to request from the bodyhaving issued the decision a copy of the file on which such bodyrelied; and

(b) if such a request is made within the ten-day period,then the party making such request shall have twenty-one daysfrom receipt of the file to file an appeal to CAS.

The time limit for the filing of an appeal or intervention filed byWADA shall be the later of twenty-one days after the last day onwhich any other party in the case could have appealed or twenty-onedays after WADA’s receipt of the complete file relating to thedecision.

Compliance with regulations.

15. (1) All national sport associations shall comply withthese regulations. These regulations shall also be incorporated eitherdirectly or by reference into each national association’s regulations.All national associations shall include in their regulations the

procedural regulations necessary to effectively implement these anti-doping regulations. Each national association shall obtain the writtenacknowledgement and agreement, in the form attached as Schedule 1,of all athletes subject to doping control and athlete support personnelfor such athletes. Notwithstanding whether or not the required formhas been signed, the regulations of each national association shallspecifically provide that all athletes, athlete support personnel andother persons under the jurisdiction of the national association shallbe bound by these regulations.

(2) As a condition of receiving financial or other assistancefrom the government of Malta and, or the Council, nationalassociations shall accept and abide by the spirit and terms of thenational anti-doping programme and these regulations, including theapplication of its sanctions to individuals, and shall respect theauthority of, and co-operate with the Council and the hearing bodiesin all anti-doping matters which are not governed by the regulationsof the relevant international federation in accordance with the Code.

(3) When a national association has received an adverseanalytical finding on one of its athletes it shall report the followinginformation to the international federation and WADA withinfourteen days of the process described in regulations 8 (1)(b) and (c):the athlete’s name, country, sport and discipline within the sport,whether the test was in-competition or out-of-competition, the date ofsample collection and the analytical result reported by the laboratory.The national association shall also regularly update the ADC, theinternational federation and WADA on the status and findings of anyreview or proceedings conducted pursuant to regulations 8, 9 or 14,and comparable information shall be provided to the ADC, theinternational federation and WADA within fourteen days of thenotification described in regulation 8(1)(i), with respect to otherviolations of these regulations. In any case in which the period ofineligibility is eliminated under regulation 11(5)(a) or reduced underregulation 11(5)(b), the ADC, the international federation and WADAshall be provided with a written reasoned decision explaining thebasis for the elimination or reduction.Neither the ADC, theinternational federation, nor WADA shall disclose this informationbeyond those persons within their organisations with a need to know,until the national association has made public disclosure or has failedto make public disclosure as required in sub-regulation (8).

(4) The Council shall promptly report any TUE granted to anathlete, except those athletes not in the registered testing pool, to theapplicable international federation, to the athlete’s national sportsfederation and to WADA.

(5) The Council shall submit to WADA current athletewhereabouts information. WADA shall make this informationaccessible to other anti-doping organisations having authority to testthe athlete.

(6) The Council shall report all in-competition and out-of-competition tests to WADA as soon as possible after such tests havebeen conducted.

(7) This information shall be maintained in strict confidence atall times; shall be used exclusively for purposes of planning, co-ordinating or conducting testing and shall be destroyed after it is nolonger relevant for these purposes.

(8) The ADC and national associations shall not publiclyidentify athletes whose samples have resulted in adverse analyticalfindings, or who were alleged to have violated other articles of theseregulations until it has been determined in a hearing in accordancewith regulation 9 that an anti-doping regulation violations hasoccurred, or such hearing has been waived, or the assertion of an anti-doping rule violation has not been timely challenged or the athlete hasbeen provisionally suspended. Once a violation of these regulationshas been established, it shall be publicly reported within twenty days.

(9) Any decision by the international federation or a nationalassociation regarding a violation of these regulations shall berecognized by all national associations, which shall take all necessaryaction to render such results effective.

(10) The Council shall publish annually, a general statisticalreport of its doping control activities during the calendar year with acopy provided to WADA.

Recognition of testing etc.

16. Subject to the right to appeal provided in regulation 14, thetesting, TUEs and hearing results or other final adjudications of anysignatory to the Code which are consistent with the Code and arewithin the signatory’s authority, shall be recognised and respected bythe ADC and the national associations. The ADC and the nationalassociations may recognise the same actions of other bodies whichhave not accepted the Code if the regulations of those bodies areotherwise consistent with the Code.

Prescriptive period.

17. No action may be commenced under these regulationsagainst an athlete or other person for a violation of an anti-doping rulecontained in these regulations unless such action is commencedwithin eight years from the date the violation occurred.

Biannual report.18. The ADC will report to WADA on the Council’s

compliance with the Code every alternate year and shall explainreasons for any non-compliance.

Miscellaneous provisions.

19. (1) The Council may from time to time issuecommentaries and guidelines referring to these regulations.

(2) Schedule 1 shall be considered integral parts of theseregulations.

(3) These regulations have been adopted pursuant to theapplicable provisions of the Code and shall be interpreted in a mannerthat is consistent with applicable provisions of the Code. Thecomments annotating various provisions of the Code shall be used to,where applicable, assist in the understanding and interpretation ofthese regulations.

(4) These regulations shall not apply retrospectively to matterspending before the date these regulations came into effect.
