का.आ. 3534(अ).—सािं यक सं हण िनयमावली, 2011 के िनयम 5 स े 7 के साथ प ठत सािं यक सं हण अिधिनयम, 2008 (2009 का 7) क धारा 3 तथा धारा 4 ारा द त शि य का योग करते ए दनाकं 27 फरवरी, 2013 क सं या का.आ. 786(अ) के तहत भारत के राजप , असाधारण, भाग-।।, खंड-3, उपखंड(ii) म कािशत भारत सरकार, व मं ालय क अिधसूचना के अिध मण म जहा ंतक उनका संबंध ऐस ेअिध मण से पहले कए या लोप कए जान ेवाल ेकाय स ेह,ै व मं ालय, भारत सरकार एततदारा -

(i) ाकृितक, मानव िन मत और सथे टक फाइबर, पन यान, फलामट यान, ऊनी टॉप, कॉटन टे सटाइल, ऊनी टे सटाइल, िस क, तकनीक व , कपड़,े मेड-अ स, प रधान (िनटेड और वूवन, सिहत व मद के िविनमाता और यापा रय , अित र त पुज का िविनमाण करन ेवाली यिूनट , िज नग फैि य , कॉटन े सग फैि य तथा कॉटन िज नग

और े सग फैि य सिहत ह त और िव ुत चािलत व सं करण यिूनट , व मशीनरी िविनमाण युिनट से सािं यक और इस अिधसूचना के साथ सलं न अनसुचूी-। म उि लिखत यौरे के अनसुार हथकरघा, खादी और पटसन को छोड़कर व

े स ेसंबंिधत अ य सभी आकंड़ के सं हण का िनदशे देती ह;ै

(ii) भौगोिलक इकाई/इसम उि लिखत अिधकार े के संबंध म उ त अिधिनयम के तहत शि य का योग करने के िलए इस अिधसूचना क अनसुचूी-।। म दए गए यौरे के अनुसार व आयु त, भारत सरकार और साथ ही कायालय म उनके ितिनिधय के प म सािं यक अिधकारी क िनयिु करती ह;ै

(iii) इस अिधसूचना के तहत सािं यक सं हण के योजनाथ सांि यक सं हण अिधिनयम, 2008 क धारा 4 क उप-धारा(5) के तहत उसे द त क सरकार क सभी शि यां नामत: सूचनादाता ारा दी जाने वाली सािं यक सूचना के

प, अपेि त िववरण या उस अंतराल तथा उस सािं यक अिधकारी को िविन द ट करने क शि या ं करती ह ै इस अिधसूचना के अंतगत सांि यक अिधकारी को यायोिजत करती ह ैिजसे यह सचूना तुत क जाएगी।

(iv) सािं यक सं हण अिधिनयम, 2008 क धारा 4 क उप-धारा(4) ारा द त शि या,ं जो उ त अिधिनयम क उप-धारा (2) और (3) ारा उस े दान क गई ह, उस भौगोिलक इकाई के अंतगत िजसके िलए ऐस ेसािं यक अिधकारी क िनयिु क जाती ह,ै नामत: एजिसयां या ऐसी एजिसय म काम कर रह े यि य को िनयु त करन ेया कसी एजसी या कंपनी या संगठन या यि य के संघ को सिंवदा के आधार पर िनयोिजत करने के िलए इस अिधसूचना के तहत सांि यक अिधकारी को यायोिजत करती ह।ै

अनसुचूी-।

1. सािं यक सं हण का िवषम और योजन, थािपत मता,इकाइय के कायकरण, रोजगार, क चे माल क खपत, उ पादन और सपुुदगी और माह के अंत तक व मद के टॉक से संबंिधत सािं यक सं हण का योजन व े के िवकास और कायकरण पर िनगरानी रखना और नीितगत िनणय का योग करने के िलए डाटाबेस का रखरखाव करना होगा। 2. सािं यक सं हण के िलए भौगोिलक े , व से संबंिधत सांि यक सं हण ज मू और क मीर रा य को छोड़कर पूरे भारत पर लागू होगा। 3. आंकड़ा सं हण क प ित, कसी व मद का िविनमाण कर रही कसी इकाई या यि या व मद के कसी यापारी या िनयातक या आयातक के िलए यह अपिे त होगा क वह व आयु त ारा िविन द ट प म पंजीकृत डाक या

द ती डाक या वस् आयु त ारा िविन द ट कसी अ य मा यम स ेसूचना या आकंड़ े तुत कर। 4. सूचनादाता का कार िजनसे आंकड़ ेएक कए जाएगें, कोई इकाई या यि (इकाई का मािलक या जोतदार सिहत) जो कसी व मद का िविनमाण कर रहा ह ैया व मद का कोई यापारी या िनयातक या आयातक समय-समय पर व आयु त ारा यथा-अपेि त सूचना दान करेगा। 5. वह अविध िजसके दौरान सािं यक सं हण का काय परूा कया जाएगा, येक सूचनादाता ारा िविनमाण या यापार याकलाप या कसी अ य सूचना के संबंध म मािसक, ितमाही, अ वा षक और वा षक आधार पर या व आयु त ारा यथा िविन द ट कसी अ य बारंबारता पर व आयु त ारा िनधा रत तारीख और मा यम म सूचना भजेनी होगी।

6. एक क जान े वाली सूचना का व प, तुत क जाने वाली सूचना का संबंध थािपत मता, इकाइय के कायकरण, यापा रक याकलाप, रोजगार, क चे माल क खपत और उपभो य व तुएं, आयात,उ पादन, क मत, िब , िनयात, सुपुदगी, यापार से सबंंिधत सूचना, िबजली क खपत, कैप टव िव ुत उ पादन, व क मद का माह के अंत तक का टॉक और ऐसी कसी अ य सूचना से होना चािहए जो व आयु त ारा अपिे त हो। 7. वह भाषा िजसम सूचना तुत क जानी ह,ै सूचनादाता, िनधा रत प म िह दी या अं ेजी म सचूना तुत करेगा। अकं संबंधी सूचना अरबी अकं म दी जाएगी। 8. िबजनस रकॉड और अ य रकॉड का व प िजनका िनरी ण कया जा सकता ह ैकमचा रय के रॉल के संबंध म रिज टर या रकॉड जैस े कसी इकाई या यि का िबजनस रकॉड, खरीद या िब या उपयोग या उ पादन या सूचना के समथन म ऐसी इकाई या यि ारा कसी अ य द तावेज का रखरखाव कया जाएगा और कसी इकाई या यि ारा दए गए आंकड़ का य स यापन सिहत िनरी ण कया जाएगा और व आयु त या उनके ारा ािधकृत कसी अ य यि

ारा नमून क जांच क जाएगी। 9. िनरी ण का ढंग, कसी इकाई या यि के िबजनस रकॉड और अ य रकॉड के आधार पर कसी इकाई या यि

ारा िववरणी के िनधा रत प म दी गई सूचना का स यापन व आयु त या उनके ारा ािधकृत कसी यि ारा कया जा सकता ह ैऔर उस इकाई या यि या सबंंिधत मािलक या जोतदार या प ेदार या इकाई के बंधन ारा ािधकृत कसी यि स े प टीकरण मांग सकता ह।ै

10. सचूनादाता का दािय व, (i) व मद का िविनमाण कर रहा कोई यि या कसी इकाई का मािलक या जोतदार या प ेदार िविनमाण या यापा रक याकलाप के संबंध म यथािविन द ट तारीख तक िनधा रत प म आविधक सािं यक िववरणी तुत करेगा। (ii) कोई सूचनादाता िनरी ण के िलए संगत रकॉड भी तुत करेगा और व आयु त या उनके ारा ािधकृत कसी यि

ारा यथा-अपेि त सािं यक से संबंिधत प टीकरण या नमने तुत करेगा। इस योजनाथ कमचा रय के आकंड़ या सूचना स े संबंिधत सभी रिज टर या रकॉड जैसे कसी यि या इकाई के िबजनस रकॉड, मशीनरी के प रचालन, खरीद या उपयोग या क चे माल का टॉक, उ पादन या, उ पादन क गई मा ा और िब या उ पाद का टॉक िजसम उप-उ पाद

MINISTRY OF TEXTILES

NOTIFICATION

New Delhi, 24th November, 2016

S.O. 3534(E).—In exercise of the powers conferred by section 3 and section 4 of the Collection of Statistics Act, 2008 (7 of 2009) read with rules 5 and 7 of the Collection of Statistics Rules, 2011 in supersession of the notification of the Government of India, in the Ministry of Textiles, published in the gazette of India, Extraordinary, Part-II, Section 3, Sub-Section (ii) vide number S.O. 786 (E), dated the 27th February, 2013, except as respect things done or omitted to be done before such supersession, the Ministry of Textiles, Government of India hereby –

(i) directs collection of statistics from the manufacturers and traders of textile items including natural, manmade and synthetic fibres, spun yarn, filament yarn, woollen tops, cotton textiles, woollen textiles, silk, technical textiles, cloth, made-ups, garments (knitted and woven), hand and power operated textile processing units, textile machinery manufacturing units including units manufacturing spare parts, ginning factories, cotton pressing factories and cotton ginning and pressing factories and all other data relating to textile sector excluding Handloom, Khadi and Jute as per the details mentioned in Schedule-I appended to this notification;

(ii) appoints the Textile Commissioner, Government of India, as also his or her assignees in office as the Statistics Officer, as detailed in Schedule-II of this notification, to exercise powers under the said Act, in respect of the geographical unit/jurisdiction mentioned thereof:

(iii) delegates to the Statistics Officer under this notification, all the powers of the Central Government conferred on it under sub-section (5) of section 4 of the Collection of Statistics Act, 2008 for the purpose of collection of statistics under this notification, namely specify the form, the particulars required or the interval within which, and the statistics officer to whom, the statistical information by the informants shall be furnished; and

(iv) delegates to the Statistics Officer under this notification, powers conferred by sub-section (4) of section 4 of the Collection of Statistics Act, 2008, namely the powers of appointing agencies or persons working in such agencies or employing on contract basis any agency or company or organization or association of persons, conferred on it by sub-sections (2) and (3) of the said Act, within the geographical unit for which such statistics officer is appointed.

SCHEDULE-I

1. Subject and the purpose for collection of statistics, the purpose for collection of statistics relating to installed capacity, working of the units, employment, consumption of the raw material, production, deliveries and month end stock of the textile items shall be for monitoring the growth and working of the textile sector and for maintaining database for making use in policy decisions.

2. Geographical area for the collection of statistics, the collection of statistics related to textile shall be applicable to the whole of India except the State of Jammu and Kashmir.

3. Method of data collection, a unit or person manufacturing any textile item or a trader or exporter or importer of textile items shall be required to submit information or data in the formats specified by the Textile Commissioner, by way of registered post or by hand delivery or any other means specified by the Textile Commissioner.

4. Nature of Informants from whom data may be collected, a unit or person (including owner or occupier of the unit) manufacturing any textile item or a trader or exporter or importer of textile items shall furnish the information as required by the Textile Commissioner from time to time.

Period during which collection of statistics may be completed, the return of information shall be required to be submitted by the date and mode specified by the Textile Commissioner each informant by in respect of the manufacturing or trading activity or any other information on Monthly basis, Quarterly basis, Half yearly basis and Annual basis or any other frequency as specified by the Textile Commissioner.

6. Nature of Information to be collected, information required to be submitted should relate to install capacity, working of the units, trading activity, employment, consumption of the raw material and consumables, imports, production, prices, sales, exports, deliveries, trade related information, power consumption, captive power generation, month end stock of the textile items or any other information that may be required by the Textile Commissioner.

7. Language in which Information is to be furnished, an informant shall furnish information in the prescribed formats either in Hindi or in English. The numerical information shall be in Arabic Numerals.

8. Nature of Business Records and other Records which may be inspected, business records of a unit or person, such as register or records in respect of employees on rolls, purchase or sales or consumption or production or any other documents in support of the information shall be maintained by such unit or person and the data furnished by the unit or person may be inspected including physical verification and drawal of samples by the Textile Commissioner or any other person authorised by him.

9. The Manner of the inspection, the Textile Commissioner or person authorised by him may verify the information furnished in the formats of the return by a unit or person on the basis of business records and other records of the unit or person and seek clarifications from the unit or person or concerned owner or the occupier or lessee or any person authorised by the management of the unit.

10. Obligation of Informant, (i) A person or an owner or occupier or lessee of a unit engaged in manufacturing of textile items shall submit the periodical statistical return in the format and by the date as specified in respect of manufacturing or trading activity.

(ii) An informant shall also furnish relevant records for inspection and submit clarifications or samples in relation to the statistics furnished, as may be required by the Textile Commissioner or a person authorised by him. For this purpose, business records of a person or unit, such as all registers or records regarding data or information of employees, operations of machinery, purchase or consumption or stocks of raw materials, production process, produced quantity and sale or stocks of products including by-products, or any other information and documents in support of information furnished by the unit shall be produced for inspection before the Textile Commissioner or person authorised by him.
