I was reminded the other day of the saying “the cobbler’s children have no shoes”. I was visiting a client and while

Age is a double-edged sword. For
years bring wisdom that comes from experience. That experience
comes mostly from doing something erroneously and then learning from that. Wisdom comes through the school of knocks. Possibly one of the most important things that I’ve become aware of is accountability and my need to step into it.
For me, being accountable means that I take ownership of the things that I say and do, both good and bad. It’s easy to shoulder the winning decisions and actions, but it can be embarrassing to take the weight of those that are poor and result in a bad case of regret.
Accountability seeps into every part of our lives and there is little that is
untouched by it. How often have you experienced people avoiding being accountable in your work environment? There is always someone who ducks and
all costs” individual that just won’t step up. How do you feel about them? Do you trust or respect them?
Think about your feelings toward that person the next time you duck and dive. If you don’t trust or respect someone who lives their lives without accountability, how will people feel about you when you do the same?
The peculiar thing is that we like people who take responsibility for what they say and do. We feel like we could hit the trenches with them. It’s natural. They won’t leave you standing when the music stops, will they?
You’ve also met the person that stands up and admits that they made the wrong call and takes the resulting heat. The one that comes into the meeting late and doesn’t make excuses – they simply apologise and get on with it.
Being accountable involves a couple of simple steps that you can follow at
any time. Let’s say you promised to do

What can be learnt from Barry Roux and Gerrie

You could be forgiven for wondering why these often hostile and confrontational men are people to be admired. They challenge everything said by witnesses, are aggressive to anyone that challenges them, and their behaviour borders on downright rudeness.

Arbitrator misconduct occurs in many different
including: bias; interrogation of witnesses; failure to
keep records; ignoring evidence; refusal to allow a party the right to question witnesses or bring evidence; failure to apply the mind; misconstruing of evidence; overstepping authority; and failure to consider statutory provisions.
BiasIn the case of Mutual and Federal
Insurance Company versus CCMA and
court held that proof of actual bias was not necessary. The applicant for the review only needed to prove that the arbitrator’s conduct indeed gave rise to a reasonable suspicion or perception of bias. It is important to note that it would not be enough for a party to have believed there was bias. They will have to prove that the actions of the arbitrator would have given any reasonable person a clear impression of bias.
For example, in the case of Best Boland Motors versus Dispute Resolution Centre and others (Contemporary Labour Law
Appeal court found that the conduct of the arbitrator suggested bias. In that case the arbitrator and the applicant employee left
before and after the arbitration hearing and entered into discussions between
themselves. As they had no acceptable reason for this the court found that the arbitrator’s conduct led the respondent to a reasonable apprehension of bias.
Bias can show itself in other ways too. For example, the arbitrator might assist
interrogate witnesses rather than ask
evidence.
