1. INDLELA YOKUSEBENZISA LE NCWAJANAIngeyani le ncwajana?

Bonke abantu banamalungelo afanayo ayisisekelo, ngaphandle kokubhekwa kweminyaka, ubulili, ubulili obuthandwa ngumuntu noma umsebenzi awenzayo. Kodwa ngenxa yokuthi ukusebenza ngocansi akukho emthethweni eNingizimu Afrika, abasebenzi abasebenza ngocansi abaningi abawazi amalungelo abo.

Isikhungo Sezomthetho Wabesifazane sibhale le ncwajana ngenxa yezizathu ezintathu: 1. Ukuveza ukuthi amalungelo abantu abasebenza ngocansi ahlukunyezwa kanjani

ngabasebenzi bahulumeni, amaphoyisa, amakhasimende, abanikazi bezindlu ezingamabhrotheli kanye nabaphathi;

2. Ukuveza ukuthi imithetho ephathelene nemisebenzi yezocansi inemithelela enjani kubantu abasebenza ngocansi; kanye

3. Nokuchaza amalungelo abantu abasebenza ngocansi, nokuthi bangawusebenzisa kanjani umthetho ukuze balwisane nokuhlukunyezwa bakwazi nokuzivikela.

Yini engingayifunda kule ncwajana?

Njengomsebenzi ngocansi, ziningi izindlela zokuphula amalungelo akho njengomuntu. Sebenzisa le ncwajana ukuze: • Ufunde ngamalungelo onawo ngokomthethosisekelo nangokomthetho angakusiza ukuthi

uzivikele angaphulwa amalungelo akho. • Ufunde ukuthi umthetho ungakusiza kanjani uma amalungelo akho njengomuntu ephuliwe. • Usize abanye abasebenza ngocansi ukuthi bafunde ngamalungelo abo ngokomthethosisekelo

nangokomthetho.

Kubaluleke ngani ukwazi amalungelo ami?

Uma uwazi amalungelo akho, ngaleyo ndlela uzokwazi: • Ukwazi indlela elungile abanye okumele bakuphathe ngayo. • Ukwazi uma indlela abakuphatha ngayo abanye ingahambisani nomthetho.• Ukwazi ukuthi umthetho ungakusiza kanjani uma amalungelo akho njengomuntu ephuliwe. • Ukwazi ukuthi ungaya kuphi ukuze usebenzise amalungelo akho uphinde uthole nosizo

kwezomthetho.• Ukuthola ubulungiswa uma amalungelo akho ephuliwe. • Ukuqwashisa umphakathi mayelana nokuphulwa kwamalungelo abantu abasebenza

ngocansi. • Ukufundisa umndeni, abangani kanye namalungu omphakathi wakho mayelana

namalungelo abantu. • Ukulekelela uvimbele ukuthi abanye abasebenza ngocansi bangaphathwa ngendlela

engalungile.

Sebenzisa lezi zithombe njengemihlahlandlela kule ncwadi.Ukuphawula: Uzobona lesi sithombe somsizi eduze nolwazi olubaluleke kakhulu noma ongase uluthole lunzima ukuthi uluqonde.

Izincazelo: Uzobona lesi sithombe sebhalubhu kagesi eduze kwamatemu ezomthetho namagama ongawathola kunzima ukuthi uwaqonde. Uma ubona igama elidwetsheliwe,

kuzoba khona incazelo endaweni eseduze nalo. Uma igama ungalazi, sicela ufunde incazelo.

2. ITEMU “OSEBENZA NGOCANSI”Sisebenzisa itemu elithi “osebenza ngocansi” kunaleli elithi “umqwayizi” ukuze sigxile ekutheni lo umsebenzi, nokuthi abasebenza ngocansi nabo banamalungelo afanayo futhi kumele bavikeleke emisebenzini yabo njengabanye abasebenzi. Ukushintsha igama akushintshi ukuthi abantu bacabangani ngabasebenza ngocansi, kodwa kukhombisa inhlonipho kanye nesithunzi kanye namalungelo abantu abathola imali nezinye izinto ezibizayo ngokuthi bakusize ngocansi.

Kwesinye isikhathi sisebenzisa itemu elithi “umqwayizi” ngenxa yokuthi ilona gama elisetshenziswe emithethweni esikhuluma ngayo.

3. AMALUNGELO ABASEBENZI BEZOCANSI NGOKOMTHETHOSISEKELO

UMthethosisekelo waba umthetho ngonyaka wezi-1996 emva kokuthi iNingizimu Afrika ibe yizwe lentando yeningi. Ungumthetho omkhulu ezweni: Lokhu kusho ukuthi namuphi na umthetho oshayisana noMthethosisekelo awusebenzi.

Isahluko sesi-2 soMthethosisekelo siqukethe uMthethosivivinywa wamaLungelo okuyiwo onikeza abantu baseNingizimu Afrika amalungelo abantu ayisisekelo okumele ahlonishwe, avikelwe, akhuthazwe futhi agcwaliswe. Amanye alawa malungelo okuyiwo abalulekile ikakhulukazi kubasebenzi bezocansi yilawa:

Se-9 Ukulingana Wonke umuntu uyalingana ngaphambi komthetho futhi unemihlomulo elinganayo nokuvikeleka komthetho.

Abasebenza ngocansi kumele baphathwe ngokulingana. Imithetho ekhona evikela zonke izakhamizi kumele ivikele nabasebenza ngocansi.

Se-10 Isithunzi sobuntu Wonke umuntu unesithunzi futhi unelungelo lokuthi isithunzi sakhe sihlonishwe futhi sivikelwe.

Akekho umuntu noma isikhungo esingakuphuca ukuzihlonipha kwakho ngamazwi noma ngezenzo.

Izincazelo

Izwe lentando yeningi: Izwe elikhululekile nelizimele. INingizimu Afrika yaba izwe lentando yeningi emva kokukhishwa kohlelo lwezikhathi zobandlululo. UMthethosivivinywa wamaLungelo: Isigaba soMthethosisekelo esiqukethe amalungelo abantu. Isikhathi sobandlululo: Uhlelo olwaluhlukanisa abantu ngokobuzwe luphinde luphathe abantu ngokungalingani ngenxa yobuzwe. Amalungelo abantu ayisisekelo: Amalungelo ayisisekelo nabalulekile onawo noma owanikeziwe njengomuntu. Okungasebenzi: okungasebenzi, okuyize ngokomthetho, okungamukelekile, okungekho emthethweniOkuhlonishwayo: Okubalulekile/okwaziswayo Okuvikelekile: okuvikelwe, okugadiwe, akukho okumele kume endleleni yokuphakamisa uMthethosisekelo.Khuthazwa: Phakanyiswa, wesekiwe futhi uyagqugquzelwa. Gcwaliswa: uyalandelelwa futhi kuqaliswe ukusebenza.

Se-12 Inkululeko nokuvikelela komuntu Wonke umuntu unelungelo lokukhululeka angahlushwa noma aphathwe ngendlela enonya, engenabo ubuntu noma emehlisa isithunzi.

Angeke uboshwe ngaphandle kwesizathu esiyiso. Angeke uphathwe kambi ngenkathi usavalelwe ngamaphoyisa.

Se-14 Ilungelo lokuba nemfihlo Wonke umuntu unelungelo lokuba nemfihlo.

Unalo ilungelo lokugcina isimo sakho ngeGciwane LesaNdulela-Ngculazi noma INGCULAZI kuwe. Akekho umuntu noma isikhungo esingakuphoqa ukuthi ubatshele isimo sakho noma uhlolelwe Igciwane LesaNdulela-Ngculazi.

Se-16 Ukukhuluma ngokukhululeka Wonke umuntu unelungelo lokukhuluma ngokukhululeka okubandakanya ilungelo lokunika noma ukuthola ulwazi noma imibono.

Unalo ilungelo lokukhuluma ngokukhululeka ubeke imibono yakho ezindabeni inqobo nje uma ingaphathi kambi omunye umuntu.

Se-18 Ukuhlanganyela ngokukhululeka Wonke umuntu unelungelo lokuhlanganyela ngokukhululeka.

Unalo ilungelo lokuhlanganyela namakilabhu, amaqembu noma izinhlangano, futhi angeke uhlukaniswe nabantu ngenkani.

Sama-21 Ukuhamba nokuhlala ngokukhululeka Wonke umuntu unelungelo lokuhamba ngokukhululeka, ahlale noma aphume ezweni ayohlala noma kukuphi lapho ethanda khona ngaphakathi ezweni.

Ungahamba uzungeze izwe ngendlela othanda ngayo, futhi angeke uphoqwe ukuthi uthuthele endaweni ehlukene nomphakathi.

Sama-22 Inkululeko yokuthengisa, ukusebenza kanye nomsebenzi Wonke umuntu unelungelo lokukhetha uhlobo lomsebenzi ngokukhululeka.

Ungazikhethela ukuthi hlobo luni lomsebenzi ofisa ukuwenza.

Angeke ucwaswe emsebenzini.

Sama-24 Imvelo Wonke umuntu unelungelo lemvelo engeke ilimaze ezempilo noma inhlalakahle.

Unelungelo lokuhlala endaweni ehlanzekile kanti futhi wonke umuntu kubandakanywa nohulumeni banomsebenzi wokuvikela nokugcinela isizukulwane esizayo imvelo.

Sama-26 Ilungelo lezindlu Wonke umuntu unelungelo lokuthola indlu ekahle. Akekho umuntu ongaxoshwa ekhaya lakhe noma ongabhidlizelwa ikhaya ngaphandle kokuthola isinqumo senkantolo.

Angeke unqatshelwe ukuthola usizo lwezimali noma imalimboleko ukuze uthenge indlu ngenxa yokuthi usebenza ngocansi. Akukho emthethweni ukuxoshwa ekhaya lakho ngenxa yohlobo lomsebenzi olwenzayo.

Sama-27 Ilungelo lokunakekelwa kwezempilo, ukuthola ukudla, amanzi kanye nokuvikeleka kwenhlalakahle Akekho umuntu onganqatshelwa ukwelashwa okuphuthumayo. Wonke umuntu unelungelo lokuthola usizo lokunakekelwa kwezempilo okufana nokunakekelwa kokuzala kanye nemihlomulo yokuvikelela kwenhlalakahle okubandakanya ukusizwa okufanele uma bengakwazi ukuzondla bona nemindeni yabo.

Ezibhedlela noma abelaphi angeke banqabe ukukwelapha.

Sama-29 Ilungelo lokufunda Wonke umuntu unelungelo lemfundo eyisisekelo, okubandakanya imfundo yabadala eyisisekelo.

Isikole angeke sinqabe ukukufundisa noma ukufundisa ingane yakho ngenxa yokuthi usebenza ngocansi.

Sama-32 Ukuthola ulwazi Wonke umuntu unelungelo lokuthola ulwazi olugodlwe ngomunye umuntu olungase ludingeke ukuze umuntu akwazi ukusebenzisa noma ukuvikela amalungelo akhe.

Uma uzwa sengathi amalungelo akho aphuliwe ngandlela thize, isibonelo mayelana nenqubomgomo yomsebenzi, ungacela ukubona inqubomgomo bese uphikisana nayo enkantolo. Lokhu kuyinto efanayo nakwezinye izindawo noma izikhungo.

Sama-33 Izenzo zobulungiswa bokuphatha Wonke umuntu onelungelo elithikanyezwe izenzo zokuphatha unelungelo lokunikwa izizathu ezibhaliwe, ezifana nokuthi kungani kuthatha isikhathi ukwenziwa kwezinto.

Uma uzwa sengathi uyanqatshelwa ukuthola usizo ngenxa yezizathu ezingalungile noma ezingenabulungiswa, ungafuna ukuthola izizathu bese unquma ukuthi ufuna ukusiphonsela inselela leso sizathu.

Sama-35 Abantu ababoshiwe, abavalelwe noma abangabasolwa Wonke umuntu ovalelwe kubandakanya neziboshwa ezigwetshiwe zinelungelo lemibandela yokuvalelwa engahambisani nelungelo lakhe lesithunzi

Iziboshwa angeke ziphathwe ngendlela engalungile noma engenasithunzi ngenxa yokuthi zingabasebenzi bocansi.

4. IMITHETHO EKHONA NJENGAMANJE MAYELANA NOMSEBENZI WEZOCANSI ENINGIZIMU AFRIKA Umthetho okhona ukwenza kube yicala ukuya ocansini ukuze uhlomule KANYE nokuhlomulisa ngenxa yokuthola ucansi. Ngakho-ke emsebenzini wocansi bobabili umsebenzi nekhasimende benza ubugebengu ngokomthetho.

Nansi imithetho eqondile ekhuluma ngalokhu:

• Isigaba sama-20(1)(aA) soMthetho wamaCala oCansi wezi-1957 uthi: “Noma yimuphi umuntu ozibandakanya ocansini olungekho emthethweni, noma izenzo ezihlambalazayo , nanoma yimuphi umuntu ukuze ahlomule wenza icala.”

UMthetho wamacala ocansi we-1957 nawo awukuvumeli lokhu okulandelayo:-

Ukugcina ibhrotheli; Ukubamba – ngamanye amagama, ukuqasha umuntu ukuze asebenze ngocansi noma asebenze endlini yobufebe; Ukwenza noma ukusiza emsebenzini wocansi, isibonelo lapho ama-ejenti abadayisa ngomzimba enikezela ngabadayisi bomzimba bebe bazi ukuthi bazonika amakhasimende abo ucansi bese bethola imihlomuloUkuziphilisa ngemali yomsebenzi wocansi (lesi sigaba sibhekiswe kwabafunela abanye abaqwayizi). Ukucelela – ngamanye amagama, ukushela abanye ngamagama, izenzo noma iyiphi enye indlela ukuze bakukhokhele ukwenza nabo zinto zocansi. Ukuziveza okungekuhle kanye nokuzihlambalaza emphakathini.

UKUXOSHWA OKUNGENABULUNGISWA

Umthetho Wobudlelwane Nabasebenzi Unemibandela Yokuziphatha Okuhle okufanele umqashi ayilandele. Ubulungiswa banoma yikuphi ukuxosha bunqunywa ngokubuka izinto ezimbili: Ubulungiswa banoma yikuphi ukuxoshwa bunqunywa amaphuzu amabili: ubulungiswa beqiniso kanye nobulungiswa benqubo.
