“Нужно задуматься и о более глубокой кооперации в сфере энергетики — вплоть до создания единого энергокомплекса Европы. Важные шаги в этом направлении — строительство газопроводов «Северный поток» по дну Балтики и «Южный поток» в Черном море. …После их полного ввода в эксплуатацию Европа получит надежную и гибкую, не зависящую от чьих-либо политических капризов систему газоснабжения, что позволит не формально, а реально укрепить энергобезопасность континента. • European spot trading began in the mid-1990s in the UK with the development of a virtual UK-wide trade center - the National Balancing Point (NBP)
• NBP - still the only European marketplace considered mature by the gas industry
• NBP strongly influences the continental hubs
• At present, continental Europe has seven acting hubs, which trading data are published: Zeebrugge - in Belgium, TTF - in the Netherlands, PEG - in France, PSV - in Italy, NCG and Gaspool - in Germany, CEGH - in Austria, CDG - in Spain, for which there is no official information yet
• Gas exchanges, working in close connection with these hubs, are: ICE / APX - in London, Powernext - in Paris, APX / NP-Endex - in Amsterdam and EEX - in Leipzig

• According to the 2010, the physical spot volumes at all the continental hubs and NBP reached nearly 250 bcm (which is equal to 47% of total gas consumption in EU-27)
• Some of these volumes could be resold among the hubs themselves, so, it is not technically feasible actual deliveries of gas to end-users from the spot hubs, but the clear trend for the significant increase in the share of spot trades is obvious
• Expert estimates of the hub pricing share in total European gas consumption were about 25% in 2009, reaching up to 30-35% by the end of 2011

• Gas demand in 2008 (563 bcm) could easily be accommodated within the LTC flexibility
• Gas demand of 2009 (523 bcm + some storage build) was beyond the reach of contract flexibility
• In 2009 gas market in Europe turned out to be significantly oversupplied:
• LNG supplies increased significantly as the result of weak LNG markets in the United States and Asia Pacific regions, and Europe continuing to provide better netbacks;
• Norwegian supplies were stable;
• Russian gas exports were significantly below Take-or-Pay levels;
• Algerian pipeline volumes in 2009 appeared to decline by around 10% year over year

HOW WAS THE SPOT MARKET LIQUIDITY CREATED:

COLD WINTER RESULTED IN LOW SPOT MARKET LIQUIDITY
In January –February 2012 European spot market failed to provide consumers with requiredvolumes of gas
Spot trading spot in Baumgarten (which mostly deals with Russian gas) almost stopped in January: there were only 12 physical gas volume deals upto 17 January 2012, and then no deals were held until the end of the month
In early February (with the most severe weather conditions) spot prices jumped from $290to $420-500 and the trade revived a little: the traders effected 15 deals within two days before the first February weekend (total volume of 1.5 mln. cm)
The delivery volumes should be amounted to 200 to 500 th. cm per day. However at its peak demand, about 80 mln. cm gas should be delivered every day from Russia to the Baumgarten

SOME OBSERVATIONS….
Continental gas hubs are developing fast. The share of spot trading in EU-27 overall gas consumption increased dramatically during the last years, making spot pricing nearly as influential as oil indexation
Pre-crises European gas demand forecasts were over-optimistic, resulting in an aggregate over-contracting of gas in Europe
During the crisis, the reduced demand, excessive supply of uncontracted LNG and resale of unclaimed gas from long-term contracts resulted in the sharp drop in European spot prices. Economic crises lead to their decoupling from oil-linked contract prices, and further stable coexistence of these two pricing models is now questionable
During the last decade gas consumers in Europe claimed that traditional netback market pricing based largely on oil products is no longer logical because gas and oil product markets have diverged and there is very little switching capacity left. Recession and gas oversupply speeded up this process
Development of gas spot markets (a gap between the prices set forth in long-term contracts and spot prices) increases the consumers intention to avoid binding contract prices in the wholesale long-term contracts with oil product indexes. Price review pressure increases, consumers insist on modification of the contract system and changing the price terms
Now there is hot discussion on the prospect of radical change of this hybrid-pricing European gas market model, European companies insist on modernization of existing contracts and move to hub-based prices. North American and UK gas markets moved to market pricing and away from long term contracts 15-25 years ago. In both cases this was a painful process which took 5-10 years to complete. Continental Europe is now facing the same changes which could be even more painful…

- Будучи основным транзитером, Украина остается одним из проблематичных в этом отношении регионов. «Газовые конфликты» зим 2006 и 2009 годов стали апогеем ряда экономических и политических проблем, которые усугублялись с момента распада Советского Союза и дезинтеграции единой экономики. - С 1991 года коммерческие отношения между Россией и Украиной в области
поставок и транспортировки газа оставались сложными. Россия была и остается для Украины основным поставщиком газа, в то время как Украина контролирует инфраструктуру трубопроводов, необходимую России для выполнения своих контрактных обязательств перед покупателями газа в Центральной и Восточной Европе.
- Газовые решения 2006 и 2009 г.г. носили локальный характер- - На территории Украины нет такой специально предназначенной транзитной
линии, как газопровод Ямал-Европа. Поэтому газ, предназначенный для внутреннего потребления и дальнейшего экспорта, поступает в принадлежащую «Нафтогазу» газовую транспортную сеть. Россия поставляет газ в ту же самую трубопроводную систему, из которой украинские газовые компании снабжают своих потребителей по всей сети. - Одной из проблем в обеспечении надежности системы экспортных поставок российского газа по территории Украины является поддержание нормального режима функционирования системы
- Для решения этой проблемы предлагалось несколько вариантов, в том числе, приобретение части активов газотранспортной инфраструктуры ОАО Газпром, а также более теоретический, заключавшийся в передачи функции оператора одной из европейских компаний (в этом случае газ бы сбывался на границе Россия-Украина, что противоречит стратегии ОАО Газпром – продвижению на газовый рынок Европы).
- -Однако, с 2007 г. эти варианты стали нереализуемыми в виду того, что парламент Украины принял закон"О внесении изменений в Закон Украины "О трубопроводном транспорте" относительно предприятий магистрального трубопроводного транспорта", согласно которому приватизация украинской ГТС запрещается.

В общих чертах разногласия в российско-украинских отношениях по вопросам экспорта газа заключаются в следующих вопросах:1. Цена для потребителей в Украине2. Ставка транзитного тарифа3 . Минимальный уровень закупки российского газа «Нефтегазом Украины»4. Технические условия для обеспечения транзита вне зависимости от состояния поставок российского газа украинским потребителям.5. Вопрос о несанкционированном отборе газа в ГТС Украины.

1. ЗАКОНОДАТЕЛЬСТВО ЕС (1)
- Со странами-участницами подписаны МПС о реализации Южного потока и создании соответствующих СП, однако это входит в противоречие с правилами Третьего энергопакета (в части запрета на право собственности экспортера на внутренние трубы). Вопрос главенства МПС или внутреннего законодательства ЕС
- Пока в реализации Третьего Энергопакета много неясностей, и не прописан принцип гарантирования транспортных услуг владельцу контрактов на поставку, прежде всего долгосрочных.
- Пакет предполагает пересмотр всех транспортных контрактов и приведение их в соответствие с новыми требованиями – пока даже не сформулированными.
- Утвержденный ЕС в положениях «Руководящих принципов (TEN-E)» список приоритетных инфраструктурных проектов останется не включения в него новых проектов, например, «Южного потока». Однако, даже если, согласно словам Г. Эттингера , что «после получения более полной информации по объемам и маршруту проекта «Южный поток» ... Еврокомиссия по-прежнему готова рассматривать возможность присвоения статуса TEN проекту», проект получит статус TEN – это в лучшем случае может означать (как у Набукко) получение не более 50% изъятий мощности от обязательного доступа 3-х сторон.
- Очевидно, что Третий энергетический пакет в любом случае будет реализован Европейским Союзом.
Необходимо проведение дополнительных технико-экономических расчетов по реализации проекта «Южный поток» с учетом возникающих ограничений в рамках Третьего
энергетического пакета.
2. НЕОПРЕДЕЛЕННОСТЬ ПРОГНОЗОВ РАЗВИТИЯ ЕВРОПЕЙСКОГО СПРОСА НА ГАЗ

- Предполагается осуществлять поставки в Хорватию, которая с 1.01.2011 прекратила поставки российского газа, не продлив долгосрочный контракт и заключив вместо него контракт с Италией- Дополнительный спрос в рассматриваемых странах оценивается на уровне 23,5 млрд. куб. м, причем скорее всего именно на этот спрос буду ориентированы поставки 16 млрд. куб. м азербайджанского газа, которые начнутся в 2016 г.
ВЫВОДЫ ПО ПЕРСПЕКТИВАМ ЕВРОПЕЙСКОГО РЫНКА
- Отсутствует единое четкое представление об объемах прогнозного спроса на газ
в Европе
- Страны, вовлеченные в проект реализации Южного потока, не являются
перспективными с точки зрения роста спроса на газ
- Пока не заключено ни одного нового контракта на поставку газа, более того с
некоторыми странами (Хорватия) истекают действующие
- Предполагается ли заключение новых контрактов или будет перезаключение
действующих ( в том числе в западноевропейскими партнерами) с изменением
условий поставки газа – например, пересмотр точки сдачи газа. Тогда возникает
вопрос стоимости этого газа, доставляемого по маршруту Южного потока
