HUMAN RIGHTS ASPECTS OF THAILAND’S DRAFT ASSEMBLY ACT
The following is an analysis of the human rights aspects of Thailand’s Draft Assembly Act (the
Draft Act), which Royal Thai Police submitted to the NCPO and later will pass to the Cabinet
and National Legislative Assembly.
Each section of the analysis is followed by short recommendations. Because under the
current legal situation in Thailand protection of the right to freedom of peaceful assembly
cannot be ensured by changes to the Draft Act alone, some of these recommendations are for
legislative and other measures beyond this Draft Act.
The analysis and recommendations relate to Amnesty International’s key concerns and do not
cover each and every provision or human rights aspect of the Draft Act.
1. THE INTERNATIONAL AND CONSTITUTIONAL LEGAL FRAMEWORK
1.1. INTERNATIONAL HUMAN RIGHTS LAW
The right to freedom of peaceful assembly, together with the closely related rights of freedom
of association and freedom of expression, is enshrined in human rights treaties to which
Thailand is a party, in particular the International Covenant on Civil and Political Rights
(ICCPR).
Article 21 of the ICCPR provides:
The right of peaceful assembly shall be recognized. No restrictions may be placed on the
exercise of this right other than those imposed in conformity with the law and which are
necessary in a democratic society in the interests of national security or public safety,
public order (order public), the protection of public health or morals or the protection of
the rights and freedoms of others.
In a communication received by the UN on 8 July 2014, Thailand informed the UN Secretary
General that it had invoked Article 4 of the ICCPR1 on 20 May 2014 to derogate from, that is
suspend or restrict, its treaty obligations, on a variety of rights provided in the ICCPR, among
them the right to peaceful assembly.2

Amnesty International would reiterate that under Article 4 of the ICCPR, in times of
emergency, only measures derogating from the Covenant’s provisions that are “strictly
required by the exigencies of the situation” are allowed. The Human Rights Committee has
explained that: “…the obligation to limit any derogations to those strictly required by the
exigencies of the situation reflects the principle of proportionality which is common to
derogation and limitation powers. Moreover, the mere fact that a permissible derogation from
a specific provision may, of itself, be justified by the exigencies of the situation does not
obviate the requirement that specific measures taken pursuant to the derogation must also be
shown to be required by the exigencies of the situation.”3 The Committee also emphasised
that “Measures derogating from the provisions of the Covenant must be of an exceptional and
temporary nature.”4
Amnesty International believes that restrictions on the right to freedom of peaceful assembly
imposed since the imposition of Martial Law in Thailand – as well as on the related rights to
freedom of expression and association – fail to meet these requirements. Measures curbing
the right to freedom of assembly are far too arbitrary and sweeping, both in scope and in
substance, to be considered proportional or exceptional. Moreover, with these measures still
in place and implemented more than five months after they were imposed, they can no longer
be considered “temporary” either.
Amnesty International supports the view of the Human Rights Committee that the restrictions
within Article 21 itself are sufficient, so there is no justification for any derogations from
these provisions even in time of emergency.5
Amnesty International’s recommendation:
Withdraw all derogations from the ICCPR.
1.2. CONSTITUTIONAL PROTECTION OF THE RIGHT TO FREEDOM OF PEACEFUL ASSEMBLY
At the outset Amnesty International would like to stress that the human right to peaceful
assembly, like all other key human rights, is best protected domestically when provided for
both in specific legislation and in basic laws such as Constitutions.
The 2007 Constitution of Thailand did include, among many other provisions for human
rights, a specific provision protecting the right to peaceful assembly6 as well as provisions for
the closely related freedom of opinion and expression.7 In contrast, the Interim Constitution,

enacted in July 2014 and currently in place,8 does not contain any provisions on specific
rights. Instead, Article 4 provides a general protection:
Subject to the provisions of this Constitution, human dignity, rights, freedoms and
equality of all Thais, which have been protected under the customary practices of the
government of Thailand under the democratic regime with the King as Head of State and
under existing international obligations of Thailand, shall remain protected under this
Constitution.
As noted by Amnesty International previously,9 the organization is concerned that the Interim
Constitution provides much weaker protection of human rights than its predecessor. In
addition to the absence of any detailed listing of key rights to be protected, making the
protections in Article 4 “subject to the provisions of this Constitution,” means that human
rights and Thailand’s international obligations are subjugated to and trumped by the Interim
Constitution. It should be noted that under customary international law,
a state may not invoke provisions of its internal law as justification for its failure to perform a
treaty.10
Amnesty International’s recommendations:
Reinstate Constitutional provisions protecting human rights; Ensure that all domestic legislation accords with Thailand’s international human
rights obligations.
2. KEY HUMAN RIGHTS CONCERNS IN THE DRAFT ACT
2.1. EVEN THE LIMITED PROTECTIONS OF THE DRAFT ACT WILL NOT BE AVAILABLE UNDER MARTIAL LAW
Article 4 of the Draft Act provides that “public assembly during the time when emergency
situation is declared or Martial Law is imposed, and any public assembly for the benefit of
election campaign can be conducted in accordance with the relevant applicable laws.”
This means that the Draft Law, even if adopted, would as things stand be immediately
suspended pending the repeal of Martial Law. Currently, under National Council for Peace
and Order (NCPO) Announcement No. 7/2557 from May 2014, “all political gathering or

assembly of more than 5 persons are prohibited” and “Violation of this order is punishable by
imprisonment not exceeding one year, or a fine not exceeding 20,000 baht, or both.”11
Under Thailand’s Interim Constitution, this and all other NCPO orders continue to be in place
and have the force of law.12 In other words, the Draft Law is powerless to change anything on
the ground until either Martial Law or NCPO Announcement No. 7/2557 is lifted.
Amnesty International’s recommendation:
Repeal all provisions of the Martial Law which adversely affect human rights; Repeal all NCPO orders and announcements which restrict human rights in general,
and the right to freedom of peaceful assembly in particular.
2.2. DEFINITIONS GRANTING WIDE POWERS TO THE AUTHORITIES TO PROHIBIT PEACEFUL ASSEMBLIES
Article 7 of the Draft Act provides, among other things:
Any public assembly, which has led to obstruction or prevention of normal use of public
highway or public way by general public, or which takes place without permission from
the authority in charge of the public way, or which has resulted in nuisance beyond
reasonable expectation and without any due causes, or which has led to infringement of
the rights and liberties of other people, or which includes any act that causes disruption
and public disorder, shall not be considered a peaceful public assembly.
While the ICCPR allows for the exercise of the right to freedom of peaceful assembly, as well
as certain other rights (including freedom of association and freedom of expression), to be
subject to some restrictions, any such restrictions are only permissible if they are, first,
provided by law; second, placed for the purpose of protecting certain public interests
(national security or public safety, public order, protection of public health or morals) or the
rights and freedoms of others; and, third, demonstrably necessary for that purpose.13 Any
restrictions imposed which do not meet all elements of this “three-part test” constitute
violations of the right.14
Amnesty International is deeply concerned that Article 7 grants the authorities extensive
powers to prohibit the holding of peaceful protest, powers which do not meet the above
criteria. Of particular concern is the fact that under this Article, a peaceful assembly would
“not be considered a peaceful assembly” – opening the door to prosecution and the use of

force by police - for the sole reason that the assembly “led to… prevention of normal use of
public highway or public way by the general public.” Where people gather in some numbers
to demonstrate peacefully on, say, a street or a square within a city, such “prevention of
normal use” is inevitable, so this provision would allow the authorities to ban or disperse
practically any assembly they are unhappy with, however peaceful. Similarly, the term
“disruption” is extremely wide and can be used to suppress peaceful assemblies arbitrarily.
Other Articles use the term “inconvenience”, which is similarly open to be used to restrict
peaceful assembly arbitrarily (“Causing inconvenience to people when using, entering or
exiting a public venue”, Article 12(1), and similarly in Article 18(1)).15
Amnesty International’s recommendations:
Rephrase Article 7 and all other provisions imposing restrictions on the right to freedom of peaceful assembly so as to limit restrictions to those allowed by Article 21 of the ICCPR;
Ensure, through legislation, regulations and specific instructions, that such restrictions are narrowly interpreted in law and in practice, while observing the principles of necessity and proportionality.
2.3. OBLIGATION ON ORGANIZERS TO SEEK PERMISSION
Article 11 of the Draft Act provides:
Anyone desires to organize a public assembly and given that the assembly may affect the
maintenance of national security, public safety, public order, moral high ground or public
health or the convenience of people when using public property or the protection of the
rights and liberties of other people, is obliged to inform the authorized body via a written
application at least 24 hours in advance before the assembly takes place.
The Article goes on to provide, among other things, that “The application for organizing a
public assembly must contain description of the public assembly and must be written
according to the format set out by the Minister.”
Article 12 sets out the circumstances under which Article 11 would apply, which again
include “Causing inconvenience to people when using, entering or exiting a public venue.”
While some of the restrictions listed in Articles 11 and 12 correspond to those of Article 21
of the ICCPR, the Draft Act adds that permission to hold an assembly must be sought also
when it “may affect… the convenience of people using public property.”16 As noted,
“convenience” is an extremely wide and vague term, and Amnesty International is concerned
that the requirement to seek permission whenever there is mere potential (“may”) that the
public’s “convenience” would be affected is in effect a demand that each and every planned
peaceful assembly must first be approved by the authorities.

The UN Special Rapporteur on the rights to freedom of peaceful assembly and of association
has stated that peaceful intentions of assemblies should be presumed.17 The Special
Rapporteur has stressed that no authorisation should be required to assemble peacefully.18
The exercise of the right to freedom of peaceful assembly should be governed at most by a
regime of prior notification, which should not be burdensome, the rationale of which is to
allow state authorities to facilitate the exercise of the right and take measures to ensure
public safety and order and the rights and freedoms of others.19 The Special Rapporteur has
recommended that notice should be subject to a proportionality assessment, and should only
be required for large assemblies or those where a certain degree of disruption is anticipated.20
Amnesty International’s recommendations:
Rephrase Article 11 so as to remove any requirement to apply for permission; Limit the requirements from organizers’ to simple prior notification in cases where the
assembly is likely to cause a certain degree of disruption.
2.4. CRIMINALISATION OF ORGANIZING A PEACEFUL ASSEMBLY
Article 30 of the Draft Act provides:
The organizer of public assembly which may affect the maintenance of national security,
public safety, public order, moral high ground or public health or the convenience of
people when using public property or the protection of the rights and liberties of other
people, who fails to notify the authorized body as per Article 11, shall be liable to
imprisonment for a term of not exceeding six months or to a fine of not exceeding ten
thousands baht or to both.
The Draft Act goes on to impose a range of penalties on organizers, those who help them and
in some cases participants, for breaches of provisions of the Draft Act, with imprisonment
ranging from one month to ten years and fines from 1,000 baht (USD 30) to 200,000 (USD
6,200).21
While states may legitimately, in the defence of the rights of their population, criminalise
certain acts such as acts of violence, including when committed by protestors, Amnesty
International is deeply concerned that criminalising organizers and participants of peaceful
assemblies would adversely affect the human right to freedom of peaceful assembly and the

closely related rights to freedom of expression and association. The organization notes that
what Article 30 of the Draft Act criminalises is the simple failure to notify the authorities, and
that failure concerns an assembly that “may affect”, among other things “the convenience of
the public using public property”. This coupling of mere potentiality with the wide scope of
public “convenience,” already noted, provides the authorities with wide-ranging powers to
arrest and prosecute organizers of peaceful assemblies almost at whim.
The UN Special Rapporteur on the rights to freedom of peaceful assembly and of association
has stressed that “should the organizers fail to notify the authorities, the assembly should not
be dissolved automatically and the organizers should not be subject to criminal sanctions, or
administrative sanctions resulting in fines or imprisonment.”22
Amnesty International’s recommendations:
Remove all provisions imposing criminal or administrative sanctions, including imprisonment or fines, on organizers for lack of notification of an assembly;
Remove all provisions criminalising actions by organizers or protestors, bearing in mind that general criminal legislation would apply to protestors as to any other person.
CONCLUSIONS
Currently, freedom of peaceful assembly, in particular involving political activities, is severely
restricted, and Amnesty International appreciates the effort being made by the authorities to
draft a law that would provide for peaceful assemblies to be held lawfully.
However, the current Draft Assembly Act is deeply flawed and fails to meet Thailand’s
obligations under international human rights law, in particular the provision for the right to
freedom of peaceful assembly in Article 21 of the International Covenant on Civil and
Political Rights (ICCPR) and the related provisions for freedom of expression (Article 19) and
association (Article 22).
Amnesty International is particularly concerned that the Draft Act contains definitions which
have the effect of granting wide powers to the authorities to prohibit peaceful assemblies;
obliges organizers to apply for permission to hold peaceful assemblies; and criminalises a
variety of vaguely and broadly worded acts by organizers and participants in peaceful
assemblies.
This proposed legislation comes against a deeply worrying background of ongoing human
rights violations, including sweeping legal restrictions on human rights in Thailand in general,
and on the right to freedom of peaceful assembly in particular. Thailand has stated that it is
derogating from Article 21 of the ICCPR, and the military has repealed the 2007 Constitution
with its extensive protections for human rights; imposed Martial Law; and issued orders

severely restricting peaceful assemblies, orders that would not be affected by the Draft Act
becoming law.
Amnesty International urges the Thai authorities to revise the Draft Act extensively so as to
ensure that it fully accords with Thailand’s international human rights obligations, as detailed
in this document. The organization also calls upon the Thai authorities to remove other
obstacles to the full enjoyment of the right to freedom of peaceful assembly, in particular by
withdrawing its derogations from the ICCPR, restoring Constitutional protections of human
rights and repealing military orders that have made peaceful assemblies involving “political”
activities virtually impossible to hold legally.

กจะยงไมมผลบงคบใชทนทจนกวาจะยกเลกกฎอยการศก
ในปจจบนตามประกาศคณะรกษาความสงบแหงชาต (คสช.) ฉบบท 7/2557 นบแตเดอนพฤษภาคม
2557 ระบวา “หามมใหมวสม หรอชมนมทางการเมอง ณ ทใด ๆ ทมจ านวนตงแต 5 คน ขนไป” และ
“หากผใดฝาฝนตองระวางโทษจ าคก ไมเกน 1 ป หรอปรบไมเกน 20,000 บาท หรอทงจ าทงปรบ”11
ตามรฐธรรมนญแหงราชอาณาจกรไทย (ฉบบชวคราว)

แตขอจ ากดดงกลาวจะกระท าไดกตอเมอในประการแรกคอมกฎหมายก าหนดเอาไว ประการทสอง
คอเพอคมครองประโยชนสาธารณะ (ความมนคงของชาต ความสงบเรยบรอย การสาธารณสข
หรอศลธรรมของประชาชน) หรอเพอคมครองสทธเสรภาพของบคคลอน และประการทสาม

“ขดขวางความสะดวกของประชาชนทจะใชหรอเขาออกทสาธารณะนนตามปกต”
แมวาขอจ ากดตามมาตรา 11 และ 12 จะสอดคลองกบเนอหาของขอ 21 ของกตกา ICCPR
แตรางพรบ.ฯ ฉบบนยงก าหนดเพมเตมใหประหนงเหมอนตองขออนญาตในการจดการชมนม
ในกรณทการชมนม “อาจกระทบตอความสะดวกของประชาชนทจะใชทสาธารณะ ”16
ดงทต งขอสงเกตไววา ค าวา “ความสะดวก” เปนค าทมความหมายกวางขวางและคลมเครอ แอมเนสต
