    Ch gii phn:

    1. (a) Cc mt hng (tr qung phng x) p ng cc m t trong nhm 28.44 hoc 28.45 s c xp vo cc nhm v khng c a vo nhm khc ca Danh mc. (b) Theo ch gii mc (a) trn, cc mt hng p ng m t ca nhm 28.43 hoc 28.46 s c xp vo cc nhm v khng c a vo nhm no khc ca phn ny.

    2. Theo Ch gii 1 trn y, vic phn loi hng ho trong nhm 30.04, 30.05, 30.06 , 32.12, 33.03, 33.04, 33.05, 33.06, 33.07, 35.06, 37.07 hoc 38.08 v c ng gi theo liu lng hoc ng gi bn l, c xp vo cc nhm v khng xp vo bt c nhm no khc ca Danh mc. 3. Cc mt hng ng gi thnh b gm t hai hoc nhiu phn cu thnh ring bit, trong mt vi hay tt c cc phn cu thnh ca cc mt hng nm trong phn ny v chng c trn vi nhau to ra mt sn phm ca phn VI hoc VII phi c xp vo nhm ph hp vi sn phm , vi iu kin l cc cht cu thnh phi:

    (a) Theo cch thc ng gi ca chng cho thy r rng l chng c s dng cng nhau m khng cn phi ng gi li;

    KHI QUT CHUNG Ch gii phn 1.

    Theo cc quy nh ca mc (a) ca Ch gii ny, tt c cc nguyn t ha hc phng x v cc ng v phng x, v cc hp cht ca cc nguyn t v cht ng v (c th l v c hoc hu c, v c th hoc cha c xc nh v mt ha hc), c phn loi nhm 28.44, ngay c khi chng cng c th c phn loi vo nhm khc ca Danh mc.   • c phn loi trong nhm 28.44. Tuy nhin, cng cn ch cc loi qung phng x c phn loi trong phn V ca Danh mc.

    Trong trng hp cc cht ng v khng phng x v cc hp cht ca chng, Ch gii quy nh cc cht ny (d dng v c hoc hu c, v hoc cha c nh ngha v mt ha hc) c phn loi nhm 28.45 v khng c phn loi ni no khc trong Danh mc. Nh vy, cc ng v ca cacbon c phn loi vo nhm 28.45 v khng c phn loi vo nhm 28.03.

    Mc (b) ca Ch gii quy nh cc hng ho c m t trong nhm 28.43 hoc 28.46 c phn loi vo bt k nhm no ph hp trong cc nhm m khng c phn loi nhm khc phn VI, vi iu kin l chng khng phi l cht phng x hoc khng dng ng v (trong trng hp chng c phn loi trong nhm 28.44 hoc nhm 28.45). Do , on ny ca Ch gii quy nh bc caseinate c phn loi vo nhm 28.43 ch khng c phn loi vo nhm 35.01, v bc nitrat ngay c khi c ng gi bn l s dng trong chp nh, c phn loi vo nhm 28.43 ch khng phi nhm 37.07.

    Tuy nhin, cng cn lu cc nhm 28.43 v 28.46 ch dnh quyn u tin i vi cc nhm khc trong phn VI. Khi cc hng ha c miu t trong nhm 28.43 hoc 28.43 cng c xp vo cc nhm trong cc Phn khc ca danh mc, vic xp loi cc hng ha ph thuc vo s p dng cc ch gii phn hoc chng lin quan v ca cc Quy tc ch gii ca Danh mc. V d: lu hunh c ng gi bn l iu tr bnh c phn loi trong nhm 30.04 v khng c phn loi vo nhm 25.03 hoc 28.02, v dextrin c ng gi bn l nh l mt loi keo c phn loi vo nhm 35.06 ch khng c phn loi trong nhm 35.05.   • Ch gii ny lin quan n phn loi ca cc sn phm c ng gi thnh b gm hai hoc nhiu thnh phn ring r, mt s hoc tt c cc thnh phn ny c xp vo phn VI. Tuy nhin, Ch gii ny gii hn cc b m thnh phn trong d nh c trn cng nhau to ra mt sn phm ca phn VI hoc Phn VII. Nhng b sn phm s c phn loi trong nhm ph hp vi sn phm ny vi iu kin l cc b phn cu thnh phi p ng cc iu kin t mc (a) n mc (c) ca Ch gii.

    V d v cc hng ho trong nhng b sn phm nh vy l cht hn rng v xi mng gn rng thuc nhm 30.06 v mt s loi vec ni v sn ca cc nhm t 32.08 n nhm 32.10 v cc loi ma tt b thuc nhm 32.14.     Ch gii ch-ng:

    1. Tr khi c cc yu cu khc, cc nhm thuc ch-ng ny ch bao gm:

    (a) Cc nguyn t ha hc ring bit v cc hp cht -c xc nh v mt ha hc ring bit, c hoc khng cha tp cht.

    (b) Cc sn phm -c nu trong mc (a) trn y -c ha tan trong n-c.

    2. Ngoi dithionit v sunphoxylat -c lm cht n nh bng cc cht hu c (nhm 28.31), cacbonat v peroxocarbonat ca cc baz v c (nhm 28.36), cc xyanua, oxit xyanua v phc xyanua ca cc baz v c (nhm 28.37), cc fulminat, xyanat v thioxyanat ca cc baz v c (nhm 28.38), cc sn phm hu c thuc cc nhm t 28.43 n 28.46 v cc cacbua (nhm 28.49), th ch c cc hp cht carbon sau y s -c xp vo ch-ng ny:

    (a) Oxit cacbon, hydrocyanua v axit funminic, isocyanic, thiocyanic v cc axit cyanic n hoc phc hp khc (nhm 28.11)

    (b) Cc oxit halogenua ca carbon (nhm 28.12)

    (c) Carbon disulphua (nhm 28.13)

    (d) Cc thiocarbonat, selenocarbonat, telurocarbonat, selennocyanat, Tetrathiocyanatodiamminocromat (mui Reineck) v cc phc cyanat khc ca cc base v c (nhm 28.42)

    (e) Hydro Peroxit -c lm rn bng ur (nhm 28.47), carbon oxysunphua , thiocacbonyl halogenua , cyanogen v cyanogen halogenua v cyanamit v cc cht dn xut kim loi ca chng (nhm 28.51) tr cyanamit canxi, dng tinh khit hoc khng tinh khit (ch-ng 31)

    3. Theo cc iu khon ca ch gii 1 phn VI, ch-ng ny khng bao gm:

    (a) Natri clorua (NaCl) hoc Oxit Magie (MgO), dng nguyn cht hoc khng, hoc cc sn phm khc ca phn V.

    (b) Cc hp cht hu c - v c tr cc hp cht nu trong ch gii 2

    (c) Cc sn phm nu trong ch gii 2, 3, 4 hoc 5 ch-ng 31.

    (d) Cc sn phm v c s dng nh- cht pht quang thuc nhm 32.06; hn hp nu thu tinh v thu tinh khc dng bt, ht hoc mnh thuc nhm 32.07;

    (e) Graphit nhn to (nhm 38.01), cc sn phm dng nh- cht dp la np cho bnh cu ho hoc lu n dp la thuc nhm 38.13; cht ty mc ng gi bn l thuc nhm 38.24; tinh th nui cy (tr cc b phn quang hc) halogenua kim loi kim hoc kim th -c to ra nng khng d-i 2,5g mi tinh th, thuc nhm 38.24.

    (f) qu hoc bn qu (t nhin, tng hp hoc ti to) hay bi hoc bt ca cc loi (nhm 71.02 n 71.05) hay kim loi qu v hp kim kim loi qu thuc ch-ng 71.

    (g) Kim loi nguyn cht hoc khng nguyn cht, hp kim hoc gm kim loi, k c ccbua kim loi thiu kt (cacbua kim loi thiu kt vi kim loi) thuc phn XV; hoc

    (h) Cc b phn quang hc, v d loi lm bng halogenua kim loi kim, hay kim th (nhm 90.01)

    4. Cc axit phc hp -c xc nh v mt ha hc bao gm mt axit phi kim loi thuc phn ch-ng II v mt axit kim loi thuc phn ch-ng IV phi -c xp vo nhm 28.11.

    5. Cc nhm 28.26 n 28.42 ch bao gm mui kim loi hoc mui amoni hoc mui peroxy. Tr khi c nhng yu cu khc, cc mui phc hp hoc mui kp phi -c xp vo nhm 28.42.

    6. Nhm 28.44 ch p dng cho:

    (a) Technetium (nguyn t s 43): prometi (nguyn t s 61), poloni (nguyn t s 84) v tt c cc nguyn t c s th t trong bng tun hon ln hn 84).

    (b) Cc cht ng v phng x t nhin hoc nhn to (k c cc cht ng v phng x ca kim loi qu hay kim loi th-ng thuc phn XIV v XV), hoc ch-a trn ln vi nhau.

    (c) Hp cht v c hay hu c ca cc nguyn t hoc ng v ca chng, hoc ch-a -c xc nh v mt ha hc, hoc ch-a trn vi nhau.

    (d) Hp kim, cc cht tn sc (k c gm kim loi), cc sn phm gm v

    (e) ng (cartridges) nhin liu bc x ca l phn ng ht nhn.

    Theo mc ch ca ch gii ny v cch din t ca cc nhm 28.44 v 28.45, thut ng cht ng v cp ti:

    - Cc ht nhn ring l, khng k nhng ht nhn tn ti trong thin nhin d-i dng cht ng v n.

    - Hn hp cc cht ng v ca mt nguyn t v nguyn t nh- nhau -c lm giu bng mt hay vi cht ng v ni trn, ngha l cc nguyn t m thnh phn ng v t nhin -clm thay i mt cch nhn to.

    7. Nhm 28.48 bao gm phosphua ng (ng phospho) c cha hn 15% trng l-ng phospho.

    8. Cc nguyn t ha hc (V d: nh- silic v selen) -c kch np dng trong ngnh in t phi xp vo ch-ng ny, nh-ng chng phi dng ch-a gia cng nh- ko hoc dng hnh tr hay dng que. Khi -c ct thnh hnh a hoc hnh dng t-ng t, chng phi -c xp vo nhm 38.18.
