events but would emphasize

the need for volunteers and

donations to help sponsorthese events.

Another area of budget reduc-

tion was printing, postage and

supply. While we do have

this newsletter this quarter,

future newsletters in 2010 will

be distributed electronically.

Overall, the association’s

financial position is a healthy

one. The association is

slightly under-reserved but

has some resources in the

bank.

The 2010 budget in place will

generate a surplus. This sur-

plus will be added to the exist-

ing reserves and allow the

association to maintain its

assets. Our efforts will con-

tinue on collection of existing

debt as it is imperative to the

association’s fiscal bottom

line.

ACAHOA is presently at the

tail end of the 2010 collection

efforts. Invoices were distrib-uted in December followed by

two additional mailers in Feb-

ruary and March. In early

April, certified letters were

sent to all outstanding ac-

counts and liens will be

placed in May, wherever nec-

essary. Collections have im-

proved slightly compared to

last year, however, approxi-

mately six percent of residents

still owe at least one year of 

dues. Unfortunately, pursuit

of collections on these ac-counts will cost the associa-

tion. Several accounts are

under short-term payment

plans, which should be col-

lected promptly.

Similar to other associations

in the area, we have been noti-

fied of several foreclosure

proceedings within ACA-

HOA. We are presently track-

ing these legal proceedings

and will continue to try to

collect dues where appropri-ate. Hopefully, several of 

these will be resolved without

issue.

As you are aware, no increase

in dues was pursued this fiscal

year. As such, adjustments

were made to the original

proposed 2010 budget. While

there were no changes to the

main areas of the budget

(common ground, pool main-

tenance, etc.), discretionary

spending was reduced. Weare hopeful these changes will

create a larger surplus that can

be dedicated to future asset

maintenance.

One area where funding was

significantly reduced was the

social budget. We have heard

from several residents who

would like to see our events

calendar continue. The ACA-

HOA is open to holding

The Arbor Creek Community pool

is scheduled to be opened on Fri-

day, May 28, 2010.

Can’t find your pool key? Contact

HAS at 913-825-0001 for a re-

placement. There is a fee associ-

ated with key replacements. If 

your ACAHOA dues are out-

standing, replacements will not be

issued.

4. Homeowners are contacted

by a member of the Commit-tee if additional information is

required, and are notified

when the application is ac-

cepted or rejected.

5. All decisions made by the

Committee are communicated

to the Homeowner via mail

and/or phone. Formal letters

of approval or rejection are

sent via US Mail by HAS.

6. If an application is denied,the Homeowner has 30 days

to file appeal to ACAHOA.

7. All determinations made

by the ACAHOA are final.

The process followed by the

Architectural Committee inaccepting or rejecting an appli-

cation submitted is:

1. The homeowner completesthe Architectural Committee

Approval Application and

submits it to Homes Associa-

tion Solutions (HAS).

2. HAS logs the request and

forwards all necessary infor-

mation to the Committee.

3. The Committee determines

if the request falls within theArbor Creek Declaration of 

Restrictions. Decisions are

normally made within one

week of receipt or sooner.

Chad Mudloff was appointed

to the ACAHOA in November

2009 as a member-at-large.

This year, in addition to serv-

ing as a Board Member, he is

serving as co-chair to the Ar-

chitectural Control Commit-

tee.

Chad graduated from Kansas

State University with a Bache-

lor of Science in Construction

Science Engineering andManagement. He traveled for

eight years as the Project and

Area Manager for Perform-

ance Contracting, Inc., living

in California, North Carolina,

and New York, to name only

a few, before settling back inthe Olathe area, where he was

raised.

Along with his wife Lori, and

sons Austin, twelve, and

Colton, eight, the Mudloff’s

have lived in the Arbor Creek

and helping to make thingseven more beautiful while

upholding the rules found in

our community’s deeds and

restrictions. It’s a tough as-

signment, but one that is wor-

thy.

Most of us spend the winter

months dreaming of green

grass, red tulips and rock re-taining walls. With the spring

upon us, we can now actually

turn those dreams into reali-

ties. But before we do, we

must remember to complete

an Architectural Committee

Approval Application.

Through our weekly block 

captain messages, we have

sent a few reminders out

about the applications and the

process followed once theapplications are received.

This is a busy time of year for

the committee and we need

your help. We are looking for

2-3 individuals willing to

serve.

It’s not just about whether or

not a paint color is the right

one, or if a basketball goal can

day is a way to let in a little

fresh air. To me, it’s an invi-

You may remember seeing

some tips to prevent burglar-

ies in the March 12, 2010

Block Captain news and Up-

dates. As promised, follow-

ing are the other tips pro-

vided:

• Of course I look familiar; I

was here just last week. I

was cleaning your carpets,

painting your shutters, or de-

livering your new refrigerator.

• Hey, thanks for letting me

use your bathroom. While I

was there, I unlatched the

back window to make my

return a little easier.

• Those yard toys your kids

leave out always make me

wonder what type of gaming

system they have.

• If glass if part of your front

entrance, don’t let your alarm

company install the control

panel where I can see if it’s

set. That makes it too easy.

• I always know you’re home

first. If you answer, I’ll ask for directions somewhere or

offer to clean your gutters

(don’t take me up on it).

• If you don’t answer when I

try the door, occasionally, I

hit the jackpot and walk right

in.

• Sometimes, I carry a clip-

board. Sometimes I dress like

a lawn guy and carry a rake…

and your vehicle open. This is

an invitation for a thief to get

into your home.

6) Beware of home improve-

ment scams. If you did not

solicit the contractor or sales-

man who shows up at your

door unannounced, then do

not do business with that per-

son. If a utility representative

comes to your house, request

identification. True represen-

tatives will carry their identifi-cation and will gladly show it

to you. Call their company

for verification.

Being a good neighbor can be

one of the best crime preven-

tion tools. Watchful, attentive

neighbors can spot criminals

and alert police and the com-

munity to their presence. Get

involved in your community

and help us keep your spring

happy and safe.

It’s spring so let’s discuss

Spring Crime Prevention.

As we enjoy warm weather,

the Olathe Police Department

wishes to remind us of some

ways to keep ourselves and

our homes safe during the

spring months.

1) Please keep doors locked

at all times. If you are work-

ing in the back yard, keep

your front door and garagedoor closed and locked, and

conversely, the back door

locked when you are in the

front yard. Please, lock your

doors when you leave, even if 

you will be gone for 10 min-

utes or less.

2) At this time of year many

people open widows or slid-

ing glass doors while they are

at home. Always remember

to close and lock your win-

dows and sliding doors when

you go to bed or leave the

house.

3) Install motion-activated

lights in your front and back 

yards, so when someone ap-

proaches your home, the

lights automatically come on,

illuminating the person.

4) Put all ladders and tools

back into a secure storage area

after you use them. Ladders

and other tools that are left outcan be used by criminals to

access your home. AND,

always lock any storage unit

or shed you have on your

property.

5) Always roll up your car

windows, take valuables out

of your car, and lock all doors

every time you exit your vehi-

cle, EVEN, if your car is

parked in your driveway.

As a reminder, per Olathe City

Ordinance 9.07.280, Unlawful

Juvenile Activity, unless accompa-

nied by a parent, legal guardian, or

other adult person over the age of 

21 years of age that has been given

custody or control of the child by

the parent or legal guardian, all

children under 18 years of age

must be indoors between the hours

of 11:00 pm and 6:00 am.

In a Neighborhood Watch pro-

gram, the community works

closely with law enforcement to

inform and encourage members to

be aware of crime in their

neighborhood.

Overnight Parking Parking on the street overnight is not permitted per our Deeds and Restric-

tions. Overnight parking at the pool parking lot and school lot is not allowed without prior ap-

proval from the ACAHOA.

Trashcans/Recycle Bins Trashcans/recycle bins may not be set on the curb until after 6:00 pm

the night before the pick-up day, which is WEDNESDAY.

Spring Garage Sale the weekendof May 7-8, 2010. Residents can

determine their own start and close

times.

An ad will be placed in the KC

Star, Craig’s List and The Olathe

Daily News.

Signs may be placed at the site of 

the sale, and not at corners or com-

mon areas. The ACAHOA will

post banners at the entrances.
