海巡署參加第7屆亞裔有組織犯罪暨恐怖活動國際會議

壹、前言

海巡署自成立後推動各項國際情報交流合作計

畫,陸續與美國、日本、韓國、菲律賓、印尼、新加

坡、越南等國家提升雙方實質關係,成功偵查違法活

動與即時防處意外事件,並以拓展對外聯繫管道,強

化國際情報交流合作,及廣蒐周遭國家海域情勢為重

點,以推動國際事務策略方案、統籌涉外事務資源與

培育運用相關人才為根本。

Part I. Preface

Ever since the establishment of this Administration, it has

gradually develop various international intelligence collaboration

plans with the U.S., Japan, Korea, the Philippines, Indonesia,

Singapore, and Vietnam that lead to eminent bilateral

relationships, successful investigations of criminal activities,

and apt prevention and handling of accidents. CGA's focus

tasks are to expand the foreign contact channels, to strengthen

international intelligence communications, and to broadly

collect neighboring maritime information; it's fundamental

purposes are to prompt strategies for international affairs, to

integrate the foreign affairs resources, and to cultivate and to

make the best use of them.

The main subjects discussed in ICAOCT were criminal

forensics, drug smuggling, trafficking in persons, and

information security. This year the conference was held in the

Crowne Plaza Hotel, St. Paul-Riverfront, Minnesota U.S.A.

from 16th to 20th May 2010. CGA's Deputy General Yu Ming-

xi and assistant director Su Chuan-chen of the intelligence

Department attended the conference By participating the

CGA learn experiences and investigating skills from agencies

of advanced countries, demonstrate the effectiveness

in international affairs of maritime countries, and lay the

foundation for our macro development in overall foreign affairs

regulations.

Part II. Key Subjects Discussed in the Conference

I. Dr. Henry Lee Chang-yu speech on "Crime Scene and International Collaborated Investigation":

(I) The importance of Crime Scene: The traces and evidences

left leave on scene could lead to new investigation

directions or clues, and the relevancy between evidences

and scene could offer opportunities to solve the case.

(II) Seize the traces and evidences on scene: Dr. Lee was

once requested by a law enforcement agency to examine

photographs of the scene. He noticed a hand print with

traces of blood which had not been noticed before on

the back of the corpse. The hand print was later listed

as new evidences and lead the agency toward the right

investigation direction.

(III) The role of investigators: To rescue and provide protection

on scene, secure the scene and the personnel within,

collaborate with prosecution agencies and conduct

investigations.

(IV) The role of forensic investigators: To process, search,

collect, and preserve biological, chemical, and physical

evidences on scene, to identify the causes and methods

which led to the death, to analyze and reconstruct the

scene, to examine the material evidences, and to create

links between suspects and the scene.

(V) Emphasize on the benefit of international collaboration: The

scene investigation of any major international cases has

to conduct by an investigation panel grouped by personnel

from relevant countries' law enforcement and investigation

agencies to achieve a successful crime investigation.

「亞裔有組織犯罪暨恐怖活動國際會議」主要研

究議題為刑事鑑定、毒品走私、人口販運及資訊安全

等,本屆係於99年5月16至21日假美國明尼蘇達州聖

保羅市河濱飯店舉行,本署由尤副署長明錫率情報處

專員蘇泉諶出席與會,以汲取先進國家相關執法經驗

及偵辦技巧,展現海洋國家之國際事務成效,並奠定

整體涉外事務發展宏規。

貳、會議研討重點

一、李昌鈺博士演說「刑案現場與跨國偵查合作」:

(一)刑案現場的重要性:現場跡證可以啟發新的蒐

證方向或新的偵查線索,根據證據與現場的關

聯性可以提供破案契機。

(二)掌握現場細微跡證:曾有執法機關請李博士勘

驗某個現場相片,他發現屍體背上有個其他人

尚未注意到的血手印,這個血手印成為新的跡

證,使偵查機關得以掌握正確的偵查方向。

(三)偵查人員的角色:現場搶救與保護,確保案件

現場與人員的安全,協調檢察機關並展開案件

的調查。

(四)鑑識人員的角色:現場處理、蒐集並保存生

物、化學或物理跡證,鑑別死亡原因與方式,

現場分析與重建,實體物證的檢驗,將嫌犯與

刑案現場鏈結。

(五)重視跨國合作效益:任何重大跨國案件的現場

調查必須由各國執法與鑑識調查人員共同組成

調查團隊,合作進行犯罪調查方能奏功。

II.U.S.DEAOfficeinMinnesotapublishedthereportof"The Latest Disguised Drugs":

(I) Amphetamine products resemble chewing gums.

1. DEA was informed the latest drug disguise, the informer

once employed by a major chewing gum manufacturer.

He worked with a chemist to learn the manufacture

techniques and successfully mixed "HASHISH OIL" in

to chewing gums to produce marijuana chewing gums.

The effect of the substance is immediately once the gum

was chewed, and drug enforcement agencies have no

information about this new criminal practice. Therefore

the product is very popular in the market.

2. Later the informer taught the techniques to an unknown

ex-convict, and produced at least 50 thousands packs

of drug gums and put them on sale in California. The

informer said that the disguise technique is very much

sought after; other dealers may also acquire this

technique to make similar products.

(II) Explosives resemble amphetamine: DEA investigated an

amphetamine factory and accidentally recovered objects

that resemble amphetamine. Lab examinations showed

that the content contains explosive substance "triacetone

triperoxide TATP". The investigation and forensics agents

from around the world should be cautious for personal

safeties.

III. The U.S. Department of State Transnational Crimes InvestigationCommitteepublished"TraffickinginPersons Report":

(I) Trafficking in persons is a global phenomenon; it penetrates

across borders, destroys humanity, and undermines

legitimate economy. Human trafficking, commonly known

as "modern slavery", is a global phenomenon. Through

means of force, fraud and coercion, it violates human rights

to obtain or maintain the labor or service. It generates

billions of interest each year, and is the world's fastest

growing illegal activities, in par with illegal trade in drugs and

firearms.

(II) With the help of global economy and international

mobility improvement, human trafficking market is

expanding rapidly.

二、美國緝毒署明尼蘇達州辦公室發表「最新毒品偽裝手法」報告:

(一)口香糖造型安非他命毒品

1、祕密線民提供美國緝毒署新的毒品偽裝手

法,該線民曾在美國某大型知名口香糖

工廠任職,與1名化學專家共同工作,從

而習得口香糖製造技術,並且將大麻油

(HASHISH OIL)成功混合入口香糖,製成大

麻口香糖。由於咀嚼時可收立即效果,且

查緝機關尚未了解此新型犯罪手法,所以

在毒品市場廣受歡迎。

2、後來線民在美國猶他州將技術傳授給一位有

前科的不詳人士,該身分不明人士至少製

造了5萬條口香糖毒品,並且在加州地區販

售。線民表示這種新的毒品偽裝手法十分

搶手,其他的毒販可能也已取得技術開始

製造類似產品。

(二)外形類似安非他命之爆裂物:美國緝毒署調查

安毒工廠,意外發現外形類似安非他命之物

品,檢驗發現含爆裂成份(TATP, Triacetone

Triperoxide),呼籲各國偵辦及鑑驗人員注意安

全。

三、美國國務院跨國犯罪調查組發表「全球人口販運概況」報告:

(一)人口販運是個全球現象,且跨越國界、摧殘人

性、破壞合法經濟。人口販運俗稱「現代的奴

隸」,為全球性的現象,係以強制、欺騙與脅

迫的手段,違反人權以獲得或維持勞工或服務

的目的。每年產生數十億的利益,為全世界成

長最迅速的非法活動,與毒品及槍械的非法交

易齊名。

(二)在全球的經濟條件與國際機動力增加的助長

下,使得人口販運交易市場持續快速的擴張。

(III) Eliminate trafficking in persons from 2 facets:

1. In one end to lend helping hands to victims.

2. In the other end the international community has to

stay together to reject the forced labors and the related

industries.

(IV) Combating the trafficking in persons is a critical mission

domestically or internationally for Obama government.

The U.S. constantly seek more solutions to strengthen the

prevention of human trafficking, and will work closely with

international partners. President Obama has ordered to

set up "The Department of State's Office to Monitor and

Combat Trafficking in Persons" to monitor the policies on

human trafficking prevention and to execute cross-agency

policies. The office is a cross-agency committee headed

by prosecution agency and work with regional and local

agencies.

(V) To improve the human trafficking victim protection, the

revision of "Trafficking in Persons Victims Protection Act"

legitimates the prosecution to not only the domestic crime

on trafficking in persons, but also to U.S. citizens or legal

residency holders who committed trafficking in persons

crime in foreign countries.

(VI) All nations should promote campaigns to raise the public

awareness to this issue, and straighten the definition

of human trafficking. The fact is as long as the labor or

service was not provided voluntarily, the provider is a

victim of forced labor or sex trafficking and should be

protected. Another common misunderstanding is that when

labors received their salaries, it is not trafficking, but labor

dispute. But if any person was forced to offer labor by

means of violence or coercion, even if the person received

salary or compensation, it is still human trafficking.

(VII) A comprehensive human trafficking prevention strategy

should include effective international collaboration. The

U.S. government believes that they could not win this

war by fighting alone; they would keep working with

governments and NGOs from across the world to jointly

combat trafficking in persons, and ensure the victims

would to suitable shelter and aids when they returned to

their country, and won't be subjected to trafficking again.

(三)從兩個方面解決人口販運問題:

1、一方面向被害人伸出援手。

2、另一方面國際社會要團結起來,一起努

力並向不當的勞資僱佣關係及其產業說

「不」。

(四)對抗人口販運,無論在美國本土或國外,都是

歐巴馬政府的重要工作,美國持續尋求更多方

法來增強防制人口販運的成效,也會跟全世界

的夥伴緊密合作,歐巴馬總統特別成立「跨機

關監控及打擊人口販運工作小組」,負責監督

防制人口販運的政策和跨機關的政策執行,由

檢察機關負責帶領區域和地方的跨部會工作小

組。

(五)美國政府為了強化人口販運被害人保護,修改

後的「人口販運被害人保護法」不但可以起

訴國內的人口販運犯罪,也可以起訴美國國民

和合法永久居民在海外犯下的人口販運相關犯

罪。

(六)建議各國應加強擴大宣導,提升社會大眾對這

個問題的重視,並破除對於人口販運定義的誤

解。事實上,一旦工作或服務並非出於自願,

即為強迫勞動或強迫性交易的被害人,應該受

到法律保護。另一個常見的誤解是,一旦勞工

拿到薪水,就不算是人口販運,只能算是勞資

糾紛。但是,如果一個人是因為暴力或脅迫而

勞動,即使得到薪資或補償,這樣也算是人口

販運。

(七)一個全面的防制人口販運策略,應該包括有效

的國際合作,美國政府深信無法單獨打贏這場

仗,將持續與世界各國政府及非政府組織緊密

合作,共同防制人口販運,確保返國的被害人

能夠受到適當的收容與援助,並確保他們不會

再度被販運。

IV. U.S. Secret Service published the report of "Super Note Identification":

(I) Definition of Super Note:

Super Note is the highest quality counterfeiting bill found

around the world, even bank teller found it difficult to

indentify. The bills have different serial numbers from

genuine ones but were made with similar template; hence

it was called "SUPER NOTE" by the U.S. agents. The first

Super Note was found by a bank teller in Manila, Philippines

in 1989. Suspected but failed to be identified its legitimacy,

it was sent to USSS for identification. At first it was deemed

genuine, but later it was proved to be counterfeiting note.

The forgery was done in such details that general criminal

groups could not possibly counterfeit it.

(II) The transportation of Super Note:

1. Smuggled by cargo containers and fishing vessels: North

Korea is under financial sanction commenced by UN

for a very long term. Mainland China became its easiest

channel, alone the Yalu River border there are several

trade towns on both sides. Through land transportation,

the Super Note left North Korea for Mainland China,

then were hidden in cargo containers and smuggled by

fishing vessels to the world.

2. Smuggled by diplomats: Though North Korean is

under UN financial sanction, it still sends diplomatic or

trade delegations to several nations and areas. So the

diplomats exploit their diplomatic immunity to smuggle

the Super Note is known to be the other route.

(III) Our delegation discussed with USSS representative Johnny

Mak to learn the reasons why the USSS is condemning

North Korean government for counterfeiting Super Note:

1. According to the intelligences provided by North Korean

defectors, the government of North Korea is actually

counterfeiting, and the hi-techniques needed were

directed by Japanese captives.

2. In Hong Kong and Macau 1994, North Korean diplomats

and trade officers were found holding large amount of

Super Note. In Africa there had been cases that shortly

after North Korean Embassy opened, the counterfeiting

emerged. The evident were all pointing to North Korean

diplomats.

四、美國祕勤局發表「超級假美鈔之辨識方法」報告:

(一)「超級假美鈔」定義:全球各地查獲各類偽造

美鈔,以超級假美鈔品質最佳,金融人員亦難

以分辨,鈔票序號不同但皆使用類似模版,美

方人員稱此類假鈔為「超級假美鈔」 (SUPER

NOTE)。首張超級假美鈔於1989年在菲律賓馬

尼拉被1名菲國金融人員發現,但是無法區別

與真鈔具體相異之處,輾轉送請美國祕勤局鑑

定,祕勤局初步鑑定為真鈔,經二次鑑定才證

實為假鈔,其偽造手法非常精細,非一般犯罪

集團所能為。

(二)超級假美鈔的運輸路線:

1、貨櫃及漁船走私:北韓長期受到聯合國經濟

制裁,大陸是北韓對外最便捷管道,雙方

沿著鴨綠江邊界有數個貿易城鎮,超級假

美鈔自北韓由陸路進入大陸後,至大陸沿

海以貨櫃夾藏及漁船走私方式,輸往世界

各地。

2、外交人員走私運輸:北韓雖受到聯合國經濟

制裁,但仍在世界部分國家地區派遣外交

或經貿人員,故由外交官員藉外交豁免權

夾帶超級假鈔成為另一走私運輸方式。

(三)經本署訪團與美國祕勤局與會代表Johnny Mak

討論後得知,美國祕勤局認定北韓政府製造超

級假美鈔之理由如下:

1、依據北韓投誠人士提供情報,北韓政府確實

製造假美鈔,且印刷工廠內高階技術是由

早期日本籍俘虜主導。

2、1994年在香港及澳門兩地,查獲北韓外交

及經貿官員持有大量超級假美鈔。在非洲

亦曾發現北韓大使館開館後不久,即在當

地出現超級假美鈔的案件,證據均指向北

韓外交官員涉案。

V. U.S. Drug Enforcement Administration published a report on "East Asia and Southeast Asia Drug News Bulletins and Recent Regional Collaborations":

(I) Major update:

1. East Asia and Southeast Asia had consistent

improvement on reducing the crop areas for illegal

opium poppy cultivation, but suffered a setback in

2008 when the regional crop areas increased 3.3%

compared to 2007 data.

2. The trafficking of methamphetamine and illegal

production of ecstasy (MDMA) were growing fast.

Furthermore, in recent years it had a first emergence

of illegally production of γ-Hydroxybutyric acid (GHB)

in the region.

3. China had investigated and recovered various new

products contained synthetic compounds:

(1) In December 2008, tablets made from methaqualone

and ephedrine mixture compound were detained

in Northern China (Inner Mongolia Autonomous

Region).

(2) In January 2009, compounds of GHB, MDMA, and

Ketamine mixture were found hidden in bottles

labeled "Traditional Cough Medicine" in Guangxi

Autonomous Region, China.

4. In East Asian and Southeast Asian countries such as

Singapore, drug dealers target women through social

networking website to hire as drug traffickers who have

fit the profile of single woman, aged from 20 to 30 years

old with clean criminal records, unemployed or doing

paperwork, sales or services jobs.

5. Ketamine is not controlled internationally, but the

illegally manufacturing, trafficking, and abusing has

made Chinese government to crackdown on 44

underground factories involved in manufacturing

Ketamine illegally in 2007.

五、美國緝毒署情報中心發表「東亞和東南亞毒品主要動態及區域合作近況」報告:

(一)主要動態:

1、東亞和東南亞國家幾年來在減少非法罌粟

種植面積上取得了進展,但2008年遭遇挫

折,當年該地區非法罌粟種植面積比2007

年增加了3.3%。

2、甲基苯丙胺的販運和搖頭丸的非法製造也大

幅度增加。此外,近年來首次出現非法製

造羥基丁酸的案例。

3、中國緝獲含有合成藥物混合物的各類新型產

品:

(1)2008年12月,在中國北方(內蒙古自

治區)緝獲由甲喹酮和麻黃素混合而

成的片劑。

(2)2009年1月,在中國廣西自治區緝獲

了羥基丁酸、搖頭丸和氯胺酮的混合

物,這些混合物藏在貼有「傳統咳嗽

藥」標記的瓶子中。

4、在新加坡等東亞和東南亞國家,販毒分子使

用社交網站招雇東南亞婦女充當「運毒車

手」。販運者年齡在20至30歲之間、沒有

犯罪紀錄、沒有工作或從事文書、銷售或

服務性工作的單身婦女作為其僱用目標。

5、儘管氯胺酮不受國際管制,但其非法製造、

販運和濫用,中國2007年已打擊44家涉及

非法製造氯胺酮的地下加工廠。

(II) Regional Collaborations:

1. In 2008-China offered trainings for drug enforcement

agents from Cambodia, Laos, Burma, and Vietnam in

their police institutes. The trainees were shown how the

national drug enforcement was conduct in China, and

took trainings of drug enforcement skills.

2. In September 2008-the 18th International Conference of

Drug Liaison Officers was held in Busan, South Korea.

The conference had called on the jointly set up of an

internet web server to exchange criminal information.

3. In October 2008-National Drug Control of Indonesia and

Drug Enforcement Administration of Philippines signed

the memo of "Combating illicit production and trafficking

of narcotic drugs, psychostimulant drugs and precursor

compounds".

4. In April 2009-National Food and Drug Administrations

from China and South Korea signed the cooperation

memorandum to ensure the safety of medicines and

medical facilities, the Food and Drug Administrations

from these two countries can exchange information

related to licensing and regulatory system.

5. In May 2009-police commissioners from ASEAN

countries held a meeting in Hanoi and concluded to

control drug precursor compounds to prevent illegal use

in producing drugs.

6. In October 2009-drug enforcement commissioners from

Asia Pacific region held a conference in Indonesia, it

was recommended in the meeting that governments

should assure that their legal framework should be in

line with international treaties of controlled drugs. Also

it encouraged countries to strengthen the inter-agency

communications between agencies of law enforcement,

forensics, and chemistry goods control to ensure

the detained chemical compounds and drugs will be

disposed in a safe and environmental process.

7. With technical support from Japan, the Drugs

Administration Office, Department of Justice, Thailand

held regional collaboration training to improve the drug

enforcement in Cambodia, Laos, Burma, Thailand, and

Vietnam.

(二)區域合作:

1、2008年-中國員警學院於代訓柬埔寨、寮

國、緬甸和越南等國的藥物管制官員,學

員參訪中國國家藥物管制工作情況,並接

受毒品稽查技巧訓練。

2、2008年9月-第18次緝毒聯絡官員會議於南

韓釜山舉行,會中建議建立共同的網際網

路伺服器,交流有關犯罪資訊。

3、2008年10月-印尼國家藥品管制局和菲

律賓緝毒局簽署「打擊非法生產和販運麻

醉藥品、覺醒劑藥物和先驅化合物」備忘

錄。

4、2009年4月-中國和南韓國家食品藥品監督

管理局簽署關於合作確保藥品和醫療設施

安全問題的備忘錄,這兩個國家的食品藥

品監督局將彼此交流本國許可證發放和監

管系統的相關資訊。

5、2009年5月-東協國家警察首長會議於在河

內舉行,決議擬訂管制毒品先驅化合物,

防止非法轉用製毒。

6、2009年10月-亞太國家緝毒執法機關首

長會議於印尼舉行,會中鼓勵各國政府確

保其法律框架符合國際藥物管制公約的規

定,並促請各國政府支持加強其執法、法

醫和化學品管制機構之間的協調聯繫,確

保以安全和環保的方式處置所緝獲的化學

原料和毒品。

7、泰國司法部藥物管制局辦公室在日本技術援

助下,實施區域合作專案訓練,以改進柬

埔寨、寮國、緬甸、泰國和越南的緝毒工

作。

VI. The U.S. Immigration and Law Enforcement Bureau published a report on "News Bulletins of Illegal Smuggling of Amphetamine Precursor Chemicals":

(I) During the period from 01/Nov/2008 to 31/Oct/2009,

there were 92 tons of ephedrine and 911 tons of

pseudoephedrine involved in illegal smuggling, these

cargo came from 34 source countries to 125 destination

countries.

(II) Key investigation cases from various nations:

1. In 2008, Iran government intercepted 2 batches of

pseudoephedrine hydrochloride on cargo vessels

with 8 tons and 3 tons of cargo respectfully; Belgium

intercepted 50 kilograms of ephedrine heading to

Congo; Canada intercepted 3 batches of 200 kilograms

ephedrine, and a batch of 142,848 boxes pharmaceutical

preparations which contained roughly 51 kilograms of

pseudoephedrine in total en route to Panama, and later

another 156,528 boxes of similar cargo for Panama was

intercepted; and the U.S. authorities also intercepted 13

batches of cargos.

2. In 2008, 23 countries had reported detentions of

ephedrine and pseudoephedrine, the reported amount

of ephedrine material seized had an total weight of

12,637.47 kg, China who recovered 6,700 kg, and

Mexico 3,293 kg had larger proportions. The ephedrine

detained in Mexico came from Argentine, Canada, Hong

Kong, and India.

3. The reported amount of pseudoephedrine seized by

governments had a total weight of 5,130 kg, among

them Mexico had the largest proportion with 2,873 kg,

China 1,100 kg, U.S. 602 kg, and France 502 kg.

4. 17 countries reported detentions of pharmaceutical

preparations with pseudoephedrine content, among

them Mexico had 7 detentions made, the largest

amount recovered was 3,768 kg of tablet drugs from

China. Oceania countries reported interception tablets

with pseudoephedrine substance; Australian authority

had intercepted 2 batches of tablet cargos from

Thailand weighted 850 and 622 kg respectfully. New

Zealand detained 622 kg of pseudoephedrine in 367

cases, the pseudoephedrine were granular intended

to disperse in capsules. These cargos were from 15

source nations, among them 300 batches were came

from China.

六、美國海關移民執法局發表「安非他命毒品先驅化學物質非法走私動態」報告:

(一)2008年11月1日至2009年10月31日期間,計有

92噸麻黃鹼和911噸偽麻黃鹼涉及不法走私,這

些貨物來自34個出口國家,輸往125個進口國。

(二)各國查緝重點情形:

1、2008年伊朗政府攔截兩批分別載有8噸和

3噸鹽酸偽麻黃鹼的貨船;比利時攔截了

發往剛果的50公斤麻黃鹼貨物;加拿大攔

截3批各重200公斤的麻黃鹼貨物,且攔截

一批出口到巴拿馬約含51公斤偽麻黃鹼的

142,848箱藥物製劑,在此之後,同樣準備

出口到巴拿馬的一批156,528箱同類產品的

貨物也遭攔截;美國當局也攔截或扣押了

13批貨物。

2、2008年有23個國家通報麻黃鹼或偽麻黃鹼

緝獲情況,報告緝獲的麻黃鹼原料總重為

12,637.47公斤,其中中國緝獲6,700公斤,

墨西哥緝獲3,293公斤,所占比重較大,墨

西哥緝獲的麻黃鹼來自阿根廷、加拿大、

香港及印度。

3、各國政府報告緝獲的偽麻黃鹼總重為5,130

公斤,其中墨西哥報告的緝獲量最大共

2,873公斤,其次是中國1,100公斤、美國

602公斤和法國502公斤。

4、有17個國家通報緝獲含偽麻黃鹼的藥物

製劑,其中墨西哥緝獲7次,來自中國的

3,768公斤片劑包裝毒品為最大單筆緝獲

量。大洋洲國家報告截獲了含偽麻黃鹼的

片劑,其中澳洲當局緝獲兩批來自泰國的

片劑包裝貨物,數量分別為850公斤和662

公斤。紐西蘭在367個案件中緝獲了總量

622公斤的偽麻黃鹼,所緝獲的偽麻黃鹼

為顆粒狀,最初打算裝入膠囊到市場上銷

售。這些貨物是從15個國家進口的,其中

300批緝獲貨物來自中國。

5. Thai authority reported interception of 192 kg of

pseudoephedrine pharmaceutical preparations in Phuket

en route for Australia, and 507,450 pseudoephedrine

tablets in its Burma border, also recovered 200,000

tablets came from Malaysia. Meanwhile, Holland

authority detained 5 millions tablets.

(III) Although the detention of ephedrine and pseudoephedrine were

enormous, this information did not reveal the whole picture of

how seriously these precursors were illegally used to produce

amphetamine. From January to September 2008, there were

49 suspicious transnational cases involving trades of ephedrine

and pseudoephedrine. Most of them were raw materials with

only 11 cases were trades of chemical preparations. Meanwhile

among the suspicious cargos or transported cargos detained,

70 % were tablets, roughly or partially packaged in many

cases, even loose tablets. Illegal manufacturers exploit the

loop holes in precursor chemicals international trading treaties

to smuggle these substance. Therefore it is recommended

that all countries should publicly list the controlled substance

for a better management of pharmaceutical preparations with

ephedrine and pseudoephedrine content.

VII. The Federal Bureau of Investigation published a report on "The application of "Real-time Analytical Intelligence Database, RAID" in Transnational Crime Investigations", the summary is as following:

(I) The development of technology and multi-dimensional society

made the traditional manual processes of intelligence analysis

and filtration tougher than ever as the information collected by

law enforcement agencies from major cases were too enormous

and complicated. Therefore the U.S. Department of Justice

utilizes "Real-time Analytical Intelligence Database" to digitalize

the massive intelligences by using computers to compute the

relevancies of intelligences and out puts with visualized graphics

to simplifies the processes and makes information easy to

understand for users (law enforcement agents).

5、泰國當局報告在普吉島緝獲了運往澳洲的

192公斤偽麻黃鹼製劑並報告在泰、緬邊境

緝獲了507,450片偽麻黃鹼片劑,另亦緝獲

來自馬來西亞的200,000粒片劑。且同期荷

蘭緝獲了500萬片。

(三)儘管麻黃鹼和偽麻黃鹼緝獲量可觀,但這些資

料僅部分說明了該類先驅化學物用於安非他命

類毒品非法製造活動的嚴重程度。在2008年1

月至9月,查獲49起涉及原料麻黃鹼和偽麻黃鹼

的可疑國際貿易,其中大部分是原料交易,只

有11起是製劑交易。而在同一期間查緝的可疑

貨物或轉移貨物中,70%是藥物片劑,且很多

案例中之片劑產品僅進行了粗略包裝或部分包

裝,甚至只是散裝運輸,不法分子未以合法藥

品貿易進行銷售,非法製造者利用現有關於先

驅化學物國際貿易條約漏洞進行走私,因此建

議各國以表列明訂的方式來管制含麻黃鹼和偽

麻黃鹼的藥物製劑。

七、美國聯邦調查局發表「情報分析整合系統(Real-time Analytical Intelligence Database, RAID)在跨國犯罪偵查之應用」報告,重點摘要如下:

(一)因科技發展及社會多元,執法機關偵辦重大案

件所蒐獲之情資往往因過於龐大複雜而難以傳

統人工方法分析過濾,故美國司法部利用「情

報分析整合系統」將大量的情資數據,以電腦

運算方式計算彼此之關聯性,並以視覺化的方

式呈現,使用者(執法人員)操作方便且一目

了然。

參、參與國際會議之效益

一、推展國際合作、促進情資交流

(一) 本屆會議由明尼蘇達州聖保羅市警察局主辦,來

自全美各地及國際上對亞裔有組織犯罪暨恐怖活

動的專家,在會議中提供廣泛的執法議題指導;

另有來自全美各地方、州及聯邦的執法單位代表

及來自亞洲地區國家之執法單位代表出席此盛

會。藉由共同出席本會議,彼此提供跨國犯罪暨

恐怖活動所需之關鍵情報,且為難得的交流互動

機會。

(二) 本署專責台灣地區海域及海岸執法工作,藉此會

議與各國執法人員緊密的互動,交換經驗與心

得,且掌握未來國際間犯罪及恐怖活動的形態與

趨勢,不但達到會議的宗旨,亦對我國執法工作

與國際外交有更進一步的助益,宜持續運用機會

參加國際查緝有關會議,達到汲取國際犯罪調查

新知及開展對外交流合作成效之目標。

二、打擊人口販運、提升國際形象

我國政府為打擊人口販運,由行政院成立「防制

人口販運協調會報」,有效整合各部會資源,特別是

被害人之鑑別、安置及保護工作,經由訂定相關法

令,已逐步落實並制度化;我國雖向來重視基本人

權之保障,也不遺餘力強化執法及立法等各種層面工

作,然因勞力剝削案例仍時有所聞,以致影響我國打

擊人口販運所做種種努力,故應持續結合各相關機關

推動人口販運防制工作,以期有效遏止人口販運案

件,特別是勞力剝削之發生,以符合國際社會對我國

之期待。

PartIII.TheBenefitofParticipationinInternational Conferences

I. To promote international collaboration and increase intelligence exchange.

(I) The conference was hosted by the Saint Paul City Police

Department, Minnesota this year. Asian organized crime

and terrorism specialist from across the States and

the world offered broad advises for law enforcement

issues in the conference. Also the participants included

representatives came from local, state, and Federal law

enforcement agencies in the States and delegations

from law enforcement agencies in Asia countries. Their

attendance in the conference offered critical intelligences

on transnational crimes and terrorism, let alone the rare

opportunity to intercommunicate.

(II) The Administration is responsible for the law enforcement

tasks in the sea territory and seashore of Taiwan, through

the participation in this conference, the law enforcement

agents from across countries had a closer interaction, and

a chance to exchange experiences and knowledge. Not

only fulfilled the goals of the conferences, but also gave us

a further benefit in law enforcement tasks and international

diplomacy. We shall constantly take the opportunities of

participating international crime investigation conferences

to reach the goals of accessing new knowledge of

internat ional cr ime invest igat ion and developing

international collaborations.

II.Fightagainsthumantraffickingtoimprovetheimageof the country

To fight against human trafficking, the government has set

up a "Human Trafficking Prevention Inter-Agency Meeting"

through Executive Yuan to efficiently integrate resources from

involved ministries and councils. Specifically the regulations

regarding victims identification, relocation, and protection

had been revised and legislated, and has been enforced

systematically. Our nation has valued basic human right

protection highly, and effortlessly strengthened the multi-layer

tasks from law enforcement and legislation. But occasionally

cases of labor exploitation happened, and spoiled our effort on

combating human trafficking. Therefore, the relevant agencies

should continuously tackle on the task of human trafficking

prevention jointly to effectively prevent human trafficking,

especially on labor exploitation, to meet the international

communities' expectations for our country.

三、增進專業技能、提升執法能力

(一) 美國聯邦調查局「情報分析整合系統」,其以電

腦運算方式計算彼此之關聯性,並以視覺化的方

式呈現,使用者(執法人員)操作方便且一目了

然,可作為本署業務參考。

(二) 美元為全球通用貨幣,適逢美國政府發行新版美

鈔,為加強本署同仁查緝偽造美鈔技能可以獲取

之美國祕勤局「新版百元美鈔防偽辨識特徵」資

料,作為本署業務參考。

四、參考招募方式、增進團結融合

美國祕勤局執法幹員之晉用,除具有完備之人員

招募作法,含基本之身家調查、學識背景及體格檢查

外,更以資深探員參與口試方式確認新進人員性向是

否適任未來的工作,以使其融入所屬機關文化,與機

關內部同仁團結合作,所蒐得之美國祕勤局招募新進

人員測驗方式,應可作為情報體系人員調用參考。

肆、結語

總統「藍色革命、海洋興國」施政理念,已特別

強調「發展海洋戰略,走出冷戰鎖國思維」及「培養

涉外事務能力,積極參與國際組織」治國方針,未來

本署將積極提升國際事務處理能力,逐步加強與重要

國家巡防及執法機關交流合作關係,成為創造海洋國

家願景的堅實後盾,並藉由派員出席此國際會議,汲

取先進國家相關執法經驗及偵辦技巧,另透過參與全

球執法同儕交流活動,促進彼此情資交流與執法網路

資源共享,增進各執法單位間合作交流之機會。

III.Toimproveprofessionalskills,andstrengthenthelawenforcement capability.

(I) The "Real-time Analytical Intelligence Database, RAID" used

by U.S. FBI utilizes computers to compute the relevancies of

intelligences and out puts with visualized graphics to simplifies

the processes and makes information easy to understand for

users (law enforcement agents). The Administration could

make use of the system for its operations.

(II) U.S. Dollar is the most globally valid currency, and coincidently

the U.S. government is now issuing a newer version of Dollar

bills. To improve our agents' ability to identify counterfeiting

notes, the obtained information of "New $100 Note Security

Features" from the United States Secret Service could be

used for the Administration's reference.

IV. To reference the recruitment procedures, improve the group consent.

The procedures of USSS Agent recruitment includes,

apart from complete generic procedures such as basic family

background check, education background check, and physical

check, senior agents' participation in interviewing to confirm

if newly recruits were apt for their future works, so that they

could fit into their agency culture and work as a team together.

The collected information of USSS recruitment test methods

could be used by the Administration for managing the agents in

intelligence system.

Part V. Conclusion

The President has expressed his policy of "make a blue

revolution and seek prosperity from the ocean", and outline

the directives of "develop maritime strategy, walk out from cold

war mentality of closed country" and "develop foreign affairs

management, actively participate international orgnisations".

In the future the Administration will aggressively improve

the capability of foreign affair management, and gradually

reinforce the collaboration of joint patrol and communication

with law enforcement agencies from major nations to build a

solid foundation for the vision of realizing a maritime state. By

sending delegation to this international conference we could

learn experiences and investigating skills from corresponding

law enforcement agencies of advanced countries. Through

partaking in the global peer communities of law enforcement

personnel to enhance the intelligence exchange and resource

sharing of law enforcement networks, and to increase the

opportunity of cross agency collaborations.
