    CyberOne Protection

    In consideration of the payment of a premium to Us and subject to the terms and conditions of this Policy, We agree to provide cover in the manner and to the extent set out in this policy. Please Read This Policy If this policy contains incorrect information, please return it to Us immediately for correction.

    IMPORTANT INFORMATION ABOUT THIS COVER

    1. Your Policy 1.1 Your Policy and Policy Schedule describe the insurance contract between You and Us. 1.2 In return for You paying Us the premium, We will insure You for the Event(s) subject to the terms,

    conditions and exclusions of Your Policy and Policy Schedule.

    2. Please read Your Policy 2.1 It is important that You read carefully and understand Your Policy and Policy Schedule because

    they describe the terms, conditions and exclusions that apply to Your insurance under Your Policy.

    3. Checking Your Policy 3.1 Please check this document (which is Our Policy) and Your Policy Schedule to make sure all the

    information on them is correct. Please let Us know straight away if any alterations are needed. Please contact Us if You have changed Your address or account details.

    5. Keeping Your documents safe 5.1 You should keep this document and Your Policy Schedule in a safe place in case You need to refer

    to them in the future.

    5.2 Certain types of cover under Your Policy require You to provide receipts and other documentaries evidence to Us. You should keep those documents in a safe place in case We need them to settle a claim.

    COVER UNDER YOUR INSURANCE POLICY

    1. Who and what is insured?

    1.1 You are insured for the Event(s) subject to the terms, conditions and exclusions of Your Policy.

    2. What are the eligibility requirements?

    2.1 To be eligible for cover, You must be a Hong Kong Resident, and You must be (18) years of age or older at the Commencement Date or have a parent or guardian who is the Policyholder.

    The process for making a Claim is set out at Part 6 – How to make a claim. Prior to contacting Chubb Assist to make a Claim, You must report the Cyber-Bullying or Identity Theft to the police. Please have the police reference number and Your Policy details ready when You contact Chubb Assist.

    PART 2: DEFINITIONS

    The following words when used with capital letters in Your Policy Wording or the Policy Schedule have the meaning given below:

    1. Additional Expenses means expenses solely and directly incurred by You as a result of a Cyber-Bullying incident or an Identity Theft, including but not limited to the following: (i) Replacement Fees (if applicable); (ii) Travel Expenses; (iii) eldercare and/or childcare costs; (iv) expenses incurred on the instructions of Our IT / Tech Support to arrange additional

    technical support in circumstances where it is not possible to assist with resolving or minimising the extent of the Cyber-Bullying Incident or Identity Theft by telephone or remote access alone.

    2. Benefit Amount means any amount referenced as such in the Policy Schedule. For the avoidance of doubt, each Benefit Amount is an annual limit and once exhausted You will have no further cover for that benefit in the relevant Benefits Period.

    3. Benefits Period means for so long as this Policy remains in force, the period of 12 consecutive months starting from the Commencement Date and then each consecutive period of 12 months.

    4. Children means any of Your children who: (a) permanently reside with You; (b) are under 18 years of age; and (c) are unmarried.

    5. Chubb / We / Us/ Our means Chubb Insurance Hong Kong Limited. 6. Claim means a request by You for any of the benefits under this Policy. 7. Commencement Date means the original inception date of cover as shown in Your Policy

    Schedule. 8. Cyber Attack means the following malicious or fraudulent acts:

    (i) unauthorised access to, or use of, You or Your Immediate Family’s, Electronic Device(s); (ii) alteration, corruption, damage, manipulation, misappropriation, theft, deletion, or destruction

    of You or Your Immediate Family’s, Electronic Device(s); (iii) transmission or introduction of a computer virus or harmful code, including ransomware, into

    You or Your Immediate Family’s, Electronic Device(s); or (iv) restriction or inhibition of access targeted at or directed against You or Your Immediate

    Family’s, Electronic Device(s),

    but Cyber Attack shall not mean the following non-malicious acts:

    (i) human operating error or omission, including the choice of the program used, an error in setting parameters or any inappropriate single intervention by You or Your Immediate Family, or a third party providing services to You;

    (ii) mistakes in legitimate electronic code or damage from code installed on You or Your Immediate Family’s, Electronic Device(s) during the manufacturing process, upgrade process, or normal maintenance; or

    (iii) power failure, surge or diminution of electronic systems. 9. Cyber-Bullying means acts of harassment or intimidation, including defamation of character,

    invasion of privacy, or threats of violence, first committed against You online via an Electronic Device within the Policy Period.

    10. Cyber-Bullying Incident means a single instance, or multiple related instances, of Cyber-Bullying.

    11. Cyber Disruption means loss arising out of a Cyber Attack which results in the interruption of continuous, normal operation of Your: (i) electronic household management systems, where such interruption:

    a) denies You or Your Immediate Family access to your residence; or

    b) would make Your residence uninhabitable; or

    (ii) incidental business at home. 12. Cyber Extortion means one or more similar or related acts, which arise out of a Cyber Attack

    committed directly against You or Your Immediate Family’s, Electronic Device(s) and threatens the following unless a payment is made: (i) to release, divulge, disseminate, destroy, or use You or Your Immediate Family’s Personal

    Data;

    (ii) to cause failure to Electronic Device(s) owned by You or Your Immediate Family; or (iii) to restrict or inhibit access to You or Your Immediate Family’s, Electronic Device(s) or

    Personal Data. 13. Cyber Financial Loss means one or more similar or related acts, which:

    (i) arise out of a Cyber Attack; and (ii) result in theft of You or an Immediate Family’s personal account funds from a financial

    institution without Your knowledge or Your Immediate Family’s knowledge. 14. Doctor means a person other than You, Your Immediate Family or Your relative who is a

    properly qualified medical practitioner licensed by the competent medical authorities of the country which treatment is provided, and who in rendering such treatment is practicing within the scope of his or her licensing and training.

    15. Documents mean papers or other items containing references to Your identity issued by a government authority, tertiary education institution, financial institution, professional trade association, public utility provider or service provider, including but not limited to the following: (i) Passport; (ii) Driving License; (iii) Credit, debit and bankcards; (iv) Share certificates; (v) Hong Kong Identity Card (“Identity Card”); (vi) Birth certificate; (vii) Bank account details; (viii) Insurance documents - motor, home, travel and life; (ix) Utilities account numbers; or (x) Membership numbers of professional bodies.

    16. Electronic Device means any personal network connected device including, but not limited to, desktop computer, laptop/netbook, smartphone, tablet, personal organiser and router.

    17. Event(s) means the event(s) set out at Part 3 – Description of Cover of this Policy. 18. Identity Theft means the theft of Your Personal Data or Documents by a third party without

    Your consent for the purpose of obtaining goods, money or services. 19. Hong Kong Resident means a Hong Kong permanent resident or a holder of a valid work permit

    / visa. 20. Hong Kong means the Special Administrative Region of the People’s Republic of China. 21. Immediate Family means the Policyholder’s: (i) Children, (ii) Spouse and/or Partner, and/or

    (iii) parents who permanently reside with the Policyholder at the address registered with Us as the Policyholder’s permanent residence.

    22. Initial Counselling Session means one session of counselling, during business hours (9.30am – 5.30pm), for You (up to one (1) hour) with a Doctor, a Registered Psychiatrist or a Registered Psychologist from Our panel of providers following a Cyber-Bullying Incident.

    23. IT / Tech Support means a 24/7 hotline service that is provided for You to reach out to Our panel of providers following a Cyber-Bullying Incident or Identity Theft. The expert will guide You on the phone or take remote access to Your Electronic Device(s) to assist with resolving or minimising the extent of the Cyber-Bullying Incident or Identity Theft.

    24. Legal Expenses in respect of cover under: (i) “Part 3 – Section A: Cyber-Bullying” means reasonable legal fees and disbursements,

    approved by Us in advance, incurred in engaging legal assistance from Our panel of providers in order to pursue or defend legal action in respect of or arising from a Cyber-Bullying Incident.

    (ii) “Part 3 – Section B: Identity Theft” means reasonable legal fees and disbursements, approved by Us in advance, incurred in engaging legal assistance from Our panel of providers in order to: a) stop further fraudulent use of Your identity; b) restore Your credit rating; c) restore Your bank, mortgage or loan accounts; d) amend or rectify records regarding Your true name or identity; e) pursue the amendment or rectification of records regarding Your true name or identity; f) defend any suit brought against You by a creditor or collection agency or other entity

    acting on behalf of a creditor for non-payment of goods or services or default on a loan; and/or

    g) remove any civil judgment wrongfully entered against You. 25. Loss of Income means:

    (i) actual personal income lost by You due to time reasonably taken off from Your work; and/or (ii) compensation for paid leave actually taken by You from Your work; where such income has been lost as per (i) above or such leave has been taken as per (ii) above following an Identity Theft, solely in order to:

    a) stop further fraudulent use of Your identity; b) restore Your credit rating; c) restore Your bank, mortgage or loan accounts; d) amend or rectify records regarding Your true name or identity; e) pursue the amendment or rectification of records regarding Your true name or identity.

    26. Partner means Your de-facto partner who has been living permanently with You for three (3) months or more at the time of the covered Event.

    27. Personal Data means personal information as defined under the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong), including text, images, videos and files, stored in Electronic Device(s) or online.

    28. Policy means this document and the Policy Schedule describing the insurance contract between You and Us.

    29. Policyholder means the customer aged eighteen (18) or over, being a Hong Kong Resident, whose name appears on the Policy Schedule as such.

    30. Policy Period means, where You are paying an annual premium, one (1) year from the Commencement Date or the latest Renewal Date whichever is later.

    31. Policy Schedule means the document We send You which contains details of the cover provided to You by Us.

    32. Pre-existing Condition means any condition in respect of which: (i) You received medical treatment, diagnosis, consultation or prescribed drugs, preceding the

    Policy Period; (ii) medical advice or treatment was recommended by a Doctor, Registered Psychiatrist or

    Registered Psychologist preceding the Policy Period; and/or (iii) You were aware, or should reasonably have been aware, preceding the Policy Period.

    33. Quick Legal Consult means one (1) hour of legal advice obtained from Our legal assistance helpline on immediate next steps following a Cyber-Bullying Incident or Identity Theft. A Quick Legal Consult shall be a single consultation, even if the consultation lasts less than one (1) hour. Quick Legal Consult shall be available during business hours (9.30am – 5.30pm).

    34. Registered Psychiatrist means a person other than You, Your Immediate Family or Your relative who is a properly qualified psychiatrist licensed by the competent medical authorities of the country, and included on Our panel of providers which treatment is provided, and who in rendering such treatment is practicing within the scope of his or her licensing and training.

    35. Registered Psychologist means a person other than You, Your Immediate Family or Your relative who is a properly qualified psychologist licensed by the competent medical authorities of the country, and included on Our panel of providers which treatment is provided, and who in rendering such treatment is practicing within the scope of his or her licensing and training.

    36. Renewal Date means, where You are paying annual premium, one (1) year from the Commencement Date and subsequently, the same day of each successive year.

    37. Replacement Fees means fees actually charged by the relevant authority or entity to issue You with new Documents.

    38. Trauma means debilitating shock, mental anguish, or mental injury suffered by You resulting from a Cyber-Bullying Incident, as diagnosed by a Doctor, Registered Psychiatrist or Registered Psychologist.

    39. Trauma Counselling means counselling for Trauma provided by a Registered Psychiatrist or Registered Psychologist, as assigned by Us from Our panel of providers or otherwise approved by Us.

    40. Trauma Counselling Expenses means fees solely and directly incurred by You for Trauma Counselling from Our panel of providers

    41. Travel Expenses means reasonable travel expenses solely and directly incurred by You as a result of a Cyber-Bullying Incident or an Identity Theft, including but not limited to attending or

    visiting a Doctor, Registered Psychiatrist or Registered Psychologist, police/local authority stations, court hearing, legal specialists or technical specialists.

    42. You / Your means: (i) where “Individual Policy” has been selected, and shown on the Policy Schedule, the

    Policyholder; or (ii) where “Family Policy” has been selected, and shown on the Policy Schedule, the

    Policyholder or, where applicable, his/her Immediate Family.

    PART 3: DESCRIPTION OF COVER

    Section A: Cyber-Bullying

    (a) In the event, of a Cyber-Bullying Incident, We will provide You with access to Our panel of providers to assist to mitigate from the impact of the Cyber-Bullying Incident through: (i) Quick Legal Consult; and/or (ii) IT / Tech Support (up to one (1) hour); and/or (iii) Initial Counselling Session.

    We will reimburse You for Additional Expenses incurred by You (if any) to attend Your Initial Counselling Session, subject to all terms and conditions set out under this Policy and up to the respective Benefit Amount(s) shown in the Policy Schedule: (b) In the event that the Cyber-Bullying Incident results or has resulted in:

    (i) Your wrongful termination; and/or (i) Your false arrest; and/or (ii) wrongful discipline of You by a governing official or body of a primary or secondary school,

    institution of higher education, or professional bodies; and/or (iii) You suffering Trauma;

    then in addition to the benefits under Section A above, We will, subject to Our approval in advance, pay for

    (i) Legal Expenses; and/or (ii) Trauma Counselling Expenses; and/or (iii) Additional Expenses,

    Section B: Identity Theft

    In the event You suffer an Identity Theft which occurred or commenced during the Policy Period, We will: (a) provide You access to Our panel of providers to assist to mitigate from the impact of the incident

    through: (i) Quick Legal Consult; and/or (ii) IT / Tech Support (up to one (1) hour); and

    (b) In the that event the incident was not resolved We will pay for: (i) Legal Expenses, subject to Our approval in advance; (ii) Loss of Income, calculated by reference to Your last gross monthly salary or, if You are self-

    employed, Your average daily income in the preceding 12 months; and/or (iii) Additional Expenses,

    solely and directly incurred as a result of an Identity Theft, subject to all terms and conditions set out under this Policy and up to the respective Benefit Amount(s) shown in the Policy Schedule.

    (c) pay You for Replacement Fees solely and directly incurred as a result of the loss or theft of Your Documents during the Policy Period. Any payment made under Section B shall be subject to, and apply against, the aggregate Benefit Amount shown in the Policy Schedule for Additional Expenses.

    (d) not, under Section B, provide for or pay any benefit arising directly or indirectly from a Claim in respect of: (i) replacement of any item or credit obtained as a result of fraudulent use of Your identity. (ii) any loss arising from any business pursuits or the theft of a commercial identity. (iii) any loss or liability arising from the use of any motor vehicle bought, leased or hired by

    fraudulent use of Your identity, where civil or criminal action is, or has been, taken against You.

    (iv) authorised charges that You have disputed based on the quality of goods or services. (v) theft of Your identity by Your Immediate Family. (vi) the amount of any Claim which exceeds the applicable Benefit Amount shown in the Policy

    Schedule in any Benefits Period. (vii) any Loss of Income, Legal Expenses or Additional Expenses not agreed in advance by

    Us. (viii) authorised account transactions or trades that You had disputed, or are disputing, based on the

    execution (or non-execution) of electronic transfers, trades or other verbal or written instructions or directions.

    (ix) any loss that was not incurred or did not commence during the Policy Period. (x) any Identity Theft occurrence for which You do not have a police reference number. (xi) any loss of money or stolen funds, including but not limited to securities and crypto currencies.

    PART 4: GENERAL EXCLUSIONS

    We will not cover losses under any section(s) of this Policy which are recoverable from any other source, or arising directly or indirectly from: 1. non-reporting of the Cyber-Bullying Incident or Identity Theft to the police and/or You do not have a

    police reference number. 2. concealment: coverage will be voided, whether before or after the loss, if You or Your Immediate

    Family have concealed or misrepresented any material fact or circumstance concerning this insurance or provided fraudulent information to Us.

    3. failure to comply with Your duties to Us: We have no duty to provide coverage under this Policy unless there has been full compliance with Your duties to Us.

    4. mass cyber-attack. We do not cover any loss caused by a mass, coordinated effort by a domestic or international actor intended to affect a large number of software or hardware users or members of a class or a group. Such acts can include coordinated malware attacks to individuals or businesses which You or Your Immediate Family may use for personal or professional reasons.

    5. a false report of Cyber- Bullying or Identity Theft. 6. Cyber-Bullying or Identity Theft by You or a family member or any person acting on behalf of

    You or a family member, whether acting alone or in collusion with others. 7. Cyber Extortion, Cyber Financial Loss or Cyber Disruption. 8. prior knowledge. We do not cover any loss arising out of any act or circumstance that could

    reasonably be expected to lead to a Claim under this Policy and which You or an Immediate Family member, first discovered, or were first made aware of, prior to the Commencement Date.

    9. any Pre-Existing Condition. 10. dishonest, fraudulent, criminal, malicious or intentional act, error or omission, or any intentional or

    knowing violation of the law by You or Your Immediate Family or Your relative. 11. activity intended to realise a benefit or financial gain to which You or a family member is not legally

    entitled. 12. any Cyber-Bullying Incident or an Identity Theft occurrence that occurs prior to the

    Commencement Date. 13. Any Claim in respect of Cyber-Bullying first notified to Us more than six (6) months after the

    occurrence of the Cyber-Bullying Incident. 14. Sanctions Exclusions Applicable to this Policy

    (a) This insurance does not apply to the extent that trade or economic sanctions or other laws or regulations prohibit Us from providing insurance, including, but not limited to, the payment of claims. All other terms and conditions of the Policy remain unchanged.

    (b) Chubb Insurance Hong Kong Limited is a subsidiary/branch of a US company and Chubb Limited, a NYSE listed company. Consequently, Chubb Insurance Hong Kong Limited is subject to certain US laws and regulations in addition to EU, UN and Hong Kong sanctions restrictions which may prohibit it from providing cover or paying claims to certain individuals or entities or insuring certain types of activities related to certain countries such as Cuba.

    PART 5: GENERAL CONDITIONS

    1. Assignment: No assignment of interest under this Policy shall be binding upon Us.

    2. Breach of Conditions: If You are in breach of any of the conditions or provisions of the Policy (including a Claim condition), We may, to the extent permitted by law, decline to pay a Claim.

    3. Cancellation:

    a. By Policyholder, no refund for any cancellation of this Policy. b. By Us, We may cancel the Policy at any time by giving the Policyholder at least seven (7) days

    prior notice in writing to the Policyholder address on file, and in accordance with the law, including where the Policyholder has: i. made a misrepresentation to Us before the Policy was entered into; ii. failed to comply with Policyholder’s duty of disclosure; iii. failed to comply with a provision of Policyholder’s policy including failure to pay the

    premium; iv. made a fraudulent Claim under the Policy or any other policy during the time the Policy

    has been in effect; v. failed to notify Us of a specific act or omission as required under the Policy; or vi. failed to tell Us about any changes in the circumstances of the risk during the Policy

    Period.

    In the event of cancellation under b. i, ii, iv-vi , We will return promptly any premium actually paid by the Policyholder.

    4. Changes in Policy: No change in this Policy will be valid unless agreed to in writing by Us. The requirements of any section of the Policy may not be deemed to be waived unless We agree to waive them in writing.

    5. Claims Investigation: In the event of a Claim, We may make any investigation We deem necessary and You shall co-operate fully with such investigation. Failure to co-operate with Our investigation may result in denial of the Claim.

    6. Clerical Error: Clerical errors by Us shall not invalidate an otherwise valid insurance nor continue an insurance which is not valid.

    7. Currency: The Benefit Amount stated in the Policy Schedule and this Policy are expressed in Hong Kong dollars. Notwithstanding the first sentence of this Policy, losses and/or benefits will be adjusted and paid in Hong Kong dollars or at Our option in the currency of the local country. When currency conversion is necessary when applying terms and conditions of the Policy, the rates of exchange to be adopted shall be those prevailing at the date of loss as per the exchange rate at the median level quoted on www.oanda.com.

    8. Duty of Disclosure: Before You enter into Your Policy with Us, You must disclose fully and faithfully all the facts which You know or ought to know, which are relevant to Us in providing insurance to You and the premium We calculate. If You do not do so, We reserve the right to cancel this insurance, or to refuse to pay Your Claim, or You may receive no benefit from the Policy.

    9. Entire Contract: This Policy, together with its endorsement(s), attachment(s) (if any), any application form completed by the Policyholder, together with any document(s) attached to that application form or referred to in it, comprise and constitute the entire contract of insurance. This Policy shall not be modified except by written amendment signed by Our authorised representative.

    10. Fraud or Mis-statement: Any false statement made by You or concerning any Claim shall result in Us having the right to void this Policy or repudiate liability under it.

    11. Geographical Limit and Operative Time: The geographical limit and operative time shall apply twenty-four (24) hours a day anywhere in the world during the Policy Period.

    12. Interpretation of this Policy: Please note that the English version of this Policy is the official version. This Policy has been provided to You in both English and Chinese languages for ease of reference only. The English version of the Policy will prevail if any dispute arises regarding the interpretation of any part of the policy.

    13. Jurisdiction: This Policy shall be governed and construed in accordance with the laws of Hong Kong. Subject to General Condition 17, any dispute under this Policy shall be settled in accordance with the laws of Hong Kong.

    14. Legal Action: No legal action shall be brought to recover on this Policy until sixty (60) days after We have been given written proof of loss. No such action shall be brought after three (3) years from the date of loss.

    15. Mediation: Any dispute or difference arising out of, or in connection with this Policy, must first be referred to mediation at the Hong Kong International Arbitration Centre (HKIAC) and in accordance with the HKIAC’s mediation rules. If the mediation is abandoned by the mediator or otherwise ends without the dispute or difference being resolved, the dispute or difference must be referred to, and resolved by, arbitration at the HKIAC and in accordance with the HKIAC’s domestic arbitration rules. If We refuse to pay any Claim under this Policy and a dispute or difference arising from that refusal is not referred to mediation and, if necessary, arbitration, within twelve (12) months from the date of refusal, any Claim against Us arising from that dispute or difference will be barred.

    16. Notice and Sufficiency of Claim: Written notice of Claim must be given to Us as soon as is reasonably possible and in any event within thirty (30) days from the first day of the event giving rise to the Claim under this Policy. Notice given by or on behalf of a Policyholder to Us with information sufficient to identify You shall be deemed valid notice to Us. We, upon receiving a notice of Claim, will provide to You such forms as are usually provided for filing proof of Claim. You shall, at Your own expense, provide such certificates, information and evidence to Us as it may from time to time require in connection with any Claim under this Policy and in the form prescribed. Proof of all Claim must be submitted to Us within one-hundred-eighty (180) days from the first day of the event giving rise to a Claim.

    17. Notice of Trust or Assignment And Third Party Rights: We shall not be bound or be affected by any notice of any trust, charge, lien, assignment or other dealing with or in relation to this Policy.

    A person who is not a party to this Policy contract shall have no right to enforce any of its terms, other than any rights conferred by law.

    18. Other Insurance: To the extent permitted by law, when other insurance applies to a covered loss, We will pay only in excess of the other insurance, limited to the indemnity being provided under Your Policy, unless that other insurance was specifically written as an excess over the indemnity provided in Your Policy.

    19. Premium: We has no liability under this Policy until the premium is paid. The premium is deemed to be fully earned on the date this Policy is purchased. No refund of premium shall be allowed once the Policy has been issued.

    20. Renewal of Your Policy: If the Policyholder continues to pay the premium, then, unless We give the Policyholder thirty (30) days written notice before the Renewal Date that We will not be renewing or will be amending the coverage, a Policy with the same terms and conditions shall automatically be issued to You for one (1) year from the Renewal Date.

    21. Right of Recovery: In the event payment is made by Us for a Claim whereby Policy liability is not engaged, We reserve the right to recover against You the full sum which was paid by Us to You for the Claim.

    22. Sum Insured under each Section: Once the Benefit Amount available to You under any Section of this Policy has been exhausted, that Benefit Amount will not be reinstated and We will have no further liability under that Section to You.

    PART 6: HOW TO MAKE A CLAIM

    • To make a Claim, please contact Chubb Assist at +852 2862 0164. Prior to that, You must report the relevant event to the police and provide Us with the police reference number.

    • You must supply on request all Your original invoices, receipts, and reports and any other document necessary to support Your Claim. You should keep copies of all documents that You send to Us.

    You must:

    • provide Us with information and documents within thirty (30) days of notifying the Claim to Us; and

    • give Us at Your, or Your legal representative’s expense, all medical and other certificates and evidence required by Us that is reasonably required to assess the Claim.

    • If You fail to comply with the terms and conditions of this Policy when making a Claim, We may be entitled to refuse to pay or reduce the Claim that may be payable.

    We may have You medically examined at Our expense when and as often as We may reasonably require after a Claim has been made. Processing and payment of claims

    • We will take all reasonable steps to pay a valid Claim promptly.

    • We will pay all Benefit Amount under Your Policy to You. In the event of Your death, We will pay the amount to Your estate.

    Making claims after Your Policy is cancelled

    • If Your Policy is cancelled, this does not affect Your right to make a Claim under Your Policy if the Event(s) occurred before the date of cancellation, except where there is cancellation by Us under Part 5 Clause 3. b.

    PART 7: PERSONAL INFORMATION COLLECTION STATEMENT

    We want to ensure that Our Policyholder and/or insured person(s) (“You / Your”) are confident that any personal data

    collected by Us is treated with the appropriate degree of confidentiality and privacy.

    This Personal Information Collection Statement sets out the purposes for which We collect and use personally identifiable information provided by You ("Personal Data"), the circumstances when Personal Data may be disclosed and information regarding Your rights to request access to and correction of Personal Data.

    (a) Purposes of Collection of Personal Data We will collect and use Personal Data for the purposes of providing competitive insurance products and services to You, including considering Your application(s) for any new insurance policies and administering policies to be taken out with Us, arranging the cover and administering and managing Your and Our rights and obligations in relation to such cover. We also collect the Personal Data to be able to develop and identify products and services that may interest You, to conduct market or customer satisfaction research, and to develop, establish and administer alliances and other arrangements with other organisations in relation to the promotion, administration and use of Our respective products and services. We may also use Your Personal Data in other ways with Your consent.

    (b) Direct marketing Only with Your consent, We may also use Your contact, demographic, policy and payment details to contact You with marketing information regarding Our insurance products by mail, email, phone or SMS.

    (c) Transfer of Personal Data Personal Data will be kept confidential and We will not sell Your Personal Data to any third party. We limit the disclosure of Your Personal Data but, subject to the provisions of any applicable law, Your Personal Data may be disclosed to:

    (i) third parties who assist Us to achieve the purposes set out in paragraphs a and b above. For example, We provide

    it to Our relevant staff and contractors, agents and others involved in the above purposes such as data processors,

    professional advisers, loss adjudicators and claims investigators, doctors and other medical service providers,

    emergency assistance providers, insurance reference bureaus or credit reference bureaus, government agencies,

    reinsurers and reinsurance brokers (which may include third parties located outside Hong Kong);

    (ii) Our parent and affiliated companies, or any company within Chubb local and outside Hong Kong;

    (iii) the insurance intermediary through which You accessed the system;

    (iv) provided to others for the purposes of public safety and law enforcement; and

    (v) other third parties with Your consent.

    With regard to the above transfers of Personal Data, where applicable, You consent to the transfer of Your Personal

    Data outside of Hong Kong.

    (d) Access and correction of Personal Data

    Under the Personal Data (Privacy) Ordinance ("PDPO"), You have the right to request access to and correction of Personal Data held by Us about You and We will grant You access to and correct Your Personal Data as requested by You unless there is an applicable exemption under the PDPO under which We may refuse to do so. You may also request Us to inform You of the type of Personal Data held by Us about You.

    第二部分:釋義

    在閣下的保單或承保表中,下列詞彙應具有以下涵義:

    1. 額外費用指閣下純粹及直接因網絡欺凌事件或身份盜竊而產生的費用,包括但不限於以下各項:

    (i) 補領費用(如適用);

    (ii) 交通費用;

    (iii) 長者及/或小童看護費用;

    (iv) 如無法透過電話或遠程連接方式來解決或減低因網絡欺凌事件或身份盜竊引致的影響,我們的資

    訊科技/技術支援安排額外技術支援而產生的費用。

    2. 保障額指承保表內所提及的任何金額。為免存疑,各項保障額均以年度計算,當賠償達致該限額,閣下

    於保障期間內將不再享有該項保障。

    3. 保障期間指本保單有效期內,自生效日起計連續十二(12)個曆月及其後每連續 12 個月的期間。

    4. 子女指(a)閣下同住;(b)未滿 18 歲;及(c)未婚的子女。

    5. 安達/我們╱本公司指安達保險香港有限公司。

    6. 索償指閣下就本保單的任何一項保障所提出的申請。

    7. 生效日指閣下的承保表內所列保障的生效日期。

    8. 網絡攻擊指以下各種惡意或欺詐行為:

    (i) 未經授權進入或使用閣下或閣下直系親屬的電子設備;

    (ii) 更改、破壞、損壞、篡改、濫用、盜取、刪除或損毀閣下或閣下直系親屬的電子設備;

    (iii) 將電腦病毒或有害代碼(包括勒索軟件)輸入或植入閣下或閣下直系親屬的電子設備;或

    (iv) 限制或阻止使用閣下或閣下直系親屬的電子設備,

    但網絡攻擊不包括以下非惡意行為:

    (i) 人為操作失誤或疏忽,包括閣下或閣下直系親屬對所用程式的選擇、參數設置出錯或任何不當單

    一干預或向閣下提供服務的第三方;

    (ii) 閣下或閣下直系親屬的電子設備在生產過程、升級過程或正常保養過程中安裝的合法電子代碼錯

    誤或因所安裝的代碼而引起的損毀;或

    (iii) 電子系統出現電源故障、電源波動或功率下降。

    9. 網絡欺凌指於受保期間內首先透過電子設備經網絡對閣下作出騷擾或恐嚇行為,包括誹謗、侵犯隱私或

    暴力威脅。

    10. 網絡欺凌事件指網絡欺凌的單一事件或多個相關事件。

    11. 網絡干擾指因網絡攻擊而引致的損失,導致閣下的:

    (i) 電子家居管理系統無法持續正常運作,從而:

    a) 導致閣下或閣下的直系親屬無法進入閣下的住所;或

    b) 導致閣下的住所不適宜居住;或

    (ii) 非主要性的於家中進行的業務。

    12. 網絡勒索指一項或多項類似或相關行為,對閣下或閣下直系親屬的電子設備直接發起的網絡攻擊,並

    威脅若不付款將作出以下行為:

    (i) 公佈、洩漏、散播、損毀或使用閣下或閣下直系親屬的個人資料;

    (ii) 導致閣下或閣下直系親屬擁有的電子設備發生故障;或

    (iii) 限制或禁止存取閣下或閣下直系親屬的電子設備或個人資料。

    13. 網絡經濟損失指符合以下描述的一項或多項類似或相關行為:

    (i) 源自網絡攻擊;及

    (ii) 在閣下或閣下的直系親屬並不知情的情況下,閣下或閣下的直系親屬於某金融機構的個人賬戶中

    的資金被盜。

    14. 醫生指合資格執業的醫師,在提供治療予他人時,獲所處司法管轄區的主管醫療當局已發出牌照,

    提供治療時已領有合資格執業的醫師牌照並提供其接受培訓的範圍內的醫療服務,惟有關人士不包

    括閣下、 閣下的直系親屬或閣下的親屬。

    15. 文件指政府機構、專上教育機構、金融機構、專業商會、公用事業提供者或服務提供者發出的文件或其

    他物件(當中載有閣下的身份證明資料),包括但不限於以下各項:

    (i) 護照;

    (ii) 駕駛執照;

    (iii) 信用卡、扣帳卡及銀行卡;

    (iv) 股票;

    (v) 香港身份證(「身份證」);

    (vi) 出生證明書;

    (vii) 銀行戶口資料;

    (viii) 保險文件 - 汽車保險、家居保險、旅遊保險及壽險;

    (ix) 水電煤帳戶號碼;或

    (x) 專業團體的會員號碼。

    16. 電子設備指任何連接私人網絡之設備,包括但不限於桌面電腦、手提電腦╱小型筆記本電腦、智能手機、

    平板電腦、個人行事曆及路由器。

    17. 受保事件指本保單「第三部分 - 保障摘要」中所載的事件。

    18. 身份盜竊指第三方在未經閣下同意的情況下盜用閣下的個人資料或文件以獲取商品、金錢或服務。

    19. 香港居民指香港永久性居民或持有有效工作許可證╱簽證的人士。

    20. 香港指中華人民共和國香港特別行政區。

    21. 直系親屬指保單持有人於本公司登記居住的地址,且與保單持有人同住住:(i)子女,(ii)配偶及╱或伴

    侶,及╱或(iii)父母。

    22. 初步諮詢服務指在發生網絡欺凌事件後由本公司特許服務提供者的醫生、註冊精神科醫生或註冊心理醫

    生於營業時間(上午 9 時 30 分至下午 5 時 30 分)為閣下提供一次輔導服務(最長一(1)小時)。

    23. 資訊科技╱技術支援指向閣下提供的全天候 24 小時熱線服務,以便閣下在遭受網絡欺凌事件或身份盜

    竊後與本公司特許服務提供者聯絡尋求協助。專家將透過電話向閣下提供指引或遠程連接閣下的電子設

    備,以協助消除或減輕受網絡欺凌事件或身份盜竊的影響程度。

    24. 法律費用當涉及:

    (i) 「第三部分 - 章節 A:網絡欺凌」中的保障時,要求本公司的特許服務提供者提供法律緩助,就

    網絡欺凌事件引起或與之有關的法律訴訟進行申索,或抗辯所產生並經本公司事先批准的合理法

    律費用及支出。

    (ii) 「第三部分 - 章節 B:身份盜竊」中的保障時,指要求本公司特許服務提供者提供法律緩助以達

    到以下目的所產生並經本公司事先批准的合理法律費用及支出:

    a) 阻止閣下的身份被進一步冒用;

    b) 恢復閣下的信用評級;

    c) 恢復閣下的銀行、按揭或貸款戶口;

    d) 更改或更正有關閣下真實姓名或身份的記錄;

    e) 促使更改或更正有關閣下真實姓名或身份的記錄;

    f) 就債權人、或收數公司、或代表債權人行事的其他實體就拖欠貨款、或服務費用、或拖欠

    貸款而針對閣下提起的任何訴訟進行抗辯;及╱或

    g) 撤銷任何針對閣下的民事錯判。

    25. 入息損失指於發生身份盜竊後:

    (i) 閣下因工作時間被合理佔用的實際個人入息損失;及╱或

    (ii) 閣下實際支取的有薪假期所對應的補償;

    其中,如上文(i)所述損失收入或如上文(ii)所述支取假期,純粹為:

    a) 阻止閣下的身份被進一步冒用;

    b) 恢復閣下的信用評級;

    c) 恢復閣下的銀行、按揭或貸款戶口;

    d) 更改或更正有關閣下真實姓名或身份的記錄;

    e) 促使更改或更正有關閣下真實姓名或身份的記錄;

    26. 伴侶指於受保事件發生時已與閣下同住三(3)個月或以上的事實伴侶。

    27. 個人資料指《個人資料(私隱)條例》(香港法例第 486 章)所界定的個人資料,包括電子設備或網

    上儲存的文本、圖像、影片及檔案。

    28. 保單指本文件及承保表,當中列明閣下與我們之間的保險合約。

    29. 保單持有人指在承保表內被列為保單持有人並且為香港居民及年滿十八(18)歲或以上的客戶。

    30. 受保期間指在閣下以年繳方式繳付保費,由生效日或最近一次續保日(以較後者為準)起計的一(1)年。

    31. 承保表指我們給予閣下的文件,當中載有我們向閣下提供的保障詳情。

    32. 已存在狀況指符合以下描述的任何疾病:

    (i) 於受保期間開始前, 閣下已就此疾病接受醫學治療、求診、諮詢或服用處方藥;

    (ii) 於受保期間開始前,醫生、註冊精神科醫生或註冊心理醫生就此疾病推薦醫療建議或治療;及╱

    (iii) 於受保期間開始前, 閣下已知悉或理應知悉。

    33. 基本法律諮詢指因網絡欺凌事件或身份盜竊發生後應立即採取的措施,且透過本公司法律援助服務熱線

    接受一(1)小時的法律諮詢服務。即使基本法律諮詢持續時間不足一(1)小時,亦以一次諮詢處理。基本

    法律諮詢服務於營業時間內(上午 9 時 30 分至下午 5 時 30 分)提供。

    34. 註冊精神科醫生指合資格執業的精神科醫生,在提供治療予他人時,獲所處司法管轄區的主管醫療當局

    已發出牌照,提供治療時已領有合資格執業的醫師牌照並提供其接受培訓的範圍內的醫療服務,惟有關

    人士不包括閣下、 閣下的直系親屬或閣下的親屬

    35. 註冊心理醫生指合資格執業的心理醫生,在提供治療予他人時,獲所處司法管轄區的主管醫療當局已發

    出牌照,提供治療時已領有合資格執業的醫師牌照並提供其接受培訓的範圍內的醫療服務,惟有關人士

    不包括閣下、 閣下的直系親屬或閣下的親屬。

    36. 續保日指在閣下每年繳付保費的情況下自生效日起計一(1)年及其後每一年的同一日。

    37. 補領費用指有關當局或機構向閣下補發文件所收取之實際費用。

    38. 創傷指經醫生、註冊精神科醫生或註冊心理醫生確診閣下因網絡欺凌事件而遭受的精神衰弱、精神痛苦

    或精神傷害。

    39. 創傷輔導指由本公司特許服務提供者或經本公司另行批准的註冊精神科醫生或註冊心理醫生提供的創傷

    輔導。

    40. 創傷輔導費用指閣下純粹及直接因接受本公司特許服務提供者的創傷輔導而產生的費用。

    41. 交通費用指閣下純粹及直接因網絡欺凌事件或身份盜竊而產生的合理交通費用,包括但不限於向醫生、

    註冊精神科醫生或註冊心理醫生求診、造訪警署╱當地主管機構、出席法庭聆訊、拜訪法律專家或技術

    專家。

    42. 您╱閣下指:

    (i) 如於承保表選擇為「個人保單」,則指保單持有人;或

    (ii) 如於承保表選擇為「家庭保單」,則指保單持有人或其直系親屬(如適用)。

    第三部分:保障摘要

    章節 A:網絡欺凌

    (a) 一旦發生網絡欺凌事件,我們的特許服務提供者將為您提供以下服務,以助減輕網絡欺凌事件的影響:

    (i) 基本法律諮詢;及╱或

    (ii) 資訊科技╱技術支援(最長一(1)小時);及╱或

    (iii) 初步諮詢服務。

    我們將補償閣下因接受初步諮詢服務而產生的額外費用(如有),惟須受本保單所載的所有條款及細則所約束,

    且以承保表所列之保障額為限:

    (b) 如網絡欺凌事件將導致或已經導致:

    (i) 閣下被不當解僱;及╱或

    (ii) 閣下被不當拘捕;及╱或

    (iii) 閣下被小學或中學、高等教育機構或專業團體或部門作出不當處分;及╱或

    (iv) 閣下遭受創傷;

    則除上文章節 A 所述的保障外,我們將在獲本公司事先批准後支付

    (i) 法律費用;及╱或

    (ii) 創傷輔導費用;及╱或

    (iii) 額外費用。

    章節 B:身份盜竊

    若您在受保期間內遭遇身份盜竊:

    (a) 我們的特許服務提供者將為您提供以下服務,以助減輕有關事件的影響:

    (i) 基本法律諮詢;及╱或

    (ii) 資訊科技╱技術支援(最長一(1)小時);及

    (b) 若有關事件未能解決,我們將支付純粹及直接因身份盜竊而產生的:

    (i) 法律費用,惟須獲本公司批准;

    (ii) 入息損失,參考閣下最近一個月的薪金總額或(若閣下為自僱人士) 則以閣下過去 12 個月的日

    均收入計算;及╱或

    (iii) 額外費用,

    惟須受本保單所載的所有條款及細則所約束,且以承保表所列之保障額為限。

    (c) 我們將向閣下支付純粹及直接因閣下的文件於受保期間內遺失或被盜而產生的補領費用。根據章節 B 支

    付的任何款項均以承保表所示的總保障額為限,並用於支付額外費用。

    (d) 我們將不會根據章節 B 提供或支付因下列直接或間接產生的索償提供任何保障:

    (i) 補領因閣下身份被冒用而獲得的任何項目或信用。

    (ii) 因任何業務目的或商業身份被盜用而導致的任何損失。

    (iii) 因閣下身份被盜用而購買、租賃或租用的任何車輛所引致的任何損失或責任,而閣下因此被或已

    被提出民事或刑事訴訟。

    (iv) 閣下基於商品或服務的質素提出異議的授權收費。

    (v) 閣下的身份被閣下的直系親屬盜用。

    (vi) 任何於保障期間內,超過承保表所列之保障額的任何索償。

    (vii) 未經我們事先同意的任何入息損失、法律費用或額外費用。

    (viii) 閣下因電子轉賬、買賣或其他口頭或書面指示或指令的執行(或不執行),且已經或正在提出異

    議的授權帳戶的交易或買賣。

    (ix) 任何並非於受保期間內產生或發生的損失。

    (x) 閣下未能就身份盜竊事件提供相關報案編號。

    (xi) 任何金錢損失或資金被盜,包括但不限於證券及加密貨幣。

    第四部分:一般不保事項

    本保單內的任何部分概不承保可從任何其他途徑追回或因以下各項直接或間接引致的損失:

    1. 閣下未有就網絡欺凌事件或身份盜竊事件向警方報案及或未能提供相關報案編號。

    2. 隱瞞:若閣下或閣下的直系親屬就有關本保險的重要事實或情況隱瞞實情或作出虛假陳述或向我們提供

    欺詐性資料,保障一律無效,不論發生於損失前或損失後。

    3. 閣下未能履行對我們的義務:除非閣下完全履行對我們的義務,否則我們沒有義務根據本保單提供保障。

    4. 大規模網絡攻擊。我們概不承保任何俱規模性、由本地或國際性的人仕聯合,以影響大量的軟件或硬件、

    或一群或一組人仕的損失為攻擊目標。此類行為包括對個人或業務進行聯合攻擊的惡意軟件,而閣下或

    閣下的直系親屬用作私人或專業理由。

    5. 虛報網絡欺凌或身份盜竊。

    6. 閣下或閣下家庭成員、或代表閣下或閣下家庭成員行事的任何人士作出的網絡欺凌或身份盜竊(不論是

    否單獨行動或與他人共謀)。

    7. 網絡勒索、網絡經濟損失或網絡干擾。

    8. 事先知情。我們概不承保因可合理地預料會導致之損失,而根據本保單提出索償,且閣下或直系親屬於

    生效日之前已發現或已知悉的任何行為,或情況所引致的任何損失。

    9. 任何已存在狀況。

    10. 閣下或閣下的直系親屬或閣下的親屬的不誠實、欺詐、犯罪、惡意或故意行為、錯誤或疏忽,或任何故

    意或明知故犯地違法行為。

    11. 實現閣下或家庭成員無權合法享有的利益或經濟得益的活動。

    12. 任何於生效日前已發生的網絡欺凌事件或身份盜竊事件。

    13. 任何就網絡欺凌事件發生後超過六(6)個月才首次通知我們的網絡欺凌事件提出的索償。

    14. 適用於本政策的經貿制裁規定

    (a) 當經貿制裁規定或其他法規禁止本公司提供保險(包括但不限於支付賠償金)時,本保險不適用。

    保單中的所有其他條款及細則保持不變。

    (b) 安達保險香港有限公司是一間美國公司Chubb Limited(一間紐約證券交易所上市公司)的子公

    司╱分公司。因此,除了歐盟、聯合國及香港的制裁限制外,安達保險香港有限公司還受某些美

    國法律和法規的約束,這些限制可能禁止其向某些個人或實體提供保障或支付賠償,或對涉及某

    些國家(例如古巴)的某類活動提供保險。

    第五部分:一般條款

    1. 轉讓:本保單的任何權益轉讓對我們並無約束。

    2. 違反條文:若閣下違反任何本保單的條文(包括索償條件),我們可在法律容許下的範圍內,拒絕支付

    索償。

    3. 註銷:

    a. 保單持有人提出註銷本保單不會獲得退還任何款項。

    b. 我們可根據法律,於任何時間向保單持有人的存檔地址發出最少提前七(7)日的書面通知註銷本保

    單:

    i. 閣下在簽訂本保單前向我們作出虛假陳述;

    ii. 閣下未能遵守保單持有人的披露義務;

    iii. 閣下未能遵守保單持有人保單的規定,包括未能支付保費;

    iv. 閣下在本保單生效期間,就閣下的保單或任何其他保單作出欺詐性索償;

    v. 閣下未能根據閣下保單的要求通知我們特定的作為或不作為;或

    vi. 閣下在保障期間內未能告知我們任何風險情況的變動。

    如發生 b. i, ii, iv-vi 的註銷情況,本公司將即時向保單持有人退還已付的保費。

    4. 保單變更:保單內的任何變更必須經我們的書面同意後方可生效。除非我們書面同意作出豁免,否則本

    保單的任何部份不得被視為豁免。

    5. 索償調查:於出現索償時,我們可能作出其視為必要的任何調查,閣下應全面配合該調查。倘閣下未能

    配合我們的調查,可能導致索償遭拒。

    6. 文書錯誤:我們的文書錯誤不應令生效的保單因此失效,亦不應令失效的保單因此生效。

    7. 貨幣:本保單所有列於承保表內的保障額以港幣計算。儘管本保單之賠償及/或保障將調整至港幣計算

    及付款,我們亦可選擇以當地貨幣算付。而相關之貨幣匯率則以損失當天列於網站 www.oanda.com 的

    匯率中位數換算。

    8. 披露義務:在閣下與我們簽訂保單前,閣下必須全面及如實地披露閣下知悉或應知悉的一切與我們向閣

    下提供保險及我們計算保費相關的事實。假如閣下未能作出披露,我們有權註銷本保險,或拒絕支付閣

    下的索償,或閣下可能不能得到本保單的保障。

    9. 完整合約:本保單,連同其批註、附件(如有)、經保單持有人填妥的任何申請表格連同該申請表格附

    帶或於申請表格提及(如有)的任何文件,組成及構成完整的保險合約。除經我們授權代表簽署的書面

    修訂外,本保單不得修改。

    10. 欺詐或錯誤陳述:由閣下作出或有關任何索償的任何虛假陳述均會導致我們有權廢除本保單或撤銷根據

    本保單提出的責任。

    11. 地域限制及施行時間:地域限制及施行時間適用於受保期間在世界各地的一日二十四(24)小時

    12. 本保單的詮釋:本保單以中英雙語撰寫;而英文版本為正式版本。如因對本保單內任何地方的詮釋而引

    起任何爭議,均以英文版本為準。

    13. 司法管轄權:本保單受香港法律約束並據其解釋。依從一般條款第 18 項,本保單的任何爭議均須根據

    香港法律解決。

    14. 法律訴訟:閣下在向我們發出書面損失證明後六十(60)天起,方可展開法律訴訟追討本保單的賠償。閣

    下於損失日期起三(3)年後不得提出有關訴訟。

    15. 調解:凡出現因本保單產生或與本保單有關的任何爭議或歧異,均須首先提交香港國際仲裁中心,並按

    香港國際仲裁中心的調解規則進行調解。假若調解員放棄調解,或調解以任何方式結束但未能解決爭議

    或歧異,則該爭議或歧異必須提交香港國際仲裁中心,並按香港國際仲裁中心的本地仲裁規則透過仲裁

    解決。倘若我們拒付根據本保單提出的任何索償,而因拒付產生的任何爭議或歧異並未於拒付日期起計

    十二(12)個月內提交調解及仲裁(如有必要),則因該爭議或歧異所引致而針對我們的任何索償將不獲

    受理。

    16. 索償通知及充份程度:索償的書面通知必須在合理的情況下盡早送交我們,且在任何情況下,須於導致

    根據本保單提出索償的受保事件發生之日起計三十(30)天內送交我們。由閣下或其代表或索償人送交我

    們且載有足以證明閣下身份的通知,應視為已有效送交我們的通知。我們於接獲索償通知後,將向閣下

    提供我們為備存索償證明而通常提供的該等表格。閣下或索償人須根據本保單及該等表格就有關提出任

    何索償的規定,以自費方式就此向我們提供有關證明書、資料及證據。所有索償的證明必須於導致索償

    的受保事件發生之日起計一百八十(180)天內送交我們。

    17. 信託或轉讓及第三方權利通知:我們不受任何信託、押記、留置權、轉讓或其他處理或與本保單有關的

    任何通知約束或影響。

    除非法律賦予任何權利,一名不屬於本保單當事人的人士不得享有執行本保單任何條款的權利。

    18. 其他保險:在法律許可的範圍內,如其他保險適用於受保的損失,我們將只支付其他保險不保障的數額,

    並受本保單的賠償限額限制,除非其他保險以書面訂明該保險是閣下保單所提供賠償的自付額。

    19. 保費:除非保費已支付,我們在本保單內並無任何責任。保費於保險購買日期已被視為完全收取。當保

    單繕發後,保費將不獲退還。

    20. 續保閣下的保單:若保單持有人持續支付保費,本保單將以相同的條款及細則於續保日當天自動續保一

    (1)年,除非我們於續保日前三十(30)天以書面通知保單持有人我們將終止本保單。

    21. 討回權利:如我們就沒有承保的索償作出賠償,我們保留權利向閣下討回我們就閣下獲得賠償的總額。

    22. 每一章節的保額:閣下根據本保單任何章節可獲賠償的保額一經耗盡,保障額將不會重置,且我們毋須

    根據該章節對該閣下承擔任何進一步責任。

    第六部分:如何索償

    • 如要提出索償,請致電 Chubb Assist 熱線+852 2862 0164。在此之前,閣下必須向警方報告相關事件

    並向我們提供警方參考編號。

    • 閣下必須提供所有正本之發票、收據、報告、以及其他與索償相關的文件。閣下亦應保留所有送交至我

    們的文件之副本。

    閣下必須:

    • 在提出索償前三十(30)天內通知我們及提供相文件;及

    • 向我們提供閣下或閣下的代表法律的費用,及我們要求的所有醫療和其他相關證明文件,以便我們合理地作

    出索償評估。

    • 如閣下在提出索償時未能遵守本保單的條款及細則,我們可能拒絕支付或減少可能需要支付的索償。

    我們可能會在閣下提出索償後向閣下要求進行合理的醫學檢查。

    支付索償

    • 我們將採取一切合理措施及時支付有效索償。

    • 我們將支付閣下保單內列明之保障額。若閣下不幸身故,我們將向閣下的遺產繼承人支付索償。

    閣下的保單於取消後提出索償

    • 除非我們根據第 5 部分 3.b 取消閣下的保單,否則如索償事件發生在取消生效日之前,這並不影響閣下

    根據本保單提出索償的權利。

    第七部分:個人資料收集聲明

    本公司 (「我們」) 竭力確保受保人(「閣下」)對我們在收集個人資料方面的信心,我們於處理任何已收集的個人資料均會採取適

    當的保密程度及以處理私隱手法採用資料。

    本個人資料收集聲明陳述我們收集及利用由閣下提供以識別 閣下個人的資料(「個人資料」)的目的、個人資料可能被公開的情況

    及 閣下有權要求查閱及更改個人資料的詳情。

    (a) 收集個人資料的目的

    我們收集及使用 閣下個人資料的目的,是為了向 閣下提供具優勢的保險產品及服務,包括用作考慮 閣下投保任何新的

    保險產品,及管理由我們提供的保單,安排保障,及執行和管理 閣下及我們在該等保障下的權利及責任。同時,我們亦

    會收集及使用 閣下個人資料以設計及識別能吸引 閣下的產品及服務,進行市場或顧客滿意度調查,及發展、建立及管理

    與其他機構就宣傳推廣、行政及使用我們相應的產品及服務的聯盟及其他計劃。在 閣下的同意下我們亦可能使用 閣下的

    個人資料作其他用途。

    (b) 直接促銷

    只會在得到閣下的同意,我們會使用 閣下的聯絡資料、人口統計資料、保單資料及繳費資料透過郵寄、電郵、電話或

    SMS 短訊方式聯絡 閣下以便提供有關我們的保險產品的宣傳推廣。如 閣下不希望接收到我們的宣傳推廣,請於下列方

    格內加上「✓」。

    (c) 個人資料的轉讓

    個人資料將予以保密,而我們亦絕對不會將 閣下的個人資料售賣給第三者。我們會對公開 閣下個人資料作出限定;但在

    任何適用的法例條文下, 閣下的個人資料可能:

    (i) 會被透露予我們相信必須達成以上第 a 及第 b 段所述目的之第三者。 例如:我們把 閣下的個人資料提供予我們相

    關的員工及承辦商、代理及其他涉及以上目的之人士,如處理數據的人士、專業人士、損失評估人員及索償調查員、

    醫生及其他醫療服務提供者、緊急支援服務提供者、保險局或信貸局、政府機構、分保人及分保經紀 (當中可能包括

    在香港以外的第三方);

    (ii) 會給我們的母公司及附屬聯營公司或安達在本地及海外的相關人員使用;

    (iii) 會提供予保險中介人, 閣下可以透過指定系統查閱有關資料;

    (iv) 會給予有關人士以維持公眾安全及法紀;及

    (v) 在 閣下同意下提供予其他第三者。

    就以上個人資料的轉移,如有適用的地方,則代表 閣下亦同意該資料在香港以外地方轉移。

    (d) 查閱及更改個人資料

    根據個人資料(私隱)條例, 閣下有權要求查閱及更改曾給予我們的資料,另除非在個人資料 (私隱)條例下有適用的豁免

    條款賦予我們可拒絕遵從,否則我們必須按 閣下的要求,給 閣下查閱及更改本身的個人資料。 閣下亦可向我們要求提

    供持有 閣下個人資料的類別。
