Notice

1. All duly completed entry forms and sketches must reach The Future Cut Ltd. office, no later than 15th January, 2020.

2. All garment designs must be original and have never been paraded before.

3. Shortlisted contestants will be asked to prepare two sets of fully accessorized garments based on their design sketches.

Each contestant should submit two designs for competition in the sequence below:

No. 1 Theme board with statement in English or Chinese explaining the design concept/inspiration,

No. 2 Mood board;

No. 3 Full sketches board, describe in detail the individual design, the colour, fabrics and details demonstration to be used with fabric

swatches attached.

4. Fabric swatches size should not be smaller than 80mm x 80mm.

5. Designs should all be shown in FULL COLOR on A3 size paper (420 x 297mm). Please do not submit 3D models/presentation sets.

6. The selected designers will be required to submit two sets of completed outfit for the competition on or before 15th August, 2020 (to be

confirmed). Outfits that do not meet required standard will be rejected.

7. All submitted show garments must be produced in accordance with the original submitted design sketches. Any significant

discrepancy from the original submitted designs will lead to disqualification.

1. 所有正式填寫的參賽表格和草圖必須在 2020 年 1 月 15 日之前到達「裁出天地有限公司」辦公室。

2. 所有服裝設計必須是原創的，參賽之前從未公開。

3. 每位參賽者須根據他們的設計草圖，準備兩套完全裝飾的服裝。

參賽者應按以下順序提交兩個參賽設計：

1. 主題板: 連同英文或中文陳述設計概念/靈感；

2. 情緒板；

3. 全草圖板，詳細描述了附加的織物樣本的個性化設計，顏色，織物和細節演示。

4. 織物樣本尺寸不應小於 80mm x 80mm。

5. 設計應全部在 A3 尺寸紙張（420 x 297 毫米）上以全彩色顯示。請不要提交 3D 型號/演示文稿集。

6. 選定的設計師將被要求在 2020 年 8 月 15 日之前提交兩套完整的裝備進行比賽（將確認）。不符合要求標準的服裝將被

拒絕。

7. 所有提交的演出服裝必須按照原始提交的設計草圖製作。任何重大的與原始提交的設計的差異將導致取消資格。

Terms and Conditions

1. Upon submitting an enrolment, the Applicants are deemed to have read, accepted and agreed to abide by the relevant rules of the

Competition, including these terms and conditions (the “Terms and Conditions”), Official Rules, Competition Rules, File Requirements,

Enrollment Procedures and any other rules and terms which the Organizer shall announce from time to time including during the Competition (collectively as “Regulations”).

2. Any fee paid by the Applicants in the Competition enrollment shall be made payable to the Organizer and shall not be refunded by the Organizer under any circumstances.

Eligibility

1. The Organizer reserves the right in its sole and absolute discretion to disqualify or exclude any legal or natural person from the Competition who:-

a. gives incorrect or incomplete personal data/information during enrollment and/or in the Competition; b. fails to register prior to the beginning of the Competition or fails to return to the specified venue at the prescribed time as announced

by the Organizer during the Competition;

c. breaches the Regulations; d. engages in any unlawful or other improper misconduct; or e. the Organizer reasonably believes to have committed any of the above.

Liability and indemnification

1. The Contestants are reminded to and shall remind its members to look after their own and companions’ personal belongings and their safety during the Competition. They shall show courtesy to the other contestants and members of the public during the Competition.

2. The Contestants hereby irrevocably consent to, and shall procure their members to, be captured in any photos and videos taken by the Organizer during the Competition or any Competition related or prize-related activity (“Photos and Videos”). The Contestants hereby give

an irrevocable and perpetual permission to the Organizer and/or its affiliated companies to use, edit, modify or reproduce, publish and/or

disseminate any and all Photos and Videos bearing the images of the Contestants and their members for any purposes, including but not

limited to advertising, publicity and promotional purposes or any other purposes as the Organizer considers appropriate, whether in Hong

Kong or other places, by any means, in any manner and on any platform that the Organizer thinks fit, without prior notice or consent nor

indemnity to the Contestants or their members.

3. The Contestants must ensure that they and their members shall abide by all instructions given by the Organizer or any of its authorized representatives during the Competition.

4. The Contestants warrant that they shall comply with all applicable laws and regulations, including but not limited to the Personal Data (Privacy) Ordinance (Cap. 486).

5. The Contestants and their members participate in the Competition in their own capacity and shall not be regarded as servants and/or agents and/or representatives of the Organizer by virtue of their participation of the Competition. The Contestants and their members shall be fully

liable for any acts, omission, conduct and/or negligence at all times (including but not limited to a breach of any of these Regulations) and

shall hold the Organizer harmless for any claims and liability arising thereof.

6. To the extent permitted by law, the Organizer shall not, in any circumstances, be liable to any direct or indirect loss, damage or personal injury caused by any Contestant or any of its members to himself/herself, other Contestants or any other third party. Notwithstanding

anything to the contrary, to the extent permitted by law, the Organizer’s total aggregate liability in contract, tort, equity or otherwise for any

loss or damage arising out of or in connection with this Competition shall be limited to HK$250.

7. In the event that the Organizer is/are held liable for any act, omission, conduct and/or negligence of any Contestant or any of its members and/or any claims for direct or indirect loss and damage, personal injuries, loss of profit or any other economic loss, that Contestant and

his/her parent or legal guardian shall fully indemnify and hold the Organizer harmless, together with any expenses, costs and further loss

and damage suffered or incurred by the Organizer.

Intellectual property rights of Entries

1. By submitting an Entry in the Competition, Contestants have given and shall procure their members to give an irrevocable perpetual non-exclusive license to the Organizer and/or its affiliated companies to use, edit, modify, reproduce, publish and/or disseminate the submitted

Entry for any purposes, including but not limited to advertising, publicity and promotional purposes or any other purposes as the Organizer

considers appropriate, whether in Hong Kong or other places, by any means, in any manner and on any platform that the Organizer thinks

fit, without prior notice or consent nor indemnity to the Contestants or their members.

2. Contestants warrant and guarantee that they and their members had not, have not and/or will not give the above license to any third party. In consideration for the prizes obtained in this Competition, Contestants further agree to, and procure their members to, assign the ownership

of all intellectual property rights of the Entry to the Organizer.

3. Contestants declare and warrant that they and their members are the sole owner of all copyrights of the Entry and to the best of their knowledge that no complaint or claim shall be arisen from any third party in respect of such Entry.

4. Contestants declare and warrant that the Entry (including photos or images, their titles and captions) are his/her/its member’s original work taken by them on the date of Competition.

5. Contestants declare the Entry does not: a. infringe or violate, or involving elements that infringe or violate applicable law and regulations, including but not limited to

crimes, violence, obscenity, indecency, libel, defamation, privacy invasion, or threatening;

b. infringe or violate any intellectual property rights, including but not limited to copyrights, patent, trademarks, trade names, trade secrets or other proprietary rights, held by any third party, regardless whether such rights are known to the Contestants;

c. contain any confidential information of any third party; d. contain an individual or group of persons, who does not give consent to take such pictures; e. contain personal data, as defined in the Personal Data (Privacy) Ordinance (Cap. 486) or the EU General Data Protection

Regulation;

f. contain viruses, corrupted files, or other materials that may cause damage to another's computer; or g. advertise or otherwise solicits funds or sales of goods or services.

6. If an Entry submitted by the Contestant infringes or violates any third party’s rights, including but not limited to intellectual property rights, and/or any legislation, law or regulation, the Organizer shall not be responsible for any consequences, legal or otherwise, thereto.

7. When the Organizer suffers from any claim, in contract or in tort, or investigations conducted by any competent authorities, by reason of any right allegedly subsist in the Entry or infringement of the same, Contestant agrees to hold the Organizer harmless and to indemnify the

Organizer in full for any direct or indirect loss and damage, economic loss, loss of reputation and/or any consequential loss and damage or

otherwise, together with any expenses, costs and further loss and damage suffered and incurred by the Organizer as a result of such claims

and investigations.

Personal Data

Statement of Purpose of Collection of Personal Data

Purpose of Collection

1. The personal data provided and collected will be used by the Organizer for one or more of the following purposes: a. For creation, processing and maintenance of the Applicants’ and their members’ enrollment records, the administration and

monitoring of the Competition, publication, printing, exhibition, display, promotion, issue or other purposes as the Organizer

deems appropriate in connection with the Entry submitted by the Contestant for the Competition;

b. For marketing of goods and/or services and/or upcoming events of the Organizer, the Organizer’s parent company and/or its respective subsidiaries and/or affiliated companies;

c. For statistical and research purposes; and d. Any other legitimate purposes as may be required, authorized by law.

1. The provision of personal data is voluntary. If Applicants do not provide sufficient information, Applicants may not be able to enroll the Competition. The Organizer will treat the personal data provided by Applicants in accordance with the Personal Data (Privacy) Ordinance (Cap. 486).

Classes of Transferees

1. The personal data Applicants provided are mainly for use within the Organizer but the information may also be disclosed by the Organizer to other third parties for the purposes stated above, if required.

Access to Personal Data

1. Applicants have the right to request access to and correction of your personal data under sections 18 and 22 and principle 6, schedule 1 of the Personal Data (Privacy) Ordinance (Cap.486). The Organizer may impose a fee for complying with a data access request.

Enquiries

1. Enquiries concerning the personal data provided, including the request for access and correction, should be addressed to the Organizer.

General

1. The Organizer shall have the sole and absolute right to cancel, adjourn or change any details including the date and venue of the Competition without prior notice to any parties.

2. The Organizer reserves the right to amend, delete, supplement and interpret the Regulations from time to time, and to adjudicate any dispute arising from the Competition. A decision of the Organizer shall be final and binding on all Applicants. The Applicants agree to, and

to procure their members to, abide by the decision of the Organizer.

3. A person who is not a party to these Terms and Conditions shall have no right at law to enforce these Terms and Conditions. 4. If any provision of these Terms and Conditions shall be held to be unlawful, void or unenforceable, the remaining Terms and Conditions

shall continue in full force and effect.

5. These Terms and Conditions and any dispute or claim arising out of or in connection with them or its subject matter shall be governed by and construed in accordance with laws of Hong Kong Special Administrative Region. The Applicants agree to submit to exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.

In case of any inconsistency between the English version and Chinese version of these Terms and Conditions, the English version shall prevail.

「條款及條件」

1. 申請者一旦遞交報名申請即表示申請者及/或其家長或監護人已閱讀、接受及同意遵守該比賽的有關規則，包括本條款及條

件(下文稱「條款及條件」)、參賽規則、比賽規則、檔案格式要求及報名流程、以及其他主辦機構將不時, 包括比賽當日公

佈的規則及條款(統稱「規則」)。

2. 所有比賽的報名費用將由申請者支付給主辦機構及在任何情況下概不退回。

參賽資格

1. 對有下述情況的法人或自然人，主辦機構保留其獨有及絕對酌情權以取消其參賽資格或拒絕接受其報名申請：

a. 在報名或比賽中提供不正確或不完整的個人資料；

b. 在比賽開始前沒有進行登記或沒有按照主辦機構於比賽中公佈的指定時間返回指定地點；

c. 違反規則；

d. 參與任何違法或其他不當行為；或

e. 主辦機構合理地相信該人仕已違反任何上述情況。

責任及補償

1. 參賽者須，及提醒其成員，在比賽期間注意自身及其同伴人身及財物安全，並應禮貌對待其他參賽者及公眾人士。

2. 參賽者同意，並須促使成員被攝於任何於比賽中、及任何與比賽或獎品有關的活動中拍攝的照片及短片(「照片及短片」)。

參賽者授予主辦機構及/或其關聯公司不可撤回及永久的許可，不論在香港或其他地區，以任何主辦機構認可之途經或方

式，在任何主辦機構認可之平台使用、編輯、修改、複製、出版及/或傳播任何及所有包含參賽者及其成員影像的照片及短

片作任何用途，包括廣告、宣傳、推廣或其他主辦機構認可之用途，而無須事先通知或徵得參賽者或其成員的同意或提供任

何彌償。

3. 參賽者須確保其及其成員遵守所有於比賽中由主辦機構或其授權代表不時給予之指示。

4. 參賽者保證遵守所有適用的法律和法規，包括但不限於個人資料(私隱)條例(第 486 章)。

5. 參賽者及其成員均以個人名義參加本比賽，其參賽身分不被視為主辦機構的員工及/或代理及/或代表。參賽者及其成員在比

賽期間的舉動、疏忽、行為及/或失職(包括但不限於違反規則)，一概由參賽者自行承擔所有法律責任，而參賽者有責任確保

主辦機構免除於任何因而引起的責任及申索。

6. 在法例最大容許下，在任何情況下，主辦機構對由參賽者或其成員對其自身、其他參賽者或其他第三方造成的任何直接或間

接的損失、損害及人身傷害概不負責。儘管有任何相反規定，在法律允許的範圍內，無論是依據契約法、侵權法、衡平法或

其他的法律基礎，主辦機構對於與本比賽產生或有關的任何損失或損害之總承擔責任上限為港幣二百五十元正。

7. 若主辦機構須對任何參賽者或其成員的舉動、疏忽、行為及/或失職，及/或任何直接或間接的損失及損害、人身傷害、利潤

損失或其他經濟損失承擔法律責任，參賽者及其家長或監護人需立即完全彌償主辦機構免受損害，並賠償其導致主辦機構一

切開支、費用及額外損失及損害。

＂作品＂的知識產權

1. 所有參賽作品一經提交，即參賽者已授予，並須促使成員授予主辦機構及/或其關聯公司不可撤回、永久及非專有的許可，

不論在香港或其他地區，以任何主辦機構認可之途經或方式，在任何主辦機構認可之平台使用、編輯、修改、複製、出版

及/或傳播提交的參賽作品作任何用途，包括廣告、宣傳、推廣或其他主辦機構認可之用途，而無須事先通知或徵得參賽者

或其成員的同意或提供任何彌償。

2. 參賽者保證其或其成員不曾、不會及/或不將，把以上之許可授予任何第三者。作為於比賽中獲得獎品的代價，參賽者進一

步同意，並須促使成員同意轉讓參賽作品之所有知識產權的擁有權予主辦機構。

3. 參賽者聲明及承諾其及其成員為參賽作品的唯一版權擁有人，並據參賽者所知沒有任何第三方會對該參賽作品有任何投訴或

申索。

4. 參賽者聲明及承諾參賽作品(包括相片或圖像、其名稱及說明) 為參賽者或其成員於比賽舉行日期之原創作品。

5. 參賽者聲明所有作品並不：

a. 抵觸或違反適用法律或規則，或涉及、觸犯或違反適用法律或規則的元素，包括但不限於犯罪、暴力、淫穢、不

雅、有中傷性、誹謗性、侵犯私隱或具威脅性的；

b. 侵犯或違反任何知識産權，包括但不限於由第三方持有的版權、專利權、商標、商號、商業秘密或其他財產權，不

論你對該些產權是否知情；

c. 包含任何第三方的機密資料；

d. 包含未經個別人仕或團體事先同意而拍攝的照片；

e. 包含個人資料（私隱）條例（第 486 章）或歐洲聯盟《通用數據保障條例》中定義為個人資料的內容；

f. 載有病毒、受感染檔案或其他有可能導致他人電腦受破壞的資料；或

g. 宣傳或兜售資金或商品售賣或服務。

6. 如參賽者提交之參賽作品侵犯或牴觸任何第三者的權利，包括但不只於知識產權，及/或違反任何法例、條例或規定，主辦

機構將不會負上任何法律或其他責任。

7. 若主辦機構因任何聲稱存在於參賽作品的權利或對其該等權利之侵犯，或因任何參賽者提交的資料，需面對任何基於合約

法、侵權法或其他的申索，或接受任何主管當局調查，參賽者有責任致使主辦機構免於任何因此而引起的申索及調查，並將

完全彌償主辦機構任何直接或間接的損失及損害、利潤損失、名譽損失及/或其他隨之發生的損失及損害等，更需賠償其導

致主辦機構面對該申索及調查的一切開支、費用及額外損失及損害。

個人資料收集個人資料的用途聲明

收集資料的目的

1. 申請者所提供或主辦機構收集的個人資料會被主辦機構用作下列一項或多項用途：

a. 製作、處理及保存申請者及其成員報名資料，比賽行政及管理，主辦機構認為適當而與參賽者提交作品有關的出

版，印刷，展覽，展示，推廣，發行或其他相關用途；

b. 主辦機構的母公司及/或其各間子公司和關聯公司提供的產品及/或服務及/或即將舉行的活動的銷售；

c. 進行統計及研究；及

d. 法律所需、容許的其他合法用途。

2. 提供個人資料屬自願性質。如申請者未能提供足夠資料，申請者或許不能參加比賽。主辦機構將根據個人資料

（私隱）條例處理申請者之個人資料。

資料轉交的類別

1. 申請者個人資料主要被主辦機構使用，如有需要，有關資料可能會被主辦機構透露予第三者以用作上述之用途。

查閱個人資料

1. 根據個人資料（私隱）條例第 1 8 及 2 2 條以及附表 1 第 6 項原則的規定，申請者有權查閱及改正有關個人資料。因應有

關要求，主辦機構可能向參賽者收取費用。

查詢

1. 有關查詢申請者的個人資料，包括查閱及改正，可向主辦機構查詢.

其他事項

1. 主辦機構對該比賽，包括日期及地點的取消、延期或其他細節的更改享有唯一及絕對的權利而無須事先通知任何人仕。

2. 主辦機構保留不時對上述之規則作出修改、刪除、增加及解釋的權利及對該比賽任何爭議的最終決定權。主辦機構之決定為

最終決定並對所有申請者有約束力。申請者同意，並須促使成員同意接受主辦機構的決定。

3. 任何非本條款及條件的契約方無權依法執行本條款及條件。

4. 如本條款及條件的任何條文被視為不合法、無效或不能強制執行，則本條款及條件的其餘條文將繼續具有效力及作用。

5. 本條款及條件應在各方面及由其產生之任何爭議或申索均受香港法例管轄及詮釋，並按香港法例執行，雙方不可徹回地將專

屬司法管轄權提交予香港法院。

如本條款及條件的中、英文版本出現歧義或不符時，概以英文版為準.
