Delegation of Functions by the Minister for Home Affairs, National Security and Law Enforcement

WHEREAS according to the Ministers (Delegation of Functions) Act (Cap. 324), a Minister may delegate to a Parliamentary Secretary assisting him in the performance of his duties any functions which in virtue of his office are conferred on him by or under any Law.

Now therefore, the Hon. Byron Camilleri, LLB, Dip. Not. Pub., LLD, MP, Minister for Home Affairs, National Security and Law Enforcement, hereby delegates to the Hon. Alex Muscat, B.Com. (Hons), Econ. (Melit.), MP, Parliamentary Secretary for Citizenship and Communities in the Ministry for Home Affairs, National Security and Law Enforcement, all those functions which by virtue of his office and of his Ministerial portfolio are vested in the Minister for Home Affairs, National Security and Law Enforcement by or under the Public Registry Act (Cap. 56), Articles 268, 271 and 278A of the Civil Code (Cap. 16), the Identity Cards and Other Identity Documents Act (Cap. 258), the Passports Ordinance (Cap. 61), the Maltese Citizenship Act (Cap. 188), the Fees Ordinance (Cap. 35) insofar as it refers to matters regulated by the said Principal Laws, and under the Subsidiary Legislation made under the said Principal Laws, as well as by the Identity Malta Agency (Establishment) Order (S.L 497 .07).

IN accordance with the provisions of subarticle (1) of article 26 of the General Elections Act (Cap. 354), a list is herewith being published which contains the names of registered voters in the Local Councils’ Electoral Register and the European Parliament Electoral Register who are to be deregistered as voters because they:

(a) Have not been effectively served with or collected the voting document pertaining to elections in the past 12 years; and

(b) Do not have a valid Identity Card or Residence Card.

The deregistration shall come into effect on the lapse of

one month from the date of this notice.

Local Notice to Mariners No. 22 of 2020

Submarine cable repairs in St Paul’s Bay

The Ports and Yachting Directorate, Transport Malta, notifies mariners and operators of vessels that repairs of the submarine cable in St Paul’s Bay are scheduled to commence with immediate effect, subject to weather.

The repair works will be carried out within the following positions, shown hatched on chart found on Transport Malta website (www.transport.gov.mt):

Divers with floating buoys will be engaged to carry out the repairs and will be assisted by vessel ‘Antonio Meucci’. This vessel will be left in position during the repair works and will be displaying the International Code Flag “A” and will be lit during the night.

Mariners are advised to navigate with caution at slow speed and give a wide berth when in the vicinity. They are to keep out of the abovementioned area.

Mariners and vessel operators are to comply with instructions and directions issued by Valletta Port Control (Valletta VTS) on VHF Channel 12 and any enforcement agency that will be in the area.

The Ports and Yachting Directorate, Transport Malta, notifies mariners that three (3) red Port Hand Buoys will be placed within the next 15 days, weather permitting, at the Ċirkewwa Ferry Terminal Berth 3 in the following positions:

These buoys mark the eastern limit of the 6m depth area between the jetty and shallower area as shown on chart found on Transport Malta website (www.transport.gov.mt).

Suspension of Traffic and Parking

The Mellieħa Local Council notifies that the areas mentioned hereunder will be classified as tow-zones and therefore the transit and parking of vehicles will be prohibited in:

Misraħ il-Parroċċa, on Sunday, 1st March, 2020, from 5.00 a.m. till 3.00 p.m.;

Offers are to be submitted by the completion of the detailed form available for download on the website (www.wasteservmalta.com) and hard copies may be obtained from SAWTP offices during office hours or downloaded from the company’s website.This procedure is intended to be repeated every month. The company wishes to advise bidders to view material prior to submitting offer.

Local bidders interested in taking part in such bids must provide relevant permits from the local authority (ERA) for the handling of specific waste streams. Foreign agencies which are interested in purchasing any of the items in the list, must provide the relevant authorisations from their country’s competent authorities and from the local authority (ERA) for the handling of specific waste streams. In any case, transport of waste must be carried out by a registered waste carrier and export of waste must be done according to the Trans Frontier Shipment of Waste Regulations.

Before any loading of positive fractions, full payment by the bidder, in accordance to the quantity being loaded, will be effected in favour of the company. Without prejudice to the aforesaid, the company may, at its sole discretion grant credit arrangements, to be determined by the company. In case of negative fractions, a credit period of 120 days will apply.

The closing date is Friday, 28th February, 2020, at 10.00 a.m. Sales order forms are to be deposited in the Tender Box at the SAWTP Head Office, in a sealed envelope addressed as ‘Sales of Recyclables’ or submitted online on (https://www.wasteservmalta.com/sales).

By means of a decree given by the Court of Appeal (Appeals) (Malta Arbitration Centre) in the records of the Application in the names Hackenbruch Susanna et vs Sammut Emmanuel et, Application Number 80/18 LM, on the 17th January, 2020, the following publication was ordered for the purpose of service of the respondent Ramon Fenech, in terms of Article 187(3) et sequitur of Cap. 12.

By means of an Application filed in the Court of Appeal (Appeals) following the decision of the Malta Arbitration Centre, Decision Number Arb C 4752/2016, in the names Susanna Hackenbruch (ID 61136A) and Albert Mamo (ID 277145M) vs Emanuel Sammut (ID 711259M) and Ramon Fenech (ID 0489683M), decided 14th June, 2018, the applicant Susanna Hackenbruch (ID 61136A) and Albert Mamo (ID 277145M) respectfully pleaded:

The Demand of the Appellant Plaintiffs

2. That the present dispute relates to a cause brought by the appellants before the Arbitration Tribunal to contest measures taken by the administration of the condominium, or rather the block of apartments called ‘Centre Court 4’, Triq il-Faxxina, Swieqi, in which block the applicant appellants are the owners of the apartments where they reside as well as to contest the change of the regulations of the same condominium.

3. That in virtue of their demand filed before the Malta Arbitration Centre the appellants therein plaintffs premised the following:

Award and Appeal

6. That by means of an award dated 14th June, 2018, after examining the demands and the pleas and an analysis of the provisions which create the regime of mandatory arbitration of Cap. 398 of the Laws of Malta, the Arbitration Tribunal decided that none of the appellant’s demands figures under the regime of mandatory arbitration and thus declare itself incompetent to decide on the merit of the demands.

8. That the grievance of the applicant appellants is clear and manifest and as shall be exposed and elaborated better further on in this application consists in a wrong interpretation of the law by the Arbitration Tribunal.

L-aggravju tar-rikorrenti appellanti

8. Illi l-aggravju tar-rikorrenti appellanti huwa ċar u manifest u kif ser jiġi espost u elaborat aħjar aktar ’il quddiem f’dan ir-rikors jikkonsisti f’interpretazzjoni ħażina tal-liġi mit-Tribunal tal-Arbitraġġ.


Appeal from measures taken by the Administrator

9. That the complaints brought forward by the appellants relate to measures taken by the administrator from which measures Article 19(3) of Cap. 398 provide a remedy by means of action brought before the Tribunal of Arbitration.

10. That in the award abovementioned after considering the provisions of Article 19 of the Act relating to Condominia, the Arbitration Tribunal declared that whilst there is ambiguity in the law in the sense that it is not clear whether it is creating a right of arbitration in the circumstances contepmplated by the article itself, the article does not create a basis of mandatory arbitration competence of itself, consequently the Tribunal declared that it is not competent to decide the complaint of the appellants.

Contestation of the regulations of Condominium

19. That without prejudice to the premised the fifth complaint of the appellants falls also under article 24(7) of Chapter 398 of the Laws of Malta:

‘Every dissident condominus can contest those regulations or part of them for the reason that they are against the law or that they are not reasonable or that they are oppressive and can refer the dispute of that contestation to arbitration’.

Conclusion

Thus in the light of the submissions above exposed as well as shall result during the verbal submissions in the audience appointed for the appeal de quo the appellants are respectfully praying that this Honourable Court of Appeal saving any necessary declaratioin it deems opportune and necessary in the circumstances uphold the present appeal by revoking and cancelling the award given by the Arbitration Tribunal in regard to the competence of the arbitration in its entirety and declare that the Arbitration Tribunal is competent to determine the complaints of the appellants.

With costs of both instances against the respondent defendant.

By means of a Notice issued by the Registy Superior Courts, on the 3rd December, 2019, and whereas the written proceedings in the cause before the Court of Appeal betwen Susanna Hackenbruch and Albert Mamo vs Emanuel Sammut and Ramon Fenech have been closed the Court, fixed the hearing of this cause on Friday, seventeenth (17) January, 2020, at 10.30 a.m., and put off to the 6th March, 2020, at 10.45 a.m.

Appell minn miżuri meħuda mill-Amministratur

9. Illi l-ilmenti mressqa mill-appellanti jirrigwardaw miżuri meħuda mill-amministratur, minn liema miżuri l-Artikolu 19(3) tal-Kap. 398 jipprovdi rimedju permezz ta’ azzjoni miġjuba quddiem it-Tribunal tal-Arbitraġġ.

10. Illi fil-lodo suċitat wara li kkunsidra d-dispożizzjoni tal-Artikolu 19 tal-Att dwar il-Condominia, it-Tribunal tal-Arbitraġġ iddikjara illi filwaqt li ‘hemm ambigwità fil-liġi fis-sens li mhux eżattament ċar jekk dan l-Artikolu qed joħloq dritt ta’ arbitraġġ fiċ-ċirkustanzi kontemplati mill-artikolu stess, l-artikolu ma joħloqx bażi ta’ kompetenza arbitrali mandatorja minnu nnifsu’. Konsegwentement it-Tribunal iddikjara ruħu mhux kompetenti biex jiddeċiedi l-ilment tal-appellanti.

Kontestazzjoni tar-regoli tal-Kondominju

19. Illi mingħajr preġudizzju għall-premess il-ħames ilment tal-appellanti jinkwadra ruħu wkoll taħt l-Artikolu 24 (7) tal-Kapitolu 398 tal-Liġijiet ta’ Malta:

‘Kull condominus dissidenti jista’ jikkontesta dawk ir-regoli jew xi parti minnhom għar-raġuni li dawn ikunu jmorru kontra l-liġi jew li ma jkunux raġonevoli jew li jkunu oppressivi u jista’ jirreferi l-kwistjoni ta’ dik il-kontestazzjoni għall-arbitraġġ.’

B’digriet mogħti mill-Qorti Ċivili Prim’Awla fis-7 ta’ Ottubru, 2019, fuq rikors ta’ Joseph Farrugia (KI 732856M), ġie ffissat il-jum tal-Ħamis, 26 ta’ Marzu, 2020, fl-għaxra u nofs ta’ filgħodu (10.30 a.m.) għall-bejgħ bl-irkant li għandu jsir f’Kamra numru 78, biswit l-Arkivju, Livell -1, Qrati tal-Ġustizzja, Triq ir-Repubblika, Il-Belt Valletta tal-fond hawn taħt deskritt.

Il-fond uffiċjalment immarkat bin-numru tlieta u ħamsin (53) ġja tletin (30) fi Triq il-Kbira, Iż-Żurrieq liberu u frank bi drittijiet u l-pertinenzi kollha tiegħu u bil-pussess battal garantit u żewġt ikmamar waħda fuq l-oħra li ġew segregati mill-fond numru disgħa u għoxrin (29) fi Triq il-Kbir, Iż-Żurrieq li huma kontigwi għal beni tal-kompratur skont il-kuntratt tad-disgħa u għoxrin t’Ottubru elf disgħa mija ħamsa u tmenin (29.10.1985). Il-fond jinkorpora fih binja ta’ tliet sulur b’ċirka mija sebgħa u sebgħin metru kwadru (177m²) stmat li jiswa sitt mija ħamsa u tletin elf ewro (€635,000).

L-imsemmi fond huwa proprjetà ta’ Żurrieq Football Club.

By decree given by the Civil Court, First Hall on 7th October, 2019, on the application of Joseph Farrugia (ID 732856M), Thursday, 26th March, 2020, at half past ten in the morning (10.30 a.m.), has been fixed for the sale by auction to be held in Room number 78, near the Archives, Level -1, Courts of Justice, Triq ir-Repubblika, Valletta of the following property.

The tenement officially numbered fifty-three (53) previsouly thirty (30) in Triq il-Kbira, Żurrieq free and unencumbered with all its right and appurtenances and with vacant possession and two single rooms one on another that were taken from tenement numbered twenty-nine (29) in Triq il-Kbira, Żurrieq, also are adjacent to the property of the buyer as per contract dated twenty-nine of October one thousand nine hundred and eighty-five (29.10.1985). The tenement incorporates three levels superficially measuring one hundred and seventy-seven square metres (177m²) valued six hundred and thirty-five thousand euro (€635,000).

The said tenement is the property of Żurrieq Football Club.

N.B. The said tenement will be sold as described in the acts of judicial sales number 51/2019.
