INTRODUCTION - The institution of Lokayukta or ombudsman as it is

known in other countries has been constituted under an Act of State Legislature in the

year 2003 to provide the common man a relatively less expensive easier less time-

consuming and less complicated means for redressal of grievances against any public

servant of Haryana State

The institution of Lokayukta is a quasi-judicial body committed to enquire into

problems faced during peoples interaction with public servant and also complaints of

corruption andor misuse of official position relating to public servant of Haryana It is a

step to ensure a greater degree of accountability in Governance empowering the common

man in the spirit of the Directive Principles enshrined in the Constitution

Main Characteristics Of Lokayukta Organization and Rights Of Common Man in

respect of this Organization as enshrined in the Haryana Lokayukta Act 2002 and

Haryana Lokayukta (Functions Powers Inquiry and Investigation) Rules 2008

(1) Definition of Public Servant has been considerably broadened and the following

office bearers have been termed as public servants-

(Sec a) Chief Minister Ministers amp MLAs

2(m)

b) Any office bearer in Govt Deptts State Boards amp Corporations

Companies and Cooperative Societies

c) Any Office bearer in Municipal Bodies amp Panchayat Samities

d) VC Pro VC and Registrar in Universities

e) Office Bearers in any Statutory or Non-Statutory Bodies registered or

constituted by State of Haryana

(Sec 10) (2)(i) Any aggrieved person himself or if he is dead or unable to act

himself any person on his behalf who in law represents his estate or is

permitted to act on his behalf may make a complaint on his behalf

(ii) Any person may make a complaint wherein an allegation against

a public servant is levelled in respect of following-

(Sec 2(b)(i) (a) That the public servant has knowingly and intentionally abused his

position as such to obtain undue gain or favour to himself or to any

other person or to cause undue hardship or harm to any other person

(Sec 2b(ii) (b) That the public servant has discharged his official duties having been

influenced by personal interest or improper or corrupt motives

(Sec 2b(iii) (c) That the public servant is guilty of corruption and lacks the integrity

in his capacity as such

(Sec 2b(iv) (d) That the public servant possesses pecuniary resources or property

disproportionate to his known source of income and such pecuniary

resources or property is held by the public servant personally or by any

member of his family or by some other person on his behalf

Sec10(2) amp 3 The complainant is required to mention his name full address name

Rule 3

and official designation address of public servant against whom

complaint is preferred alongwith allegation(s)grievance(s) against such

public servant in detail The complainant is also required to submit an

affidavit in support of his complaint made by him

Sec8(1) 4 The Lokayukta may on receipt of a reference from Govt proceed to

enquire into allegations or the grievances made against a public servant

Sec 13 5 Lokayukta while investigating the allegations contained in public

complaint against a public servant may summon and examine any record

of any public office of State of Haryana or summon and examine any

person Lokayukta may require any person to divulge any information or

to produce any document for the purpose of any enquiry or

investigation For this purpose he enjoys vast powers of a civil court

under the provisions of CPC 1908 namely-

(i) Summoning and enforcing the attendance of any person and

examining him on oath

(ii) requiring the discovery and production of any document

(iii) receiving evidence on affidavits

(iv) requisitioning any public record or copy thereof from any court

or office and

(v) issuing commissions for the examination of witnesses or

documents

Rule 8(2) 6 During the course of preliminary enquiry or investigation if any

person appears before Lokayukta for giving evidence or to produce any

document he would be given a certificate to this effect by Lokayukta

office If such a person is employed in private service he or she shall

not be deemed absent from duty during this period Such person would

be given travelling expenditure incurred and subsistence allowance as

may be permitted by the Lokayukta The person who is not in private

service shall also be entitled to actual travelling expenditure incurred by

him and subsistence allowance If such person is a public servant he

shall be treated as on duty on that day or date and he shall be entitled to

claim TADA from his Deptt

Act 12(3) 7 Subject to provisions of RTI Act 2005 every investigation shall be

conducted in private by Lokayukta and identity of complainant and

public servant affected by investigation shall not be disclosed to public

or press

Sec11 8 On receipt of a public complaint the Lokayukta may hold a

preliminary enquiry to ascertain whether the complaint deserves to be

investigated If no sufficient grounds for conducting investigation are

ascertained the matter will be closed and complainant informed

accordingly

Sec10(3) 9 Even a person lodged in police custody jail or in any asylum or

custodial place may write a letter to Lokayukta and it would be duty of

the Police Officer Incharge of such Jail Asylum or Custodial place to

immediately forward that letter to Lokayukta unopened and Lokayukta

may if he is satisfied treat that letter as a complaint

Sec18(i) 10 Lokayukta may issue interim direction to any of public servants if

he so deems fit to avoid grave injustice on receipt of a complaint

Sec14 (1-(b) 11 Lokayukta may enter upon any land and survey demarcate or

prepare the map of the same

Sec16 12 Any person found willfully and maliciously making false and

vexatious complaint shall be punished with rigorous imprisonment

which may extend to three years or with fine which may extend to ten

thousand rupees or both

Sec17(1) 13 If after inquiry in respect of a complaint the Lokayukta is

satisfied-

(a) that no allegation or grievance has been substantiated he shall close

the case and intimate the competent authority concerned accordingly

(b) that all or any of the allegations or grievances have or has been

substantiated either wholly or partly he shall by report in writing

communicate his findings appropriate recommendations and

suggestions to the competent authority and intimate the complainant and

the public servant concerned about his having made the report

Sec17(2) 14 The Competent authority is duty bound to examine and to inform

the Lokayukta of the action taken against the public servant on his report

within a period of three months

Sec17(3)amp(4) 15 Lokayukta presents a consolidated annual report of his activities to

the Governor and the Governor in turn causes the same to be placed

before State Legislature so that public representatives as well as public

at large may come to know the activities of Lokayukta as well as action

recommended against guilty public servants and follow-up action taken

thereupon

Rule 4 16 The complainant shall have to pay a fee of Rs one thousand in the

form of Judicial Stamps (Court fee stamps) for lodging a complaint

Provided that the Lokayukta may on an application made by the

complainant in his discretion waive the requirement of payment of fee

in appropriate cases

Sec8(2) 17 The Lokayukta may enquire into any act or conduct of any person

other than a public servant if the same is necessary in his view for

proper enquiry into allegation of misconduct against a public servant

provided that the Lokayukta shall give such person reasonable

opportunity of being heard and to produce evidence in his defence

Rule 7 18 While conducting a preliminary inquiry or an investigation the

Lokayukta may engage any agency or person or professionals including

subject experts etc on payment of a reasonable fee with the approval of

the Government

19 Any citizen can obtain any information regarding Lokayukta

organization under the provisions of RTI Act 2005 The Under

Secretary and Superintendent Oo Lokayukta have been designated as

State Public Information Officer and Asstt State Public Information

Officer respectively in this respect On being dissatisfied in this regard a

citizen can appeal to ldquoThe Secretary Oo Lokayukta who has been

designated as First Appellate Authority under the RTI Act 2005

Main Characteristics Of Lokayukta Organization and Rights Of Common Man in

respect of this Organization as enshrined in the Haryana Lokayukta Act 2002 and

Haryana Lokayukta (Functions Powers Inquiry and Investigation) Rules 2008

(1) Definition of Public Servant has been considerably broadened and the following

office bearers have been termed as public servants-

(Sec a) Chief Minister Ministers amp MLAs

b) Any office bearer in Govt Deptts State Boards amp Corporations

Companies and Cooperative Societies

c) Any Office bearer in Municipal Bodies amp Panchayat Samities

d) VC Pro VC and Registrar in Universities

e) Office Bearers in any Statutory or Non-Statutory Bodies registered or

constituted by State of Haryana

(Sec 10) (2)(i) Any aggrieved person himself or if he is dead or unable to act

himself any person on his behalf who in law represents his estate or is

permitted to act on his behalf may make a complaint on his behalf

(ii) Any person may make a complaint wherein an allegation against

a public servant is levelled in respect of following-

(Sec 2(b)(i) (a) That the public servant has knowingly and intentionally abused his

position as such to obtain undue gain or favour to himself or to any

other person or to cause undue hardship or harm to any other person

(Sec 2b(ii) (b) That the public servant has discharged his official duties having been

influenced by personal interest or improper or corrupt motives

(Sec 2b(iii) (c) That the public servant is guilty of corruption and lacks the integrity

in his capacity as such

(Sec 2b(iv) (d) That the public servant possesses pecuniary resources or property

disproportionate to his known source of income and such pecuniary

resources or property is held by the public servant personally or by any

member of his family or by some other person on his behalf

Sec10(2) amp 3 The complainant is required to mention his name full address name

and official designation address of public servant against whom

complaint is preferred alongwith allegation(s)grievance(s) against such

public servant in detail The complainant is also required to submit an

affidavit in support of his complaint made by him

Sec8(1) 4 The Lokayukta may on receipt of a reference from Govt proceed to

enquire into allegations or the grievances made against a public servant

Sec 13 5 Lokayukta while investigating the allegations contained in public

complaint against a public servant may summon and examine any record

of any public office of State of Haryana or summon and examine any

person Lokayukta may require any person to divulge any information or

to produce any document for the purpose of any enquiry or

investigation For this purpose he enjoys vast powers of a civil court

under the provisions of CPC 1908 namely-

(i) Summoning and enforcing the attendance of any person and

examining him on oath

(ii) requiring the discovery and production of any document

(iii) receiving evidence on affidavits

(iv) requisitioning any public record or copy thereof from any court

or office and

(v) issuing commissions for the examination of witnesses or

documents

Rule 8(2) 6 During the course of preliminary enquiry or investigation if any

person appears before Lokayukta for giving evidence or to produce any

document he would be given a certificate to this effect by Lokayukta

office If such a person is employed in private service he or she shall

not be deemed absent from duty during this period Such person would

be given travelling expenditure incurred and subsistence allowance as

may be permitted by the Lokayukta The person who is not in private

service shall also be entitled to actual travelling expenditure incurred by

him and subsistence allowance If such person is a public servant he

shall be treated as on duty on that day or date and he shall be entitled to

claim TADA from his Deptt

Act 12(3) 7 Subject to provisions of RTI Act 2005 every investigation shall be

conducted in private by Lokayukta and identity of complainant and

public servant affected by investigation shall not be disclosed to public

or press

Sec11 8 On receipt of a public complaint the Lokayukta may hold a

preliminary enquiry to ascertain whether the complaint deserves to be

investigated If no sufficient grounds for conducting investigation are

ascertained the matter will be closed and complainant informed

accordingly

Sec10(3) 9 Even a person lodged in police custody jail or in any asylum or

custodial place may write a letter to Lokayukta and it would be duty of

the Police Officer Incharge of such Jail Asylum or Custodial place to

immediately forward that letter to Lokayukta unopened and Lokayukta

may if he is satisfied treat that letter as a complaint

Sec18(i) 10 Lokayukta may issue interim direction to any of public servants if

he so deems fit to avoid grave injustice on receipt of a complaint

Sec14 (1-(b) 11 Lokayukta may enter upon any land and survey demarcate or

prepare the map of the same

Sec16 12 Any person found willfully and maliciously making false and

vexatious complaint shall be punished with rigorous imprisonment

which may extend to three years or with fine which may extend to ten

thousand rupees or both

Sec17(1) 13 If after inquiry in respect of a complaint the Lokayukta is

satisfied-

(a) that no allegation or grievance has been substantiated he shall close

the case and intimate the competent authority concerned accordingly

(b) that all or any of the allegations or grievances have or has been

substantiated either wholly or partly he shall by report in writing

communicate his findings appropriate recommendations and

suggestions to the competent authority and intimate the complainant and

the public servant concerned about his having made the report

Sec17(2) 14 The Competent authority is duty bound to examine and to inform

the Lokayukta of the action taken against the public servant on his report

within a period of three months

Sec17(3)amp(4) 15 Lokayukta presents a consolidated annual report of his activities to

the Governor and the Governor in turn causes the same to be placed

before State Legislature so that public representatives as well as public

at large may come to know the activities of Lokayukta as well as action

recommended against guilty public servants and follow-up action taken

thereupon

Rule 4 16 The complainant shall have to pay a fee of Rs one thousand in the

form of Judicial Stamps (Court fee stamps) for lodging a complaint

Provided that the Lokayukta may on an application made by the

complainant in his discretion waive the requirement of payment of fee

in appropriate cases

Sec8(2) 17 The Lokayukta may enquire into any act or conduct of any person

other than a public servant if the same is necessary in his view for

proper enquiry into allegation of misconduct against a public servant

INTRODUCTION - The institution of Lokayukta or ombudsman as it is

known in other countries has been constituted under an Act of State Legislature in the

year 2003 to provide the common man a relatively less expensive easier less time-

consuming and less complicated means for redressal of grievances against any public

servant of Haryana State

investigated If no sufficient grounds for conducting investigation are

ascertained the matter will be closed and complainant informed

accordingly

Sec10(3) 9 Even a person lodged in police custody jail or in any asylum or

custodial place may write a letter to Lokayukta and it would be duty of

the Police Officer Incharge of such Jail Asylum or Custodial place to

immediately forward that letter to Lokayukta unopened and Lokayukta

may if he is satisfied treat that letter as a complaint

Sec18(i) 10 Lokayukta may issue interim direction to any of public servants if

he so deems fit to avoid grave injustice on receipt of a complaint

Sec14 (1-(b) 11 Lokayukta may enter upon any land and survey demarcate or

prepare the map of the same

Sec16 12 Any person found willfully and maliciously making false and

vexatious complaint shall be punished with rigorous imprisonment

which may extend to three years or with fine which may extend to ten

thousand rupees or both

Sec17(1) 13 If after inquiry in respect of a complaint the Lokayukta is

satisfied-

(a) that no allegation or grievance has been substantiated he shall close

the case and intimate the competent authority concerned accordingly

(b) that all or any of the allegations or grievances have or has been

substantiated either wholly or partly he shall by report in writing

communicate his findings appropriate recommendations and

suggestions to the competent authority and intimate the complainant and

the public servant concerned about his having made the report

Sec17(2) 14 The Competent authority is duty bound to examine and to inform

the Lokayukta of the action taken against the public servant on his report

within a period of three months

Sec17(3)amp(4) 15 Lokayukta presents a consolidated annual report of his activities to

the Governor and the Governor in turn causes the same to be placed

before State Legislature so that public representatives as well as public

at large may come to know the activities of Lokayukta as well as action

recommended against guilty public servants and follow-up action taken

thereupon

Rule 4 16 The complainant shall have to pay a fee of Rs one thousand in the

form of Judicial Stamps (Court fee stamps) for lodging a complaint

Provided that the Lokayukta may on an application made by the

complainant in his discretion waive the requirement of payment of fee

in appropriate cases

other than a public servant if the same is necessary in his view for

proper enquiry into allegation of misconduct against a public servant

provided that the Lokayukta shall give such person reasonable

opportunity of being heard and to produce evidence in his defence

Rule 7 18 While conducting a preliminary inquiry or an investigation the

Lokayukta may engage any agency or person or professionals including

subject experts etc on payment of a reasonable fee with the approval of

the Government

19 Any citizen can obtain any information regarding Lokayukta

organization under the provisions of RTI Act 2005 The Under

Secretary and Superintendent Oo Lokayukta have been designated as

State Public Information Officer and Asstt State Public Information

Officer respectively in this respect On being dissatisfied in this regard a

citizen can appeal to ldquoThe Secretary Oo Lokayukta who has been

designated as First Appellate Authority under the RTI Act 2005
