أوال : ا الشروط العامة

2014/2015 ـ 12مناقصة رقم تحديث وتطوير أجهزة شبكة المعلومات ببلدية الكويت

( الغرض من تقديم العطاء 1 مادة )

.تحديث وتطوير أجهزة شبكة المعلومات ببلدية الكويت

( معلومات عن مقدمي العطاءات 2 مادة )

يشترط فيمن يتقدم بعطائه في هذه المناقصة اآلتي : أن يكون كويتيا تاجرا فردا كان أم شخصا اعتباريا ومتخصصا في أعم��ال موض��وع(1

المناقصة ويجوز أن يكون أجنبيا بشرط أن يكون له شريك أو وكيل/ م��وزع معتم��دكويتي تاجرا بعقد رسمي موثقا طبقا لألنظمة المعمول بها في الكويت .

أال يكون عضوا في لجنة المناقصات المركزية أو مجلس األمة أو المجلس البل��دي(2أو موظفا في بلدية الكويت .

أال تكون الشركة مملوك��ة جزئي��ا أو كلي��ا لموظ��ف بالبلدي��ة أو عض��و مجلس بل��دي(3 وك��ذلك أق��اربهم من الدرج��ة األولى أو يكون��وا في إدارة الش��ركات المش��اركة

بالمناقصة . يجب على مق��دم العط��اء أن ي��بين عنوان��ه ب��الكويت، وتعت��بر جمي��ع المراس��الت(4

واإلخطارات واإلعالنات القضائية التي ترسل إليه بهذا العنوان بمثابة إعالن صحيح،16

وعليه أن يخطر البلدية كتابة بكل تغيير في عنوان��ه أو عن��وان ممثل��ه س��واء حص��ل هذا التغيير قب��ل أو بع��د ترس��ية المناقص��ة، وم��ا لم يتم ه��ذا اإلخط��ار تعت��بر جمي��ع المراسالت واإلعالنات التي توجه إليه على ه��ذا العن��وان ص��حيحة وناف��ذة على أن

في حق��ه وبمثاب��ة إعالن ق��انوني س��ليم منتجتكون جميع المراسالت باللغة العربية .آلثاره القانونية

( نموذج العطاء 3 مادة )

يكتب العطاء باللغة العربية بالحبر أو الطابعة ويجب تقديم��ه في وث��ائق المناقص��ة(1 الرسمية دون إجراء أي تعديل فيه�ا وتعت��بر وث�ائق المناقص��ة شخص��ية للمناقص��ين الذين حصلوا عليها وال يجوز تحويلها للغير، كما يجب أن يرفق مع وثائق المناقص��ة

اإليصال الدال على تحصيل ثمن وثائق المناقصة .ختم المتعهد

المناقص��ة على أن يتمش��هر من موع��د إغالق عقد اجتماع تمهيدي قب��ل وسيتم إرسال أي أسئلة خاصة بالمناقصة إلى بلدية الكويت � إدارة نظم المعلوم��ات ��� خالل أسبوع من ت��اريخ اإلعالن عن المناقص��ة ولن يتم اس��تالم أي أس��ئلة بع��د ه��ذا الت��اريخ أو خالل االجتماع التمهيدي وسيتم الرد على األسئلة خالل االجتم��اع وستض��م األس��ئلة

واإلجابات لوثائق المناقصة ويل��تزم المتعه��د بم��ا ج��اء فيه��ا س��واء حض��ر أو لم يحض��رويعتبر ملما بكافة ما صدر به من توصيات أو قرارات إن وجدت .

من ي��رغب الحض��ور تق��ديم كت��اب إلدارة نظم المعلوم��ات بالبلدي��ة باس��م وعلى المفوض من الشركة أو المؤسسة مع إبراز اإليص�ال ال�دال على حص�وله على وث�ائق

العطاء .

( األثمان 5 مادة )

يجب أن تقدم العطاءات بطريقة يبين فيها سعر كل بند على ح��دة حس��ب ت��رتيب(1جداول الفئات ويجب أن تكتب األثمان باألرقام والحروف دون كشط أو تحشير .

ختم المتعهد تسعر جميع العطاءات بالعملة الكويتية الرسمية والسعر اإلجمالي هو السعر الذي (2

سيعتد به عن��د المقارن��ة بين العط��اءات وإذا ت��بين عن��د الت��دقيق في المناقص��ة أن األسعار الفردية في التفصيالت غير مطابقة للسعر اإلجمالي فالعبرة دائما بالسعر اإلجمالي إال إذا ك��ان الخط��أ في��ه بالزي��ادة عن مجم��وع األس��عار الفردي��ة في ه��ذه

الحالة يعتد بالمجموع الصحيح كل ذلك دون اإلخالل بأحكام الفقرة التالية . %( خمسة بالمائة بالزيادة أو النقصان من5إذا تجاوز الخطأ الحسابي ما نسبته ) (3

السعر اإلجمالي اس��تبعد العط��اء م��ا لم ت��ر اللجن��ة بإجم��اع آراء الحاض��رين قبول��ه العتبارات تتعلق بالمصلحة العامة وإذا اختلف المبلغ المكتوب باألرق��ام عن المبل��غ

المكتوب بالحروف أخذت بلدية الكويت بالمبلغ األقل . إذا وجد عند التدقيق أن بعض األسعار اإلفرادية غير معقولة قامت اللجنة بتع��ديلها(4

مع المتعهد الفائز قبل ترسية المناقصة عليه في حدود السعر اإلجمالي . يجب على مقدم العطاء أن يالحظ أن أس��عاره ال��واردة بالعط��اء هي ال��تي س��تتم (5

المحاسبة النهائية عليها بغض النظر عن تقلبات األسعار أو سعر العملة أو الرسومالجمركية أو الضرائب أو أية رسوم أخرى .

يجب على مقدم العطاء إذا أجرى أي خصم أو إضافة في سعر عطائه اإلجمالي أو(6 في سعر أي بند من بنود العط��اء أن يثبت الخص��م أو الزي��ادة في ك��ل من ج��داول الكميات واألسعار وصيغة العطاء وكل خصم أو زيادة ترد في كتاب مستقل أو في

وثيقة من وثائق المناقصة عدا جداول الكمي��ات واألس��عار وص��يغة العط��اء س��يعتبركأن لم يكن ولن يلتفت إليه بأي حال من األحوال .

على مقدم العطاء الذي يح��دث كش��ط أو مح��و أو تغي��ير في أي بي��ان من بيان��ات (7 العط��اء س��واء في األس��عار االنفرادي��ة أو الكمي��ات أو حاص��ل ض��ربها أو الس��عر اإلجمالي أو غيره أن يقوم بالشطب على األرقام والبيانات الخط��أ بالم��داد األحم��ر وبعد ذلك يعيد كتابة الرقم الصحيح باألرقام والحروف بالمداد األحمر ومن ثم يوقع إلى ج��انب ه��ذا التص��حيح مقرون��ا بخ��اتم المؤسس��ة أو الش��ركة ال��تي يمثله��ا وإال

ستضطر اللجنة إلى اعتبار العطاء باطال .

ختم المتعهد

( المدة التي ال يجوز فيها سحب العطاء 6 مادة )

( يوم��ا من90 مقدم العطاء أن يبقى عطاءه قائم��ا ال يمكن س��حبه لم��دة )يقبل تاريخ فض مظاريف العطاءات .

( التأمين األولى 7 مادة )

على المتعهد أن يودع مع عطائه تأمين��ا أولي��ا بالقيم��ة الم��ذكورة في إعالنيجب في صورة ش��يك مص��دق أو خط��ابلصالح لجنة المناقصات المركزية طرح المناقصة

ضمان من أحد البنوك المعتمدة في الكويت باللغة العربية غير مشروط وخال من أيتحفظات .

يجب أن يكون هذا التأمين صالحا مدة سريان العطاء ولن يلتفت إلى العطاءكما غير المصحوب بالتأمين األولى وسيرد هذا التأمين لكل من لم تتم الترسية عليه وذلك عند قيام المتعهد الذي تمت الترسية عليه بتقديم التأمين النهائي وتوقيع العق��د ك��ذلك يرد هذا التأمين إلى من تمت الترسية عليه إذا قام بدفع التأمين النهائي تنفيذا للم��ادة

( من هذه الشروط وال يجوز لمقدم العطاء المطالبة بأية فائدة عن هذا التأمين .10)

( دراسة المناقصة 8 مادة )

على المتعهد دراسة األعمال موضوع المناقصة دراسة نافية للجهالة واليجب يقبل منه بأي حال من األحوال االحتجاج بأي معلومات أو بيانات قد تهاون في اإلطالع

عليها ودراستها .

( قبول العطاء 9 مادة)

المناقصة غير قابلة للتجزئة وال يسمح بتقديم عطاءات بديلة فيها .(1 يقبل العطاء إذا قدم بأقل سعر إجمالي وكان متماشيا مع متطلب��ات وث��ائق المناقص��ة(2

ويجوز تفضيل عطاء مقدم بسعر أكبر أو إلغاء المناقصة دون إب��داء األس��باب وفق�ا/37للش��روط واألحك��ام المنص��وص عليه��ا في ق��انون المناقص��ات العام��ة رقم )

( وما طرأ عليه من تعديالت .1964

ختم المتعهد

تخطر لجنة المناقصات المركزية كتاب��ة المتعه�د ال��ذي رس��ت علي��ه المناقص��ة بقب��ول(3 عطائه وترسية المناقصة عليه وال يترتب علي إرساء المناقص��ة وإبالغ المتعه�د به�ا أي حق له قبل الدولة في حال العدول عن الترسية طبقا ألحكام القانون وال يعت�برالمتعهد متعاقدا إال من تاريخ توقيع البلدية على العقد وفقا ألحكام الفقرة التالية .

تطلب البلدية من المتعهد الفائز الحض��ور لتوقي��ع العق��د خالل خمس��ة أي��ام عم��ل من(4تاريخ إبالغه كتابة فإن لم يتقدم خالل هذه الفترة للتوقيع اعتبر منسحبا .

إذا تخلف المتعهد الفائز عن التق�دم لتوقي�ع العق�د في الموع�د المح��دد أو عن تق�ديم(5 ( من هذه الشروط أو انسحب ألي10التأمين النهائي المنصوص عليه في المادة )

سبب من األسباب خسر تأمينه األولي دون اإلخالل بحق البلدية في الرج��وع علي��ه بالتعويضات وفى هذه الحال�ة يج��وز إلغ�اء المناقص��ة وإع�ادة طرحه�ا م����ن جدي�د أو ترسيته�ا على المتعهد التالي سعرا والمطابق للمواصفات وفقا ألحكام الق��انون وفي جميع األحوال يلتزم المتعهد بتعويض البلدية عن كاف��ة األض��رار ال��تي لحقته��ا نتيجة إلغاء المناقصة وإعادة طرحها من جديد أو نتيج��ة لترسيته���ا عل����ى المتعه��د

التالي له في السعر والمطابق للمواصفات .

( التأمين النهائي 10 مادة )

يجب على المتعهد الفائز بعد إخطاره بقب��ول عطائ��ه وقب��ل توقي��ع العق��د أن ي��ودع(1 %( عشرة بالمائة من قيمة العق��د بص��فة ت��أمين وض��مان لتنفي��ذ10مبلغا وقدره )

العقد على الوجه األكمل لصالح البلدية وال تدفع فوائد عن هذا التأمين . يجب إيداع الت��أمين النه��ائي بإح��دى الط��رق المنص��وص عليه��ا في الت��أمين األولى(2

عل�ى أن يكون ساري المفعول طيلة مدة العقد إضافة لثالثين يوما بعدها . يبقى هذا الت��أمين ل�دى البلدي��ة إلى أن يتم تنفي��ذ كام��ل العق��د وله��ا الح��ق في أن(3

تخصم منه قيمة الغرامات والتعويض��ات ال�تي تس�تحق على المتعه�د بم�وجب ه�ذا العقد وفي حالة حصول مثل هذا الخصم يجب على المتعه��د خالل س��بعة أي��ام من تاريخ إخطاره أن يكمل التأمين فإن قصر في ذلك كان للبلدية الحق في أن تكم��لالتأمين مما يستحق له لديها من أية مبالغ أخرى فإذا لم يكن له مبالغ مستحقة...

ختم المتعهد الصرف وعجز عن تكملة التأمين خالل المهلة المشار إليها فإن للبلدي��ة الح��ق في

( من هذه الش�روط وذل�ك بكت�اب موص�ى علي��ه دون13فسخ العقد طبقا للمادة ) حاجة إلى اتخ��اذ أي��ة إج��راءات قض��ائية م��ع حف��ظ ح��ق البلدي��ة في الرج��وع علي��ةبالتعويضات المترتبة على ذلك وال يجوز لدائني الطرف الثاني الحجز على مبلغه .

( التنازل عن العقد 11 مادة )

للمتعاقد معه أن يتنازل عن العق�د أو ج�زء من�ه للغ�ير أو أن يتعاق�د منال يجوز الباطن إال بموافقة كتابية مسبقة من البلدية وفي هذه الحال��ة يظ��ل مس��ئوال م��ع المتنازل إليه أو المتعاقدين من الباطن مسئولية تضامنية عن تنفيذ جميع أحك��ام

العقد . ( الخصم من مستحقات المتعاقد معه 12 مادة )

المبالغ التي تستحق على المتعاقد معه للبلدية تطبيق��ا ألحك��ام العق��د س��واءكل بصفة غرامات أو تعويض��ات أو مص��اريف أو غيره��ا يك��ون له��ا الح��ق في خص��مها من التأمين النهائي أو من أية مبالغ أخرى تكون مستحقه ل��ه ل��دي البلدي��ة بن��اء على ه��ذا العق��د أو أي عق��د آخ��ر أو ل��دى أي وزارة أو إدارة أخ��رى من وزارات الحكوم��ة وإداراتها، كل ذلك دون أن يكون له الحق في االع��تراض ودون حاج��ة إلن��ذار أو اتخ��اذ

أية إجراءات قضائية .

( فسخ العقد 13 مادة )

على أي حق أخر في هذا الصدد محتفظ به في العقد أو في القانون للبلديةعالوة فلها أن تفسخ العقد ألي سبب من األسباب التالية :

إذا أخل المتعاقد معه بأي شرط من العقد .أ(إذا ارتكب المتعاقد معه أو من ينوب عنه شيئا من قبيل الغش .ب( إذا رش��ا أو ح��اول أن يرش��ي أي موظ��ف أو عام��ل بالبلدي��ة إم��ا بطري��ق مباش��رت(

أو غير مباشر .إذا أفلس المتعاقد معه أو قدم طلب إفالسه .ث( إذا أظهر المتعاقد معه بطئا في تنفيذ التزاماته على وجه يتحقق مع��ه للبلدي��ة بش��كلج(

ملحوظ أنه لن يستطيع إتمام األعمال في المواعيد المحددة .

ختم المتعهدإذا صدر ضده حكم قضائي يدل على سوء االستغالل أو مخالفة القانون.ح( إذا عجز عن تكملة التأمين النهائي بعد خصم آية مبالغ منه بع��د س��بعة أي��ام عم��ل منخ(

تاريخ إبالغه . إذا انسحب بعد توقيع العقد سواء كان قبل أو بعد تنفيذ العقد .د( إذا تنازل عن العقد أو جزء منه للغير دون موافقة كتابيه مسبقة من البلدية .ذ(إذا تجاوز مبلغ الغرامة الحد األقصى المنصوص عليه في هذه الشروط .ر( ( من الم��ادة الرابع��ة من3.2.1إذا تحق��ق أي��ا من المخالف��ات ال��واردة في البن��د )ز(

الشروط الخاصة للمناقصة والمتعلقة بالمخالفات والجزاءات . فسخ العقد في هذه الحاالت بموجب كتاب موصى عليه دون حاجة التخاذويكون

أية إجراءات قضائية .ويترتب على فسخ العقد ما يلي :

.أن يصبح التأمين النهائي حقا خالصا للبلدية دون الحاجة التخاذ أي إجراءات قضائيةأن تقوم البلدية باستكمال ما تبقى من العقد بالطريقة التي تراها مناسبة مع الرج��وع

على المتعاقد معه بكافة ما يستحق من تعويضات أو مصاريف .ويجوز للبلدية بدالً من فسخ العقد أن تنفذ ما لم يتم تنفيذه من العقد بالطريق��ة ال��تي

تراها مناسبة على حساب الطرف الثاني مع الرجوع عليه بفروق األسعار وكافة مايستحق لها من مصاريف وتعويضات وغرامات.

( أحكام عامة 14 مادة ) يلتزم المتعاقد معه بشراء ما يحتاجه من مواد أو أدوات أو آالت أو بضائع أو أجهزة(1

لق��رار وزي��ر التج��ارة من المنتجات الوطنية أو المنتجات ذات المنشأ الوطني وفقا 282( والق��رار رقم )23/1987( المع��دل ب��القرار رقم )6/1987والص��ناعة رقم )

(، وتعت��بر أحك��ام ه��ذا الق��رار ج��زءا ال يتج��زأ من العق��د وي��ترتب على2000لسنة %( من قيمة المشتريات فض��ال20اإلخالل بهذا االلتزام توقيع غرامة ال تقل عن )

عن الجزاءات األخرى المترتبة على إخالل المتعهد بالتزاماته التعاقدية، كم��ا يل��تزم( الصادر في اجتماع��ه رقم )412المتعاقد معه بأحكام قرار مجلس الوزراء رقم )

بش��أن دعم المنتج��ات والس��لع المحلي��ة والمق��اولين13/6/1999( بت��اريخ 23/99الوطنيين .

ختم المتعهد يلتزم المتعاقد معه في نقل العمالة والبضائع محل العقد ج��وا باس��تخدام ط��ائرات(2

شركة الخطوط الجوية الكويتية، أو طائرات شركات الطيران األخرى التي لها حق النقل للركاب والبضائع طبقا لالتفاقيات الثنائية التي أبرمتها دول��ة الك��ويت، ووفق��ا

( مع��دال1985 لس��نة 21للضوابط المنصوص عليها في قرار مجلس الوزراء رقم )م .13/4/1987( بتاريخ 1987 لسنة 18بقراره المتخذ في الجلسة رقم )

إذا كان الطرف الثاني شركة أجنبية أو شركة كويتية وكيلة عن شركة أجنبية(3/أوالً/738( من قرار مجلس الوزراء رقم )2فسيتم التقيد بما جاء في البند رقم )

14/7/2008( المنعقد بتاريخ 2/2008-35/ب،ج( الصادر في اجتماعه رقم )1 بشأن إضافة نص في العقود يفيد باحتجاز الدفعة النهائية لحساب ضريبة الدخل

وال ترد إلى الطرف الثاني إال بعد أن يقدم ما يثبت براءة ذمته . يسري على هذا العقد جميع القوانين والل��وائح الكويتي��ة وك��ل ن��زاع أو خالف مهم�ا(4

كان نوعه ينشأ عن هذا العقد أو بسببه تختص بالفصل فيه المحاكم الكويتية . ( بش��أن الكش��ف عن25/1996يل��تزم المتعه��د الف��ائز بأحك��ام الق��انون رقم )(5

العموالت التي تقدم في العقود التي تبرمها الدولة و التقيد بما ورد من أحك��ام في ( بهذا الشأن1/1996مجال سريانه وذلك على ضوء تعميم ديوان المحاسبة رقم )

في ش��أن دعم2000( لس��نة 19يل��تزم الط��رف الث��اني بأحك��ام الق��انون رقم )(6 وتشجيع العمالة الوطنية للعمل في الجهات غير الحكومي��ة وق��رار مجلس ال��وزراء

بتحديد نسب العمالة الوطنية لدى تلك الجه��ات2008/خامساً( لسنة 1104رقم ) وتعديالتهما ، ويتعين على الشركة أن تقدم شهادة حديث��ة باس��تيفاء نس��بة العمال��ة الوطنية الصادرة من وزارة الشئون االجتماعية والعمل قبل إبرام العقد وفقاً لنص

المش���ار إلي���ه وق���رار لجن���ة2000( لس���نة 19( من الق���انون رقم )6الم���ادة )المناقصات المركزية بهذا الشأن.

على المتعاقد معه تقديم الشهادة التجارية الدالة على القيد بالسجل التجاري وفي(7الغرفة التجارية بالكويت وإرفاقها ضمن أوراق المناقصة وذلك وفقا ألحكام .

ختم المتعهد

( بش��أن تنظيم1/1959( والمرسوم األميري رقم )68/1980قانون التجارة رقم )(8السجل التجاري ويلتزم المتعهد بتقديم الشهادة الخاصة بعام طرح المناقصة .

( وما طرأ عليها من تع��ديالت قب��ل37/1964تعتبر أحكام قانون المناقصات رقم )(9توقيع العقد مكملة ومتممة لشروط العقد .

يجب على مقدم العط��اء أن يرف��ق م��ع عطائ��ه ش��هادة من إدارة الش��ئون المالي��ة(10 )بلدية الكويت( تفيد براءة ذمته اتجاه البلدية وتثبت أنه غير مدين أو مستحق عليه

أية مبالغ أو ديون للبلدية أيا كان مصدرها . في ش��أن ض��ريبة1955( لس��نة 3يلتزم الط��رف الث��اني بأحك��ام المرس��وم رقم )(11

والئحته التنفيذية الصادرة2008( لسنة 2الدخل الكويتية ، المعدل بالقانون رقم ) وتعديالته.2008( لسنة 29بالقرار الوزاري رقم )

برنامج العمليات المقابلة " األوفست ":(12 يل��تزم )الط�رف الث�اني( بتوقي�ع "م�ذكرة اتف��اق" الخاص��ة بتنفي��ذ برن�امج العملي�ات المقابلة األوفست قبل توقيع العقد وتعتبر جزء ال يتجزأ من العقد ومكمالً ل��ه، وذل��ك

وفق��ا للق��رارات الص��ادرة بش��أنه، وتحدي�دا ق�راراتتنفيذا اللتزام برن�امج األوفست ، وال��ذي تض��من26/7/1992( بت��اريخ 694مجلس الوزراء التي تشمل: ق��رار رقم )

بتف��ويض10/5/1992التأكد على قرار المجلس المتخذ في اجتماعه المنعقد بتاريخ وزير المالية باتخاذ اإلجراءات الكفيلة بتنفي��ذ برن��امج األوفس��ت والق��رارات األخ��رى

لتوفير خدم��ة االتص��االت باإلض��افة إلى توف��ير نظ��ام إلدارة ومراقب��ة الش��بكة وتعزي��ز وسائل حماية الش��بكة على أن يك��ون ذل��ك وفق��ا للمع��ايير المش��ار إليه��ا في كراس��ة

المواصفات. على مقدم العطاء أن يلتزم بتقديم حل متكامل لجميع الخدمات واألنظم��ةيجب

إن الشروط والمتطلبات المذكورة في الوثائق الخاصة بكراسة المواص��فاتRFP المطروحة باللغة اإلنجليزية والشروط العامة والخاص��ة هي الح��د األدنى المقب��ول لدى بلدية الكويت ويجب االلتزام الكام��ل بم��ا ورد به��ا، وأي إخالل في ش��رط من

شروطها يحق للبلدية استبعاد ذلك العرض .

أن يقدم خطة عمل تفصيلية تلبى بش��كل منطقي وواقعي المتطلب��ات ال��واردة بكراس��ة المواص��فات تش��مل الخط��ة الزمني��ة وخط��ة إدارة المش��روع وخط��ة

االختبارات والقبول وخطة التدريب وكذلك الدفعات المالية طبقا للمراحل .الع��رض الف��ني المق��دم والتص��ميم التفص��يلي للش��بكة يجب أن يعتم��د على

للشركة، وقدرة ومالئمة الشركة المالية لتنفي�ذ مش�روعات به�ذا الحجم وعلي��هيجب االلتزام بتقديم ما يثبت ذلك مدعوما بشهادات حديثة ومعتمدة .

أن يلتزم مقدم الع��رض الف��ائز بح��ل المش��كالت والمعوق��ات والتع��ديالت ال��تي تظهر طبق��ا لنت��ائج االختب��ارات والعم��ل على إص��الحها بع��د اعتماده��ا من بلدي��ة

الكويت، دون أية تكاليف إضافية .أن يراعى عند التصميم وتوري��د األجه�زة وال�برامج إمكاني��ة الزي��ادة في أحم�ال

خالل خمس س��نوات50التشغيل والتوسعة في االستخدام بزي��ادة مق��دارها %دون الحاجة إلى تغيير أي من عناصر الشبكة .

( وقط��ع2013-2014أن تكون جميع األجهزة في مرحلة التسليم منتجة حديثا ) الغي��ار وأنظم��ة التش��غيل وال��برامج المس��تخدمة واألنظم��ة المطلوب��ة أص��لية ومصنعة من الشركة األم بموجب ترخيص معتمد من الشركات المنتج��ة وعلي��ه

يجب االلتزام بتقديم ما يثبت ذلك مدعوما بشهادات حديثة ومعتمدة . أن يدرج اتفاقية مستوى ال خدمةService Level Agreementفي العرض

المق��دم بم��ا ال يتع��ارض م��ع ش��روط وبن��ود ه��ذه المناقص��ة وأن ش��روط ه��ذهاالتفاقية ستؤخذ بعين االعتبار عند تقييم العروض المقدمة .

االلتزام بتقديم ما يثبت ذلك مدعوما بشهادات حديثة ومعتمدة .يجب معاملة كافة محتويات المناقص��ة على أنه��ا بيان��ات خاص��ة ومن ممتلك��ات

دولة الكويت ويحظر تداولها إال بإذن كتابي من بلدية الكويت .يجب على مق��دم العط��اء الف��ائز به��ذه المناقص��ة تس��مية رئيس فري��ق عمل��ه

للتنسيق والتعاون مع مدير المشروع الذي سوف يحدد من قبل بلدي��ة الك��ويت كم��ا يجب أن يق��دم كاف��ة المعلوم��ات في ال��وقت المناس��ب لض��مان تنفي��ذ

المشروع حسب الخطة .يجب على مقدم العطاء استخدام النماذج المرفقة بكراسة المواص��فات الفني��ة

وتوفير جميع البيانات المطلوبة بهذه النم��اذج وخصوص��ا نم��وذج التس��عير ال��ذي يوجب ذكر جميع األجهزة والبرامج والخدمات ال��تي س��وف يتم توفيره��ا وح��تى

التي تقدم بدون سعر .يجب إرفاق شهادات ووثائق لجميع األجهزة المطلوبة واألنظمة والبرامج التابعة

لها وشهادات خبرة المهندس��ين والخ��برات في مج��ال االختص��اص بحيث تك��ون ( أش��هر وم��ا دون ذل��ك لن يتم3مختومة وحديث��ة وال تق��ل م��دة ص��الحيتها عن )

األخذ به من قبل بلدية الكويت .يجب أن تك��ون ش��هادات خ��برات المهندس��ين حديث��ة وتثبت ب��أنهم على كفال��ة

الشركة مع إرفاق بطاقة مدنية تثبت ذلك .يجب تق��ديم خط��ة عم��ل قب��ل ب��دئ المش��روع يتم في��ه ش��رح مراح��ل ت��ركيب

وتشغيل أجهزة االتصال وملحقاتها وتركيب نقاط الكم��بيوتر على أن يرف��ق م��ع الخط�ة أع�داد المهندس�ين والفن�يين المن�اط لهم عملي�ة ال�تركيب بحيث يك��ون عددهم مناسب لحجم مواقع البلدية حتى يتم االنجاز بالزمن المح��دد ومن ح��ق

البلدية قبول او رفض أي عدد ال يلبي الواقع بعملية التركيب .

فحص األجهزة الموردة قبل التركيب وبعده بمعرفة المختصين بالبلدية وعلىيتم المتعهد أن يحضر الفحص بنفسه أو يرسل مندوبا عنه ف��إذا وج��دت األجه��زة الم��وردة غير مطابقة للشروط والمواصفات الفنية المتعاقد عليها رفض قبوله��ا وعلى المتعه��د استردادها وإحضار غيرها مطابقة خالل )أسبوع( من تاريخ التبليغ للش��ركة وإال طبقت في حق��ه الج��زاءات المنص��وص عليه��ا والبلدي��ة غ��ير مس��ئولة عن األجه��زة ال��تي

ال يستردها المتعهد في حينها وتكون معرضة للسرقة او الفقد والتلف . المتعاقد بأن تكون للبلدية مطلق الص��الحية وكام��ل الح��ق في أن توج��هويلتزم

تعليمات أضافه حسبما تقتض��ي ب��ه الض��رورة وص��وال إلى تنفي��ذ األعم��ال على الوج��هاألكمل واألنسب وعلى المتعهد تنفيذ تلك التعليمات والتقيد بها .

INTRODUCTIONThe Kuwait Municipality )hereafter referenced as KWM( is requesting proposals for setting up a Network Upgrade services for the current LAN Active Network Infrastructure.

KWM has the right to establish a contract with one supplier as The Bidder to complete all the parts of the project. KWM will not accept partial bids and the contract will not be divided between bidders.

KWM Main RequirementsThe successful bidder will be responsible for ensuring the complete implementation of this project. This will include the phased and planned activities working with KWM in close co-operation for:

Installing the new hardware, software and applications with all associated patch cabling fibre connectors and accessories so as to interconnect with our existing Network as deemed necessary by KWMto the best practices.Redesigning the current network to meet the requirements of KWM and implement the new network configuration.Incase if any problem does occur in our current working environment during the new implementation it will be the sole responsibility of the bidder to rectify the issue immediately.Implementing the new project fully including the certified hand over to KWM and ensuring that all the devices installed have the latest Operating System, IOS, patches and fixes

The Bidder must be known in Kuwait as IT Company for at least 10 years and registered with KWM as a network hardware/software supplier, failing to do so would lead to disqualification of the Bidder offer.The proposed solution must be based on International technology Open-Standards in the fields of information technology networks, security and management, fulfilling ISO standards for Open System Interconnection.The provided hardware and software must be purchased through the proper channels, and must be new, original and registered for the name of Kuwait Municipalitywith proper manufacturer support. The winning bidder must provide a letter from the manufacturer confirming the above.The Bidder must have the highest partnership )Gold, Tier-1( for the last 5 years with an international world class IT Company that manufactured the proposed network solution, and at least )Silver( partnership with the security vendor. The bidder must submit the adequate documentation to prove the partnership, and letter from the vendor showing full support on this project. Failing to do so would lead to disqualification of the Bidder offer.

تحديث وتطوير أجهزة شبكة المعلومات ببلدية يرغب الطرف األول في حيث والمحددة أعدادها وأوصافها في وثائق الشروط .. وأبدى الطرف الثاني رغبته فيالكويت

تنفيذ ذلك بموجب العطاء المقدم من الطرف الثاني ومن ثم فقد تم االتفاق على ما يلي :

أوال : تعتبر المستندات التالية أساس هذا االتفاق وجزء ال يتجزأ منه، وهي :

الشروط العامة .-1الشروط الخاصة والفنية .-2جدول المخالفات والغرامات .-3صيغة العطاء والنماذج وجدول إجمالي التكاليف .-4محضر االجتماع التمهيدي .-5المستندات والكتب المقدمة مع العطاء .-6

ثانيا : ( ستة وثالثون شهرا من تاريخ توقيع العقد وحتى انتهاء فترة الض��مان36 )مدة العقد

خامساً : على هذا العقد القوانين واللوائح الكويتية وتختص المحاكم الكويتية بالفصل فيتسري

تسلم للطرف الثانيأي نزاع قد ينشأ عنه أو بسببه وقد تحرر من أربع نسخ نسخة منها .
