装置などを表す言葉

特許では装置およびそれに関連する語が頻繁に出てきます。それらの語を上手に使いこな

すことで、正確かつ明確な英語を書くことができます。ここには、装置などを表す主な言葉

（apparatus, device, system, unit, equipment, appliance, mechanism, machinery, machine, instrument）と実際の用例をまとめてあります。必要に応じて参照してください。 1. apparatus：ある目的に必要な複雑な機械装置。特別の機能または特別の用途に合うよう

に機器、機械類、工具、機材などを組み合わせたもの。 apparatus は米国では装置の特許のクレームで好んで使用されます。しかし、発明の記述

の部分では apparatus の代わりに、他の具体的な言葉が使用される傾向にあります。つまり、

米国出願ではこの言葉はクレームで装置を表す特別な語という意味合いを持っています。た

だし、apparatus をクレーム以外でも使用することは可能であり、実施形態の中で用いてい

る例もあります。 もともと日本語の「装置」という語は apparatus の訳語として作られたものです。しかし、

現在では apparatus 以外の語も「装置」と訳される場合が数多くあります。 apparatus は不可算名詞と可算名詞の両方に扱われています。可算名詞の場合、複数形を

apparatuses とする場合と、単複同形の apparatus とする場合があります。したがって、単

に apparatus と書かれた場合、不可算名詞か複数名詞の区別がつかない場合があります。本

講座では apparatus を可算名詞として扱い、複数形を apparatuses で統一しています。 （１） The reaction of the present invention can be batchwise or continuously carried out

device は装置を表す言葉としては特許で最も頻繁に使用されます。

実際の用例では、apparatus と device の間には明確な区別はなく、以下の文例（６）～（８）

に示すように、同じ装置が、ある特許では apparatus と呼ばれ、別の特許では device と呼ば

上記の例で明らかなように、apparatus と device の間に明確な区別はありません。しかし、

同じ特許の中で、apparatus と device の両方が使用される場合は、文例（９）および（10）に示すように、より大きな装置に apparatus を使用します。つまり、相対的には apparatusの方が device よりは大きな概念を持っています。
