(c) If the Employee is already employed as a permanent Employee or Staff of the Em-ployer, the term of the Employment Contract may be extended by negotiation and upon mutual agreement between the Employer and the Employee.

(ဃ) အလပသမာား၏စကရ င၊အလပရ င၊ အလပဌာနင၊ ကမၸဏင၊ လပငနားတြင အလပစတင၀ငေရာက သညဖေန႔မစ၍ တစဆကတညားျ စေသာ လပသကမာားက အလပရငမေရတြကေပားရမည။

(d) The Employer shall take into account the length of continuous service of the Employ-ee, starting from the date of commencement of employment at the current facto-ry/workshop/enterprise/company.

၆။ အလပခ န 6. Working Hours

၇။ နကး ႔၊ းလပပ ႔ႏငည စငည ႔ 7. Rest Days, Holidays and Leave Days

(က) နာားရက။ a) Rest days

(အႏ င(မညသည။ နကး ႔ စငမညဆြ းလပ(အကးဥပေ အ ကးႏငညးမည လပ လစက စကး စငည (မညသည။ Ordinarily, Sunday shall be designated as the weekly rest day; alternatively, de-pending on the nature of the enterprise and local customs, the Employer and the Employee may upon mutual agreement designate any other day of the week as the weekly rest day. Wage/salary for the rest day shall be enjoyed in accordance with the applicable labour laws.

(ခ) အလပပ တရက (b) Holidays

(၁) ျပညေထာငစအစ ားရက ာစစ အမ န႕ေကာျငာစာျ ငဖသတမတထာားေသာ အမာား ျပညသအလပပ တရက မာား တြင လပခလစာအျပညဖျ ငဖ အနာားေပားရမည။

(1) The Employee shall enjoy full payment of wage/salary on public holidays as prescribed annually by notification of the Union Government.

(၂) အကန၍အမာားျပညသအလပပ တရကာငဖ ရကသတပတအလပပ တ ရကတ ကဆ င ေနပက အမာားျပညသအလပပ တရကအျ စ သတမတရမည။

(2) Where a public holiday and a rest day coincide, such day shall be consid-ered a public holiday.

(ဂ) ခြငဖရကမာား။ (c) Leave Days:

အလပသမာားက ပေ ာငဖအည ခြငဖတ ငကာားလင ေအာကပအတ ငားခြငဖခ စာားခြငဖရ သည။ Leave days may be enjoyed in accordance with the applicable labour laws upon

request of the Employee as follows:

(၁) ေရာငတခငခြငဖ။အလပစတင ၀ငေရာကသညဖေန႔ရကမ ၁၂ လ အတြငား ေရာငတခငခြငဖ ၆ ရကက လပခလစာ အျပညဖျ ငဖ ခ စာားခြငဖ ရ သည။ (႔ဆ င ကႏစးစငး စငညအမလ င ထ စငညပ ႔ပမ(မညသည။ ၾ႔ အလ င ၃ ႔ထ႔ပ ၍ စငည စကး စငညအ ပါသည။ း ကးအမည(မညည စငညႏငညအ ေပါငးစပ စကး စငညအ ပါသည။

1 Casual Leave: the Employee shall be entitled to six days of casual leave with payment of basic salary/wage for every twelve months of employ-ment from the date of commencement of the employment. Casual leave shall expire if not enjoyed within the relevant year and may not be spent for more than three consecutive days at a time. Casual Leave may not be enjoyed in conjunction with any other type of leave.

2 Earned Leave: the Employee shall enjoy ten days of earned leave (consec-utively or separately) per annum at basic salary/wage or basic daily wage excluding any allowances, provided that the Employee has completed twelve months of service with a minimum of twenty working days per month. Upon mutual agreement between the Employer and Employee, earned leave may be enjoyed at less than ten days per instance. For each month without the minimum of twenty working days, the Employer shall deduct one day from the earned leave entitlement of the Employee.

၃ ေဆး စငညသည။ လပ(႔လ ၆လ လပမညည ပး((မည းေ လစက ဖငညစႏစလ ငေဆး စငည ႔ ေပါငး ၃လ စကး စငည (မညသည။( ႏ ကစငးနမညးဆးလပ(႔လ ၆ ၆လပမညဖ ေးကငအလပ ြည ေ(းလ ငေဆးလ႔အ စငည႔ လစကအ စငည ႔းဖစစ စကး စငည (မညသည။လအကဖလေ းဥပေ း း႔ မးငးကအ းလပ(အကးဖစပါ႔ါ႔မငးလဥပေ ပါ စကး စငည း ငး စကး စငည (မညသည။

3 Medical Leave: upon completion of six months of service, the Employee shall be entitled to enjoy 30 days of medical leave per annum with basic pay. In case of service of less than six months, the Employee shall enjoy medical leave without pay. If the Employee is insured under the Social Se-curity Law (2012), the Employee shall enjoy medical leave as provided therein.

4 Maternity Leave: upon completion of six months of service, the Employee shall be entitled to enjoy six weeks of maternity leave before delivery and eight weeks after delivery with basic pay.

၅ းလပ(အကးဒသ၏လ အ (ကးစငလ ( အမ လ အ ဘနကေ း႔ စစဖစ(မညညး ါလးန မညးဆး း ေၾ႔းေငစအလဖေက႔ ငးအပမဘြလ၁၅၁လ ႏစလ စငည ႔ႏငညလးလပပ ႔း႔ ဥပေ း စကး စငည (မညသည။လးးလပ(အကးဒသ၏ဥပေ ပါ စငည စကးအက႔နဆး န စငလလစကအြည စငညးေနဖငညလမညမည ႏက ငး စကး စငည (မညသည။

5 Funeral Leave: in the event of the death of a family member or the par-ents of the Employee, the Employee shall be entitled to enjoy funeral leave as prescribed under the Leave and Holidays Act (1951) without any deduc-tion from minimum wage. If the statutory leave entitlement has been ex-hausted, the Employee shall enjoy leave without pay by negotiation and upon mutual agreement between the Employer and Employee.

၈။ း နပ လပ႔ င ငး 8. Overtime

လပငနားသေဘာသဘာ၀မာားအေပခမတည၍ အလပရငာငဖအလပသမာားသေဘာတ ညခကျ ငဖ ပေ သတမတခကမာား ာငဖအည အခ နပ လပက ငာ ငသည။ အခ နပ လပခက သကဆ ငရာ ပေ အရသတမတထာားသညဖပ ေသနညားအတ ငား တြကခကေပားရမည။ Depending on the nature of the enterprise, the Employer and Employee may mutual-ly agree on the Employee working overtime in accordance with the applicable labour laws. The payment of overtime pay shall be computed in accordance with the formu-la prescribed by the applicable labour laws.

၁၁။ ေဆးါး႔( ငး 11. Medical Treatment

(က) ၂၁၂ ႏစ လအကဖလေ းဥပေ ႏငည း႔ မးအငေ(က းလပ(အကးအ ကးးကး ေးက႔ ပါ ႏးစ႔ းလပ ငဒသ၏ ႔န႔ စ ဖငည ေဆးါး႔( န စစဥ ေပး အမည-

(a) For any Employee not covered by the Social Security Law (2012), the Employer shall provide at its own expense medical treatment in the following cases:

(၁) လပငနး စငထ ႔ က အက၊ (1) Workplace injury;

(၂) လပငနး စငဆ င က ေ ကဂါ အက၊ (2) Work-related disease; and/or

(၃) လပငနး စငးစငး ဖ ကးနကအကသည။ (3) Sickness at the workplace.

(ခ) ၂၁၂ ႏစ လအဖလေ းဥပေ ႏငည း႔ မးငေ(က းလပ(အကးအ ကးးစ႔ (႔ဆ င က ဥပေ ႏငညးမည ေဆးါး႔( စငည (မညသည။

(b) Any Employee covered by the Social Security Law (2012) shall enjoy medical treatment in accordance with the applicable law.

(ဂ) ၂၁၂ ႏစ လအကဖလေ းဥပေ ႏငညး႔ မးအငေ(က းလပ(အကးအ ကး းစ႔ းလပ႔ းေၾ႔ကငးပမ၍ ထ ႔ က အကအ ကးးစ႔ (႔ဆ င က းလပ(အကး ေလ ကေၾ႔းဥပေ ႏငည းမည ေဆကင စ႔ေပး အမညသည။

(c) Work-related injuries of Employees not covered by the Social Security Law (2012) shall be handled in accordance with the applicable Workmen’s Compen-sation Act (1923).

၁၃။ အလပသမာားမာားလ ကနာရမညဖစညားကမားခကမာား 13. Employment Rules

အလပသမာားမာားလ ကနာရမညဖစညားကမားခကမာားက ေအာကပအတ ငား အမ ားအစာား ခြြျခာားသတမတ ၍အေရားနမႈအဆငဖဆငဖအပ အ၀ငေနာကဆကတြြမာားအျ စ ပါကဤစာခပတြငထညဖသြငားခပဆ သည။ Employment Rules, specifying different categories of misconduct and levels of disciplinary action, are attached to this Employment Contract as annexures and shall be complied with by the Employee:

(က) ေနာကဆကတြြ(က) သာမနျပစမႈမာားာငဖအေရားနမႈ (a) Annexure A: Ordinary misconduct and disciplinary action; and/or

(ခ) ေနာကဆကတြြ(ခ) ဒကားေလားေသာျပစမႈမာားာငဖအေရားနမႈ (b) Annexure B: Grave misconduct and disciplinary action.

မတခက။ စကမႈဇနတြငထတျပနထာားေသာကငဖ၀တမာားက နမနာနာ ငၿပား လပငနားသေဘာ သဘာ၀ာငဖက ကညစြာ သတမတာ ငသည။ လပငနားခြငစညားကမားမာားက အလပရငင၊ အလပသမာားာစ ကည ာႈ ငား၍သတမတာ ငသည။ Note: Employment Rules may be prescribed in accordance with the nature of the en-terprise (taking the code of conduct issued by the Industrial Zone as reference). 14. Training and Bond Period after Training

(က) သငတနားက အလပအက ငာငဖ ကၽြမားကငမႈ ြ ႕ၿ ားတ ားတကေရား ပေ အရ ာစ ားသေဘာတ ည ာႈ ငားေဆာငရြက ာ ငသညသည။

a Training may be carried out in accordance with the Employment and Skills Devel-opment Law (2013) uponလ mutualလ agreementလ betweenလ theလ Employerလ andလEmployee.

(ခ) လပငနး စင႔ကစအး႔ ငအကဆ င က (င နး႔ေ က႔ ငးႏငည စပလ ဥး၍ (ေဘက စက မပ႔ ဥပေ ႏငညးမည (း ကး မပဆ အမညသည။

b A separate agreement shall be executed in accordance with the applicable labour laws in respect of any training.

(က) းလပအ ႏက ထစ႔ ငး (a) Resignation

(၁) းမည ပမ နႏထကးေ(ကးလပ(အကး(မည းလပ ကနအ ႏကထစ႔လ ပါ႔ းေၾ႔ကငးၾ႔ကး စက႔ (႔ဆ င ကလပငနး စြ ကန အဆငည းလပ င ( အမ အနေနဂ က ( ႏအမ စအးပ မပ(ထ( ႏ းနမညးဆးစလၾ႔ မင၍ းေၾ႔ကငး ၾ႔ကး အမညသည။

(1) Upon confirmation of employment, the Employee shall, if desirous of re-signing from work, give at least one months’ notice in advance to the Em-ployer, Manager or Administrator.

(၂) းလပအ ကးငႏက ထစ႔ စငညပမ ကစင းလပ(အကး(မည အ အ းကး ထ ေပးထကး(မညည လစကကတင၊ နထအး႔၊ လပငနး(းပစစမညးႏငည ႔ မကအ ကး႔ ပနလမညေပးးပ အမညညးပင အ အ ကနမထကး(မညည စက ငးအ ကး၊ ေငစေၾ႔းအ ကး၊ ပစစမညးအ ကး႔ လမညး းလပ ငထ( ႏ စနစ ႔ လႊြေပကငးေပးးပ အမညသည။

(2) Upon confirmation of resignation, the Employee shall return the salary card, employee card, work-related equipment, materials, accounts, mon-eys and assets entrusted to Employer.

(၃) းလပ(အကး(မည းလပအ ႏက ထစ႔လ ပါ႔ စလၾ႔ မင၍ းေၾ႔ကငးၾ႔ကး အမညဖစပး းလပ ငအ းလပ ပစြအက နစနကေၾ႔း ေပး နအလ ဘြ န (မညည းအန ႔မ းလပလပ ြည (မညည ရ႔အ ကးးစ႔ လပ ႔ နေငစႏငည လပ(႔ စငည႔ စကး စငညေပးပး ႏက ထစ႔ စငညပမ အမညသည။

(3) The Employee shall give at least one months’ prior notice to the Employer if the Employee is desirous of resigning from work. The Employer shall permit the resignation with disbursement of any outstanding salary/wage for the days actually worked and remaining earned leave days, but shall not be required to pay severance pay to the Employee.

(၄) းထ႔းပ စြငမ (၃) ပါး ငး းလပအ ႏက ထစ႔ စငညပမ ကစင းလပ င ဒသ၏ ႔န႔ စ ဖငည (င နး႔ေ က႔ထကး(မညညလးလပ(အကးအ ကးးစ႔ းလပး႔ ငႏငည႔ကစအး႔ ငအကဖစႏ ဖ မး း႔ေ း ဥပေ ပါလး ငးလေဆကင စ႔ အမညသည။

(4) Any Employee who attended training paid for by the Employer shall be subject to the relevant provision of the Employment and Skills Develop-ment Law (2013) in the event of a resignation from work in accordance with the above sub-sub-paragraph (3).

းလပအ ပစြ ငး၊ထပမ ငး (b) Termination

(၁) အလပရငသည အလပသမာားအာား အလပရပစြသညဖအခ ခ ငလ ေသာ အေကာငားျပခကျ ငဖ မတတမားမတရာမာားေဆာငရြကထာားရ ၿပား ရ ားအမ န႔စာျ ငဖ အလပရင သ ႔မဟတ အလပရငက နစာားတာ၀နရ သက လကမတေရားထ ား၍ အလပသမာားအာား ေပားၿပားမ အလပမရပစြရမည။ အလပသမာားအာား အလပမ ရပစြျခငားင၊ ထတပနျခငား က စၥရပမာား အာားလ ားသည အလပရငတြငသာ တာ၀နရ သည။

(1) If the Employer terminates the employment of the Employee, the Employ-er or a person on behalf of the Employer shall sign and give the Employee an official notice and keep records of the reason for the termination. The Employer shall solely be responsible for all matters regarding the termina-tion or dismissal of the Employee.

(၂) (အထကးေ(ကစမညး႔အး ႔အ ကး႔ ေဖက႔ဖ ႔႔ ကးလစန(မညည းလပ(အကး အ ကးးကး (ကအနပစအကအ ကးးစ႔ ပထအးၾ႔ အ စာဖငည( ေပး ငး၊ မ းၾ႔ အစကဖငည ( ေပး ငး၊ မးၾ႔ အ န ႔ လ႔အ ေ း ထ းေစ ငး စ(မညည ( ေပး ငး ၃ ၾ႔ အပမလပပးေနက႔ ၁၂ လ အတြငား အလပသမာားသည သာမနျပစမႈက ထပအ႔ ကးလစန ြညလ ငလ းလပ င(မညလ နစနကေၾ႔းေပး န အလ ဘြးလပအ ပစြ ႏ င(မညသည။(ကအနပစအက စ လ႔ မးလစန ပးပါ႔ ၁၂လးစငး ေနက႔ထပပစအကလစစစ က႔ ကးလစန ငးအ လ ငဖစေစလလ မးႀ႔ အ ႔ ကးလစန ြည ပးေနက႔လ၁ ၂လလ

လးစငးထပအ႔ ကးလစန ြည ငးအ လ ငဖစေစ ထ ႔ ကးလစန ြညေ(က ပစအကးကးလး႔ းလပ ငအေ ဖ ႔ေပး အမညသည။

(2) If the Employees violates the prescribed rules, the Employee shall – for or-dinary misconduct – be given a written warning for the first violation, a written warning for the second violation and sign an undertaking for the third violation. In the event of any further violation within twelve months after the third violation, the Employer may terminate the employment of the Employee without payment of severance pay/compensation. If the Employee does not commit any further violation within twelve months from the third violation, or if no other violation is committed within twelve months after a case of ordinary misconduct, all previously committed viola-tions shall be cancelled.

(၃) းထ႔းပ စြငမ(၁)အးပ းလပ(အကးအ ကးးကး မညဆြဥပေ ၊ နမညးဥပေ ၊ စမညးအ ဥးစမညး႔အးအ ကးႏငညးမည းလပ င႔ စလဒက င းေၾ႔ကငးၾ႔ကး၍ (အထကး(မညညနစနကေၾ႔းေပးပး းလပအ ပစြႏ င(မညသည။လ( ကစငလဥပဥပေ ပဌကနး ႔၊လလပထး လပနမညးအ ကးႏငညဆန႔ င၍လးလပ(အကးးကးလးလပ ထ ငးအ မးအဖစေစ သည။

(3) Other than in accordance with above sub-sub-paragraph (1), the Employer may terminate the employment by giving at least one months’ prior notice to the Employee and payment of severance pay in accordance with the applicable labour laws. The Employee shall however not be dismissed in contravention of provisions of law and regulations.

(၄) လပ(ကးေလ ကည ငး၊လးလပ(အကးးကးလးလပအ ပစြ ငး းစ႔ လ းလပ င (မညလ းလပ(အကးးဖစြ းစမညးအ ပါ႔ းလပ(အကးေ း က လပငနးမည ႏ ကငးေ း ေ႔ကအႏငညမည ႏက ငးေဆကင စ႔ အမညသည။းလပ(အကးးဖစြႏးစမညစမညးလ ပါ႔လး လပ(အကးလးးဖစြႏးစမညးဒသ၏လ႔ မစကးလမႏငညလးလပ(အကးေ း ကလလလပငနးမည ႏက ငးေ းေ႔ကအလဒသ၏႔ မစကးလမ ပးေပါငး၍လးလပ င( ႏအႏအမ လးလပ င ႔ မစကးလမႏငညလမည ႏက ငးေဆကင စ႔ အမညသည။

(4) In the absence of a Labour Organization, the Employer shall coordinate with a Labour Affairs Negotiation Work Committee in respect of redundan-cies and termination of employment of Employees. If a Labour Organiza-tion has been formed, a representative of the Labour Organization and a representative of the Labour Affairs Negotiation Work Committee shall jointly negotiate with the Employer or his representative.

၁၆။ စက မပ ပစြ ငးသည။ 16. Termination of Employment Contract

ေးက႔ပါး ႔အ ကးေၾ႔ကငည (ေဘကစက မပ ပစြႏ င(မည - The Employment Contract may be terminated for the following reasons:

(က) စ႔ /အလပရ င၊ အလပဌာနင၊ ကမၸဏင၊ လပငနားဖ ႔( အး ငး၊ (a) Winding up of the factory/workshop;

(ခ) အေအ ကအနးႏ ငေ(က ဖစ ပေၾ႔ကငည လပငနး ပဆ ငး(စကး ငး၊ (b) Cessation of the Employer’s business by reason of unforeseeable events; and/or

(ဂ) းလပ(အကးေ(ဆး ငး၊ (c) Death of the Employee.

၁၇။ စာခပပစညားကမားခကအတ ငားတာ၀နရ မႈမာား 17. Contractual Obligations

(က) းလပ ငဒသ၏ ကန ကးအ ကး (a) Obligations of the Employer:

(၁) း(ငးးဖစြႏင ဖစအက၊လလအ မး၊လဘက(က၊လ႔ ကး/မင၊ အသကအရြနကြာျခာားမႈအေပခမတည၍ ခြြျခာားဆကဆ ျခငားင၊တနားတအခြငဖအေရားမေပားျခငားတ ႔က မျပလပရင၊

(1) The Employer shall not discriminate or deny equal treatment to the Employee based on union membership, race, religion, gender or age;

(၂) အနအကႏ ငင( လကေ က႔းလပလပ႔ င(မညည ႏ ငင ကး(ကး းလပ ငအ ကး၊ ၾ႔းၾ႔ပ( အ ကး၊ပမညက ငအ ကးႏငည အ (ကးစငအ ကး(မည အနအကႏ ငငဒသ၏ မညဆြ ဥပေ အ ကး၊ မဥေ႔ းအက ႏငည ဓေလညထးစအ ကး႔ ေလးစကးလ ႔နက အမည၊

(2) Foreign Employers, supervisors, professionals and family members shall respect and abide by the applicable laws as well as the culture and customs of the Re-public of the Union of Myanmar;

(၃) မညဆြးလပ(အကးေ း က ဥပေ အ ကးးပါးငလ အနအကႏ ငငဒသ၏ မညဆြး ကး ဥပေ အ ကး ႔ လေလးစကးလ ႔နက အမည၊

(3) The Employer shall respect and comply with the applicable laws of the Republic of the Union of Myanmar;

(၄) ဥပေ ႏငညးမည ကးစစြဆ စငညႏငည ကးစစြဆ ႏ င စငည အမညသည။ (4) The Employer shall have the right to sue and be sued in accordance with the

applicable laws;

(၅) အလပရငသည အလပသမာားမာား၏ ရပ ငခြငဖမာားင၊ ခ စာားပ ငခြငဖမာားာငဖ စပလ ား၍ အလပသမာားမာား အာား ပြငဖလငားစြာ အသ ေပားထာားရမညင၊

(5) The Employer shall inform the Employee about their rights and benefits of the employment; and

(၆) အလပရငသည လပငနား၏လ အပခကအရ လပငနားခြငေဘားအာရာနကငားရငားေရားက အထား ားစာားေပားေဆာငရြကရမည။

(6) The Employer shall give special priority to workplace safety and health in ac-cordance with the needs of the business.

(ခ) အလပသမာားမာား၏တာ၀န၀တရာားမာား (b) Employee’s obligations

၁) အလပသမာားသည လပငနား၏လ အပခကအရ ထတျပနထာားေသာ လပငနားခြင ေဘား အာရာန ကငားရငားေရား ဆ ငရာ ညလနကာားခကမာားက လ ကနာေဆာငရြကရမညင၊

(1) The Employee shall comply with instructions issued in accordance with needs of the enterprise concerning the workplace safety and health;

(၂) လပငနး စင းစငး( အငေ က႔အ လပငနးလ းပ ႔ း (အထကးေ(က လပငနး စင း႔ကး႔စမေပးေ း ပစစမညးအ ကး႔ စနစ႔ ဆင အမညသည။

(2) Before entering the workplace, the Employee shall wear workplace safety equipment as prescribed in accordance with the operational needs of the Em-ployer;

(၃) လပငနး စငႏငညးလပ နးစငးလအးမစေဆးါးအ ကး႔ လေ(က႔စကး ငး၊လလပေဖက႔ ငဖ႔ အ ကး႔ စ င မငငေးကငေႏကငညမ႔ ငးးႏ ကမေပး ငး၊လ႔ မထ လ႔ေ က႔ ႔ ကးလစန ေစက႔ကး ငးအ ကးအပမလပ ၊

(3) The Employee shall refrain from consuming intoxicants or causing harassment, danger or physical harm to colleagues at the workplace and during working hours;

(၄) အလပရငမဒက တင ြငဖဟထာားသညဖ လ ႕၀ကအပေသာ သတငားအခကအလကမာားက ျပငပသ ႔ မေပကကာားေအာငထ နားသ မားရမည။ အခြငဖအမ န႔မရ ဘြ လပငနားာငဖဆ ငေသာ စာရြကစာတမားမာားင၊ စာရငားမာားင၊ မတတမားမာားက ထတာႈတအသ ားျပျခငားင၊ ကားနျခငားင၊ နရာားျခငားင၊ ေ ာက ကျခငားင၊ ျပငပသ ႔နေဆာငသြာားျခငားမျပရင၊

(4) The Employee shall not, without permission, disclose confidential information of the Employer. The Employee shall not extract, use, copy, remove, delete and/or carry outside any documents, accounts and/or records related to the business of the Employer;

(၅) းလပ ငႏငညလးလပ(အကး႔ မစကးလမအ ကး မည ႏက ငး(ေဘကမည ထကး(မညညး ါလးကးေလ ကစစကလထ ပနထကး(မညညစမညးအ ဥးစမညး႔အးအ ကး႔ လလ ႔နက အမည၊

(5) The Employee shall abide by the rules and regulations issued from time to time upon mutual agreement between representatives of the Employer and Employ-ee;

(၆) အလပသမာားသည တညဆြ ပေ မာားအတ ငား ထညဖ၀ငေပားေဆာငရမညဖ အခြနအခမာားက သတမတာႈနားထာားမာားအတ ငား ေပားေဆာငရမညင၊

(6) The Employee shall pay taxes and fees in accordance with the applicable laws;

(၇) တညဆြအလပသမာားေရားရာ ပေ မာားက ေလားစာားလ ကနာရမညင၊ (7) The Employee shall respect and comply with the applicable labour laws; and

(၈) ဥပေ ႏငညးမည ကးစစြဆ စငညႏငည ကးစစြဆ ႏ င စငည အမညသည။ (8) The Employee shall have the right to sue and be sued in accordance with the

applicable laws.

၁၈။ အလပခန႔ထာားမႈဆ ငရာ သေဘာတညခကစာခပအာား အလပရငာငဖ အလပသမာားာစ ား သေဘာတ ကသ မားျခငား

18. Cancellation of the Employment Contract by mutual agreement between the Employer and Employee

အလပရငာငဖ အလပသမာားာစ ားာစ က သေဘာတညခကျ ငဖ မလခပဆ ထာားေသာ အလပခန႔ထာားမႈ ဆ ငရာသေဘာတညခက စာခပအာား ကသ မားာ ငသည။ The Employment Contract originally executed may be cancelled upon mutual agreement between the Employer and Employee.

၁၉။ အျခာားက စၥရပမာား (အလပရငာငဖအလပသမာားအျငငားပြာားမႈမာားက ေျ ရငားျခငား) 19. Other matters (resolution of disputes between Employer and Employee)

အလပရငာငဖ အလပသမာားမာားအျငငားပြာားမႈမာားေပခေပကပက ာစ ားာစ က ည ာ ႈငား နေျ သညဖနညားျ ငဖ ေျ ရငားရမည။ အကန၍ ေျပလညေအာင ေျ ရငားာ ငျခငားမရ ပက ၂၀၁၂ ခာစ အလပသမာားေရားရာ အျငငားပြာားမႈေျ ရငားေရား ပေ ာငဖ တညဆြ ပေ မာားအတ ငား ေျ ရငားေဆာငရြကရမည။

Any dispute arising between the Employer and Employee shall be resolved through media-tion. If a resolution cannot be achieved, the dispute shall be resolved in accordance with the applicable labour laws (including the Labour Disputes Resolution Law (2012)).

၂၀။ စက မပစမညး႔အးအ ကး႔ လ(အ ငး၊ ပငဆင ငးႏငညဖမညညစစ႔ ငး 20. Regulation, modification and addition of contract terms

းမည ပမလ႔အေ းထ းၿပားေ(က းလပ နထကးအကဆ င က (ေဘကမည ႔စက မပ႔ (႔ဆ င က အ မႏနမ းလပး႔ ငႏငည းလပ(အကး ကေဖစေ း းအ ကး( ေပးပ ပ အမညသည။ထ ပင မညဆြးလပ(အကး ဥပေ အ ကးႏငညးမညပငဆင ငးႏငညဖမညညစစ႔ ငးပမလပလ ပါ႔ းလပ ငႏငညးလပ(အကးႏစဥးႏစဖက မည ႏက ငးေဆစးေႏစးပငဆငဖမညညစစ႔ ပးေနက႔းဆ ပါလ(ေဘကစက မပး(စ႔ လလမညးငပ အမညသည။ The signed Employment Contract shall be sent to the relevant Township Labour Office. Any amendment of the registered Employment Contract shall be in accordance with the appli-cable labour laws, be negotiated by the Employer and Employee and sent to the relevant Township Labour Office.

၂၁။ အေထြေထြ 21. Miscellaneous

(က) အလပသမာားသည အလပသမာား ပေ ာငဖ ဆကစပလကရ ေသာ ပေ မာားတြင ပ၀ငသညဖ ရပ ငခြငဖမာား အကာအကြနာငဖ အက ားခ စာားခြငဖအာားလ ားက ခ စာားခြငဖရ သည။

(a) The Employee shall be entitled to enjoy all rights, protections and benefits provided by the applicable labour law and other related laws.

(ခ) လ အပပကတညဆြ ပေ မာားာငဖမဆန႔ကငေသာ သကဆ ငရာ လပငနားခြငသဘာ၀အရ ထတျပန ထာားသညဖတညၿမြအမ န႔ာငဖအလပခြငအတြငားလ ကနာရန စညားမ ားစညားကမားာငဖ ရပ ငခြငဖမာားက ပါကဤစက မပဒသ၏စစ စေ (းဖစအ မ အမညသည။

b) Any employment manual of the Employer prescribing work place regulations and rights, which does not contravene prevailing laws, shall be deemed a part of this Em-ployment Contract.

(ဂ) အလပခန႔ထာားမႈဆ ငရာသေဘာတညခကစာခပအာား လပငနား၏သေဘာသဘာ၀အရ တညဆြ အလပသမာား ပေ မာားပရပ ငခြငဖာငဖအခြငဖအေရားမာားေအာက နတေလာဖျခငားမရ ဘြ အျပညျပည ဆ ငရာစ ခ နစ ညလနားမာားာငဖအည သကဆ ငရာ စကရ င၊အလပရ င၊ အလပဌာနင၊ ကမၸဏင၊ လပငနားမ အလပရငာငဖ ၅၀ ရာခ ငာႈနားထကေကာေသာ အလပသမာားမာား၏ သေဘာတညခကျ ငဖ ျပငဆငျ ညဖစြကာ ငသည။

(c) The Employment Contract may upon mutual agreement between the Employer and the majority of Employees be amended in accordance with the nature of the enter-prise and subject to the applicable labour laws and international standards.
