The Sales promotions Permit Application must be filed before the start of the duration

General Rule on Duration – Sales promotion campaigns shall have duration of not more than a year, extendible to a maximum of six (06) months, except for discount which is three (03) months inclusive of the extension. However, in case of closing out sales, the period shall be six (06) months

• Single city/municipality/ province - the application shall be filed at the Department’s provincial office in that province, or, in the absence thereof, at the Department’s regional office which has jurisdiction over the said province.

• 2 or more cities/municipalities/ province within a single region - the application shall filed at the Department’s regional office which has jurisdiction over said provinces

Where to file sales promotion applications, if it involves:

• Single city/municipality/ province - the application shall be filed at the Department’s provincial office in that province, or, in the absence thereof, at the Department’s regional office which has jurisdiction over the said province.

• 2 or more cities/municipalities/ province within a single region - the application shall filed at the Department’s regional office which has jurisdiction over said provinces

•  National Capital Region or in several regions including NCR - the application shall be filed at the Department’s regional office in the National Capital Region (NCR)

•  More than one region but excluding NCR - the application shall be filed at the Department’s regional office where the main office or the coordinating office of the sponsors is located, whichever is nearest to the areas to be covered by the sales promotion campaign.

Changes on Approved Promotions which have not yet started, if letter request states that no advertising material or collateral has been released and that revisions shall be incorporated in the advertising material or collateral to be released, check the submitted advertising material for consistency.

Changes on Approved Promotions which have already started, if proposed changes in the letter request will be beneficial to consumers who have already participated in the promotion, otherwise application shall not be approved.

Changes on Approved Promotions which have not yet started, check if letter request states that no advertising material or collateral has been released and that revisions shall be incorporated in the advertising material or collateral to be released, check the submitted advertising material for consistency.

Changes on Approved Promotions which have already started, check if proposed changes in the letter request will be beneficial to consumers who have already participated in the promotion, otherwise application shall not be approved.

Extension of duration - Not more than 6 months, except for discounts which shall not exceed 3 months including the original duration (closing out sale maximum of 6 months)

- Deadline for submission of entries - Shall be at least one day before the determination of winners unless, otherwise, the one day period is impracticable

-  Draw date / determination of winner/s - Not more than 2 weeks from the last day of the deadline of submission of entries

- Prizes - There must be additional prize for additional winner

3.  Only changes that are beneficial to consumers will be approved. Changes as well as the fact of approval shall be published, announced or advertised at least twice before such change is effected in the same manner and medium that the sales promotion was originally announced, published or advertised.

7. There shall be no cancellation

of ongoing sales promotion except upon approval from the Department.

Grounds for the cancellation of ongoing sale promotion:

-  Final judgment of insolvency of the sponsor/s from a court of proper jurisdiction -  The occurrence of a fortuitous event that will make it impossible for all sponsors to continue to deliver the products or services which has to be purchased for in order for one to participate in the promotion; Provided that all those that have won in the promotion before the cancellation was approved shall be paid their prizes.

3. Sales promotions (other than Beauty Contest and Home Solicitation Sales), the Permit fees for the conduct of sales promotion schemes shall be as follows:

Based on Geographic Coverage - NCR only or in several regions including Metro Manila or nationwide – Php 1,000.00 - More than one region but excluding Metro Manila - Php 750.00

5. Amendment Fee - Minor changes (change in draw date and venue) shall be subject to Php100.00 application fee - For extension and other changes requiring re- evaluation shall be subject to Php 300.00 processing fee

•  For applications covering more than one scheme, each scheme will be subject to a separate processing fee.

5. Amendment Fee - Minor changes (change in draw date and venue) shall be subject to Php100.00 application fee - For extension and other changes requiring re- evaluation shall be subject to Php 300.00 application fee

For applications covering more than one scheme, each scheme will be subject to a separate permit fee based on the schedule.

Note:

For payments made by mistake; it shall be refunded to the payor, not directly but by way of crediting the mistake payments to future obligations of the payor to the same concerned agency/office.

2. Permit #s shall be assigned sequentially. For Area/Provincial Offices, the Area Code will be added as a prefix as An-XXX, where n is the Area Code, and XXX is the sequential number.
