    New Policy for Selection, Appointment and Management of Consultants under the Purview of the Engineering and

    Associated Consultants Selection Board – Pre-registration Exercise

    Background Development Bureau (DEVB) has recently conducted a review of the policy on the selection, appointment and management of consultants under the purview of the Engineering and Associated Consultants Selection Board (EACSB). Objective The review aims at achieving the following objectives, with corresponding measures to be implemented in phases:

    i. promote healthy competition; ii. reinforce value-for-money (VFM) based procurement;

    iii. improve monitoring and disciplinary mechanisms; and iv. enhance co-ordination among bureaux and departments.

    The List Among the new measures to be promulgated, a list of consultants will be established under the purview of the EACSB (the “List”). The existing nine EACSB Service Categories will be adopted for the listing purpose and each of the Service Category will be divided into two to three Groups of consulting firms according to the size of the firms.

    Pre-registration Consulting firms are required to apply for admission to the List through a formal registration process. To gauge the number of consulting firms in each Service Category and Group prior to the formal registration process, you are cordially invited to express your interest on a non-committal basis in admission to the List under this pre-registration exercise by completing and returning the reply slip enclosed. The administrative rules (Annex I), bidding restrictions (Annex II) and forecast of consultancies (Annex III) are enclosed herewith to facilitate your consideration of deciding your preferred Service Category and Group. Your attention is drawn to the Note for Pre-registration at the back of the reply slip. Phased Implementation Based on the outcome of the pre-registration exercise, we may refine the administrative rules and bidding restrictions as appropriate. It is planned that the formal registration process will commence in mid-2018. Consultants will be eligible to undertake an engineering and associated consultancy assignment under listed Service Category only if they are admitted to the appropriate Service Category and Group of the List upon promulgation of the relevant administrative rules and bidding restrictions in end 2018 or early 2019. As for other new measures to be implemented in phases, please refer to Annex IV for the tentative target dates. Enquiries

    2. A consulting firm may select more than one Service Category, but not more than one

    Group in each Service Category. 3. If more than one Group in each Service Category are selected, the higher Group will be

    taken as the actual interested Group of the consulting firm.

    4. The Annexes attached hereto including the administrative rules, the bidding restrictions and a phased implementation plan are in draft forms only and are subject to further review and changes. They should only be used for reference purpose only in this pre-registration exercise. DEVB reserves the right to amend any part(s) of them at any time without prior notice to you.

    5. A consulting firm’s interest indicated in the reply slip will not affect the consulting firm’s

    eligibility in the formal registration process or any future admission to any Category or Group in the List, i.e. the consulting firm is not obliged to follow the same Service Category(ies) and Group(s) indicated in the reply slip for this pre-registration exercise in its future formal application for admission to the List.

    6. The participation in the pre-registration exercise and/or the use of the information in the

    reply slip by DEVB does not give any consulting firm any advantage or guarantee as to its subsequent application for formal admission to the List.

    7. The forecast of consultancies is issued in good faith, but in no way suggests or indicates

    that consultancies will be invited for the particular projects listed. The date of inviting expression of interest / proposals as mentioned in the forecast of consultancies refers to the probable date of inviting expression of interest from longlisted consultants / listed consultants in the List for a project, or the probable date of inviting technical & fee proposals from an initial list of consultants for a project if one-stage consultants selection process is adopted, but in no way suggests or indicates the consultancies will be invited, whether at the time stated or at all. The consulting firm acknowledges and confirms that the decision to participate in the pre-registration exercise has not been taken in reliance of the information contained in the forecast of consultancies.

    Draft Administrative Rules of the List of Consultants [for reference in the pre-registration exercise only]

    1. Categories The EACSB maintains a List of Consultants (the List) for undertaking the following categories of engineering and associated consultancy services:

    2. Grouping

    Civil Infrastructure and Development, Drainage and Sewerage, Geotechnical and Slope, Roads and Associated Structures and Waterworks Service Categories are each divided into 3 Groups of consulting firms to accord with

    the size of the firms, while Electrical and Mechanical, Environmental, Town Planning and Traffic and Transport Categories are each divided into 2 Groups.

    3. Criteria for Inclusion in the List Each Group will have its own prescribed admission criteria to be determined by the Managing Department of the respective Service Category (Attachment A). Consulting firms which wish to be listed may apply for inclusion on the relevant lists of appropriate Service Category and Group.

    4. Rules for Inclusion in the List (a) A consulting firm may apply for inclusion in more than one Service

    Category subject to compliance with the corresponding admission criteria.

    (b) A consulting firm can be listed on more than one Service Category but not more than one Group within the same Category, including associated companies (subsidiaries, parent/sister companies), unless the companies are separate legal entities and there is no overlap of personnel.

    (c) A consulting firm may apply for direct entry/promotion to a higher

    Group, subject to compliance with the minimum admission criteria for that particular Group.

    5. Changes to the List (a) A listed consulting firm may be demoted or delisted if it fails to

    comply with the minimum listing criteria of the Group concerned; and

    (b) A listed consulting firm may apply for change to a lower Group, subject to compliance with the corresponding listing criteria of that Group. In the third phase of the implementation, upon approval, the company will be debarred from application for change of Group within 12 months.

    6. Validity and Renewal In the third phase of the implementation, the validity of the listing will be for a period up to a pre-defined date each year. Listing thereafter will expire automatically. The consulting firms are required to renew their listing status annually if they wish to remain on the list. In assessing the renewal applications, apart from the consultants’ performance in undertaking the assignments, its participation and performance in tendering exercises in the past year will also be considered.

    7. Office Audit on Consultants (a) Office audits on selected consultants for verifying the company

    information and documents submitted by the consultants will be conducted each year during the annual renewal exercise.

    (b) Notwithstanding the annual office audit, if there is information that would give rise to reasonable suspicions as to the technical capability of a firm, e.g. reduction of staff resources dramatically or unsatisfactory performance recently etc., additional office audit may be conducted at any time of the year.

    Remarks for Appendix A 1. Both relevant public/private sector agreements will be counted for assessing

    history/standard of work for admission.

    2. For agreements completed by the applicant as a participant or shareholder in the joint venture or as a sub-consultant, only the part of the agreement completed by the applicant shall be accredited and shall be calculated in accordance with his share of works by value. The part completed by the applicant shall be relevant to the services under the Category he is applying for. The applicant shall provide sufficient evidence to demonstrate the experience acquired as a participant or shareholder in the joint venture or as a sub-consultant from his completed part of the agreement.

    3. Completion of agreement refers to the issue of letter of completion of the services.

    4. “Value” refers to the client’s estimated value of completed services and, in case of agreements completed by the consultant as a participant or shareholder in the joint venture or as a sub-consultant, the shared value of completed services undertaken by the applicant.

    Draft Bidding Restriction [for reference in the pre-registration exercise only]

    1. General (a) To promote competition and widen participation, bidding restrictions

    will be imposed taking into consideration a combination of two factors: “estimated lump sum fee” and “complexity of the assignment”. Cross-Group bidding is only allowed in a controlled manner as shown in Figure 1:

    (b) The complexity of each assignment will be determined by the procuring department following the prescribed criteria laid down by the managing department of the particular Service Category. Details of the classification of assignment complexity for the main Service Categories are enclosed at Attachment B.

    2. Bidding as Sole/Lead Consultant

    (a) For assignments under listed Service Category, the sole/lead consultant

    should have the listed Group status for that particular type of assignment as stipulated in Figure 1. For example, a “complex” assignment with estimated lump sum fee exceeding $5M but not exceeding $10M under Service Categories with three Groups, consulting firms in Group 2 and 3 can bid as sole/lead consultant. For a “normal” assignment with estimated lump sum fee exceeding $5M but not exceeding $10M under Service Categories with three Groups, only consulting firms in Group 2 can bid as sole/lead consultant.

    (b) For assignments not under the listed Service Category, the Assessment Panel should select suitable consultants from all reasonably available sources to form a non-restrictive list based on the agreed selection criteria. The invitation of expression of interest (or technical & fee proposals under one-stage selection process) shall not be restricted to the consultants on the list. Other suitable consultants not on the list should also be considered.

    3. Bidding as Sub-consultant

    (a) For assignments under listed Service Category requiring the engagement

    of sub-consultants, the lead consultant will be allowed to choose freely sub-consultants1, subject to compliance with the following requirements:

    if there are appropriate Service Category for the sub-consulting services, irrespective of whether the sub-consulting service is of the same or different Service Category, the lead consultant can choose any listed consulting firms with the Group status as stipulated in Figure 1 or from a lower Group as sub-consultant. For example, a “complex” assignment with estimated lump sum fee exceeding $5M but not exceeding $10M under Service Categories with three Groups, consulting firms in Group 1 to 3 in the respective category of the sub-consulting services can be engaged as sub-consultant. For a

    “normal” assignment with estimated lump sum fee exceeding $5M but not exceeding $10M under Service Categories with three Groups, only consulting firms in Group 1 to 2 can be engaged as sub-consultant; and

    if there is no appropriate Service Category for the sub-consulting services, the procuring department may provide a non-restrictive list of sub-consulting firms based on all reasonably available sources for the tenderers’ reference.

    (b) For assignments not under the listed Service Category requiring the

    engagement of sub-consultants, the lead consultant will be allowed to choose freely the sub-consultants, subject to compliance with the following requirements:

    if there are appropriate Service Category for the sub-consulting services, consulting firms eligible to be the sub-consultant should also be determined by referring to Figure 1 as if the assignment is under the respective listed Service Category. For example, a “normal” assignment2 with estimated lump sum fee exceeding $5M but not exceeding $10M, only consulting firms in Group 1 and 2 can be engaged as sub-consultant; and

    if there is no appropriate Service Category for the sub-consulting services, the procuring department may provide a non-restrictive list of sub-consulting firms based on all reasonably available sources for the tenderers’ reference.

    4. Bidding as Joint-Venture

    (a) For assignments under listed Service Category, the following bidding

    restrictions will be imposed on joint venture:

    only joint venture formed by two or more listed consulting firms with the listed Group status for that particular type of assignment as

    stipulated in Figure 1 are allowed3. For example, a “complex” assignment with estimated lump sum fee exceeding $5M but not exceeding $10M under Service Categories with three Groups, joint venture of consulting firms in Group 2 and 3 can be formed. For a “normal” assignment with estimated lump sum fee exceeding $5M but not exceeding $10M under Service Categories with three Groups, joint venture of consulting firms in Group 2 can be formed; and

    (b) For assignments not under the listed Service Category, joint venture of

    all suitable consultants fulfilling the selection criteria agreed by the Assessment Panel can be formed.

    5. Bidding as Sub-consultant and Joint-Venture by an Unlisted Consulting Firm

    (a) unlisted consulting firms are allowed to be engaged as sub-consultant by a listed consulting firm, if the unlisted consulting firm has made application for inclusion on the relevant Category and Group to EACSB before tender submission and there is no precedent that the unlisted consulting firm has made similar attempts in previous tendering exercise.

    (b) unlisted consulting firms are allowed to form joint venture with listed consultants subject to similar conditions for sub-consultants in (a) above. Moreover, the consulting firm(s) with the listed Group status as stipulated for that particular type of assignment should have a share of participation of not less than 50%.

    6. Procurement by Quotation (a) For procuring engineering and associated consultancies not exceeding

    the financial limit as set out in Section 220 of Stores and Procurement Regulations (currently, at $3M), Figure 1 is still applicable. For assignments under the listed Service Category, only listed consulting firms in Group 1 shall be invited to submit quotation for the consultancies of “normal” complexity, whereas only listed consulting firms in Groups 1 and 2 shall be invited to submit quotation for consultancies of “complex” nature. Likewise, restriction on

    sub-consulting and formation of joint-venture mentioned above will also be applicable.

    7. Exemption to Bidding Restrictions (a) If a procuring department intends to deviate from the proposed bidding

    restrictions, personal approval of the Head of Department shall be sought and EACSB and DEVB shall be informed. Examples of situations requiring exemption are below:

    Engagement of sub-consultant of higher Group for sub-consulting service under listed Service Category;

    Engagement of unlisted consultants for services under listed Service Category.

    8. Tender Award Restrictions

    (a) The tender award restrictions imposed under the “Paired Tendering”

    approach will remain unchanged.

    (b) Tender award restrictions will be imposed on new entrants to the EACSB market, i.e. those consulting firms without relevant public works engineering services experience under EACSB. The arrangement is as shown in Figure 2:

    (c) The restrictions will be lifted after the consulting firm has satisfactorily executed an EACSB assignment for two years or upon satisfactory completion of one public/private-sector assignment4 of appropriate scale and complexity within 5 years, after inclusion on the List/Group.
