Infrastruktura e shërbimit dixhital të Porsche / Porsche ID

Ne, Porsche Smart Mobility GmbH (referuar në vijim si "ne" ose "PSM GmbH"), gëzohemi që po përdorni infrastrukturën e shërbimit dixhital të Porsche dhe ofertat tona të tjera dixhitale (gjithashtu, referuar në vijim individualisht ose bashkërisht si "shërbimet" dhe bashkërisht si "Infrastruktura e shërbimit dixhital të Porsche"), si dhe për interesin tuaj për kompaninë dhe produktet tona. 2. Objekti i mbrojtjes së të dhënave

Objekti i mbrojtjes së të dhënave është mbrojtja e të dhënave personale. Kjo ka kuptimin e krejt informacionit në lidhje me një person natyror të identifikuar ose të identifikueshëm (të njohur si “subjekti i të dhënave”). 3. Natyra, shtrirja, synimet dhe bazat ligjore të përpunimit

Kjo Politikë e Përgjithshme e Privatësisë ju ofron një vështrim të përgjithshëm të natyrës, shtrirjes, synimeve dhe bazave ligjore të përpunimit të së dhënave brenda kuadrit të regjistrimit, krijimit dhe përdorimit të llogarisë suaj të përdoruesit Porsche ID si dhe rezervimit dhe përdorimit të Shërbimeve tona në bazë të llogarisë

suaj të përdoruesit Porsche ID. Në tekstin vijues ju do të gjeni edhe informacion për mbrojtjen e të dhënave dhe privatësinë, të tillë si për marrësit e të dhënave personale, përpunimin e të dhënave në vende të treta dhe të drejtat tuaja si subjekt të dhënash, çfarë zbatohet në përgjithësi brenda kuadrit të përdorimit të Infrastrukturës të Shërbimeve Dixhitale të Porsche-it. Për informacion më të hollësishëm rreth përpunimit të së dhënave personale, në lidhje me përdorimin e Shërbimeve individuale, bazave ligjore përkatëse dhe të drejtave specifike të subjekteve të së dhënave në lidhje me Shërbimin përkatës, lutemi shihni edhe Politikën përkatëse Specifike të Privatësisë dhe, atje ku vlen, njoftimet e mëtejshme specifike të privatësisë, që lidhen me Shërbimin përkatës.

4. Llogaria e përdoruesit Porsche ID

Për të përdorur të plotë Infrastrukturën e Shërbimeve Dixhitale të Porsche-it dhe Shërbimet e ofruara brenda saj, është e nevojshme që të regjistroheni dhe të krijoni një llogari përdoruesi Porsche ID në My Porsche. Pasi ta kryeni procesin e regjistrimit dhe të krijoni llogarinë e përdoruesit Porsche ID, do të merrni edhe një Porsche ID tuajën (emrin e përdoruesit për llogarinë e përdoruesit Porsche ID). Gjatë regjistrimit dhe kur po krijoni dhe përdorni llogarinë tuaj të përdoruesit Porsche ID, të dhënat personale përpunohen nga palë të treta dhe mund t’u transferohen atyre, siç përshkruhet më poshtë, që ne të plotësojmë detyrimet tona kontraktuale në këtë kontekst. Përveçse kur specifikohet ndryshe, ne i kryejmë të gjitha operacionet e përpunimit të përshkruara në këtë seksion në zbatim të kontratës që ekziston mes jush dhe nesh, në bazë të Nenit 6(1)(b) të GDPR.

4.1 Procesi i regjistrimit dhe krijimi i llogarisë suaj të

përdoruesit Porsche ID

Mund të zgjidhni një nga dy mënyra për t’u regjistruar dhe për të krijuar llogarinë tuaj të përdoruesit Porsche ID:

4.1.1 Ftesë nga një koncesionar i autorizuar

Nëse dëshironi, koncesionari juaj i autorizuar do të futë në emrin tuaj të dhënat personale që ju keni dhënë, përmes aksesit të koncesionarit në sistemet tona. Pastaj ju do të merrni një lidhje me email, për shembull, që do t’ju duhet ta përdorni për të konfirmuar regjistrimin tuaj dhe krijimin e llogarisë së përdoruesit Porsche ID. Lutemi mbani parasysh se koncesionarët e autorizuar janë kompani të pavarura dhe se ne nuk kemi ndonjë ndikim mbi ta. Një faktor i dytë do të përdoret për verifikim të mëtejshëm, për shembull një kod i dërguar me mesazh tekst, që ju pastaj do ta futni si pjesë të procesit të regjistrimit dhe krijimit të llogarisë suaj të përdoruesit Porsche ID.

4.1.2 Vetë-regjistrimi

Në rast se regjistrimi dhe krijimi i llogarisë tuaj të përdoruesit Porsche ID nuk është kryer nëpërmjet një shitësi të autorizuar, mund ta regjistroni ose krijoni vetë llogarinë e përdoruesit Porsche ID dhe të jepni të dhënat personale në mënyrë të pavarur. Në shtetet e zgjedhura, mund të shtoni gjithashtu një automjet dhe të përdorni shërbimet e tjera dixhitale që kërkojnë të jeni në pronësi të një automjeti. Gjithashtu, duhet të ngarkoni një kopje të mjetit të identifikimit, vërtetimin e pronësisë dhe, nëse nuk jeni pronari i automjetit, prokurë nga pronari i tij pasi të keni dhënë numrin e identifikimit të automjetit. Këto dokumente i transferohen mbështetjes së Porsche Connect ose, në shtetet ku gjuha zyrtare e të cilave nuk mbështetet nga mbështetja e Porsche Connect, direkt te shitësi i zgjedhur nga ju dhe kontrollohen lokalisht duke përdorur kriteret tona të verifikimit. Si vërtetim i verifikimit me sukses, ne ruajmë gjithashtu emrat, datëlindjet, vendlindjet dhe adresat që shfaqen në dokumentet përkatëse të identifikimit, së bashku me datat e vlefshmërisë së dokumenteve, si dhe numrat e identifikimit të automjeteve, emrat e përdoruesve dhe adresat që shfaqen në vërtetimin e pronësisë. Pas përfundimit të verifikimit, kopjet e dokumenteve do të fshihen. Nëse shtoni një automjet dhe ju caktohet një automjet specifik në llogarinë e përdoruesit Porsche ID, ekziston një e ashtuquajtur marrëdhënie me automjetin (referuar në vijim si "marrëdhënia e automjetit"). Pas verifikimit me sukses, do të merrni, për shembull, një email me një lidhje që duhet të përdorni për të konfirmuar regjistrimin dhe krijimin e llogarisë tuaj të përdoruesit Porsche ID. Një tipar i dytë ju lejon gjithashtu të verifikoheni dhe identifikoheni, për shembull, nëpërmjet një kodi me SMS, të cilin më pas e vendosni gjatë procesit të regjistrimit dhe krijimit të llogarisë së përdoruesit Porsche ID. Vetë-regjistrimi kërkon që të ngarkoni foto nga pajisja juaj. Kjo do të thotë se do t’ju kërkohet autorizim për akses në kamerën e pajisjes suaj ose në bibliotekën e fotove. Dhënia e autorizimit është me bazë vullnetare. Megjithatë, nëse dëshironi të përdorni funksionalitetin e vetë-regjistrimit, duhet ta jepni edhe autorizimin përkatës, meqë përndryshe nuk do të mund ta kryeni vetë-regjistrimin. Autorizimi do të mbetet aktiv, derisa ta resetoni nëpërmjet çaktivizimit të cilësimit përkatës në pajisjen tuaj dhe/ose shfletuesin e Internetit. (a) Informacioni i nevojshëm që të regjistroheni dhe të keni

një llogari përdoruesi Porsche ID

Kur të regjistroheni dhe të krijoni llogarinë e përdoruesit Porsche ID, duhet (në rast vetë-regjistrimi) të futni adresën tuaj të emailit, një fjalëkalim, emrin tuaj dhe çdo prapashtesë, informacion të kontaktit dhe të adresës, numrin e telefonit celular, adresën e emailit dhe, atje ku vlen, gjuhën me të cilën dëshironi të komunikoni me ne, ose (në rast regjistrimi dhe krijimi të llogarisë suaj të përdoruesit Porsche ID nëpërmjet një koncesionari të autorizuar) t’i konfirmoni këto të dhëna personale gjatë procesit të regjistrimit dhe të krijimit të llogarisë së përdoruesit Porsche ID. Këto të dhëna personale janë të nevojshme për të konfiguruar dhe menaxhuar llogarinë tuaj të përdoruesit Porsche ID, në mënyrë që ju të mund ta përdorni gamën e plotë të Shërbimeve tona, që ofrohen brenda kuadrit të Infrastrukturës së Shërbimeve Dixhitale

të Porsche-it. Në shtete të caktuara, ju mund të përdorni edhe ofertat tona, si klient perspektiv. Në këtë rast, gjithçka që duhet të jepni është emri juaj, adresa e emailit dhe një fjalëkalim. Neve na duhen këto dhe, sipas rastit, edhe të dhëna personale të mëtejshme, që të jemi gjithashtu në gjendje, mes të tjerash, t’u përgjigjemi kërkesave, pyetjeve dhe vërejtjeve tuaja. Veç kësaj, në ruajmë orën e logimit tuaj më së fundi. Gjatë regjistrimit dhe krijimit të llogarisë suaj të përdoruesit Porsche ID, ne kryejmë një kontroll të vërtetësisë së informacionit për emrin tuaj dhe adresën. (b) Informacioni që jepni vullnetarisht kur regjistroni dhe

krijoni llogarinë tuaj të përdoruesit Porsche ID

Kur regjistroni dhe krijoni llogarinë tuaj të përdoruesit Porsche ID, ju gjithashtu keni opsionin për të futur vullnetarisht informacion të mëtejshëm, të tillë si informacion të mëtejshëm për emrin (tituj akademikë, etj.), informacion të kontaktit për kompaninë, datëlindjen, numra të tjerë telefoni, informacion për kartën e kreditit (i cili ruhet ekskluzivisht nga ofruesi i shërbimit të pagesës), si dhe numrin e regjistrimit të automjetit tuaj dhe një emër personal të automjetit. Gjithashtu ju mund të jepni informacion për interesat dhe preferencat tuaja si dhe për kanalet që dëshironi për t’ju kontaktuar. Lutemi mbani parasysh se ky informacion nuk është i detyruar për t’u dhënë, gjatë regjistrimit dhe krijimit të llogarisë suaj të përdoruesit Porsche ID dhe se varet tërësisht prej jush nëse do të na i komunikoni apo jo këto të dhëna personale.

4.2 Infrastruktura e Shërbimeve Dixhitale të Porsche-it:

Përpunimi i të dhënave pas regjistrimit dhe krijimit të

llogarisë suaj të përdoruesit Porsche ID

Po ta keni regjistruar dhe krijuar llogarinë tuaj të përdoruesit Porsche ID, ne do të bashkëndajmë informacion bazë në lidhje me llogarinë tuaj të përdoruesit Porsche ID dhe automjetet tuaja me koncesionarët e Porsche-it që ofrojnë shërbimin, në mënyrë që të jemi në gjendje t’ju ofrojmë shërbim edhe nëpërmjet rrjetit të koncesionarëve tanë, sipas nevojës. Kjo bëhet në zbatim të kontratës që ekziston mes jush dhe nesh, në bazë të Nenit 6(1)(b) të GDPR. Për këtë qëllim, ne do të transferojmë jo vetëm numrin e identifikimit të automjetit, por edhe emrin tuaj të përdoruesit (Porsche ID), disponibilitetin teknik dhe/ose të ndërlidhur me shitjet, të Shërbimeve dhe ofertave të produkteve për llogarinë tuaj të përdoruesit të Porsche ID ose të automjetit dhe ngjarjet relevante brenda kontekstit të krijimit, modifikimit ose heqjes së llogarisë suaj të përdoruesit Porsche ID, lidhjet drejt automjeteve, përzgjedhjen e koncesionarëve ose aktivizimin a çaktivizimin e Shërbimeve. Në qoftë se keni përzgjedhur një koncesionar të autorizuar dhe keni dhënë pëlqimin, të dhënat personale të ruajtura në llogarinë tuaj të përdoruesit Porsche ID, dhe veçanërisht informacioni i kontaktit, informacioni për shërbimin e klientit, kontratën dhe Shërbimet dhe informacioni për interesat tuaj, automjetet dhe Shërbimet që keni përdorur gjithashtu do të bashkëndahen me koncesionarin e autorizuar dhe sinkronizohen me çdo të dhënë personale në lidhje me ju, që mund të jetë ruajtur nga koncesionari i autorizuar. Nëse ju nuk dëshironi më që këto të dhëna të bashkëndahen në të ardhmen, mund t’i ndryshoni cilësimet e përdoruesit për llogarinë tuaj të përdoruesit Porsche ID, sipas dëshirës. Që nga ai moment, të dhënat personale të përmendura më lart nuk do të bashkëndahen më me koncesionarin e autorizuar. Baza ligjore për përpunimin e të dhënave tuaja personale në këtë kontekst është pëlqimi juaj sipas Nenit 6(1)(a) të GDPR.

4.3 Heqja e llogarisë suaj të përdoruesit Porsche ID

Në qoftë se ju e hiqni llogarinë tuaj të përdoruesit Porsche ID, edhe të dhënat personale të ruajtura në llogarinë tuaj të përdoruesit Porsche ID do të fshihen, sapo të përfundojë marrëdhënia kontraktuale, por jo para se të mbarojë afati i


licencave tuaja ekzistuese të shërbimit. Sa kohë që të dhënat personale duhen ruajtur për arsye ligjore, këto të dhëna do të bllokohen (kjo njihet edhe si “kufizim i përpunimit”). Ashtu të dhënat personale nuk janë më në dispozicion për përdorim të mëtejshëm, në veçanti për përdorimin e Shërbimeve. Si rezultat i kësaj, Shërbimet nuk do të funksionojnë më plotësisht ose mund të mos funksionojnë më fare. Ashtu ju nuk do të mund të përdorni më as Infrastrukturën e Shërbimeve Dixhitale të Porsche-it në tërësinë e saj. Edhe nëse kontrollorë të tjerë, brenda grupit të kompanive Porsche dhe rrjetit përkatës të shitjeve i përpunojnë të dhënat personale nën përgjegjësinë e tyre, kjo nuk do të ndikojë në përpunimin e këtyre të dhënave personale. Në atë masë që të dhënat personale janë bashkëndarë me një koncesionar të zgjedhur prej jush, në bazë të pëlqimit tuaj sipas Nenit 6(1)(a) të GDPR, ne do të njoftojmë koncesionarin për heqjen e llogarisë suaj të përdoruesit Porsche ID.

5. Shërbimet Qendrore

5.1 Rezervimi dhe aktivizimi i shërbimeve; trajtimi i

informacionit për pagesat

Ju mund të rezervoni Shërbime My Porsche dhe Shërbime Porsche Connect individuale ose të shumëfishta dhe të aktivizoni licenca Shërbimesh. Kur të përzgjidhni Shërbimin përkatës ose paketën e Shërbimeve, ju mund të shihni edhe informacionin përkatës që përfshihet në hollësitë e ofertës, rreth përpunimit të së dhënave personale në kuadrin e Shërbimeve në fjalë. Për të ekzekutuar dhe realizuar një rezervim dhe marrëdhënien kontraktuale të ndërlidhur me të, ne përpunojmë jo vetëm informacionin përkatës të rezervimit, por edhe të dhënat tuaja personale që janë mbledhur gjatë procesit të regjistrimit dhe të krijimit të llogarisë suaj të përdoruesit Porsche ID. Ju mund ta ndryshoni adresën tuaj të faturimit para se të përfundojë procesi i rezervimit. Në atë rast ne do ta përdorim këtë informacion të

adresës të dhënë prej jush, për synime të faturimit dhe balancimit të llogarisë. Ne përdorim një ofrues të shërbimit të pagesës të autorizuar nga ne për të përpunuar pagesat për shërbimet dhe produktet me pagesë brenda kuadrit të My Porsche, Porsche Connect, Tregut në linjë dhe Porsche Drive. Për këtë arsye, ne përpunojmë të dhënat e kartës suaj të kreditit, si dhe informacionin përkatëse të pagesës. Menaxhimi i informacionit të kartës suaj të kreditit, si dhe përpunimi i pagesave kryhet nëpërmjet sistemeve të ofruesit të shërbimit të pagesave në emër të Porsche Smart Mobility GmbH. Nëse jepni informacionin e kartës suaj të kreditit, kjo gjë bëhet direkt përmes fushës hyrëse të ofruesit të shërbimit të pagesave, i cili e enkripton, ruan dhe përdor këtë informacion në mënyrë të pavarur për pagesat tuaja. Më pas, informacioni i enkriptuar përcillet nga Porsche/ne drejt ofruesit të shërbimit të pagesave, ku ruhet dhe përdoret për pagesën. Baza ligjore për përpunimin është përmbushja e kontratës. Ekskluzivisht për synimet e menaxhimit të llogarive të kreditit (përfshi kontrollet e kompliancës, në atë masë që e kërkon ligji) dhe për të kryer kontrolle të kreditit, ofruesi i shërbimit të pagesës që përdorim përpunon, në emrin tonë, informacionin tuaj të klientit dhe të kontaktit (emrin, adresën, adresën e-postare, numrin e klientit Porsche Connect; nëse duhet, emrin e kompanisë dhe të kompanive filiale) dhe numrin e identifikimit të automjetit që tregohet te prova e pronësisë. Baza ligjore për përpunimin e të

dhënave personale të përmendura për synimet e parashtruara më lart është, sipas Nenit 6(1)(c) të GDPR, komplianca me një detyrim ligjor të cilit i nënshtrohemi ose, sipas Nenit 6(1)(f) të GDPR, interesi ynë legjitim në përmbushjen e kërkesave ligjore. Kur blini nëpërmjet dyqaneve në linjë, ofruesi ynë i shërbimit të pagesës përcakton riskun e mashtrimit. Të dhënat e transaksionit kontrollohen dhe ekzaminohen për parregullsi (p.sh. shpeshtësia e ndryshimit të fjalëkalimit). Baza ligjore për përpunimin e të dhënave personale të përmendura për qëllimet e lartpërmendura është, sipas Nenit 6 [1] (b) të GDPR-së, përmbushja e kontratës

ose, në përputhje me Nenin 6 [1] (f) të GDPR-së, interesi ynë legjitim për parandalimin e mashtrimeve. Pasi të kryhet rezervimi, ju mund t’i aktivizoni Shërbimet. Kjo do të ruajë informacionin tuaj të përdoruesit në sistem dhe do të bëjë që lista e Shërbimeve në dispozicion të përditësohet sipas rastit. Për të përdorur Shërbime të caktuara (të tilla si ofertat për stacione të karikimit) do të dërgohet, me postë në shumë shtete ku ofrohen Shërbimet, një kartë e personalizuar që përmban çipe RFID (Porsche ID Card, Porsche Charging Card), pasi të blihet një produkt. Në këtë kartë ruhet një numër identifikimi; ky numër mund të përdoret për ta bashkëlidhur kartën me llogarinë tuaj të përdoruesit Porsche ID. Në kartë nuk ruhen të dhëna personale në formë dixhitale, përveç numrit të identifikimit; dhe sidomos nuk ruhet emri dhe adresa juaj. Në qoftë se karta ju humbet, mund ta bllokoni që nga llogaria juaj e përdoruesit Porsche ID. Pasi të dorëzohet, karta Porsche ID Card mund të përdoret drejtpërdrejt në transaksionet me infrastrukturën e mbështetur (të tillë si stacionet publike të karikimit). Përveçse kur specifikohet ndryshe, ne i kryejmë të gjitha operacionet e përpunimit të përshkruara në këtë seksion në zbatim të kontratës që kemi me ju, në bazë të Nenit 6(1)(b) të GDPR.

5.2 Përdorimi i Shërbimeve My Porsche dhe i Shërbimeve

Porsche Connect

Shërbimet My Porsche dhe Shërbimet Porsche Connect që janë rezervuar mund t’i përdorni, në varësi të Shërbimit, në automjetin tuaj (në atë masë që ato janë në dispozicion për automjetin tuaj) përmes një lidhjeje radio celulare ose përmes pajisjeve të mëtejshme në My Porsche ose app-in tuaj Porsche Connect dhe, atje ku kjo vlen, edhe nga shumë pika aksesi ose të gjitha pikat e aksesit. Për këtë qëllim, automjeti juaj ose pajisja përkatëse do të lidhen me Infrastrukturën e Shërbimeve Dixhitale të Porsche-it. Kur ju përdorni Shërbimet që keni rezervuar përmes My Porsche ose Dyqanit Porsche Connect në automjetin tuaj ose në pajisje të tjera, ne i përpunojmë të dhënat personale të lidhura me ju për synime të aftësimit të përdorimit të Shërbimeve, për synime të mbështetjes dhe për synime të tjera, të përcaktuara në mënyrë specifike. Përveç rasteve kur e përcaktojmë ndryshe, ne i përpunojmë të dhënat tuaja personale vetëm në masën e nevojshme për të aftësuar përdorimin e Shërbimit My Porsche ose Shërbimit Porsche Connect përkatës. Kur ju përdorni Shërbime individuale My Porsche ose Shërbime individuale Porsche Connect, mund të përpunohen kategoritë e mëposhtme të së dhënave personale, për shembull, në varësi të si punon Shërbimi specifik:

a) informacion identifikimi, i tillë si numri i identifikimit i automjetit, Porsche ID juaja dhe ID-të e pajisjes dhe të sistemit për pajisjet tuaja dhe modulet radio celulare, i cili nevojitet për t’ju identifikuar ju personalisht, pajisjen tuaj ose automjetin tuaj, për të vendosur lidhjet, përdorur Shërbimet ose marrë akses në materialet;

b) informacion të autorizimit, përfshi atë që automjeti ose pajisja përkatëse janë aktivizuar për Shërbimin përkatës Porsche Connect, dhe që mund të lidhet me të dhënat tuaja personale, që ju futët gjatë procesit të regjistrimit dhe të krijimit të llogarisë suaj të përdoruesit Porsche ID;

c) informacion të logimit, që nevojitet nëse ju dëshironi të përdorni shërbime nga ofrues të tjerë, që kërkojnë logim në automjetin tuaj ose në pajisje të tjera;

d) informacion të komunikimit, që nevojitet për të vendosur një lidhje midis automjetit tuaj dhe/ose pajisjeve të tjera dhe serverëve tanë ose serverëve të


ofruesve palë të treta të materialeve për Shërbimet Porsche Connect;

e) informacion për vendndodhjen dhe lëvizjet, të tillë si të dhëna GPS ose të shpejtësisë, që nevojitet për të përdorur materiale të bazuara në vendndodhjen;

f) informacion për gjuhën, që aftëson kontrollin zanor dhe futjet zanore, në Shërbime Porsche Connect të caktuara. Të dhënat zanore transferohen tek ne nga automjeti ose pajisja si regjistrime, për t’u konvertuar pastaj në tekst. Teksti që pastaj përftohet nga një ofrues shërbimi i kthehet automjetit dhe regjistrimi hiqet në anën tonë;

g) informacion kontakti që përdoret në shërbimet e komunikimit, për shembull për të dërguar e-postë ose mesazhe tekst;

h) të dhëna faturimi, të tilla si dokumente lidhjesh individuale, që kanë të bëjnë me proceset e faturimit. Ne mund ta kombinojmë këtë informacion me adresën tuaj dhe informacionin e pagesës, për synime të faturimit individual;

i) Të dhënat e imazhit/videos së automjetit tuaj ose komponentëve të tij;

j) materiale të tjera që duhen bashkëndarë me ne ose me ofruesit e shërbimit, në mënyrë që këta të mund të ofrojnë një Shërbim për ju.

Për informacion të hollësishëm në lidhje me cilat të dhëna personale përpunohen brenda kuadrit të secilit Shërbim, lutemi shihni përshkrimet e Shërbimeve përkatëse ne https://connect-store.porsche.com/al/en. Sa më poshtë vlen veçanërisht në kontekstin e vizitave në ofiçinë dhe me përdorimin e shtimit të porosisë në linjë në lidhje me to: Shtimi i porosisë në linjë është një shërbim që u ofron klientëve

tanë mundësinë të ndjekin procesin e pranimit të automjetit gjatë një takimi në ofiçinë, kurdo dhe kudo, nëpërmjet videove të regjistruara dhe të personalizuara të konsulentit dhe/ose teknikut të shërbimit. Për më tepër, klienti mund të lëshojë/miratojë riparime/shtime riparimesh të tjera direkt nëpërmjet portalit My Porsche dhe/ose aplikacionit My Porsche. Përveçse kur specifikohet ndryshe në këtë dokument, në ndonjë nga Politikat Specifike të Privatësisë ose, atje ku vlen, në njoftime të tjera specifike të privatësisë që lidhen me një Shërbim të caktuar, ne i përpunojmë të dhënat tuaja personale, në çdo rast, në bazë të Nenit 6(1)(b) të GDPR për t’ju ofruar Shërbimet në këtë kontekst dhe në zbatim të kontratës së bashkëlidhur me to.

5.3 Përdorimi i shërbimeve të një ofruesi palë e tretë

Nëse ju përdorni shërbime të një ofruesi palë e tretë, me të cilin ju keni një marrëdhënie kontraktuale tuajën, përmbajtja e këtyre shërbimeve mund të afishohet brenda automjetit tuaj ose mbi të dhe informacion mund të bashkëndahet midis automjetit tuaj ose pajisjes dhe ofruesit të shërbimit në fjalë. Ne nuk kemi ndikim ndaj përpunimit të së dhënave nga ky ofrues palë e tretë ose vendit ku përpunohen të dhënat. Prandaj lutemi shihni njoftimet e veçanta të privatësisë të ofruesit përkatës palë e tretë për informacion rreth natyrës, shtrirjes dhe qëllimit të përpunimit të së dhënave personale në raport me shërbimin përkatës.

Ne i transferojmë të dhënat personale të nevojshme drejt ofruesit përkatës palë të tretë në bazë të Nenit 6(1)(b) të GDPR në zbatim të kontratës ekzistuese mes jush dhe nesh.

6. Garantimi i interesave legjitimë

Në atë masë që ne i përpunojmë të dhënat tuaja personale për të garantuar interesat tanë legjitimë, kjo ndodh përtej operacioneve të përpunimit të së dhënave dhe synimeve të përshkruara në këtë Politikë të Përgjithshme të Privatësisë, Politikave Specifike të

Privatësisë ose, atje ku vlen, njoftimeve të tjera specifike të privatësisë që lidhen me Shërbimin përkatës brenda kuadrit të Shërbimit specifik dhe veçanërisht në kontekstin e interesave të mëposhtëm:

1. zhvillimi i mëtejshëm i produkteve, shërbimeve dhe ofertave të shërbimit të klientit si dhe masave të tjera për të menaxhuar transaksionet dhe proceset e biznesit;

2. përmirësimi i cilësisë së produkteve, mënjanimi i gabimeve dhe çrregullimeve, përfshi edhe nëpërmjet analizës të së dhënave të automjeteve dhe feedback-ut nga klientët;

3. përpunimi i të dhënave në një platformë qendrore të kujdesit për klientët aktualë dhe perspektivë si dhe sisteme të para dhe pas shitjeve për besnikërinë e klientëve dhe synime të shitjeve, për të ofruar kujdes individual për klientët aktualë dhe perspektivë;

4. trajtimi i rasteve të garancisë dhe të shërbimeve, përpunimi i kërkesave për informacion dhe kërkesave të tjera të paraqitura nga klientë perspektivë dhe klientë aktualë jashtë kontratave;

5. analiza e kërkesës dhe e segmentimit të klientëve, p.sh. llogaritja dhe vlerësimi i afiniteteve, preferencave dhe potencialit të klientëve;

6. menaxhimi i riskut dhe bashkërendimi i fushatave për kthim produktesh;

7. kontrollet e kreditit, përmes bashkëndarjes së të dhënave me byrotë e kreditit (p.sh. SCHUFA);

8. sigurimi i kompliancës ligjore, parandalimi i shkeljeve ligjore dhe mbrojtja ndaj tyre (veçanërisht akteve kriminale), formulimi i pretendimeve ligjore dhe mbrojtja ndaj tyre;

9. garantimi i përdorshmërisë, operacionit dhe sigurisë së sistemeve teknike dhe menaxhimi i të dhënave teknike.

Përpunimi i të dhënave përkatëse kryhet në bazë të Nenit 6(1)(f) të GDPR në lidhje me këtë.

7. Pëlqimi

Nëse ju na jepni pëlqimin tuaj për operacione të caktuara të përpunimit të së dhënave, ky pëlqim gjithnjë i bashkëlidhet një synimi specifik; dhe synimet kanë të bëjnë, në çdo rast, me përmbajtjen e deklaratës specifike të pëlqimit. Në këtë rast, përpunimi i të dhënave kryhet në bazë të Nenit 6(1)(a) të GDPR. Nëse ju nuk e jepni pëlqimin, ne nuk do të mund të përmbushim kërkesën tuaj që mbulohet nga pëlqimi. Pasi ta keni dhënë, ju mund ta tërhiqni pëlqimin tuaj në çdo kohë pa ndikuar kjo në ligjshmërinë e përpunimit që ka ndodhur në bazë të atij pëlqimi, para se të tërhiqej. Në bazë të pëlqimeve që ju mund të keni dhënë, kompanitë e listuara në deklaratën e pëlqimit mund t’i përdorin të dhënat për synime specifike, p.sh. për të ofruar kujdes individual për klientët aktualë dhe perspektivë dhe mund t’ju kontaktojnë përmes kanaleve tuaja të preferuara të komunikimit. Nëse ne i përdorim të dhënat tuaja për të ofruar kujdes individual për klientët aktualë dhe perspektivë në këtë kuadër, kjo do të kryhet me synimin për t’ju ofruar një eksperiencë të kënaqshme të markës dhe të kujdesit për klientin nga ana e Porsche-it dhe për t’i

bërë komunikimet dhe ndërveprimet tona me ju sa më personale dhe relevante që të jetë e mundshme. Se cilat nga të dhënat tuaja përdoren pikërisht për të ofruar kujdes individual për klientët aktualë dhe perspektivë, kjo varet në veçanti nga cilat të dhëna janë mbledhur në bazë të kërkesave, porosive dhe këshillimit (p.sh. kur blini produkte Porsche) dhe cilat të dhëna (p.sh. interesat tuaja personalë) ju keni dhënë në pikat relevante të kontaktit (p.sh. përmes këtij uebsajti ose në Porsche Zentrum).

Në këto raste, shtrirja specifike dhe synimi i pëlqimit të dhënë prej jush përcaktohen nga formulimi i deklaratës së pëlqimit te pika e kontaktit.

8. Marrësit e të dhënave personale

Marrësit e brendshëm: Brenda PSM GmbH, aksesi kufizohet me ata persona që kanë nevojë për të, për synimet specifike të përmendura. Marrësit e jashtëm: Ne nuk ua komunikojmë të dhënat tuaja personale marrësve jashtë PSM GmbH, me përjashtim të atje ku kjo është e nevojshme për të ofruar dhe përmbushur Shërbimin përkatës, atje ku ka një autorizim tjetër ligjor ose atje ku ne kemi pëlqimin tuaj për të vepruar kështu. Marrësit e jashtëm mund të jenë si vijon: a) Përpunuesit: Dr. Ing. h.c. F. Porsche AG ose filialet e saj ose ofruesit e jashtëm të shërbimeve me të cilët ne kemi lidhur kontrata për dhënien e shërbimeve, për shembull në fushat e infrastrukturës teknike dhe shërbimit/mirëmbajtjes për ofertat e PSM GmbH ose ofrimin e materialeve. Ne i përzgjedhim përpunuesit me kujdes dhe i vlerësojmë rregullisht, për t’u siguruar që privatësia juaj të mbetet e garantuar. Ofruesve të shërbimit nuk u lejohet të përdorin të dhëna personale për arsye të ndryshme nga synimet e specifikuara prej nesh dhe në bazë të udhëzimeve tona. b) Ente publike: Agjencitë qeveritare dhe institucionet shtetërore, të tilla si autoritetet e taksave, prokuroritë ose gjykatat, drejt së cilave ne transferojmë (dhe/ose jemi të detyruar të transferojmë) të dhëna

personale për arsye ligjore të detyrueshme ose për të mbrojtur interesa të ligjshëm. Në këto raste, transferimi kryhet në bazë të pikave (c) dhe/ose (f) të Nenit 6(1) të GDPR. c) Ente private: Koncesionarët e Porsche-it dhe bizneset e shërbimeve, partnerët në bashkëpunim, ofruesit e shërbimeve ose persona drejt së cilëve të dhënat personale transferohen në bazë të pëlqimit, për të zbatuar një kontratë me ju ose për të mbrojtur interesa të ligjshëm, të tillë si qendrat Porsche dhe qendrat e shërbimit Porsche, bankat financuese, ofruesit e shërbimeve të mëtejshme ose ofruesit e shërbimeve të transportit. Në këto raste, transferimi kryhet në bazë të pikave (a), (b) dhe/ose (f) të Nenit 6(1) të GDPR.

9. Përpunimi i të dhënave në vendet e treta

Nëse të dhënat transferohen në organe, zyra qendrore ose vendi i të cilave për përpunimin e të dhënave nuk ndodhet në një shtet anëtar të Bashkimit Evropian, në një shtet tjetër jashtë Bashkimit Evropian që është nënshkrues i Marrëveshjes për Zonës Ekonomike Evropiane ose në një shtet për të cilin është përcaktuar një nivel i përshtatshëm i mbrojtjes së të dhënave nëpërmjet një vendimi të Komisionit Evropian, përpara zbulimit, ne do të sigurohemi që transferimi i të dhënave të mbulohet nga një autorizim ligjor, që të ketë garanci për një nivel të përshtatshëm

të mbrojtjes së të dhënave në lidhje me transferimin e të dhënave (p.sh. nëpërmjet marrëveshjes së garancive kontraktuale, rregulloreve të njohura zyrtarisht ose rregulloreve detyruese të brendshme për mbrojtjen e të dhënave pas marrjes së tyre), ose që keni dhënë pëlqimin për transferimin e të dhënave. Kur të dhënat transferohen në bazë të nenit 46, 47 ose nenit 49, paragrafi 1, nënparagrafi 2 të GDPR-së, ju mund të merrni nga ne një kopje të garancive për ekzistencën e një niveli të përshtatshëm të mbrojtjes së të dhënave në lidhje me transferimin e të dhënave. Për këtë qëllim, përdorni informacionin nën pikën 1.

10. Mbledhja e të dhënave nga palë të treta

Ne nuk përpunojmë vetëm të dhëna personale që marrim drejtpërdrejt prej jush. Ne gjithashtu marrim disa të dhëna personale nga palë të treta, në atë masë që kemi një bazë ligjore për këtë. Për informacion për mbledhjen e të dhënave nga palë të treta, lutemi shihni Politikën Specifike të Privatësisë dhe, atje ku vlen, njoftimet e mëtejshme specifike të privatësisë, sipas Shërbimit përkatës.

11. Vendim-marrja dhe profilizimi i automatizuar

Ne nuk përdorim vendim-marrje të automatizuar, në bazë të Nenit 22 të GDPR, për të përgatitur, vendosur dhe ekzekutuar marrëdhëniet e biznesit. Në atë masë që profilizimi lejohet, kjo ndodh vetëm për synimet e përmendura brenda kuadrit të Politikës së Përgjithshme të Privatësisë, Politikave Specifike të Privatësisë dhe, atje ku vlen, njoftimeve të mëtejshme specifike të privatësisë sipas Shërbimit përkatës dhe mbështetur në bazat ligjore të përmendura.

12. Kohëzgjatja e ruajtjes; fshirja

Përveçse kur informacioni për kohëzgjatjen specifike të ruajtjes dhe/ose fshirjes së të dhënave personale ofrohet në përshkrimin e Shërbimeve specifike, do të veprohet si vijon: Ne i ruajmë të dhënat tuaja personale vetëm për sa kohë që kjo është e nevojshme, për të arritur synimet tona ose – në rast pëlqimi – derisa ju ta tërhiqni ose nëse e tërhiqni pëlqimin. Në rast të një kundërshtimi ndaj përpunimit, ne i fshijmë të dhënat tuaja personale, përveçse kur vazhdimi i përpunimit të tyre lejohet në bazë të dispozitave statutore relevante. Ne gjithashtu i fshijmë të dhënat tuaja personale, nëse detyrohemi ta bëjmë këtë për arsye të tjera statutore. Duke i zbatuar këto parime të përgjithshme, ne përgjithësisht i fshijmë të dhënat tuaja personale pa vonesë

- pasi baza ligjore nuk zbatohet më, me kusht që të mos ketë bazë ligjore tjetër (p.sh. periudha të ruajtjes të imponuara nga ligjet tregtare ose fiskale) që zbatohet. Në këtë rast të fundit, ne i fshijmë të dhënat personale pasi të pushojë së zbatuari baza tjetër ligjore.

- Nëse ato nuk nevojiten më për synimet tona të përgatitjes dhe të zbatimit të një kontrate ose për të ndjekur interesa legjitimë dhe nuk ka ndonjë bazë tjetër ligjore (p.sh. periudha të ruajtjes të imponuara nga ligjet tregtare dhe fiskale) që zbatohet. Në këtë rast të fundit, ne i fshijmë të dhënat personale pasi të pushojë së zbatuari baza tjetër ligjore.

- Nëse synimi për të cilin i kemi mbledhur nuk vlen më, dhe nuk ka ndonjë bazë ligjore tjetër (p.sh. periudha të ruajtjes të imponuara nga ligjet tregtare ose fiskale) që zbatohet. Në këtë rast të fundit, ne i fshijmë të dhënat personale pasi të pushojë së zbatuari baza tjetër ligjore.

13. Të drejtat e subjekteve të së dhënave

Si subjekt i të dhënave të prekura nga përpunimi i të dhënave, ju keni një numër të drejtash në dispozicion. Dhe pikërisht: E drejta e aksesit: Ju keni të drejtën të merrni informacion për

të dhënat tuaja personale që ne ruajmë. E drejta e korrigjimit dhe e fshirjes: Ju mund të kërkoni që ne

të korrigjojmë të dhëna jokorrekte dhe – me kusht që kërkesat statutore paraprake të përmbushen – t’i fshijmë të dhënat tuaja.


Kufizimi i përpunimit: Ju mund të kërkoni – me kusht që

kërkesat paraprake statutore të përmbushen – që ne të kufizojmë përpunimin e të dhënave tuaja. Bartshmëria e të dhënave: Nëse ju na keni dorëzuar të dhëna

në bazë të një kontrate ose pëlqimi, ju mundeni, nëse përmbushen parakushtet statutore, të kërkoni që t’i merrni të dhënat e dorëzuara prej jush në një format të strukturuar, të përdorur rëndom dhe të lexueshme nga kompjuteri, ose që ne t’i transferojmë ato te një kontrollor tjetër. Kundërshtimi i përpunimit të së dhënave në rast “interesi

legjitim” si bazë ligjore: Ju keni të drejtën të kundërshtoni,

për arsye të ndërlidhura me situatën tuaj të veçantë dhe në

çdo kohë, përpunimin e të dhënave prej nesh, në atë masë

që ky përpunim ka “interesin e ligjshëm” si bazë ligjore.

Nëse ju e ushtroni të drejtën tuaj për të kundërshtuar, ne

do ta ndërpresim përpunimin e të dhënave tuaja, me

përjashtim të rastit kur ne mund të provojmë – në pajtim

me specifikimet statutore – se kemi arsye legjitime

detyruese për ta vazhduar përpunimin, çfarë edhe i anulon

të drejtat tuaja.

Tërheqja e pëlqimit: Në atë masë që ju na keni dhënë

pëlqimin për përpunimin e të dhënave tuaja, ju mund ta

tërhiqni atë në çdo kohë, me efekt në të ardhmen. Kjo nuk

ka lidhje me ligjshmërinë e përpunimit të së dhënave tuaja

para tërheqjes së pëlqimit.

mbikëqyrës: Ju mund edhe të paraqitni një ankesë tek autoriteti

mbikëqyrës kompetent, në qoftë se besoni se përpunimi i të dhënave tuaja e shkel ligjin në fuqi. Për këtë qëllim, ju mund të kontaktoni autoritetin mbikëqyrës për mbrojtjen e të dhënave që ka juridiksion mbi vendin ku banoni ose shtetin tuaj ose autoritetin

Shërbimet e ofruesve të tjerë me të cilët lidhen dhe ju lidhin Shërbimet tona janë projektuar dhe ofrohen nga palë të treta. Ne nuk kemi ndonjë ndikim ndaj dizajnit, përmbajtjes dhe/ose funksionimit të këtyre shërbimeve. Ne shprehimisht distancohemi nga çdo përmbajtje e ofruar nga të gjitha shërbimet e lidhura. Lutemi mbani parasysh se këto shërbime, të tilla si uebsajtet palë të treta, mund të instalojnë cookies në pajisjen tuaj ose të mbledhin të dhëna personale. Ne nuk kemi ndikim mbi këtë. Faqet e internetit të Porsche Smart Mobility

Mund të përdorni My Porsche, Porsche Connect Store, tregun në linjë dhe Porsche Drive nëpërmjet faqes sonë të internetit (në vijim të referuar gjithashtu si "faqja e internetit").

Mund të rezervoni shërbimet e My Porsche, Porsche Connect services dhe Functions on Demand (FoD) dhe të aktivizoni licencat përkatëse në My Porsche dhe Porsche Connect Store. Në Porsche Drive, mund të merrni automjete me qira. Kjo kërkon që të regjistroheni në My Porsche dhe të keni një llogari përdoruesi Porsche ID. Në varësi të shërbimit, ju mund të përdorni dhe menaxhoni shërbimet e lartpërmendura nëpërmjet faqes sonë të internetit, përmes aplikacioneve të ndryshme Porsche, dhe nëse ofrohet për automjetin tuaj, në automjet përmes lidhjes së rrjetit me valë. Për më tepër, mund të përdorni tregun në linjë për të qasur gamën e gjerë të produkteve dhe shërbimeve të ofruara nga kompanitë e grupit tonë dhe ofruesit e palës së tretë. 1.1 Sigurimi i faqes sonë të internetit

Këtë faqe interneti mund ta përdorni pa regjistrim deri në një nivel të caktuar. Edhe nëse e përdorni faqen e internetit regjistrim, të dhënat personale mund të përpunohen gjithsesi. Të dhënat e mëposhtme do të përpunohen nga ne kur të qasni faqen tonë të internetit me pajisjen tuaj:

Ne i përpunojmë këto të dhëna në bazë të Nenit 6 nënparagrafi 1, pika f) të GDPR-së me qëllim ofrimin e faqes së internetit, ruajtjen e funksionimit të saj teknik dhe identifikimin dhe korrigjimin e defekteve. Në këtë mënyrë, ne ndjekim interesin për të mundësuar përdorimin e faqes sonë të internetit dhe sigurimin e funksionalitetit të saj teknik afatgjatë. Kur qasni faqen tonë të internetit, të dhënat përpunohen automatikisht. Nuk do të mund të përdorni shërbimet tona pa ofruar këto të dhëna. Këto të dhëna nuk përdoren për të nxjerrë përfundime rreth jush apo identitetit tuaj.

- Përpunimi i të dhënave në kuadrin e reklamimit, komunikimit dhe tipareve të marketingut në platformë, veçanërisht modulet me shitje të ndërthurur;

- Përpunimi i pagesës për rezervimet dhe aplikimet e paguara në kuadrin e dyqanit përkatës të tregut në linjë;

- Mbështetja e klientit në lidhje me dyqanin përkatës në treg.

Në përputhje me aktivitetet e përpunimit të të dhënave, ne përcaktojmë qëllimet dhe mjetet e përpunimit të të dhënave personale në bashkëpunim me pjesëmarrësit përkatës të tregut.

Në marrëveshje me pjesëmarrësit përkatës të tregut me përgjegjësi të përbashkët, kemi përcaktuar, sipas GDPR-së, neni 26, detyrat dhe përgjegjësitë përkatëse në përpunimin e të dhënave personale dhe palët përgjegjëse për të përmbushur detyrimet e mbrojtjes së të dhënave. Në veçanti, kemi përcaktuar se si mund të sigurohet një nivel i saktë i sigurisë dhe i të drejtave tuaja si një subjekt të dhënash, si mund të përmbushim në mënyrë të përbashkët detyrimet e mbrojtjes së të dhënave dhe si mund të monitorojmë incidente të mundshme të mbrojtjes së të dhënave. Ky funksion ju mundëson të merrni me qira një automjet Porsche. Për të përmbushur kontratën e qirasë, duhet të na jepni të dhënat personale të renditura më poshtë. Këto të dhëna personale mund t'i ruani në llogarinë tuaj të përdoruesit Porsche ID në çdo kohë, duke përshpejtuar kështu përpunimin në vendndodhjen e qiramarrjes. Nëse nuk ofrohen këto të dhëna, nuk mund të merrni një kontratë qiraje apo automjetin. Ne do të përpunojmë të dhënat e mbledhura në bazë të Nenit 6, nënparagrafi 1, pika b) dhe f) të GDPR-së për t'ju ofruar shërbimet që kërkoni në këtë lidhje dhe për të zbatuar marrëdhënien kontraktuale të lidhur me ju. Baza ligjore për përpunimin e të dhënave është Neni 6, nënparagrafi 1, pika f), me anë të së cilës interesi ynë legjitim synon garantimin dhe mirëmbajtjen e funksionimit dhe sigurisë së shërbimeve tona dhe eliminimin e defekteve. Në këtë kuadër, ne përpunojmë gjithashtu të dhënat për qëllime analizimi, pa ia përcaktuar një personi specifik. Nëse na ofroni të dhëna personale shtesë nëpërmjet "Bisedës së drejtpërdrejtë", do ta bëni me vullnetin tuaj të lirë. Përveç përdorimit të tregut në linjë me Porsche ID, klientët mund të përdorin seksionin e tregut të Porsche Store pa regjistrim apo krijimin paraprak të një llogarie përdoruesit Porsche ID nëpërmjet tiparit "Qasja e vizitorëve". Për informacione mbi përpunimin e të dhënave në këtë kontekst, referojuni pikës 2.2.5.

2.3.3 Vendndodhja më e afërt e Porsche Drive

Porsche Digital Service Infrastructure / Porsche ID

We, Porsche Smart Mobility GmbH (hereinafter referred to as "we" or "PSM GmbH"), are pleased about your use of the Porsche Digital Service Infrastructure and other of our digital offers (hereinafter individually or jointly also referred to as "services" and jointly "Porsche Digital Service Infrastructure") and about your interest in our company and our products. Your privacy is important to us. We take protecting your personal data and handling this data confidentially very seriously. Processing of your personal data takes place exclusively within the scope of the statutory provisions of data protection and privacy law, particularly the EU General Data Protection Regulation (hereinafter “GDPR”). This Privacy Policy provides you with information on the processing of your personal data and your rights as a data subject within the scope of your use of our Services. For information on the individual Services, please see the Specific Privacy Policy and, where applicable, the further specific privacy notices pertaining to the relevant Service. 2. Subject-matter of data protection

The subject-matter of data protection is the protection of personal data. This means all information concerning an identified or identifiable natural person (known as the “data subject”). This

includes information such as name, postal address, email address or phone number, as well as information that necessarily arises during the use of our Porsche Digital Service Infrastructure.

3. Nature, scope, purposes and legal bases of data

processing in the case of the Porsche Digital Service

Infrastructure

This General Privacy Policy provides you with an overview of the nature, scope, purposes and legal bases of the data processing within the scope of the registration, creation and use of your Porsche ID user account as well as the booking and use of our Services on the basis of your Porsche ID user account. You will also find in the text that follows information on data protection and privacy, such as on the recipients of personal data, data processing in third countries and your rights as a data subject, which applies in general within the scope of the use of the Porsche Digital Service Infrastructure. For more detailed information on the processing of personal data in relation to the use of individual Services, the relevant legal bases and specific rights of data subjects with regard to the relevant Service, please also see the relevant Specific Privacy Policy and, where applicable, the further specific privacy notices pertaining to the relevant Service.

4. Porsche ID user account

To use the Porsche Digital Service Infrastructure and the Services offered within it in full, it is necessary to register and create a Porsche ID user account in My Porsche. After completing the registration process and creating your Porsche ID user account you will also receive your Porsche ID (username for the Porsche ID user account). During registration and when creating and using your Porsche ID user account personal data is processed and may be transferred to third parties as depicted hereinafter in order to fulfil our contractual obligations in this context. Except where indicated otherwise, we carry out all processing operations described in this section in order to perform the contract existing between you and us on the basis of Article 6(1)(b) GDPR.

4.1 The registration process and creating your Porsche ID

user account

You can choose one of two ways to register and create your Porsche ID user account:

4.1.1 Invitation by an authorised dealer

If you wish, your authorised dealer will enter the personal data you have provided for you via the dealer’s access to our systems. You will then receive a link by email, for example, that you will have to use to confirm your registration and the creation of your Porsche ID user account. Please note that the authorised dealers are independent companies and we have no influence over them. A second factor will be used for additional verification, for example a code sent via text message that you then enter as part of the process of registering and creating your Porsche ID user account.




4.1.2 Self-registration

In the event that the registration and creation of your Porsche ID user account was not carried out via an authorised dealer, you can register and create your Porsche ID user account yourself and enter your personal data independently. In selected countries you can also add a vehicle and use other digital services that require vehicle ownership. You must also upload a copy of an identification document and proof of ownership and, in case you are not the owner of the vehicle, a power of attorney from the vehicle owner after entering your vehicle identification number. These documents are forwarded to Porsche Connect Support or, in countries whose official language is not supported by Porsche Connect Support, directly to the dealer selected by you and checked locally, using our verification criteria. As proof of successful verification, we also save the names, birth dates, birthplaces and addresses shown in the relevant identification documents along with the validity dates of the documents, as well as the vehicle identification numbers, owner names and addresses shown in the proof of ownership. After verification is complete, the copies of the documents will be deleted. If you add a vehicle and a specific vehicle is therefore assigned to you in your Porsche ID user account, a so-called vehicle relationship (hereinafter referred to as "vehicle relationship") exists. After successful verification, you will receive, for example, an e-mail with a link, which you must use to confirm your registration and creation of your Porsche ID user account. A second feature allows you to additionally verify your identity, for example via an SMS code, which you then enter during the process of registering and creating your Porsche ID user account. Self-registration requires that you upload pictures from your device. This means you will be asked for authorisation to access your device’s camera or photo library. Granting authorisation is voluntary. However, if you wish to use the self-registration feature, granting the relevant authorisation is required, as you will be unable to use self-registration otherwise. The authorisation remains active until you reset it in your device and/or internet browser by deactivating the relevant setting. (a) Required information when registering and creating

your Porsche ID user account

When registering and creating your Porsche ID user account you are required (in the case of self-registration) to enter your email address, a password, your name and any suffixes, contact and address information, mobile phone number, email address and, where applicable, the language in which you wish to communicate with us, or (in the case of registration and creation of your Porsche ID user account via an authorised dealer) to confirm this personal data during the process of registering and creating your Porsche ID user account. This personal data is required in order to set up and manage your Porsche ID user account for you so that you can use the full range of our Services offered within the scope of the Porsche Digital Service Infrastructure. In selected countries, you can also use our offerings as a prospective customer. In this case all you are required to provide is your name and email address and a password. We also need this and, where applicable, further personal data not least in order to be able to respond to requests, questions and criticism. In addition we store the time of your most recent log-in. During registration and creation of your Porsche ID user account we perform a plausibility check of your name and address information. (b) Voluntary information when registering and creating

your Porsche ID user account

When registering and creating your Porsche ID user account you also have the option to voluntarily enter further information, such as additional name information (academic titles, etc.), company contact information, date of birth, other phone numbers, credit card information (which is stored exclusively with the payment service provider) and your vehicle registration number and a personal vehicle name. In addition you can provide information on

your interests and preferences and your desired contact channels. Please note that this information is not required in order to register and create your Porsche ID user account, and it is entirely up to you whether you wish to communicate this personal data to us.

4.2 Porsche Digital Service Infrastructure: Data processing

after registration and creation of your Porsche ID user

account

If you have registered and created your Porsche ID user account we will share fundamental information regarding your Porsche ID user account and your vehicles with Porsche dealers that provide service in order to be able to provide you with service via our dealer organisation as well, as needed. This is done in order to perform the contract with you on the basis of Article 6(1)(b) GDPR. To this end, we will transfer not only your vehicle identification number, but also your username (Porsche ID), the technical and/or sales-related availability of Services and product offerings for your Porsche ID user account or vehicle and relevant events within the scope of the creation, modification or deletion of your Porsche ID user account, links to vehicles, the selection of dealers or the activation or deactivation of Services. If you have selected an authorised dealer and granted your consent, the personal data stored in your Porsche ID user account, particularly contact information, customer service, contract and Service information and information on your interests, vehicles and Services used, will also be shared with the authorised dealer and synchronised with any personal data concerning you that may be stored by the authorised dealer. If you no longer wish this sharing of data to take place in the future, you can adjust the user settings for your Porsche ID user account accordingly. The aforementioned personal data will no longer be shared with the authorised dealer from then on. The legal basis for the processing of your personal data in this context is your consent pursuant to Article 6(1)(a) GDPR.

4.3 Deleting your Porsche ID user account

If you delete your Porsche ID user account, the personal data stored in your Porsche ID user account will also be erased upon termination of the contractual relationship, but not before the end of the term of your existing Service licences. To the extent that personal data must be stored for legal reasons, this data will be blocked (this is known as “restriction of processing”). The personal data is then no longer available for further use, particularly for the use of Services. The Services may no longer function in full or at all as a result. You will then no longer be able to use the Porsche Digital Service Infrastructure in full either. If further controllers within the Porsche group of companies and its sales organisation process personal data on their own responsibility, the processing of this personal data will not be affected by this. To the extent that personal data has been shared with a dealer of your choice based on your consent pursuant to Article 6(1)(a) GDPR, we will notify the dealer of the deletion of your Porsche ID user account.

5. Central Services

5.1 Booking and activation of Services; handling of

payment information

You can book individual or multiple My Porsche Services and Porsche Connect Services and activate Service licences. When selecting the relevant Service or Service package you can also view the relevant information included in the offer details on the processing of personal data within the scope of the Services in question. To perform and fulfil a booking and the contractual relationship associated with it we process not only the relevant booking information, but also your personal data that has been collected during the process of registering and creating your Porsche ID user account. You can change your billing address


before the booking process is concluded. In this case we will use this address information that you provide for purposes of billing and settling the account. We use a payment service provider commissioned by us to process payments for paid services and products within the framework of My Porsche, Porsche Connect, Online Marketplace and Porsche Drive. For this purpose, we process your credit card details and the respective payment information. Management of your credit card information as well as the processing of payments is carried out via systems of the payment service provider on behalf of Porsche Smart Mobility GmbH. If you enter your credit card information, this is done directly via an input field of the payment service provider, which encrypts, stores and uses this information independently for your payments. The encrypted information is then transferred from Porsche/from us to the payment service provider where it is stored and used for your payment. The legal basis for processing is fulfilment of the contract. Exclusively for the purpose of accounts receivable management (including compliance checks, to the extent required by law) and to perform credit checks, the payment service provider used processes your customer and contact information (name, address, email address, Porsche Connect customer number; if applicable, company name and affiliated companies) and the vehicle identification number shown in the proof of ownership on our behalf. The legal basis for the processing of the personal data mentioned for the purposes stated above is, pursuant to Article 6(1)(c) GDPR, compliance with a legal obligation to which we are subject or, pursuant to Article 6(1)(f) GDPR, our legitimate interest in complying with legal requirements. When purchasing through online shops, our payment service provider determines the fraud risk. The transaction data is checked and examined for abnormalities (e.g. frequency of

password changes). The legal basis for the processing of the mentioned personal data for the aforementioned purposes is, in accordance with GDPR Article 6 [1] (b), the fulfilment of a contract, or, pursuant to GDPR Article 6 [1] (f), our legitimate interest in preventing fraud. After the booking is complete, you can activate the Services. This will store your use authorisation in the system and cause the list of available Services to be updated accordingly. To use certain Services (such as charging station offers), a personalised card containing RFID chips (Porsche ID Card, Porsche Charging Card) is sent out by mail in numerous countries where the Services are offered when a product is purchased. An identification number is stored on this card; this number can be used to associate the card with your Porsche ID user account. No personal data other than the identification number, particularly not your name or address, is stored digitally on the card itself. If the card is lost, you can block it within your Porsche ID user account. Once delivered, the Porsche ID Card can be used directly in dealings with supported infrastructure (such as public charging stations). Unless otherwise indicated, we carry out the processing operations described in this section in order to perform our contract with you on the basis of Article 6(1)(b) GDPR.

5.2 Use of the My Porsche Services and Porsche Connect

Services

You can use the My Porsche Services and Porsche Connect Services that have been booked, depending on the Service, in your vehicle (to the extent available for your vehicle) via mobile radio connection or via further devices in My Porsche or your Porsche Connect app and, where applicable, also from multiple or all access points. To this end, your vehicle or the relevant device will connect to the Porsche Digital Service Infrastructure.

When you use the Services booked via My Porsche or the Porsche Connect Store in your vehicle or on other devices, we process personal data concerning you for the purposes of enabling the use of the Services, for support purposes and for further, specifically defined purposes. Unless otherwise indicated, we process your personal data only within the scope necessary to enable the use of the relevant My Porsche Service or Porsche Connect Service. When you use the individual My Porsche Services or Porsche Connect Services the following categories of personal data may be processed, for example, depending on how the specific Service works:

a) identification information, such as the vehicle identification number, your Porsche ID and the device and system IDs for your devices and mobile radio modules, which is needed to identify you personally, your device or your vehicle in order to establish connections, use Services or access content;

b) authorisation information, including that the vehicle or the relevant device has been activated for the relevant Porsche Connect Service, which can be linked to your personal data that you entered during the process of registering and creating your Porsche ID user account;

c) login information that is needed if you wish to use services from other providers that require a login in your vehicle or on other devices;

d) communication information that is required in order to establish a connection between your vehicle and/or other devices and our servers or the servers of third-party providers of content for Porsche Connect Services;

e) location and movement information, such as GPS or speed data, that is needed in order to use location-based content;

f) language information that enables voice control and

voice entries in certain Porsche Connect Services. Voice data is transferred to us from the vehicle or a device as recordings for the purpose of conversion to text. The text that is then generated by a service provider is transferred back to the vehicle and the recording is then deleted at our end;

g) contact information that is used in communication services, for example to send email or text messages;

h) billing data, such as individual connection records regarding charging processes. We may combine this information with your address and payment information for individual billing purposes;

i) Image/video data of your vehicle or its components; j) further content that must be shared with us or with

service providers in order to be able to provide a Service for you.

For detailed information on which personal data is processed within the scope of which Service, please see the relevant Service descriptions at https://connect-store.posche.com/al/en/. The following applies especially in the context of workshop visits and the associated use of online order extension: Online order extension is a service that offers our customers the possibility to follow the vehicle acceptance process during a workshop appointment at any time and from anywhere through

recorded and personalised videos of the service consultant and/or technician. In addition, the customer can release/approve additional repairs/repair extensions directly via the My Porsche Portal and/or the My Porsche App. Unless otherwise mentioned here, in one of the Specific Privacy Policies or, where applicable, in the further specific privacy notices pertaining to the relevant Service, we process your personal data in each case on the basis of Article 6(1)(b) GDPR in order to provide you with the Services in this context and perform the contract associated therewith.

5.3 Use of services of a third-party provider

If you use services provided by a third-party provider with which you have a contractual relationship of your own, content of these services may be displayed in your vehicle or on your device and information may be shared between your vehicle or device and the service provider in question. We have no influence over the processing of data by this third-party provider or the location of the data processing. Therefore please see the relevant third-party provider’s separate privacy notices for information on the nature, scope and purpose of the processing of personal data with regard to the relevant service. We transfer the necessary personal data to the relevant third-party provider on the basis of Article 6(1)(b) GDPR to perform the contract existing between you and us.

6. Safeguarding legitimate interests

To the extent that we process your personal data to safeguard our legitimate interests, this takes place in addition to the data processing operations and purposes described in this General Privacy Policy, the Specific Privacy Policies or, where applicable, the further specific privacy notices pertaining to the relevant Service within the scope of the specific Service particularly against the background of the following interests:

1. further development of products, services and customer service offerings as well as other measures to manage business transactions and processes;

2. improvement of product quality, elimination of errors and disruptions, including by means of analysis of vehicle data and customer feedback;

3. processing of data in a central prospective customer and customer care platform as well as upstream and downstream systems for customer loyalty and sales purposes to provide individual care to customers and prospective customers;

4. handling of warranty and service cases, processing of inquiries and other requests submitted by prospective customers and customers outside of contracts;

5. analysis of demand and customer segmentation, e.g. calculation and evaluation of affinities, preferences and customer potential;

6. risk management and coordination of recall campaigns; 7. credit checks, by means of sharing data with credit

bureaus (e.g. SCHUFA); 8. ensuring legal compliance, preventing and protecting

against legal violations (especially criminal acts), assertion of and defending against legal claims;

9. ensuring the availability, operation and security of technical systems and technical data management.

The relevant data processing takes place on the basis of Article 6(1)(f) GDPR in this regard.

7. Consent

Should you grant us consent to certain data processing operations, this consent is always associated with a specific purpose; the purposes arise in each case from the content of the specific declaration of consent. In this case, the processing of data takes place on the basis of Article 6(1)(a) GDPR. If you do not consent, we are not able to comply with your request that is covered by the consent. You can withdraw consent, once granted, at any time without this affecting the lawfulness of processing that has taken place based on consent before its withdrawal. On the basis of any consent that may have been granted by you, the companies listed in the declaration of consent may use the data for specific purposes, e.g. to provide individual care for customers and prospective customers, and may contact you via your desired communication channels.

If we use your data to provide individual care for customers and prospective customers within this scope, this takes place in order to provide you with an exciting brand and customer care experience with Porsche and to make our communications and interactions with you as personal and relevant as possible. Which of your data is specifically used to provide individual care for customers and prospective customers depends in particular on which data has been collected on the basis of inquiries, orders and advising (e.g. when purchasing Porsche products) and which data (e.g. your personal interests) you have provided at the relevant contact points (e.g. via this website or at the Porsche Zentrum). In these cases, the specific scope and intended purpose of the consent granted by you arise from the wording of the declaration of consent at the point of contact.

8. Recipients of personal data

Internal recipients: Within PSM GmbH access is restricted to those persons who require it for the specific purposes mentioned. External recipients: We do not disclose your personal data to external recipients outside PSM GmbH except where necessary in order to provide and carry out the relevant Service, where there is another legal authorisation or where we have your consent to do so. External recipients may be the following: a) Processors: Dr. Ing. h.c. F. Porsche AG or its affiliates or external service providers with which we contract for the provision of services, for example in the areas of technical infrastructure and

service/maintenance for the offerings of PSM GmbH or the provision of content. We select these processors carefully and subject them to regular reviews to ensure that your privacy is safeguarded. The service providers are not permitted to use the personal data other than for the purposes specified by us and according to our instructions. b) Public bodies: Government agencies and state institutions, such as tax authorities, public prosecutors’ offices or courts, to which we transfer (and/or are required to transfer) personal data for mandatory legal reasons or to safeguard legitimate interests. In these cases the transfer takes place on the basis of point(s) (c) and/or (f) of Article 6(1) GDPR. c) Private bodies Porsche dealers and service businesses, cooperation partners, service providers or persons to which or whom personal data is transferred on the basis of consent, to perform a contract with you or to safeguard legitimate interests, such as Porsche centres and Porsche service centres, financing banks, providers of further services or transportation service providers. In these cases the transfer takes place on the basis of point(s) (a), (b) and/or (f) of Article 6(1) GDPR.

9. Data processing in third countries

The features within the framework of our offering on our website and the relevant processed personal data, purposes and legal bases are described below. 2.2.1 Booking and activating services, handling payment

information, identity verification

For information about how to book services via our website and how payment information is handled, see Point 5.1 of the Porsche Digital Service Infrastructure / Porsche ID General Privacy Policy. The laws in some countries may require an identity check based on identification documents in order to book certain telecommunications services. In relation to data processing when carrying out such identity checks, we are jointly responsible with - IDnow GmbH, Auenstr. 100, 80469 Munich, Germany. You can access the Privacy Policy of our cooperation partner IDnow GmbH via https://idnow.io/privacy/. There are two methods available for performing identity verification. One method is that you can be redirected to the external page or app of the service provider, IDnow, as part of the service booking procedure. As part of the process, we will, at your request, transmit the information to be verified (your name, your address and your date of birth) as well as a reference number to the service provider that will allow us to assign the test result at a later point. As part of the identity check, the service provider will compare the aforementioned data with your identification document and store the data, as well as an optoelectronic copy of the identification document, a photo of the verified person and an audio record of the session. The service provider will then inform us of the result of the identity check, using the reference number. Your other option is to have identity verification performed at a participating Porsche Centre. This involves staff at the Porsche Centre verifying your identity on the basis of an identification document and sending the verified information (your name, address and date of birth) and a reference number to the service provider via a Porsche system. By entering this reference number, you can use the service provider's app to submit an optoelectronic copy of your identification document to the service provider at your convenience. The service provider will then inform us of the result of the identity check, using the reference number. Personal data resulting from this identity check will only be shared with third parties if we are legally obliged to do so. Only in such cases will we obtain access to a copy of your identification document from the service provider, for the purpose of fulfilling our legal obligations. The legal basis for our processing of your personal data in order to carry out an identity check is GDPR Article 6 [1] (c) and/or (f), as the identity check is the fulfilment of a legal obligation by which

we are bound, or reflects to our legitimate interest in complying with legal requirements. As the jointly responsible party together with IDnow GmbH, we have determined in an agreement according to GDPR Article 26 how the respective functions and relationships in the processing of personal data are to be structured and who is to satisfy which data protection obligations, in particular with regard to ensuring an adequate level of security, the implementation of your rights as a data subject, the fulfilment of data protection obligations, as well as the monitoring of potential data protection incidents, including the assurance of reporting or notification obligations (as required). To request service appointments with Porsche dealers and service companies in the "My Porsche" section of our website, we may provide customer and vehicle data to companies of your choice at your request. In connection with the use of services, in the event of error messages or as part of defined data evaluation measures, certain vehicle, service and product data from the vehicle, from services or from other Porsche products may be transferred by Porsche Smart Mobility GmbH to Porsche AG in order to be available there for evaluation of the aforementioned purposes. You can consent to this on the "My Porsche" website. The vehicle, service and product data comprise identification, basic, usage, analysis, environmental, traffic, location and movement data. Some data cannot be deleted retroactively, as they are stored without concrete vehicle identification. In this case the data will be deleted after 5 years at the latest. 2.2.6 Reservation and purchase of services and products

via the "Online Marketplace" section

As part of the Online Marketplace, we offer you a central platform where you can book or purchase services and products from us, our group companies and third-party providers (hereinafter also referred to as "participants"). The respective participant is provided with an area on our platform to present and offer their products and services (hereinafter referred to as "shop"). Customers with a Porsche ID user account can use the "Marketplace" sections "Porsche Finder" and "Porsche Store". Customers without an existing Porsche ID contract can also use the Marketplace section "Porsche Store" via the "Guest access" feature. Processing within the framework of the Online Marketplace is carried out partly by us, partly by the respective participant and partly under joint responsibility. 2.2.6.1 Processing under the responsibility of PSM GmbH

and Marketplace participants

With regard to the following processing, we are jointly responsible with the respective participants of the Online Marketplace who have placed the offer on the respective page and with whom you may book services or products:

- Data processing as part of the visit and the booking,

application or reservation process in the respective shop of the Marketplace participant, but not the downstream service processing outside the platform;

- Automated data collection, data processing to improve our online service, storage of cookies and data analysis (see Point 1.1 of this Privacy Policy);

- Data processing within the scope of advertising, communication and marketing features of the platform, especially cross-selling modules;

- Payment processing for paid bookings, applications and reservations within the framework of the respective shop of the Online Marketplace;

- Customer support with regard to the respective shop in the Marketplace.

In relation to these data processing activities, we determine the purposes and means of processing personal data in cooperation with the respective Marketplace participants. In an agreement with the relevant Marketplace participants on joint responsibility, we have defined, pursuant to GDPR Article 26, the respective tasks and responsibilities in the processing of personal data and the responsible parties to fulfil data protection obligations. In particular, we have defined how an appropriate level of security and your rights as a data subject can be ensured, how we can jointly comply with data protection information obligations and how we can monitor potential data protection incidents. This also includes ensuring that we can fulfil our reporting and notification obligations. PSM GmbH is at your disposal as your central point of contact with regard to the aforementioned processing in joint responsibility. You can assert your rights in relation to processing operations under joint responsibility but also vis-à-vis a jointly responsible Marketplace participant. Insofar as you contact us in relation to these processing operations, we will consult with the relevant Marketplace participant in accordance with the aforementioned agreement under GDPR Article 26 in order to answer your enquiry and to guarantee your data subject rights. In this case, the statements in Section 13 of the General Privacy Policy apply.

This joint responsibility does not affect, in particular, the processing operations mentioned in the General Privacy Policy, including those for master data administration (Porsche ID) and data processing on the platform, which are carried out under the sole responsibility of Porsche Smart Mobility GmbH. In particular, the service processing of the purchase, booking, application or reservation contract as well as invoicing does not take place under joint responsibility, but under the sole responsibility of the relevant Marketplace provider. 2.2.7 Formation and processing of the rental agreement

This feature enables you to rent a Porsche vehicle. In order to conclude a rental contract, you must provide us with the personal data listed below. You can save this personal data in your Porsche ID user account at any time, thus speeding up processing at the rental location. If you do not save this personal data in your Porsche ID user account in advance, you will be required to provide this personal data by completing this personal data in your Porsche ID user account at the rental location (possibly by our service provider). An appropriate device will be made available to you at the location for this purpose if necessary. In order for a valid rental contract to be created, the following

mandatory data must be saved in your Porsche ID user account:

- Gender, - First and last name, - Date of birth, - Nationality, - E-mail address, - Mobile phone number, - Address (street and house number, postcode and

card number, issuing institution, card security code). If this data is not provided, it is not possible to draw up a rental contract and the vehicle cannot be collected. We shall process the gathered data on the basis of GDPR Article 6 [1] (b) and (f) in order to provide you with the services you require in this connection, and to implement the associated contractual relationship with you. In order to establish your identity before you sign the rental contract, you will be asked by our service provider to identify yourself. In addition, to ensure the correctness of the data (for example no typographical errors, reversal of first and last name, the spelling of foreign street names and house numbers, etc.) and for security reasons (for example disclosure of the card number to the competent authorities in the event of a criminal offense or misdemeanour relating to the rented vehicle) a copy is generally made of your ID card. Unnecessary information (such as your height or eye colour) will be blacked out. You personal data will be processed on the basis of GDPR Article 6 [1] (b), (c) and (f) in order to provide you with the services you require in this connection, to implement the associated contractual relationship with you and to meet our legal obligations. Our legitimate interest derives from the purposes set out at the beginning of this paragraph. We do not process any payment data on this website. Billing uses

your Porsche ID user account. For more information on the handling of payment information, please refer to Point 5.1 of the Porsche Digital Service Infrastructure / Porsche ID General Privacy Policy.

The vehicles have a device for tracking the location and

condition of the vehicle (especially current mileage). Using

this device, it is possible for a limited number of employees

to keep track of the contractually agreed mileage and

current location of the vehicle.

You personal data will be processed on the basis of GDPR

Article 6 [1] (b), (c) and (f) in order to safeguard our

legitimate interest, to provide you with the support you

require and to prevent uses contrary to the contract and

potential damage as well as to fulfil official and/or legal
