26. NOTING OF P.C.B. SANCTION – ENGAGEMNT OF PHYSIOTHERAPIST
THROUGH OUTSOURCE AGENCY:
To note P.C.B. sanction obtaining under Section 26 of Cantonment Act,2006 for the
engagement of physiotherapist in Cantonment General Hospital,Kasauli through outsource agency.
The Cantnoment Board has established a physiotherapist ward in Cantonment General Hospital in
order to provide the medical facilities to the general public of Kasauli Cantt as well as the adjoining
areas. The necessary equipments etc. have been procured out of the fund of DSR and installed in the
said physiotherapist ward.
27. AUCTION OF KHADI ASHRAM STALL – KASAULI CANTT:
To consider the matter regarding allotment of Khadi Ashram Stall on a private treaty. The
DG,DE vide letter No.70/WC/Kasauli/C/DE/15,dated13.5.2015 and Dte,DE WC letter
No.7/15/Gen/Cantt/Vol/VI, dated 20.5.2015 desired that the request of Khadi Gram Udyog for
retention/allotment of shop to them on private treaty agreement be considered sympathetically, subject
to the condition that they will sell only those items that are made by the Khadi Gram Udyog.
The DG DE and Dte,DE WC letters are placed on the table.
28. DISPOSAL OF MUNICIPAL SOLID WASTE OF DAGSHAI CANTT:
To consider letter No.CBD/8/10/-366, dated 23.5.2015 received from Cantonment Board,
Dagshai requesting disposal of municipal waste of Dagshai Cantt at Cantonment Board,Kasuali
incinerator. The Cantonment Board Dagshai vide CBR No.17 dated 07.5.2015 resolved to obtain the
consent from Cantonment Board,Kasauli for disposing of Municipal solid waste of Dagshai at Cantt
Board incinerator,Kasauli.
The Cantt Board Dagshai letter alongwith resolution is placed on the table.
29. INTRODUCTION OF NEW ASSURED CAREER PROGRESSION SCHEME ON
COMPLETION OF 4,9 & 14 YEARS OF SERVICES IN A CADRE AND
RESTORATION OF OLD (8-16-24-32) ASSURED CAREER PROGRESSION SCHEME
FOR GOVERNMENT EMPLOYEES:
Reference CBR No.123 dated 31.3.2014.
To consider and approve the Introduction of “New Assured Career Progression Scheme” to
Cantonment Board employees,Kasauli at par with the employees of State Govt. The H.P.State Govt.
sanctioned the above scheme vide letter No.Fin(P)B(7)-59/2010, dated 09.08.2012 effective from
27.8.2009. According to the scheme on completion 4,9,and 14 years of service ina cadre w.e.f.
27.8.2009 (i.e. date before which earlier scheme was in operation) in a post or posts without any
financial enhancement in the same cadre shall be granted the grade pay which is next higher in the
hierarchy of grade pay given in the schedule annexed to Revised Pay Rules,2009 upto the maximum
grade pay of Rs.8900/-. This scheme is optional. An existing employee “including employee having
less
than four years of service will have the option either to continue in the existing “Assured Career
Progression Scheme” after a service of 8,16,24 and 32 years or to opt 4,9, and 14 years “Assured
Career
Progression Scheme.” An employee who wants to opt this new scheme will have to exercise an option
within 02 months from the date of issue of this letter alongwith an undertaking in the enclosed
proforma
that he wants to accept this scheme effective from 27.8.2009 and will not claim any arrear. An
employees who does not exercise any option within the above stipulated period of two months shall be
deemed to have opted for continuance in the earlier (8-16-24-32 ) “Assured Career Progression
Scheme”
w.e.f. 27.8.2009.
In accordance with the H.P.State Govt. notification dated 09.8.20012, the Board was
considered
the recommendation of the screening committee vide CBR referred to above and resolved that the said
scheme be given to the Cantt Board employees with the prior sanction of the GOC-in-C,the command.
Accordingly, the proposal for grant benefits under new assured career progression scheme to 61 Cantt
Board employees were submitted to the Dte,DE,WC vide letter No.CBK/Estt/3(A)-44, dated
22.4.2014.
In the meanwhile the H.P.State Govt. made partial modification to earlier orders on ACP
Scheme and its has been directed vide notification No.FIN(PR)B(7)-59/2010, dated 07.07.2014 that
once an employee has already got three enhancements/financial up-gradations i.e. grant of progression
under the New of Old ACPs or promotion or any other financial enhancement except the annual
increment or the general pay revision based on the pay commission in fourteen years or more of his/her
entire service, therefore, he/she will not be entitled for placement in next higher grade pay in the ACPs
schemes introduced vide FDs instructions dated 09.8.2012.
Accordingly, in the light of the said notification dated 07.7.2014, the matter was again
considered by the screening committee in its meeting held on 24.4.2015. Forty four employees of the
Cantonment Board have not got the benefit of three enhancement/up-gradations by way of grant of
benefit under old/new ACPs scheme or promotion and have opted for 4,9, and 14 years “New Assured
Career Progression Scheme” within 02 months from the issue of notification dated 09.8.2012 and have
given an undertaking not to claim any arrear on this account.
The service record of entitled employees who completed 4,9, & 14 years of service was
scrutinized by the screening committee and its recommendation alongwith H.P.State Govt. Notification
is placed before the Board.
30. APPOINTMENT OF LEGAL ADVISOR OF CANTT BOARD,KASAULI:
To consider and approve the matter regarding retainership of Sh.V.K.Attri, Advocate as Legal
Advisor of the Board. His services are required to defend the various court cases at Kasauli,Soland and
Labour Court at Chandigarh and to seek/obtain legal advices in various matters from time to time. The
appointment of Sh.V.K.Arrti,Advocate as Legal Advisor was approved by the Board w.e.f. 01.7.2014
for a period of one year vide CBR No.19 dated 18.6.2014. The Board vide CBR No.61 dated
28.11.2014 enhanced the retainership fee of Rs.8000/-P.M.

32. LEASING OUT OF PARKING FEE COLLECTION AT BUS STAND:
To consider the matter regarding leasing out of parking fee collection at Bus Stand. The leasing
out of collection rights of parking fee at Bus stand is valid upto 22.7.2015. The tenders for leasing out
the parking fee were invited upto 08.6.2015 through publishing advertisement in the News Papers
i.e.”The Tribune” in English on 22.5.2015 and “Dainik Bhashakar” in Hindi on 24.5.2015 and also vie
public notice on 21.5.2015. In response to the advertisements four tenders were received on due date.
The tenders so received were opened on the same day in the presence of tenders and Cantt Board
officials. The comparison of rates of tenders so received are as under:-

33. TRADE LICENSES UNDER SECTION 277 OF CANTTS ACT,2006
To consider and approve the matter regarding issue of trade licenses to Shopkeepers/Hotels
from S.No.1 to 38 of Trade License Register under Section 277 of Cantonments Act,2006 for the year
2015-16. The application of trade licenses verified by the RMO,Cantt General Hospital and
AHO,M.H.,Kasauli alongwith register is placed on the table.
34. GRASS CUTTING RIGHTS FOR THE YEAR 2015-16:
To consider and approve the matter regarding disposal of grass cutting right of Cantonment
forest area for the year 2015-16. The tenders for the grass cutting rights of forest areas were invited
upto 22.6.2015 through public notices and vide advertisement published in Hindi News Paper “Dainik
Bhashakar” on 10.6.2015. Four tenders were received on due date. The tenders were opened on the
same date at 1530 hours in the presence of tenderers and Cantt Board officials. The comparison of
rates of tenders received is as under:-

35. TENDER FOR MAINTENANCE & REPAIR OF BITUMENOUS ROADS FOR 2015-
16:
Reference CBR No.04 dated 22.4.2015.
In accordance with the decision contained in the above referred CBR, the Cantonment Board
re-invited the sealed tenders from the various firms for maintenance and repair of bituminous roads
vide tender Notices and through News Papers. In response to the advertisement five tenders were
received on due date i.e. on 06.5.2015. The tenders were opened on the same day in the presence of
tenderers and Cantt Board officials. The rates quoted by the contractors are as under:-

36. NOTINGS OF P.C.B. SANCTION – TA/DA TO ELECTED MEMBERS:
To note PCB sanction obtaining under Section 26 of Cantonments Act,2006 on account of
payment of TA/DA bills amounting to Rs.36,420/- submitted by the elected members of
Cantonment Board,Kasauli on account of attending the Orientation Programme for newly elected
members held at Delhi on 16th
& 17th
June,2015.
37. REPAIR OF DAMAGED RETAINING WALL NEAR CANTT GENERAL HOSPITAL:
To consider the matter regarding repair of damaged retaining wall near Cantt General Hospital,
Kasauli. As intimated by R.M.O.,Cantt General Hospital, the said retaining wall in the hospital
premises towards the way to Gym has been collapsed on 07.6.2015 due to heavy rain and the public
path leading to Bazar area has been blocked. The JE, Cantonment Board prepared the estimates
amounting to Rs.1,60,000/-only on account of repair of the said damaged retaining w all. The work is
to be executed through the concerned T.C. contract approved by the Board for 2015-16.
The report of RM,Cantt General Hospital alongwith estimate prepared by the JE,Cantt
Board,Kasauli is placed on the table.
38. MUTATION OF SHOP NO.1 COMPRISING SY.NO.156/3 SITUATED AT SADAR
BAZAR,KASAULI CANTT:
To consider the matter regarding mutation of shop No.1, comprising Sy.No.156/3 in favour of
Sh.Gurbachan Lal S/o Sh.Achhar Singh.The case was processed during the special drive for clearing
pending mutation cases held on 09.2.2015 in presence of Cantt Legal Advisor. The property is an old
grant property situated inside the notified civil area and stands in the name of Smt.Sheela Devi w/o
Sh.
Harbans Lal. Smt. Sheela has since been expired and she has gifted the said property to her grand son
Sh.Gurbachan Lal s/o Sh.Achhar Singh who has admitted the Govt. titled on land vide admission deed
duly registered in the office of Sub-Registrar,Kasauli on 10.2.2015. There is :-
i) No-unauthorized construction
ii) No encroachment on Govt. land
iii) No sub-division of site
iv) No change of purpose
On the basis of application dated 28.5.2013 a public notice No.CBK/Bldg/1(1)-12, dated
04.4.2015 was issued for inviting objections to the proposed mutation. The objection was also invited
through News Paper, but no objection received till date.

NO.35(LEASED PORTION) SY.NO.144/18-A SITUATED IN MRKET
BAZAR,KASAULI:
To consider the matter regarding mutation of shop No.35 comprising Sy.No.144/1 and shop
No.35(leased portion) comprising Sy.No.144/18-A,Market Bazar, Kasauli. The case was processed
during the special drive for clearing pending mutation cases held on 09.2.2015 in presence of Cantt
Legal Advisor. The property comprising Sy.No.144/1 is an old grant site and the leased portion
comprising Sy.No.144/18-A are situated inside the notified civil area and stands in the name of
Smt.Sheela Devi w/o Sh. Harbans Lal. Smt. Sheela has since been expired and she has gifted the said
property to her grandson Sh.Gurbachan Lal s/o Sh.Achhar Singh who has admitted the Govt. titled on

In accordance with the decision contained in above referred CBR, the tenders to outsource the
public toilet at Market Bazar,Kasauli were invited from the interested firms 2015 vide public notices
and through advertisement published in News Paper “ Amar Ujala” on 11.06.2015. In response to the
advertisement, three tenders were received on due date on 24.6.2015. The tenders were opened in the
presence of the tenders and Cantt Board officials on the same date. The comparison of rates tendered

44. CONSTRUCTION OF RAIN WATER HARVESTING TANK AT GAYATRI
BUNGALOW COMPRISING SY.NO. 79, LOWER MALL,KASAULI CANTT:
To consider letter dated 16.5.2015 received from Sh. Kewal Singh Kanwar, Officer - Admin &
HR Larsen & Toubro Limited,Gayatri Bungalow,Kasauli requesting to grant permission for
construction of tank for rain water harvesting at Bungalow know as Gayatri Bungalow comprising
Sy.No. 79, Lower all, Kasauli Cantt. The work required to be executed rain water harvesting tank does
not comes under the definition of “Building” as defined in the Cantts Act,2006.
As required under Section 186(3) of Cantonments Act,2006,it shall be the duty of every Board
to practice and propagate the scientific methods of water harvesting including harvesting of rain water
for use and make arrangement for recharging the sources of ground. Accordingly, in the light of the
provision of Cantts Act, the general public may be encouraged to adopt the method of rain/roof water
harvesting in Kasauli Cantt.

45. AUCTION OF CANTONMENT BOARD MARKET STALLS ETC.
Reference CBR No.44, dated 29.9.2014.
In accordance with the decision contained in the above referred CBR, the auction of Cantonment
Board stalls/godowns/khokhas etc have been conducted successfully in phased manner on 11.11.2014
and 28.5.2015 respectively. During the course of auction of stalls etc held on 11.11.2014 in phase, the
Cantonment Board had already asked all the ex-lessees to handover their respective stalls etc to
Cantonment Board peacefully on 11.11.2014 midnight to enable this office to handover the same to
the successful bidder. As per terms of the public auction, the stalls etc were handed over to the
successful bider w.e.f. 01.12.2014. In response to this office letter referred to above, all ex-lessees
except the following Ex-lessee handed over their stall etc to Cantonment Board:-

All the above mentioned stalls etc were subletted further by the original lessees. During the
course of public auction held on 11.11.2014, the sublettees retained the stalls mentioned at Sl.No.1,2,5
and 8 with themselves by giving competitive bid whereas other sublettees mentioned at Sl.No.3,4, 6
and 7 did not hand over the vacant possession to Cantt Board in stipulated time period and
continuously run the trades in the said stalls etc unauthorizedly. Further, this office vide Notice
No.CBK/Bldg/3-771, dated 28.11.2014 gave a final opportunity to the aforesaid ex-lessee to handover
the vacant possession of the said Cantt Board stalls etc to Cantt Board to avoid further action. All the
ex-lessees mentioned above handed over the vacant possession to this office beyond the stipulated
time period causing delay in handing over the same to the successful bidder/lessee on due date i.e.
w.e.f. 01.12.2014.The new lessee however, requested that their agreement may please be treated as
executed from the date of possession of stall instead of 01.12.2014. The detail of handing over of
physical possession of stalls to the new lessees is given as under:-

The stall No.2,3,11 and godown No.38 as mentioned above were subletted by the original
lessees and the subletees retained these stalls etc with themselves by giving competitive bid. Therefore
no change in gound position as they continued the same trade as they were running earlier. Only a
change was required in the papers as the name of the lessee is to be changed.
All the successful bidder/lessees have submitted the Agreement executed to Cantt Board
except stall No.2,Smt. Minakshi Bharti. Despite of repeated notices, the lessee of stall No. 25 still has
not taken over the possession of his respective stall from Cantonment Board till date. The Cantonment
Board office vide letter CBK/Bldg/3-118, dated 06.5.2015 also requested the ASG,Govt. of India to
provide legal opinion in the matter. The legal opinion is still awaited.
Similarly, the auction of the rest 34 stalls etc were held on 28.5.2015. The Board approved the
auction proceedings vide CBR No.24 dated 30.5.2015. All the ex-lessees except two have handed over
the vacant possession in respect of their respective stalls etc to Cantt Board. All the successful
bidder/lessees have executed the lease agreement with Cantonment Board w.e.f. 15.6.2015 and taken
over the possession of stall etc from Cantt Board on due date. The Ex- lessee of stall No.01,20 and
stall No. 24 have not yet handed over the vacant possession to Cantt Board. However, the successful
bidder/lessee of Stall No.1 & 24 have executed the lease agreement with Cantt Board. The successful
bidder/lessee of stall No.20 has not yet submitted the Non–judicial stamp paper to this office for
execution of lease agreement. Both the stalls are to be shifted amongst the lessees. Therefore, both the
lessees have submitted an Affidavit to this office and have come into mutual agreement that they shall
vacate the stall by 29.6.2015.
To consider the action to be taken in the matter. The whole case file is placed on the table.
46. FIXING OF PHSIOTHERAPY CHARGES:
To consider the matter regarding fixing of physiotherapy charges in Cantonment General
Hospital,Kasauli. The Physiotherapist of Cantt General Hospital,Kasauli vide letter dated 27.6.2015
proposed to fix the following physiotherapy charges:-

47. BEAUTIFICATION OF KASAULI CANTONMENT:
To consider the proposal submitted by Sh.Vivaan Sundram a resident of Upper Mall,Kasauli to
donate two of his painting “Quitanl of Grass” and “Ten feet Beam” to Cantonment Board,Kasauli to
transfer it on tiles and put them on any of the retaining wall on the entrance of Kasauli.In this regard
Sh.Vivaan Sundram has forwarded a copy of these two painting to the Board for the approval of the
design. Once approved, the cost of construction of these painting in the form of tiles work shall be
borne by Sh.Vivaan Sundam himself as a gift to Kasauli.
48. DONATION OF ELECTRIC-BATTERY OPERATED VEHICLE:
To consider the proposal submitted by Sh.Rajiv Luthra and other to donate battery operated
vehicle to Kasauli Cantonment Board in order to help and assist Cantonment Board to regulate the
traffic problem in Kasauli. Sh.Rajiv Luthra and others have proposed donation of Mahindra Maxximo
electric after holding a trial run for this vehicle in month of July. The plying of electric vehicle would
require regulating of traffic on the Upper and Lower Mall by not allowing the traffic to move beyond a
certain point. It shall also require fixing of suitable rate by the Cantonment Board for trip to Monkey
point and other tourist points in Kasauli. A major component of the proposal shall be
running/operation/
Maintenance of the said vehicles. A suitable Model is also required for the same.
49. SHIFTING OF BARRIER:
To consider the matter of shifting of Cantonment Board Barrier from Bus Stand Kasauli to a
suitable location within the Cantonment in order to meet the present day requirement of traffic
regulation. It has been experienced over the past couple of years that the numbers of tourists visiting
Kasauli has increased manifold. There is a constant problem of congestion of traffic near exiting Cantt
barrier at Bus Stand. This often leads to long queue of cars creating traffic block at the entrance of Bus
Stand and Kasauli Cantonment.
50. WATER CONNECTION:
To consider the application of Sh. S.S.Brar resident of Lower Mall,Kasauli. Sh.S.S.Brar was
sanctioned a domestic water connection on certain terms and conditions by the Cantonment
Board,Kasauli vide its CBR No.89 dated 06.2.2015. Sh.S.S.Brar complied with all the terms and
conditions and submitted his agreement alongwith other documents to the Cantt Board office. The
connection was sanctioned on the condition that Sh.S.S.Brar shall approach for permanent water
connection from the I&PH Deptt. H.P.State Govt. and the existing water connection, through
Cantonment Board, shall automatically be withdrawn after completion of one year from the date of
execution of agreement. Sh.S.S.Brar approached the I&PH Deptt but was refused (in writing) by the
I&PH Deptt. “ as the house of the applicant falls up stream site of the scheme LWSS Garkhal Dochi
and as per site condition it is impossible for the department to provide water connection to the
applicant”.
Keeping in view of the facts explained above, the applicant vide letter dated 11.6.2015 requested Cantt
Board,Kasauli to regularize the domestic water connection in view of the circumstances explained.
51. BEAUTIFICATION OF GILBERT TRAIL:
To consider the matter regarding beautification of gilbert trail by providing benches, sign
boards etc. The said gilbert trail is used by the tourist visiting Kasauli. Therefore, the gilbert trail is
requited its proper cleanliness.
52. IDENTITY CARD TO SERVANT ENGAGED IN CANTT BOARD SHOPS:
Reference CBR No.18 dated 22.4.2015.
To consider the matter regarding issue of ID cards to the servants engaged by the shopkeepers
in their respective stalls etc. The Board vide CBR referred to above resolved that the directions of the
Army Cdr be implemented in Cantt Board Market shops,Kasauli.
53. IDENTIRY CARDS TO ELECTED MEMBERS:
To consider the matter regarding issuing of Identity Cards to the elected members of
Cantonment Board,Kasauli. The elected members of Kasauli Cantt requested to issue ID cards as other
Cantt Boards have already issued the ID cards to their members.
