The case is presently before the Court on a number of challenges to its extraterritorial jurisdiction over the actions of the Defendant. Also at issue is whether, under the law of war, the Defendant is subject to prosecution as a combatant in a theater of war. Both the United States and the Defendant have submitted detailed memoranda supporting their respective positions, and the Court heard evidence and oral argument on June 17-18, 2015. While many of the principles governing the issues at hand have been well-developed in courts of the United States, their application to a group of insurgents purportedly affiliated with the Taliban is a venture into a new frontier. The complexity of the Court's analysis is compoundedin two respects.
