Secondary liability rule is unclear and may be broader than in the
U.S.
一定以上の割合で侵害コンテンツが存在するサービスは、抽象的な侵害の認識で違法となる可

A service with infringing content above a certain amount can be
held liable with a general awareness of infringement
通知の窓口の指定がなく、誰が通知を受領してもプロバイダに
「認識」があることとなる
No system of designated agent – any notice to any department can create knowledge or awareness
of the provider
プロバイダの免責基準は「侵害を知ることができたと認め
るに足りる相当の理由」( Cf. 米国「明白」)
Providers are liable when “there is a reasonable ground to find that
said provider could know the infringement of the rights”
(Cf. U.S.: “apparent”)

ビックデータの時代には個人を識別できない情報の収集・利用もプライバシー侵害とな

In the age of Big Data, collection and use of Non-PII can create
infringement of privacy

U.S. and EU has taken a step to give certain protection with legal enforcement over both PII and
