Indeed, our Construction Industry is a pioneer in the Hong Kong’s meditation history. The Hong Kong government officially ratified mediation as a legal process in 1982 while modifying the arbitration ordinance to help settle disputes in the construction industry and those involving commercial organizations. The government launched a mediation pilot scheme to settle various disputes arising from 16 selected official civil engineering contracts. The program was implemented by The Hong Kong Institution of Engineers (HKIE) based on the 1985 HKIE Mediation Service Rules. The first successful case occurred in 1986 when the rules helped solve a number of private business disputes. In 1989, HKIE and the Hong Kong government issued an updated version of the Mediation Service Rules and Administrative Guide to support those parties wishing to resolve disputes through mediation. The Rules stipulate that disputes arising from government contracts worth over HKD6 million can be solved by mediation. In January 2011, Hong Kong began implementing the Practice Direction - 31. Citizens who intend to pursue civil action are sent a mediation certificate informing them of the advantages of mediation over legal action.   • So, what is Mediation?Mediation comprises four main characteristics:

    1. Voluntary The entire mediation process is based on the

    voluntary participation of both parties; either party or the mediator can withdraw from the process at any time. The aim of mediation is for both parties to voluntarily reach an agreement, and not as a result of coercion or intimidation. Although, the parties’ rights to legal action cannot be replaced by imposed mediation a court has the right to order both parties to use mediation to resolve a dispute before the matter is heard by a court in the case that mediation fails. This does not conflict with the litigation rights conferred by the Constitution on Hong Kong citizens. In practice, however, most parties involved in a dispute undertake mediation based on the direct or indirect demand of the court.

    2.ConfidentialityMediation is generally a confidential process and its content is not admissible in any subsequent court or legal proceeding. This complies with the one most important explicit or implicit article of a mediation agreement - the mediation process and all materials developed for mediation are absolutely confidential. Neither the parties nor the mediator can disclose the mediation process or content to any third party unless agreed by both parties. Additionally, unlike litigation, the media is forbidden to report any aspect of the mediation process.

    Any issue relating to the case raised by either party during mediation does not affect that party’s rights and obligations, except the final result agreed by both parties through mediation.

    3. NeutralityThe mediator has the responsibility to assist each mediating party equally. The mediator cannot determine what is right or wrong, favor the interests of one party, make decisions for either party, or make a judgment based on his or her professional knowledge of the sector on which a dispute is focused. Logically, both parties usually appoint an individual with professional dispute knowledge as a mediator so as to effectively facilitate the mediation process.

    4. Legal AcknowledgementWhen an agreement is reached, the mediator prepares a mediation agreement that becomes legally binding when signed by both parties. If

    Advantages of MediationThe current Justice Secretary for Hong Kong, Wong Yan-lung, has pointed out that civil action can take up to two years, which is considerably longer than the mediation timeframe of between one or two weeks. And it is highly expensive. Therefore, mediat ion is more eff ic ient, dramatically saving both time and money. Another advantage of mediation is its flexibility and confidentiality. By comparing the features of mediation, arbitration, and litigation, the following table indicates some of the usually overlooked advantages of mediation.

    prompted the government to begin advocating mediation as an expedient option: firstly, it is far cheaper and quicker than a lawsuit; and secondly, court workloads are reduced, enabling appropriate cases to be heard by courts more quickly.

    Postscript As a recognized mediator, I have found that mediation training imbues one with strong conflict management skills. My experience in the field of mediation has also enabled me to understand the happiness, anger, joy and grief experienced by those who practice law in Hong Kong. Most mediators from sectors other than engineering are barristers and solicitors. In most cases, the key tasks of carrying out the legal process are not just about using legal provisions to solve problems. They have to strike a balance between justice and human emotion. The capability to do so is a highly valuable skill.

    Restrictions of MediationNevertheless, mediation cannot completely replace arbitration and litigation, and is not applicable in the following scenarios:

    1. Legal definitions; for example, the two parties differ in opinion over the definition or interpretation of certain points of law;

    2. Conflicts in principle; for example, disputes over religious doctrines;

    3. Malicious motives; for example, one party employs delay tactics to cause the other to lose the right and opportunity to pursue litigation;

    4. Personal safety; for example, criminal cases or cases that involve violence;

    5. Mental or emotional issues; for example, one party requires psychological treatment;

    6. Disputes based around the establishment of truth based on facts.

    7. Disputes that can only be resolved by a court; for example, granting an injunction or a writ of habeas corpus;

    8. Principles that cannot be compromised

    “Save the words to the court” is no longer the only optionAlmost all civil law cases were previously decided through legal action, including engineering contracts, property rights disputes between family members, medical claims, and custody battles.   • 香港機電工程商聯會與其六個屬會 (包括香港空調及冷

    凍商會) ,在2011年7月8日共同簽署了「調解為先承諾

    書」,在此承諾書上提及到聯會/屬會與個人或商業機

    構之間若有爭議,聯會/屬會意先嘗試採取調解來解決

    紛爭爭議,然後才依循其他解决方法或於在法庭進行訴

    訟來取替代爭議。

    其實我們工程界於香港「調解」發展史上早已擔當了先

    行者的角色。當時的香港政府在1982年修改仲裁條例

    時,正式引入調解於有關法例內,協助建造業及商業機

    構解決他們之間的糾紛。在同一時間亦推行了一個「調

    解試驗計劃」,試圖解決16個選定官方土木工程合約

    所產生的合約糾紛。這個調解試驗計劃是由香港工程師

    學會(HKIE)舉辦,按HKIE「調解服務規條第(1985年版

    本)」進行監察。第一個成功個案是於1986年,調解服

    務規條來解決了私人商業糾紛。於1989年,HKIE及前

    香港政府推出一套更新的「調解服務規條及行政指引」

    來,協助那些願意使用調解人士,並規定所有總值超過

    港幣600萬元的政府合約,均可選擇調解來解決他們的

    合約糾紛。

    究竟什麼是「調解」呢?

    簡單而言,調解共有四方面的特質:

    (一) 自願性

    整個過程是雙方自願參與加的,爭議雙方及調解員亦有

    權隨時終止會議的;經調解後,雙方能否達成和解協議

    亦必須按雙方的意願而定,不能強迫,這是合約的基本

    精神。故此,並不容許強制以調解取代爭議雙方的訴訟

    權利。然而,這並不表示法庭在實質審理訴訟之前,便

    無權要求爭議雙方進行調解以嘗試達至和解協議,若調

    解失敗,方才由法院審理。此舉與憲法賦予香港市民的

    訴訟權利並沒有牴觸。在實踐的層面,爭議雙方往往是

    在法庭直接或間接命令或「鼓勵」下才進行調解的。

    (二)保密性

    整個過程都是在完全保密環境下進行,而雙方及調解員所

    有對話是完全保密的,亦不會作為日後呈堂証供。這是遵

    照調解協議的一個重要明文或暗示條款—調解過程和內

    容必須完全保密。除非獲爭議雙方同意,否則無論是任何

    一方或調解員均不能向外透露調解的過程和內容。基於這

    個原因,調解都是私下進行的。而傳媒亦不能就調解過程

    和內容作出任何報導,這與訴訟完全不同。

    爭議雙方在調解中透露的任何與案有關的事情及作出的任

    何提議,均以不損害其法律權責為原則。但上述並不適用

    於雙方經調解後所達成的調解協議結果,這是唯一例外。

    (三) 中立性

    調解員以中立第三者的身份,協助雙方進行談判,協助

    雙方最後能找到解決方案。但在過程中調解員是不會判

    斷誰對誰錯,亦不會替雙方作出任何決定。通常爭議雙

    方通常會找一名對爭議事項有專業知識的人士擔任調解

    員,以方便進行調解,這也是理所當然的。但無論調解

    員的專業知識或經歷何其豐富,他亦不能偏袒任何一

    方,或就雙方爭議之事情作出任何專業「判決」。

    (四) 法律認受性

    當達成協議之後,調解員會為雙方起草一份調解協議書

    給當事人簽署,一經簽署,這份協議書便具有法律效

    力。若一方違反調解協議的條款,受害一方可向法庭提

    出訴訟,要求強制執行或賠償。

    而在2011年1月,本港已實施(法庭實務守則31條),打

    算進行民事訴訟的市民將收到調解證明書,藉以認識及

    考慮利用調解代替訴訟的好處。市民必須回應是否願意

    進行調解,若不願意必須給予解釋,若法庭認為調解比

    訴訟更為合適,但當事人仍堅持打官司的話,即使勝訴

    亦可能討不回訴訟費,而律師亦有責任向當事人解釋調

    香港特區政府現任律政司司長

    黃仁龍曾指出,一般民事訴訟

    的官司需要花較長的時間,部

    份案件更要用上兩年之久以及

    龐大費用進行訴訟。若能透過

    調 解 解 決 , 隨 時 可 在 一 至 兩

    二個星期完成,。所以調解是

    一種既省時又省錢的解決糾紛

    的好方法。除此之外,其彈性

    處理程序及保密性亦是其一可

    話雖如此,調解亦不能完全取代仲裁及訴訟處理衝突個案,以下情況是不適宜進行調解的:

    (一) 涉及法律定義,例如爭議雙方對法律條文有不同的定義或解釋;

    (二) 原則性的衝突,例如宗教思想上的教條糾紛;

    (三) 不良的背後動機,例如其中一方想拖延時間使對方失去追討的權利及機會;

    (四) 涉及人身安危,例如嚴重暴力或刑事案件;

    (五) 精神及情緒問題,若某一方爭議人的精神狀況需接受要心理治療;

    (六) 需要尋求事實真相,有關糾紛是需要涉及判斷事實的可靠性及真實性;

    (七) 非常緊急,只有經法庭才能給予保障,如人身保護令及禁制令;

    (八) 不能妥協的價值。

    後記

    筆者是一位認可的和解員,在修讀調解課程的過程

    中,最大的收獲相信是學會了更多衝突管理的技巧;

    除此之外,更認識到工程以外來自不同行業的和解員,

    當中有很大部份是執業大狀及律師。因而體會到香港

    法律從業員的「樂與怒」、「喜與悲」。很多時候他

    們解决問題方法不一定靠硬道理的法律條文,而是盡

    量做到「情理兼備」的原則,這一點也是值得我們學

    習的地方。

    「有乜事, 到法庭先講!」已不是唯一的選擇

    以往無論工程合約爭執、子女爭產、醫療索償、父母

    離婚爭取撫養權等民事案件,都只能夠以訴訟的方法

    處理;當中某程度上只涉及「為啖氣!」而付出大量時

    間、金錢及精神,即使最終勝訴也可能得不償失。因此

    政府近年提倡以調解作為訴訟以外的另一選擇,一方面

    可減省市民對訴訟付出時間及金錢,而另一方面又可減

    低法庭的積壓的案件數目,使有確實需要作訴訟的案件

    得到盡快處理。

    Trane Care Services – New Instrument for Professional Eddy Current Test Services特靈空調護理服務-專業的渦旋電流測試服務

    With the increasing demand for chiller system reliability from our customers, Trane Service Hong Kong has recently introduced an additional brand new tube- testing instrument - the “ECT48 Mmicro Dock” Eddy Current System - with state-of-the-art technology to provide professional services to our customers.

    A heat exchanger (condenser and evaporator) contains several hundred tubes, all of which undergo mechanical stress and chemical corrosion. Corrosion may cause leaks into the rest of the equipment, stopping the production of chilled water but also damaging the compressor mechanism and internal heat exchanger elements, ultimately leading to major system breakdowns. The tube condition is therefore critical to chiller performance and yet tubes are not checked during standard maintenance. While they are relatively easy to maintain, heat exchangers can be very expensive to repair or replace.

    The eddy current test is a non-destructive test that uses electromagnetic sensory technology to locate, identify and record defects in the heat exchanger (condenser and evaporator) tubes. Our new eddy current system, the “ECT48 Micro Dock” Eddy Current System, is a high-speed, fully- featured 4-frequency, 8-channel eddy current system capable of automatic defect detection and analysis. Performing eddy current tests with our new system is the most effective way to maintain heat exchangers in optimum condition and avoid catastrophic failure of your chillers.

    Start-up and Stop Sequence of the Trane AdaptiView™ Chiller特靈AdaptiView™ 冷水機組一般起動操作模式

    A chiller compressor is often likened to a human heart. In turn, the chiller controller resembles a brain that controls movement, thought and memory. After receiving a customer’s startup and shutdown instructions via either the Building Management System (BMS) or at the AdaptiView™ display module, the Trane AdaptiView™ controller monitors the startup and shutdown processes of the system to ensure that the chiller operates stably.

    AdaptiView™ has five general states (see Fig.1): power up, stopped, starting, running, and stopping. The following demonstrate the start up and stop sequence of the chiller.

    Start up sequence (see Fig.2)1) Start the chilled water pump and establish

    speci f ied water f low (recommend 15 minutes).

    2) Start the condensing water pump and establish specified water flow (recommend 15 minutes).

    3) Automate the start up operation mode by pressing the “Auto” button on the AdaptiView™ display module or by sending an instruction from the BMS.

    4) Check the motor wiring sensor and oil temperature (normal oil temperature: 60℃-63℃).

    5) Check that the inlet guide vane is fully closed6) Start the oil pump and establish the oil

    pressure (differential oil pressure: 124 kpa-152Kpa for not less than one minute).

    7) Check the system vacuum lockout protection8) Start the compressor (approx. four minutes

    af ter the water f low establ ish at the evaporator and the condenser).

    Stop sequence (see Fig.3):1) Close the inlet guide vane and de-energize

    the compressor’s current.2) Stop the compressor and shut down the

    condensing water pump.3) Keep the oil pump running for at least three

    minutes.

    4) Stop the oil pump and check the oil pressure.5) Stop the chilled water pump.

    The self-adjusting function of AdaptiView™ controller enables it to accurately monitor loading based on the fluctuation of the system chilled water temperature. This not only improves energy efficiency but also provides customers with a comfortable air-conditioned environment. Customers can review the daily running status of the chiller using the AdaptiView™ built-in chart functions. AdaptiView™ also outputs diagnostic reports to lab top computer for further analyze of any faults occur.

    冷水機組的壓縮機往往比喻為人體的心臟,而冷水機組的控制器就

    像我們的大腦,控制身體各部份作出各種動作、分析和記憶。特靈

  • 「啟動中」次序( 見圖二):

    1) 啟動蒸發器冷凍水泵並建立水流量 (建議15分鐘)。

    2) 啟動冷凝器散熱水泵並建立水流量 (建議15分鐘)。

    3) 自動操作模式,可直接由AdaptiView™控制介面上按起動

    (Auto)或大廈屋宇管理系統發出起動指令。

    4) 檢測馬達溫度傳感器及油溫是否正常 (正常油溫60℃至

    63℃ )。

    5) 檢測導葉片並確保已關閉。

    6) 啟動油泵並建立油壓 ( 建立油壓124 Kpa-152 Kpa不少於

    1分鐘 )。

    7) 檢測系統真空鎖定保護。

    What is the Impact of CARBON TAX? Australia Government CLEAN ENERGY FUTURE (CEF)Regulations for HVAC Industry

    碳排放稅有何主要影響?澳洲政府針對暖通空調業而推行的潔淨能源未來法案

    In view of solid evidences and data proving that the world is warmer than before and that the high level of carbon pollution poses risks to our ecosystem, the Australian Government has developed a comprehensive plan to move towards a clean energy future. The need for this plan is clear, from both an environmental and economic perspective, and involvesd the four (4) elements listed below:

    1. Carbon Tax;2. Renewable Energy; 3. Energy Efficiency; 4. Action on the Land.

    One of the key objectives of this plan is to ensure that Australia fulfills its commitments by reducing the emission of Green House Gases (GHG) by at least 5 percent by 2020 compared with 2000, and by 80 percent by 2050.

    鑑於有充分證據及數據證明全球氣候正不斷暖化,而碳污

    染亦對生態系統構成威脅,澳洲政府制定了一套全面的計

    劃,引領全國邁向潔淨能源的未來。此計劃無論從環保及

    經濟角度出發,皆目標清晰,並包含下列四大元素:

    1. 實施碳排放稅;

    2. 發展可再生能源;

    3. 提高能源效益;

    4. 善用土地資源。

    此計劃的其中一個主要目標,是確保澳洲能在2020年以

    前,較2000年減少最少5%溫室氣體排放量,及至2050

    年,則減少80%溫室氣體排放量。

    The above mentioned item (1), the Carbon Tax, will be implemented in a two-stage approach:

    1. The carbon pricing mechanism will commence on 1 July 2012, with a tax that will be fixed for the first 3 years. The tax will start at A$23 per ton and will rise by 2.5 per cent per annum in real terms.

    2. On 1 July 2015, the carbon tax will transition to a fully flexible tax under an emissions trading scheme, with the price determined by the market.

    Among the six types of Green House Gases: CO2, HFCs, N2O, SF6, PFC, & CH4, most of the widely- used HFC refrigerants , have high Global Warming Potential (GWP) values, and, therefore, the price impact for our HVAC industry will be very substantial.

    The tax amounts for 2012/13, per kg of refrigerant will be A$23/ton CO2-e. The future Carbon Tax will be increased to A$24.15/ton CO2-e in 2013/14 and A$25.40/ton CO2-e in 2014/15.

    If you plan to have chillers or air conditioners installation with R134a/R410A, the prices of HFC refrigerants will have a significant effect on the equipment’s Total Life Cycle Cost calculation.

    上述的第一項-實施碳排放稅將分兩階段實行:

    1. 碳排放稅機制將於2012年7月1日實施,稅項在首三

    年將固定不變。稅項開始為澳元$23/噸,並按實值計

    算,每年上升2.5%。

    2. 2015年7月1日,在排污交易計劃下,碳排放稅將改變

    為具高度彈性的稅項,由市場定價。

    六種主要溫室氣體包括:CO2、HFCs、N2O、SF6、PFC及

    CH4。大部分獲廣泛使用的HFC冷媒皆具有高全球暖化潛能

    值(GWP),因此,這對我們暖通空調行業的價格影響非

    常大。

    2012/13年度稅額,按冷媒每公斤計算,將為澳元$23/

    噸 CO2-e。未來的碳排放稅將於2013/14年度升至澳元

    $24.15/噸 CO2-e,及於2014/15年度升至澳元$25.40/噸

    CO2-e。

    Aberdeen Marina ClubIn 2010, the Aberdeen Marina Club implemented a two-phase project to upgrade its air conditioning system. As part of the project, Trane has provided four air cooled screw chillers with a total cooling capacity of 1,000 tons. When the project ends in January 2012, the Trane solution will deliver the building’s highest cooling capacity since its completion in 1984.

    Commercial Development Project ofSheung Shui Town Lot 73Trane has provided three 400-ton water cooled screw chillers for the Sheung Shui Town Lot 73 project. The chillers are expected to be delivered to the construction site in July 2012.

    Printing HouseLocated in Central, The Printing House plans to renew three 400-ton water cooled screw chillers. Testing and commissioning is expected to be finished by the summer of 2012.

    Grand Central PlazaLocated near Sha Tin Station on the MTR East Rail Line, Grand Central Plaza comprises a 16-storey grade A office building and a 4-storey shopping mall. Trane Service Hong Kong has been contracted to upgrade and optimize the building’s air conditioning system. The project includes replacing the old air cooled chillers with four sets total 1,600-ton water cooled screw chillers system includes installing six numbers of cooling towers; upgrading the system’s water pumps, water tanks, water supply systems and switchboards with the latest solutions. The project is set to run from November 2011 to May 2012. Trane engineers will liaise with Hong Kong’s Electrical and Mechanical Services Department, Water Supplies Department and Buildings Department to ensure the project runs smoothly. Upon completion of the project, annual saving of 4.92Million kWh or reduction of 3,450 tonnes carbon dioxide Green House Gas were estimated to achieve.

    深灣遊艇俱樂部於1984年落成的深灣遊艇俱樂部由2010年開始分兩階段進

    行空調系統更新工程,整項工程預計於2012年1月完工。

    特靈為該工程提供4台風冷螺杆式冷水機組,總冷量超過

    1,000冷噸。工程完工後,將為大廈提供較以往更高的總製

    冷量。

    上水市73地段商業發展項目特靈為上水市73地段商業發展項目提供3台400冷噸的水冷

    螺杆式冷水機組,機組預計於2012年7月付運至工地。

    印刷行位於中環的印刷行,將更換3台合共400冷噸的水冷螺杆式

    冷水機組。預計於2012年夏季完成機組調試。

    新城市中央廣場鄰近港鐵東鐵綫沙田站的新城市中央廣場,由兩座16層

    高甲級寫字樓及4層購物商場組成。特靈空調服務為該客

    戶更新空調系統,包括把舊有風冷式冷水機組更換為4台

    合共1,600冷噸的螺杆式冷水機組系統,包括6台水塔、

    水泵、水缸、供水系統及制櫃等設備。工程期由今年11

    月至明年5月,特靈工程師須與機電工程署、水務署及屋

    宇署多方協調,確保工程得以順利進行。待工程完成,

    估計每年可節省492萬度電及減少製造3,450公噸二氧化

    碳溫室氣體。

Mrs. Carrie Lam, GBS, JP, Secretary for Development was invited as their guest of Honour. A few weeks earlier on November 10, the Hong Kong Federation of Electrical and Mechanical Contractors (HKFEMC) held its 10th anniversary celebrations at the JW Marriott Hotel Hong Kong.

    The seminars covered the development trends of Trane’s full series of air conditioning products, variable primary flow systems, chiller plant controls systems, and trend of refrigerants.

    Besides, Mr. Mike Thompson, Trane’s US Global Leader of Refrigerant Strategy, visited Trane Hong Kong to give a presentation on the latest refrigerant market developments to engineers. Later he went to a consultancy firm and introduced refrigerant knowledge there.

    Dennis Ng from the Energy Solution Department visited Trane’s US headquarters in late July 2011 to attend a four-month Graduate Training Programs (GTP) covering basic air conditioning systems, products, and sales strategies. The program gave Dennis the chance to meet 50 of Trane’s engineers from other parts of the world.

    ASHRAE RP Walk 20112011 ASHRAE 步行籌款The Research Promotion Committee of the American Society of Heating, Refrigeration and Air-Conditioning Engineers - Hong Kong Chapter (ASHRAE HKC) organized a ASHRAE RP Walk 2011 at Hong Kong Geopark on November 20 to raise funds for the committee. Mr. Albert Lo, Senior Manager of Trane Hong Kong (also the incumbent President-Elect of ASHRAE HKC), and two colleagues participated in the event. Trane staff raised a sizable sum for the committee and pledged their support for the event.
