    III. Further Information

    The Office of New Reactors and Officeof Nuclear Reactor Regulation are

    revising these sections from theircurrent revisions. Details of specificchanges in the proposed revisions areincluded at the end of each of theproposed sections.

    The changes to this SRP chapterreflect current staff review methods andpractices based on lessons learned fromNRC reviews of design certification andcombined license applicationscompleted since the last revision of thischapter. Among other changes, therevisions include (1) revision of the titleof SRP Section 11.1 to Coolant SourceTerms, (2) implementation of InterimStaff Guidance (ISG), COL/DCISG013

    (ADAMS Accession No. ML12191A304),and (3) the revision also harmonizesSRP Section 11.2 with BTP 11.6regarding the guidance of COL/DCISG013 for calculating doses to members ofthe public and identifying acceptablecriteria in assessing the radiologicalconsequences of accidental releases dueto tank failures.

    IV. Backfitting and Finality Provisions

    Issuance of these draft SRP sections,if finalized, would not constitute

    backfitting as defined in 50.109 ofTitle 10 of the Code of Federal

    Regulations (10 CFR), (the Backfit Rule)or otherwise be inconsistent with theissue finality provisions in 10 CFR part52. The NRCs position is based uponthe following considerations.

    1. The draft SRP positions, iffinalized, would not constitutebackfitting, inasmuch as the SRP isinternal guidance to NRC staff.

    The SRP provides internal guidanceto the NRC staff on how to review anapplication for NRC regulatory approvalin the form of licensing. Changes ininternal staff guidance are not matters

    for which either nuclear power plantapplicants or licensees are protectedunder either the Backfit Rule or the

    issue finality provisions of 10 CFR part52.

    2. The NRC staff has no intention toimpose the SRP positions on existinglicensees either now or in the future.

    The NRC staff does not intend toimpose or apply the positions describedin the draft SRP to existing licenses andregulatory approvals. Hence, theissuance of a final SRPeven ifconsidered guidance within the purviewof the issue finality provisions in 10CFR part 52would not need to beevaluated as if it were a backfit or as

    being inconsistent with issue finality

    provisions. If, in the future, the NRCstaff seeks to impose a position in theSRP on holders of already issuedlicenses in a manner that does notprovide issue finality as described in theapplicable issue finality provision, thenthe staff must make the showing as setforth in the Backfit Rule or address thecriteria for avoiding issue finality asdescribed in the applicable issue finalityprovision.

    3. Backfitting and issue finality donotwith limited exceptions notapplicable hereprotect current or

    future applicants.

    Applicants and potential applicantsare not, with certain exceptions,protected by either the Backfit Rule orany issue finality provisions under 10CFR part 52. Neither the Backfit Rulenor the issue finality provisions under10 CFR part 52with certainexclusionswere intended to apply toevery NRC action that substantiallychanges the expectations of current andfuture applicants. The exceptions to thegeneral principle are applicablewhenever an applicant references a 10CFR part 52 license (e.g., an early sitepermit) and/or NRC regulatory approval

    (e.g., a design certification rule) withspecified issue finality provisions. TheNRC staff does not, at this time, intendto impose the positions represented inthe draft SRP in a manner that isinconsistent with any issue finalityprovisions. If, in the future, the staffseeks to impose a position in the draftSRP in a manner that does not provideissue finality as described in theapplicable issue finality provision, thenthe staff must address the criteria foravoiding issue finality as described inthe applicable issue finality provision.

    The NRC staff is issuing this notice tosolicit public comments on theproposed SRP Sections and BTPs in

    Chapter 11. After the NRC staffconsiders any public comments, it willmake a determination regarding theproposed SRP Sections and BTPs inChapter 11. The SRP is guidance for theNRC staff. The SRP is not a substitutefor the NRC regulations, and compliancewith the SRP is not required.
