W hereas it is enacted by section five of the D angerous D rugs Act, ig2 5 (a ), th a t if H is M ajesty in Council th inks fit to declare that a finding w ith respect to an y p repara tion containing any of the d rugs, to w hich P a r t I I I of the D angerous D rags A ct, 1920(b ), as am ended b y the said D angerous D rugs A ct, 1925, applies, h as , in pursuance of A rticle 8 of the In ternational Opium C onvention signed a t G eneva on behalf of H is M ajesty on the n ineteenth d a y of F eb ru ary , 1925, been com m unicated by the Council o f the League of N ations to the parties to the said C onvention, the provisions of the said P a r t I I I shall as from such date a s m ay be specified in the D eclaration cease to apply to the p repara tions specified therein :

Now, therefore, H is M ajesty is pleased, b y and w ith the advice of H is P riv y Council, to declare, and it is hereby declared, th a t findings w ith respect to the p repara tions speci­fied in the Schedule hereto have in pursuance of A rticle 8 of the said C onvention been com m unicated b y the Council of the League of N ations to the parties to the said C onvention and that the d a te from w hich th e provisions of P a r t I I I o f the Dangerous D rugs A ct, 1920, shall cease to app ly to the said preparations shall be th e th irtie th d a y of Ju n e , 1937.

T he K ing’s Most E xcellent M ajesty in Council

W hereas b y subsection (2) of section eight of the D angerous Drugs A ct, 1920, as am ended by subsection (2) of section one of the D angerous D rugs A ct, 1932, (a ) pow er is conferred on H is M ajesty b y O rder in Council to declare th a t P a rt I I I of the D angerous D rugs Act, 1920, shall app ly to any d rug of w hatever lan d in the sam e m anner as it applies to the drugs m entioned in subsection (1) of the said section eight if it appears to H im th a t the d ru g is o r is likely to be productive, if im ­properly used, o r is capable of being converted in to a substance which is or is likely to be p roductive, if im properly used, of ill effects substan tially of the sam e charac te r o r na tu re as or analogous to those produced b y m orphine or cocaine :

A nd w hereas is appears to H is M ajesty th a t all p reparations of esters of ecgonine and of th e ir respective salts and all preparations of ecgonine contain ing less th an one-tenth per cent, of ecgonine an d all p reparations of esters of m orphine are productive, if im properly used, o r are capable of being con­verted in to a substance which is or is likely to be productive, if im properly used , of ill effects substan tia lly of the sam e character o r na tu re as or analogous to those produced by m or­phine or cocaine:

Now, therefore, H is M ajesty, in pursuance of the powers confered upon H im by subsection (2) of section eight of the Dangerous D rugs A ct, 1920, as am ended b y subsection (2) of section one of the D angerous D rugs A ct, 1932, is pleased, by and w ith the advice of H is P riv y C ouncil, to o rder and declare, and it is hereby ordered an d declared , th a t P a r t I I I of the D angerous D rugs A ct, 1920, shall on and a fter the first

PREPARATIONS, OTHER THAN EXTRACT OR TINCTURE OFI n d ia n H e m p , o f w h ic h s u c h R e s i n s f o r m t h e b a s e .

In pursuance of section 3 of the D angerous D rugs Act, 1920, (a ) as am ended b y section 1 of the D angerous D rugs A ct, 1925, (b)I hereby m ake the following R egulations : —

1.— (1) A person shall no t, unless he is du ly au thorised so to Supply, do or otherw ise th an in accordance w ith the term s an d condi- procuring tions of his au tho rity , supply or p rocure , o r offer to supply o r ^dvertisin procure, to or fo r a n y person (including him self), w hether in of drugs!*18 Great B rita in or elsewhere, o r advertise for sale, a drug .

(2) A person shall n o t supply o r procure, o r offer to supply or procure, a d rug to o r for any person in the U nited K ingdom or the Isle of M an unless th a t person is au thorised to be in pos­session of the d ru g an d the d rug is to be supplied o r procured in accordance w ith the term s an d conditions of th a t person’s authority.

For the purpose of this p a rag rap h of th is R egulation “ authority " m eans in the case of a person in N orthern Ire lan d or the Isle of M an an y licence or au tho rity issued o r g ran ted in that behalf by the M inister of H om e Affairs fo r N orthern Ireland or the L ieutenant-G overnor of the Isle of M an, as the case m ay be, an d the expression “ au thorised " shall be con­strued accordingly.

2.— (1) A person shall no t be in possession of a d rug unless Possession he is duly so authorised . of drug8*

(2) For the purposes of these R egulations, a person shall be deemed to be in possession of a d rug if it is in his ac tual custody or is held b y an y other person subject to his control o r fo r him or on his behalf.

G eneral au th o rity for certain classes of persons to possess and supply drugs.

3 .— ( i) W here a d ru g is to be law fully supplied to any person (hereinafter referred to as " the recipient ”), the person supply­ing the d rug (hereinafter referred to as “ the supplier ” ) shall no t deliver it to a person who purports to be sent by or on behalf of th e recipient, unless th a t person either—

(a) is a person au thorised un d er these R egulations to bein possession of th a t d ru g ; or

(b) p roduces to the supplier a sta tem ent in w riting signedb y the recipient to the effect th a t he is authorised by the recipient to receive the drug in question on behalf of th e recipient an d the supplier is reasonab ly satisfied th a t the docum ent is a genuine docum ent.

(2) A person to w hom a d rug is law fully delivered in the cir­cum stances m entioned in p a rag rap h (1) (b) of this Regulation shall be deem ed to be a person au thorised to be in possession thereof, b u t for such a period only as in the circum stances of the case is reasonab ly sufficient to enable the delivery to the recipient to be effected.

4. Persons w ho a re m em bers of the following classes, that is to say—

(а) du ly qualified m edical practitioners :( б ) reg istered ve te rin a ry surgeons :(c) persons who are au thorised sellers of poisons w ithin the

m eaning of the P h arm acy an d Poisons Act, 1933 (a) :(d) pharm acists w ho are em ployed or engaged in dispens­

ing m edicines a t a public hospital o r o ther public institu tion :

(e) persons w ho are in charge of a lab o ra to ry used for pur­poses of research o r instruction an d attached to a un iversity , un iversity college, public hospital or other institu tion approved for the purpose of this Regula­tion b y th e Secretary of S tate :

(/) persons du ly appoin ted b y a local au tho rity as analysts of articles of food a n d drugs un d er section 15 of the F ood a n d D rugs (A dulteration) Act, 1928 (b) :

(g) persons acting as sam pling officers under the Food andD rugs (A dulteration) A ct, 1928 (b) :

(h) persons du ly appoin ted b y the P harm aceu tical Societyof G reat B rita in as inspectors un d er section 25 of the P h arm acy an d Poisons A ct, 1933 (a) :

a re hereby au thorised , so fa r as m ay be necessary for the prac­tice or exercise of th e ir respective professions, functions or em ploym ents, in th e ir capacity as m em bers of their respective classes, to be in possession of and to supp ly d r u g s . ______

5. I f an y person , being an au thorised person, is convicted of an offence against the principal A ct o r of an offence under the enactments relating to the Custom s as applied by the principal Act, the Secretary of State m ay, if he is o f opinion th a t th a t person cannot p roperly be allow ed to rem ain a n authorised person, by notice in the L ondon G azette an d in th e E d inburgh Gazette, w ithdraw the au thority of th a t person:

Provided th a t no thing in this R egulation shall be taken to prejudice an y pow er otherw ise vested in the Secretary of State of w ithdraw ing a n y au tho rity g ran ted b y him .

6. E very person au thorised to supply drugs shall com ply w ith the following provisions—

(a) he shall, in accordance w ith the provisions of this R egu­lation , keep a register in the form set out in the F irst Schedule to these R egulations and en ter therein true p articu la rs w ith respect to every qu an tity of any d rug obtained b y him an d w ith respect to every q u an tity of any drug supplied b y h im , w hether to persons w ithin o r to persons outside G reat B rita in :

(&) A separa te register o r a separate p a rt of the register shall be used w ith respect to each of the following drugs—

(i) raw opium ,

(ii) coca leaves,

(iii) In d ia n hem p an d resins obtained fromIn d ian hem p an d all p repara tions (otherth an ex tract an d tincture of In d ian hem p) of w hich such resins form the base:

(c) the required en try m ust be m ade on the d a y on whichthe d rag is received or on which the transaction w ithrespect to the supp ly b y h im of the drug takesp lace, or, if th a t is no t reasonab ly practicable, on the d ay nex t following the said d ay :

(d) a separate register shall be kep t in respect of each setof prem ises a t w hich the au thorised person carries on business and , sub ject to the approval of the Sec­re ta ry of S tate, an au thorised person m ay, if he thinks fit, keep a separate register for each dep art­m ent of the business carried on b y him :

(e) no cancellation, obliteration or alteration shall be m adeof an en try in the register an d an y correction of an en try m ust be m ade by w ay of a m arg inal note o r a footnote which m ust specify the da te on which the correction is m ad e:

(/) the au thorised person shall, on dem and by the Secretary of S tate or b y an y person em pow ered in th a t behalf by order in w riting b y the Secretary of S tate, furnish to the Secretary of S tate or th a t person, as the case m ay be, such particu lars as the Secretary of State or th a t person m ay require w ith respect to the ob­tain ing or supplying b y the au thorised person of an y d rug o r w ith respect to any stocks of drugs in the possession of the au thorised person:

(g) the register shall be kep t in som e p a r t of the premises to which it relates and so as to be a t all tim es avail­able for inspection:

(,h) every en try requ ired to be m ade under th is Regulation and every correction of such an en try m ust be made in ink o r otherw ise so as to be indelible.

7. — ( i) I f any d rugs au thorised un d er the law of any country outside G reat B rita in to be exported therefrom to any destina­tion outside G reat B rita in are b rough t in to G reat B rita in , no person shall, w ithout au tho rity in th a t behalf from the Secretary of S tate, cause o r p rocure those drugs to be d iverted to any o ther destination.

(2) F o r the purposes of this R egulation the destination to w hich any drugs are au thorised to be exported shall be taken to be the destination sta ted in the au tho rity for the export thereof from the coun try of export.

8. All registers, records, books an d o ther docum ents which are kep t, issued o r m ade in pursuance of the requirem ents or for the purposes of these R egulations shall be preserved in the case of a register, book o r o ther like record for a period of two years from the date on w hich the last en try is m ade therein, and in the case of an y o ther docum ent for a period of tw o years from the da te on w hich it is issued o r m ade.

9 .— (1) In these R egulations, unless the context otherwise requires, the follow ing expressions have the m eanings hereby respectively assigned to them , th a t is to say—

" A uthority ” m eans—(a) an y licence issued by the S ecretary of S tate under

section tw elve of the p rincipal A ct;(b) any au tho rity g ran ted by the Secretary of State

under th a t section; and

(c) an y general au thorisation conferred b y these Regula­tions;

an d the expression “ au thorised ” shall be construed accordingly:

" P rincipal A ct ” m eans the D angerous D rugs Act,1920,(a ) and references in these R egulations to th a t A ct shall be construed as references to th a t A ct as am ended b y any subsequent enactm ent :

“ R egister ” m eans a bound book and does n o t include any form of loose leaf register o r ca rd index.

(2) The In terp re ta tion Act, 1889, (b) shall app ly to the in ter­pretation of these R egulations as it applies to the in terpretation of an Act of P arliam ent.

10.— (1) These R egulations m ay be cited as the R aw O pium , Citation,

etc. R egulations, 1937. “ nT(2) These R egulations shall come into operation on the first repeal,

day of Ju ly , nineteen hund red and thirty-seven.(3) T he R egulations set ou t in the Second Schedule to these

Regulations a re hereby repealed :

Provided th a t th is repeal shall no t affect any o rder m ade or any direction o r au tho rity given un d er the said R egulations, and every such o rder, direction o r au tho rity shall continue in force and, so fa r as it could have been m ade o r given un d er these Regulations, shall have effect as if m ade o r given thereunder.

drugs to w hich P a r t I I I of th e principal A ct applies are :—(a) m edicinal opium ;(b) any ex trac t or tin c tu re of Indian hem p;(c) m orphine and its salts, and diacetylm orphine (commonly known as

diam orphine or heroin) and th e o ther esters of m orphine and th e ir respective salts;

(d) cocaine (including syn thetic cocaine) and ecgonine and th e ir respec­tive salts, and th e esters of ecgonine and th e ir respective salts;

(e) an y solution or dilution of m orphine or cocaine or th e ir salts inan ine rt substance w hether liquid or solid, containing an y pro­portion of m orphine or cocaine, and any preparation , adm ixture, ex trac t o r o ther substance (not being such a solution or dilution as aforesaid) containing no t less th a n one-fifth per cen t, of m orphine or one-tenth per cent, of cocaine;

(/) any preparation , adm ixture, ex trac t o r o ther substance con­tain ing an y proportion of diacetylm orphine or of th e o ther esters of m orphine, and any preparation, adm ixture, ex tract or o ther substance containing any proportion of ecgonine or o f th e esters of ecgonine;

(g) dihydrohydroxycodeinone, dihydrocodeinone, dihydrom orphinone.acetyldihydrocodeinone, dihydrom orphine, th e ir esters and th e salts of an y of these substances and of th e ir esters, m orphine-N - oxide (comm only know n as genom orphine), th e m orphine-N - oxide derivatives, and any other p en tava len t nitrogen m orphine derivatives;

(h) thebaine and its salts, and benzylm orphine and th e otherethers of m orphine and th e ir respective salts;

(i) any preparation , adm ixture, ex trac t o r o ther substance contain ­ing any proportion of an y of th e substances m entioned in p ara ­graph (g) o r in paragraph (h) except, in th e case of preparations of m ethyhnorphine or ethylm orphine, syrupus codeinae phosphatis B .P .C . 1934, and preparations, adm ixtures or o ther substances containing n o t more th a n 2-5 per cent, of m ethyl- m orphine or ethylm orphine (calculated as pure drug) associated w ith o ther m edicinal substances,

except such preparations as are specified in th e Schedule to an Order in Council dated 13th A pril, 1937 (S.R. & O. 1937, No. 327),

In pursuance of section seven of the D angerous D rugs Act, 1920,(B) I hereby m ake the following R egulations: —

1. A person shall n o t m anufactu re , o r ca rry on any process in the m anufactu re o f, a d ru g —

(a) unless he is du ly au thorised so to d o :(b) except on au thorised prem ises:(c) otherw ise th an in accordance w ith the term s and con­

ditions of h is au thority .

2 .— (1) A person shall no t, unless he is du ly au thorised so to do o r otherw ise th an in accordance w ith the term s an d con­ditions of his au tho rity , supply or p rocu re , o r offer to supply o r p rocu re , to o r fo r a n y person (including him self), whether in G reat B rita in or elsew here, o r advertise fo r sale, a drug or p repara tion .

(2) Subject as here inafter p rov ided , a person shall n o t supply o r p rocu re , o r offer to supp ly o r p rocure , a d rug o r preparation to o r fo r any person in the U nited K ingdom o r th e Isle of M an unless th a t person is au thorised to be in possession of the d ru g o r p rep ara tio n an d the d ru g o r p rep ara tio n is to be sup­p lied o r p rocu red in accordance w ith the term s an d conditions of th a t p e rso n ’s au th o rity :

Provided th a t fo r the purpose of th is p a rag rap h of th is R egula ­tion the adm in istration of a d rug o r p repara tion b y , o r under the d irect personal supervision an d in the presence of, a du ly qualified m edical p rac titioner, or b y , o r un d er the d irect per­sonal supervision of a n d in the presence of, a registered dentist in the course of den ta l trea tm en t, shall not be deem ed to be the supplying of a d rug or p repara tion .

For the purpose of th is p a rag rap h of th is R egulation " authority ” m eans in the case of a person in N orthern Ire land or the Isle of M an an y licence o r au thority issued or g ran ted in that behalf b y the M inister of H om e Affairs fo r N orthern Ireland or th e L ieu tenant-G overnor of the Isle of M an, as the case m ay b e , an d the expression “ au thorised ” shall be con­strued accordingly.

3.— ( i ) A person shall n o t be in possession of a d rug o r preparation unless he is du ly so authorised.

(2) F o r the purposes of these R egulations—

(а) a person to w hom a d rug o r p repara tion is law fully supplied—

(i) b y a du ly qualified m edical p rac titioner or registered veterinary surgeon who dispenses his own m edicines; o r

(ii) on a prescrip tion law fully given b y a duly

Sualified m edical p rac titioner, a registered entist o r a registered vete rin ary surgeon

shall be deem ed to be a person au thorised to be in possession of the d ru g o r p repara tion so supplied :

P rov ided th a t a person supplied w ith a d ru g or p repara tion b y , o r on a prescrip tion given b y , a m edical p rac titioner shall n o t be deem ed to be a person au thorised to be in possession of the d ru g o r p repara tion if he w as then being supplied w ith a d rug o r p rep ara tio n b y , or on a prescrip tion given b y , ano ther m edical p rac titioner in the course of tre a t­m ent a n d d id n o t disclose the fac t to the first- m entioned m edical p rac titioner before the supply b y him o r on his prescrip tion.

( б ) a person shall be deem ed to be in possession of a drug o r p rep ara tio n if it is in his actual custody o r is he ld by an y o ther person subject to his control o r fo r h im o r o n his behalf.

4.— (1) W here a d ru g or p rep ara tio n is to be law fully sup ­plied to any person (hereinafter referred to as “ the recip ien t " ) otherwise th an b y , o r on a prescrip tion given b y , a du ly qualified medical p rac titioner, the person supp ly ing the d rug o r p rep a ra ­tion (hereinafter referred to as " the supplier " ) shall not

(2) A person to w hom a d rug o r p repara tion is law fully de­livered in the circum stances m entioned in p a rag rap h (1) (6) of th is R egulation shall be deem ed to be a person authorised to be in possession thereof, b u t for such period only as in the circum stances of the case is reasonably sufficient to enable the delivery to the recipient to be effected.

5. Persons w ho are m em bers of the following classes, that is to say—

(а) du ly qualified m edical p ractitioners :

( б ) registered den tists:(c) registered v e te rin ary surgeons:( d ) pharm acists w ho are em ployed o r engaged in dispens­

ing m edicines a t a public hospital o r o ther public institu tion :

(e) persons w ho are in charge of a labo ra to ry used forpurposes of research o r instruction an d attached to a un iversity , un iversity college, public hospital or o ther institu tion approved fo r the purpose of this R egulation b y the Secretary of S ta te :

(/) persons du ly appo in ted by a local au tho rity as analysts of articles of food an d drugs u n der section 15 of the F ood an d D rugs (A dulteration) Act, 1928 (a ) :

(g) persons acting as sam pling officers un d er the Food andD rugs (A dulteration) A ct, 1928 (a ) :

(h) persons du ly appo in ted b y the Pharm aceu tical Societyof G reat B rita in as inspectors u n d er section 25 of the P h arm acy an d Poisons A ct, 1933(to) :

(*) persons w ho a re em ployed o r engaged in connection w ith a schem e fo r testing the qua lity and amount of the d rugs, p repara tions and appliances supplied to insured persons under the N ational H ealth Insurance A cts, 1936 an d 1937, an d the R egulations made thereunder :

are hereby au thorised , so fa r as m ay be necessary fo r the practice or exercise of their respective professions, functions or employments, in their capacity as m em bers of the ir respective classes, to be in possession of and to supply drugs o r p rep a ra ­tions :

Provided th a t a dentist shall no t be authorised to supply drugs or preparations unless the drugs o r p reparations a re adm inistered by, or under his d irect supervision an d in his presence to persons receiving trea tm en t from him .

6.— ( i) Persons who are au thorised sellers of poisons w ith in

the m eaning of the P h arm acy and Poisons Act, 1933, (a ) are hereby au thorised—

(a) to m anufactu re on the registered prem ises in the o rd in ­a ry course of their retail business (i) any ex tract or tinctu re of In d ian hem p, and (ii) an y p repara tion ; an d

(£>) subject to the provisions of these R egulations to carry- on on the registered prem ises the business of reta il­ing , dispensing or com pounding drugs o r p rep a ra ­tions.

(2) E v ery d ru g o r p repara tion in the actual custody of a p e r­son authorised b y v irtue of this R egulation shall be kep t in a locked receptacle w hich can be opened only b y him or by some assistant of his being a pharm acist.

7.— (1) If any person , being an authorised person , is con­victed of an offence against the principal A ct or of an offence under the enactm ents relating to the C ustom s as applied by the principal A ct, the Secretary of S tate m ay , if he is of opinion that that person cannot p roperly be allow ed to rem ain an authorised person , b y notice in the L ondon G azette an d in the Edinburgh G azette, w ithdraw the au tho rity of th a t person :

Provided th a t—

(а) in the case of a person au thorised by v irtue of thelast preceding R egulation , the Secretary of S tate shall, before w ithdraw ing the au tho rity consult the council of the Pharm aceu tical Society of G reat B rita in ; an d

(б) N othing in this R egulation shall be taken to prejudiceany pow er otherw ise vested in the Secretary of State of w ithdraw ing an y au tho rity g ran ted by him .

(2) W here the person whose au tho rity is w ithdraw n under p a ra g ra p h (1) of th is R egulation is a du ly qualified medical p rac titioner, a registered dentist o r a registered veterinary surgeon, the Secretary of S tate m ay , by notice given in like m an n er, d irect th a t it shall no t be law ful for th a t person to give prescrip tions fo r the purposes of these R egulations.

8 .— (1) F o r the purposes of these R egulations a prescription Im eans a prescrip tion directing the supply of a d rug or prépara- 1tion an d given either by a du ly qualified m edical practitioner Ifor th e purposes of m edical treatm ent, b y a registered dentist Ifor the purposes of den tal trea tm en t o r by a registered veterinary I surgeon fo r the purposes of anim al trea tm ent. (2) A person b y w hom a prescrip tion is given shall comply I w ith the following requirem ents— I

health insurance, the to ta l am oun t of the p rep a ra ­tion o r of each p repara tion , as the case m ay be, an d in an y o ther case th e to ta l am ount of the d rug to be supplied.

9 .— ( i ) A person shall no t supply a d rug o r p repara tion on a prescription—

(a) unless the prescrip tion complies w ith the provisions ofthese R egulations relating to prescrip tions ; and

(b) unless, in the case of a health prescrip tion , he h as noreason to suppose th a t it is n o t genuine, or, in the case of a n y o ther prescrip tion, he either—

(i) is acquain ted w ith the signature of the person b y w hom it pu rpo rts to have been given and has no reason to suppose th a t it is n o t genuine ; or

(ii) h as taken reasonably sufficient steps to satisfy him self th a t it is genuine.

(2) I f a prescription expressly states th a t it m ay , subject to the lapse of a specified in terval or of specified in tervals, be dis­pensed a second o r th ird tim e, the d rug o r p repara tion thereby prescribed m ay , as the case m ay be, be supplied a second o r a third tim e a fte r the specified in terval o r in tervals an d no m ore, but, subject as aforesaid , a prescrip tion shall no t fo r the p u r­poses of these R egulations be taken to authorise the d rug or preparation prescribed to be supplied m ore th an once.

(3) T he person dispensing a prescrip tion shall, a t the tim e of dispensing i t, m ark thereon the date on w hich it is dispensed, and in the case of a prescrip tion w hich m ay be dispensed a second o r th ird tim e, the date of each occasion on w hich-it is dispensed, an d shall, unless it is a health prescrip tion, reta in it and keep it on th e prem ises w here it is dispensed an d so as to be a t all tim es availab le for inspection.

10.— (1) Subject to the provisions of this R egulation, no person shall—

(а) supp ly a d rug unless the package or bottle in w hich itis contained is p lain ly m arked w ith the am ount of the d rug contained therein ; or

( б ) supply a p rep ara tio n , unless the package o r bottle inw hich it is contained is p lain ly m arked—

(i) in the case of a pow der, solution o r o intm ent, w ith the to ta l am oun t thereof in the package or bottle a n d the percentage of the d rug contained in the pow der, solution o r oin tm ent; or

(ii) in the case of tab lets o r o ther sim ilar articles, w ith the am oun t of the d ru g in each article an d the num ber of articles in the package o r bottle.

(2) T his R egulation shall no t app ly in a case w here a p repara ­tion is law fully supplied in accordance w ith these R egulations by, o r on a prescrip tion law fully given b y , a du ly qualified medical practitioner.

11.— (1) E v ery person au thorised to supp ly drugs or p rep ara ­tions shall com ply w ith the following provisions—

(а) he shall, in accordance w ith the provisions of this R egu­lation , keep a register in the form set ou t in the Second Schedule to these R egulations an d enter therein tru e particu la rs w ith respect to every quantity of any d rug o r p repara tion ob tained b y him an d with respect to every quan tity of any d rug o r preparation supplied b y him , w hether to persons w ithin or to persons outside G reat B rita in :

( б ) a separa te register o r a separa te p a rt of the register shallbe used w ith respect to each of the following classes of drugs an d p reparations—

(i) cocaine and ecgonine, an d p repara tions con­tain ing cocaine o r ecgonine,

(ii) m orphine, an d p repara tions containing m orphine,

(iii) d iacetylm orphine, an d p repara tions contain­ing diacetylm orphine,

(iv) m edicinal opium ,(v) ex trac ts o r tinctu res of In d ian hem p,

(vi) d ihydrohydroxycodeinone (commonly know n as eucodal), and p repara tions containing d ihydrohydroxycodeinone,

(vii) d ihydrocodeinone (com m only know n as dicodide), an d p repara tions contain ing dihydro­codeinone,

(viii) d ihydrom orphinone (com m only known as d ila u d id e ), an d p repara tions containing dihydro­m orphinone :

(c) the requ ired en try m ust be m ade on the day on whichthe d ru g o r p repara tion is received o r on which the transaction w ith respect to the supply by him of the d rug o r p rep ara tio n takes p lace, o r, if th a t is not reasonab ly p racticable, on the day next following the said day :

(d) a separate register shall be kep t in respect of each setof prem ises a t which the au thorised person carries on business an d , sub ject to the approval of the Secretary of S tate, an au thorised person m ay , if he thinks fit, keep a separa te register fo r each departm ent of the business carried on by h im :

(/) the au thorised person shall, on dem and by the Secretary of S tate o r by any person em pow ered in th a t behalf by o rder in w riting by the Secretary of S tate, furn ish to the Secretary of S tate o r th a t person , as the case m ay be, such particu lars as the Secretary of State o r th a t person m ay require w ith respect to the obtain ing o r supplying by the au thorised person of an y d rug o r p repara tion o r w ith respect to an y stocks of drugs or p repara tions in the possession of the au thorised person :

(g) the register m ay be used fo r the purpose of the entries requ ired to be m ade u n der subsection (2) (6) of section 18 of the P h arm acy an d Poisons A ct, 1933,(a ) b u t save as aforesaid shall no t be used fo r any purpose o ther th an the purposes of these R egulations.

(2) So m uch of th is R egulation as requires a person to en ter in the register particu lars w ith respect to drugs or p reparations supplied by him shall no t app ly to—

(a) a du ly qualified m edical practitioner w ho enters in a daybook particu la rs of every d rug or p repara tion sup­plied b y him to any person, together w ith the nam e an d address of th a t person and the date of the supply , an d en ters in a separate book kep t fo r the purposes of th is R egulation a p roper reference to each en try in the day book which relates to the supply of any d rug o r p repara tion ; o r

(b) an au thorised seller of poisons w ithin the m eaning ofthe P h arm acy an d Poisons Act, 1933, (a ) who enters in a separa te book kep t for the purposes of this R egulation a p roper reference to each en try in a P h arm acy A ct book which relates to the supply of any d rug o r p repara tion .

(3) References in the separate book m ust be m ade in chrono­logical o rder an d the book m ust be kep t in separa te parts relating respectively to each of the several classes of drugs and preparations specified in p a rag rap h (1) of th is R egulation , and must not be used fo r any purpose other th an the purposes of paragraph (2) of th is R egulation.

(4) The en try in the day book o r in the separate book must be m ade on the day on w hich, b u t fo r p a rag rap h (2) of this R egulation , an en try w ould have been requ ired to be m ade in the register, an d sub-parag raph (e) of p a rag rap h (1) of this R egulation shall app ly as respects an y such entry .

(5) E v ery register, every separate book kep t under the provisions of p a rag rap h (2) of th is R egulation, every d ay book in w hich an y en try w ith respect to th e supply of a drug or p repara tion is m ade an d every P h arm acy A ct book containing an en try w hich is referred to in the separate book shall be kep t on the prem ises to which the register o r book relates or w here the prescrip tion w as dispensed, as the case m ay be, and so a s to be a t all tim es availab le for inspection.

(6) E v ery en try requ ired to be m ade u n der th is Regulation and every correction of such an en try m ust be m ade in ink or otherw ise so as to be indelible.

(7) F o r the purposes of this R egulation—

(i) a d rug o r p repara tion adm inistered by , o r under thedirect supervision an d in the presence of, a duly qualified m edical p rac titioner o r a registered dentist shall no t be deem ed to have been supplied b y him;

(ii) “ a p roper reference ” m eans a reference which isen tered in the separa te book u n d er the sam e date as th a t on w hich th e en try in the day book o r in the P h arm acy Act book w as m ade a n d is otherw ise such as to enable th a t en try to be easily identified.

12 .— (1) If an y drugs o r p repara tions au thorised under the law of an y coun try outside G reat B rita in to be exported there­from to an y destination outside G reat B rita in a re brought into G reat B rita in , no person shall, w ithou t au tho rity in th a t behalf from the Secretary of S tate, cause o r p rocure those drugs or p repara tions to be d iverted to an y o ther destination.

(2) F o r the purposes of this R egulation the destination to which any drugs o r p repara tions are au thorised to be exported shall be tak en to be the destination stated in the authority for the export thereof from th e country of export.

13 .— (1) T he m aster of a ship w hich does not carry on board as p a r t of her com plem ent a du ly qualified m edical practitioner is hereb y au thorised—

(a) so fa r as necessary for the purpose of com pliance withthe A cts relating to m erchan t shipping, to be in possession of drugs an d p reparations ; and

(b) subject to and in accordance w ith an y con d ition sim posed b y th e Secretary of S tate an d any instruc­tions issued b y the B o ard of T rade , to supply drugs an d p repara tions to m em bers of the crew.

(2) W here a d rug o r p repara tion is supplied to a m em ber of the crew of a ship , the en try in the official log-book, in accord ­ance w ith p a rag rap h (5) of section tw o h u n d red an d forty of the Merchant Shipping A ct, 1894, (») of the m edical trea tm en t adopted shall, no tw ithstanding any th ing in these R egulations, be a sufficient record of the supply , if th a t en try specifies the drug or preparation supplied.

(3) T he m aster of a foreign ship w hich is in a p o rt in G reat Britain is hereby au thorised to purchase an d be in possession of such quan tity of drugs o r p repara tions as m ay be certified by the medical officer of h ea lth of the p o rt w here the ship is, or in his absence by the assistan t m edical officer of health , to be necessary for the equipm ent of the ship until it nex t reaches its hom e port.

A person who supplies a d rug o r p repara tion in accordance with a certificate given u n d er this p a rag rap h of th is R egulation shall reta in th e certificate an d m ark it w ith th e da te on which the d rug o r p repara tion w as supplied and keep i t on h is prem ises and so as to be a t all tim es availab le for inspection.

(4) F arm ers an d stockow ners w ho have obtained a certificate for the purpose, in the form set ou t in the T h ird Schedule to these R egulations, from the Chief Officer of Police fo r the area in which they ca rry on business, are hereby au thorised to be in possession of tinctu re of opium , B .P . com m only know n as laudanum fo r use solely in the trea tm en t of anim als, subject to the conditions specified in the certificate.

(5) Certified m idw ives, who have in accordance w ith the provisions of the M idwives A ct, 1902,(b ) o r the M idwives (Scot­land) A ct, 1915, (c ) notified to the local Supervising A uthority their intention to practise , are hereby authorised to be in posses­sion of, and to adm inister, p repara tions contain ing opium so fa r as is necessary for the p ractice of their profession o r em ploym ent in such capacity , sub ject to the condition th a t they shall fo rth ­with enter in a book to be kep t for the sole purpose particu lars of all supplies obtained including the da te on w hich, an d the name and address of the person from w hom the supply is obtained, and the qu an tity obtained.

14.— (1) All registers, records, books, prescrip tions and o ther Preserva- documents w hich a re kep t, issued o r m ade in pu rsuance of the *ion of requirements o r fo r the purposes of these R egulations shall be documents< preserved in the case of a register, book o r o ther like record fo r a period of two years from the date on which the last en try is m ade therein, and in the case of an y o ther docum ent for a period of two years from the date on which it is issued o r m ade.

(2) E very signed o rder given for the purpose of p a rag rap h (3) of Rule 7 of the Poisons R ules, 1935,(0) for a d ru g o r p rep a ra ­tion shall be preserved fo r a period of two years from the date on which the last delivery under the o rder w as m ade.

15. T he Secretary of S tate m ay , subject to such conditions as he m ay prescribe, exem pt any hospital o r o ther public institution from any provision of these R egulations.

16. N othing in these R egulations shall app ly to—( а) an y of the d rugs o r p repara tions m entioned in the

F o u rth Schedule to these R egulations o r to a drug or p repara tion w hich has been denatu red in m anner approved b y the Secretary of S tate :

( б ) (i) an y prescrip tion issued fo r the purposes of a schemefor testing the quality a n d am ount of the drugs, p repara tions an d appliances supplied to insured per­sons u n der the N ational H ealth Insu rance Acts, 1936 an d 1937, and the R egulations m ade there­under;

(ii) a n y prescrip tion issued to a sam pling officer for the purposes of the F ood an d D rugs (A dulteration) Act, 1928.(a )

17.— (1) In these R egulations, unless the context otherwise requires, the following expressions have the m eanings hereby respectively assigned to them , th a t is to say—

“ A uthority ” m eans—(a) an y licence issued b y the Secretary of S tate under

section tw elve of the p rincipal A ct;(£>) an y au th o rity g ran ted b y the Secretary of State

u n der th a t section; an d(c) any general au thorisation conferred b y these Regu­

lations;a n d the expression “ au thorised " shall be construed accordingly:

" Chief Officer of Police ” h as the sam e m eaning as in the Police Pensions A ct, 192i ( b) :

“ D rug ” m eans an y d rug , n o t being a p repara tion with­in the m eaning of these R egulations, to w hich P a r t I II of the principal A ct applies :

“ H ealth p rescrip tion ” m eans a prescrip tion given by a du ly qualified m edical p rac titioner u n d er an d in accordance w ith the Acts rela ting to national health insurance, or given b y a du ly qualified m edical practitioner upon a form issued by a local au tho rity fo r use in connection w ith a health service of th a t au tho rity :

“ P h arm ac ist ” m eans a du ly registered pharmaceutical chem ist o r chem ist an d druggist:

“ P repara tion ” m eans any p repara tion , adm ixture, ex tract o r o ther substance containing such a proportion of a d rug as is sufficient to m ake the p repara tion , adm ixture , ex tract o r substance a d rug to which P a r t I I I of the principal Act applies:

“ P rincipal Act " m eans the D angerous D rugs Act,1920, (a ) and references in these R egulations to th a t A ct shall be construed as references to th a t A ct as am ended by any subsequent enactm ent o r as extended by an y O rder in Council m ade u n der subsection (2) of section eight of th a t Act:

“ R egister ” m eans a bound book and does no t include any form of loose leaf register o r card index:

" R egistered prem ises ” m eans prem ises duly registered under P a r t I of the P h arm acy and Poisons Act, 1933 ( b ) .

(2) F o r the purposes of these R egulations b u t subject in each case to an y lim itation a ttached to his au thority—

(а) a person authorised to m anufacture a d rug shall bedeem ed to be authorised to supply th a t d rug ; and

( б) a person authorised to supply a d rug or p repara tionshall be deem ed to be a person au thorised to be in possession of, to procure, to offer to supply o r p rocure , an d to advertise fo r sale, th a t d ru g or p repara tion .

(3) T he In te rp re ta tion A ct, 1889,(c ) shall app ly to the in ter­pretation of these R egulations as it applies to the in terp retation of an A ct of Parliam ent.

18.— (1 ) These R egulations m ay be cited as the D angerous C itation,

Drags R egulations, 1937. mcn’TTnd( 2 ) These R egulations shall come into operation on the first r e p e a j

day of Ju ly , nineteen h u n d red an d thirty-seven.(3) The R egulations set out in the F ifth Schedule to these

Regulations a re hereby repealed.Provided th a t th is repeal shall no t affect any order m ade or

Constitution of Reference Tribunal for the purpose of Regulation 7 (3).

1. Separate tribunals shall be constitu ted to deal respectively w ith the cases of persons practising in E ngland and th e cases o f persons practising in Scotland.

2 .T he tribunal shall consist, in th e case of a du ly qualified medical practitioner, of three du ly qualified m edical practitioners, and, in th e case of a registered dentist, of three registered dentists, together in either case w ith a legal assessor.

3. The m em bers o f th e tribunal and th e legal assessor shall be appointed b y th e Secretary o f State.

4. In the case of a duly qualified m edical practitioner, one o f th e members of th e tribunal shall be appointed on th e nom ination of th e General Medical C ouncil, one on th e nom ination o f th e B ritish M edical A ssociation, and one on th e nom ination, in th e case of the tribunal for E ngland, of th e Royal College o f P hysicians of London, and, in th e case o f th e tribunal for Scot­land, o f th e R oyal College o f P hysicians o f Edinburgh.

5. In the case of a registered d en tist, one of th e mem bers of th e tribunal shall be appointed on th e nom ination o f th e D ental Board o f th e United K ingdom , one on th e nom ination of th e General M edical Council, and one on th e nom ination of th e B ritish D en ta l A ssociation, or, if the dentist is registered b y virtue of th e provisions o f section three of th e D en tists Act, 1921, or section one of th e D en tists A ct, 1923, of th e Incorporated Dental Society , L im ited.

(c) H e m ust produce th is certificate on th e occasion o f each purchase toth e person supplying him , and th e person supplying m ust enter on back o f the certificate, a t th e tim e of purchase, th e date of purchase and th e q u an tity purchased, and attach h is signature thereto.

(d) The tincture o f opium shall be kept b y him or h is responsiblem anager under lock and k ey and shall only be issued to responsible persons in h is em ploym ent and on ly for th e purpose of adm inistration to anim als. Each b ottle or vessel containing th e tincture shall be labelled w ith th e words “ F or adm inistra­tion to anim als o n ly .”

(e) H e m ust produce th is certificate for inspection when required b yany constable or b y any person authorised for th e purpose b y th e Secretary o f S tate, and m ust furnish th e Secretary o f State w ith such particulars o f his purchases as m ay be required.

(/) T his certificate is va lid only for th e person and in respect o f the address w hich is nam ed herein. If he ceases to carry on business a t th e address nam ed he m ust return th e certificate im m ediately to th e Chief Officer of P olice, and if a certificate is desired in respect of another address, m ust m ake application to him for such certificate.

(g) T his certificate shall continue in force u n til revoked b y th e Chief Officer of P olice or b y th e Secretary o f S tate, and on revocation shall be surrendered to th e Chief Officer of Police.

W hereas b y subsection (2) of section eight of the D angerous Drugs A ct, 1920(a ), as am ended b y subsection (2) of section one of the D angerous D rugs Act, 1932(b ), pow er is conferred on H is M ajesty b y O rder in Council to declare th a t P a r t I I I of the D angerous D rugs A ct, 1920, shall apply to any d rug of w hatever k ind in the sam e m anner as it applies to the drugs mentioned in subsection (1) of the said section eight if it appears to H im th a t the d rug is o r is likely to be productive, if im ­properly used, o r is capable of being converted into a substance which is, o r is likely to be productive, if im properly used, of ill effects substan tia lly of the sam e character o r n a tu re as or analogous to those produced b y m orphine or cocaine:

And w hereas it appears to H is M ajesty th a t all p repara tions, adm ixtures or o ther substances (except sy rupus Codeinae Phosphatis B .P .C . 1934) containing an y p roportion of m ethyl- morphine (com m only know n as codeine) o r ethylm orphine (commonly know n as dionin) associated w ith an inert substance whether solid or liqu id an d all p repara tions, adm ixtures or other substances contain ing m ore th an 2 • 5 per cent, of m ethyl- morphine o r ethylm orphine (calculated as pure drug) associated with ano ther m edicinal substance a re productive, if im properly used, o r are capable of being converted into a substance which is, or is likely to be productive, if im properly used, of ill effects substantially of the sam e character or n a tu re as o r analogous to those p roduced b y m orphine or cocaine :
