1.Auction RepresentativeKingsley could assist you to bid artworks from

worldwide auction house and make suggestions for

the sales of your collections. As your commissioned

representative, we include auctioning, trading,

packaging, and shipping services for your works.

2.Art AgencyKingsley conducts private art sales through its Taiwan

offices. We also provide professional consultation

on art appraisal issues, value management, and

investment advice.

3.Insurance and Tax ConsultationKingsley also helps to deal with any insurance and tax

related issue of your import or export art. And we also

manage with international/domestic shipping and

packaging for your art works.

4.Sales Tax Payable by the Buyer The buyer shall pay for (value added) sales tax in

the amount of 5% of the Hammer Price with respect

to imported works of art collected by the buyer in

Taiwan pursuant to the laws of the ROC. The buyer is

not required to pay for sales tax if such imported works

of art【with ＊ marks by the lot in the catalogue】

are delivered to the buyer outside the ROC and are

handled by Kingsley for the relevant shipments. The

buyer shall notify Kingsley in written form within 7

business days following the auction day if he or she

desires to collect the items auctioned outside the

ROC.

5.CurrencyThe buyer is required to settle up in NT dollars. If paid

by other foreign currencies, we trade on the currency

of that wired transaction day for the first 7 business

days. If the payment is to be wired after 7 business

days and the currency rate is lower than that of

the bidding day, then we trade by the rate on the

bidding day.

6.Phone BidsSince the phone line service at the venue of auction

is limited, please contact us 48 hours prior to the

auction. Meanwhile, please fill in the absentee bid

form attached to the catalogue to specify the item

7.Written BidsYou may use the absentee bid form attached to the

catalogue to process your bid as well. To allow time to

王攀元的〈雪景〉，由雪白屋頂重壓於矮長屋厝上，微彎的屋頂娓娓道出了雪的重量，不經意地宣告冬季的來

臨，淺色調堆疊出的色澤，淺淺的綠讓荒涼的大地透露出生命力，彎曲的線條無盡向遠方蔓延，拉出了寂靜與

遼闊。沒有日月的陪襯，卻有著灰濛濛的天空，是灰藍，是淡藍，更是冬天沉悶的色彩。在這沉悶的季節裡，

右下角奔跑躍動的狗影叫醒了整個畫面，不但平衡也生動了畫面。

1912 年，排行第二的王攀元出生於江蘇北部的徐家洪，在當地是有名的望族不但居住大宅，

更擁有不少田地。但天不從人願，欲天降大任於斯人也，必先苦其心志，勞其筋骨。小時，父

母相繼過世，在掌權的家族親戚不願提供學費的情況下，每學期王攀元就要為自己的學費東奔

西跑，在奶媽與佃農的幫助下過關。從小學到省立的淮安中學，讓他比同年紀的小孩細膩早熟。

1933 年考上復旦大學法律系，但非其所愛，重考後，高中上海美專。上海美專以開創性的美

學教育、裸體寫生的課程與成果展衝擊當時傳統風俗，傳統派長輩更不願提供學費，所幸在友

人幫助下才得以入學。在陳人浩、潘玉良、王濟遠等老師啟迪教育下，扎下藝術概念與技法，

在旁聽潘天壽、諸聞韻等國畫老師課程後，對於國畫更有興趣不但勤於練習更時時走訪鄉間寫

生觀察。能將情緒感染於畫作上，｢問君能有幾多愁，恰似一江春水向東流。｣從詩詞上體會

到的是自身的際遇。畢業後，欲去法國留學的王攀元回江蘇籌錢，不料松滬戰爭爆發後他沒錢

也沒路回到上海，而後國共戰爭的號角又吹起，王攀元便帶著其妻倪月清，一路顛簸，輾轉來

台，抵達鳳山已經是 1949 年的事，便在碼頭兼差搬運果其腹。最後在堂弟幫忙下到羅東中學

授課，得以安定。

此件王攀元的畫作〈夜深沉〉曾於形而上畫廊展出，這種由黑與白的大塊面分割，是他較晚期

發展出的系列：畫中藏有很強烈的詩性，殘留的宋代留白的韻味，如同他日記中自述所提，｢

我喜歡繪畫多留空白，我喜歡對人說話應有餘地，我喜歡靜思反省不與人爭｣，也是他溫和有

容的畫格。

在他筆下，繪出許許多多的美女、芭蕾舞者、裸女，那圓潤的體態、粉嫩的膚色、溫婉的氣質、柔美

的用色等等，皆是造成一、二十幾年前藏家們相繼搶購的主因。此件〈芭蕾舞者〉是沈哲哉 80 年代盛

期之作，和諧的天空藍鋪成整張畫面的主要色調，在這湛藍色的空間裡他偶爾用黃、橘紅點綴，對比

李義弘，1941 年出生於台灣台南，以農家子弟而欲終身投於藝術工作領域。初高中時期，相繼獲得南部七縣市美術比

賽國畫組第一名，此刻開啟了李義弘的藝術道路。順利進入台藝美術科後，師事高一峰、傅狷夫、胡克敏等大陸來台畫

家，奠定其深厚的設色與肌理的基礎。之後偶然看到江兆申的作品大為震撼，多次請益之後終於成為江派入室弟子。李

義弘在傳統國畫技法中，加入不少新的觀念，使他的畫表現得截然不同流俗。

這幅作品〈竹雨書情〉所畫的是一幅嫻靜適然的幽靜景色，在悠悠竹林環繞的深山小屋裡，文人靜靜地端坐賞畫。不遠

處隔著幾處濃郁林子的是圈養的鴨群，長短不拘地的竹籬在李義弘筆下就這樣圈起牠們。視角再往右移動竟是一片桃花

源，鮮嫩的粉紅花點綴枝枒，為右下角帶來另一份生氣。

李義弘從文人水墨的角度切入，從文人心境的抒發發展，他認為現代水墨的創新並不能以仿效攝影構圖為依靠，水墨畫

講究的筆墨本質依然是水墨在現代藝術浪潮中屹立不搖的根本。每幅創作都在在彰顯他在「傳統」與「現代」之間，經

過努力不懈探究、追尋、融合的功力。

鄭善禧出生於 1932 年中國福建，家中經營碾米廠兼賣土產，生活無拘無束備受寵愛。自幼對繪畫有著無比興趣，

除了拿筆塗塗抹抹畫些神像、布袋戲等民俗畫之外，也隨手取家附近的泥土做泥塑神像捏著玩。國小的美術老

師黃文爛，發現鄭善禧有這方面的天份，也常提供他一些圖片作為參考練習。1950 年自福建來台，考取台南師

範美術科，之後又考上師大美術系，扎下深厚的美術基礎。1960 年畢業之後，他的興趣由水彩寫生轉入國畫，

1965 年獲第 20 屆台灣省美展首獎之後，便開始在台灣畫壇嶄露頭角，也逐漸找到自己的畫風。

1969-71 年旅居美國，開啟新的藝術視野，繪畫題材廣泛，媒材也從平面書法拓展至立體陶瓷。鄭善禧偏好民俗

繪畫，且從不講究如何佈局，完全採取喜不喜歡和要不要畫為主；而且常在畫面之上以毫無體制的字，直接毫

無裝飾的去敘述畫的內容，一旦由這些直敘的旁白、自由憨拙的字體，和充滿童稚心聲，趣味性濃的圖形，把

整張空白填滿之後，就變得十分有趣。

他開始加入對國畫的革新，他的方法既不「汲古潤今」，又不是「引西潤中」。他是採取融合之後開創自

己。他特別強調五四運動中的「白話運動」對他創作的啟示最大。所以他以白話化的方式去開創自己繪畫樸

拙的意境和民主化的現代風貌。他常將身邊隨處可見的題材入畫，將小貓、小狗、狗熊、獅子、小烏龜等動

物擬人化，看過的人都不禁會心一笑。而他筆下的山水風景，則有別於傳統中國山水花鳥畫，他畫的都是觀

眾熟悉的台灣場景並自由呈現這些花花綠綠的山巒、栩栩如生的動物，有時亦帶點幽默氣息，令人玩味。

乙卜，本名田小赤，藝名蓮池。1966 年出生於吉林長春。1994 畢業於吉林藝術學院，並於 1996 年任教於吉

林藝術學院附中。1999 年執意創作並展開自由畫家的路程，現居於宋莊。

田小赤創作能量源於自然，他曾說過：「作為一個藝術家，把你的藝術還給自然多少，你的藝術就有多大」。

層出不窮的靈感使其創作題材多元，所繪的特殊線條與皴法闢出自我新水墨風格。近年發展出許多系列：「魚

系列」中描繪出魚兒展現生命力與活躍；「鳥系列」裡有鴻鵠展翅、翱翔動態美與立於湖面的寂靜美；甚於「笑

佛系列」觀自在，笑開懷的真性情，正如其自述「畫家需要一種寬闊的胸懷，只有放下功利心，才能產生好作

品」，也是目前乙卜當代水墨的創作中，有其體現生活，表現自然率真的灑脫、豪邁。

2014 年所創作的〈大紅魚〉相當喜氣，田小赤以墨線快速勾勒魚身，多層次的線條帶出肥美的厚度，黃黃、

紅紅、綠綠的色塊之上再用快筆加諸細節，亂中有序、沉穩中帶著藏不住的躍動感。田小赤以水墨為媒材，卻

畫出了中國傳統沒有的立體感及為背景上色之點—飽含立體感之主角大紅魚，安於墨色深沈的背景前，突顯

中西合璧寫意之美。此舉不同於 1950 年代以來藝術家將中國傳統水墨融合西方進行抽象轉換的大趨勢，田小

赤在現代走出獨自的新水墨風格，也因此近年來大陸重要拍賣公司主動徵求其作品送拍，2014 年更獲北京雁

栖湖中國大飯店 APEC 會議廳徵集懸掛其 21 件巨幅作品，扶搖直上之日應指日可待。

朱銘年僅 15 歲時，便開始跟隨李金川師傅學習傳統雕刻技藝，30 歲時才又拜入楊英風的門下繼續深造其雕塑，

80 年代後以「太極系列」作品揚名國際。所謂太極一般指宇宙的根本。人屬於自然，自然間陰陽相生，其關鍵

在於「氣」與「勁」的互通及流轉。

朱銘的「太極系列」沒有臉部表情，凌駕於形體之外，徹底擺脫題材的具象束縛，省略人體許多動作細節的線

條，只取其意，不重其形，從包羅萬象的東方精神之中進入一種完全來自精神的造型組織，融會貫通須超脫自

我。此件〈太極系列〉以樟木為基，大刀闊斧地鑿切出兩人對打連成長方形拱門狀，展現剛硬的力道，穩如泰山，

但所呈現的造型，是溫雅帶著柔韌，剛柔並用、陰陽平衡，正中太極所蘊含的道理。「太極系列」完美融合傳

統東方精神的表現，不僅奠定了朱銘在亞洲藝壇的地位，更讓世界的收藏群眾為之驚艷。

陳蔭羆 1913 年出生於廣東中山縣，1925 年 12 歲時於中國完成中學學業，隨父親前往美國，念念不忘在排華法案下，滯留在中國無法團聚的母親與弟弟，儼然成為陳蔭羆心中的遺憾與牽掛。年少的陳蔭羆居住父親中藥店，卻對於陌生環境難以融入，憤而前往洛杉磯一孤兒

院中當起志工。1934 年孤兒院內部協助下，獲全額獎學金進入洛杉磯奧地斯藝術學院 (Otis Art Institute) 的機會，並接受正統的美學薰陶，

1940 年取得美術碩士學位。

外來移民的身分在孤兒院人道培養下成長，足以反映在他取材上，多以孩童、社會邊緣者的人物像，在暗淡的背景下，抑鬱的色調對比出人

物表情是他一貫風格，細膩寫實地描繪出人物臉部的神情，彷彿在對現實狠狠的批判，更是他對社會無奈的反叛。〈紅領帶的男孩〉(Lot61)

與〈紅襯衫的女子〉(Lot62) 皆是為此時期完成的作品，非常早期，也相對更看得出陳蔭羆筆下的主角，都被投射出自己看待大環境的叛逆眼

光。風景題材，少以寫實風格精準表現，反而多以光影寫生的印象風格繪製，擅於用白色帶出光感，暗色調鋪陳氛圍，細筆多層次的點撇讓

風景在光的作用下流露於畫面裡，印象風格也影響他後期。

1947 年二次大戰結束後他短暫返回中國，曾在長老會學習的書法，更在 1950 年回到美國後將書法與抽象結合創作，希望能在創作中凸顯自

己的華人身份和文化血緣，他首先以片段抽象銘文融入山水宛如與古人對話，尋找能與美國抽象表現共鳴的中國文化元素，進而發展成自身

的美學形式。此時期他以鮮明的黑白色系「文字畫」為主，從漢字的符號書寫出發，表現筆勢的韻味並考究畫面質感。

之後的抽象風格則能越見陳蔭羆受馬克・托比 (Mark Tobey 1890-1976)「白色書寫」系列與傑克森・波洛克 (Jackson Pollock 1912-1956) 這

兩位在紐約掀起抽象風潮中最重要代表人物的影響。托比追求畫面的和諧感；帕洛克著眼於繪畫的動作本身，記錄充滿能量的整體性為過程。

而陳蔭羆試圖融入這兩位藝術家的風格形式，儼然展開了將白色中文應用於潑灑與滴流的畫面上，在繽紛的畫面下更顯得集中、有序性。

1960 年代的創作最能呼應抽象表現主義精神，以淺色為基底，將黑底白字如拓字的書法字帖糊裱於畫布上，再將字的樣貌解構，覆以書寫、

色彩的灑染，形成漢字符號交雜著色般繽紛。陳蔭羆故意製造有關中國古文物，例如青銅器因銅綠的腐蝕，所產生的一種因為時間才能生成

的歷史廢墟或文明湮滅貌；或以文字為主體的紀念石碑，因為長期經風雨侵蝕所產生的斑駁效果。他也為了製造具有時間感、歷史風塵的感

覺，嘗試加入許多材質，其中引用細沙的使用，畫面肌理細密厚實，色韻和諧，整體作品在隱喻歷史斑駁感之間呈現古雅且現代的微立體畫作。

陳蔭羆此時的創作呈現一種神秘迷離的風格，創意豐沛，風格多樣。

1970 年代後期創作的〈銘文變奏〉(lot59) 雖仍脫不開這兩位抽象畫家的身影，藍色系的畫面中，仍以白色滴流的方式，創造馬克・托比白色

書寫帶來的神秘多義性，覆以自由線條的表現性演出，如音符與旋律般相互呼應，強化形色變奏後的壯麗效果。材質上採用油彩與拼貼完成，

營造緊密厚實的質地，各種甲骨、鐘鼎銘文、碑刻、篆銘參雜，斑斕色彩交織成具現代意涵的抽象圖示，而其實內涵本質則更貼近東方。

陳蔭羆創作這刻意的文化構成，是對中國文化與文明的緬懷歌頌。一邊傾訴文化的力量，一邊凸顯文明的美感，亦透過這樣的意識，陳蔭羆

甚至有意地彰顯自己的文化源。漸漸他的創作裡能看到另一種風貌「綴錦性格」，那是他經歷寫實肖像、靜物、風景、文字畫抽象、抽象表

現主義形式之後所演變成的風格。此時的創作尺幅更盛大，自由揮灑線條已打破文字書寫概念，也能看出他脫離馬克・托比的影響，而接近

帕洛克的自動性概念，以滴彩的形式、奔放的色彩，探索視覺美感的無限可能，畫面呈現亂中有序、華艷有味的個人特色。

「藝術創作是在傳達心靈成長的訊息和過程，宇宙的大能量是我創作中源源不絕的重要靈感。」—— 蕭勤

1935 年出生於上海的蕭勤，1949 年抵達台灣，在 1952 年北師時

期進入李仲生老師畫室，李仲生提倡的現代繪畫觀念深植其心，

自此也正式開啟他研究現代藝術的意向。在當時政治低迷而社會

上卻興起一片「再造五四」、「文藝復興」的呼聲中，1955 年底

蕭勤在台北與李元佳、歐陽文苑、吳昊、夏陽、霍剛、陳道明、

蕭明賢等人創辦中國第一個抽象團體「東方畫會」。

然而翌年因獲得西班牙政府獎學金之契，始赴西班牙留學。到了

西班牙之後，蕭勤結識當時最活躍的非形象藝術家們，例如達比

埃 (A. Tapies 1923-2010) 等人的影響下，試著以一種直覺衝動的

方式創作，卻因李仲生老師要求「手、臉、心、腦」並用的原則，

使蕭勤自省需要在作品中加入更深入的思想去支持。

在陌生國度開拓藝術新天地

1960 年代蕭勤遷居義大利後，他再次展開新的藝術探險，反覆

深思、檢視自身文化，並深入研究老莊、道家等中國思想，建立

其中自我觀點，並與志同道合的藝術家在米蘭發起「龐圖運動」

(Punto)，傳達藝術作為靜觀和內省思想的主張，認為藝術應從個

人的思想體悟出發。此後他開始由衝動的直覺轉入深沉的內省，

重新從中國文字結構中，去找尋精神上的意義；其中特別採取對

稱的造型、加強象徵性的意味，這也是蕭勤建立個人自我面貌的

開始。

至 1960 年代中期開始的作品，漸漸受到「極限藝術」的影響，發

展出一系列以烤漆或壓克力創作的「硬邊系列」，他在畫面上構

築象徵性的宇宙空間，並至一個足以造成亦靜亦動的生命世界。

1965 年〈向邱吉爾致敬〉(Lot64) 一畫中，深藍色與桃紅色塊將底

色一分為二，下方的紫色、藍色、亮黃的同心圓，向內凝結成為

一種好似永恆的靜止；潑灑形成的淺色斑點在深藍色面上躍動，

等距的多層次直角造型由四邊向內進入，營造出在騰動的空間中

不斷向內進入的錯視感。蕭勤運用極簡的造型營造出一個二元的

宇宙空間，利用方與圓、永恆凝靜與流動不懈使它既對立又和諧，

反映出整個宇宙的神秘性。

1960 年末到 1970 年初的這段時期，蕭勤接觸印度神秘學及老子

哲學、也廣泛接觸許多「外太空」、「失去的文明」及「外星文化」

的書籍與訊息，以增廣思考的範疇與深度。從思想的傾向言，蕭

勤接下來這個時期的創作，結束了之前從抽象形式中找尋形上意義

的努力，從這些神秘主義、玄思哲學汲取而來的養分，其實是為

之後 16 年完整創作歷程鋪陳。1970 年代之後蕭勤離開美國，因

開始轉而鑽研佛教思想，發展出「禪」的系列，並響應當時西方「回

歸自然」的呼應，不僅創作主題，甚至連創作媒材都回復到運用

有機的紙、墨水、不裝內框的棉布，一切以自然適性為主，以「無

我」宇宙大我的生命結合，到達一種絕對東方且自在安逸的禪學

境界。接下來的 1980 年代初期，蕭勤進入「宇宙風景」階段，畫

面經常出現宇宙漩渦、陣雨、混沌初開、彗星等宇宙相關的元素，

呈現對宇宙聚散的體悟與詮釋。其間也受到時事影響，創作出許

多不同系列，例如 1989 年開始的「天安門系列」、「中國之再生」、

「蛻變」等系列。

重生直至永恆

1990 年的蕭勤因喪女之痛而一度中斷創作，隔年參透生死大限意

義後，開始重拾畫筆為女兒也為自己創作一系列布上壓克力作品：

「莎芒坦的超越」、「度大限」、「永久的花園」、「大限外」、「宇

宙愛心」等系列。這些系列，沿用 85 年始見的彩色斑點佈滿畫面

為共通形式。在 Lot 66〈大限外之 57〉由一道道如波紋般的粗圓

筆觸，鮮豔濃烈的藍色自左上整齊排列而下，右下方颯地安排一

筆粗獷的鮮紅，成為視覺的焦點。蕭勤說：「生命，以一種方式

離開，卻會以不同的方式轉換出現，生命的本質在不斷地轉換。」

他悟出生命的永恆性，在畫面上藉由鮮豔對比的色彩傳達給觀者，

希望能以最單純的方式呈現最強烈的超脫意境。

1980 年代中後期開始至 2000 年代，都不停有「炁」為題的作品

出現，〈大炁之 27〉(Lot65) 完成於 1998 年，由單純墨色粗線條

完成，深深淺淺、由短漸長，飛揚直至畫面右上消逝，「炁」所

指的無中生火之意象就好比如此，極富生命能量的表徵綿延無盡。

若以佛洛伊德提出的「夢的潛意識」精神分析理論解釋，這粗獷

如書寫般紛揚的墨線亦暗示空間與時間的無限擴張。2003 年創作

的〈宇宙漩渦之 72〉(Lot67) 以西方的壓克力媒材在東方的紙上展

現其創作，正紅色漩渦佔據三分之二畫面，純白色的背景潔淨了

所有雜念，極具能量的螺旋紋表現動態的生命與邊上靜置的黑色

軌跡相抗衡，表現一切成象其實皆是「心轉」的結果。

蕭勤將此浩瀚大氣運行的律動，含蓄地以內斂的東方禪宗一式轉

換出永恆的墨色生命能量，為台灣畫界注入新思想；而在國際前

衛藝術的舞台上，他也提供了一個東方人特有的觀點與形貌。

在影響美國抽象表現主義甚遠的藝術家，傑克森・波洛克 (Jackson Pollock 1912-1956) 死後，紐約現

代藝術博物館，大都會博物館等博物館分別展出波洛克藝術作品，在當時更加掀起一陣抽象表現藝術

風潮，而當時丁雄泉正沉浸於這片風潮中。在他的畫風中，灑脫的揮灑、炫麗鮮豔的色彩奔放、無拘

無束的線條就此展開他獨特的風格，如此沾沾自喜自封為「採花大盜」、「風流先生」；採花是因為

喜歡花的多采多姿，更留戀於世間女人花，這也是他創作中多以女人、花卉為主，他眼中看到的是女

子與花婀娜多姿的姿態，為生活粉墨綻放的色彩，而他負責將如此的美麗表現出來。風流先生如同蝴

蝶般遊戲人間，不僅輕舞於美女、花叢間，也從自然動物裡琢磨觀察，筆墨間的揮毫便是他處處觀望

的心得。此幅〈藝妓與鸚鵡〉，有著丁雄泉獨樹一幟的畫風，細筆勾勒出女子挑逗的眼神，櫻桃般的

小嘴微微張開，彷彿藏著某種心思；鮮明的色彩分配得當，在花朵與鸚鵡佈局下，讓視角集中女子神情。

劉國松激情而堅決地宣告：「人類的繪畫，由寫實而寫意，再由寫意而抽象，是一條必然的定律。」

朱德群，早年就讀杭州藝專，後來台任教，至 1955 年才遠赴法國深造，與他心中的大師塞尚 (Paul Cézanne 1839-1906) 、馬諦斯 (Henri Matisse 1896-1954) 等作品近距離接觸。赴法之前的朱德群已在油畫上打下紮實基礎，這從他早年

的風景、肖像畫中可證，初到巴黎的風景作品色彩洋溢而精確，隱約見得印象派大師保羅・塞尚的影響，直到赴法後隔年，

一次俄籍抽象畫家尼古拉．德．斯塔埃爾 (Nicolas de Staël 1914-1955) 畫展中，斯塔埃爾作品中不具形的自由與激情點醒

了朱德群，令他開始思考屬於自己的這條路該怎麼走，意即對抽象畫的摸索。

1950 年代中後期至 1960 年代朱德群從具象走到非具象，嘗試各種抽象的創作，多以單一色調作為其背景，快筆揮灑出寬、

窄、厚、薄之線條。部分作品筆觸營造的色塊，仍帶點斯塔埃爾潛移默化的影子，但筆觸間書法狂草的氣韻早已蘊藏其中，

甚至可回溯中國山水水墨的靈秀縱逸。此時的他也愛用紅、黑等強烈色調令畫作呈現奔放而激盪的氣氛，風格逐漸確立。

1970 年代的作品受到林布蘭 (Rembrandt Harmenszoon van Rijn 1606-1669) 的影響，朱德群並將中國書法技法如「飛白」

融入其中。這段時間他試著將他心中無形的情感整理成作品，對於光線、直覺、內心探索有更深的體悟，使其作品並無沉

鬱之感，反之擁有行雲流水之雅暢。

直到 1980-90 年代，朱德群創作進入高峰，結合東西方，卻不囿於東西方，更趨向中國傳統之繪畫藝術，探討了宇宙之變

化和人與自然之間的連結。他自覺該有改革藝術歷史的使命感，也真正做到了貫通中西美學、物我合一、筆隨意到的境界，

他幾乎能將胸臆中的感受一一化作作品，落筆酣暢，用色層次豐厚而不著痕跡，舉重若輕，如同溫柔多變的幻想，有時想

像恣肆筆力萬鈞，有時輕盈細微如絲如水，有時是對往日的緬懷，品嘗日常中空氣的質感，朦朧的思緒片段，蒼茫恢弘的

雪景，神秘濃烈的藍光，對他而言生活的靈感俯拾即是，無一不是題材。

2003 年所創作的〈神秘的喜悅〉正是朱德群創作大筆刷系列巔峰時期的作品之一，整體色調深沉穩重，運用不同色階的墨

色，豪邁筆觸筆直掃蕩，明亮的色塊點綴期間形成帶狀，營造出豐富的層次和空間感，整體上顯得沉穩奔放。對朱德群來說，

抽象畫不一定要否定物質的自然形象，他破除了抽象與具象之間的對立，觀者在作品中尋覓的也不僅只是物象的呈現，更

能領受中國山水畫論提出畫作可游、可居的藝術欣賞功能。藝術家透過繪畫追念記憶中的一幕風景，或者是來自詩詞與音

樂的啟發，讓人與世界相互走近，它帶來心靈層面的充實及愉悅，使人與外在世界合二為一、不分主客彼此，整體一氣流蕩，

這即是朱德群作品中天人合一的審美境界。

朱沅芷 1906 年生於廣東朱家村，15 歲移居美國，並在

1924 年進入美國加州美術學校學習並奠定其風格，並

隨葛塔多 • 匹亞秋尼 (Gottardo Piazzone 1872-1945) 練

習風景畫，並與歐蒂斯 • 歐菲德 (Otis William Oldfield

1890-1969) 學習素描、靜物和人體油畫。華人在 20 年

代的美國不太有其地位，朱沅芷 1926 年輟學，與老師

歐菲德和友人在三藩市成立「現代畫廊」，也藉此契機

舉行其個人展覽，在展覽中結識了阿齊爾 • 穆哈特王子

與王妃 (Prince & Princess Achille Murat)，在他們鼓勵與

邀約下，1927 年七月朱沅芷隻身前往歐洲巴黎，藉著王

子與王妃引薦，朱沅芷的繪畫風格與名聲在巴黎畫壇中

流傳開來，舉辦不少個展，在歐洲期間，其繪畫風格融

入塞尚斜線筆觸構成塊面，在色彩應用上也選擇偏暗與

彩度較低且較飽合的色彩。

〈坐在紅色扶椅上的裸女〉是朱沅芷在紐約時期的作品，

別於色塊的處理，更留心線條與色彩的堆疊，色調相近

偏於暗調，彷佛透露出畫家的抑鬱。女子雙手抱頭，斜

傾於紅色扶椅上，著重於側身展露出裸女的體姿；流利

的線條勾勒出裸女的身形，藉著線條上的粗細與色度表

現出光影，再搭配肌膚上色彩的調合，朱沅芷的色塊並

非消失，而是帶著塞尚的靈魂流露於線性筆觸中，在筆

觸中畫家用更精準的功力與色調繪出大膽的創作。別於

其他藝術家對女性詮釋的既定柔美色調，朱沅芷選用自

己愛用的表現性色彩，女子慵懶泰若的體態更在他的詮

釋之下展現出極其微妙的懾人氛圍。

曾海文，本名曾天福，1927 年出生於福建廈門，排行老大，在經商的家庭中，父親不常在身邊，小曾海文

便圍繞在喜好書法的祖父身邊學習經典詩詞與書法，從好奇初學塗鴉到矯若遊龍，在點、線、撇一步步探

索線條繪畫出他的心中世界。可惜快樂的時光，在 1937 年對日戰爭爆發後，曾海文為避戰火蔓延，向南

遷移，一路流離到了越南，在異鄉度過年少。成年的他，背負著父親深深的期許前往法國習醫，過於理性

的醫學始終掩蓋不了他想繪畫的念頭，毅然決然的學畫讓父親斷了經濟來源，在友人的幫忙下，才得以追

求自身的理想。理想是現實與意志的堆積，他沒有正統的教學，只能靠著自己走訪博物館之間，在從其他

藝術家友人與畫冊討論中尋求答案，與不斷的練習寫生，才發展出他想表現的繪畫。

曾海文的作品道盡了他的淡泊與灑脫，是東方道家思想與西方抽象表現的結合。濃濃的中國味繪出的不是

青綠山水，而是心中太極。雙聯幅的水墨畫，是曾海文最為人稱道的創作，是一也是二的表現，「一」分

為「二」，「二」合為「一」的概念，如此新穎的理念拉開了一畫一世界的視野。源自太極，濃筆淡墨相

互交會，有線條也有幾何圖形，即虛即實，是唐海文四處遊走中的感觸。此幅〈無題〉一筆一圓畫過兩張

分開的圖坐落於圖中央，濃墨暈染於上下欲於平衡，相似的創作，左右對照卻有些許的差異，彷彿訴說著

鏡中的我仍有個性，合一後是完整包容下更再創了新的我，似景似宇宙的抽象表現，更涵蓋擬人的隱喻。

邱亞才 1980 年代開始以人物畫為主要發展，他喜歡觀察日常生活中的平凡小人物，對於人性有著莫大的感觸與

琢磨；他研讀莎士比亞、杜斯妥也夫斯基等西方文學大師的巨作，從中汲取創作養分，沒有學院派的框架束縛，

自由地以最直接的感受去創作繪畫、撰寫小說，這也是能讓他的天賦最能自由發揮的優勢。

傳統古代西方肖像畫，總是雍容華貴的皇室貴族才能有幸在畫布上被畫師留下紀念性的樣貌，東方肖像畫亦同。

一般無名小卒是不可能留下任何畫作記錄的。即便到了近代，西方肖像畫的人物，也大多是畫家身邊熟識的人，

或付錢而做的作品。而邱亞才筆下的肖像畫，並非依照真實存在的人物所繪，他是將存在於其心中的意象畫出，

所以他作品中的人物都有個籠統的特質：消瘦的身材、細長的杏眼、高挺的鼻形、面無表情的長型鵝蛋臉及黯淡

不清的單一色塊背景，突顯出「人」這個主題觀點。

早期的人物臉型偏圓、暗色為主，顏料厚實筆觸粗獷，帶有藏不住的焦躁、陰暗特質，或帶有較誇張的戲劇感。

〈浪人〉(Lot76) 為此時期的作品，粗獷厚實的筆觸、睜大的雙眼以及凌亂的爆髮帶有誇張戲劇感。邱亞才作品

直至 1990 年代中後期，風格才逐漸確立，顏色由陰暗轉為明亮，他嘗試以各種顏色點出人物個性，也使用各種

幾何圖形裝飾畫中人物服裝，並漸漸使用曲線繪出富有情感的長圓臉形，並營造出蕭然優雅的文人氣質，融入西

方知識分子的滄桑時代感。〈哲學系學生〉(Lot75) 大約創作於 1993 年左右，男學生柔軟的頭髮服貼於前額，細

長的眉毛與彎勾的長鼻，作畫的黑色線條受到唐宋古畫的影響，輕輕描繪於臉上。背景簡單地用大筆構出一個窗

框，還有類似凳子或邊桌的圓型色塊。與 Lot77〈紳士〉一樣，皆用深藍綠色為主色系，人物以黑色線條勾勒，

形象大致與其他人物籠統特質符合，雖未說明作品年代，觀其風格應也為 1990 年代之後期的作品。

邱亞才並不將他的想法以直接具象的方式傳達給觀者，而是使用一種隱晦的提示在畫布上大作文章，以東方傳統

藝術中「留白」的概念，目的是要留給觀者空間想像與思考，那種未完成，抑或是說曖昧不明的美。繪畫本身的

藝術性，以及每個觀者所添加上的自由想像，作者、作品與觀賞者的三方交流之下，更是提升了其藝術價值。

1980 年代末期至 1990 年代初期楊識宏的作品以「植物

的美學」為特徵，他將對生命的思考轉為以植物的形體來

表現，描繪植物漂浮、蔓生、生死榮枯。此件〈成長與腐

朽〉完成於 1986 年，是此時期的初階段作品。在空間中

漂浮的野獸骸首、非洲面具、樹枝等半抽象元素，原本在

時間分斷流中各自為政，在楊識宏的組合之下將它們互相

連結，藉這些無數循環的死亡與再生，探索生命的本質，

傳達了將面對死亡的思考轉化為對生命的禮讚，對於自然

的更迭、生命的興衰及時間消逝的意境表現，他無意妄下

斷論，只是觀察與想像，以他靜謐又迷人的靈巧筆觸帶來

無限詩意。

郭維國，1960年出生於台北，1984畢業於中國文化大學美術系，1998年與原為台北畫派的畫家盧天

炎、楊茂林、陳瑞文、吳天章、陸先銘、李民中、連建興、楊仁明共創了悍圖社，並為悍圖社的第一

任社長，一群志同道合的夥伴憑藉著一腔熱血，利用藝術創作批判社會的理念，是初衷，也是對社會

改善的期盼，從90年走過將近30年的歲月。2004年畢業於國立台北藝術大學美術系美術創作碩士班。

從 1993年到 2015年創作展覽不斷，2007年〈男男自娛〉，〈臺灣超現實〉，2009年〈判離異象：

其繪畫風格寫實，細膩的椰子樹景與人物、陽光映於海面上的光澤，人物坐落於白布上佈景的配置，

搭配著昏暗的色調，宛如攝影輸出，另一方面，畫中的佈局又充斥著荒謬的夢境，不真實的諷刺感深

藏畫家的心思，更令觀者耐人尋味的琢磨細節間的關聯。

身為一個台灣當代藝術家，常陵擅長使用油畫媒材的特徵，對物質性有許多實驗性的探討，有別於法蘭西斯・培根

(Francis Bacon 1909-1992) 藉由感覺邏輯自身觸摸客體，常陵探討的物質性自身是依附在對於物件輪廓的概念。另

一方面，常陵通常在單一作品使用類似如鬼魅般的憂鬱色系，並藉由主題的留白效果醞釀出一股介於當代與古典之

中的憂鬱，就像是一場融合十八世紀巴洛克風格的當代戲劇。這張作品其實是「五花肉系列」作品中的一個面向，

其中使用了竹與鶴等中國元素，詮釋現代主義下的東方；藝術家從媒材、從圖像出發，重新審視傳統文化，並試圖

走出屬於現代性下的個人特色。

台灣雲林人，日本拓殖大學政治系畢業，留法一年，在日本接受嚴格的膠彩媒材訓練，擅長以此

作畫，表現膠彩既高雅卻又不閃閃發亮的光澤；而其題材擴及自然風景，人物，甚至花鳥。目前

長年旅居日本。姚旭燈擅長使用人工的顏色，在畫面的表現上卻又顯得層次柔和且典雅。在這青

綠色為底的畫面，常鶲鳥身上的細節被細細描繪，停佇在搖曳綻放的梔子花中，情景交融充分表

現閒情野意。

1937年出生於彰化，1957年畢業於台北師範藝術科。梁奕焚企圖追求一種「既非東方西方，既不現

代也不傳統，超越時空」的自由藝術形式，並擅於使用童年記憶、日常生活、台灣民俗、以及原住民

的生活為題材。在知天命的歲數，貿然離台赴美闖蕩，大膽筆觸，簡單線條勾勒出的「黑美人」，鮮

豔的色彩，富有生命力的題材，不但在紐約蘇活區 (SoHo) 得以定期展覽，更成功打出名聲，廣為收

藏的作品，也因此不曾間斷地在國內外畫廊及拍賣場出現。

1959 年生於四川成都，畢業於四川美術學院油

畫系，1988年前往美國佛羅里達大學攻讀碩士。

在美國，楊千接觸到了抽象繪畫理論以及不同的

藝術媒介，讓他不斷探討繪畫的內在與形式及虛

實的表現。楊千的繪畫所探索的是手工圖像（繪

畫）和機械圖像（攝影）之間的關係，是他早期

雙重繪畫的創作理念基礎。楊千的創作多以人物

為主，且女性居多。在攝影照相抬頭的時代，楊

千不但受其影響並從中反思，利用攝影的特徵轉

化到繪畫當中，並將日常生活的紀錄以個人和情

感的角度重新詮釋。

杜溪常常使用現當代的圖像符碼，重新組構中國傳統文本裡的故事、歷史、甚至神話，也正因他對傳說有著深厚的情誼，對當代有著自我的見

地，杜溪的作品觸及了當代社會裡的某條神經。而他以卡通式的人物表現中國傳統故事所造成的衝突感來自對於舊時代的追溯，卻又充分表達

2012 年路易・威登為紀念和草間彌生的合作，發售了世界限

量 111 件的精裝簽名版畫書。此件作品更曾在該年倫敦泰特

現代美術館的《草間彌生回顧展》展出。本作品包含英國作家

查爾斯．路德維希．道奇森 (Charles Lutwidge Dodgson) 的

不朽名作《愛麗絲夢遊仙境》的原版稿故事書，由草間彌生添

加插畫；草間彌生簽名的絲網印刷〈自畫像〉以及草間彌生的

簽名肖像照片，共計 3件的收藏組合。其中，絲網版畫〈自畫

像〉(Self-Portrait) 原作為佛羅倫斯．烏菲茲美術館收藏（2010

年，壓克力畫布，100x80 公分）。而草間彌生的簽名肖像照

片，為 2012 年 3 月 15 日由攝影師 Antoine Jarrier 掌鏡，在

美國藝術家 KAWS，原名布萊恩・唐納利 (Brian

Donnelly) 出生於 1974 年美國紐澤西，小學時即

展現對塗鴉的興趣。1995 年，KAWS 還是曼哈頓

視覺藝術學院的學生，便已經開始在自己的街頭藝

術中混合商業設計元素，更曾為當地的街頭服裝品

牌 Subware 設計產品。畢業後曾經在一家動畫製

作公司工作，自此對米奇老鼠、阿童木等一些耳熟

能詳的角色產生喜愛並將其作為創作基礎。他因深

受塗鴉藝術影響與啓發，以獨出心裁的手法在廣告

牌和海報上添加自己的創作，廣受歡迎；他畫中人

物眼睛總是變成Ｘ形，成為他獨特的標誌。

本此集結具代表性的 2004 年出的 KAWS 5YL

Companion，15 吋全身大耳朵公仔及 2006 年出

的 14吋半與 KASS創立的潮牌Original Fake聯合

出版的 Original Fake Companion，是右半露出身

體內部的大耳朵公仔，二者為一組 lot，共有黑色

系 (Lot110) 及灰色系 (Lot111)。此外還有 KAWS

劉漢文 1965 年出生，從小對繪畫有興趣，在求學

過程中已參加不少比賽，也榮獲臺灣中部五縣市中

學繪畫獎第三名，得到不少掌聲與肯定，更讓他確

定方向，少時曾在台灣前輩水彩大師林順雄學習水

彩，而後遠赴西班牙美術學院學習。

劉漢文的作品，細膩的寫實手法繪畫出的創作，擁

有真實肌理物件欺騙了眼睛，更利用水彩可暈染的

特性，鋪造出幻境般具有設計感的背景，讓畫更有

戴清擅長使用油畫厚重的質地，粗獷的線條，表現介於抽象與具體之間的形象，強烈而狂野的筆觸、大膽的色彩和

作品中流露出現實感。其作品一般都以人類面孔作為描繪的題材，在我們最熟悉的視覺印象—面孔，塗抹出每一個

人的特性。曾如藝術家本人的自述：「順其自然」，其實是順其藝術家自身的任性與反叛，所以每一張繪畫都是畫

The following provisions are entered into by and between Kingsley Art Auctions (hereinafter referred to collectively as "the Company" ), as the auctioneer, and the Seller (hereinafter the "Seller"). The Agreement is also entered into by and between the Company as the agent of the Seller and the Buyer (hereinafter the "Buyers"). Both the Buyer and the Seller shall review and accept all provisions hereunder.

AgentThe Company, as the auctioning party, shall act as the agent of the Seller. Except otherwise provided, items successfully sold in the action held by the Company shall be bound by the agreement made by and between the Seller, through the agency of the Company, and the Buyer.

Before the auctiona.Authentication

We s t rongly recommend that the prospective buyers conduct their own authentication for the items they are interested in bidding prior to the action. We provide no guarantees to the buyer (with the exception of the guarantee with regard to counterfeits as defined of the Agreement).

b.Catalogue ExplanationsAny statement of the author, history, date, year, size, material, ownership, authent ic i ty , o r ig in , cond i t ion of preservation or estimated selling price of any of the Lots shown in the catalogue or the authentication opinion made by the Company, or any other verbal or written statements made separately shall be solely statements of opinions and shall not be deemed the basis for the statements of actual fact. The photographs shown in the catalogue shal l serve as reference only and shall not be deemed as the basis for determining the color or tone of any Lot or disclosure of the defects of such item. The estimated of the auction price shall not be deemed the price at which such item will be successfully sold or the statement of the value of the item for other purposes. Many auction items fail to maintain their perfect condition because of time and other environmental factors. Some of the explanations in the catalogue or the authentication opinions will state defects and/or the repair background of the Lots. Such information is meant for reference only. Missing information in the statements does not mean the Lot has no defects or has not been repaired any statement of the one particular defect does not mean there is no any other defect.

c.Responsibility of the BuyerThe Buyer is responsible for clarifying and satisfying himself about the condition of the items and any related matters stated in the catalogue descriptions.

During the auctiona.Refusal of admission

The company has the right, at our own

discretion, to refuse admission to the premises or participation in any auction and to reject any bid.

b.Registration before biddingA prospective buyer must fill in and sign the registration forms prior to the bidding and provide personal identification. Prospective buyers should also note that the Company may be requested to conduct credit checks against buyers.

c.The bidder is the BuyerUnless a written agreement has been made upon registration that the bidder will be the agent who acts on behalf of a third person and such third person is accepted by the Company, the bidder will be deemed as the Buyer who will bear individual legal responsibilities.

d.Absentee bidsThe Company will make proper effort to bid for the prospective buyers who instruct us to bid on their behalf by using the forms attached to the catalogue. Written bids form should be delivered to the Company prior to the auction. If we receive written bids on a particular lot for identical amounts, and the auction these are the highest bids on the lot, it will be sold to the person whose written b id was rece ived and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with it.

e.Telephone bids

The Company will make proper efforts to contact the bidder to participate in the auction by phone. The prospective buyer should request such arrangements prior to the auction. However, the Company will bear no responsibilities to the Seller or any prospective buyer if no contact is making under any circumstances.

f.Currency converterThe currency converter will be utilized at the auction. Errors may occur in the operation of the currency converter and we do not accept liability to bidders who follow the currency converter rather than the actual bidding in the saleroom.

g.Video or digital imagesThe image projection will be made at the auctions; however, errors may occur during the operation. The company is not liable for the color accuracy of the reproduced image and whether the projected image corresponds to the item being auctioned.

h.Auctioneer's discretion

The auctioneer reserve the absolute

right to reject any bid, push for bids at his own discretion, withdraw any auction items, separate or combine two or more auction items, and if there is any error or dispute, re-auction the items.

i.Successful bidsUnder the discretion of the auctioneer, the highest bidder accepted by the auct ioneer wi l l be the buyer and the striking of his hammer means the acceptance of the highest bid and the conclusion of a contract for sale between the seller and the buyer.

After the auctiona.The service fee of each lot payable by

the Buyer (Modern and Contemporary Art)

(1) The Buyer should pay the h a m m e r p r i c e a n d , i n addition, the service fee to the Company. For hammer price below NT$16,000,000 (inclusive), the service fee should be calculated at 20% of the hammer price.

(2) For hammer price higher than NT$16,000,000 the first NT$16,000,000 should be calculated at 20% and the rest of the amount should be 12%.

b.Taxes

All the payments payable by the Buyer to the Company do not include any commodity or service taxes or any other value added taxes (whether imposed by the R.O.C. government or elsewhere). The Buyer shall be responsible for paying any applicable taxes as required by the law.

c. Payment

(1)All payments due (including the hammer price, buyer's premium and any applicable taxes) shall be paid within 7 days after the auction.

(2 ) I f the Buyer fa i l s to pay to the Company all the payments due, the Buyer will not acquire the ownership of the Lot even if the Company has delivered such item to the Buyer. If the payment is made other than NT dollars, the buyer shall pay the related expense incurred, including bank charges and foreign exchange service fees.

d.Collection, packing and shippingU n l e s s o t h e r w i s e a g r e e d b y t h e Company, the Company wi l l hold temporarily the successfully sold Lots

Ⅰ . The Buyer

until all payments to the Company are made in full. The Lot will be covered by the insurance of the Company from the auction date for 7 days during the temporary holding period. The insurance coverage will terminate upon collection of such item. The Buyer should be responsible for all risks following expiration of the said 7-day period or the collection (whichever is the earlier). The Company will provide shipping company upon the buyer's request and do not accept any liability if any damage occurred by the shipping company.

e.Remedies for non-payment or non-collection of purchases of purchasesThe Company is entitled to exercise one or more of the following rights or remedies if the Buyer fails to make payment within 7 days.(1)An interest at the monthly rate of

no higher than 4% plus the base interest rate will be imposed on all of the payment due if payment is not made within 7 days following the auction date. The payment to be made by the Buyer should offset any payment owed by the Company or its subsidiaries to the Buyer for any other transactions.

(2)The Company reserves the right to refuse the Buyer to make on behalf of others, bids in any future auctions and/or to require a deposit from the Buyer before accepting any future bids made by the Buyer. If the Buyer fails to make payment within 35 days, the Company is entitled to exercise the following rights in addition to the aforementioned.

(3)To take legal action to the Buyer on behalf of the Seller to claim the entire payment due and the legal fees resulting from such legal action based on a total claim.

(4)To cancel the transaction of Lots bid by the Buyer or any other auction items sold to the Buyer at the same or any other auctions.

(5)To arrange a public or private re-sale of the Lot. If the reselling price is lower than the payment, the differences and other expenses incurred shall be responsible by the Buyer.

f.No collection of the purchasesThe Company wi l l arrange for the storage of the Lot if such item sold is not collected within 7 days of the item, regardless payment is made or not. Such storage cost will be borne by the Buyer.

g.Export permitU n l e s s o t h e r w i s e a g r e e d b y t h e Company in written, the process of applying the export permit does not affect the Buyer's responsibility to make the payments within 7 days. If the Buyer requests the company to apply the export permit on his or her behalf, the Company is entit led to charge the related expenses.

The legal responsibility of the CompanyThe company is responsible for returning payment to the Buyer pursuant to Article 6 . otherwise, whether the Buyer, the Company, any employees or agents of the company will not be held liable for any statements of the author, history, date, year, ownership, authenticity or origin of any auction item or any errors with respect to any explanations and any flaws or defects of any auction item. The Buyer, the Company makes no guarantee with respect to any auction items. Any warrantee of any k ind shal l not be included herein.

Return of payments for forgeryIf the Lot is considered as a forgery by the Buyer, the Buyer should inform the Company in written notice within 14 days. The written comment should under the following condition and the transaction will be cancelled and payments made will be returned to the Buyer. It is unnecessary for the Company to pay the Buyer an amount more than what the Buyer pays in connection with the Lot and the Buyer does not reserve the right to claim interests under any circumstances.

a.The written report should be provided by two individual experts and agreed by the Company.

b.The Buyer must return the Lot to the Company within the following 21 days and the condition of the item must be the same as on the auction day.

c.The Buyer has absolute right to the Lot and the Lot is free from the third party rights of claims.

d.The Company will refund to the Buyer any amount paid to the Company after receiving the amount returned by the Seller.

The agentThe Company acts as the agent of the Seller at a public auction. The Closing Agreement of the Lot is the agreement by and between the Buyer and the Seller.

Expensesa.The Seller shall bear costs including

packing, shipping, storage, insurance, catalogue, framing, mounting, repair, and tax.

b.If the auction succeeds or a private deal is done, the company will deduct from the hammer price at a regulated rate as the commission and expenses.

Insurancea.The company will collect 1% of the

hammer price from the Seller or 1% of the reserve price if the Lot is not

successfully auctioned. If the shipping i s ar ranged by the company, an additional amount will be collected by the Company, an additional amount will be collected by the Company from the Seller as the shipping insurance. Such amount varies depending on the individual condition of each auction item. The company will refer a freight forwarder if necessary. However, the Company is not responsible for any legal responsibilities incurred therefrom.

b.The Lots will remain insured up to 7 days after the sale. If the Lot has not been sold, it will be at the Seller's risk upon the expiry of 7 days.

c.We are unable to accept responsibility for damage caused by woodworm or changes in atmospheric conditions or weather.

Insurance purchased by the SellerI f t h e S e l l e r i n f o r m t h e C o m p a n y specif ical ly that it is unnecessary to purchase insurance for the Lot, the risks shall be borne entirely by the Seller until the Buyer makes all the payments. The Seller must indemnify the Company, the employees and agents of the Company and the Buyer (if applicable) any claims in connection with the auction against the Company, the employees and agents of the Company and the Buyer, regardless of the cause of such claim.

Commitments made by the Seller with respect to the Lota.The Seller is the only owner of the Lot

and has the unlimited right to assign his ownership to the Buyer which should not concern any third party right or claim (including copyright claims).

b. The Seller complies with all the laws in connection with the import and export of auction items and any other laws and has notified the Company in writing any failure to comply with such rules in the past.

c. The Seller has notified the Company in writing of any major modifications in the Lot to the best of his knowledge and any concern the third party has raised with respect to the ownership of the Lot and the condition.

d. In the event of any inaccuracy of the above mentioned, the Sel ler must guarantee, if requested, to identify fully the Company and/or the Buyer all the claims, costs and expenses arising here from, whether caused by the Lot or the auction proceeds.

Auction arrangementsa. T h e C o m p a n y h a s i t s d i s c r e t i o n

over the description of the auction in the catalogue, display layouts, authentication opinions, location and method of the auction, who will be allowed to bid and the acceptance of the bid price, whether to seek profession

opinion and whether to combine or separate the Lots. The Company reserves the right to withdraw the lot without obtaining the consent of the Seller.

b. If the Company or the Seller withdraws the Lot, the Company may charge 10% of the Reserve set by the Seller.

Auction rulesThe Company wi l l auct ion the i tem according to the Reserve. The Reserve may not be higher than the minimum of the estimates set in the catalogue. The Company is entitled to auction the item at a price lower than the Reserve, If the lot is sold according to the above principle, the Company is responsible to pay the Seller the difference between the closing price and the Reserve.

After the successful auctiona. Settlement

After the payment is made by the Buyer, unless the Company receives a notice claiming such auction item is a forgery (as defined in the Agreement), the Company will pay the Seller within 45 days following the successful auction day an amount equal to the closing price taking away all the expenses payable by the Seller. If the Buyer delays the payment, the Company will pay the Seller within 7 days following the payment by the Buyer. If for any reason The Company pays the Seller before the Buyer makes the payment, the Company acquires the full ownership of the item. However, if the Company is forced to reclaim the Lot from the Buyer because such item is a counterfeit, the Seller must return the auction proceeds to the Company.Unless otherwise instructed by the Seller in writ ing, the Company wil l make its payment in NT dollars. If the Seller requests to pay in currencies other than NT dollars, the Company will collect from the Seller any foreign exchange expenses arising therefrom.

b. Non-payment by the Buyer

I f the Buyer fa i l s to make a l l the payments due within 35 days following the auct ion day, the Company i s entitled to negotiate special terms in connection with the payments, storage, and insurance on behalf of the Seller and act deemed necessary by the Company to collect payments payable from the Buyer. However, the Company is not responsibility for making remittance to the Seller nor for bringing any legal actions on behalf of the Seller. The Company will discuss with the Seller to adopt appropriate actions to claim auction payments from the Buyer.

c. Forgery

If the Buyer convinces the Company

that the Lot is a forgery (as defined in the Agreement) within 14 days following the auction day, then (1) If the Buyer has not paid all or part of the payment, the Company is entitled to call off the transaction and/or (2) If the Company at that time has paid all or part of the payments payable to the Seller, the Seller must return all of the payments made to the Company if requested. The Company will exercise lien for the latter. Any items belonging to the Seller under control of the Company will be kept as security of the payments to be returned.

d. Unsuccessfully auctioned items

Any item not auctioned successfully, not included in the auction or withdrawn from the auction for any reason must be collected by the Seller within 35 days upon notification by the Company to the Seller. The storage fee of NT$300 per day will be charged on each item not collected after such 35 day period together with an additional charge for purchasing insurance coverage. The Company may dispose the Lot if such item is not collected within 90 days following the auction date or the notice date (whichever is the earlier). Such disposal includes removing the item to a third party warehouse with the associated expenses borne by the Seller and to auction such items under terms deemed appropriate by the Company (including the terms of estimates and the Reserve). The Company will pay the Seller the related expense after payments owed are offset.The Company is authorized to act as the sole agent of the Seller within 30 days following the auction for any auction item with-drawn from the auction or not sold. The Company may auction in private the item based on the net amount the Seller may receive (the amount after deducting all the expenses payable by the Seller) or sell such item in private at a lower price agreed upon by the Company and the Seller. Under such circumstances, the Seller's responsibilities and liabilities to the Company are the same as during an auction.

Photographs and displayThe Company owns non-exclusive rights to the photographs, recordings and other reproduced images of the Lot. All the rights of such images shall belong to the Company and the company is entitled to use such images in any manner it deems appropriate.

TaxThe payment payable by the Seller to the Company dose not include any commodity or service tax or any other value added tax (whether imposed in the Taiwan or elsewhere) The Buyer should be responsible for paying such taxes pursuant

to the tax rates and time provided by the law if there is any such applicable tax.

If the Company is commissioned by the Seller to auction in Taiwan, the Company must pay the income tax for the Seller pursuant to the R.O.C. laws.

CopyrightT h e c o p y r i g h t o f a l l t h e i m a g e s , photographs and written material in connection with the Lot belong to the Company at any time. The Buyer or any person may not use such items without obtaining prior written consent from the Company.

NoticesAll the notices distributed according to the Transaction Agreement herein shall be made in writing. Any notice shall be deemed served to the recipient on the second day following delivery if sent by mail. If the recipient is abroad, the notice shall be deemed as received on the fifth working day following delivery by mall.

SeverabilityIf any part of the Transaction Agreement is deemed invalid, illegal or unenforceable by any court, such part can be ignored and the rest of the Transaction Agreement continues to be valid and enforceable to the maximum extent permitted by the law.

JurisdictionT h e T r a n s a c t i o n A g r e e m e n t a r e governed under the R.O.C. law and the interpretation and effect of the Rules shall be subject to the R.O.C. laws. The Buyer and Seller shall submit themselves to the exclusive jurisdiction of the Taiwanese court for the interests of the Company. (Any discrepancy between the Chinese and English version of this terms and Conditions of Business, the Chinese version shall prevail.)

Ⅲ . Terms applicable to both the

Buyer and the Seller

本規則，為本公司作為拍賣公司與賣家訂立合約，亦為賣家之代理人與買家訂立合約之條款。

買家及賣家請務必細讀，並同意下列條款規定。

一、代理人

金仕發拍賣有限公司（以下稱本公司）

作賣家代理人，除另行協定外，在本公

司之拍賣中成功拍賣之物品，即產生

賣家通過本公司之代理與買家達成之合

約。

二、拍賣前

1. 鑑定物品

本公司鄭重建議，準買家應於拍賣進

行之前親自鑑定有興趣競投之物品。

本公司除就膺品（如本拍賣交易條款

所界定者）作出之證明外，不對買家

作任何保證。而拍賣品以其拍賣時

「現狀」出售。

2. 目錄說明

本公司於目錄對任何拍賣品之作者、

來歷、日期、年代、尺寸、材質、歸

屬、真實性、出處、保存狀況或估計

售價之陳述，或另行對此等方面之口

頭或書面陳述，均僅屬意見之陳述，

不應依據為確實事實之陳述。目錄

圖示亦僅作為指引參考，不應作為任

何拍賣項目之依據，藉以決定其顏色

或色調，或揭示其缺陷。拍賣價格之

估計，不應為拍賣品會成功拍賣價格

之依據或拍賣品作其他用途之價值陳

述。

許多拍賣品基於其年代或性質，使其

未能有完美之狀況，目錄內有些說明

或鑑定意見書會提述拍賣品之損壞及

/或修整資料。此等資料僅作為指引

參考，如未有提述此等資料，亦不表

示拍賣品並無缺陷或修整，如已提述

特定缺陷，亦不表示並無其他缺陷。

3. 買家之責任

有關物品狀況及目錄說明所提述事

項，買家需於拍賣前充分詳閱，並確

認自身對於該物品感到滿意。

三、拍賣時

1. 拒絕入場

本公司具有絕對之決定權拒絕任何人

士進入拍賣場地、參與拍賣，亦可拒

絕接受任何競投。

2. 競投之前作出登記

準買家在作出競投前，必須填妥及簽

署登記表格，並提供身分證明。本公

司通常會要求對買家作出信用核查。

3. 競投者為買家

除非登記時已書面協定，競投者將為

代第三人行事之代理人，而該第三人

為本公司所接受者，否則競投者將被

視為買家而須承擔個人法律責任。

4. 委託競投

競標前收到書面競標，本公司將盡適

當努力代其競投。如本公司就某一拍

賣品而收到多個委託競投之相等競投

價，而在拍賣時此等競投價乃該拍賣

品之最高競投價，則該拍賣品會歸其

委託競投最先送抵本公司之人，除

非在競投時有其他委託，此項書面競

投的執行是本公司的免費服務。本公

司不會對因未能執行之書面競投，或

在當中出現任何錯誤或遺漏負任何責

任。

5. 電話競投

如準買家於拍賣前與本公司做好安

排，本公司將盡適當努力聯絡競投

者，使其能以電話參與競投，但在任

何情況下，如未能聯絡，本公司對賣

家或任何準買家均不負任何責任。

6. 貨幣兌換顯示板

拍賣會上，如有使用貨幣兌換顯示

板，該貨幣兌換顯示板在操作時難免

會出現錯誤。買家因依賴貨幣兌換顯

示板 (而非拍賣場的實際競投 )而蒙

受之任何損失，本公司概不負責。

7. 錄映影像

拍賣中如有影像投射，有關操作上的

失誤或影像素質參差不齊之情況，本

公司不負任何責任。

8. 拍賣官之決定權

拍賣官具有絕對決定權，亦即有權拒

絕任何競投、以其決定之方式推動出

價、將任何兩件或多件拍賣推動出

價、將任何拍賣品撤回或分批、將任

何兩件或多件拍賣品合併，如遇有誤

差爭議，將拍賣品重新拍賣。如在拍

賣後有任何爭議，將會以本公司的拍

賣紀錄為依據。

9. 成功競投

在拍賣官之決定權下，下槌即顯示對

最高競投價之接受，亦即賣家與買家

之成功拍賣合約之訂立。

四、拍賣後

1.買家支付每件拍品之服務費率

（現代與當代藝術）

(a)買家除支付落槌價外，另須支付服務費予本公司，落槌價於

新台幣壹仟六佰萬元以下者含

壹仟六佰萬元以 20%計算。(b)落槌價超過新台幣壹仟六佰萬元之部份以 12%計算。

2.稅項

買家支付本公司之所有款項均不包括

任何貨物稅、服務稅或其他增值稅。

如有任何相關稅項產生，買家須負責

按有關法律所規定之稅率及時間繳付

稅款。

3.付款

(a)買方需於拍賣日期後七天內悉數

支付所有交易款項（包含落槌價、

拍價支付之酬金，以及任何適用

之增值稅）。

(b)買家如未向本公司支付所應付之

拍賣規則

全部款項，則不能取得拍賣品之所

有權，即使本公司已將拍賣品交付

予買家亦然。如支付予本公司之款

項為新台幣以外之貨幣，本公司將

向買家收取所產生之匯差及規費。

4. 包裝及搬運

七天期滿後代介紹承運人或自領取時，

拍賣品風險全由買家承擔，且不負任

何法律責任。

5. 不付款或未領取之已購拍賣品補救辦

法

如買家未在七天內付款，本公司即有

權行使下述一項或多項權利或補救辦

法。

(a)在拍賣日期後超過七天仍未付款，

以年利率百分之四收取整筆現款利

息。

(b)在將來的任何拍賣中，有權拒絕

買家或由他人代其所作出之競投，

或在接受其任何競投前先收取買家

保證金。如買家未在三十五天內付

款，本公司除上述者外，另有權採

取下列措施。

(c)代賣家針對買家進行法律程序，索

回整筆款項，另買家須負擔因而產

生之法律訴訟費用。

(d)取消同一次或任何其他拍賣中買家

競投得之拍賣品或任何其他售予買

家之拍賣品之交易。

(e)安排將拍賣品公開或私下重售，如

重售所得價格較低，其差額連同因

買家未有付款而引致之任何費用一

併向買家索償。

6. 未領取已購之拍賣品

如已購得之拍賣品未能在成功拍賣七

天內領取，不論是否已付款，本公司

將安排貯存事宜，費用由買家承擔。

7. 出口許可證

(a)除本公司另有書面同意外，買家希

望申請出口許可證，並不影響買家

在七天內付款之責任，亦不影響本

公司對延遲付款收取利息之權利。

(b)如買家要求本公司代為申請出口許

可證，本公司有權收取增值稅與其

他相關費用。

(c)如買家無論是否需要出口許可證之

事實而作出付款，本公司並無責任

退還買家因此產生之利息與其他已

產生之費用。

五、本公司之法律責任

本公司有責任在本交易條款第六條所列之

情況退還予買家。除此之外，不論賣家或

本公司，或本公司任何僱員或代理人，對

任何拍賣品之作者、來歷、日期、年代、

歸屬、真實性或出處之陳述，或任何其他

說明之誤差，任何拍賣品之任何毛病或缺

陷，均不負有任何責任。買家、本公司、

本公司之僱員或代理人，均無法就任何拍

賣品作出任何保證，任何種類之擔保，均

不包含在本條款之內。

六、膺品處理

買方如認定拍賣品係為膺品，需於拍定售

出日起十四個工作天內，以書面通知本公

司，且須符合下列條件，始得取消交易，

並將其支付本公司之款項無息退回，並不

得請求其他賠償。

(a)由二位獨立專家提出書面說明，並

經本公司認可。

(b)買家應於拍定售出日起二十一個工

作天內，將購得之拍賣品退回本公

司，且本公司收到該拍賣品時，該

拍賣品之狀況需與拍賣當日相同。

(c)買家對該拍賣品擁有絕對所有權，

並未在該拍賣品上設定任何債權。

(d)賣家需繳回相關費用後，本公司始

得退還買家。

一、代理人

金仕發拍賣有限公司（以下稱本公司）作

為賣家代理人，賣家拍賣品的成交合約，

則為買家與賣家之間的合約。

二、費用

1. 賣家須支付拍賣相關費用，費用項目

包括拍賣品之包裝、運送、儲存、目

錄製作、裝框裱褙、鑑定、整修與關

稅及任內市場推廣費用等。

2. 拍出者，本公司自「拍定價」中扣除

依「合約」計算之佣金，因未能拍出

而私下議價者亦同。

三、保險

1. 本公司將向賣家收取委託底價之百分

之一作為保險費。如由本公司安排運

送，本公司將向賣家收取額外款項，

作為運送保險費，費用視每宗拍賣品

之特定情況而定。在賣家的要求下，

本公司可提供承運廠商資訊予賣家，

惟本公司不承擔任何有關方面之法律

責任。

2. 拍賣品在拍賣後七天內保險仍然有效。

如拍賣品未能成功拍賣，逾期後風險

由賣家承擔。

3.因蛀蟲、空氣或氣候轉變對拍賣品造成

之損壞，本公司概不承擔法律責任。

四、賣家購買保險

如賣家特別指示本公司毋須為拍賣品購買

保險，風險全由賣家承擔，直至買家付清

款項為止。賣家須保障本公司、本公司之

僱員與代理人，以及買家索償之賠償責

任，而不論索償產生之任何原因。

五、賣家就拍賣品所作之承諾

1. 賣家為拍賣品之唯一物主，具備將所

有權轉讓予買家之無限制權利，並與

一切第三人權利或索價（包括版權索

償）無涉。

2. 賣家已遵守一切與拍賣品之進出口有

關之法律或其他方面之規定，並已將

過去任何第三人未能遵守此等規定以

書面通知本公司。

3. 賣家將其所知之有關拍賣品任何重大

修改以及第三人就拍賣品之所有權、

狀況或歸屬以書面通知本公司。

4. 如上述 1-3項有任何不確實之處，賣家

須應要求保證完全償還本公司及 /或

買家一切因之而引起之索償、費用之

或開支，而不論是因拍賣品還是因拍

賣收益而引起。

六、拍賣安排

1. 本公司對目錄內拍賣品之描述與圖示

方式、鑑定意見書、拍賣地與方式、

進場參與競投者與競投價之接受、專

家意見的尋求，以及物品合併或分開

拍賣等均有完全之決定權，本公司在

未徵得賣方同意下有權撤回拍賣品。

2. 賣方於圖錄完成後不得撤回拍賣品，

圖錄未製作前經本公司同意賣家撤回

拍賣品，本公司得收取賣家委託底價

百分之十之費用。

七、拍賣守則

本公司將會參照底價將拍賣品拍賣。底

價不得高於目錄所印估價之下限。但

本公司有權將拍賣品以低於底價拍賣。

如本公司如此將拍賣品拍賣，本公司

將有責任向賣家支付成交價與底價之

差額。

八、成功拍賣後

1. 結算

在買家付款後，除非本公司收到通知

該拍賣品為膺品（如本拍賣規則界定

者），本公司會於成功拍賣日期後

四十五天，將成交價扣除賣家應支付

所有費用之款項支付賣家。如遇買家

延遲付款，本公司將在買家付款後七

天內支付賣家。如因任何理由而使本

公司在買家付款前即已付款予賣家，

本公司即獲得拍賣品完整之擁有權與

所有權。惟本公司因拍賣品為品的情

況下，賣家方須將已收取之拍賣款項

退還予本公司。

除與賣家事前書面協定外，本公司以

新台幣付款。如賣家要求以新台幣以

外之貨幣付款，本公司將向賣家收取

所產生之任何外匯費用。

2. 買家不付款

如買家在拍賣日期後三十五天內未支

付應付之全部款項，本公司即有權代

賣家就付款、貯存與保險而協定特別

條款，採取本公司認為需要的法律行

動向買家收取應付之款項。惟本公司

並無責任支付賣家款項，亦無責任代

賣家採取任何法律行動。本公司將與

賣家討論採取適當行動以向買家索回

拍賣款額。

3. 膺品

如在拍賣日期後十日內，經買家提出

證明並經本公司認同該拍賣品為膺品

（本拍賣規則界定者），則 (1) 如買家

尚未支應付之全部款項，本公司有權

取消交易；及 /或 (2) 如本公司屆時已

支付賣家全部或部份應付款項，賣家

須應要求將該款項悉數退還本公司。

在後一情況下，本公司將行使留置權，

有權留置屬於賣家之任何物品以作為

應退還款項之擔保品。

4. 未能成功拍賣之拍賣品

任何拍賣品如未能成功拍賣，或不包

括在拍賣之內，或因任何理由而徹回

拍賣，在本公司發出通知，要求賣家

領回拍賣品之三十天內，賣家必須領

回拍賣品。任何此等拍賣品如在三十

天過期後仍未領回，每天每件將徵收

貯存費新台幣伍百元整，並加收貯存

期間產生之保險費用。任何此等拍賣

品如在拍賣日期後或上述通知日期後

九十天內（以較早日期為準）未被領

回，本公司可決定是否將該拍賣品進

行處置。處置包括將拍賣品移往第三

人之貨倉，開支費由賣家承擔，與將

該拍賣品按本公司認為適當之條款（包

括有關估計與底價之條款）公開拍賣。

本公司其後將拍賣所得扣除所有相關

費用後支付予賣家。

任何拍賣品如在拍賣中收回或未能成

功拍賣，本公司獲授權在拍賣後的

三十天內作為賣家之獨家代理人，按

賣家可收取之淨款額（即扣除賣家應

付之一切費用後之款額），私下出售

拍賣品，或按本公司與賣家另行同意

之較低價格私下出售。在此情況下，

賣家就該拍賣品而對本公司所負有之

責任，與拍賣品成功拍賣時相同。

九、圖片與圖示

本公司對拍賣品之圖示、錄影或將拍賣品

複製影像具有非排他性之權利。此等影像

一切權利均屬本公司所有，且本公司有權

以任何適合之方式使用。

十、其他事項

1. 稅項

賣家支付予本公司之所有款項不包括

貨物稅、服務稅或其他增值稅，如有

任何相關之稅項產生，賣家須依據有

關法律規定之稅率及時間繳付稅款。

一、版權

與拍賣品有關之一切影像、圖示與書面材

料之版權，屬於本公司之財產。未徵得本

公司事先書面同意，買家或任何人均不得

使用。

二、通知

根據本拍賣規則發出通知，均以書面發

出。如採用郵遞發出，在付郵後第二個工

作天即當作已由收件人收妥；如收件人在

海外，為付郵後第五個工作天。

三、可分割性

本交易條款中如有任何條款遭任何法院認

定無效，該部分即不執行，而本拍賣規則

之其他部份在法律許可之最大範圍內須繼

續有效及可強制執行。

四、法律及管轄權

本拍賣規則依據中華民國法律規限，本拍

賣規則之解釋與效力均適用台灣法律。為

本公司之利益而言，買賣家須服從台灣地

區法院之排他性管轄權。（上述有任何詮

釋上的問題，一概以中文版本為準）
