the sales of your collections. As your commissioned

representative, we include auctioning, trading,

packaging, and shipping services for your works.

2.Art AgencyKingsley conducts private art sales through its Taiwan

offices. We also provide professional consultation

on art appraisal issues, value management, and

investment advice.

3.Insurance and Tax ConsultationKingsley also helps to deal with any insurance and tax

related issue of your import or export art. And we also

manage with international/domestic shipping and

packaging for your art works.

4.Sales Tax Payable by the Buyer The buyer shall pay for (value added) sales tax in

the amount of 5% of the Hammer Price with respect

to imported works of art collected by the buyer in

Taiwan pursuant to the laws of the ROC. The buyer is

not required to pay for sales tax if such imported works

of art【with ＊marks by the lot in the catalogue】

are delivered to the buyer outside the ROC and are

handled by Kingsley for the relevant shipments. The

buyer shall notify Kingsley in written form within 7

business days following the auction day if he or she

desires to collect the items auctioned outside the

ROC.

5.CurrencyThe buyer is required to settle up in NT dollars. If paid

by other foreign currencies, we trade on the currency

of that wired transaction day for the first 7 business

days. If the payment is to be wired after 7 business

days and the currency rate is lower than that of

the bidding day, then we trade by the rate on the

bidding day.

6.Phone BidsSince the phone line service at the venue of auction

is limited, please contact us 48 hours prior to the

auction. Meanwhile, please fill in the absentee bid

form attached to the catalogue to specify the item

沙龍與法國沙龍的歷史糾葛

對歐洲人來説，空間是孕育文化思想的場所，尤其是沙龍 (Salon) 和咖啡廳 (Café)。沙龍，起源於文藝復興初期義大利，至十七世紀法國將沙龍文化發揮到極致。法國人更於1664年創造了「沙龍 (Salon) 」一詞。

沙龍，為上流社會和資產階級人士定期邀請文人、藝術家、思想家到家裡，互相討論文學、藝術、哲學或時事，激蕩出思想火花的聚會。如喬弗蘭夫人 (Marie Thérèse Rodet Geoffrin)，以及名聞法蘭西的彭芭杜夫人 (Madame de Pompadour, Jeanne Antoinette Poisson)，後者是路易十五的愛妾，雖然身處封建體制的牢籠，但她十分支持啓蒙思想，對於當時的思想家贊助有加。有別平常的住家空間，沙龍，對於歐洲文化、藝術、思想的發展貢獻是功不可沒，因此又被稱為「文明社會的搖籃」。

以欣賞藝術品而成立的沙龍，最早為1673年由法國皇家繪畫暨雕刻學院 (Académie Royale de Peinture et de Sculpture) 在羅浮宮的一個方型房間 (salon carré) 所舉辦的一個半公開的美術展。為此美術展所製作的圖錄更成為現今美術史家研究的重要史料，刊登於法國La gazettes雜誌上對於展覽的評論，更是讓美術評論家這個職業新興的契機。而這個官辦的美術展，到了法國大革命 (1789年) 之後，法國沙龍展的評審觀越發保守，印象派的畫家們的作品數度遭逢落選、越來越多作品也都遭審查拒絕。這些經常落選的藝術家們刻意舉辦對抗沙龍的落選展、印象派的畫家們也持續舉辦自己的展覽會鬧得沸沸揚揚，使得後來政府於1881年不再插手沙龍事務，而改以法國藝術家學會 (La Société des artistes français) 以巴黎沙龍 (Salon de Paris) 之名，繼續舉辦沙龍展覽會。

秋季沙龍展 (Salon d'Automne) 為一個每年在法國巴黎舉行的藝術展，1903年由比利時建築師弗朗茲・喬戴恩 (Frantz Jourdain) 與赫克托・吉馬爾 (Hector Guimard)，藝術家喬治斯・德思瓦利斯 (Georges Desvallières)、歐仁・卡里埃爾 (Eugène Carrière)、菲利克斯・瓦洛 (Félix Vallotton)、愛德華・維亞爾 (Édouard Vuillard) ，在室內設計工作室梅森・詹森 (Maison Jansen) 中成立。

其創立宗旨是為對抗官方的巴黎沙龍，後迅速成為20世紀創新且具成長力的繪畫、雕塑、建築與裝飾藝術展示的最佳地方。創立最初幾年，許多已成名的藝術家，如雷諾瓦 (Pierre-Auguste Renoir) 都支持這個新展覽，羅丹 (Auguste Rodin) 甚至也提供自己的幾件作品展示其中。這個秋季沙龍展也展出了許多如塞尚 (Paul Cézanne)、馬蒂斯 (Henri Matisse)、高更 (Paul Gauguin)、盧梭 (Georges Rouault) 等藝術家的作品，亦見証了野獸派 (Fauvism, 1905年) 的誕生、立體派 (Cubism, 1910年) 的發跡、1912年引發法國國會仇外和反現代主義的爭論。

秋季沙龍展自1903年至今，已有112年歷史，本次拍賣遴選出9位曾經於秋季沙龍參展的藝術家作品，法式細膩的色彩、超越學院派的新潮構圖思想，都可於這些作品中看見，期待獲得亞洲收藏家的喜愛。

野、竹林景色及農舍家畜為伍。自 1953 年台北

師範藝術科畢業後便返鄉任教，作育英才，退休

馮騰慶作品取材廣泛，用色濃重、沉著、厚實，

筆觸古拙，以印象派表現方式重視色彩與光影的

反射效果；構圖則採取由上而下的視覺特寫，拉

近欣賞者的距離，以朦朧的焦點，產生另一種自

由想像的美感世界，畫面耐人尋味。作品多次獲

得省展、教員美展、台北市美展特選。

的陳輝東，在 1988 年由教職退休之後專心於油畫創作。

畫風為寫實風格，題材為人像畫、風景畫到近年來喜好

的帆船系列，喜歡以藍紫色調作為背景烘托畫面營造氣

氛。在逐漸變化的題材中，深愛周遭風物人文之美的老

師，藉由繪畫來詮釋。此為陳輝東 1989 年油畫作品，

一個天氣晴朗微風徐徐的天，陽光普照，用明亮輕快的

筆觸色調描繪出港口帆船及漁船悠閒的步調，波光粼粼

的海面倒影出作者的心境澄澈，熱愛這片人文風景及土

地所深刻刻畫出漁港的純樸以及帆船優美的線條。

楊三郎年輕時就非常喜歡描繪大自然，並且熱愛到現場作畫，感受當場光影變化所產生的對應關係，在

一定時間內如實記錄美麗的風景。他一生畫過非常多的海景，尤其是台灣東北角海岸一帶的風景為主，

本作便是其中之一。大膽的筆觸搭配橘紅的光色處理，充滿力道的海面及岸石構圖搭配，結構穩固且動

態十足。他特別擅長表現海景的奔放宏偉，尤其是陽光照射下所造成的海面淋漓，更是劇力萬千。直到

「人來自土地，我們一邊要有自己的思想，一邊也要記住故鄉的土地。」—廖德政

1946 年剛從日本返回台灣的廖德政，掀開他藝術創作的首頁，開始書寫圍繞著表現台灣本土風情，幼嫩的花卉、圍籬內的雞仔、新鮮的台灣

果物等等，他與第一批台灣西洋畫家相同，都專注於表現台灣獨有的特質與顏色。而從他的作品可見其逐漸擺脫在日本習得的基礎繪畫方式，

那些原本理應注重的造型或畫面構圖都不再是第一思考順位，廖德政欲解析物象的本質、色調與畫面空間的整體關係。廖德政找到他的創作

中心：是亞熱帶台灣特殊的「綠」。這綠色將成為他往後創作生涯裡重要的顏色，他將其發揮地淋漓盡致。1970 年廖德政移居天母之後，不

論是靜物畫中窗外的遠山、亦或橫臥遠方的山脈風景，觀音山都以配角或主角的方式出現。

廖德政所畫的觀音山，藏著二二八情節，也有他喜好自然的研究的原因。觀音山八里一帶，聽說是父親在二二八事件期間，最後出現的地方，

看著遠方的觀音山令他思親情切。廖德政抽離現實中的建築物，畫出理想中的土地，師法賽尚 (Paul Cézanne, 1839-1906) 的理性空間結構；

選用波納爾 (Pierre Bonnard, 1867-1947) 的顏色；他與呂璞石以科學方式探討研究美學，大膽地安排出水份、空氣與光線互通聲息的構圖，也

探討一幅畫所能表現的「溫度」，他藉由色彩傳達溫度相對性的差異，企圖在風景作品中重現沒有過去、未來、慾望的理想世界，同時刻意在

畫裡表現一股身歷其境的真實感。

綜觀觀音山系列作品，只留大地風土，沒有人煙，沒有樓房，視線所及盡是一片茵茵翠綠，留在畫面的細膩筆觸，都可想見他緩慢地繪畫速度、

力求完美的修改，抽取印象中那純粹的綠意，讓其在畫面上重新呼吸。連續畫到第 30 個年頭，1999 年創作 2000 年完成的〈暮色孤影〉，所

繪的是黃昏之中，遠方的觀音山矗立在寧靜的海面上，薄暮中散發著自信的霞光，一隻覓鴞形單影隻地飛翔。廖德政在作品完成的前一年 (1999

年 ) 妻子去世後曾如此形容自己：「以後都是一隻鳥自己飛。」如同畫面中那隻覓鴞，以此寄託他倆極少言語，卻情意深濃的夫妻關係，胸中

積鬱如春蠶吐絲，緩慢而綿密地抒放於畫作。

1909 年出生於中國遼寧省，後遷居瀋陽，畢業於瀋陽遼

寧省立師範美術科。1948 年移居台灣，在台灣師大美術

系教授水彩畫，長達廿七年，與藍蔭鼎、李澤藩並列台

灣水彩三大家。與來台教授的日本水彩畫家石川欽一郎

看法相通。馬白水自學生時期便走出戶外寫生，所到之

處皆會留下水彩寫生作品，結合西洋水彩與中國水墨的

顏料與技法特色，表現個人獨特畫風，從寫生、寫景到

造景，水、墨、彩的運用變幻無窮。1959 年〈谷關〉色

塊較為破碎，完全無任何勾勒邊線，下筆即是風景的自

信清楚可於此方小天地感受。碎石河道夾著潺潺流水，

河道壁切面凌厲矗立兩旁，濕潤的鮮綠點出充滿生命力

的濃密綠蔭植被。

1979 年〈山水間〉所繪地點推測應該在花蓮

太魯閣步道附近。映著霞光的高聳峽壁佔據了

畫面四分之三，一片浮雲輕輕蕩漾期間，磅礡

氣勢與幽幽繚繞的對比，看得出馬白水在構圖

方面更上一層樓。運用深色墨線勾勒山壁，淺

色墨色暈染岩石肌理，剪影似的遠方還有綿延

而至的黃色岩石，細細涓流也巧妙地安排於左

下一角與飄移的白雲相呼應，於矗立的山壁亦

有一動一靜的對比之美。

席德進於 1923 年出生在四川嘉陵江上游一處風景幽雅的鄉村，同

性戀的身分並不影響他在台灣近代畫壇上的極大影響力。他受到

林風眠、馬蒂斯、畢卡索及歐洲的普普、歐普、硬邊主義的影響，

致使他融合了水墨、油畫、中國、西洋各種技法，開創出屬於自

己「雄強動魄」的畫風。1969 年席德進在台灣師範大學藝術系任

教授；1979 年前往香港會見林風眠，回台後出刊「改革中國畫的

先驅者—林風眠」；同年 7 月在電影「香火」中客串演出游擊隊

長的角色；1980 年 8 月因胰臟癌入榮總開刀；1981 年由攝影家

柯錫傑拍攝席德進人像，作為雄獅美術 124 期的封面人物；同年

5 月 27 日病情加重，動第二次手術；6 月歷史博物館主辦「席德

進畫展」，教育部特頒贈榮譽獎章；8 月 3 日病情惡化，於凌晨

病逝。歲月不斷的流逝，淘去的是載浮載沉的沙土，卻淘不去那

不可撼動的巨石。席德進的畫作，有如歷史長流中的巨石，在台

灣這塊土地上永遠屹立不搖，令後人無限景仰。

生於 1912 年，福建長樂人。是台灣推動現代藝術的先趨者及國際上肯認的世界級書畫家、版畫家、雕塑家，被藝壇譽稱為「十項全能

大師」、「國寶級大師」，以陸軍上尉軍官參與抗日戰爭。他來自書香官宦世家，祖父陳君耀是清朝進士，祖母是兩江總督暨開台功臣

沈葆楨的女兒，父親陳曰謀是保定軍校 1 期（與蔣中正同班）的黨國元老。8 歲時失聰，日後又漸漸失語。17 歲時因接觸到徐悲鴻的畫作，

決心走向現代藝術的創作。1938 年抗日戰爭爆發，1946 年來台，在台中和平日報任美術主編，他是八年抗戰時期「中華全國木刻協會」

唯一離開大陸來台的會員。1958 年與楊英風、秦松、江漢東等創立「現代版畫會」；1959 年起連續 5 年受邀參展巴西聖保羅雙年展；

1970 年獲韓國版畫雙年展首獎；1999 年受邀參加在西班牙、法國巡迴展的「20 世紀金屬雕塑大展」，展出包括法國雕塑大師塞薩、畢

卡索等人。同年法國藝術史學家「路易費里爾」編寫「20 世紀的藝術大師」一書，從 1900 年到 1999 年以編年史的方式敘寫，內容涵

蓋繪畫、建築、雕塑等範圍，每年介紹 10 位世界級大師，亞洲唯一被收錄者只有陳庭詩一人，從此奠定了他在世界藝術史上的地位。

他以旺盛的生命力和意志力，全心的投入版畫、水墨、書法、鐵雕、篆刻、壓克力畫、詩、詞、現代畫、收藏奇石等十項藝術均能風格獨到，

精妙絕倫。他在中國水墨中更能融入西畫的光影、色彩、畫技，有中西合璧的趣味，尤其他的甘蔗板版畫創造出獨一無二的崩裂效果，

呈現出「東方神秘哲學」的感覺無人能比，被藝壇譽稱為「十項全能大師」、「國寶級大師」。他最大的貢獻在於將西方的藝術觀念融

入中國的繪畫、版畫、雕塑中，又將抽象的手法表現於中國的藝術中，他是推動台灣藝術的先趨者，也是台灣 50 年代現代抽象畫的代表

人物之一。

光復前台灣著名畫家當中唯一的女性，亦是台灣美

術發展世上的第一位東洋女畫家。畢業於日本東京

女子美術學校，取材多自身邊女性人物、庭園植物

等。1927 年，以一年級的三件學期作品〈姿〉、〈罌

粟〉、〈朝〉參加第一屆台展東洋畫部，均獲入選，

並與林玉山、郭雪湖共獲「台展三少年」之美譽。

豔粉的花瓣集滿整個畫面，在翠綠的嫩葉陪襯下，

穩重的構圖方式隱隱保留〈玫瑰花〉的熠熠生氣。

投入繪畫一甲子，陳進筆下的身邊人物生活一景、

原住民、花鳥植物是最常入畫的題材，不同於西方

女性畫家已生活於風氣較開的世代，陳進默默耕耘

我將來要用我的熱忱在台灣再生活、再創造，我要使台灣不朽。那兒的陽光，土地的氣息，人的

精幹……凝固於我的畫上。像高更一樣，躲開了巴黎，而畫出了大溪地土人的原始誠樸。像梵谷一

樣躲開巴黎，而畫出南方的陽光和向日葵的生命。（1966.1.3 巴黎）──席德進

1948 年初到台灣的他，受到台灣亞熱帶蓊鬱的樹林、深野土地的氣息召喚，製作了一批水彩風景，

他也從學生的畫中發現「眼前的自然」，其實才是他更應去追尋的目標，他可以因為捕捉到一朵

浮雲，染著南台灣的溫暖色調而欣喜，覺得得到救贖。四年後 (1952 年 )，他決心做一位專業畫家，

便辭去教職北上台北，其中也接了一些為社會上的仕紳名媛繪製肖像的案子，這些畫像等於也記

錄了 1960 年代前後台灣富裕人家的品味與文化。

當時的台灣因為政治紛亂，藝術活動較不受到重視，但很快地在四年後，台灣掀起了一股推崇西

方現代繪畫的運動—「東方畫會」、「五月畫會」等各種新型畫會相繼成立，「傳統」與「西方

現代」的對立狂潮，隨著一次次密集的展覽而波瀾四起、聲勢浩大，而席德進也身在其中，1957

年他在台北「華美協進社」舉辦了第一次個展，展出抽象畫多幅之後，1959 年他又參加台北「現

代畫聯展」，此後他幾乎每年都舉辦個展或參加聯展，並同時在報章評論當時藝術普遍出現的「傳

統派」畫家作品千篇一律，讚揚「無名年輕畫家」夏陽、吳昊等努力新興繪畫創作，不盲從跟隨

馬諦斯、畢卡索，從中國繪畫裡發覺被人遺忘的中國珍貴古代藝術，此後積極展出及評論發表，

確立他在這波西化狂潮中扮演著中堅角色，而這些評論也可看出席德進對「傳統」的看重。

水彩在西方原是做為繪製油畫之前，習作時使用的媒材，因此本身並未受到重

視，直至 18 世紀由英國畫家將阿拉伯膠加白密汁、甘油調和水彩顏料，因而能

忠實呈現英國的陰雨天氣始逐漸普及於世。在台灣，水彩藉由日治時期在台成立

「台灣繪畫研究所」的石川欽一郎殷殷提倡水彩教育，學生倪蔣懷、藍蔭鼎、李

澤藩等人的優秀作品頻出，才逐漸於 1930 年代開始在台灣藝壇嶄露光芒。到了

席德進正式加入水彩創作的時候，已約 1960 年代中期，馬白水、劉其偉、張杰、

王藍等人紛紛加入水彩的領域，盛極一時的新興水彩畫家們為國內水彩畫壇帶來

許多啟發與刺激。

旅歐那段時間，席德進雖然在追求現代藝術的同時，仍守著對「傳統」的關懷，

作品裡始終看得出「傳統」台灣鄉土的元素；但時不時地，他仍對台灣自然感

到懷念，「我現在真想再回到台灣，重要那種靜靜地感受自然偉大的生活」、

「奇怪的是我在夜裡總是懷念著台灣，那些彩色的廟宇，總佔有了我的夢幻……

(1965.10.8 慕尼黑 )」。歸台之後，他認真思索如何將中國繪畫注入新生，一心

超越傳統、勇於創新，席德進用現代的眼睛去看山水，講求「寫生」的重要性。

他畫台灣風景、傳統廟宇、台灣花卉、鳥禽、台灣鄉土風情，都是台灣特有的主

題。他意識到：「假如我們不是那麼狹義地解釋水彩畫，我們何嘗不可以說中國

宋代的潑墨畫法不也是水彩畫嗎？所不同的，是中國畫以墨為主，以墨當色了

吧。」是故，他開始大量創作水彩作品，並開始習中國碑帖書法，使筆法更具

書法性的功力，建構繪畫創新的形式。他在紙上渲染，他用色分層豐富，時而留

下恰當的留白，時而留下勁挺的筆觸。20 年後他寫道：「對傳統國畫筆墨的尊

重，把國畫重新改回眼前現實的生活裡，並注入新鮮的血液。尋找新的題材、新

的構圖、新的意境。以水彩色感融合於水墨，使國畫的色彩更具有新鮮的活力。」

為他嘗試將水墨與水彩的結合，作了一個完美的總結。

相思情深時的你，是否也跟她一樣，如此地情感豐富、如此輕易地受

外在風景影響，多愁善感？在丁雄泉構築的花園裡，女人被花卉簇擁

著，鮮豔的顏料恣意潑灑在畫布上，將內心的喜樂轉換倒是覺得歡

愉，滿足純粹的感官世界。1929 年出生的丁雄泉，1946 年移居香港，

1952 年遠赴巴黎，1960 年移民紐約。早期畫風受野獸派、超現實主

義影響，中後期作品以豔麗的色彩及大膽的表現方式著稱，使用中國

式的書法線條與西洋的油蠟筆、壓克力油彩，在現代主流畫派之外走

出獨自的花卉、鸚鵡、馬兒、鳥兒、團扇簇擁的美人圖；丁雄泉在喜

愛女體之餘，也嘗試寫詩甚至出版詩集及畫冊，畫中不僅僅單有女體

滿溢的狂放地俗艷「色相」，亦漸漸飽含詩意的空靈氣息，透過採花

這期間的風景題材作品，可略見受到中國傳統水墨的影響，描繪群山環抱遼闊的〈港〉都繁忙景色，以黑色的勾邊線條框出進港停泊的船隻，

色彩有濃有淡，潑染出遠山與近海口的深度，切合其晚年在一次訪談中回憶道：「早年學習西畫，喜歡描繪窮苦人家、老人與小孩。自中國

返美之後，我發現美國藝術已然走向現代化之路，為迎頭趕上，於是，我透過閱讀書籍，致力使自己的畫風由傳統邁向現代。我認為中國畫

家用心靈作畫，西方畫家則用眼睛作畫。我最愛的中國畫家為石濤，因為他以獨特的方式表現了中國傳統。」清朝大家石濤主張「筆墨當隨

時代」；畫山水者應「脫胎於山川」、「搜盡奇峰打草稿」，進而「法自我立」。石濤的創新思維與當時亟思有所作為的陳蔭羆十分契合。

在他的數幅有海的風景作品中，皆深具如此脫胎於山川的流線筆法，帶有濃濃的思古情懷及文化鄉愁。縱使二次大戰後陳蔭羆的風格，逐漸

受到當時抽象表現主義畫派影響，他始終秉著自己華人的文化傳承，將書法漢字、金石刻文符號，結合媒材營造質感，創造出最膾炙人口亦

為其的代表作品「銘文系列」。這刻意的文化構成，一邊傾訴文化的力量，一邊凸顯文明的美感，亦是對中國文化與文明的緬懷歌頌。

蕭勤 1935 年出生於上海，1949 年隨國民政府遷台，在 1952 年北師時期與提倡現代繪畫的李仲生老師習畫，

開啟了他研究現代藝術的意向。雖是台灣經濟復甦的時期，但當時政治壓迫，知識青年往往於此時更具激發的

火種，特別是藝文方面，常常有更多的情感抒發與激盪。1955 年底蕭勤在台北與李元佳、歐陽文苑、吳昊、

夏陽、霍剛、陳道明、蕭明賢等人創辦中國第一個抽象團體「東方畫會」。

然而翌年因獲得西班牙政府獎學金，始赴西班牙留學，開啓了蕭勤特有的藝術旅程，歷經二戰渡台的經歷，蕭

勤在創作上有著更多的情感抒發，於西班牙馬德里及巴塞隆那的傳統美術教育已沒辦法滿足蕭勤內心追隨的內

心探究及精神自省，當時的蕭勤感到非常失望，毅然決然放棄於西班牙的獎助學金，以自己的方式探究合適自

己的藝術境界。

而此幅作品＜ MC-*3-61 ＞恰巧於蕭勤西班牙的學習旅程告一段落後，欲赴義大利展開新的藝術探險時期的創

作，屬於蕭勤技巧已純熟，思想剛爆發時的上品，後來旅居義大利時期，蕭勤也與志同道合的藝術家在米蘭發

起「龐圖運動」(Punto)，主張是傳達藝術作為靜觀和內省思想的，這當然是一個研究老莊思想的東方傳統創

作者於西方求學時急欲填補的內心空缺，那種迸發的澎湃情緒是很率真的展現，東方筆法及墨色的底藴氣質毫

不保留，而創作手法保留非形象藝術衝動直覺的方式，頓時，結合了，抽象繪畫無論於西方至東方，被蕭勤帶

到了另一個境界，「氣韻生動」這本專限於形容東方傳統書畫的至上讚美，可以完美的描述蕭勤的非形象藝術，

這是一種跨越具象圍籬的重要象徵，而這內在的訴求是力求精神、內觀、心靈的表現，又異於當時西方抽象藝

術的本質訴求。

1929 年李仲生進入廣州美專，爾後轉入上海美專繪畫研究所。此時的上海因為早已開放通商，擁有最新的西洋新知、

完備的學習系統，當時大學數量更居全國之冠。當時民初教育總長蔡元培發表〈以美育代宗教說〉、〈文化運動不

要忘了美育〉等文中亦傳達「文化進步的國民，既然實施科學教育，尤要普及美術教育。」在這樣思想開放的環境

下生長與學習的李仲生，參加了中國史上最早提倡現代藝術的團體「決瀾社」，初創成員有龎薰琹、關良、常玉等人，

與他們一同以自由地用新的技法來表現新時代的精神。

1932 年，李仲生赴日本學習院大學修習藝術，隔年加入日本前衛美術團體「東京前衛美術研究所」；1934 年於日本

前衛展覽室「二科會」展出；1935 年再加入日本前衛畫會「東京黑色洋畫會」，接觸到自動性技法理論、體悟到李

仲生有感於學校教育的侷限性，透過社會教育、社團展覽、評論與授課等方式拉進藝術與民眾的關係，來台定居後

更以實際行動推動台灣現代藝術。

1950 年發表〈中國畫與日本畫的問題〉，針對當時台及畫家與外省畫家之間存在的大陸國畫（仿古）及台灣國畫（仿

日）等意識形態作出論述；此時的他在政大與中山女中授課之餘，開班教授現代藝術，從發揚日本所學之「前衛技

法」，到以精神傳精神的方式，啟發學生的創造本能。許多年輕學子都受其啟蒙現代藝術之芽，例如後來成立「東

方畫會」的霍剛、蕭勤、夏陽、吳昊、陳道明、蕭明賢、劉芙美等人，李仲生對於台灣美術教育創作成就可謂是功

不可沒。

觀李仲生最大的的繪畫特色是純繪畫性，非文學的、非敘事性的、非主題性的，揉合佛洛伊德思想與抽象思想，富

於精神語言及心理語言，並發展出自己的現代前衛風格，可謂為「抽象的超現實主義」或「無形象的超現實派」。

1965 年出生於英國里茲，癡迷於保存動物肉體，泡於福馬林的肉體對他來說比精神更加永

恆。在 1992 年〈生者對死者無動於衷〉(The Physical Impossibility of Death in the mind

on Someone Living) 的張嘴進食的鯊魚一作，入圍透納獎、1995 年〈分離的母親與小孩〉

(Mother and Child Divided) 將母牛與小牛平均對分，分裝在四個裝滿福馬林的玻璃箱，以

30 歲的年輕之姿便贏得該年透納獎、藥丸系列代表 2007 年〈搖籃曲之春〉、蝴蝶系列、

鑽石骷髏系列、1986 年以仿 DNA 分子結構開始創作的各種圓點畫作，到 2014 年圓點米

老鼠的原點系列、旋轉畫系列…。

其中最膾炙人口的代表系列「蝴蝶」，也是表現生與死的主題；蝴蝶在東西方文化和宗教

上象徵永生與復活，在迸射噴發的鮮豔顏料上再拼貼蝴蝶標本，或單隻或多隻，或有組成

曼陀羅、萬花筒形，具有宗教意義的圖案象徵，同時反映人們對永生的盼望。赫斯特所強

調的：「我想，生存與死亡是隨時存在的，如同一場亮麗的展演一樣；我也清楚介於美麗

使者和採集者之間的關係，而我角色，便是一位藝術的採集者。」簡白地說明了其創作宗

旨。在這些美麗的蝴蝶標本所傳達美麗的表象之外，達米恩・赫斯特更會將這些價值不菲

的作品送給多家公益機構：兒童收容所、國際救援組織等，他更致力培養音樂人，支持贊

助 Joe Strummer 基金和青年兒童教育及比爾美林達基金會。

2000 年，現代泰特美術館開放作為這類現代作品的主要展地，2013 年倫敦奧運期間，泰

德現代美術館更為達米恩・赫斯特舉辦首次回顧展，原本保守的英國博物館體系因其而改

變！達米恩・赫斯特「凝固」(Freeze) 之始，改變了現代藝術教育和商業操作模式，鞏固

2008 年於荷蘭開辦巡迴回顧展以來、2009 年雪梨現代美術館、2011 年歐美回顧展、2012 年泰特現代美

術館 (Tate Modern) 、2013 年南美回顧展，經遊數十個國家完成 60 年創作經歷的回顧展，草間彌生很開

心這個她從小開始使用的符號—「圓點」，變成了通行世界的愛與和平的符號，去除那一絲反文化的解放

意涵下，如今幾乎完美地與文化工業結合。

稍微認識草間彌生創作的人都知道，她是因為有著精神官能症而見著每件事物都是滿溢著浮動的圓點，而

這也成為其日後創作的重要元素，其他固定組成元素還有網子、鋸齒等等。〈月〉一作以銀色為浩瀚銀河，

粉紅色的網線在小小的畫面裡交織，相對少了其他作品中瀰漫的圓點，僅有裝飾性地幾顆灑在網上，表現

宇宙無垠的空間裡充滿了許許多多未知的星體。

草間彌生，1929 年出生於日本長野縣，1975 年移居美國紐約後，開始前衛藝術的創作；從 1950 年代無

限重複的「網」開始、1960 年代「累積」系列的軟陽具以及開始以「環境雕塑家」自居，藉嬉皮文化重

返人性、進行多樣化生產，拍實驗影片、創立自己時尚品牌、1970 年代回到日本定居後的精神療養拼貼

系列與繪畫詩集、1980 年代的「觸鬚」般的陽具實驗性雕塑、1990 年代之後重新探索暗室及鏡屋的裝飾

藝術。草間彌生經常對媒體表示：「如果不是為了藝術，我很早就自殺了。」從早年的幽冥深邃的特質轉

為直率的藝術語言，作品蘊含強大的瘋狂能量，這種強大到能令她選擇活下來，傳達某種近乎堅強不可摧

毀的永恆能量。

單見他作品中的點、圓、線、方塊、三角形等一絲不苟的幾何構圖，可輕易地歸類為西方幾何抽象，又稱「冷

抽象」(Cold Abstract) ，但仔細觀看作品畫面卻充滿了手繪的角度、人造的溫度，和所謂的西方幾何抽象的

莊喆，這位長期致力於探討繪畫藝術、繪畫與抽象理論並同時關注且持續提升

自我的藝術家。內斂儒雅的他，1958 年自台灣師範大學美術系畢業，同年加入

「五月畫會」成為主要成員之一。自此以「現代繪畫」為出發點，展開漫漫創

作之旅。

70 年代之後漸漸演變為抽象山水的軸心，以書法的線條筆勢入畫，在運筆虛實

頓挫之間，自表象所示之山水形象，走向以內省為裡的心象山水，那種種剛柔、

陰陽、疏密、濃淡、乾枯、濕潤等特質，取自其崇拜的古人畫家：石濤、八大

山人、徐渭、陳洪綬，進而揮灑出隱喻了大自然界各種生命氣息，包括四季、

樹木、岩石、湖海、飛鳥、天光、雲彩、雲景、殘寂、人物…。

2000 年代之〈堤岸天光〉一作，屬較為晚期的創作，上下揮灑的筆觸與自然滴

流、潑濺的律動，在四方形的畫幅裡營造出可近可遠的虛幻空間，渾沌與飛揚

之中又展現氤氳、蒼潤之氣。莊喆對中國藝術精神，即是對「自然」的尊重，

在數十年旅居美國的生活環境下，移民融合的受創感、根深般的中華血緣，都

是推動其持續創作的源源動力。

1980 年代台北紫藤蘆茶館是聚集多位文人雅士的地方，當時常於紫藤蘆出沒的人現在也不

少成為國際知名的藝術家，包括鄭在東、陳來興、于彭等人都是，邱亞才也是其中之一，

但個性略顯孤僻的他，在紫藤蘆的活動都是獨來獨往，專注於自己的寫作工作以及創作思

考，而這個時代，每個路過的工人、路人、旅人都可能是他創作的對象。直到 1990 年代，

邱亞才的創作風格有了變化，出現了他典型的陰柔清秀的人物氣質，顏料運用也從厚重的

重疊肌理表現，慢慢轉為清澈薄塗的俐落表現，整體的風格更為穩定精準，氣質優雅，「鬥

牛士」正是此時期的作品，靜雅地人物氣質以簡單的色塊表現，乾淨整齊的髮型搭配高尚

的服裝，完全以漂亮的配色和真摯的線條構成，圓潤的臉龐是邱亞才此時期的創作特色之

一，一時間難以分辨畫中人物的性別，由於性格的關係，他刻意使用完全的側身處理畫面

構圖，沒有景深，展現出一種從旁觀察人物的氛圍，那種繪者與被繪者之間的關係僅僅停

留在凝視的階段，專注到出了神，卻淺嘗則止，沒有下個步驟，對邱亞才的創作來說，這

是一個美麗的交流所產生的結果，一種令時間都停滯的瞬間。

近年亞洲最受關注的藝術家，邱亞才必然是其中之一。根據國際知名網站 Artprice 的「2014

年當代藝術品市場報告」，以 1945 年以後出生的藝術家為界，邱亞才的作品的拍賣總成

交額於全球排名第 87 位，也是台灣最高名次的藝術家，並且持續攀升中。會如此受歡迎

的原因當然是那脫俗的繪畫氣質受人喜歡，且其愛戴者遍集全球，跨越了國界，是難得少

數的經典之一。

魏樂唐的繪畫深受漢磚及魏碑金石書法的影響，筆觸雄健、蒼勁，這與其自幼承襲門風，飽讀詩書有著極其

深遠的關係。在 1949 年因時局動盪，舉家遷至香港避難後才開始接觸西畫，亦開啟了他學習繪畫詩篇的第

一章。1956 年因緣際會遷居美國，當時美國抽象表現主義盛極一時，原本選擇科學報國之路的他，敵不過

內心對藝術創作的渴求，還另選修了美術創作學科，以工程師及繪畫創作雙重身份進修不懈。他從東方文化

的角度觀察抽象表現主義繪畫，發覺中國書法應是東西方藝術交會的切入點，因此他嫻熟運用自幼累積的書

法，研習經典古籍，將中國書法中以書寫的方式表現繪畫力為主，汲取西方當代使用色彩的妙義為輔；勁巧

地將黑色筆掃過畫面，自然生成暈染或滴流的特色以及留白的抽象空間，展現不同於西方使用油彩繪畫的精

此為楊識宏在 1990-1993 年的《草葉集》系列，植物美學時期的作品之一，結合具象與抽象，畫中透過植物枝葉的

姚瑞中，臺灣知名現代藝術家，從事多種媒材的藝術創作。

1994 年國立藝術學院（現為國立台北藝術大學）美術系畢業，

曾代表台灣參加 1997 年威尼斯雙年展、2005 年橫濱三年展、

2009 年亞太三年展、2010 年台北雙年展聯動計劃、2012 上

海雙年展，海內外聯展百餘次。

姚瑞中此次所臨摹的古畫作品，取材自明末清初著名畫家，

金陵八大家之一的龔賢；身處明、清改朝換代之際的龔賢，

其繪畫具有強烈的遺民意識。此幅大型山水畫作品，形式上

採取了古人的山水構圖，搭配特殊的印度手工紙代替宣紙、

以貼金箔取代留白、拋棄傳統水墨的筆墨紙硯和筆法、提款、

印章等樣式規範，轉而替換為西式油性針筆，並以耗時費工

有如「春蠶吐絲」綿密的硬筆法臨摹，透過挪用與改寫，以

此混搭形式表現對正統性的顛覆。

觀看李小鏡的作品，讓人感受最深的是人與獸之間的關聯性。八十年代起他將攝影技術轉移用在

藝術創作的領域裡；九十年代興起的數位科技使他得以將繪畫、攝影與創作等經驗整合為一種獨

特的媒材，是少數能同時横跨商業及攝影，並在國際上受到肯定的藝術家。此件拍品為《成果》

系列的〈慶典〉(Celebration)，從畫面來看，李小鏡創造了一個奇幻世界，例如小白豬跳舞、小

貓拉提琴，而這些擬人化的家禽化身為具有表演天分的動物，而且具有人類思考的行為模式。從

這個角度來看，《成果》系列作品不僅表達一種節慶歡愉的意象，實際上李小鏡也從醫學觀點表

達出他想像中，未來人類與動物器官相互共存的關係裡可能會有新的模式產生。

自小對繪畫有興趣，在求學過程中已參加不少比賽。少時曾向台灣前輩水彩大師林順雄學習水彩，

而後遠赴西班牙美術學院學習。劉漢文的作品，細膩的寫實手法繪畫出的創作，擁有真實肌理物

件欺騙了眼睛，更利用水彩可暈染的特性，鋪造出幻境般具有設計感的背景，讓畫更有故事性。

此三件作品屬於「保佑系列」，以台灣傳統廟宇、石獅為題材，展現濃濃鄉土人情味。

The following provisions are entered into by and between Kingsley Art Auctions (hereinafter referred to collectively as "the Company" ), as the auctioneer, and the Seller (hereinafter the "Seller"). The Agreement is also entered into by and between the Company as the agent of the Seller and the Buyer (hereinafter the "Buyers"). Both the Buyer and the Seller shall review and accept all provisions hereunder.

AgentThe Company, as the auctioning party, shall act as the agent of the Seller. Except otherwise provided, items successfully sold in the action held by the Company shall be bound by the agreement made by and between the Seller, through the agency of the Company, and the Buyer.

Before the auctiona.Authentication

We s t rongly recommend that the prospective buyers conduct their own authentication for the items they are interested in bidding prior to the action. We provide no guarantees to the buyer (with the exception of the guarantee with regard to counterfeits as defined of the Agreement).

b.Catalogue ExplanationsAny statement of the author, history, date, year, size, material, ownership, authent ic i ty , o r ig in , cond i t ion of preservation or estimated selling price of any of the Lots shown in the catalogue or the authentication opinion made by the Company, or any other verbal or written statements made separately shall be solely statements of opinions and shall not be deemed the basis for the statements of actual fact. The photographs shown in the catalogue shal l serve as reference only and shall not be deemed as the basis for determining the color or tone of any Lot or disclosure of the defects of such item. The estimated of the auction price shall not be deemed the price at which such item will be successfully sold or the statement of the value of the item for other purposes. Many auction items fail to maintain their perfect condition because of time and other environmental factors. Some of the explanations in the catalogue or the authentication opinions will state defects and/or the repair background of the Lots. Such information is meant for reference only. Missing information in the statements does not mean the Lot has no defects or has not been repaired any statement of the one particular defect does not mean there is no any other defect.

c.Responsibility of the BuyerThe Buyer is responsible for clarifying and satisfying himself about the condition of the items and any related matters stated in the catalogue descriptions.

During the auctiona.Refusal of admission

The company has the right, at our own

discretion, to refuse admission to the premises or participation in any auction and to reject any bid.

b.Registration before biddingA prospective buyer must fill in and sign the registration forms prior to the bidding and provide personal identification. Prospective buyers should also note that the Company may be requested to conduct credit checks against buyers.

c.The bidder is the BuyerUnless a written agreement has been made upon registration that the bidder will be the agent who acts on behalf of a third person and such third person is accepted by the Company, the bidder will be deemed as the Buyer who will bear individual legal responsibilities.

d.Absentee bidsThe Company will make proper effort to bid for the prospective buyers who instruct us to bid on their behalf by using the forms attached to the catalogue. Written bids form should be delivered to the Company prior to the auction. If we receive written bids on a particular lot for identical amounts, and the auction these are the highest bids on the lot, it will be sold to the person whose written b id was rece ived and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with it.

e.Telephone bids

The Company will make proper efforts to contact the bidder to participate in the auction by phone. The prospective buyer should request such arrangements prior to the auction. However, the Company will bear no responsibilities to the Seller or any prospective buyer if no contact is making under any circumstances.

f.Currency converterThe currency converter will be utilized at the auction. Errors may occur in the operation of the currency converter and we do not accept liability to bidders who follow the currency converter rather than the actual bidding in the saleroom.

g.Video or digital imagesThe image projection will be made at the auctions; however, errors may occur during the operation. The company is not liable for the color accuracy of the reproduced image and whether the projected image corresponds to the item being auctioned.

h.Auctioneer's discretion

The auctioneer reserve the absolute

right to reject any bid, push for bids at his own discretion, withdraw any auction items, separate or combine two or more auction items, and if there is any error or dispute, re-auction the items.

i.Successful bidsUnder the discretion of the auctioneer, the highest bidder accepted by the auct ioneer wi l l be the buyer and the striking of his hammer means the acceptance of the highest bid and the conclusion of a contract for sale between the seller and the buyer.

After the auctiona.The service fee of each lot payable by

the Buyer (Modern and Contemporary Art)

(1) The Buyer should pay the h a m m e r p r i c e a n d , i n addition, the service fee to the Company. For hammer price below NT$16,000,000 (inclusive), the service fee should be calculated at 20% of the hammer price.

(2) For hammer pr ice h igher than NT$16,000,000 the first NT$16,000,000 should be calculated at 18% and the rest of the amount should be 12%.

b.Taxes

All the payments payable by the Buyer to the Company do not include any commodity or service taxes or any other value added taxes (whether imposed by the R.O.C. government or elsewhere). The Buyer shall be responsible for paying any applicable taxes as required by the law.

c. Payment

(1)All payments due (including the hammer price, buyer's premium and any applicable taxes) shall be paid within 7 days after the auction.

(2) I f the Buyer fa i l s to pay to the Company all the payments due, the Buyer will not acquire the ownership of the Lot even if the Company has delivered such item to the Buyer. If the payment is made other than NT dollars, the buyer shall pay the related expense incurred, including bank charges and foreign exchange service fees.

until all payments to the Company are made in full. The Lot will be covered by the insurance of the Company from the auction date for 7 days during the temporary holding period. The insurance coverage will terminate upon collection of such item. The Buyer should be responsible for all risks following expiration of the said 7-day period or the collection (whichever is the earlier). The Company will provide shipping company upon the buyer's request and do not accept any liability if any damage occurred by the shipping company.

e.Remedies for non-payment or non-collection of purchases of purchasesThe Company is entitled to exercise one or more of the following rights or remedies if the Buyer fails to make payment within 7 days.(1)An interest at the monthly rate of

no higher than 4% plus the base interest rate will be imposed on all of the payment due if payment is not made within 7 days following the auction date. The payment to be made by the Buyer should offset any payment owed by the Company or its subsidiaries to the Buyer for any other transactions.

(2)The Company reserves the right to refuse the Buyer to make on behalf of others, bids in any future auctions and/or to require a deposit from the Buyer before accepting any future bids made by the Buyer. If the Buyer fails to make payment within 35 days, the Company is entitled to exercise the following rights in addition to the aforementioned.

(3)To take legal action to the Buyer on behalf of the Seller to claim the entire payment due and the legal fees resulting from such legal action based on a total claim.

(4)To cancel the transaction of Lots bid by the Buyer or any other auction items sold to the Buyer at the same or any other auctions.

(5)To arrange a public or private re-sale of the Lot. If the reselling price is lower than the payment, the differences and other expenses incurred shall be responsible by the Buyer.

f.No collection of the purchasesThe Company wi l l arrange for the storage of the Lot if such item sold is not collected within 7 days of the item, regardless payment is made or not. Such storage cost will be borne by the Buyer.

g.Export permitU n l e s s o t h e r w i s e a g r e e d b y t h e Company in written, the process of applying the export permit does not affect the Buyer's responsibility to make the payments within 7 days. If the Buyer requests the company to apply the export permit on his or her behalf, the Company is entit led to charge the related expenses.

The legal responsibility of the CompanyThe company is responsible for returning payment to the Buyer pursuant to Article 6. otherwise, whether the Buyer, the Company, any employees or agents of the company will not be held liable for any statements of the author, history, date, year, ownership, authenticity or origin of any auction item or any errors with respect to any explanations and any flaws or defects of any auction item. The Buyer, the Company makes no guarantee with respect to any auction items. Any warrantee of any k ind shal l not be included herein.

Return of payments for forgeryIf the Lot is considered as a forgery by the Buyer, the Buyer should inform the Company in written notice within 14 days. The written comment should under the following condition and the transaction will be cancelled and payments made will be returned to the Buyer. It is unnecessary for the Company to pay the Buyer an amount more than what the Buyer pays in connection with the Lot and the Buyer does not reserve the right to claim interests under any circumstances.

a.The written report should be provided by two individual experts and agreed by the Company.

b.The Buyer must return the Lot to the Company within the following 21 days and the condition of the item must be the same as on the auction day.

c.The Buyer has absolute right to the Lot and the Lot is free from the third party rights of claims.

d.The Company will refund to the Buyer any amount paid to the Company after receiving the amount returned by the Seller.

The agentThe Company acts as the agent of the Seller at a public auction. The Closing Agreement of the Lot is the agreement by and between the Buyer and the Seller.

Expensesa.The Seller shall bear costs including

packing, shipping, storage, insurance, catalogue, framing, mounting, repair, and tax.

b.If the auction succeeds or a private deal is done, the company will deduct from the hammer price at a regulated rate as the commission and expenses.

Insurancea.The company will collect 1% of the

hammer price from the Seller or 1% of the reserve price if the Lot is not

successfully auctioned. If the shipping i s ar ranged by the company, an additional amount will be collected by the Company, an additional amount will be collected by the Company from the Seller as the shipping insurance. Such amount varies depending on the individual condition of each auction item. The company will refer a freight forwarder if necessary. However, the Company is not responsible for any legal responsibilities incurred therefrom.

b.The Lots will remain insured up to 7 days after the sale. If the Lot has not been sold, it will be at the Seller's risk upon the expiry of 7 days.

c.We are unable to accept responsibility for damage caused by woodworm or changes in atmospheric conditions or weather.

Insurance purchased by the SellerI f t h e S e l l e r i n f o r m t h e C o m p a n y specif ical ly that it is unnecessary to purchase insurance for the Lot, the risks shall be borne entirely by the Seller until the Buyer makes all the payments. The Seller must indemnify the Company, the employees and agents of the Company and the Buyer (if applicable) any claims in connection with the auction against the Company, the employees and agents of the Company and the Buyer, regardless of the cause of such claim.

Commitments made by the Seller with respect to the Lota.The Seller is the only owner of the Lot

and has the unlimited right to assign his ownership to the Buyer which should not concern any third party right or claim (including copyright claims).

b. The Seller complies with all the laws in connection with the import and export of auction items and any other laws and has notified the Company in writing any failure to comply with such rules in the past.

c. The Seller has notified the Company in writing of any major modifications in the Lot to the best of his knowledge and any concern the third party has raised with respect to the ownership of the Lot and the condition.

d. In the event of any inaccuracy of the above mentioned, the Sel ler must guarantee, if requested, to identify fully the Company and/or the Buyer all the claims, costs and expenses arising here from, whether caused by the Lot or the auction proceeds.

opin ion and whether to combine or separate the Lots. The Company reserves the right to withdraw the lot without obtaining the consent of the Seller.

b. If the Company or the Seller withdraws the Lot, the Company may charge 10% of the Reserve set by the Seller.

Auction RulesThe Company wi l l auct ion the i tem according to the Reserve. The Reserve may not be higher than the minimum of the estimates set in the catalogue. The Company is entitled to auction the item at a price lower than the Reserve, If the lot is sold according to the above principle, the Company is responsible to pay the Seller the difference between the closing price and the Reserve.

After the successful auctiona. Settlement

After the payment is made by the Buyer, unless the Company receives a notice claiming such auction item is a forgery (as defined in the Agreement), the Company will pay the Seller within 45 days following the successful auction day an amount equal to the closing price taking away all the expenses payable by the Seller. If the Buyer delays the payment, the Company will pay the Seller within 7 days following the payment by the Buyer. If for any reason The Company pays the Seller before the Buyer makes the payment, the Company acquires the full ownership of the item. However, if the Company is forced to reclaim the Lot from the Buyer because such item is a counterfeit, the Seller must return the auction proceeds to the Company.Unless otherwise instructed by the Seller in writ ing, the Company wil l make its payment in NT dollars. If the Seller requests to pay in currencies other than NT dollars, the Company will collect from the Seller any foreign exchange expenses arising therefrom.

b. Non-payment by the Buyer

I f the Buyer fa i l s to make a l l the payments due within 35 days following the auct ion day, the Company i s entitled to negotiate special terms in connection with the payments, storage, and insurance on behalf of the Seller and act deemed necessary by the Company to collect payments payable from the Buyer. However, the Company is not responsibility for making remittance to the Seller nor for bringing any legal actions on behalf of the Seller. The Company will discuss with the Seller to adopt appropriate actions to claim auction payments from the Buyer.

c. Forgery

If the Buyer convinces the Company

that the Lot is a forgery (as defined in the Agreement) within 14 days following the auction day, then (1) If the Buyer has not paid all or part of the payment, the Company is entitled to call off the transaction and/or (2) If the Company at that time has paid all or part of the payments payable to the Seller, the Seller must return all of the payments made to the Company if requested. The Company will exercise lien for the latter. Any items belonging to the Seller under control of the Company will be kept as security of the payments to be returned.

d. Unsuccessfully auctioned items

Any item not auctioned successfully, not included in the auction or withdrawn from the auction for any reason must be collected by the Seller within 35 days upon notification by the Company to the Seller. The storage fee of NT$300 per day will be charged on each item not collected after such 35 day period together with an additional charge for purchasing insurance coverage. The Company may dispose the Lot if such item is not collected within 90 days following the auction date or the notice date (whichever is the earlier). Such disposal includes removing the item to a third party warehouse with the associated expenses borne by the Seller and to auction such items under terms deemed appropriate by the Company (including the terms of estimates and the Reserve). The Company will pay the Seller the related expense after payments owed are offset.The Company is authorized to act as the sole agent of the Seller within 30 days following the auction for any auction item with-drawn from the auction or not sold. The Company may auction in private the item based on the net amount the Seller may receive (the amount after deducting all the expenses payable by the Seller) or sell such item in private at a lower price agreed upon by the Company and the Seller. Under such circumstances, the Seller's responsibilities and liabilities to the Company are the same as during an auction.

Photographs and displayThe Company owns non-exclusive rights to the photographs, recordings and other reproduced images of the Lot. All the rights of such images shall belong to the Company and the company is entitled to use such images in any manner it deems appropriate.

TaxThe payment payable by the Seller to the Company dose not include any commodity or service tax or any other value added tax (whether imposed in the Taiwan or elsewhere) The Buyer should be responsible for paying such taxes pursuant

to the tax rates and time provided by the law if there is any such applicable tax.

If the Company is commissioned by the Seller to auction in Taiwan, the Company must pay the income tax for the Seller pursuant to the R.O.C. laws.

CopyrightT h e c o p y r i g h t o f a l l t h e i m a g e s , photographs and written material in connection with the Lot belong to the Company at any time. The Buyer or any person may not use such items without obtaining prior written consent from the Company.

NoticesAll the notices distributed according to the Transaction Agreement herein shall be made in writing. Any notice shall be deemed served to the recipient on the second day following delivery if sent by mail. If the recipient is abroad, the notice shall be deemed as received on the fifth working day following delivery by mall.

SeverabilityIf any part of the Transaction Agreement is deemed invalid, illegal or unenforceable by any court, such part can be ignored and the rest of the Transaction Agreement continues to be valid and enforceable to the maximum extent permitted by the law.

JurisdictionT h e T r a n s a c t i o n A g r e e m e n t a r e governed under the R.O.C. law and the interpretation and effect of the Rules shall be subject to the R.O.C. laws. The Buyer and Seller shall submit themselves to the exclusive jurisdiction of the Taiwanese court for the interests of the Company. (Any discrepancy between the Chinese and English version of this terms and Conditions of Business, the Chinese version shall prevail.)

Ⅲ. Terms applicable to both the

Buyer and the Seller

本規則，為本公司作為拍賣公司與賣家訂立合約，亦為賣家之代理人與買家訂立合約之條款。

買家及賣家請務必細讀，並同意下列條款規定。

一、代理人

金仕發拍賣有限公司(以下稱本公司)作

賣家代理人，除另行協定外，在本公司

之拍賣中成功拍賣之物品，即產生賣家

通過本公司之代理與買家達成之合約。

二、拍賣前

1. 鑑定物品

本公司鄭重建議，準買家應於拍賣進

行之前親自鑑定有興趣競投之物品。

本公司除就膺品(如本拍賣交易條款

所界定者)作出之證明外，不對買家

作任何保證。而拍賣品以其拍賣時

「現狀」出售。

2. 目錄說明

本公司於目錄對任何拍賣品之作者、

來歷、日期、年代、尺寸、材質、歸

屬、真實性、出處、保存狀況或估計

售價之陳述，或另行對此等方面之口

頭或書面陳述，均僅屬意見之陳述，

不應依據為確實事實之陳述。目錄

圖示亦僅作為指引參考，不應作為任

何拍賣項目之依據，藉以決定其顏色

或色調，或揭示其缺陷。拍賣價格之

估計，不應為拍賣品會成功拍賣價格

之依據或拍賣品作其他用途之價值陳

述。

許多拍賣品基於其年代或性質，使其

未能有完美之狀況，目錄內有些說明

或鑑定意見書會提述拍賣品之損壞及

/或修整資料。此等資料僅作為指引

參考，如未有提述此等資料，亦不表

示拍賣品並無缺陷或修整，如已提述

特定缺陷，亦不表示並無其他缺陷。

3. 買家之責任

有關物品狀況及目錄說明所提述事

項，買家需於拍賣前充分詳閱，並確

認自身對於該物品感到滿意。

三、拍賣時

1. 拒絕入場

本公司具有絕對之決定權拒絕任何人

士進入拍賣場地、參與拍賣，亦可拒

絕接受任何競投。

2. 競投之前作出登記

準買家在作出競投前，必須填妥及簽

署登記表格，並提供身分證明。本公

司通常會要求對買家作出信用核查。

3. 競投者為買家

除非登記時已書面協定，競投者將為

代第三人行事之代理人，而該第三人

為本公司所接受者，否則競投者將被

視為買家而須承擔個人法律責任。

4. 委託競投

競標前收到書面競標，本公司將盡適

當努力代其競投。如本公司就某一拍

賣品而收到多個委託競投之相等競投

價，而在拍賣時此等競投價乃該拍賣

品之最高競投價，則該拍賣品會歸其

委託競投最先送抵本公司之人，除

非在競投時有其他委託，此項書面競

投的執行是本公司的免費服務。本公

司不會對因未能執行之書面競投，或

在當中出現任何錯誤或遺漏負任何責

任。

5. 電話競投

如準買家於拍賣前與本公司做好安

排，本公司將盡適當努力聯絡競投

者，使其能以電話參與競投，但在任

何情況下，如未能聯絡，本公司對賣

家或任何準買家均不負任何責任。

6. 貨幣兌換顯示板

拍賣會上，如有使用貨幣兌換顯示

板，該貨幣兌換顯示板在操作時難免

會出現錯誤。買家因依賴貨幣兌換顯

示板(而非拍賣場的實際競投)而蒙受

之任何損失，本公司概不負責。

7. 錄映影像

拍賣中如有影像投射，有關操作上的

失誤或影像素質參差不齊之情況，本

公司不負任何責任。

8. 拍賣官之決定權

拍賣官具有絕對決定權，亦即有權拒

絕任何競投、以其決定之方式推動出

價、將任何兩件或多件拍賣推動出

價、將任何拍賣品撤回或分批、將任

何兩件或多件拍賣品合併，如遇有誤

差爭議，將拍賣品重新拍賣。如在拍

賣後有任何爭議，將會以本公司的拍

賣紀錄為依據。

9. 成功競投

在拍賣官之決定權下，下槌即顯示對

最高競投價之接受，亦即賣家與買家

之成功拍賣合約之訂立。

四、拍賣後

1.買家支付每件拍品之服務費率

（現代與當代藝術）

(a)買家除支付落槌價外，另須支付服務費予本公司，落槌價於

新台幣壹仟六佰萬元以下者含

壹仟六佰萬元以20%計算。(b)落槌價超過新台幣壹仟六佰萬元之部份以12%計算。

2.稅項

買家支付本公司之所有款項均不包括

任何貨物稅、服務稅或其他增值稅。

如有任何相關稅項產生，買家須負責

按有關法律所規定之稅率及時間繳付

稅款。

3.付款

(a)買方需於拍賣日期後七天內悉數

支付所有交易款項(包含落槌價、

拍價支付之酬金，以及任何適用

之增值稅)。

(b)買家如未向本公司支付所應付之

拍賣規則

全部款項，則不能取得拍賣品之所

有權，即使本公司已將拍賣品交付

予買家亦然。如支付予本公司之款

項為新台幣以外之貨幣，本公司將

向買家收取所產生之匯差及規費。

4. 包裝及搬運

七天期滿後代介紹承運人或自領取

時，拍賣品風險全由買家承擔，且不

負任何法律責任。

5. 不付款或未領取之已購拍賣品補救辦

法

如買家未在七天內付款，本公司即有

權行使下述一項或多項權利或補救辦

法。

(a)在拍賣日期後超過七天仍未付款，

以年利率百分之四收取整筆現款利

息。

(b)在將來的任何拍賣中，有權拒絕買

家或由他人代其所作出之競投，或

在接受其任何競投前先收取買家保

證金。如買家未在三十五天內付

款，本公司除上述者外，另有權採

取下列措施。

(c)代賣家針對買家進行法律程序，索

回整筆款項，另買家須負擔因而產

生之法律訴訟費用。

(d)取消同一次或任何其他拍賣中買家

競投得之拍賣品或任何其他售予買

家之拍賣品之交易。

(e)安排將拍賣品公開或私下重售，如

重售所得價格較低，其差額連同因

買家未有付款而引致之任何費用一

併向買家索償。

6. 未領取已購之拍賣品

如已購得之拍賣品未能在成功拍賣七

天內領取，不論是否已付款，本公司

將安排貯存事宜，費用由買家承擔。

7. 出口許可證

(a)除本公司另有書面同意外，買家希

望申請出口許可證，並不影響買家

在七天內付款之責任，亦不影響本

公司對延遲付款收取利息之權利。

(b)如買家要求本公司代為申請出口許

可證，本公司有權收取增值稅與其

他相關費用。

(c)如買家無論是否需要出口許可證之

事實而作出付款，本公司並無責任

退還買家因此產生之利息與其他已

產生之費用。

五、本公司之法律責任

本公司有責任在本交易條款第六條所列之

情況退還予買家。除此之外，不論賣家或

本公司，或本公司任何僱員或代理人，對

任何拍賣品之作者、來歷、日期、年代、

歸屬、真實性或出處之陳述，或任何其他

說明之誤差，任何拍賣品之任何毛病或缺

陷，均不負有任何責任。買家、本公司、

本公司之僱員或代理人，均無法就任何拍

賣品作出任何保證，任何種類之擔保，均

不包含在本條款之內。

六、膺品處理

買方如認定拍賣品係為膺品，需於拍定售

出日起十四個工作天內，以書面通知本公

司，且須符合下列條件，始得取消交易，

並將其支付本公司之款項無息退回，並不

得請求其他賠償。

(a)由二位獨立專家提出書面說明，並

經本公司認可。

(b)買家應於拍定售出日起二十一個工

作天內，將購得之拍賣品退回本公

司，且本公司收到該拍賣品時，該

拍賣品之狀況需與拍賣當日相同。

(c)買家對該拍賣品擁有絕對所有權，

並未在該拍賣品上設定任何債權。

(d)賣家需繳回相關費用後，本公司始

得退還買家。

一、代理人

金仕發拍賣有限公司(以下稱本公司)作為

賣家代理人，賣家拍賣品的成交合約，則

為買家與賣家之間的合約。

二、費用

1. 賣家須支付拍賣相關費用，費用項目

包括拍賣品之包裝、運送、儲存、目

錄製作、裝框裱褙、鑑定、整修與關

稅及任內市場推廣費用等。

2. 拍出者，本公司自「拍定價」中扣除

依「合約」計算之佣金，因未能拍出

而私下議價者亦同。

三、保險

1. 本公司將向賣家收取委託底價之百分

之一作為保險費。如由本公司安排運

送，本公司將向賣家收取額外款項，

作為運送保險費，費用視每宗拍賣品

之特定情況而定。在賣家的要求下，

本公司可提供承運廠商資訊予賣家，

惟本公司不承擔任何有關方面之法律

責任。

2. 拍賣品在拍賣後七天內保險仍然有

效。如拍賣品未能成功拍賣，逾期後

風險由賣家承擔。

3.因蛀蟲、空氣或氣候轉變對拍賣品造成

之損壞，本公司概不承擔法律責任。

四、賣家購買保險

如賣家特別指示本公司毋須為拍賣品購買

保險，風險全由賣家承擔，直至買家付清

款項為止。賣家須保障本公司、本公司之

僱員與代理人，以及買家索償之賠償責

任，而不論索償產生之任何原因。

五、賣家就拍賣品所作之承諾

1. 賣家為拍賣品之唯一物主，具備將所

有權轉讓予買家之無限制權利，並與

一切第三人權利或索價(包括版權索償)

無涉。

2. 賣家已遵守一切與拍賣品之進出口有

關之法律或其他方面之規定，並已將

過去任何第三人未能遵守此等規定以

書面通知本公司。

3. 賣家將其所知之有關拍賣品任何重大

修改以及第三人就拍賣品之所有權、

狀況或歸屬以書面通知本公司。

4. 如上述1-3項有任何不確實之處，賣家

須應要求保證完全償還本公司及/或買

家一切因之而引起之索償、費用之或

開支，而不論是因拍賣品還是因拍賣

收益而引起。

六、拍賣安排

1. 本公司對目錄內拍賣品之描述與圖示

方式、鑑定意見書、拍賣地與方式、

進場參與競投者與競投價之接受、專

家意見的尋求，以及物品合併或分開

拍賣等均有完全之決定權，本公司在

未徵得賣方同意下有權撤回拍賣品。

2. 賣方於圖錄完成後不得撤回拍賣品，

圖錄未製作前經本公司同意賣家撤回

拍賣品，本公司得收取賣家委託底價

百分之十之費用。

七、拍賣守則

本公司將會參照底價將拍賣品拍賣。底價

不得高於目錄所印估價之下限。但本公司

有權將拍賣品以低於底價拍賣。如本公司

如此將拍賣品拍賣，本公司將有責任向賣

家支付成交價與底價之差額。

八、成功拍賣後

1. 結算

在買家付款後，除非本公司收到通知

該拍賣品為膺品﹝如本拍賣規則界定

者﹞，本公司會於成功拍賣日期後

四十五天，將成交價扣除賣家應支付

所有費用之款項支付賣家。如遇買家

延遲付款，本公司將在買家付款後七

天內支付賣家。如因任何理由而使本

公司在買家付款前即已付款予賣家，

本公司即獲得拍賣品完整之擁有權與

所有權。惟本公司因拍賣品為品的

情況下，賣家方須將已收取之拍賣款

項退還予本公司。

除與賣家事前書面協定外，本公司以

新台幣付款。如賣家要求以新台幣以

外之貨幣付款，本公司將向賣家收取

所產生之任何外匯費用。

2. 買家不付款

如買家在拍賣日期後三十五天內未支

付應付之全部款項，本公司即有權代

賣家就付款、貯存與保險而協定特別

條款，採取本公司認為需要的法律行

動向買家收取應付之款項。惟本公司

並無責任支付賣家款項，亦無責任代

賣家採取任何法律行動。本公司將與

賣家討論採取適當行動以向買家索回

拍賣款額。

3. 膺品

如在拍賣日期後十日內，經買家提出

證明並經本公司認同該拍賣品為膺品

﹝本拍賣規則界定者﹞，則﹝1﹞如買

家尚未支應付之全部款項，本公司有

權取消交易；及/或﹝2﹞如本公司屆

時已支付賣家全部或部份應付款項，

賣家須應要求將該款項悉數退還本公

司。在後一情況下，本公司將行使留

置權，有權留置屬於賣家之任何物品

以作為應退還款項之擔保品。

4. 未能成功拍賣之拍賣品

任何拍賣品如未能成功拍賣，或不包

括在拍賣之內，或因任何理由而徹回

拍賣，在本公司發出通知，要求賣家

領回拍賣品之三十天內，賣家必須領

回拍賣品。任何此等拍賣品如在三十

天過期後仍未領回，每天每件將徵收

貯存費新台幣伍百元整，並加收貯存

期間產生之保險費用。任何此等拍賣

品如在拍賣日期後或上述通知日期後

九十天內﹝以較早日期為準﹞未被領

回，本公司可決定是否將該拍賣品進

行處置。處置包括將拍賣品移往第三

人之貨倉，開支費由賣家承擔，與將

該拍賣品按本公司認為適當之條款

﹝包括有關估計與底價之條款﹞公開

拍賣。本公司其後將拍賣所得扣除所

有相關費用後支付予賣家。

任何拍賣品如在拍賣中收回或未能成

功拍賣，本公司獲授權在拍賣後的

三十天內作為賣家之獨家代理人，按

賣家可收取之淨款額﹝即扣除賣家應

付之一切費用後之款額﹞，私下出售

拍賣品，或按本公司與賣家另行同意

之較低價格私下出售。在此情況下，

賣家就該拍賣品而對本公司所負有之

責任，與拍賣品成功拍賣時相同。

九、圖片與圖示

本公司對拍賣品之圖示、錄影或將拍賣品

複製影像具有非排他性之權利。此等影像

一切權利均屬本公司所有，且本公司有權

以任何適合之方式使用。

十、其他事項

1. 稅項

賣家支付予本公司之所有款項不包括

貨物稅、服務稅或其他增值稅，如有

任何相關之稅項產生，賣家須依據有

關法律規定之稅率及時間繳付稅款。

一、版權

什麼是荷蘭式拍賣 Dutch Auction

荷蘭式拍賣，相傳是最早的拍賣方式，源自於荷蘭的花卉市場。

花是一種隨著時間快速凋萎的植物，當賣花的有100朵鮮花，必須在一天內賣完，否則花開始枯萎就不能賣了。

聰明的花販因此首先設定最高賣價，

假設為每朵100元，每2個小時就降價10元。拍賣開始後，可能一開始沒有人願意購買，因為價錢不吸引人。

但降價為每朵80元時，有一人競價了，他可能全買走，或者買了部份。假設他只買30朵，那麼剩下的就繼續拍賣。

過了2個小時，還是沒賣掉，此時價格降為每朵70元，又有人出價了，她買走50朵花。

花販的就這樣，不斷降價，直到賣光他的花為止。

這種不斷降價求售的拍賣方式，

又被人稱為「減價拍賣」。

無底價荷蘭式競拍專場

本次「中日韓現當代藝術小品專場」集結當代藝術創造力旺盛的作品群，呈現一

種小型而精緻的拍賣會，特別採用改良後的荷蘭式拍賣，稱為「混合式荷蘭式拍

賣」，這古老卻新穎的拍賣手法為：拍賣官會首先喊出拍品的最高起拍價，若無人

應價時，拍賣官便開始依階梯，降低起拍價，一口一口降，直到有第一個人舉牌應

價。請注意，此時勝負仍未分！當競爭者出現，競價將會逆轉往上，變回一般我們

熟悉的增價式拍賣方式，直到無人出價為止；但萬一起拍價已降低至最低底價時，

拍品將會自動流拍。

根據作品吸引買家程度不同，也許作品根本無人應價，而至最低底價時，便默默流

拍。也許意外地作品非常吸引人，當有人一馬當先搶了頭彩之後，想要競拍的人便

會相繼出現，爭奪作品直至落槌。

此種拍賣方式要注意的是，競拍者永遠不知道甚麼時候降到底價，一不小心拍品就

會流拍！但如果躁進出價又容易買貴。藏家們將在競價與不競價之間、要與不要之

間糾纏千回，取決難捨，這就是拍賣會的誘惑迷人之處，也只有現代藝術拍賣場上

能帶來如此無比感受。
