分部職責Branch Responsibilities

116 電訊管理局二零零六至零七年營運基金報告書

電訊局在1993年7月1日成立為一個獨立

政府部門，是電訊局長的行政機關。電訊局長

根據《電訊條例》（第106章），獲委任為負責

規管電訊市場的法定人士。

OFTA was established as an independent Government

department on 1 July 1993 and is the executive arm of the TA.

The TA is appointed under the Telecommunications Ordinance

(Cap.106) as the statutory body responsible for regulating the

telecommunications industry.

自1995年6月起，電訊局一直以營運基金的

方式運作，經費主要來自牌照費的收入。

Since June 1995, OFTA has been operating on a trading fund

basis, with its funding supported by income derived mainly from

licence fees.

電訊局約有員工313人，主要負責規管和促進

電訊業的發展，包括經濟及技術規管、執行公

平競爭條款、協調電訊基礎建設的發展、調查

有關涉嫌違反《電訊條例》及發牌條款的消費

者和業界投訴、管理無線電頻譜、協調衛星軌

道、就電訊事宜向政府提供意見、代表香港參

加國際電聯與其他國際論壇，以及確保香港遵

守相關的國際協議。

With about 313 staff members, OFTA‘s major role is to regulate,

and facilitate the development of the telecommunications sector.

Its responsibilities include economic and technical regulation,

enforcing fair competition rules, coordinating the development of

the telecommunications infrastructure, investigating consumer

and industry complaints pertaining to suspected breach of

provisions in the Telecommunications Ordinance and licence

conditions, managing the radio frequency spectrum, coordinating

satellite orbital positions, providing advice to the Government on

telecommunications matters, representing Hong Kong in the ITU

and other international fora, and ensuring Hong Kong’s

compliance with relevant international agreements.

電訊局由四個分部組成：規管事務部、競爭事

務部、執行部及支援部，負責履行電訊局的職

能。這四個部門的主要職責是：

OFTA‘s functions are performed by its four branches: Regulatory

Affairs, Competition Affairs, Operations and Support. The main

duties of these four branches are:

規管事務部負責公共電訊服務的規管和發牌事宜、執行牌照條款及管理電訊號碼計劃。

其他職責還包括就電訊規管計帳向電訊局長提

供意見、監察公共電訊服務營辦商的表現、調

查有關公共電訊服務的業界投訴、協助公共流

動網絡營辦商進入土地設置無線電通訊裝置、

以及協調在公用道路鋪設電訊電纜管道

的工程。

The Regulatory Affairs Branch oversees the regulation

and licensing of public telecommunications services, enforces

licence conditions and administers the telecommunications

numbering plan. Responsibilities of the branch also include

providing advice on regulatory accounting to the TA, monitoring

the performance of public telecommunications operators,

investigating industry complaints regarding public

telecommunications services, facilitating public mobile network

operators‘ access to land to place radiocommunications

installations and coordinating the laying of ducts for

telecommunications in public roads.

競爭事務部負責執行競爭規例，禁止反競爭手段及具誤導性的行為，並作出裁決及調

解，以解決業界在互連、共用設施和接駁問題

上的糾紛。職責亦包括作出市場狀況評估，供

規管政策研究之用。此外，亦須就實施《廣播

條例》下的競爭條文提供意見。

The Competition Affairs Branch is concerned

with the enforcement of the competition rules prohibiting

anti‑competitive practices and misleading conduct. It also

handles determinations and mediations to resolve industry

disputes related to interconnection, sharing of facilities and

access. It is responsible for providing market‑related

assessments in the consideration of regulatory policy. In

addition, it provides advice on the implementation of competition

provisions in the Broadcasting Ordinance.

執行部負責管理香港的無線電頻譜、就電訊事宜向政府提供意見，並就規管廣播服務

提供技術支援，職責包括與中國內地及澳門

當局協調無線電通訊和廣播頻率的使用、專

用電訊服務的發牌、調查廣播接收不佳的個

案並提供技術解決方案、調查有關干擾及輻

射危險的投訴、檢控非法使用電訊設備、舉

辦水上無線電操作人員的考試和發出證書，

以及就營辦商進入樓宇公用部分鋪設電訊╱

廣播設施及網絡進行協調。

The Operations Branch manages Hong Kong‘s radio

frequency spectrum, provides advice to the Government on

telecommunications matters and renders technical support in

the regulation of broadcasting services. Its responsibilities also

include coordinating the use of radiocommunications and

broadcasting frequencies with the Mainland and Macau

authorities, licensing private telecommunications services,

investigating poor broadcast reception and recommending

technical solutions, investigating interference and radiation hazard

complaints, prosecuting illegal use of telecommunications

equipment, administering examination and certification of

maritime radio operating personnel and coordinating access to

common parts of buildings by operators for the purpose of installing

telecommunications / broadcasting equipment and wirings.

支援部執行規管發送商業電子訊息的《非應邀電子訊息條例》（不包括與詐騙活動有關的條

文），以及負責技術標準、國際事務、公共關

係及行政方面的工作。在技術方面，職責包括

通訊衛星系統和服務的規管和發牌、確保各項

國際協議獲得遵守、訂定技術標準和核准有關

的電訊設備。至於行政方面，職責包括與傳媒

保持溝通，回應市民查詢、籌辦宣傳、公共關

係及消費者教育活動、處理與涉嫌違反《電訊

條例》和發牌條款有關的消費者投訴，以及擬

訂資訊科技、人力資源及財務管理的策略。

The Support Branch enforces the Unsolicited Electronic

Messages Ordinance (except the parts related to fraudulent

activities) which regulates the sending of commercial electronic

messages, oversees technical standards, international affairs and

implements OFTA‘s public relations and administrative functions.

On the technical side, its portfolio covers the regulation and

licensing of communications satellite systems and services,

ensuring compliance with various international agreements,

developing technical standards and approving related equipment.

On the administrative side, it is responsible for communicating with

the media, responding to public enquiries, organising publicity and

public relations events, conducting consumer education

programmes, handling consumer complaints pertaining to

suspected breach of provisions in the Telecommunications

Ordinance and licence conditions, and devising information

technology, human resources and financial management strategies.

• 為實施頻譜政策綱要，我們已於2007年

4月首次公布頻譜供應表，以便業界知悉

可能於未來三年透過公開競投或招標供

應的無線電頻譜。頻譜供應表將會按年

或於有需要時因應最新發展予以更新。

我們將會按照該政策綱要的指引，跟進

各項所需的有關頻譜管理安排的工作，

包括評估市場主導管理方法是否適用於

各段頻帶，以及公布未被指配而可用行

政手段指配的頻譜。

• AspartoftheimplementationoftheSpectrumPolicy

Framework(theFramework),wepublishedthefirst

SpectrumReleasePlaninApril2007inordertoinformthe

industryofthepotentialsupplyofradiospectrumthrough

anopenbiddingortenderingprocessforthecomingthree

years.Theplanwillbeupdatedannuallytakingintoaccount

thelatestdevelopments,orasnecessary.Wewillfollow

uptheissuesrequiredtoalignthespectrummanagement

arrangementswiththeguidanceoftheFramework,

includingtheassessmentofapplicabilityofmarket‑based

spectrummanagementtodifferentfrequencybandsand

thepublicationofinformationforunassignedspectrum

availableforadministrative‑basedassignment.

• 我們會就數碼地面電視的技術標準向廣播

事務管理局提供意見，以支援實施數碼地

面電視廣播的政策。此外，亦會與地面電

視廣播機構及消費電子產品業緊密合作，

確保於2007年順利推出數碼地面電視廣

播服務。

將於2007年10月舉行。我們會繼續與

本地業界進行協調工作，並積極籌備參與

大會。

October2007.Wewillcoordinatetheinputfromthe

localindustryandactivelyprepareforourparticipationin

• 我們會與北京第29屆奧林匹克運動會組

織委員會（北京奧委會）及第29屆奧林匹

克運動會馬術比賽（香港）有限公司緊密合

作，處理北京奧委會、媒體及參加者在

2008年奧林匹克運動會及殘疾人奧運會

馬術項目中使用無線電通訊器材的事宜。

• 電訊局於2006年實施電子發牌系統，新

的專用無線電系統牌照正逐步取替現時供

專用流動無線電系統使用的移動無線電系

統牌照。我們會研究把電子發牌系統應用

於其他專用電訊牌照。

• WiththeimplementationoftheElectronicLicensingSystem

forOFTA(ELSO)in2006,thenewPrivateRadioSystem

LicenceisprogressivelyreplacingtheexistingMobileRadio

SystemLicenceforprivatemobileradiosystems.Wewill

conductastudywithaviewtoextendingtheELSOtocover

otherprivatetelecommunicationslicences.

• 我們已完成檢討無線電監察組的現有設備

裝置，將會把部分設備升級以提升我們監

察無線電及調查干擾的能力。

• 規管非應邀電子訊息的法例草案已於

2006年7月提交立法會。我們將會就該

法例的所有相關事宜向商務及經濟發展局

提供所需支援及建議，包括技術發展、趨

勢、可執行性及參考海外制度等。

• ThelegislationthatregulatesthesendingofUnsolicited

ElectronicMessages(UEM)wasintroducedtothe

LegislativeCouncilinJuly2006.Wewillsupportand

adviseCEDBonallaspectsofthelegislationincluding

technologydevelopment,trends,enforceabilityand

• 在該法例開始實施前，我們將繼續與各利

位能夠及時處理可能違反《電訊條例》或

牌照條件的投訴，並採取行動，同時適當

地監察《電訊條例》及牌照條件範圍以外

的投訴。
