Anti-Labour Trafficking Project ประเทศไทยเปนทงตนทาง ปลายทางและทางผานของการคามนษยดานแรงงาน ซงเปนการคามนษยรปแบบหนง แรงงานเหลานถกขายหรอลอลวงมาแลวถกบงคบหรอตกอยในภาวะจ ายอมตองท างานหรอใหบรการ เนองจากกลววาตนหรอบคคลอนจะเกดอนตรายจากการกระท าทไมชอบดวยกฎหมาย แรงงานเหลานนตองท างานหนก งานอนตราย ไมไดคาจางหรอไดคาจางต า และมสภาพความเปนอยทเลวราย เหยอของการคามนษยดานแรงงานถกละเมดสทธมนษยชนในหลายดาน แตไมไดรบการคมครองเนองจากกฎหมายเออมมอไปไมถง โครงการนจะชวยเหลอเหยอของการคามนษยโดยใหค าปรกษาหรอจดหาทนายความให เพอด าเนนคดตอผกระท าผด ทงทางแพงและอาญา ดงนนหากทานพบเบาะแสการคามนษยดานแรงงานโปรดแจง 1. 1300 ศนยประชาบด กระทรวงการพฒนาสงคมและความมนคงของมนษย

the worst conditions imaginable. Some are physically threatened and some are

unpaid or paid minimally. Victims have no protection of rights. Anti-Labour Traf-

ficking Project will provide legal aid. To prosecute the trafficker, and gain compen-

วตถประสงค

1. ใหความชวยเหลอดานกฎหมาย การด าเนนคดเขาส

กระบวนการยตธรรมทงในทางแพงและทางอาญาแกผเสยหาย

จากการคามนษยดานแรงงาน

2. รวมมอและประสานงานกบหนวยราชการ และองคกรพฒนา

เอกชนเพอใหมาตรการบงคบใชกฎหมายการคามนษยอยางม

ประสทธภาพ

3. รณรงคและเผยแพรความรเพอประชาชนมสวนรวมในการ

ตอตานการคามนษย

Anti Labour Trafficking Project

Anti-Labour Trafficking Project was established in May

2009 by Human Rights and Development Foundation in

collaboration with government agencies and private sec-

tors in Thailand and Greater Mekong Sub-region (GMS).

Anti-Labour Trafficking Project supported by UN Inter-

Agency Project (UN-IAP)

Objectives

1. Legal consultancy: providing legal aid to victims of

trafficking in forced labour. To prosecute the traf-

ficker, and gain compensation for victims.

2. In cooperation with government agencies and private

sectors to apply the Anti-Trafficking in persons law

enforcement effectively and pursue the appropriate

legislation on the trafficking in persons problem in

Thailand.

3. Advocacy campaigns to promote and protect the

rights of forced labour and combat human trafficking.

การคามนษยคออะไร

ตามมาตรา 6 แหงพระราชบญญตปองกนและปราบปรามการคา

มนษย พ.ศ. 2551 (พรบ.ตอตานการคามนษย)

1. ผใดกระท าตอบคคลใดอยางหนงอยางใดดงตอดงตอไปน - จดหา - ซอ - ขาย - จ าหนาย - พามาจากทใด - สงไปยงทใด - หนวงเหนยวกกขง - จดใหอยอาศย - รบไว 2. โดยวธการอยางหนงอยางใดดงตอไปน - ขมข - ใชก าลงบงคบ - ลกพาตว - ฉอฉล - หลอกลวง - ใชอ านาจโดยมชอบ - ใหเงนหรอผลประโยชนใดๆแกผปกครองหรอผดแลเดก คนพการ คนทตองพงพงตน ฯ เพอใหผปกครองหรอผดแลยนยอมใหผกระท าความผดท าตอบคคลดงกลาวตาม 1 และ 2 3. โดยมวตถประสงเพอแสวงหาประโยชนโดยมชอบอยางใด

อยางหนงดงตอไปนตามมาตรา 4 พรบ.ตอตานการคามนษย ไมวา

บคคลนนจะยนยอมหรอไมกตาม คอ

- การแสวงหาประโยชนจากการคาประเวณ

- การผลตหรอเผยแพรวตถหรอสอลามก

- การแสวงหาประโยชนทางเพศในรปแบบอน

- การเอาคนลงเปนทาส

- การน าคนมาขอทาน

- การบงคบใชแรงงานหรอบรการ

- การบงคบตดอวยวะเพอการคา

- การอนใดทคลายคลงกนอนเปนการขดรดบคคล (การขดรด

หมายความวา การแสวงหาประโยชนโดยวธบบบงคบเอา การแสวงหา

ประโยชนโดยวธบบบงคบใหยนยอม)

การบงคบใชแรงงานหรอบรการ หมายความวา การขมขนใจใหท างานหรอบรการ (บรการ หมายถง การปฏบตรบใช การ

ใหความสะดวกตาง ๆ หรอการปฏบตอน ๆ ทท าใหอกฝายหนงเกด

ความพงพอใจ) โดยท าใหกลววาจะเกดอนตรายตอชวต รางกาย

เสรภาพ ชอเสยง หรอทรพยสน ของบคคลนนเองหรอของผอ น โดยข

What is Human Trafficking? Section 6 in the Anti-Trafficking in Persons Act 2008 1. Whoever, does any of the following acts: - procuring - buying - selling - vending - bringing from - sending to - detaining - confining - harbouring - receiving any person 2. The acts in 1 are committed by any of the following methods: - threats - use of force - abduction - fraud - deception - abuse of power - giving money or benefits to achieve the consent of a per-son having control over another person in allowing the of-fender to exploit the person under his control. 3. The acts in (1) and the methods in (2) have been done with any of the following exploitative intention (Section 4 of the Anti-Trafficking in Persons Act 2008): - seeking benefits from prostitution - production or distribution of pornographic materials - other forms of sexual exploitation - slavery - causing another person to be a beggar - forced I labour or service - coerced removal of organs for the purpose of trade; - any other similar practices resulting in forced extortion (forced extortion means exploitation by means of use of force upon someone to obtain his consent). Regardless of such person’s consent.

Forced labour or service means:

compelling the other person to work or provide service (service means working as a servant, other acts of provid-ing convenience or other treatment that satisfies another person) by putting such person in fear of injury to life, body, liberty, reputation or property, of such person or an-other person by means of intimidation use of force, or any other means causing such person to be in a state of being unable to resist);
