1. EXECUTIVE SUMMARY

1.1 This report updates Members on the sites/properties sold last financial year, those properties deferred to the 2006/07 and identifies additional properties to be included in the 2006/2007 disposals programme.

1.2 The report also recommends further action to designate land for Trust use as

part of a de-urbanisation programme.

2. RECOMMENDATIONS

That Members note and approve: 2.1 The disposals sold in the last financial year, 2005/2006 (contained in Appendix

3. BACKGROUND AND PROGRAMME UPDATE 3.1 Appendix 1 of this report lists those sites and properties sold in 2005/2006,

which totals £8,142m.

3.2 Appendix II of this report, lists those sites deferred from this years disposals programme to the 2006/07 programme, (Approximately £3.6m). Members will note that the Burnside Site was not sold last year owing to the Environment Agency objecting to the outline planning permission, which has necessitated the requirement for a flood risk assessment report in order to address their concerns. It has therefore deferred consideration of the outline planning application submitted for change of use to residential development. It is anticipated that this site will be sold this financial year, ie 2006/2007.

3.3 The land fronting Camlet Way, Hadley Wood, was also deferred and will be

the subject of a separate report to Members in the near future. 3.4 Members will note that the Assistant Director of Finance and Corporate

Resources (Property) is inviting expressions of interest for the freehold purchase of the BP filling station, Mollison Avenue and it is intended that offers will be invited on the basis of a shortlist of potential ‘special purchasers’. Britannia House, Baker Street, which is currently leased to ‘Prospects’ as career offices, will also shortly go to auction as a freehold investment sale.

3.5 Members will also note that the Lodge House at Trent Park, Cockfosters,

Cemetery House, Church Street, No1 College Farm and East Lodge Cottage, Botany Bay, have been added to the 2006/2007 disposals programme (Appendix III) and Members are requested to approve their inclusion in the list.

3.6 The Assistant Director of Finance and Corporate Resources (Property) will

bring forward a further tranche of new disposals in 2007/2008 for Members’ consideration in the early autumn, which will include complex disposals involving site assembly with existing tenants and the restructuring of leases in the Councils commercial portfolio. This to include appraisal for generating a capital sum, or premium in return for a long lease at a peppercorn, or nominal rent.

3.7 Members should note that there are issues regarding the disposals of

properties/sites containing restrictive covenants with the Duchy of Lancaster. Proposed sales affected by this covenant have been deferred, pending resolving any outstanding issues with the Duchy and to seeking legal advice.

3.8 The sites/properties identified in appendices, I, II, and III will, subject to Members’ approval, be disposed of either by auction, tender or private treaty (in the case of special purchaser). In each case, officers shall, under delegated powers, select and proceed with disposal on the best appropriate bid subject as always to certification that the selected bid satisfies best consideration under Section123 Local Government Act 1972. Members

should note therefore that tender results etc will not be reported back to Cabinet once a site has been approved for inclusion in the disposals programme, unless such a report is specifically requested by Members.

3.9 As a part of the ongoing Asset Management Plan process, the Assistant Director of Finance and Corporate Resources (Property) is identifying other sites/properties suitable for inclusion in the disposals programme. If, as a result of bringing new disposals over the next 3 years, the capital receipts targets are exceeded, it is proposed that the salary costs and overheads incurred for exceeding these targets are funded from the additional capital receipts generated.

3.10 It is further proposed to review potential new disposals in consultation with the

Lead member for Finance and Corporate Resources, ward councillors and with potentially affected tenants, before bringing a report on new disposals to Cabinet for consideration in the autumn.

3.11 Any new disposals will be assessed against the Council’s policy criteria and

objectives (Cabinet report 14.07.2004 Report No 52 refers) used to assess under-performing assets, the capital value of which might be better invested in the Council’s priority programme.

4. ‘DE-URBANISATION’ AS AN EMERGING THEME The Property Strategy Board is currently developing ‘de-urbanisation’ as a

key theme for the management of the Council’s assets. For example, Members will be aware that ongoing negotiations are currently taking place with the Woodcroft Wildspace Group which has formed a company for the purpose of leasing the land at Woodcroft. Hadley Wood Residents Association has also requested the use of the land at the rear of Camlet Way, Hadley Wood. Officers will also be seeking to look at the feasibility of other similar projects at Boundary Ditch Car Park, Ponders End, land at the junction of Painters Lane and the Hertford Road, Freezy Water. The details of these projects will be the subject of a future report to Members. It is also proposed to review the lease of the Paulin Ground, Winchmore Hill in response to a request from the lessees for an extended term. This to ensure the long term future continuity of this existing Borough facility.

5. CONSULTATION

All ward Members and Cabinet Members have been provided with site plans of those sites/properties identified in the 2005/2006, 2006/2007 disposals programmes. As defined in paragraph 3.11 above, preliminary consultation will be undertaken before submitting recommendations for the new three-year programme.

6. ALTERNATIVE OPTIONS CONSIDERED The Council can continue to retain its assets and receive the revenue income

from the commercial portfolio properties.

7. REASONS FOR RECOMMENDATIONS:

To Implement the Council’s disposals programme in order to ensure delivery of the Capital Programme.

8. COMMENTS OF THE DIRECTOR OF FINANCE AND CORPORATE

RESOURCES AND OTHER DEPARTMENTS:

8.1 Financial Implications There is a loss of revenue income from the disposals of Britannia House and the BP filling station, amounting to £128k in a full year and a loss of income to the HRA from the disposals of various public houses amounting to £50k in a full year. The actual loss in the year will depend on the date of disposal. There is provision in the contingent items to cover the loss of income to the general fund. The majority of HRA disposals are in 2006/7 and will be included in the budget for that year and any loss in the current year will be met from existing resources.

8.2 Legal Implications The Council has a statutory duty to achieve the best price reasonably obtainable on disposal (or obtain the consent of the Secretary of State) and this is also reflected in property procedure rules. Members will note that detailed legal appraisals on some of the sites contained in the disposals programme have not been carried out at this stage.

9. PERFORMANCE MANAGEMENT IMPLICATIONS

9.1 The Council disposes of under performing assets which are no longer required for corporate purposes and performance is measured through the Council’s medium-term monetary plan.

9.2 The reason for the continuation of the Council’s disposals programme

is to generate capital receipts to fund the on-going capital expenditure programme.

9.3 Option appraisals have been carried out on all of the sites/properties

identified suitable for disposal in accordance with the Cabinet approved objectives and criteria matrix for bringing forward new disposals.

10. PUTTING ENFIELD FIRST

The disposals programme generates capital receipts, which will contribute towards ‘Putting Enfield First’.
