WET OP GENEESHERE, TANDARTSE EN APTEKERS, NO. 13 VAN 1928.-AANHOU EN VERKOOP VAN VER-

OIFTE.

REGULASIES IN VERBANO MET DIE AANHOU, VER­KOOP OF LEWERING VAN VERGIFTE EN PRE­PARATE WAT VERGIF BEVAT.

(Uitgevaardi.g kragtens artikels een-en-vyffig •en sestig van Wet No. 13 van 1928.)

W oordbepalings.

1. In hierdie regulasies beteken "die Wet" die Wi:t op Gene,esher-e, Tandart&e ,en Aptekers , No. 13 van 1928, of enige wysiging daarvan; "dj.e Raad" betek,:cn die Suid-Afri­kaanse Oene,eskundige Raad, "die Kommissi•e" b-etekea die Suid-Afrikaanse Aptek,erskommissie; "algemen,e of kleinhand e­-laar" betek,en 'n pers-oon wat gelisensie,er is kragtens Wet No. 32 van 1925 of ,enige wysiging daarvan, of, in die geval van die mandaatgebi,ed Suidwes-Afrika, kragtens Administra­teursproklamasi,e No. 21 van 1921 of enige wysiging daarvan.

Etikette OJJ Vergifte .

2. (1) µ,een persoon mag -enige vergif of preparaat wat vergif bevat in die Unie inv,oer, of verkoop of !ewer, hetsy by die groot- ,of kleinmaat ,of in groot hoe,ieelhede nie tensy di•e hou,er of bui-tenste omhulsel voorsien is van 'n •etiket waa110p v,erme1d staan of die vergif onder Afdeling I of At1deling II van die Vi-erde Bylae van die Wet val.

(2) Enige v,erklaring op enig,e etiket oor;e-enkomstig die bepalings van subregulasle ( 1) word vir die doel·eindes van die Wet of van enige regulasies opg,estel ingevolge daarvan, beskou as prima fade getuienis van die bestaan van die vergif genoem in so 'n verklaring.

Verkoop van Vergif deur Alg,emene Handelaars ,en K ,;opera­tiewe Landbouverenigings.

3. (1) 'n Algemene of kleinhandelaar of ':n kooperatiewe landbouv,er,eniging of maatskappy aan wie 'n sertifikaat ten opsigte van ~He v,erkoop of aanhou vir verkoop van vergifte en preparate wat v,ergif hevat, uitger,eik is deur 'n magistraat kragtens artik,el een-e.n-v yf tig van die Wet, kan g,edurende die termyn waarvoor daardi,e sertifikaat geldig is di,e volg,ende vergifte of pr,eparate wat v,ergifte hevat, v•e-rkoop of aanhou vir verkoop ooreenkomstig die hepalings van die Wet, maar geen ande-r nie :-

REGULATIONS REGARDING THE KEEPING, SALE OR SUPPLY OF POISONS.

Under and by virtue of the pO\\·ers in him vested by secti-ons fifty -one and sixty •of ·the Medical, Dental and Phar­macy Act, No. 13 of 1928, and after consultati,on with the South African Medical Council and the South African Phar­macy Board, the Minister of Public Health has been pleas-ed to make the following regulati,ons to be in force throughout the Union, includi!l•g (in accordance with the provisi-ons of section uinet1•-:1i11e of the said Act and ,Proclamation No. 3 of 1929) tlie Mandated Territory -of South W,est Africa, with effect from the 1st January, 1936, from which' date the regu]ati,ons published under Oonrnment Notice No. 5 of the 4th January, 1929, as amended by Government Notice No. 179 of 20th Ja1rnary, 1929, are her-eby cancelled:-

MEDICAL, DENTAL AND PHARMACY ACT, NO. 13 OF 1928.- KEEPING AND SALE OF POISONS.

REGULATIONS REGARDING THE KEEPING, SALE OR SUPPLY OF POISONS AND PREPARATIONS CONT AINI NG POISONS.

(Made under secHons fifty -one and sixty of Act No. 13 of -1928.)

Definitions.

1. In these r,egulations "the Act" means the Medical, Dental and Pharmacy Act, No. 13 of 1928, or any amend­ment ther,e,of; "the Council" means the Soufh' African Medical Councii; "the Board" means the South African Pharmacy Board ; "general or retail dealer" means a person licensed as such under Act No. 32 of 1925 ,or any amendment thereof, or, in the Mandated Territory of South West Africa, under Administrator's Proclamation No. 21 ,of 1921 or any amend­ment ther,eof.

Labelling of Poisons.

2. (1) No person shall import into the Unton, or supply or sell, whether wholesale or in bulk or by r-etait, any poison ,or preparation containing poison unless the oo-ntainer or outside wrapper, if any, bears a label stating whether the poison is in Division I or in Division II of the Fourth Schedule to the Act.

(2) Any statement made on any label in pursuance of the provisions of sub-regulation (1) s·hall for thie purposes ,of the Ad or of any regulations framed thereunder be deemed to be prim.a f atie ,evidence of the existence of the poison mentioned in such statement.

Sale of Poison by General Dealers and C?-op:emtive Agricnltural Societies.

3. (1) A general or retail dealer to whom, •or co­operative agricultural society or company to which a oertificati" has been issued by the magistrate under section fif1y -o:1s of the Act in respect of the sale and keeping or sale of poisons and preparations containing poison may, during the currency of that certificate, keep for sale and sell, in accord­ance with the provisions of the Act, the followi'ng pois•ons and preparations containing poison, but no,1e other: - -

Vergifte ,en preparate wat vergif bevat, \'i r gebruik in verband met veeartsenvdoeleindes, soos blaarsalf, "Con­dition Powders" en ,vurmmiddels, en alle veemiddels wat vergif bevat rnlgens di-e betekenis van die Wet en ge regist reer is by die Departement van {-andbou en Bosbou ooreenkomstig die bepalings van die Wet op Meststoffen, Vee\'Ocdsel, Zaden en Plaagmiddelen, 1917.

5. (1) Enige persoon wat skPift,elik daartoe gemagtig is deur die Sekretaris van Volksgesondheid of deur 'n magi­straat van die distrik, of deur 'n beampte van die Departe­ment van Doeane · en Aksyns of deur eni ge lid van di-e polisie­mag met di e rang van sersant -of hoer, kan inspeksies hou in \'erband met die in\'oer, Yervaardiging, vervoer, aanhou, berging, verpakking, opmaak van en etikette op medisyne, \'erkleuring, smaak-gee,. Yerkoop, lewering -of gebruik van \·ergifte -en kan enige perseel of voertuig visenteer, en kan enige pe rsoon wat in besit van 'n vergif gevind w.ord, versoek om enige korrespondensie of dokument wat betrek­king het op di-e wyse waarop hy in besit \'an sodanige vergif gekom het, Yir inspeksie te toon en kan \·e rder van so 'n

. persoon vereis om ' n m::ll1ster van .sodani,ge \·ergif te \1er­koop , !ewer, of om toe te laat dat 'n monster g2neem \Vorel. Enige persoon \,·at nalaat om enige sodanige vereistes na te kom, is skuldi.g aan 'n oortreding.

(2) Dit is di e plig \·an die Raad of Kommissi,e om elke geval waarin <lit beskou word <lat 'n inspeksie kragtens hi erdie regulasie uitge\'Oe r behoort te word, onder die aandag van die .Minister te bring.

P.ois-ons to be used exclusively in agriculture or horti­culture, or as a clip for cattle, sheep, or othe r animals, or to be used exclusively for the destruction of vermin, insects, plants, fungi, ,o.r bacteria, or for the preserva­tion of wood, these being -

all cattle and sheep dips; all weed kille rs ; arsenite of soda; arsenate of J,eacl; Paris green; tobacco extracts;

all dis infectants wntammg 3 p er oe:nt. or more ,of carbolic acid (phenol) or cresylic acid (cresol) ,or of a mixture of these substances o r of thei r derivatives (except lysol and similar prepara­tions under whatev,er name they may be de­scribed or sold);

vermin killers other than fhose containing strych­nine,

Poisons and preparations containing poison to be used for veterinary purposes, such as blistering ointments, condition powders and worm remedies, and all stock rernedi~s containing poison vv ithin the meaning of the Act, and registered with the Department of Agricul­ture and Forestry in t,e rms of the Fertilise rs, Farm Foods and Pest Remedies Act, No. 21 of 1917.

(c) Poisonous substances to be used exclusively for the cleansing ,of clothing and similar purposes.

(2) Such certif icates shall authorize fhe sale or ke,eping for sale of such poisons and preparations only at the address mentioned in the certificate an.cl un.cler the personal s•uper­visi,on of the pers•on menti,oned the r-ein and, in the case o f a co-operative agri,cultural society ,or company, shall authorize the sale of such poisons or prepa rahons only to members ,of such soci-ety -or company.

Sale by General Dealers 1/ Paf.e.nt, Proprietary or "Dutch" Medicines containing Poison.

4. A general or r,etail dealer to whom a certificate has been issu,ed by the magistrate under sedi•on f ifi y-on,e of the Act in respect of the sale and k~eping for sa1e of prepara­ti-ons known as "patent", "proprietary" v r "Dukh" medi­cines contai-ning pois-on may, during the curnency of that certificate and in accordanoe with the provisi-ons ·of the Ad, keep for sate and sell any of the following pr,eparations [ not being preparations (i) the sale ,of which by a general ·or retai i deal,er is prohibited by Chapter VI of th!e Act and the regulations ther eunder relatiing to the sale of o pium .and habit-formjng drugs, or (ii) containing any poison mentioned ,or included in Division 1 -of the F•ourth Schedule to fhle Act]: -

All homeopathic medicines. All Dutch medi·qines. All asthma powders and cigarettes. Headache powders containiing acetanilide or phenaz.one. Aperient and laxai'iv,e pills and tablets other than those

contai.nii1ng mix vomica, ,or strychnine and its salts. All cough and cold remediies except thos·e oonfai1ning h'abit-

forming drugs. Applications for corns and bunions . Ointments or creams conta,i,ning r,ed o r white precipitate. Nerve remedies and toni,c preparations other tha:n those

contain,i,ng nux vomica, or strychnine and its salts. Vapo-Cresolene.

Inspections.

5. ( 1) Any person authorized thereto ,in writing by the Secretary for Public Health or by the magiistrate of the distrid -or by an officer of the Department of Customs and Excise or by any member of the pol•i,oe force of or above th·e rank ·of sergeant may make inspecti;ons in connection with the importation, manufacture, conveyance, keeping, storage, packing, dispensing, labelling, colouring, flavouring, sale, supply or use of pois-ons, and may search any premi.ses or Ychicles and may r-equire any person found in possession of a poison to produce for ,inspection any conespondence or document having any bearing on the manne r in wh'ic'h' he came into possession of such poison, and may further r,eqitire such person to sell, supp ly, o r permit the takiing ,of a sample of such poison. Any person who fails to comply with' any such requirements shall be gui lty of an off.enoe.

(2) It shall be the duty of the Council or Board to bring to the notice of the Minister any case in wh'ic!hl i,t is considered that an i-nspection should be made under this regulation.

6. (1) Vir di,e doefoindes van hoofstuk V van die Wet in verband met diie verkoop van vergifte, bet,eken -

''Groothandel" die verkoop of lewering vir die qoel van 'herverkoping en nie vir persoonlik,e verbruik of gebruik deur die kop,er nie.

"In groot 'hoevedhede" bet,efoen die verkoop of lew,ering van vergifte of giftige stowwe vir myn-, industriele, landbou-, v•ervaardigings- of herdistribueringsdoeleindes, in oorspronklike 'houer soos verskaf deur die vervaar­diger, wat ni,e minder as 14 lb. in gewig bevat in die geval van vaste stowwe en nie mtnder as 5 gelling m die geval van vloeiistowwe nie.

(2) Geen· invoerder, handelaar, vervaardiger of distribu­eerder by die grootmaat na wi,e v,erwys word in artikel dri,e­en-vyf tig van di,e W,et mag enige van die v•ergiHe ,of pre­parate waama v•erwys word in a:rtikel een-e,n-vyftig van die \Vet aan enige a:nder handelaar vi.r herverk,oping by di-e klein­:naat verk•oop nie, t--ensy hy voorsi,en word van die datum >2 :-1 nommer van die serti<fikaat uitge-reik deur die magistraat ._,_.aarby sodanige kl-einhandelaar gemagtig word om sodanige ·:t,gif of preparare wat vergi;f bevat, te verkoop of aan t,e :: -:•'.l \·ir verkoop.

Boetes.

7. Enige persoon wat enige bepaling van hierdie r,egu­iasies of eni,ge· vereiste of v•oorwaarde vermeld in enige :'e rtifikaat uitge reik ingevolge daarvan, oortree of versuim om dit na te kom, is skuldig aan 'n oortreding en strafbaar b~· \'eroordeling met 'n boete van hoogstens vyftig pond.

Vorms van Sertifikate.

8. Die v•orms van sertifikate wat deur magistrate uit­gereik moet word ing,evolge artikel e,en-en-vyftig van die Wet, is soos uiteengesit in die aange'heg~e aanhangsd.

( 1) Vermeld hier die naam en adres van die algemene of kl-einhaindelaar ten gunste van wie die sertifikaat uitg,e-reik word.

(2) Spesifiseer hi-er noukeurig die Jigging van die wLnk,el, voorraadhuis ,of ander plek waarna die sertifikaat verwys. 'n Afsonderlike sertifikaat word ver-eis vir elk-e wink-el, pak­huis of plek waar vergifte of preparat-e wat vergif bevat, verfooop of aangehou word vir verkoop deur 'n algemene of 'kleinbandelaar.

( 8 ) Vermeld 'hier die naam (voluit) van die verantwoord-e ­like persoon.

Sa.le of Poisons by "W fnlesa!e Dealing" or '-'I n Bulk''.

6. (1) For the purposes of Chapter V of the Act relating to the saLe of poisons •-

"wholesale dealing" shall be deemed to mean sal'e or supply for the purposes of resale and not for personal consumption or use by the purc'hase-r;

"in bulk" shall be deemed to mean sale or supply of poisons or poisonous substances for mining, industrial, agricultural, manufacturing or re-distributing purposes, in odginal co.ntain-ers, as issued by the manufactur-er, holding not less than 14 lb. by weight for solids, and not less than 5 gallons by measure for liquids.

(2) No importer, dealer, manufactur,er or wholesale distributor as referred to in section fif ty-thyee of the Act shall s~ll any of the poisons or preparations referred to in s·ecti-on fifty-one of the Act to any other dealer for resalie by retail unless he is furnished with the date and number of the certificate issued by the Magistrat:.c authorizing such retail deale-r to keep for sale and sell such poi-s-on or preparation containing poison.

Penalties.

7. Any person \vho contravenes or fails to comply with any provisfon of these regulations, or any requirement or condition mentioned in any certificate issued thereunder, shall be guilty of an offence and Hable on c-onviction to a fine not exceeding fifty pounds. · ·

Forms of Certificates.

8. The forms of certificates to be issued by magistrates under section fifty-one of the Act shall be as set out in the annexur,e hereto.
