&' C!I"D. 4a5  During the course of a criinal hearing or

proceeding concerning an offense under Section *1.1+, -enal Code,

that /as coitted against a child 8ounger than 1; 8ears of age,

the court shall not a9e availa6le or allo/ to 6e ade availa6le

the cop8ing or disseination to the pu6lic propert8 or aterial

that constitutes or contains a visual iage, as descri6ed 68

Section *1.1+465, -enal Code, of a child 8ounger than 1; 8ears of

age and that /as seied 68 la/ enforceent 6ased on a reasona6le

suspicion that an offense under that su6section has 6een

coitted.

465  The court shall place propert8 or aterial descri6ed 68

Su6section 4a5 under seal of the court on the conclusion of the

hearing or proceeding.

4c5  The attorne8 representing the state shall 6e provided

access to the propert8 or aterial descri6ed 68 Su6section 4a5.

that constitutes or contains a visual iage, as descri6ed 68

Section *1.1+465, -enal Code, of a child 8ounger than 1; 8ears of

age and that /as seied 68 la/ enforceent 6ased on a reasona6le

suspicion that an offense under that su6section has 6een

coitted.

to an offense coitted on or after the effective date of this

Act. An offense coitted 6efore the effective date of this Act

is governed 68 the la/ in effect on the date the offense /as

coitted, and the forer la/ is continued in effect for that

purpose. 'or purposes of this section, an offense /as coitted

6efore the effective date of this Act if an8 eleent of the

offense occurred 6efore that date.

SECTI&N . This Act ta9es effect iediatel8 if it receives

a vote of t/o:thirds of all the e6ers elected to each house as

provided 68 Section 3, Article III, Te=as Constitution. If this

Act does not receive the vote necessar8 for iediate effect,

this Act ta9es effect Septe6er 1, *1+.
