    On 04-12-2013 while working uniformed patrol for the City of Seattle in a

    marked patrol car as 1E21 I was dispatched at 0632 to 14 Broadway, for a report of a male causing a disturbance inside the grocery store. The

    man had already been escorted out once and had returned. I arrived at 0634

    and contacted store security employee Witness/ DOB90 and manager Witness/ DOB 11-14-19 .

    I was directed to the produce section where I observed Suspect/ DOB 68. I know from numerous previous contacts. I

    arrested him at the same store on 03-31-2013. On that day store

    employees told he was trespassed from the store and not to return.

    I also told him he was trespassed and not to return. returned and

    shoplifted two bottles of vodka and was arrested. (SPD incident #

    2013-107696.)

    I observed in the produce section of the store. cannot walk

    and is in a wheel chair. He was eating tomatoes out of a container he had

    removed from the counter next to him. The cherry type tomatoes were strewn

    all around him on the floor, in his chair and in his crotch.

    pants were mostly removed and around one leg on the ground. The only thingcovering his crotch area was the spilled tomatoes.

    I took into custody for investigation of burglary. knew he

    was trespassed from the 14 Broadway and not allowed to return. Heknowingly entered the store with intent to commit a crime. While inside the

    store he committed the crime of theft by eating food he did not pay for and

    destroying food making it impossible to sell. I placed him in two sets of

    handcuffs which I gauged and double locked. I read his Miranda

    Warnings from my Department issued MIR card. Officer Walter and Patin were

    present.

    Prior to transporting to King County Jail (KCJ), I searched him

    for weapons and contraband. He had only his clothes. He had no money, no

    property and no means of paying for any purchases. Most of a still frozen

    Jimmy Dean sausage sandwich was inside shirt.

    I screened the arrest with 1E Sergeant Runolfson who responded to the

    scene. I called for AMR to tranport and his wheelchair to KCJ.

    I walked with to the frozen food aisle and observed the ripped

    open Jimmy Dean box and scattered contents. The container of tomatoes had been eating out of was destroyed from being strewn about. Ispoke with about the incident. showed me the container of

    mushrooms and second container of tomatoes he recovered. provided

    me a total cost of the four items as $ 22.75.

    I completed a super form to book into KCJ. I completed a felonyalert packet routed to Burglary. I submitted the written statements to

    DATA.
