    The plaintiff, having informed the court that it is filing herein an Information charging12 the defendant with the crime ofAggl'avatedMurder in th e First Degree, Count I, and

    Aggravated Murder in the First Degree, Count II, now moves the court pursuant to CrR13 2.2(a) for a determination of probable cause and an order directing the issuance of a warrant for

    the arrest of the defendant, and further moves the court pursuant to CrR 3.2(g) to make a finding14 (hat the crime charged herein is NOT BAILABLE.15 In connection with this motion, the plaintiffo ffers the following incorporated materials:

    The Seattle Police Department's certification or affidavit for determination of probable cause; the16 . Seattle Police Department's suspect identification data; and the prosecutor's summary in supportof an order directing the issuance of a warrant and no bail.17

    FINDING OF PROBABLE CAUSE, RISK OF FLIGHT AND DANGER TO THECOMMUNITYAND ORDER FOR ARRESTWARRANT2The Court finds that probable cause exists to believe that the above-named defendant3 committed Aggravated Murder in the First Degree, Count I, and Aggravated Murder in the

    That J.D. Mudd is a Detective with the Seattle Police Department and has reviewed theinvestigation conducted in Seattle PoliceDepartment Case Number 11-262738;There is probable cause to believe that Louis C. Chen AlM/07-01-1972 committed thecrime(s) ofMurder withinthe City ofSeattle, County ofKing, State of Washington.

    This beliefis predicated on the following facts and circumstances:TheM Street Apartments are located at 910 8thAvenue-within the City ofSeattle, County ofKing, State ofWashington. On August 11, 2011 atapproximately 9:10 a.m., M Street Apartments assistant property manager, Joy

    Pope, received a phone call from the sister ofdefendant Louis C. Chen, dob: 701-72. The defendant, victim EricA. Cooper, dob: 3-1-82, and victim CooperChen, dob: 10-9-08 resided in M Street Apartments unit #1703. The defendant'ssister had not heard from the defendant in some time and he was not returningthe sister's calls. The sister asked Ms. Pope to go to the defendant's apartment,see if the defendant was there and ifhe was, ask the defendant to call her. Ms.Pope went to #1703, knocked on the door, and identified herself. She recognizedthe defendant's voice on the other side of the door, asking her to come back inan hour. She told him that was not necessary but that his sister was trying to geta hold ofhim and to please call her. The defendant said that he would.

    August 11,2011 was to be the defendant's first day ofwork as anendocrinologist at VirginiaMason Hospital. The defendant was to meet withMadonna Carlson, a manager at VirginiaMason, at 7:50 a.m, for orientation.The defendant did not appear. After more than an hour ofwaiting, Ms. Carlsonbecame concerned. About this time, Ms. Carlson received a call from thedefendant's sister. The sister provided the defendant's address to Carlson andCarlson walked to the M Street Apartments. Ms. Carlson met with Ms Pope andexplained the circumstances. Ms. Pope went back to the defendant's apartment,again knocked on the door, and heard some noise inside. She told the defendantthat Carlson was in the building and was not leaving until she (Carlson) spokewith him. The defendant mumbled something, Pope responded that she did notunderstand, and the defendant responded "tell her to come up."

    Carlson and Pope went to the 1i h 'floor where Pope directed Carlsontowards the defendant's apartment. Ms Carlson knocked on the door and heardsome rustling noises that she described as being like paper or slippers sliding ona floor. Carlson tried to open the door at one point, but it was locked. Carlsonknocked several times. Eventually the defendant opened the door. Thedefendant was wearing no clothes, he was covered in dried blood, his right eye

    UNITFILENUMBERH# 11-259was swollen shut, and he was holding a box in front of himself. From the doorway, Carlson could see another man, later to be determined to be Eric Cooper,lying on the floor further into the apartment. She described him as wearing onlyboxer shorts, with his feet towards the door. Carlson asked the defendant abouthis son and thought that the defendant said, "baby" but wasn't sure.

    Carlson called 911. The 911 operator asked Ms. Carlson if she saw anyweapons and Ms Carlson said that there was a knife that she described as asquare, butcher knife. The 911 operator asked her to get it away from the bodiesand Carlson kicked it into the kitchen area of the unit.

    Police responded to the scene. Officers Miller and McDonald arrived atthe apartment at approximately 10:20 a.m. and observed the defendant slumpeddown by the front door of the apartment. Officer McDonald entered theapartment and checked victim Eric Cooper but could not find any signs oflife.Officer McDonald noted several stab wounds on Cooper's torso. Officer Millercontinued to the back of the unit where she found victim Cooper Chen obviouslydead in the empty master bathroom's bathtub. As the officers were leaving theunit Officer McDonald noticed the defendant moving his head and eyes. OfficerMiller escorted Ms Carlson downstairs. Officer McDonald nudged thedefendant and asked for his name. The defendant responded "Louis Chen ''.McDonald then asked for clarification by asking, "Chin or Chen?" Thedefendant then spelled his last name for Officer McDonald. Officer McDonaldasked the defendant, "Who did this?" The defendant responded, "What?"Officer McDonald then asked," Stabbed you and him." The defendant thenlooked at McDonald and said, "I did."

    Seattle fire arrived and Officer McDonald directed the medics to begintreating the defendant first. Other firefighter/medics checked the condition ofEric Cooper and Cooper Chen and pronounced them dead. The Seattle PoliceDepartment Homicide Unit was called and the scene secured.Acquaintances of the defendant report that they had not from him sinceMonday August 8, 20 II. The M Street Apartments at 910 8thAvenue is a lock-outbuilding which requires electronic key access to gain entry into the building andelevators. A printout ofthe two access "Fobs" assigned to Apartment # 1703 forAugust 2011 show the last electronic entry on August 8, 20 I I around 3:30 in theafternoon. No 911 calls had been placed since that time from Apartment #1703 orby its residents saved for the call by Madonna Carlson.A total of five knives potentially used during the attack were found in theapartment, The butcher knife that was kicked aside by Ms Carlson was found inthe kitchen. A blade, broken off from the handle, of a large kitchen .knife was inthe living room area. A handle without a blade was found in the guest bedroom.Form34.0E 5196 PAGE 2 OF 4
