I ftuar ne Komisionin Par-lamentar pr VeprimtaritProdhuese dhe Mjedisin medat 19 Janar 2016, Ministri iMjedisit z.Lefter Koka prezan-toi projektligjin pr Pr ad-ministrimin e Fondit Pyjor dheKullosor Kombtar n Repub-likn e Shqipris.N fjaln e tij, Ministri Kokatha se ndr risit q sjell ky pro-jektilgj sht kalimi i menaxhim-it fondit pyjor n masn 100%n 61 Bashkit e vendit (deritani ishin kaluar rreth 60% etij).Ai tha gjithashtu se projektligjiparashtron riorganizimin eqeverisjen e fondit pyjor dhekullosor kombtar, dukengarkuar Ministrin me funk-sion politikbrs. Funksionetmenaxhuese t fondit pyjor dhekullosor kombtar, i ngarkohetbashkive, ndrsa funksionetkontrolluese mbeten atribut iInspektoriatit Shtetror t Mje-disit dhe Pyjeve.

SA PYJE DO TKALOJN N BASHKI?

Vitet 2014-2015 ishin vitet enj pune t jashtzakonshmeq Federata Kombetare ePyjeve dhe Kullotave Komu-nale s bashku me FederatatKuks, Kor, Dibr, Tiran,Fier, Gjirokastr, Lezh, Sh-kodr, Berat dhe Elbasan re-alizuan rreth projekt ligjit prPyjet dhe Kullotat. Disatakime diskutuese u zhvillu-an me pjesmarrjen e rreth280 personave, prfaqsues tMinistris s Mjedisit, Bash-kive, Njsive administrative,Agjensive Rajonale t Mjedis-it, Inspektoriatit tMjedisit, Drejtorive t Shr-bimit Pyjor, Prefekturave,Federatave Rajonale t Pyjevedhe Kullotave, Shoqatave tPrdoruesve t Pyjeve dheKullotave Komunale. Parlamenti ka miratuar mor-atoriumin pr ndalimin e pre-rjes s pyjeve pr 10 vjet, i cilipritet t hyj n fuqi brendamuajit shkurt. Por prerja e tyrenuk do t ndalohet pr tgjith. N nenin 3 t projek-tligjin t siguruar nga ReportTv, parashikohen rastet kur dolejohet prerja e pyjeve. Ban-ort e secils bashki t ciltkan nevoj pr dru pr tu

ngrohur do lejohen t presin,por me disa kushte q do pr-caktohen nga qeveria. Gjith-ashtu n rast se ndryshon des-tinacioni i fondit pyjor dhebhet zon pr investime, dolejohet prerja.Pyet do priten edhe pr tbr rigjenerimin dhepastrimin e secils zon. Porpr t gjitha kto raste do tjen bashkit ato t cilat do tmonitorojn proesin. Natyr-isht moratoriumi nuk mundt realizohet 100% n praktik

pr vet arsyen se nevoja e pop-ullsis pr lnd drusore prngrohje, nevoja e vet pyllit prtu pastruar dhe nevojat e sh-tetit pr tjetrsim prone nukmund t anashkalohen, - thu-het n relacionin e projektligjit.T gjith personat apo subjek-tet e tjera q presin pyje pa mar-r leje dhe jasht rasteve t pr-caktuara do dnohen me gjob50 milion lek si dhe do tndiqen penalisht. Si-pas qeveris nj ndr arsyet krye-sore q u miratua moratoriumisht pasi, nga viti 2007 deri n2013-n ka patur nj katastrofmjedisore ku jan prer dhedjegur qllimisht rreth 17% efondit pyjor.Gjithashtu nj tjetr shkak sh-t edhe se gjat 2007-2013 jandhn 435 leje pr ndrtimine HEC-ve, t cilat shfrytzuannj siprfaqe t madhe pyjoredhe nuk e rehabilituan mpas zonn.

Kampionimi (tekni-ka e zgjedhjes) sht i do-mosdoshm pr arsyeekonomike dhe teknike.Gjithashtu do t sigurohetinformacion mbi pronarin/prdoruesin, t drejtat emenaxhimit, prodhimin elnds industriale, drut e

zjarrit, gjuetin, biodiver-sitetin, produktetet e dytapyjore, prfitimet social -ekonomike etj.Nprmjet hartave pyjore tdixhitalizuara, fotove ajroreose imazheve satelitore bhete mundur prcaktimi i ven-dodhjes gjeografike t zonsq do matet si dhe i sipr-faqes s saj, bhet ndarja par-celare dhe m pas identifiko-hen format kryesore t qever-isjes. stafit dhe punn n terren.Kto krkojn nj plankonkret veprimi, ek-spertt, buxhetin dhe pais-jet e nevojeshme.N kuadr t puns cil-sore t Fondacionit CNVPpr ngritjen e ktij rrjeti,Federata Kombtare ePyjeve dhe Kullotave reko-mandon ngritjen e nj Qen-dre Kombtare t Sistemitt Informacionit Gjeografik GIS. Ky do ishte nj mjeti rndsishm pr zgjidhjet integruara pr t gjithaburimet natyrore, dukeprfshir pylltarin, bu-rimet ujore, tokn. Qendra

do t mbshteste t gjithsektort e interesuar t ven-dit me trajnime dhe udh-zime. Mbshtetja pr kr-ijimin e ksaj qendre shtkrkuar disa her nga Fed-erata por ende nuk shtkonkretizuar.Sigurimi i informacionit tsakt lidhur me gjendjenreale t burimeve pyjore,produkteve dhe prfi t i -meve nepermjet rrjetit tsiprfaqeve prov sht poashtu e rndsishme prproesin e vendimarrjesdhe menaxhimin e qn-drueshm t pyjeve dheburimeve natyrore.

Jan dhn mendime tndryshme dhe konkluzionet etakimeve, si dhe shqetsimet prproblemet n pyje jan prcjellnga Federata n organet qendrore,prfshir Presidentin, Kryetarin eKuvendit, Kryeministrin, minis-trit e organe t tjera.Dy muaj m par, Federata ftoi tre

deputet t Kuvendit, prfshirKryetarin e Komisionit Parlamen-tar pr Veprimtarit Prodhuese,Tregtin dhe Mjedisin, z. EduardShalsi, pr nj vizit n terren npyjet e fshatit Zall-Dajt, ku utakuan dhe biseduan me banort fshatit Zall-Dajt, prdorues tpyjeve t familjeve dhe t fshatit,me prfaqsues t shrbimit py-jor dhe t Njsis AdministrativeZall-Bastar. Deputett u njohnme gjendjen, prdorimin e pyjevedhe plotsimin e nevojave t fsha-tarve me prodhime drusore e jo-drusore, me modelet e mira tmenaxhimit tradicional t pyllitnga fshati dhe familjet.Federata ka organizuar edhetakime t nivelit kombtar me pr-faqsues t Kuvendit, t organiz-mave ndrkombtare dhe me ak-tor t shoqris civile pr krijimine nj mjedisi t prshtatshm poli-tik, ligjor dhe institucional pr tsiguruar t drejta mbi pyllin prprdoruesit tradicional, shoqru-ar me fushata n media nprm-jet publikimeve n gazeta ko-mbtare dhe n gazetn JetoGjelbr (organ i prbashkt i Fed-

erats dhe organizats simotr nKosov) dhe nj dokumentardedikuar Pylltaris n Radio Televiz-ionin Shqiptar. Problemet dheshqetsimet e dala u jan prcjellinstitucioneve vendim-marrse dheorganizmave ndrkombtare.Nga diskutimet rezulton se pro-jektligji pr pyjet e kullotat ka pro-gres n drejtim t njohjes s pr-doruesve tradicional, t drejtstradicionale t prdorimit, njo-hjen e rolit t shoqats pr plani-fikimin e punimeve, normimin epuns s ekspertve dhe detyriminpr t emruar specialist pyjeshpr bashkit.Specialistt e pyjeve dhe publikui gjer jan shum t shqetsuarnga dmtimet dhe shfrytzimetbarbare praktikisht t pari-parueshme nga kontrabanda npyje, e mbshtetur nga politikadhe korrupsioni brenda sektorit.Shkatrrimi nuk ndodh tek pyjete fshatit por tek ata shtetror qkonsiderohen pa zot.

Reforma territorialekrkon q edhe n sektorin epyjeve t bhen prshtatjet e du-hura lidhur me organizimin e shr-bimit pyjor, t sektorve n terrendhe marrdhniet midis palve tinteresuara. Po ashtu, do t pr-shtaten edhe shoqatat e pr-doruesve t pyjeve e kullotave.

Duhet t sqarojm se kal-imi i pyjeve tek prdoruesit fshatdhe familje rurale sht njohje et drejts zakonore, t njohur qyshnga mesjeta me kanunin e LekDukagjinit, at t Labris dhe ka-nune t tjera vendore.

Krkohet hartimi i Planitt Prgjithshm t zhvillimit tPyjeve e kullotave, Strategjia dheligji i ri pr pyjet, por kryesore sh-t zbatimi i tyre dhe puna e Min-istris nuk matet me numrin eligjeve dhe udhzimeve q nxir-ren por me ruajtjen dhe prmir-simin e gjendjes s pyjeve e kullo-tave dhe shtimin e t ardhuraveprej tyre.

Kola: 'Family forest owners need to over-come about ten bureaucratic obstacles. First,going to the cadastre to get their ownershippapers. Then, making a request to the munici-pality for a harvest permit. After that, the treesthat will be allowed to be cut need to be markedby the forest agency and the volume of theharvest is determined. The forest agency willallow you only a certain period to transportyour wood.' Kola grumbles. 'As if they are say-ing: your life is in our hands.'Board member Arno Willems is also joiningour "road trip" and adds: 'The government hasa monopoly on the forest management andprovides permits as a favour. The private forestowners in principle should not need to requirea permit. In the Netherlands they are allowedto decide themselves how to manage their for-est, as long as it happens sustainably.'Farmer Gasper has practical experience withthe stubborn system. After he dressed in a brightorange outfit demonstrated how to cut a treesafely (no unnecessary luxury in a country inwhich farmers still die during tree harvests), hesays: 'Each year it takes me about ten days to geta permit.You have to explain when you intend to carryout the harvest, but if the forest agency special-ist does not show up, you have to start all overagain. Even for the use of biomass, the woodwaste from harvest, I have to request a permit.And I have to pay for all of this too.' He sighs.'Without all those procedures I would be ableto use the forest much better. If this doesn'tchange, one day I will quit.'Farmers try to get around the system. For ex-ample, to cut more than is allowed. This can bedone by bribing an official, or secretly harvest-ing at the weekend. This is risky, if caught, thefines are not small, knows Azem Teneqja. To-gether with a companion he loads wood in atruck. On his sweater in big letters it is written'Free Style'. 'This year I have been caught twotimes already. special history: during the Kosovo-war he was asniper in the Kosovo Liberation Army andfought against the Serbs who came to plunderthe villages. 'Now I am fighting my second bat-tle, he says. 'Only this time not with arms, butwith words.'With a great feeling for dramatics he explainshow he started this second 'battle'. 'In 2003 theUN designed the legislation in Kosovo. Theydid not understand anything of our forests. Thefarmers were not happy, but the governmentsaid: 'it is better to have any law than no law atall.' Unsatisfied with the process, he establishedan association and went to the department offorestry. He needed to wait there for three hoursto receive the following answer: "Dear boy, wehave a lot of qualified and experienced people.Do you think we cannot carry out our jobsproperly?"'While he shuffles the already cold food insidehis mouth, he tells how he finally came to SNVin Albania, where lobbying at national levelhas already taken place for some time. Fromthat moment on they cooperated closely to buildlocal forest associations. 'We are no longer asmall group of people: we have 16 associationsat municipal level that are joint in the nationalassociation. They received a voice. That is thestrength of CNVP/SNV. Through organisedmeetings, the authorities, associations and farm-ers got to know each other, and by showinggood examples from our projects, we are gain-ing respect. The government suddenly startedasking what we thought about their proposals.In the past I had to wait for three hours, nowa-days I can phone and say: "I am coming to youroffice".''Before we were cutting down the best trees,now we leave them. It feels as if I am working inmy own garden'Currently Gashi is sitting at the table with thegovernment discussing and designing a newforest law. 'They are looking at us: what is youropinion?' Among other things, Gashi managedto enable farmers to make use of private forestenterprises to a limited extend, instead of hav-ing the whole forest management controlled bythe government. The new law can radicallychange things, beliefs Gashi. Are all problemssolved then? Gashi laughs. 'It would be possi-ble, on the Balkans everything goes in extremes.'But then he makes a serious remark: 'We're notthere yet, but we are making steps in the rightdirection.'

A visit to Kukes,just across the border in Albania, where CNVPworks with user-rights, is on the programme.While the car drives over the small roads in themountainous landscape, Isuf Omuri fromCNVP Albania gives a concise history lesson.Traditionally farmers in Albania marked theirland with white stones. They did not registertheir land to avoid paying taxes. During thecommunist regime which came to power in1944, the government usurped all the land. Af-ter the collapse of communism in 1992 the newgovernment promised that the farmers wouldget their land back in use, but this promise isnot completely granted yet. The farmers start-ed, however, protecting the forest lands, basedon the century old borders, but unsecure re-garding forest management because they fearthat the forest will later on be taken away again.With support from SNV and later on fromCNVP, 60 percent (more than 500,000 hectares)of all forests are given to the local governmentas communal forests and 250 forest users' asso-ciations are established. The next step is: indi-vidual user-rights for the farmers themselves.

One can imagine a cosier meeting place than inthe middle of a big curve in the road, but still itappears to be a perfect location for a conversa-tion. Seven farmers have gathered. Only a fewchestnut trees are visible in the mist. Especiallyhere the farmers depend on those chestnut treesfor their livelihood. In Kukes, the local forestassociation with support from CNVP helped 30farmer families to obtain their individual user-rights. GPS-experts mapped the land and inconsultation with the community the borderswere defined.The family forest farmers proudly show theirdocuments: files with about twenty pages oftext, signatures and maps. 'Look', points Omuri.'Those are the signatures of the neighbours.And here, those of the spouses of the farmers,to assure their rights also.' The coordinates ofthe land are precisely indicated, visualised on amap using Google Maps.What makes the difference having such a doc-ument? 'I have much more power now' an-swers the farmer Behar Halili. 'I feel more con-fident because I have a legal document.' Farm-er Avdyl Meta also approaches. 'I now feel se-cure to make investments. Before we didn't lookafter the forests very well, because we did notknow who it belonged to, actually. We werecutting the best trees. Now we leave those. Itfeels as if I am working in my own garden.'Farmer Hasan Hasani is not yet completelyhappy. 'We only have it in use for fifty years,but we want to have it as our own property,because it was the property of our ancestors. Ido not trust the government, we have had badexperiences.' The other farmers smile and nod;they all know that feeling.

Besides the30 farmers in this village, in total more than 600farmers have officially identified their user-rights. With over 200,000 farmers left it is still along road to go. The aim is to ensure that thelocal forest associations will take over this pro-cess themselves in the future, since CNVP hasprovided the example in Kukes. Not only re-garding the user-rights in Albania: eventuallyall CNVP-projects need to be taken over by theassociations. Similarly to continuing the SNV-programme by CNVP, in time the associationswill continue the work of CNVP. The ball ofsustainability keeps rolling.

This requires financial sustainability. Howev-er, the associations are still very dependent onprojects. As Agron Nikqi, a chairperson of alocal forest associations, argues: 'If CNVP left

now, everything would collapse like a house ofcards. We have to learn better how to generatefunds and how to gain income through ourservice provision, such as training or biomassproduction.' Peter Kampen acknowledges thischallenge. Therefore CNVP cooperates with theforest associations to enable them to raise suffi-cient revenues to be independent and stand ontheir own feet for at least 50%.This does not happen overnight. 'Trees needtwenty to more than one hundred years to growcompletely. Only then you can see the result; inagriculture after sowing you have the result inone season. Anyway, adds Kampen, who alreadyat the age of six knew that he wanted to do some-thing with forest management: 'I am a forester. Ido not think in two years' time, but in decades.'

This is how MichelFarkas, Managing Director, CFO from SNVand Chairperson from CNVP, likes to call thespin-off of CNVP 'There is an attempt for some-thing to stay behind when you close down theprogramme. You are working for sustainabledevelopment. CNVP shows that a project cancontinue when the mother organisation leaves.'For SNV it was quite convenient that there wasa team willing to continue. The contracts withSida were ongoing till 2014. Nevertheless, wemade a careful consideration beforehand. Far-kas: 'You still want to have quality assured. If itfails, it will reflect upon us as well.' But therewas sufficient trust in the CNVP-team and thattrust existed with Sida which was willing to transferthe SNV-contracts to CNVP.Kampen has no difficulty indicating the key areasof CNVP's success. A good track record, a longhistory and probably most important of all: acommitted team which as Kampen claims 'is aproven and experienced team you can really buildon'.Board member Maarten Bremer, who was SNVRegional Director for the Balkans from 2003 till2006, also praises the team factor. 'They all waivedtheir severance pay, for some of them this went toas much as a one-and-a half year's salary. It wasuncertain if there would be a follow up, when theSida-contracts ended but they took the risk. Andthat is quite special.'

changed in their work, and the answer invariablyis that regarding the content nothing changed, butthat the organisation became much more flexibleand able to adapt to circumstances. Kampen:'SNV is a large corporate organisation. You spenda lot of time discussing what happens in Africa orAsia and if you need to focus on education, gov-ernance or water. For me this was not very inter-esting, because we knew clearly that we wanted tocontinue with forestry.'From 2009 onward forestry was no longer themain sector and the activities needed to be har-monised within renewable energy. 'At a certainmoment that became a straitjacket. Therefore, wewere thinking of demerging from SNV even be-fore SNV decided to leave. When SNV left theBalkans our business plans were already on thetable.' CNVP is now able to develop its activitiesfrom a forestry perspective much better. The fol-low up subsidies from Sida would not have beenobtained if the programme was still under SNV,since the projects are not fitting within SNV's cur-rent priorities.The relations with SNV, nevertheless remained al-ways good, as witnessed by the SNV-people beingpart of the board, and because CNVP positions itselfdeliberately as an SNV legacy organisation. 'CNVPwould not be possible with SNV. Up to 2009 we wereproud to be SNV', says Kampen.Bremer nods. 'I like the idea. SNV has built thecapacity of CNVP and CNVP builds on its turn thecapacity of local forest associations. For me this is thecore of development cooperation: building capacityinstead of flying in and leaving.'Another change compared to the SNV-time is theincreased feeling of ownership, comments Ka-mpen. 'We are smaller and therefore staff is moreengaged. If it goes wrong, there is not a largeorganisation behind you, we, are responsible our-selves.'

Farkas notices that, since there is no fixedfinancing from the Ministry of Foreign Affairs ofThe Netherlands anymore, SNV-organisations arefundraising themselves and become more cre-ative and focused. Some teams could within acouple of years stand on their own feet. But, addsKampen: 'a sense of urgency is needed to give ateam this last push. The urgency could be createdby saying: you still have a year with SNV, make abusiness plan.' Bremer thinks this is an interestingidea. 'In this way SNV could see its role in beingable to move out and leave something behind.'Is SNV currently engaged with this? Farkas is hon-est: 'The last two years SNV's business model wasfocussed more on gaining support from donors,rather than the question of how you could make aproject independent. Ensure that you can survive,to be able to hand it over later. If we know the traitsof our business model well and understand howwe can maintain support from donors, I do notexclude the possibility that in the future we wouldapply the strategy more often to create indepen-dent organisations.'Should a spin off like this be repeated elsewhere,there are at least several essential aspects that needto be ensured. In Kampen's opinion it is impor-tant that you have a solid programme which hadtime and space to experiment and develop. Andyou have to be sure that the idea comes from thepeople themselves, that there is good leadershipand an entrepreneurial team, adds Farkas. 'A soft,people oriented approach, really.'And with this we are back at the most crucialfactor, the human factor. This was probablybest expressed by Bashkim Gashi during ourfield visit. 'CNVP or SNV, these are just letters.CNVP to me is Peter Kampen. I trust Peter, Ihave trust in Haki Kola. They will never let usdown.'
