Don Sheasby (66) and Lorna Quintonhave been fighting a three-year battlewith the City of Cape Town’s valua-

tions department.Problems of incorrect land-use code and

valuations have afflicted their two adjacentproperties – number 27 and 29 in FarnworthStreet, Rugby.One of their biggest qualms – the fact that

number 27 was incorrectly categorised as“informal residential” – will now be re-solved, according to Ian Neilson, MayoralCommittee member for Fnance.“The property in question has been in-

spected and the usage will be amended tocontiguous vacant land,” confirms Neilson.This follows on years of headaches by

Sheasby in particular.When he found out the property’s use code

changed from vacant land to informal resi-dential he toldTygerBurger that there is “nosuch wording as informal residential”.

EffectsSaid Sheasby: “So they’ve sucked that out

of their thumbs, but now the thing is they’vechanged that existing use from vacant landto informal residential, without informingus. It was only when I went on to the websiteand dug around and found it. They haven’tadvised us that they’ve changed it or whateffect it will have on valuations.”Neilson explains however: “Properties

zoned as informal residential means thatthere are shacks or wendy houses withouta foundation, plumbing and electrics on astandard residential plot. Erf 138927(number 27) has two storage containers onit. The vacant erf is being used as a garden(as if it is part of the one with improve-

ments). Because the vacant erf is being usedas if it is part of the one with improvements,its use codewill be changed.This enables theBillingSection in theCity’sRevenueDepart-ment to bill both erven as if they are one resi-dential erf...”

Wrong codeThe issue of an incorrect use code is just

one of many Sheasby and Quinton have toface. They’ve been living in the house (builtin 1912) for 25 years and subdivided oneproperty into two in 2008.Up until that point they paid rates on the

whole property,whichwas zoned as residen-tial.“This is where things went totally hay-

wire!Whenwe did not receive an evaluationfor number 27 in 2009 we objected to coun-cil,” he added.

When Sheasbywent on to the council’s val-uations website he discovered that therewere apparently many factually incorrectdata.“They showed it was built in 1948. The

number of rooms and the size of the roomswere also wrong. They even gave us fivebathrooms! The outbuildings were alsowrong... they just about got everythingwrong!We actually submitted seven differ-ent objections.”Even though the initial propertywas reg-

istered to both Sheasby and Quinton, thesubdivision resulted in Sheasby “owning”number 29 and Quinton “owning” number27.Another big dilemma for Sheasby is the

fact that the valuations for the two proper-ties have gone up by 40 % and 38 % respec-tively.

Open erf“The valuation of number 27 has in-

creased by 38 %. Its value is determined byother properties in the area, but all thesehouses have structures on them. How cana property with a house’s value affect thevalue of an open erf?” asked Sheasby.Neilson states, however, that properties

are all valued based on sales of similarproperties.“Thus, vacant erven are valued based on

sales of similar vacant erven, and residen-tial dwellings are valued based on sales ofsimilar residential dwellings,”he explains.Sheasby also questioned why the valua-

tionof number 29 is apparently beingdeter-mined by another property of similar sizein the areawith a house on it that was builtin 1976, a full 64-years after his and Quin-ton’s house.Responds Neilson: “The City is satisfied

that all necessary factors are considered inthe valuations process. If the complainantis unhappy about his valuation he canlodge an objection before 30 April. No lateobjections will be accepted.”

Market valueNeilson concludes: “As per the relevant

national legislation, the city is required tovalue properties at ‘market value’. Marketvalue is defined as ‘the amount the proper-ty would have realised if sold on the dateof valuation in theopenmarket byawillingseller to a willing buyer’. In order to deter-mine themarket value of properties’ actualsales that have taken place around the dateof valuation, 1 July 2012 as registered in theDeeds Office is used as a basis. The salesinformation together with the attributes ofthe property (size, number of rooms, etc.)are used by the CAMA (Computer-AssistedMass Appraisal) system to perform valua-tions on all registered properties. Once thevalues have been generated by the CAMAsystem the valuers review the values of theproperties in their region and either acceptthe value generated by the model or over-ride thevalue if theybelieve that it is eithertoo high or too low.”

Lizelle and Russell Muller (and their 13­month­old baby) had to face a terrible ordeal whenarmed men entered their Sunningdale homethis weekend. Russell was shot twice and alsostabbed, but thankfully he is recovering inhospital.

Every time he screams of the pain and ex-claims that he’s going to die she holds hermother even tighter.

While Russell Muller (29) battles with theagony that several stab wounds and two bul-lets caused, his wife Lizelle (26) is racing to-wards the Blaauwberg Netcare Hospitalwith Casey clinging to her neck.

The couple were attacked by two armedsuspects in their Sunningdale home Fridayat midnight.

While Russell tried to protect his familyhe was shot and stabbed, and still he had thestrength to pick up the two perpetrators si-multaneously and throw them out the frontdoor.

Russell is in a stable condition in the ICU.TygerBurger talked to the traumatised

Lizelle on Monday while she was at the hos-pital. Her tale sends shivers down the spine.

“We were all at my dad’s 60th birthday inBig Bay on Friday evening and then we left

at about 11:55. We live only five minutesaway. I drove us homewhileRussell held thesleeping Casey. When we pulled up to thehouse our daughter was upset, so Russelltried to put her to bed and Iwent to the kitch-en to get some water in her bottle. As I tookthe cap off I heard footsteps behind me...When I turned around I saw a man standingin the door... I just said ‘No, no, no, no, no’...”

According to Lizelle the man (who wascarrying a knife-like garden stabbing tool)held a crooked finger to his mouth and ges-tured for her to be quiet.

This threat, however, wasn’t enough tokeep Lizelle from screaming.

She continues: “The second guy then camethrough the door, cocked his gun and point-ed it straight at me... I just kept on focusingon the bashed-up gun.”

After Russell heard his wife scream hecame “flying down” the passage and Lizelleducked into the scullery to hide.

The soundsof tumult, six gunshots and thebaby screaming in the background fed herimagination and adrenalise – her worstfears were blossoming before her.

Says Lizelle: “He kicked one of the thugs

in the chest and jumped in top of him. Withone hand he tried to strangle the guy andwith the other he grappled with the gun. Itwas just waving around everywhere. Thatwas when he got shot in his shoulder.

“Then the second guy started stabbinghim from the back and Russell was shot asecond time in his thigh. I don’t knowwherehe got the strength, but Russell then pickedup both of the men and threw them out ofthe house.”

Lizelle soon discovered that the men stoleone of their two cellphones, but she couldn’tfind the other to phone the police.

The adrenaline-fuelled Russell just pacedup and down and exclaimed repeatedly thathe had been shot.

Lizelle gotCaseyand then raced to thehos-pital with the panic-stricken Russell.

Since the incident on Friday she has livedin a daze. The extreme trauma has her in avice-like grip.

God willing, Russell will recover com-pletely, but one suspects it might take muchlonger for the family’s psychological scarsto heal.

Lizelle concludes: “That’s what I hate

them for. They’ve made me scared of every-thing. I can’t be on my own, I can’t drive...And I was an independent person...”

Op Oujaarsaand van 2011 het oom Han-nes stoksielalleen in sy kamer sit en dinkaan die ou dae.

“Al die eensames wie se kinders verwoon, sit maar só en dink,” sê hy.

Dit is tóé dat hy besluit dit is heeltemalonnodig om só alleen te sit.

Wat hy volgende gedoen het, het verrei-kende gevolge gehad. Nie net in sy lewe nie,maar in ’n hele klomp inwoners se lewens.

Oom Hannes is na die gemeenskaplikesitkamer by die dienstak, waar hy vir diesuster gevra het om af te kondig almal watalleen voel, moet in die sitkamer bymekaarkom.

“Ek het gedink ons kanmos lekker saam-sing, eerder as wat elkeen só op sy eie sit.”

Minute later het oom Hannes se moedhom amper begewe. “Ek het gewonder watmy besiel het, want ek kan nie eens klavierspeel nie.”

Hy het tannie Connie Thiart, oud-mu-siekjuffrou, wat 30 jaarmusiek gegee en ko-re afgerig het, gebel vir hulp.

OomHannes het so ses tot agt mense ver-wag, maar 36 inwoners het hul opwagtinggemaak.

“Ons het lekker gesing en nog ’n paar hetselfs gedans,” sê oom Hannes.

Oom Hannes, wat hou van gedigte skryf,het verskeie liedjies geskryf, wat tannieConnie getoonset het – selfs een getiteldOns Tuiste.

After receiving numerous complaintsover the past few weeks, TygerBurgercame to the conclusion that the

number of people parking in disabled park-ingbayswithout the requiredpermits seemsto upset locals and disabled people alike.This has been an ongoing problem but

prominent shopping malls in the area claimthey are dealing with the issue.TygerBurger recently received a com-

plaint about an incident at the De’VilleShopping Centre in Dur-banville from SanetMulder. Sanet took a photoof a black BMW parkedacross both the disabledand parents’ parking bays.“I asked the woman whyshe parked there andacross both the specialparking lots. She thenraised her voice and said ‘Iwas only five minutes;that’s why I parked here’,’’explains Sanet. The wom-an then allegedly verballyabused Sanet in front ofher young girl.

gerBurger a photo of a po-lice vehicle parked in aloading bay at N1 CityMall. “The lady in the pas-senger seat (of the police vehicle) tried herbest to hide when the photograph was tak-en,” explains Vernon Wucherpfennig whotook the photo.Needless to say, disabled people them-

selves are also upset by this flippant behav-iour. “It aggravates and upsets me,” com-ments a disabled Edgemead resident on theillegal parkers. “It all comes down to respectand what they’re saying to disabled peopleis that they simply don’t respect us.”Another Goodwood resident said: “People

shouldn’t judge. Not everyone who needs topark in a disabled parking space is disabled.I have a heart condition and can’t walk fardistances without having an angina attack.People don’t realise how important that clos-er bay is to me.”

“It is inconsiderate and disrespectful to-wards us,” a disabled shopper from CanalWalk told TygerBurger, “The bays are de-signed to be larger to make it easier to getin and out of our cars without knockingsomeone else’s car.”When asked, shopping centres admitted to

receiving complaints from customers aboutillegal parkings. Vanessa Herbst fromCanalWalk explained that they have security andparking staff monitoring their special bayson a daily basis. “We are in the process ofinvestigating ways to improve and enhance

the disabled and aged park-ing,” added Vanessa.

Blanche aired a story “Circus Elephants”,exposing animal cruelty at the BrianBoswell Circus where the elephants were al-legedly being beaten behind the scenes.TheMcLaren Circus has been stationed at

the Jan Burger Sport Complex in ParowNorth for the past two weeks and have justextended their stay here for a third week,due to the popularity of the circus.During the peaceful protest held on Satur-

day against the use of animals by theMcLaren Circus, the protesters were allspread out on the corners of McIntyre andDe Grendel Road, armed with posters withanti-cruelty messages printed and writtenon them.Some even had black stripes painted on

their faces and a few were chained to eachother and to the robot poles.Theywere shouting “Stop animal abuse in

circus!” and “Free the animals!” among oth-ers. Some protesters also handed out pam-phlets stating that the circus is the saddestshow on earth and cruelty is not entertain-ment.Although the protesters did not disrupt

the traffic, members of the local police pa-trolled the area.NikkiElliott, founder of theNo toAnimals

in Circuses and Captivity Facebook groupand protest organiser, says the use of ani-mals in circuses is one of the biggest atroci-ties today. “Supporters of the circus supportcruelty to animals,” she says.Elliott, who stated that the anti animal

cruelty group protests at every single circusall over Cape Town, said this was a legal pro-test.“Animals bred in domestically have more

instinct than others. These are all still wildanimals. Imagine putting your pets, your do-mesticated cats in cages at home. These arewild animals and they should not be caged,”says Elliott.Mari Horne, a No to Animals in Circuses

and Captivity Facebook groupmember, ani-mal welfare activist and animal foster car-egiver, says SouthAfrica is our heritage andour animals too.“We convey the message to keep our ani-

mals free and safe like the rhinos, but yet weare still giving out the wrong message thatit is okay to keep animals in cages. Manycountries around theworld have banned theuse of animals in circuses. We have had somuch change in this country, so why stillthis?” asks Horne.“Usinganimals for entertainment is cruel.

Many countries have banned the use of ani-mals in circuses and I think it is time we fol-low suit,” says Renata Harper, another Noto Animals in Circuses and Captivity groupmember.“As a parent I don’t want to explain to my

kids that we are animal lovers, but yet wedo these things or we allow it to happen toour animals,” says Lauren Doyle.Natalie Sadie and Elzette Lategan, both

group members, chained themselves to thetraffic light pole in protest against the ani-mals being caged and used in circuses.“Animals don’t belong in cages. They suf-

fer greatly. There are sanctuaries for them.We are their voices,” says Sadie. “This slav-ery must end,” shouted Lategan in outrageagainst animal cruelty.“I don’t believe that animals should be

used for entertainment. Circuses havemanyother acts with humans, why use animals?

We are sending out the wrong message toour children. Instead of teaching themabouta loving, caring and sharing relationshipwith animals, we teach them one of domi-nance and power,” says Dion Fuller.According to councillor Leonore Van der

Walt, who observed the protest on Saturday,the general feeling among the protesters isthat the animals are being abused in orderto teach them their circus acts.“I share their grievances about animals

being used in circuses, which I have person-ally witnessed before.“However, some of the protesters seemed

to have no knowledge about the McLarenCircus. One of the protesters was very un-happyabout the elephants beingusedby thiscircus. The McLaren Circus does not haveelephants,” she says.“My observation of the animals at the

McLaren Circus is that they are all happyandwell cared for. I have receivednumerousvet reports to support this.”Arnold Dickson, manager of the McLaren

Circus, says they are used to these kinds ofprotests: “There were less than 100 protest-ers in total, and yet we have sold out showsalmost every day with about 5 000 people.”

Golden Arrow Bus Services has extended itssincere apologies to all commuters who havebeen adversely affected by the ongoing na-tional bus strike.

Bus operator Golden Arrow said in a state-ment on SABC’s website on Sunday 28 April,its services in the Cape Peninsula will re-main suspended this week. “This follows adeadlock in wage talks between trade union,the South African Transport and AlliedWorkers Union and management,” read thestatement.

The union wants a 13 % wage hike while

management is offering 7,5 %.Spokesperson Bronwen Dyke says that un-

fortunately Golden Arrow is not in a positionto unlock the current situation as the SouthAfrican Road Passengers Bargaining Coun-cil (SARPBAC) comprises two employer as-sociations and two unions representing theentire South African bus industry. “Thereare no winners in this situation, as passen-gers are inconvenienced, staff members arenot receiving wages, the company is not oper-ating and the entire economy is suffering,”she said.

Bus Services apologise for delays

Golden Arrow Bus Services’ applica-tion against MEC for Transport andPublic Works, Robin Carlisle, and

two companies operating existing interimMyCiTi services was recently dismissedwith costs in the High Court.

The City of Cape Town roundly welcomedthe judgement in the case, since it threat-ened to halt the further expansion of MyCi-Ti services.

“This is wonderful news for the people ofCape Town. It means that current negotia-tions for long-term contracts to operate ex-isting MyCiTi routes, as well as those in therest of Phase 1A and Phase 1B, can continueand those contracts can be concluded. Im-portantly, this ruling allows us to imple-ment our vision of affordable and integrat-ed public transport for all the residents ofCape Town,” said mayoral committee mem-ber for transport, roads and stormwater,Brett Herron.

Golden Arrow Bus Services, which is alsoan operator of existing MyCiTi services inPhase 1A, applied to the court to compel thecity to enter into a mediation and arbitra-tion process around areas of dispute, andto prevent the city from going ahead and ne-gotiating and concluding a 12-year contractin terms of the National Land TransportAct (NLTA) to operate MyCiTi routes inPhase 1A and Phase 1B.

The judge said that the process of estab-lishing an Integrated Public Transport Net-work was “extremely complex”. He found

that compulsory arbitration and mediationwhere parties could not reach agreementwas “inappropriate”.

“If the city were obliged to reach consen-sus on every issue and with every partici-pant in the process, failing which it couldbe compelled to go to mediation and arbitra-tion, it could become endlessly boggeddown,” the judge said when handing downhis judgement.

Being compelled to a process of media-tion and arbitration would make it impossi-ble for the city to fulfil its statutory man-date, as required by the NLTA, to take steps“as soon as possible” to integrate servicesinto the larger public transport system.

The judgement said that the relevant sec-tion of the NLTA meant a contracting au-thority, such as the city, was obliged to ne-gotiate but was not obliged to agree.

Golden Arrow’s application to compel thecity to negotiate in good faith was also dis-missed. The judge said that the allegationthat the city did not negotiate in good faithwas a strong allegation, which impliedfraud or dishonesty.

He found that the city was not obliged bysection 41 of the NLTA to negotiate withGolden Arrow Bus Services about compen-sation for its vehicles and assets whichwould be made redundant by Phase 1A andB.

The city has not refused these negotia-tions at all, but the parties have negotiatedto deadlock on these issues.

Probleem lêby geweld wat‘cool’ isDie afgelope paar weke is daar ’n warmdebat in TygerBurger se briewebladgevoer rondom die kwessie van doodstraf.

Aan die een kant het die voorstandersbeweer misdaad is wel laer in lande waardie doodstraf geld. Hulle argumenteer datdié misdadigers moet besef hul grudadehet gevolge. Van hierdie mense is selfdirek geraak deur “halsmisdade”, soosmoord en verkragting.

Die ander kant het gesê doodstraf isonmenslik, dat ’n mens nie ’n lewe met’n lewe kan vergeld nie. Die meeste vanhulle het ook aangevoer die doodstraf isoneties, on-Bybels en on-Christelik.

Dit laat ’n mense wonder of misdaadnie aan die einde van die ketting gekeermoet word nie, maar aan die begin. Daarwaar ’n gesin kinders moet koester, ’nskool verder moet opvoed, maar ook waar’n samelewing moet ondersteun en liefhê.

Geweld is vandag heeltemal aanvaar-baar. In elke liewe fliek of TV-produksieis daar geweld, al is dit net ’n vuisslane-ry. Luister na musiek, kyk na rekenaar-speletjies, lees boeke, sien net hoe“harder” en gewelddadiger sport gewordhet. Hoe meer goed – en mense – opge-blaas en weggeskiet word, hoe meer bloedspuit en borrel, hoe beter. Dis vermaak-lik. Geweld is cool. En ons steun dit, regoor die wêreld waar oorloë woed, kinderskinders skiet, onskuldiges sneuwel aandie hand van “sagte mense”.

Sus ons ons gewete met die idee datons dit immers nie in die regte leweuitleef nie? Dit lyk tog of verskeie anderdalk nie dieselfde dissipline het nie.

his last fight.After the defence force as a

youngster, Graham startedworking as a doorman as wellas VIP close-protection secu-rity.Through this he was able to

learn many forms of martialarts, but still foundsomethingwas missing. That somethingwas soon found after hewatchedUFC1 and sawRoyceGracie submit his opponentsthat were much bigger than him withoutsustaining injury to himself. This was Gra-ham’s first introduction to the art of Brazil-

ian JiuJitsu.

MMA dojoIn the 90s, Graham started his first

school training in the art of street realitycombat in London. Hetrained up fighters thatcompeted for pro-tourna-ments on the British circuitreaching national level.“At the age of 45, I’mphys-

ically and mentally in theshape of my life. I have nev-er felt this good. I seemyselfas a martial artist not afighter. A fighter will stoptrainingwhenhe stops com-peting. A true martial art-ists never stops trainingeven if he knows he’s donecompeting,” said Graham.He has a busy schedule to

say the least. He is training 16 times aweek, with anything between two andfour classes daily at his Leviathans Den

dojo in Durbanville.“A lot of thought has gone into this massive

decision. I’m not done yet, far from it. I reallyfeel my best is still ahead of me. I think itwould be arrogant of me to step into the EFCring for my first fight. I need to get the ringrust off.“That’s why I decided to compete in a pro-
